And today, I came across a news item from

mistaken: It does speak about the loss of a major case in the Supreme Court seeking millions in compensation for his days of

humiliation in ICAC. It is clear from the court report in the Press that Mr. Ta

before the court that he had suffered material and moral humiliation due to the premature termination of his job in the

ICAC. The court of course declined to entertain the merits on procedural grounds of undue d

keen/clean to get back/seek compensation, why it took him almost two years to approach the court.

I just came across a judgement of the Mauritius Supreme Court on 29 May 2014 in the case, entitled Bisasur v. ICAC. As

Huzur would know, Mr. G. Bissasur was the other Dy. Commissioner of ICAC along with Mr. Taujoo, appointed almost on

the same day in 2002.

While they were serving in office, amendment in the POCA, 2005 TERMINATED their job through a specific section in that

Parliamentary legislation, virtually leaving them with no room for making any argument on grounds of any prematurity,

illegality, arbitrariness or unjustifiability as it was consequential upon the abolition of the position under that Act of

Parliament.

The 2013 decision, which I mentioned in the last mail, took the procedural route to dismiss the case of Mr. Taujoo for

compensation for termination of job contractually agreed for Ten years in 2002. He was appointed by a committee that was

headed by the President, PM and the LoP. Yet, in three years time, by Oct 2005, he lost it through an Act of Parliament.

Now the 2014 decision examines even the substantive arguments on their case, though only Mr. Bisasur is before the court.

Based on the arguments preferred by the parties and the court's discussion, the sections in the Parliamentary legislation

that terminated the job of Mr. Taujoo was described as FAIT DU PRINCE and /or "FORCE MAJEURE'.

In the English/British legal tradition, the equivalent clause is "ACT OF GOD".

They played with the employment rights of God's Messenger. While being EMPLOYED at one of the most protected

positions in the State, Allah terminated their job in such a manner and style, that even the highest court of the land could

not find anything wrong/abnormal/unjustified in the way of termination.

There is thus, clinching evidence to show that Mr. Moussa Taujoo’s termination of employment at ICAC was nothing less

an “Act of God”, not just in 'legal' terminology, but also spiritually speaking!

THE TAUJOO & BISASUR CASES – EX-DEPUTY COMMISSIONERS OF ICAC

“…Appointed on contract in 2002 by the President of the Republic for a period of ten years, the

lawyer, however, was dismissed in October 2005, three months after the advent of a new

government. His position was abolished a month earlier after the amendment to the Prevention

of Corruption Act (PoCa) because the government wanted to give a new breath to the body with

the appointment of a Director General and two assessors.

Like the Commissioner Navin Beekarry and his colleague Moussa Taujoo, Gerard Bisasur were

forced to pack their bags for their positions no longer legally exists. In his complaint, Gérard

Bisasur says that he has simply been verbally informed by the Secretary to Cabinet that his

contract was revoked and he must leave his office. It was not until January 2006 that the Anti-

Corruption Commission informed him that the sum of Rs 1,462,500 was transferred to his

account as compensation following the instructions given to it by the Secretary to Cabinet.

Gérard Bisasur then sent a letter to the ICAC to declare having accepted this money “under

protest…”

I thus give a severe warning to this so-called Amir of the Ahmadiyya Association

of Mauritius, Mr. Moussa Taujoo for all his evil deeds which he is doing whereby he is inciting

the Ahmadis to become violent towards us. There is a lot of things which he is keeping secret,

which he is keeping from the Ahmadis. Many times Allah made me understand that Moussa is

a black slipper (2001-2002). He did not get enough of his dose of humiliation (he wants more!)

After his degradation and humiliation from ICAC, he did not learn any lesson from these

humiliations.

Therefore, continue in mocking Allah, His Messenger and His signs; verily soon you shall

know (bear the consequences). This time, you shall have no face to show in society for your

degradation shall be extreme! You want to do competition with your predecessor in

evildoings. Soon, very soon you shall taste the consequences of your evil deeds. Your hatred

and all things which you are hiding from the Ahmadis shall become manifest.

“Wa lakum amalu-kum ! Antum-barii-uuna mimmaaa ‘a-malu

wa ana bariii-um-mimmaa tamaluun” –

“For me are my deeds, and for you, your deeds.

You have no concern with what I do,

And I have no relation with what you do”.
