IT is hereby notified, for general information, thatit is necessaryto drawattentionto the “Conditions forAcceptance of Copy”, whichappears in every issue of the Gazerre; and particularly the need to

submit lengthy copy, in the case of Statutory Instruments, at least21 days before the date ofclosing for the Gazette in whichthe noticeis to be published.

During the past few months or so there have been many caseswhere urgent copy for subsidiary legislation, which requires thesignature of the Presidentor a minister to giveit effect, and whichis of national importance, has been sent in for publication in theGazette after closing-time. Thesale is conducted in termsofthe rules of the High Court, which providethat it shall be without reserve but subject to the condition that the Sheriffrequires to be

satisfied that the highest price offered is reasonable, having regard to the circumstances oftime and place andthestate of the property.

. After the auction, a report on the bidding and on the highest price offered, together with any other relevant information relating to the sale, will be forwarded to the

Sheriff, who,if satisfied that the highest price offered is reasonable, having regard to the circumstances oftime and place andthestate of the property, will declare

the highest bidder to be the purchaser.

. In terms ofthe rules of court, any person having an interest in the sale may, within seven days of the Sheriff having declared the highest bidderto be the purchaser,

applyto the High Court to haveit set aside on the groundsthatthe sale was improperly conducted or the property was sold for an unreasonably lowsum,or any other

good ground.

. In the eventofno application being made within the said period of seven days the Sheriff shall confirm the sale.

(a) advise the Commissioner appointed by the Sheriff, attending the sale of the manner in whichhe intends to make paymentof the purchase-price and other costs

and chargesin termsof theseconditions. and satisfy the Commissioneras to his bona fides and ability to mect his obligations; or

(b) effect paymentto the Commissioner of the whole of the purchase-price in cash or by cheque or bank draft drawnto the orderof the Sheriff.

into the nameofthe purchaser, unless the Sheriff approves other arrangements for discharging the amount due by the purchaser,

. The purchaser shall be liable to pay interest at the rate of twenty-five per cent. per annum in respect of any unpaid balance of the purchase-price with effect fromseven daysafter the date of confirmationofthe sale by the Sheriff.

ofthe sale contained herein, the Sheriff shall have the right to apply to a judge ofthe High Court to have the sale cancelled, and to hold the purchaser liable for any

loss or damages sustained, or to employ any other remedy which he mayhave.In the event of the sale being cancelled, the purchaser shall not be entitled to any

increase which the property mayrealize at a subsequentsale.

12. The property is sold as represented bythetitle-deeds the Sheriffnot holding himself liable for any deficiency whatsoever, and renouncingall excess; and the Sheriff

does not hold himselfresponsible for the determinationof the boundaries and beacons whichshall be the responsibility of the purchaser.

13. The property shall be at the risk and profit ofthe purchaser from the date upon which the Sheriff confirms the sale and the Sheriff gives no warranty of vacant pos-

session.

14. The highest bidder may not withdrawhis bid in termsofthese conditionsofsale prior to the date of confirmation ofthe sale or rejection ofhis offer by the Sheriff.
