Behar 5778 Yuvel Redemption of Land, Contemporary Poverty and Plzen Rabbi Aaron Goldstein 12 May 2018 Our Torah portion and accompanying Haftarah require just a little bit of unpicking. The context is the instruction of the Yuvel – the Jubilee Year. Every 50th year, all tribal property that had exchanged hands during the intervening years would be returned to the original holder, according to the Divine plan for the distribution of the Land of Canaan among the Israelite Tribes. As well as land, those who fell on hard times would become enslaved to their kin but at the Jubilee gained their freedom It was a wonderfully idealistic notion and there is little evidence that it was widely practised as the entire economic system would grind to a halt. Either way, the provision was there to preserve a ‘family’ title to the land it owns or was awarded as a hereditary portion by God. An extreme example of this is presented to the prophet Jeremiah in approximately 588 BCE. The Babylonian had besieged Jerusalem and because Jeremiah had given unpopular counsel to the king, he was imprisoned. From his cell in what would have been the most horrendously inhumane conditions, according to the stricture of the Law we have just read, he is required to redeem land that was worthless as it was sure to be conquered by the Babylonians. “Then the word of the Eternal came to Jeremiah, “I am the Eternal, the God of all flesh – is anything too difficult for Me?” (Jeremiah 32:26-27)” We are fortunate to live in peaceful times, in our own homes and without too many material concerns. Whilst that is true for most in our Congregation, the future is less certain for our grand / children and right now for others in the UK, homelessness rather than home ownership is a more real experience; skipping meals, living without warmth and with children facing a lifetime of poverty. It is a situation worthy of a Jeremiah prophecy. This is a challenge to our society and demands serious thought from those behind policy. The current lull and relative wealth in our country are unsustainable. We need those who are able to think, then act in a seemingly impossible situation. Nothing is beyond the wit of humanity. The ancient inheritors of Torah Law understood that the Yuvel and other instructions were impracticable. Rabbi Hillel, created a legal fiction called the prosbul, to enable a fair loan system, a remedy to unrealistic Law. Nothing was beyond the partnership of the ideals of Divine Law and human ingenuity! When solutions are presented to us, we must be open to the necessity to give a little so that our legacy is hope and future to those besieged by a currently poverty inducing environment.
