142 Lots on 443.517 acres east of Sunsites, access from Birch Road off State Route 191
Zoned RU-4, which will develop in four phases, lot size will range from 1.29 to 1.45 acres
Conservation area is 227.693 acres (Tract B)
Density bonus results in additional 30 lots
Internal roads will be private, with two paved access roads via Birch Road

MORNING STAR AIRPARK SUBDIVISION
Request to Substitute Assurance Agreement
Ed Curry purchased the land after a Trustee’s Sale.
Mr. Curry’s intent is to preserve the entitlements on the land while continuing to pursue his farming interests on the parcel.
Staff is recommending a Waiver of the 3-year limit for making improvements and granting Mr. Curry’s request for 5 years.
As a condition of approving the requested waiver, at the end of 5-years, the economic conditions and Mr. Curry’s intent for developing the subdivision be re-evaluated.
At that time, if development does not seem likely, Mr. Curry will agree to abandon the plat to prevent a future ‘paper subdivision’.

Staff recommendation:
1.Approve the Substitute Assurance Agreement;
2.Approve the waiver of time limits for development from 3-years to 5-years; and
3.Approve the Condition that at the end of 5-years, Mr. Curry will convey his intentions for development including the possibility of abandoning the plat.
