1.1 Summary of Current Month’s Progress
Physical Progress Summary:-
Physical and financial progress as on the month of December 2016 is as follows:-Monthly progress report (MPR) from October- 2012 to December 2016 had not been submitted by the Concessionaire. Concessionaire hasreported only physical and financial progress for the month of December 2016. The physical progress as assessed by IE is as follows:

Concessionaire’s work program is not satisfactory despite 100% obstruction free land are available in both structure and road work. Betterprogress can be achieved by good planning and expeditious deployment of adequate resources. Construction activities came to standstill in allthe fronts since last July 2012 and as a result, Project Milestone – I, ll & lII based on revised Appointed date as 15th September 2012 had notbeen achieved by Concessionaire apart from breach of Maintenance requirements of the ECW resulting issue of an “Intention to issue aTermination Notice” vide Authority letter no: NHAI/HQ/Tech/KL/2011/98 dated 30.04.2014.
After restructuring the term loan, Concessionaire had resumed the project activities w.e.f 7th Oct 2014 with commencing the nominal activities atroad and structure work apart from entering upon the tunnel from entry and exit approaches.
Though the Project work was resumed from Oct 2014, the pace of progress was not upto the mark and project activities have been haltedintermittently resulting conducting a meeting with the Concessionaire and IE at NHAI HQ on 20th May 2015, 30th Nov 2015 and 1st Feb 2016emphasizing the Concessionaire to mobilize adequate resources and to demonstrate their capability to establish that Concessionaire couldcomplete the Project by 31.03.2017.
Therefore, due to the concurrent delay by both parties for the reasons broadly brought out by IE in its recommendation for 1st interim EOT, EOTin Construction period without damages and without extension in the Concession Period has been approved by Executive committee of NHAI inits 283rd meeting held on 25.05.2016 by duly rescheduling the milestones and SPCD from 17.03.2015 to 31.03.2017 for which Concessionaireshall not claim any cost overrun or any time overrun (Concession Period) due to restructuring of milestones. With respect to the restructuredmilestones, Concessionaire has achieved the milestones I & II within the cure period. Concessionaire has not achieved the 3rd milestone falls on11.11.2016. However, there is a cure period available for 90 days.
On approval EOT, Concessionaire had raised 1st and 2nd tranche Grant proposal after infusing their equity and debt disbursal as per debtequity ratio and as certified by the Statutory Auditor. The same was released by the Authority. Further, Concessionaire has raised 2nd & 3rd
Tranche grant in the month of Oct 2016. In view of approval of EOT on construction period, notice regarding an “Intention to issue aTermination Notice” vide Authority letter no: NHAI/HQ/Tech/KL/2011/98 dated 30.04.2014 stands invalid.

Summary of Progress – [DECEMBER, 2016]:

SurveyConcessionaire has commenced control points checking and center line markings and concessionaire has re-established center line chainagemarkings, Control points and TBMS shifted in regular intervals which are disturbed due to scarifying and maintenance of Existing carriageway.
Tunnel worksDrilling and blasting through left tube tunnel in D shape profile is in progress and achieved for about 1300 m. Following to this, Concessionaireshall require to undertake rock supporting work as proposed in the drawings. Similarly, treatment of vertical face of tunnel entry approach shallrequire to be done by the Concessionaire as proposed in the drawings to ensure stability of the cutting face.
Structure Work ProgressStructure work includes new construction of one major bridge, 2 flyovers, 10 underpasses, Up-gradation of one minor bridge and 87 culverts tobe widened or reconstructed as per site condition.
i) Cd Structures: 21 nos Box Culvert and 16nos Pipe Culvert completed and work in progress at 28 nos and 13 nos in Box and Pipe culvertsrespectively.
ii) Underpasses: Deck slab completed for underpass at Ch. 258+920 on LHS side, and Ch 261+830 on both sides. Wall lifts are in progress atCh 238+120 on LHS side, Ch 258+920 on RHS and Ch 262+240 on LHS.

iii) Flyover: Confirmatory boring for working piles are carried out for Flyover at Ch.262+707 and report has been submitted. All workingpiles for Mannuthy Flyover on both sides have been completed. Substructure, Girder casting & stressing works are in progress.Confirmatory bore hole work have been completed for flyover at Km. 237+035 and foundation , substructure Girder casting works are inprogress for few piers.
iv) Major Bridge: At Major Bridge Km. 247+170, 18 Nos. of foundations have been completed and substructure work, Girder casting,stressing & grouting works are in progress. 2 nos of deck slab completed.
v) Initial pile load test at one location has been done against the requirement of 2 nos. at Mannuthy flyover Km. 262+707 and test report afterconducting lateral load test is still awaited from Concessionaire.
vi) Minor Bridge: Excavation work is standstill on RHS side.
Contractor’s Work Programme:-After revising the Appointed Date as 15th September 2012, Concessionaire has again submitted the revised work program with SPCD as
March 2017.
Handing over of site:-NHAI has handed over 100% of ROW to Concessionaire including 86.86 Ha. of existing ROW and 13.95 Ha. of forest land during the
month of May 2013.Please refer NHAI letter No. – NHAI/PD/Palakkad/NH47/BOT/KL-3/HOL/784A dt. 31st May 2013. Details of land handedover to Concessionaire are given below:-Total land required for the Project – 181.122 Ha.Total land acquired by NHAI – 181.122 Ha. (100%)Total land free from Occupation – 181.122 Ha.(100%).Forest land acquired – 13.95 Ha.Existing ROW – 86.86 Ha.
Even though the joint inspection has been made regarding land availability as per Clause 10.3 of CA, the Memorandum and Appendix hasnot been signed by Concessionaire since May 2011.

Shifting of utilities
Even site clearance and dismantling of the structures within the acquired ROW had been completed by NHAI about 3 years before forentire stretch, still electric poles for 2 km length to be shifted. Revised estimate under Palakkad district have already been approved. Revisedestimate for Electric line shifting for Pattikkad division under Thrissur District has been approved. Concessionaire is still to initiate action forshifting the water supply lines at Thrissur and Palakkad District.
Forest clearance and removal of trees:-
MOEF stage 2 clearance (Final clearance) has been received on 14thMay 2013. Trees other than forest area from existing ROW havebeen almost felled down.
Design Review:-
Highway:GFC drawing of Plan and Profile for the entire stretch i.e. from Ch.236+135 to Ch. 264+410 has been issued except Ch.247+000 to
Ch.249+900 & Ch. 250+750 – Ch. 251+200. GFC drawing forService Road Plan & Profile has also been issuedexcept Ch. 236+135 – Ch.237+000, Ch. 249+450 – Ch. 250+200(LHS) and Ch. 249+450 – Ch. 254+000(RHS) and balance Plan and Profile of Service Road andDrainage Plan comments has been issued.
Structure:
The designs for Flyover at Ch. 262+707 and at Ch. 237+035 are reviewed. The design for Major Bridge at Ch. 247+170 is reviewed. Pilefoundation design calculations has been reviewed by IE and concessionaire was advised to go ahead with casting of 2no’s of initial pile forinitial pile load test at each flyover location in order to ascertain the pile capacity. The design for Minor Bridge at Ch. 241+166 for newconstruction on RHS is reviewed and for widening on LHS is reviewed and comments issued. The design for Underpass at Ch. 236+320, Ch.238+120, Ch. 258+920, Ch. 261+830 and 262+240 are reviewed. GFC for foundation, substructure and superstructure issued for Flyover at Ch.237+035 & Ch. 262+707. GFC for new construction of Minor Bridge at Ch. 241+166 issued and for Major Bridge at Ch. 247+170 are issued.GFC for 75 Nos. of Culverts issued. GFC for underpasses at Ch. 236+320,Ch. 238+120, Ch. 258+920, Ch. 261+830 and Ch. 262+240 areissued. Concessionaire has proposed for revision in design of flyover Ch. 237+035 with open foundation and revising the span arrangement ofalready reviewed drawings. Subsequently, the revised design/ drawing submission and review is in final stage.

Quality and Material Status
As on date 5 No’s of borrow areas have been reviewed for using in road embankment construction and out of which schedule - E permit for 3Nos of Borrow Area were not yet obtained.
i) As on date, 4 Nos. of Brand of cement viz Chettinad, Penna, Ultra Tech, Dalmia have been approved for use in the Project Highway.ii) Source for Fine and Coarse Aggregate from km.291+000 (RHS) at Perambra had been approved.
iii) Concrete Trial mix design on M15, M25, using Chettinad, Penna, and Ultra Tech cement had been approved.iv) Concrete Trial mix design on M15, M20, M20(Kerb), M25, M35 (RCC),M35(REB), M35 (Pile) & M45 for PSC girders using Dalmia
cement have been carried out.v) Concrete mix design for all grades of concrete for the change in source of aggregate is in progress
vi) GSB Mix Design carried out from the source Perambra Quarry km.291+000 (RHS)had been approved by IE.vii) WMM Mix Design carried out from the source Perambra Quarry km.291+000 (RHS)had been approved by IE.
viii) SAIL, RINL Vizag, TISCO have been approved as source for sourcing steel reinforcement for Project Highway.ix) Source approval for NP4 class RCC Hume Pipe also given for sourcing the pipe for pipe culvert work.x) This is required for socketing the pile/resting the raft foundation in the required strata strength. Concessionaire was also instructed to
perform bore hole investigation in the approaches of structure as the same was not done earlier.xi) Subsoil investigation at 27 Nos. of box culvert locations has been Completed and SBC reports have not yet submitted by the
concessionaire.xii) QAP of the project approved by IE for those items of work submitted.
Current Issues & Recommended Actions by IE:
DEFECTS / DEFICIENCIES IN WORK:
Existing Carriageway (ECW) of Project Highway has not been maintained for traffic worthy condition at certain stretches and the ridingquality is poor.
Even though Concessionaire has taken up road formation work at several stretches as well as structures, adequate work zone safetymeasures has not been provided till date which is posing threat to the road users and the same was brought out in the Audit Report of NHAI’sRoad Safety Consultant.
As per the final reviewed drawings of RCC Box culverts, the SBC at the founding level shall be confirmed prior to execution. But,Concessionaire has proceeded with the works of culverts even where strata at founding level is clayey, without confirming SBC and complyingwith the NCR raised by IE.

Concessionaire has executed all working piles in arbitrary manner even without completing the Initial pile load tests at the balance 1 nos of Testpile and without submitting the report where test done to confirm the design capacity of pile. Concessionaire is continuing with the casting ofpilecap and raising the super structure at mannuthy flyover Km 262+707 without conducting routine pile load test on working pile to confirm thesafe load carrying capacity of piles. Similarly, Concessionaire has cast all piles (16 nos) at Major bridge (P1 LHS) without submitting therevised drawing and confirming the pile capacity through initial pile load test on test pile. This is not acceptable to IE as this does not conform toGood Industry practices.
Concessionaire has carried out embankment widening at certain stretches of water logged areas without submitting a methodology and adoptingthe proper foundation improvement as per Mo RT&H specs despite issuing a NCR. This is liable for pavement failure in future.
Concessionaire continues to execute the RE wall foundation at Mannuthy stretch without adhering to the system provider recommendations andwithout checking available SBC at site.
Concessionaire is continuing with the construction of lined drain without providing weep holes at the GSB bottom despite issuing NCR. Thiswould pose pavement failure in future due to lack of pavement sub- surface drainage.
Concessionaire continues to carry out the backfilling with filter media behind box & pipe culverts in a stroke without compacting in layers evenafter NCR issued, which is liable for pavement settlement and posing threat to the safety of road users.

1.10 Monitoring of Operations & Maintenance Obligations
1.10.1 Maintenance Status during Construction Phase
Maintenance of existing road:-Concessionaire shall require to take up immediately the cleaning of all Existing Row chocked drain and
CD structures to prevent entry of rain water over carriageway in the forthcoming monsoon. Concessionaireshall also ensure for smooth natural drainage of surface and subsurface water during the monsoon at thosestretches where widening work taken up. Concessionaire shall require to immediately repair the potholesand patches those have been developed at several stretches in the project highway for traffic worthiness toavoid accident and inconvenience to the road users apart from inviting criticism from the representatives ofpublic and local body.
Safety Measures:-Concessionaire shall require to provide Cautionary Sign Boards at all Curve locations of Existing
Carriageway and due to lack of installation of such sign boards, accidents are occurring at curve locations inthe Project Highway which need to be prevented.
There are frequent instructions from District Administration/Commissioner of Police to enhance thesafety measures at Kuthiran hill by widening the road at paved shoulder area along with provision ofadequate sign boards in view of occurrence of accidents very often. Concessionaire shall require to resumesafety measures on priority basis to avoid further accidents.
Issues of serious concern:-
The Project activities are quite affected for want of adequate resources and deployment of staff underHighway, Bridge and Material section from Concessionaire as well as EPC side. Virtually, adequatenumbers of staff at High, middle level management and supervisory level are not available at Project sitefrom Concessionaire and EPC side to initiate, plan and co-ordinate the Project activities on day-to-day basisfor implementation of the Project.
Physical progress of 46.67%only achieved as of December 2016 and thus it is unlikely thatConcessionaire could achieve SPCD by March 2017 unless Concessionaire initiate an action plan onwar footing basis with mobilization of all resources for parallel activities in all fronts. As per revisedwork program of the Concessionaire, the financial progress of `659.48 crores should have beenachieved as against the EPC cost ` 753.80 crores whereas, it was only 351.77 crores has beenachieved.
Adequate safety measures should be provided immediately in construction zone. Concessionaire to initiate appropriate action on priority basis to maintain the ECW for traffic
worthiness including constant cleaning of side drains as the condition of road at certain stretches hasbecome very bad due to development of patches/pot holes.
Temporary Handrail provided in the Irumbubalam Bridge is found unsafe which needs to be rectifiedon priority basis for safe traffic over the Bridge.
Drainage proposal should be finalized at the earliest. Applicable permits as per Schedule E are yet to be obtained for KL-3 Project. There is acute shortage of necessary resources like manpower, machinery and material for the
execution of Project even though full work fronts (100%) are available for structure and road work. Concessionaire has still to comply the outstanding 76 No’s of NCR and the same has been enclosed
as Annexure-1

Still balance one number initial pile load test on test pile at Mannuthy flyover at Ch. 262+707 is duefor testing since last 4½ years for which Concessionaire needs to expedite the arrangement fortesting, which is a matter of concern.
Concessionaire had started raising the sub structure at Mannuthy flyover Km. 262+707 withoutconducting the routine pile load test for confirming the safe axial/lateral load carrying capacity ofpile, which is a matter of serious concern.
Concessionaire shall require to conduct subsoil investigation at all RE Wall approach locations andHigh embankment forming approach to bridge followed by performing stability analysis andsubmitting to IE with ground improvement, if any for review in advance of commencement of work.This is very important Technical Parameters required to be complied prior to execution of work.Still, this is not complied by the concessionaire.
The Concessionaire has not submitted any proposal for reconstruction of the aqueduct under positivechange of scope for obtaining approval of competent authority.
Concessionaire shall acquire the small piece of land at the exit approach at their risk and cost asagreed in the CGM(T)& RO meeting in order to avoid shifting the alignment at exit approach.
