Message from the Chairman
Dear Colleagues,
The year 2011-12 marked a significant landmark for the IT-BPO industry as it crossed the
milestone of USD 100 billion in revenues. The industry performance this year
demonstrated the sector’s ability to innovate and deliver differently in order to
maintain the growth trajectory.
More importantly, companies are investing in building platforms and productised
solutions to drive future growth opportunities. The industry is expanding into newer
geographies and verticals where the growth is 1.4 time than in the mature markets.
Emergence of a vibrant start-up product ecosystem creating solutions for India and the
world also enhanced the product opportunity for India.
During the year, NASSCOM launched significant initiatives to support the industry, and
several of these were targeted at the SME players.
Market access opportunities, sharing industry best practices, mentorship through industry leaders to highlighting the
success stories — NASSCOM worked actively to create a definitive and enduring agenda for SME growth.
I personally travelled across India, meeting over 150 SME companies to understand the challenges they were facing and
elicit their views on how these could be addressed.
NASSCOM’s Product Conclave and EmergeOut conference were extremely successful, drawing a record number of
delegates and media attention. ProductsMade.in is a unique initiative from NASSCOM that provides a market place for
products made in India. NASSCOM also launched the Technology/Knowledge Worker Health Plan to aggregate
healthcare insurance needs of SME member employees and create an affordable plan.
Talent development and growing the pool of skilled professionals was another thrust area for NASSCOM in 2011. The
organisation set up the IT-ITeS Council under the aegis of the National Skills Development Council to create assessments,
curriculum, foundational skills courses, and programmes for faculty development.
Building the domestic market remained another key priority for NASSCOM, and we worked closely with the Department
of Information Technology (DIT) to organise state workshops on e-governance across the country. A focused event was
created with UID Authority to highlight opportunities for industry to build solutions around Aadhar.
Partnership with the government on cyber security, data security and privacy is an important area for the industry. During
the year, Data Security Council of India and NASSCOM created focused sessions, white papers, and government
interactions to build thought leadership on this critical issue.
NASSCOM’s India Leadership Forum crossed the 20-year milestone this year. The two decades of the ILF have mirrored
the changing landscape of the Indian IT-BPO industry, its evolution, growing maturity and moving up the value chain.
NASSCOM has played a stellar role in engaging with the industry, a fact that is reflected in the increasing stature and size
of the conclave.
Going forward, NASSCOM will continue to facilitate the growth of the industry, scaling its initiatives in 2012 and working to
provide an environment and ecosystem that is beneficial to the sector.

Message from the President
Dear Colleagues,
The year 2010-11 has been an action packed year for NASSCOM, a period when the
organisation has worked at multiple levels and several domains, to sustain the growth
and momentum of the sector.
Expanding NASSCOM’s engagement with our members was a key priority during the
year. Regional Councils, GIC forums, HR sub-groups, CEO sessions were created to
discuss a broad range of issues and discuss best practices.
Our membership is very diverse today and accordingly the industry forums at
NASSCOM are focused on creating specific programmes that can help build these
specific sectors. During the year, NASSCOM re-energised the BPO and Engineering
Services Forum to create a focused agenda around skill development, market
opportunities and industry positioning.
NASSCOM also enhanced its policy initiatives focusing on the current operational issues of taxation, 24/7 operations as
well as engaging on areas such as standards, privacy, online payments, Free Trade Agreements, etc. NASSCOM also thengaged extensively with the government in creating the IT vision for the 12 Five Year Plan and industry inputs for the
draft National IT Policy. We are hopeful that the implementation of the 12 Plan and IT Policy will create a more
conducive and enabling policy environment in the country.
NASSCOM continued its interaction with policy makers of different countries, discussing the negatives of protectionism,
and championing the cause of free trade. At the same time, it also took up the specific issues related to mobility, visas,
double taxation, social security, etc. The focus for NASSCOM is to enable more global companies to set up presence in
India and Indian companies to expand globally, both of which need policies for movement of skilled professionals.
In 2011, NASSCOM also focused its attention on new and emerging markets and led delegations to Japan, China,
Europe and Africa. At the same time, NASSCOM hosted several foreign delegations, providing the visitors with an
overview of the country’s market, the regulatory environment and partnership opportunities with Indian players.
During the year, NASSCOM also undertook detailed analysis of the cost competitiveness of the IT-BPO sector and
published key statistics that demonstrates that despite perceptions of spiralling wage inflation and other costs, India will
retain its cost advantage.
At the same time, multitude of awards launched by NASSCOM – Innovation Awards, Emerge 50, Healthcare, Talent
Practices demonstrates how the industry is creating its value proposition of innovation and transformation, apart from
the cost leverage.
Sustainable practices around Green, Diversity were also showcased by NASSCOM through awards and research
reports.
NASSCOM also expanded its own team – building both vertical and functional experts that can service the industry
requirements of today as well as build the long term initiatives.
As we look ahead, 2012 is a challenging year with global uncertainties high. NASSCOM will continue to build specific
programmes, insights and priorities for the industry to sustain its growth momentum.

GOVERNMENT POLICY ISSUES
NASSCOM has been working closely with both the union
and state governments of India to create a regulatory
climate that is conducive to the growth of the IT-BPO
industry in the country. As part of this agenda,
NASSCOM initiated the following activities in 2011:
Union Budget Proposals
NASSCOM submitted its pre- and post- budget
memorandum to the Ministry of Finance, making
recommendations on key direct and indirect tax issues
impacting the IT-BPO industry. The issues were compiled
in close consultations with member organisations.
Service Tax
• International Private Leased Circuit (IPLC) services
The Central Board of Excise and Customs (CBEC)
released a directive, changing the classification of
IPLC services from ‘Telecommunication’ to ‘Business
Support Services’ and thereby imposing service tax
on Business Support Services. NASSCOM made a
recommendation to withdraw the directive and re-
change the classification of IPLC services to
‘Telecommunication’ services. CBEC issued the
withdrawal order (dated 19.12.2011) and reinstated
the earlier position held.
• Service Tax Refunds
NASSCOM has been representing the issue on
refunds of service tax on input services used for
providing output services in exports. The issue has
been causing undue hardship to exporters for many
years. Taking into account the proposal submitted
by NASSCOM, the CBEC came up with a draft
circular to streamline the refund process. The final
circular is due for release.
• TDS on Service Tax
The CBEC proposed to introduce the TDS
mechanism in collecting Service Tax. The board set
up a study group to examine its feasibility and
implementation. NASSCOM has made frequent
representations to rebuff such a methodology.
Income Tax
• A representation was made to the Parliamentary
Standing Committee of Finance on the Direct Tax
Code bill, 2010
• Meeting with the Director General of International
Taxation
A meeting was held with the DGIT, R.N. Dash and his
team constituted by senior officials handling
international taxation. The meeting revolved
around transfer pricing issues and attributed global
profits. Later, a half-day interactive workshop was
also organised, inviting government and industry
members for an in-depth dialogue on direct taxes.
E-commerce
• Telecom Commercial Communications Customer
Preference Regulations, 2010
The Telecom Regulatory Authority of India (TRAI)
issued a directive with reference to its Telecom
Commerc ia l Communicat ions Customer
Preference Regulations, 2010. The directive clarified
and provided exemptions to non-commercial
communication under certain categories to be
excluded from the limit of one hundred SMSes per
day per SIM.
NASSCOM proposed amending the definition of
Transactional Message and inclusion of certain
entities in the exemption category to send SMSes
beyond the prescribed limit by TRAI. The
recommendations have been well considered by
TRAI and proposed suggestions have been
implemented.
• Working Group on Online Payments
Based on recommendations from NASSCOM, a
working group on online payments has been
created by the Ministry of Finance, under the
Chairmanship of Kiran Karnik. The members of the
working group include RBI, IBA, NPC and
NASSCOM. The working group is addressing issues
related to technology infrastructure and charges
for online payments.
Funding for start-ups
• Working Group at the Department of IT
The Department of Information Technology (DIT),
Government of India under its 12th Plan
recommendations and also the draft IT policy is
looking at a fund of Rs. 1000 crore for small
companies. NASSCOM is working with the DIT on the
specific modalities of how this funding can be
executed.
THE YEAR IN REVIEW
Annual Report 2011-12 11
• Working Group at the Planning Commission
The Planning Commission has created a working
group on Early Stage, Angel and VC Investments.
NASSCOM has been invited to be a member of this
group and will suggest alternatives to enable seed
funding for start-up entrepreneurs.
Other Issues
• National Policy on Information Technology (NPIT),
2011
Submissions were made on the NPIT, 2011 circulated
by the Department of Information Technology,
Government of India with a vision of positioning
India as a ‘Global IT hub,’ building an IT powered,
sustainable and inclusive national economy, and
seeking dominance for the Indian IT-BPO business.
• A representation was made to the Parliamentary
Standing Committee of Human Resource
Development to discuss the ‘Protection of women
against sexual harassment at workplace bill 2010.’
• Special Economic Zone
The Special Economic Zone (SEZ) policy was
introduced in 2000 with a view to attract larger
foreign investments in India. The policy intended to
make SEZs an engine of economic growth,
supported by quality infrastructure and an
attractive fiscal package, both at the centre and
the state level, with the minimum possible
regulations. The Ministry of Commerce came up
with a concept paper to comprehensively address
all aspects related to the policy framework and
operational issues (viz; withdrawals of MAT and DDT
benefits from assessment year 2012-13 and
subsequent years to SEZ developers and units,
withdrawal of profit-linked incentives, etc.).
NASSCOM made its submission to the Ministry,
detailing the key policy and operational challenges
faced by the IT-BPO industry and suggesting
recommendations for the same.
• Negative List of Services
A comprehensive draft proposal was released by
the CBEC to initiate an informed public debate on
widening the tax base by introducing a negative list
of services. (A negative list of services implies two
things: firstly, a list of services which will not be subject
to service tax; secondly, all other services (besides
the ones mentioned in the negative list, and fall
within the definition of ‘supply of services’), which will
become taxab le ) . NASSCOM made i t s
recommendations on the draft proposal, stating
that the ideal time for the introduction of the
negative list of services would be when the Goods
and Services tax was introduced.
Over the years, the focus of the Global Development
Trade Programme has been to engage with a wide
variety of domestic and international stakeholders, such
as governments, customers and associations, to create
regulatory frameworks that would foster trade with the
Indian IT-BPO industry, position India as a trade partner
and promote global sourcing in emerging markets and
verticals. Under this Programme, NASSCOM has also
been spotlighting India’s edge as an outsourcing
destination and the unmatched value proposition
offered by the country’s IT-BPO service providers. It has
been doing so by reaching out to influencers including
legislators, elected officials, associations, think tanks,
academic institutions, customers, regulators, Indian
embassies and the media. In 2011, NASSCOM
continued to strengthen India’s credentials as a key
global IT-BPO hub by initiating the following activities:
EU-wide ICT (Intra-company transferee) visa
NASSCOM has been working towards an EU-wide ICT
visa on the lines of the Schengen visa rules. NASSCOM
first initiated the concept of this visa four years ago,
publishing a detailed whitepaper on the subject and
submitting it to the European Commission. Patience
and perseverance has paid dividends, with the formal
ICT directive getting tabled in the EU Parliament in 2011.
It is currently going through the parliamentary process
where NASSCOM continues to steer the conversation
with other coalition partners. NASSCOM was also called
in to testify during the Parliament debate on the ICT
directive. It is continuing to push for a harmonised work
visa regime for the industry in the EU.
Issues with delays/refusals of US visas and border patrol
at port of entry
NASSCOM had taken up the issues regarding
delays/refusals of US visas and border patrol at port of
entry with the US Ambassador in New Delhi. It had also
held several rounds of discussions with the US Counselor
in the capital and policymakers in the US to voice
industry concerns.
Visa issues with Canadian authorities
The NASSCOM President met with key policymakers
from organisations such as Citizenship and Immigration
Canada (CIC), Human Resources and Ski l ls
Development Canada (HRSDC) and Foreign Affairs and
International Trade Canada (FAIT) in Ontario. The two
key issues discussed included:
GLOBAL TRADE DEVELOPMENT
Annual Report 2011-12 12
1. Problems faced by the industry with respect to
recent changes in the migration policy 2. India–Canada FTA
NASSCOM has also made a detailed submission on visa
problems faced by the industry, which have been taken
up and will be resolved soon.
German mobility issues
India and Germany had signed a partial totalisation
treaty in 2009. Later, in July 2010, Germany had made a
few changes in its immigration policies. To take up these
issues, a bilateral meeting was initiated by NASSCOM in
Berlin where an Indian delegation led by Joint
Secretary, Ministry of Overseas Indian Affairs; Employee
Provident Fund; NASSCOM and select industry
participants met with a German delegation constituted
by representatives from the Ministry of Labour and
Social Affairs; Federal Ministry of Interior, Economics and
Technology; Employment Agency and German Liaison
Agency Health Insurance (DVKS).
A breakthrough was made and Germany Agreed to de-link the SSA (Social Security
Agreement) from the India-EU FTA and to honour
the SSA signed between nations in letter and spirit
Agreed to NASSCOM’s proposal of working
together to define an objective list of parameters
for ‘specialists’ under Section 28. This will help in
reaching an understanding on the parameters
(minimum experience, training, education, salary
level, etc.) that can be applied by adjudicating
officers and complied by Indian IT organisations
while applying for visas.
With the above accomplished, India and Germany
signed a comprehensive totalisation treaty on October
12, 2011.Shortage of work visas in Switzerland
A NASSCOM delegation led by its Chairman, met with
the Swiss immigration authorities in Bern, Switzerland. The
Indian IT-BPO industry has been facing a number of
problems with respect to visas and work permits in
Switzerland. NASSCOM had raised these issues with the
Embassy in Delhi and through the Ministry of Commerce
under its negotiations for a comprehensive treaty.
NASSCOM had submitted a detailed note with the

Workshop on global mobility issues with ministries of
Government of India
NASSCOM held a workshop with the Ministry of
Commerce, Ministry of Overseas Indian Affairs and
Ministry of Information Technology and leading industry
players on issues related to the mobility of workers in the
IT sector. The Ministry of Commerce updated the
industry participants on the current status of key
agreements that it was negotiating with the as EU,
Canada and ASEAN. It also highlighted the recently
concluded FTAs such as those with Japan, Malaysia and
Korea. The Ministry of Overseas Indian Affairs updated
the industry on the progress it had made on totalisation
treaties. The Ministry has signed SSA with more than 12
countries where four agreements, with Belgium,
Germany, France and Switzerland are already
operational. The industry’s demand on the visa and SSA
issues were noted by the Ministry of Commerce to be
taken up during the negotiation of bilateral agreements
with the respective countries.
Session on ‘Visa and immigration–Trends and
challenges’
A session on ‘Visa and immigration–Trends and
challenges’ was held in Pune. It was attended by more
than 60 participants from the industry. The session
helped attendees to understand and gain a
comprehensive overview of the current immigration
trends, challenges and best practices covering multiple
internat ional dest inat ions for mult i -nat ional
corporations.
Meeting with Indianapolis trade delegation
The meeting was held in Hyderabad on September 26,
2011. It was hosted by NASSCOM, AMCHAM (The
American Chamber of Commerce) and the City of
Indianapolis, Indiana, USA, to discuss business
opportunities in the US with the business leaders of
Hyderabad. The delegation of business leaders led by
Scott Miller, President and CEO, Develop Indy, met their
counterparts to explore the potential for mutually
beneficial business partnerships. The participants were
apprised of a wide variety of business sectors that were
