2 THAT staff be directed to give the appropriate notice for a Special Meeting of City Council in order for public input to be received respecting the reviewof the 2006 Official Plan and that this meeting be held on February 4 2013 to fulfill the requirements of Section 26(1) of the Planning Act

3 THAT staff be directed to undertake an external scan of the Brampton community agencies partners and the Region of Peel to determine the potential scope and need for reviewing the 2006 Official Plan

4 THAT staff report back following the Special Meeting to summarize the results of public consultation in addition to presenting a terms of reference and a public engagement strategy for the Official Plan Review for further consideration by Council and

5 THAT the City Clerk be directed to provide a copy of this staff report and Council resolution to the Regions of Peel York and Halton Town of Caledon City of Vaughan City of Mississauga City of Toronto Town of Halton Hills Credit Valley Conservation and the Toronto amp Region Conservation Authority for their information

Background

The City of Brampton last initiated a review of its Official Plan in 2002 which resulted in the adoption of a new Official Plan by Council in June 2006 and partial approval by the Ontario Municipal Board in October 2008 Portions of the 2006 Official Plan remain under appeal to the Ontario Municipal Board The majority of these appeals are related to corridor protection in West Brampton and environmental policies It is expected that appeals to corridor protection will not be resolved until the planning for the Bram West Parkway and North South Transportation Corridor has significantly advanced to the stage where a corridor has been determined The majority of the environmental policies under appeal are expected to be resolved in 2013 as a hearing date has now been set by the Ontario Municipal Board

Section 26(1) of the Planning Act requires that every approved Official Plan be considered for revision not less frequently than every five years by holding a Special Meeting of City Council that is open to the general public In addition the provincial Growth Plan (Places to Grow) requires a review of growth management issues on a five year cycle While Brampton has completed the planning for the Growth Plan Review that resulted in Council endorsing OPA 43 in June 2010 the implementation phase is still ongoing with the matter now before the Ontario Municipal Board With the recent release of the new growth forecasts by the Province for the horizon years 2036 and

2041 the City will eventually need to amend its Official Plan to conform to the Growth Plan by adding new City-wide forecasts for Brampton following the final approval of the Growth Plan Amendment

As land use planning is constantly an evolving function driven by multiple statutes and informed by continuous improvement of past practices the timely and systematic review of the Official Plan contributes to good governance that is responsive to local issues while conforming to Provincial plans and polices

Therefore the purposes of this report are to

bull Provide an introduction to the Official Plan Review

bull Set out the requirements for reviewing the 2006 Official Plan and bull Suggest the general scope of the review that should be undertaken by the City

Current Situation

An Official Plan is the primary strategic document that guides land use and development within a municipality Official Plans contain goals and objectives of the community and establish policies to direct the form extent nature and rate of growth and change Official Plans are generally designed to guide community decisions for a set period of time (usually 20 years) Official Plans have legal status and derive their authority from the Planning Act of Ontario

The five year review of the Official Plan is a major undertaking The scope of the review must be carefully defined in order to identify the resources that will be required to establish a realistic timeline for completion

The minimum content requirements for Official Plans are established by the Planning Act The Act helps to identify the basic scope of the Official Plan Review by listing matters of Provincial interest (see Appendix A) In addition the Planning Act also confirms the role of Provincial plans and policies in guiding local municipal planning direction In Bramptons case the Official Plan will have to conform to the Greenbelt Plan the Growth Plan the Provincial Policy Statement and the Region of Peel Official Plan All are influential in the Brampton planning environment

In addition to minimum OP content requirements under the Planning Act the decision to engage in an Official Plan review involves two primary considerations The first consideration is the basic need to review the Official Plan while the second

consideration is focused on determining the actual scope of the review

Establishing Need

The purpose of the Special Meeting required by the PlanningAct is to determine the need for reviewing the Official Plan To assist with the process of considering the need to review the 2006 Official Plan staff will consult with public agencies involved in the land use planning process for their preliminary input prior to the Special Meeting of Council

Formal notice of the Special Meeting will be placed in the Brampton Guardian and published for at least two consecutive weeks 30 days prior to the date of the Special Meeting in accordance with the requirements of the Planning Act To supplement the newspaper notice an announcement of the public meeting will be posted on the Citys Web Page and the Brampton Board of Trade Newspaper In addition the City will hold open houses to introduce the Official Plan review to seek early public input prior to the Special Meeting of Council

Upon receiving the publics input at the Special Meeting and considering any written submissions that are filed with the City staff will prepare a follow-up report to Council that advises on the need to review the 2006 Official Plan and to confirm its scope

Determining Scope

In addition to the Special Meeting of Council determining the scope of the review of the 2006 Official Plan will also be informed by undertaking an internal scan of City Departments and advisory committees and reaching out to the Brampton community public agencies partners including the Region of Peel

Once the need for reviewing the Official Plan has been established staff will focus on the issues to be addressed as part of the review

The 2006 Official Plan is based on a comprehensive review that commenced in 2002 and eventually resulted in its partial approval by the Ontario Municipal Board in October 2008 Staff considers the general policy and land use framework of the 2006 Official Plan to be current Full conformity with the Growth Plan and the Region of Peel Official Plan will soon be achieved with the implementation of OPA 43 (Bramptons Growth Plan Amendment)

At this time staff suggests that a comprehensive review of the 2006 Official Plan is not necessary and that a scoped approach whereby the review will be limited to a select group of targeted issues is more appropriate Staff has identified following preliminary

ampgts issues that would form the basis of the next review and expect the list to be refined following public consultation

bull The need to add policies and designations to the Official Plan for lands located in the Greenbelt Plan Staff was awaiting the implementation of the Regions Greenbelt conformity review which was approved as part of ROPA 24 before commencing with a review of the Citys OP

bull In accordance with the Council resolution of June 2010 undertake a review of

the Official Plans employment policies to identify strategies dealing with policies zones and implementation mechanisms to best further the Citys long term vision for viable prosperous employment lands of quality design

bull The City has received a number of inquiries regarding the potential to permit higher density housing on the remaining undeveloped parcels of land in the Toronto Gore The OP review presents the opportunity for the City to review the potential for permitting urban residential densities on full municipal services that are compatible with the existing estate residential community

bull Undertake a retail policy review recognizing that the current retail policy framework of the Official Plan is based on a study undertaken almost 10 years ago

bull Undertake a Municipal Comprehensive Review to determine whether the policies of the Official Plan can be satisfied for employment land conversion for a property located in the Nexus Avenue and Fogal Road area of the Bram East Secondary Plan

bull Determine whether the Official Plan contains sufficient policy direction on planning for Healthy Communities Sustainability and Active Transportation

bull Review the Official Plan to determine if sufficient policies are present to protect the established character of Bramptons existing neighborhoods

bull Review the policies for crematoriums based on the release of new provincial regulations

bull Whether limited outdoor storage permissions in conjunction with a fencing business should continue to be permitted for the property known as 110 Kennedy Road South and

bull A variety of general housekeeping matters

In addition there are a number of policy studies and reviews that are either underway or planned to begin within the next year that could have a possible impact on the Citys Official Plan Depending on timing the implementation of these studies and reviews could be added to the Official Plan Review or implemented separately with any revision to the Official Plan brought forward by staff as individual official plan amendments as the work is completed This would include notice to amend the Official Plan and the

convening of a statutory public meeting in accordance with the requirements of the Planning Act At this time the list of studies and reviews include

bull Review of the 2005 Provincial Policy Statement bull Region of Peel Official Plan Review which is expected to commence in 2013 bull Growth Plan Population and Employment Forecasts for 2036 and 2041 bull City of Brampton Natural Heritage and Environmental Management Strategy bull Update of the Cityof Brampton 2009 Transportation ampTransit Master Plan which

will include an active transportation component and bull Update of the Citys Development Charge By-Law

Process Considerations

Municipal effort involved in an Official Plan Review typically follows a process similar to the chart attached hereto as Appendix B The chart shows the major steps involved from initiation of the review to completion It does not cover the subsequent steps of Regional approval and possible appeals to the Ontario Municipal Board

Given Councils commitment to public consultation determining a strategy to engage the community will be a very important to define early on in the review Decisions made as part of the engagement strategy will determine the parameters for a communications plan to be implemented throughout the review

Once the need for and scope of the Official Plan review has been determined staff will prepare a work plan that indicates key milestones resources and a timeline to complete the review The work plan will integrate the elements of the communications plan and will also provide a protocol to guide relationships with the respective agencies partners and the Region of Peel

Staff will present a detailed report to Council following the Special Meeting of Council regarding the proposed scope of work and a preliminary work plan for the Official Plan Review before proceeding to with the review

It is also proposed that as policy choices are being assessed discussion papers or policy direction reports will be issued for review and endorsement by Council prior to drafting new policy As these reports will be discussed in open session they will serve to keep stakeholders informed as to the progress of the review

Once draft policies are ready for review public consultation will occur in accordance with statutory requirements and with the communications strategy This consultation

will occur before an amendment revising the Official Plan can be adopted by Council Public consultation will also assist in facilitating support for any new policy directions that may arise

Next Steps

Following the Special Meeting of Council staff will prepare a report that advises on the need to review the 2006 Official Plan Review and its proposed scope This report will also present the results of an external scan of the community including public agencies and partners that will inform the type of review to be undertaken Internal City Departments and the Region of Peel will also be consulted

In following up staff will prepare a work plan for the Official Plan review that identifies both staffing and financial resources required to undertake and complete the review in a timely manner A public communications strategy will also be presented and will identify key components of engaging the community

Conclusion

The five year review of the Official Plan is a major undertaking Careful consideration of public input early on in the process will assist staff in determining the scope of the review Therefore staff is seeking direction from Council to hold a Special Meeting to determine the publics reaction to reviewing the 2006 Official Plan

In undertaking a preliminary scan of the 2006 Official Plan staff has identified a number of key issues that need to be addressed to keep the document current and strategically relevant At this time review is intended to be scoped in nature and focus on targeted issues This scope of the review will be confirmed following consultation with City Departments external agencies and partners including the Region of Peel

Content Guidance for Official Plans under the Planning Act

Section 16 of the Planning Act provides that Official Plans contain goals objectives and policies established primarily to manage and direct physical change and the effects on the social economic and natural environment It also provides that Official Plans contain a description of the measures and procedures proposed to attain the objectives of the plan

Of perhaps equal importance Section 2 of the Act provides that municipal councils in carrying out their responsibilities under the Act have regard to a number of matters of Provincial interest These matters of Provincial interest drive the more detailed content of Official Plans They include

The protection of ecological systems The protection of agricultural resources The conservation and management of natural resource and the mineral resource base

The conservation of features of significant architectural cultural historical archaeological or scientific interest The supply efficient use and conservation of energy and water The adequate provision and efficient use of communication transportation sewage and water services and waste management systems The minimization of waste

The orderly development of safe and healthy communities The accessibility for persons with disabilities to facilities and services The adequate provision and distribution of educational health social cultural and recreational activities

The adequate provision of a full range of housing The adequate provision of employment opportunities The protection of the financial and economic well-being of the Province and the municipality The co-ordination of planning activities of public bodies The protection of public health and safety The appropriate location of growth and development The promotion of development that is designed to be sustainable to support public transit and to be oriented to pedestrians

2041 the City will eventually need to amend its Official Plan to conform to the Growth Plan by adding new City-wide forecasts for Brampton following the final approval of the Growth Plan Amendment

As land use planning is constantly an evolving function driven by multiple statutes and informed by continuous improvement of past practices the timely and systematic review of the Official Plan contributes to good governance that is responsive to local issues while conforming to Provincial plans and polices

Therefore the purposes of this report are to

bull Provide an introduction to the Official Plan Review

bull Set out the requirements for reviewing the 2006 Official Plan and bull Suggest the general scope of the review that should be undertaken by the City

Current Situation

An Official Plan is the primary strategic document that guides land use and development within a municipality Official Plans contain goals and objectives of the community and establish policies to direct the form extent nature and rate of growth and change Official Plans are generally designed to guide community decisions for a set period of time (usually 20 years) Official Plans have legal status and derive their authority from the Planning Act of Ontario

The five year review of the Official Plan is a major undertaking The scope of the review must be carefully defined in order to identify the resources that will be required to establish a realistic timeline for completion

The minimum content requirements for Official Plans are established by the Planning Act The Act helps to identify the basic scope of the Official Plan Review by listing matters of Provincial interest (see Appendix A) In addition the Planning Act also confirms the role of Provincial plans and policies in guiding local municipal planning direction In Bramptons case the Official Plan will have to conform to the Greenbelt Plan the Growth Plan the Provincial Policy Statement and the Region of Peel Official Plan All are influential in the Brampton planning environment

In addition to minimum OP content requirements under the Planning Act the decision to engage in an Official Plan review involves two primary considerations The first consideration is the basic need to review the Official Plan while the second

consideration is focused on determining the actual scope of the review

Establishing Need

The purpose of the Special Meeting required by the PlanningAct is to determine the need for reviewing the Official Plan To assist with the process of considering the need to review the 2006 Official Plan staff will consult with public agencies involved in the land use planning process for their preliminary input prior to the Special Meeting of Council

Formal notice of the Special Meeting will be placed in the Brampton Guardian and published for at least two consecutive weeks 30 days prior to the date of the Special Meeting in accordance with the requirements of the Planning Act To supplement the newspaper notice an announcement of the public meeting will be posted on the Citys Web Page and the Brampton Board of Trade Newspaper In addition the City will hold open houses to introduce the Official Plan review to seek early public input prior to the Special Meeting of Council

Upon receiving the publics input at the Special Meeting and considering any written submissions that are filed with the City staff will prepare a follow-up report to Council that advises on the need to review the 2006 Official Plan and to confirm its scope

Determining Scope

In addition to the Special Meeting of Council determining the scope of the review of the 2006 Official Plan will also be informed by undertaking an internal scan of City Departments and advisory committees and reaching out to the Brampton community public agencies partners including the Region of Peel

Once the need for reviewing the Official Plan has been established staff will focus on the issues to be addressed as part of the review

The 2006 Official Plan is based on a comprehensive review that commenced in 2002 and eventually resulted in its partial approval by the Ontario Municipal Board in October 2008 Staff considers the general policy and land use framework of the 2006 Official Plan to be current Full conformity with the Growth Plan and the Region of Peel Official Plan will soon be achieved with the implementation of OPA 43 (Bramptons Growth Plan Amendment)

At this time staff suggests that a comprehensive review of the 2006 Official Plan is not necessary and that a scoped approach whereby the review will be limited to a select group of targeted issues is more appropriate Staff has identified following preliminary

ampgts issues that would form the basis of the next review and expect the list to be refined following public consultation

bull The need to add policies and designations to the Official Plan for lands located in the Greenbelt Plan Staff was awaiting the implementation of the Regions Greenbelt conformity review which was approved as part of ROPA 24 before commencing with a review of the Citys OP

bull In accordance with the Council resolution of June 2010 undertake a review of

the Official Plans employment policies to identify strategies dealing with policies zones and implementation mechanisms to best further the Citys long term vision for viable prosperous employment lands of quality design

bull The City has received a number of inquiries regarding the potential to permit higher density housing on the remaining undeveloped parcels of land in the Toronto Gore The OP review presents the opportunity for the City to review the potential for permitting urban residential densities on full municipal services that are compatible with the existing estate residential community

bull Undertake a retail policy review recognizing that the current retail policy framework of the Official Plan is based on a study undertaken almost 10 years ago

bull Undertake a Municipal Comprehensive Review to determine whether the policies of the Official Plan can be satisfied for employment land conversion for a property located in the Nexus Avenue and Fogal Road area of the Bram East Secondary Plan

bull Determine whether the Official Plan contains sufficient policy direction on planning for Healthy Communities Sustainability and Active Transportation

bull Review the Official Plan to determine if sufficient policies are present to protect the established character of Bramptons existing neighborhoods

bull Review the policies for crematoriums based on the release of new provincial regulations

bull Whether limited outdoor storage permissions in conjunction with a fencing business should continue to be permitted for the property known as 110 Kennedy Road South and

bull A variety of general housekeeping matters

In addition there are a number of policy studies and reviews that are either underway or planned to begin within the next year that could have a possible impact on the Citys Official Plan Depending on timing the implementation of these studies and reviews could be added to the Official Plan Review or implemented separately with any revision to the Official Plan brought forward by staff as individual official plan amendments as the work is completed This would include notice to amend the Official Plan and the

convening of a statutory public meeting in accordance with the requirements of the Planning Act At this time the list of studies and reviews include

bull Review of the 2005 Provincial Policy Statement bull Region of Peel Official Plan Review which is expected to commence in 2013 bull Growth Plan Population and Employment Forecasts for 2036 and 2041 bull City of Brampton Natural Heritage and Environmental Management Strategy bull Update of the Cityof Brampton 2009 Transportation ampTransit Master Plan which

will include an active transportation component and bull Update of the Citys Development Charge By-Law

Process Considerations

Municipal effort involved in an Official Plan Review typically follows a process similar to the chart attached hereto as Appendix B The chart shows the major steps involved from initiation of the review to completion It does not cover the subsequent steps of Regional approval and possible appeals to the Ontario Municipal Board

Given Councils commitment to public consultation determining a strategy to engage the community will be a very important to define early on in the review Decisions made as part of the engagement strategy will determine the parameters for a communications plan to be implemented throughout the review

Municipal effort involved in an Official Plan Review typically follows a process similar to the chart attached hereto as Appendix B The chart shows the major steps involved from initiation of the review to completion It does not cover the subsequent steps of Regional approval and possible appeals to the Ontario Municipal Board

Given Councils commitment to public consultation determining a strategy to engage the community will be a very important to define early on in the review Decisions made as part of the engagement strategy will determine the parameters for a communications plan to be implemented throughout the review

Once the need for and scope of the Official Plan review has been determined staff will prepare a work plan that indicates key milestones resources and a timeline to complete the review The work plan will integrate the elements of the communications plan and will also provide a protocol to guide relationships with the respective agencies partners and the Region of Peel

Staff will present a detailed report to Council following the Special Meeting of Council regarding the proposed scope of work and a preliminary work plan for the Official Plan Review before proceeding to with the review

It is also proposed that as policy choices are being assessed discussion papers or policy direction reports will be issued for review and endorsement by Council prior to drafting new policy As these reports will be discussed in open session they will serve to keep stakeholders informed as to the progress of the review

Once draft policies are ready for review public consultation will occur in accordance with statutory requirements and with the communications strategy This consultation

will occur before an amendment revising the Official Plan can be adopted by Council Public consultation will also assist in facilitating support for any new policy directions that may arise

Next Steps

Following the Special Meeting of Council staff will prepare a report that advises on the need to review the 2006 Official Plan Review and its proposed scope This report will also present the results of an external scan of the community including public agencies and partners that will inform the type of review to be undertaken Internal City Departments and the Region of Peel will also be consulted

In following up staff will prepare a work plan for the Official Plan review that identifies both staffing and financial resources required to undertake and complete the review in a timely manner A public communications strategy will also be presented and will identify key components of engaging the community

Conclusion

The five year review of the Official Plan is a major undertaking Careful consideration of public input early on in the process will assist staff in determining the scope of the review Therefore staff is seeking direction from Council to hold a Special Meeting to determine the publics reaction to reviewing the 2006 Official Plan

In undertaking a preliminary scan of the 2006 Official Plan staff has identified a number of key issues that need to be addressed to keep the document current and strategically relevant At this time review is intended to be scoped in nature and focus on targeted issues This scope of the review will be confirmed following consultation with City Departments external agencies and partners including the Region of Peel
