Well, I am on the road for two weeks, which is the longest time I have been away from Rapid City for awhile. First stop NADA in Orlando - the greatest show on earth for the car business. Everything you ever needed or want is there for sale. Manu-facturers, vendors, and speakers are there for the show to do their best to sell some-thing to the dealers. Boy, howdy do they. It was an aggressive group this year with the

focus on the dealer brown badge. Now don’t get me wrong, good sales people need to be aggressive and not passive, but this group had their claws out. I finally had to flip my badge over so I could just cruise the aisles. After talking with a few dealer acquaintances they had done the same or switched badges with their spouse. The good news is that the workshops are packed because NADA put together a slate of all-star speakers that had good relevant stuff to give the dealers to take home. Speakers like Tommy Gibbs gave a seminar to a standing room only crowd Friday afternoon, which is normally pretty light on attendance. Gibbs sends out weekly newsletters pertinent to your used car operation. Go to tommygibbstraining.com to sign up. It’s well worth it. Several dealers that I know got honors. Dick Olson of Great Falls, Montana was a Dealers of Distinction recipient from Automotive News and was a Time Dealer last year. John McEleney of Clinton, Iowa, and our own Marty Rypkema where 2013 Time Dealer honorees. My friend and a fellow 20 Group member Sam Mansker of Olathe, Kansas was a Time Dealer finalist. Knowing Sam, I’m sure this was a humbling honor to a kid that started out cleaning cars 40 years ago at the dealership, serving a stint in Vietnam along the way and who worked his way to owning Olathe Ford Lincoln. If you ever have the chance to meet Sam you will know why he was nominated and a finalist. He is a great guy and a fantastic dealer.

I had a few days between NADA and my 20 Group meeting in Boca Grande. Kristol and I drove down to Marco Island to spend a few days. Marco is an interesting place that during the season swells from 15,000 people to 40,000. Traffic and Congestion! She made the comment that “I am seeing more gray in your hair.” My response was “If we spend any more time here with the over 80 crowd it will be snow white.” No disrespect intended.

Myron must have things at this point under control at Legislative Session. I received one phone call about fuel octane from him. Our stance is what the manufacturer recommends for our customers. Other than that, no call to arms to man the phones or to rush off to Pierre. Knock on wood or the closest palm tree.

President’s MessageI am writing this message

on the 26th day of the 2013 South Dakota Legislative Session. We are now at what is called, "cross over day," meaning that all Bills need to clear either the House or Sen-ate - wherever the Bill origi-nated. Most of our desires are being met either by killing or passing the Bill. I am not tired of it yet, but I am sure by the time March 11th comes, it will be nice to get back to my office in Sioux Falls.

In this column, I have highlighted a few of the Bills that I am keeping a close eye on. If you want to know the status of all Bills I am tracking on your behalf, please review the Bill Tracking List that appears in this edition of the SDADA Report. As always, if you have questions or comments, please call the office and the staff will hunt me down.

The fuel pump labeling wars - HB 1037 Define the requirements for the sale of certain octane petroleum products. HB 1091 Establish certain provisions regarding the labeling of motor fuel at a retail fuel pump. HB 1157 Increase certain penalties regarding the sale of petroleum products.

This battle started last year when 85 octane gasoline was improperly labeled and sold as 87 octane gasoline. There was both civil action and criminal prosecution that ultimately resulted in administrative rules to address the issue. HB 1037 was drafted by SD Department of Public Safety with intent to codify the adminis-trative rules. HB 1091 was drafted by the Petroleum Marketers because they did not like certain parts of the administrative rules. The result was a compromise that allows continued sale of 85 octane gasoline in the counties of Butte, Custer, Fall River, Harding, Lawrence, Meade, Pennington, Perkins, and Shannon. The fuel pump may identify the fuel as regular unleaded 85, however, any 85 octane product shall be conspicuously identified with a decal that states: "May not be suitable for all engines. Refer to owner's manual before fueling."

As a compliment to that compromise, HB 1157 was introduced to ensure compli-ance with this law by making mislabeling fuel pumps or disseminating improp-erly labeled fuel punishable by Class 1 misdemeanor penalties. Both Bills have cleared the House and Senate and soon will be in the hands of the Governor. In my opinion, a good package overall.

HB 1141 - Revise certain provisions regarding certain motor vehicle dealer license plates and permits.

This is our Bill that will remove the 13-ton cap on "88" dealer license plates. It has cleared the House and will be heard in the Senate Transportation Committee on February 25th. Passing this piece of legislation will bring positive results for our heavy truck dealer members. The Bill appears to be in good shape to clear the Senate and head to the Governor for signature.

I just returned from the 2013 NADA Convention held in Or-lando. It was great to see several South Dakota dealers in Or-lando. I hope those of you who did attend found it beneficial.The Exposition floor was packed with vendors and dealers. There were many new and updated products and services. I am amazed at how the expo floor and the vendors (BDC’s, CRM software, social media initiatives, etc.) have changed over the past five years.

David Wescott Takes NADA HelmThe NADA Board had its winter board meet just prior to our convention. Bill Underiner completed his year-long stint as chairman. Bill did a great job for

NADA and especially for small dealers. Dave Westcott from North Carolina now takes over as chairman. Dave has served on many NADA com-mittees and brings a lot of experience. I am confident he will do a great job.I received my committee assignments for the upcoming year. I will serve on the Public Affairs committee again this year and I will be on the Dealer Operations committee. It has been a couple years since I served on Dealer Ops so it will be interesting to get back to that. I also start my 3-year term on the Finance Com-mittee having served a year filling out an appointment. I am looking forward to a great year.

Glenn Mercer Phase 2 Study ReleasedOn Saturday in Orlando, Glenn Mercer highlighted the findings of the second phase of the facility image programs. This study analyzes the Return on Investment (ROI) of image investments in the short term, and examines whether these investments might be right in the longer term, for Dealerships of the Future. The first phase of the study was completed a year ago.Mercer said one of the goals of the Phase 2 study is not to prescribe a "one size fits all" solution, but to assist dealers and auto manufacturers alike to better understand each other's points of view better, and negotiate on a more informed basis for the most-efficient (low cost) and effective (high growth) way to invest in dealership facilities, not only for today, but for tomorrow as well.Mr. Mercer said the current trend to build more expensive and more brand-customized auto dealerships will lead to excessive and wasteful spending, as dealers repeatedly raze and rebuild their facilities, and as auto makers constantly update their brand image campaigns.Perhaps the most relevant finding of the study, at least for South Dakota dealers, was that standardization spending is almost always a "pure deadweight loss." That means there is no ROI to tearing up floor tile, replacing mullions and closing up "customer touch points." While this comes as no surprise to small and medium size dealers, I hope it is a revelation to the manufacturers!

FTC Warns Dealers on Buyer’s Guide The Federal Trade Commission has warned 11 used car dealerships in Jonesboro, Ark., that their failure to properly display the "Buyers Guide" on used vehicles offered for sale violates the FTC's Used Car Rule. FTC staff inspections in Jonesboro found that eight dealers failed to display Buyers Guides on al-

Bipartisan Bill to Repeal Obsolete Paperwork Requirement at Auto DealershipsIntroduced

WASHINGTON (Feb. 15, 2013) –

Legislation, H.R. 724, was intro-duced late yesterday in the U.S. House of Representatives that would eliminate a mandate that requires dealers to certify if a new vehicle has an emissions system.

Under the Clean Air Act, dealers are required to present written confir-mation to the buyer that a visual inspection has been completed of a new-vehicle’s emissions system. The bill, introduced by Reps. Bob Latta, R-Ohio, and Gary Peters, D-Mich., eliminates this obsolete and unnecessary requirement.

“There are already enough docu-ments for car and truck buyers to read at the sale of a new vehicle. Eliminating this redundant form makes sense,” said David Westcott, chairman of the National Automo-bile Dealers Association (NADA),

and a Buick, GMC and Suzuki deal-er in Burlington, N.C.

Westcott said that documenta-tion of the vehicle’s Clean Air Act compliance can already be found under the hood, on the Internet, in the owner’s manual and in war-ranty supplements, making addi-tional paperwork to the customer pointless. Additionally, automakers contractually require new-car deal-ers to perform comprehensive pre-delivery inspections of the vehicle to ensure the emissions system is functioning properly.

Westcott further noted that the bill in no way alters the original manu-facturer warranty if the emissions system of a new vehicle falters and needs to be repaired. On-board di-agnostic computers in vehicles per-form regular checks to ensure the exhaust system is working properly. If a problem arises, the vehicle’s “check engine” light would illumi-nate. Dealers would fix the problem under the vehicle’s warranty at no cost to the consumer, he said.

“Repealing laws that burden small business with no discernible bene-fit to consumers is something both

parties should agree on. I commend Reps. Latta and Peters for their ef-fort to repeal this obsolete man-date,” Westcott added.

The NADA Story

The NADA story began in 1917 when 30 auto dealers traveled to the na-tion’s capital to convince Congress not to impose a luxury tax on the automo-bile. They successfully argued that the automobile is a necessity of American life, not a luxury. From that experi-ence was born the National Automo-bile Dealers Association. most all used cars offered for sale, and three dealers failed to display

the guides on a significant number of used cars. Ten dealers properly displayed the guides on all or nearly all of the used cars offered for sale. The FTC sent warning letters urging the 11 dealers to come into compliance by properly displaying the guides in a clear and conspicuous loca-tion on all used cars.I always welcome people to come to our beautiful state, but I invite FTC investiga-tors stay the hell away!As always, please contact me with any questions or concerns.

It is with a heavy heart that we inform you of the passing of G. S. “Wendol” Holcomb. Wendoll passed away on February 3, 2013, at the Bethany Home in Brandon, SD, with his family present. He was 89 years old.

Wendol was the owner of Holcomb Freightliner (now I-State Truck Center) in Sioux Falls, SD and Sioux City, Iowa. He was an active member of both the South Dakota Automobile Dealers Association as well as the South Dakota Trucking Association.

Matters of the Heart: Women and Heart HealthBy Dr. Dan Heinemann, Sanford Health

It’s no secret that men and women are different. Just ask my wife. It’s no wonder there are countless books on navigating the differences between us. And our health is no different. Especially our heart health.

When it comes to matters of the heart, women rarely believe heart disease is their greatest health threat. However eight million women in this country are living with heart disease. And the truth is, more women die of heart disease than all forms of cancer combined.

On top of it, you’re a caregiver. You spend countless hours making sure everyone around you is okay. Sometimes that means sacrificing your health.

Because February is National Heart Month I encourage everyone to start thinking about heart health. It’s a great opportunity to learn about the risks and symptoms as well as procedures that can help.

Stereotypical symptomsOftentimes women don’t experience the same typical heart symptoms as their male counterparts. Less than a third of women in a recent survey reported early warning signs. It’s important for women to re-alize, for them, the symptoms aren’t necessarily the same ones society associates with a heart attack. They don’t often experience the crushing, clenching chest pain like men do.

In general women will experience some sort of discomfort in their chest though it may not be severe. Instead it is more likely that a woman will experience signs unrelated to chest pain. They may have dis-comfort in their neck, shoulder, upper back or stomach. Shortness of breath as well as nausea and even vomiting can be related to a heart attack. In addition, women may also begin to sweat, feel lightheaded or dizzy and may experience an abnormal amount of fatigue.

Know the risksThere are several risk factors for heart disease. Some of them you have no control over like your gen-der, your age or family history. There are others that you do have control over. By making changes to your lifestyle, you can reduce your risk for heart disease. Risks you can take control of include: smoking, high cholesterol and blood pressure, lack of exercise, obesity, diabetes and stress.

Take ActionIf you believe you’re having a heart attack, please take it seriously. It’s nothing to mess around with. Call 911 within five minutes of experiencing symptoms and tell the operator you think you’re having a heart attack. Even if your symptoms go away, get medical attention. You can also chew and swallow one regu-lar full-strength aspirin with water as soon as you can. This helps prevent blood clotting.

Please don’t drive yourself to the hospital. An ambulance is the way to go because the professionals on board can begin to treat you before you arrive at the hospital. Once you’re at the hospital, make it clear

Bowdle Healthcare Center Gets a New CPR Training UnitOn Tuesday, January 22, 2013, The Bowdle Emer-gency Medical Technicians and Hope Larson, Director of Nursing were presented with an AED Little Annie Training System. The presentation was made by Jerry and Bob Beadle and sponsored by Beadle Ford Inc. and Beadle's Chrysler Center.

Dealers throughout the country have long been in-terested in and have devot-ed much of their time, ef-fort and dollars toward the development of their com-munities.

By giving the AED Little Annie Training System to the Bowdle community it will help not only to save lives, but will give comfort and security to those who can be trained through it.

Bob filled out a medical grant for the Little Annie Training System that was made available through the National Auto Dealers Association’s Charitable Foundation.

If you know of an organization that is need of updated training equipment, please complete the applica-tion on page 22 of this publication and send it in to the SDADA office. We will attach a letter of recom-mendation and forward the application to NADA to be processed. It’s that easy! Take advantage of the opportunity to help your community!
