evaluationsand/orTIPmustbemadeformallyinwritingwithinfifteen(15)daysofreceiptofthecompletedevaluationandcompositeratingof

teachereffectiveness,orfromthedistrict'sissuanceandorimplementationofthetermsoftheTeacherImprovementPlan.Notificationofthe

appealshallbeprovidedtotheSuperintendentofSchools,thePrincipaland/orSuperintendent’sdesignee.Anappealmaynotbedecidedby

thesameindividualwhowasresponsibleformakingthefinalratingdecision.Insuchcase,theBoardofEducationshallappointadesigneeto

decidetheappeal.DesigneeswillbetrainedleadevaluatorsfromONCBOCES’componentdistricts(inclusiveofretireesfromthese

componentdistricts).Whenfilinganappeal,theteachermustsubmitadetailedwrittendescriptionofthespecificareasofdisagreementover

hisorhercompletedevaluationandanyadditionaldocumentsorwrittenmaterialsthatarespecifictothepoint(s)ofdisagreementand/orare

relevanttotheresolutionoftheappeal.Teachersareencouragedtoreviewtheappealwiththeteachersassociationbeforeitissubmitted.A

TeacherImprovementPlan(TIP)willbedevelopedandimplementedduringanappealbutwillbediscontinuedshouldtheappealdetermine

thattheteacheriseffectiveorhighlyeffective;theindicatedappealstimeframeandprocessesapply.

B.Appealsmaybemadeforthefollowingreasons:

1.thesubstanceoftheannualprofessionalperformancereview;whichshallinclude

i.theinstanceofateacherratedIneffectiveonthestudentperformancecategorybutratedHighlyEffectiveontheobservationcategory

basedonananomaly,asdeterminedlocally.

2.theschooldistrict’sadherencetothestandardsandmethodologiesrequiredforsuchreviews,pursuanttoEducationLaw§3012-d;

3.theadherencetotheCommissioner’sregulations,asapplicabletosuchreviewsandcompliancewithanyapplicablelocallynegotiated

proceduresapplicabletoannualprofessionalperformancereviewsorimprovementplans;and

4.theschooldistrict’sissuanceand/orimplementationofthetermsoftheteacherimprovementplanunderEducationLaw§3012-d.

C.Prohibitionagainstmorethanoneappeal:Ateachermaynotfilemultipleappealsregardingthesameperformancerevieworteacher

improvementplan.Allgroundsforappealmustberaisedwithspecificitywithinoneappeal.Anygroundsnotraisedatthetimetheappealis

filedshallbedeemedwaived.

D.Withinten(10)daysofreceiptofanappeal,theevaluatormustsubmitadetailedwrittenresponsetotheappealtotheSuperintendentor

Superintendent’sdesignee.Theresponsemustincludeanyandalladditionaldocumentsorwrittenmaterialsspecifictothepoint(s)of

H.Exclusivityof§3012-dAppealProcedure

The3012-dappealprocedureshallconstitutetheexclusivemeansforinitiating,reviewingandresolvinganyandallchallengesandappeals

relatedtoateacherperformancereviewandorimprovementplan.Ateachermaynotresorttoanyothercontractualgrievanceprocedures

fortheresolutionofchallengesandappealsrelatedtoaprofessionalperformancereviewand/orimprovementplan,exceptasotherwise

authorizedbylaw.

filedshallbedeemedwaived.

D.Withinten(10)businessdaysofreceiptofanappeal,theSuperintendentmustsubmitadetailedwrittenresponsetotheappealtothe
