REAL ESTATE PURCHASE CONTRACT

THIS REAL ESTATE PURCHASE CONTRACT (“Agreement”) is entered into effective as of the Acceptance Date, by and between LESLIE PITSTICK, Dayton, Ohio (“Buyer”) and the BOARD OF TRUSTEES OF BEAVERCREEK TOWNSHIP, GREENE COUNTY, OHIO (“Seller”): 1. DESCRIPTION OF PROPERTY: The Buyer agrees to buy, and the Seller agrees to sell a portion of the property located at 1410 Dayton Xenia Road, Beavercreek, Ohio, which portion (.262 acres) is described and depicted in Exhibit-A attached hereto and made a part hereof (the “Property”). The Property sold shall include the above-described real estate and all appurtenant rights, privileges and easements relating thereto and all buildings, fixtures and improvements thereon. 2. PURCHASE PRICE: The Purchase Price shall be One Thousand One Hundred and Fifty Dollars ($1,150.00) (the “Purchase Price”). The Purchase Price shall be paid in cash at closing. Such sum shall constitute the entire amount of compensation due Seller for: (a) the Property to be conveyed, including all buildings and fixtures thereon; (b) Seller's covenants set forth herein; (c) any and all supplemental instruments reasonably necessary to transfer the title of the Property.

As further consideration for the sale of the Property, Seller hereby agrees to pay one-half (1/2) of the attorney’s fees accrued by Seller for the preparation of all documents associated with the Purchase of the Property and for conducting the closing for the Property. 3. POSSESSION: Seller agrees to deliver complete possession of the Property upon the Closing Date. Seller shall be responsible to Buer for any damages caused by Seller's failure to deliver possession on the stated date. 4. DEED: Seller shall convey to Buyer marketable title to the Property in fee simple by transferable and recordable general warranty deed, free and clear of all liens and encumbrances, except zoning ordinances and taxes and assessments becoming due and payable after the Closing Date and any other exception disclosed in any title examination obtained by the Buyer.

5. EVIDENCE OF TITLE: Buyer shall secure title evidence that shall be acceptable to Buyer. If the title discloses that all or part of the real estate is unmarketable, or is subject to liens, encumbrances or easements, conditions or restrictions which are unacceptable to Buyer, Seller, at Seller's expense, shall cure such defects within 10 days after receipt of notice from Buyer of the existence of such defects. 6. TAXES AND ASSESSMENTS: Seller shall pay all real estate taxes and assessments assessed against the Property which are due and payable for periods of time prior to the closing date. Because the Property will not have been established as a separate tax parcel prior to the closing date, Seller shall fulfill the above obligation by continuing to pay the taxes assessed on the original “mother” tax parcel that includes the Property until such time as the Property is established as a separate tax parcel. No tax proration shall occur at the Closing. When the Property is established as a separate tax parcel, Buyer shall reimburse Seller for all real estate taxes paid, if any, by Seller which were attributable to the new tax parcel and assessed for periods of time after the closing date. 7. SELLER'S WARRANTIES: Seller represents that Seller owns fee simple marketable title to the Property and no other person or entity has any right to the Property, which is based on encumbrances, written agreements or oral understandings, other than matters, which appear in the public record. For the purposes of this paragraph, “marketable title” shall be determined by reference to the Ohio State Bar Association Standards of Title Examination. Seller represents that, to the best of Seller's knowledge, the Property is free from any material or substance presently prohibited or regulated by any governmental authority or which is presently known to pose a hazard to the health or safety of occupants or the Property (“Hazardous Material”). During Seller's ownership of the Property it has been used primarily for residential purposes only and the Property has never been used as a dumpsite or storage site for Hazardous Material. Seller warrants that there is no pending litigation or claim which affects or which might affect the Property. Seller warrants that no improvements or services have been installed or furnished (or notification received from public authorities of future improvements) of which any part of the cost may be assessed against the Property. These warranties of Seller shall survive the closing.

8. DAMAGE OR DESTRUCTION OF PROPERTY: Seller shall not change the existing character of the Property or alter, remove, destroy or change any improvement located on the Property. Risk of loss to the Property and all improvements shall be borne by Seller until closing. If any property, fixtures or equipment covered by this Agreement shall be damaged, or destroyed before this transaction is closed, Buyer may: (a) proceed with the transaction and be entitled to all insurance money, if any, payable to the Seller under all policies covering the Property plus an amount equal to Seller's deductible; or (b) rescind the Agreement, and thereby release all parties from liability hereunder, by giving written notice to Seller, in which case the Earnest Money, if any, shall immediately be refunded to Buyer. Seller agrees to maintain the Property in its present condition until delivery of possession and shall keep the Property adequately insured against fire and extended coverage perils prior to closing. 9. CLOSING: The consummation and closing of this Agreement shall occur at such time and place as the Parties may agree, but no later than 10 days after Buyer notifies Seller in writing that Buyer is ready to consummate and close this Agreement. Provided, however, this transaction shall be closed no later than ____________, unless the parties agree in writing to an extension. 10. DEFAULT: If either party defaults in the performance of their obligations under the terms of this Agreement, the non-defaulting party may seek any remedy in law or in equity, including, but not limited to, specific performance of this Agreement. However, if all contingencies of this Agreement requiring Seller’s actions have not been fulfilled by the closing date, the Buyer may, at Buyer’s option, proceed with the closing and waive such non-performance. 11. BINDING CONTRACT: This Agreement shall become effective upon execution by the later party to sign and shall be binding upon the parties’ successors, executors, heirs, administrators and assigns. This Agreement shall be controlled, construed and enforced in accordance with the laws of the State of Ohio. Time is of the essence in the performance of all obligations of each of the parties under this Agreement. 12. NOTICES: Communications concerning the parties shall be forwarded to their addresses shown below.

13. COUNTERPARTS: This Agreement shall be executed in triplicate and may be executed in counterparts by the various parties. Executed counterparts shall be valid in the same manner as though all parties to the Agreement had executed the same instrument. 14. ENTIRE AGREEMENT: This Agreement constitutes the parties’ entire agreement and there are no representations, oral or written, which have not been incorporated herein. Time is of the essence in all provisions of this Agreement.

A RESOLUTION GRANTING A CONSERVATION EASEMENT FOR THE BEAVER CREEK WETLANDS ASSOCIATION

Trustee ______________ moved the adoption of the following resolution: WHEREAS, on September 24, 2018 the Beavercreek Township Trustees received a request from the Beaver Creek Wetlands Association for support of their grant application to the Clean Ohio Green Space Conservation Program to restore land to native plant communities with walking trails; and WHEREAS, the property is owned by Beavercreek Township, parcel number B03000200310001600; and WHEREAS, the Beavercreek Township Trustees reviewed the request for support of the application and passed a Resolution on October 8, 2018 supporting the grant application; and WHEREAS, the Beaver Creek Wetlands Association received a grant award of $110,338.00 from the Clean Ohio Green Space Conservation Program; and WHEREAS, the grant award requires a Conservation Easement on the property. NOW THEREFORE BE IT RESOLVED THAT, the Board of Trustees of Beavercreek Township, Greene County, Ohio hereby authorize the Township Administrator to execute a Conservation Easement Agreement for the property owned by Beavercreek Township, parcel number B03000200310001600. This Conservation Easement, located in Beavercreek Township, will protect the restored land of native plant communities and provide a new opportunity for Township and County residents to enjoy the Beaver Creek Wetlands.

CONSERVATION EASEMENT

This Conservation Easement (the “Easement”), dated the ___ day of _____, 2019, is made and entered into by and between Beavercreek Township Board of Trustees, Greene County, Ohio, 851 North Orchard Lane, Suite C, Beavercreek, Ohio 45434 (“Grantor”), Beaver Creek Wetlands Association, P.O. Box 42, Alpha, Ohio 45301-0042 (“Grantee”, being the Applicant for Clean Ohio Conservation Funds), acting pursuant to Ohio Revised Code (“R.C.”) Sections 5301.67 through 5301.70, and the Ohio Public Works Commission, 65 East State Street, Suite 312, Columbus, Ohio 43215 (“OPWC”), as its interest may appear herein, for the purpose of preserving the property described herein as open space in perpetuity.

This is an agreement for the sale and purchase of a conservation easement and the monitoring and enforcement of that easement. Specifically, the Grantor agrees to convey and the Grantee agrees to purchase the Easement for One Dollar ($1.00) and[DF1] be the holder of the Easement. The Grantee, its successors and assigns, agree to monitor the property described herein in perpetuity and assist with the enforcement of the terms of this Easement. The OPWC agrees to enforce the terms of this Easement, as necessary.

Recitals

A. Grantor is the owner in fee simple of real property located in Greene County, Ohio, as more specifically described in Exhibit A which is attached hereto and made a part hereof (“Protected Property”), pursuant to instruments recorded at Greene County Official Records Volume __, Page ___.

B. Pursuant to the Ohio Public Works Commission Project Grant Agreement dated [date], 20__ (the “Agreement”), Grantee received a grant from the State of Ohio, acting by and through the Director of the OPWC, pursuant to R.C. 164.20 et seq. (the “Grant”). As a condition of receiving the Grant, Grantee must use the Grant funds to purchase an easement on and restrict the use of the Protected Property to open space, as further set forth herein.

C. In order to fulfill Grantee’s obligations under the Agreement, Grantee must record a conservation easement in order to maintain the Protected Property as open space in perpetuity.

D. Grantee is an entity authorized to receive conservation easements under R.C. 5301.69.

NOW THEREFORE, the parties hereto, for themselves and their successors and assigns, hereby agree to the following:

1. Granting Clause. Grantor, for the consideration set forth above and the mutual promises, conditions and restrictions set forth herein, conveys to Grantee a perpetual conservation easement, as defined by R.C. 5301.67(A), on the Protected Property. The Grantor warrants that Grantor has full authority to grant this Easement, has good and indefeasible fee simple title to the Protected Property described in Exhibit A, that the legal description in Exhibit A is complete and accurate to the best of Grantor’s knowledge, and that the Protected Property is free and clear of all liens and encumbrances that are inconsistent with the purpose of this Easement set forth herein. Grantor agrees to defend title to the Protected Property against all lawful claims of all persons.

2. Purpose. It is the purpose of this Easement (“Purpose”) to assure that the Protected Property will be maintained as open space, as defined by R.C. 164.22 (A) and the attached Exhibit B-Conservation Purpose and Conversation Values, by preserving and protecting the land through a perpetual restriction on the use of the Protected Property.

3. Responsibilities of the Grantor. The Grantor shall be responsible and perform all of the following obligations:

a. Grantor shall be responsible for payment of all taxes and assessments levied against the Protected Property.

b. Grantor shall be responsible for the upkeep and maintenance of the Protected Property.

4. Responsibilities of the Grantee.

a. Grantee shall take all reasonable and necessary steps for the diligent enforcement of the terms of this Easement.

b. Grantee shall conduct annual monitoring of the Protected Property to ensure compliance with the terms of this Easement. Grantee shall provide notice to the Grantor of its intent to enter the Protected Property for purposes of the required annual monitoring.

c. Grantee shall conduct investigations of any violation or potential violation of this Easement

and take appropriate enforcement action. Grantee shall notify the OPWC of any violation or alleged violation. The OPWC reserves the right to conduct an inspection of the Protected Property and enforce the terms of this Easement as set forth in Paragraph 8 below.

5. Restrictions. The parties hereby agree, for themselves and their successors and assigns as future

owners of the Protected Property that the Protected Property shall be subject to the following restrictions:

a. The Protected Property shall be maintained as open space.

b. Use and development of the Protected Property must emphasize the following:

i. The support of comprehensive open space planning and incorporation of aesthetically pleasing and ecologically informed design;

ii. The protection of habitat for rare, threatened, and endangered species or the preservation of high quality, viable habitat for plant and animal species;

iii. The preservation of existing high quality wetlands or other scarce natural resources

within the geographical jurisdiction of a council;

iv. The enhancement of educational opportunities and provision of physical links to schools and after-school centers;

v. The preservation or restoration of water quality, natural stream channels,

functioning floodplains, wetlands, streamside forests, and other natural features that contribute to the quality of life in Ohio and to the state’s natural heritage;

vi. The reduction or elimination of nonnative, invasive species of plants or animals; and

vii. The proper management of areas where safe fishing, hunting, and trapping may take

place in a manner that will preserve a balanced natural ecosystem.]

c. As specifically set forth in the Agreement, Grantee shall use the Grant funds to as specified and set forth in the Grant awarded by the Ohio Public Works Commission.

6. Prohibited Uses. Activities on or use of the Protected Property inconsistent with the Purpose of this Easement are prohibited. The following activities and uses are expressly prohibited on the Protected Property, except as otherwise set forth herein:

a. Construction/Development. There shall be no construction of new buildings or structures

or placing of any dwelling, residence, building, athletic or recreational structure, landing strip, helicopter pad, fence or sign, asphalt, concrete pavement, billboard or other advertising display, antenna, utility pole, tower, conduit line, or any other temporary or permanent structure or facility on the Protected Property without the express, prior written consent of OPWC.

b. Commercial and Industrial Activity. There shall be no commercial or industrial activity undertaken or allowed on the Protected Property. No right of passage shall be granted or retained across or upon the Protected Property if that right of passage is used in conjunction with such prohibited activities.

c. Mining and Mining Operations. Mining or extraction of soil, sand, gravel, oil, natural gas, minerals or other material is prohibited. Any activities associated with mining operations, including drilling, excavating, and transportation of any mined material by vehicle, pipeline, or other means, are also prohibited on or across the Protected Property.

d. Hydromodification. Hydromodification projects such as dams, dredging, channelization,

sedimentation, and bank clearing are prohibited on the Protected Property except as needed to improve the flow or retention of water consistent with the purpose and values of the easement.

e. Water. There shall be no disturbance of streams or other bodies of water on the Protected Property. Grantor and Grantee shall not transfer, encumber, lease, sell, or otherwise separate water rights from title to the Protected Property itself except to improve the hydrology, limit erosion or other events that threaten the conservation purpose and values of the property.

f. Waste and Dumping. Dumping, accumulation, or storage of contaminated soil, non-compostable garbage, abandoned vehicles or parts, appliances, machinery, hazardous substances, or toxic or hazardous waste are prohibited.

g. Roads. There shall be no building of new roads, parking lots, or other paved surfaces, or the widening of such existing surfaces on the Protected Property without the express, prior written consent of OPWC.

h. Utility Services and Septic Systems. Activities described in the existing utility easements or rights-of-way on the Protected Property recorded in the Official Land Records in Greene County as of the date this Easement is recorded are permitted. Otherwise, the granting of easements or rights-of-way for power lines, gas lines, sewer lines, water lines, telecommunication towers, wind farms, or other similar types of utilities is prohibited.

i. Motorized Vehicle Use. There shall be no use of motor vehicles on the Protected Property or grant of permission for such use except as necessary as a means of maintaining the conserved values of the property (Example: mowing of the prairie), [, law enforcement and public safety purposes, or as deemed necessary and approved by the Grantee or Grantor. Additionally, for maintenance purposes only Grantor or Grantee may access the property from Blacksmith Lane.

j. Surface Alterations. There shall be no removal, filling, or other disturbances of soil surface, and no changes in topography, surface or subsurface water systems, wetlands, or natural habitat except as to improve or maintain natural conditions as stated in the Conservation Purpose and Values, or to maintain intended enhancements made as part of the restoration process.

k. Any deed restriction as specified on the record plan.

7. Grantor’s Reserved Rights. Grantor reserves for itself, its successors and assigns, all rights and privileges as owner of the Protected Property to use the Protected Property for all purposes that are not expressly prohibited by this Easement and are not inconsistent with the Purpose of this Easement. The following rights are expressly reserved by the Grantor:

a. Conveyance. Grantor may sell, give, mortgage, lease or otherwise convey the Protected

Property, provided that such conveyance is made subject to this Easement and written notice is provided to Grantee and the OPWC in accordance with Paragraph 14 below.

b. Signage. Grantor may place interpretive signs, such as signs identifying that the Protected

Property is protected by this Easement, or signs identifying prairie habitat improvements, as well as “no hunting,” “no trespassing” or similar signs on the Protected Property.

8. Rights and Remedies of Grantee and the OPWC. In order to comply with and enforce the terms of this Easement, the Grantee and the OPWC shall have the following rights and remedies:

a. Right of Entry. Grantee shall have the right to enter the Protected Property in a reasonable

manner and at a reasonable time, with advance notice to the Grantor, for the purposes of: (i) inspecting the Protected Property to determine if Grantor is complying with the provisions of this Easement; and (ii) obtaining evidence for the purpose of seeking judicial enforcement of this Easement. OPWC shall have the right to enter the Protected Property after notifying Grantor as needed to exercise its rights pursuant to this Section 8 of this Easement. All notices to the Grantor under this Paragraph may be made either in writing or verbally, at the discretion of the party providing the notice.

b. Right of Enforcement. If Grantee, in its discretion, determines that a material and potentially irreversible violation of this Easement has occurred or is imminent, Grantee and/or the OPWC may take legal action, without prior notice to Grantor, to enforce the terms of this Easement, to enjoin the violation, and/or to require Grantor to restore the Protected Property to its condition prior to the violation. If Grantee determines that a minor, or reversible, violation has occurred or is threatened, and that such violation should be remedied or prevented, Grantee shall first inform Grantor in writing of the nature of the violation, and request Grantor to take corrective action to cure or avoid the violation and/or to restore any damage to the Protected Property that has occurred as a result of the violation. If Grantor fails to correct any such violation within a reasonable period of time (not to exceed 30 days), Grantee and/or the OPWC may take appropriate legal action to

enjoin the violation and/or to require Grantor to restore the Protected Property to its condition prior to the violation.

c. Right of Enforcement of the Ohio Public Works Commission. The restrictions set forth in this Easement shall be perpetual for the benefit of, and shall be enforceable by, the OPWC. The OPWC shall have the right to enforce all restrictions, conditions, and covenants of both Grantor and Grantee set forth herein by any proceedings at law or in equity. The OPWC may exercise this right of enforcement under any authority available under state or federal law if Grantee fails or is unable to enforce any of the terms of the Easement, as determined in the sole discretion of the OPWC Director. No delay or omission by Grantee or the OPWC in the exercise of any right or remedy shall impair such right or remedy or be construed as a waiver thereof.

d. Right to Recovery of Costs. The Grantee and/or the OPWC shall have the right to recover

from Grantor reasonable costs incurred in enforcing this Easement, including reasonable attorneys' fees and reasonable costs of restoration of the Protected Property. Grantor shall have no liability to restore the Protected Property with respect to damage caused by natural acts or other occurrences beyond Grantor's control.

e. Remedies. In the event that Grantee becomes aware of a violation of the terms of this Easement, Grantee shall give notice to Grantor at Grantor's last known post office address of such violation via certified mail, return receipt requested, with a copy to the OPWC, and request corrective action sufficient to abate such violation and restore the Protected Property to its previous condition. Failure by Grantor to cause discontinuance, abatement or such other corrective action as may be requested by Grantee within thirty (30) days after receipt of such notice shall entitle Grantee to enforce, by proceedings at law or in equity, the provisions of this Easement, including, but not limited to, the right to require the restoration of the Protected Property to its condition at the date of the recording of this Easement. Grantee shall not waive or forfeit the right to take action as may be necessary to ensure compliance with the terms and conditions of the Easement by any prior failure to act. If Grantee, in its sole discretion, determines that circumstances require immediate action to prevent or mitigate significant damage to the intended use of the Protected Property, Grantee may pursue its remedies under this Section 8(e) without prior notice to the Grantor or without waiting for the period for cure to expire. Nothing herein shall be construed to entitle Grantee to institute any enforcement proceeding against the Grantor for any changes to the Protected Property due to acts or other occurrences beyond the Grantor’s control, such as changes caused by fire, flood, or storm. Grantor shall notify Grantee of any occurrence which would adversely affect or interfere with the Purpose of this Easement, whether caused by the acts or omissions of Grantor or third parties.

f. Other Remedies. Grantee shall be entitled to seek expedited injunctive relief to enforce its rights with respect to the Protected Property, and Grantor waives any bond requirement otherwise applicable to any petition for such relief. Grantee shall have the right to report to regulatory authorities any environmental conditions or any potential or actual violations of environmental laws, including noxious weed laws, with respect to the Protected Property. In the event Grantor or Grantee becomes involved in legal proceedings against the other to enforce such party’s respective rights or interests under this Easement, the prevailing party shall be entitled to receive from the non-prevailing party reasonable attorneys’ fees incurred in connection with any such proceedings. However, the immediately preceding sentence shall not apply to the OPWC if the OPWC exercises its rights under this Easement.

9. Perpetual Burden and Modification of Easement. This Easement shall run with and burden the Protected Property in perpetuity and shall bind the Grantor and the Grantee, their heirs, successors, agents, and assigns. This Easement shall not be amended, released, extinguished or otherwise modified without the prior written consent of the OPWC, which consent may be withheld in its sole and absolute discretion.

10. Liquidated Damages. If Grantor, or its successors or assigns as owner of the Protected Property, as described in Exhibit A, fails to observe the conditions and restrictions set forth herein, Grantor or it successors or assigns as applicable shall pay to the OPWC, upon demand, as liquidated damages, an amount equal to the sum of the following: (a) an amount equal to all Grant funds disbursed to Grantee; and (b) liquated damages equal to one hundred percent (100%) of the funds disbursed by the OPWC together with interest accruing at the rate of six percent (6%) per annum from the date of the award of the Grant. Grantor acknowledges that such sum is not intended as, and shall not be deemed, a penalty, but is intended to compensate for damages suffered in the event of a violation of this Easement, the determination of which is not readily ascertainable. Failure by the OPWC to proceed with such enforcement shall in no event constitute a waiver of the right to enforce the original violation at a later date or a subsequent violation.

11. Transfer of the Easement. Grantor and Grantee acknowledge that the Grant for this Easement is specific to Grantee and that the OPWC’s approval of Grantee’s application for the Grant was made in reliance on Grantee’s continued ownership and control of the easement through its successors and assigns. Accordingly, Grantee shall not voluntarily or involuntarily sell, assign, transfer, lease, exchange, convey or otherwise encumber the easement without the prior written consent of the OPWC which consent may be withheld by either in their sole and absolute discretion, and with notice to the Grantor. If Grantee fails to observe this condition, Grantee shall pay to the OPWC, upon demand, as liquidated damages, the amount set forth in paragraph 10 above.

12. Severability. Each provision of this Easement is independent of and severable from the remainder of this Easement. If any provision contained herein shall be held to be invalid or unenforceable, or not to run with the land, such holding shall not affect the validity or enforceability of the remaining provisions of this Easement.

13. Notices. Notices or any communication relating to this Easement shall be in writing and shall be sent certified or registered mail, return receipt requested, or by other national overnight courier company. Notices or communications may also be personally delivered. Notice shall be deemed given upon receipt or refusal to accept delivery. Each party hereto shall notify the other parties of a change of address according to the provisions of this paragraph. The notice addresses of the parties are as follows:

Status: Non-Exempt Essential Functions of the Position:

1. Responsible for supervising employees, managing staffing levels, monitoring their staff hours, employee scheduling employees and entering payroll information.

2. Must exercise judgment in the organization. Monitors and observes departmental activities for adherence to professional standards, township policy and procedure manual, department rules and standard operating procedures.

3. Coordinates and implements the training activities of personnel assigned to the shift.

4. Supervises the implementation of pre-fire planning, hydrant testing, annual hose testing

and apparatus testing.

PERMITS: Three permits were issued in this period for single-family dwellings. Other Zoning permits issued were for one residential addition and one commercial accessory structure.

The following chart compares numbers of Zoning Permits issued for the last nine years. Totals through 2018 are year-end totals. 2019 totals are through 02/20/19. The revenue line is the amount generated by Zoning Department fees during the calendar year.

PENDING: ODOT has announced the intention to award the contract for the Super Streets project. The bids for the Shakertown Road project were due to the City of Beavercreek on Feb.15. ODOT has hired a consultant for final design and ROW acquisition for the Valley-Trebein interchange project. Phases four and five of River West (Scarborough) are under revision. The OU/Russ Research Center has announced ambitious plans; site planning meetings have been scheduled. The Mosher Machine Site Plan has been approved, Zoning permit application is pending.

The fire department is requesting that the Board accept the donation of children’s books for public education events, valued at $1,500, from Ms. Kaitlyn McGee.

2.1 Description: This is a request to purchase 72 annual renewal licenses plus an additional 9 licenses to the “Health and Safety Institute” on-line EMS and Fire training program for $3163.86.

The State of Ohio requires that each paramedic complete a minimum of 86 hours of continuing education in every three-year re-certifying cycle. The Beavercreek Township Fire Department utilizes a variety of methods to ensure that its personnel receive the required continuing education. The purchase of the listed on-line continuing education training allows for continued training and development of personnel and their EMS skills through access to online training for approved Continuing Education (CE’s) credits. This online service also allows for members to obtain CE’s for Fire Fighter and Fire Inspector re-certification at no additional cost.

3 Purchase Request for Blue Card Instructors, equipment, and program renwal

3.1 Description: This is a request to maintain the Blue Card Program for a cost of $17,488.40 This purchase is a planned and budgeted need.

3.3 Requirements: This request will assist in compliance with sections of OAC 4123:1-21-07 Fire department occupational safety and health, it continues the partial fulfillment of the Township’s 2014 Performance Audit, NFPA 1201 (2015 edition) The Standard for Providing Fire and Emergency services to the public, and NFPA 1021 (2014 edition) The Standard for Fire Officer Professional Qualifications.

3.5 Explanation: At the regularly scheduled Board meeting on 2015-03-02, the Board approved resolution 2015-098 to purchase the Blue Card Incident Command certification program. The request below will allow us to maintain the Blue Card Program as approved in 2015. The items requested are at or below the recurring costs cited in the original request. To continue the Blue Card Incident Command program, we have the annual need to renew our instructors, the Fire Chief and Township Administrator CEU modules, and the RMS. Over the

three years we showed that using our own instructors and the RMS is the most cost-effective way for us to keep our personnel’s certification current. The purchase through Blue Card will allow us to continue to provide the required training for the firefighters and officers that have completed the program. The renewal of the instructors will cost $2400, the Fire Chief and Township Administrator CE access will cost $100.00 each, and the RMS will cost $1328.40 for a total of $3,928.40. This includes a 20% bundle discount and a proration for those that were certified later in the year. The savings this year is $1049.60. At the regularly scheduled Board meeting on 2016-01-19, the Board approved resolution 2016-031 to train and maintain 3 fire department members as Blue Card Instructors. To prepare for retirements in the next two years, and to help with the increasing workload of our Blue Card Instructors, we are requesting to certify three more Blue Card instructors at a cost of $4,500 each for total of four by the end of 2020. This class is offered in Phoenix, AZ. However, to save on travel expenses, we have arranged to hold the same class in Beavercreek in September of 2019. There are three older iPads in the program that have been repurposed twice and are past their expected life cycle. Since we first instituted the program, we have used these three older iPads, we received three iPad as part of the first instructor class, and we bought two new iPads for a total of eight iPads. The three older iPads need replacement. We will receive three new iPads this September with the three new instructors saving us a $1,200 purchase. Our request is to decommission the three old iPads after receiving the new pads in September. Also, the new iPads will need new covers; the covers will protect the equipment while in use and being stored. Our request is to buy three new covers that match existing covers, not to exceed $60.00 total.

Alternate Delivery: A Blue Card instructor through a Command Training Center (CTC) must perform continuing education training. A local CTC would charge $2500 to teach a session that would provide four continuing education hours for each member. We would need a training session each quarter. Their services would cost us $10,000 per year to provide the training needed to maintain our members’ recertification requirements.

Recurring Costs: There is an annual reoccurring cost with the instructor and RMS renewal. The instructor renewal for four instructors is $2800. The RMS will cost $21.60 per person for a total of $1382.40. This price includes a 20% discount for bundling instructor and RMS.

4 Purchase Request for strategic planning services from CPSE

4.1 Description: This purchase request is for strategic planning services from CPSE in the amount of $16,800.

4.5 Explanation: The fire department is seeking assistance with strategic planning for two primary reasons. First and foremost is timeliness. A strategic plan is a key factor in ensuring that the correct funding strategy is in place to meet our operational and strategic needs for the levy in November. Secondly, while many of our personnel have participated in the strategic planning process 10-11 years ago, no one internally has the skill sets required to facilitate the process. The CPSE provides Technical Advisor Program (TAP) whose role is to provide guidance through specific aspects of the accreditation process. Their goal is to guide an agency through these processes teaching the agency how to conduct the processes internally in the future. This proposal guides the fire department through the strategic planning process producing both completed strategic plan and training personnel with the ability to facilitate a strategic planning process. Some of the major steps in the process include: CPSE facilitated internal and external stakeholder meetings, mission identification, SWOT analysis, goal and objective development, and plan implementation over a four-day period. There are several factors for seeking to use the CPSE TAP to guide the department through the process the first time: first and foremost is the credibility of the process offered by independent facilitation; secondly is the educational component for our personnel enabling us to lead future processes internally; and timeliness (60-90days), as we need to have a completed strategic plan to assist with the levy planning. The CPSE also offers other advisory services that correspond with the strategic planning and accreditation processes should we need them. The CPSE also directly aligns with the accreditation process. We did receive and review a proposal from the Ohio Fire Chiefs Association (OFCA) for strategic planning. While their proposal is significantly lower, their time frame is longer and there is some unfacilitated work required on the front end. The CPSE process offers facilitation for those steps that the OFCA does not.
