state bank of india and the architect, reserve the right to accept any tender, in part or in full or reject all tenders without assigning any reason thereof.

the rate quoted shall be inclusive of all taxes, duties, levies, octroi, works contract tax, vat, etc. and no extras will be paid on this account.

if the tenderer does not wish to quote for the work, the tender document as well as the drawings shall be returned to the office of m/s cooper and associates, on or before the last date of submission.

each page of the tender documents, including b.o.q., tender drawings, etc., must be signed by the tenderers as a token of having examined the same carefully.

the work is to be completed in all respects within 90 days from the date of issue of work order as time is of extreme essence here.

the earnest money will be returned to the unsuccessful tenderer after the intimation of rejection of the tender is sent. in the case of the successful tenderer, the earnest money will be retained and got converted as a part of total security deposit for the due performance of the contract. it will be dealt with as provided in the conditions attached to the tender.

earnest money deposit will be forfeited if the contractor:

a) after opening of the tender revokes his tender within the stipulated period or increases his earlier quoted rates;

b) in the event of any evasion, refusal, delay on the part of the contractor to sign and execute the contract in case his tender is accepted;

c) does not commence the work after it is awarded to him within the time specified in the letter of intent / work order or fifteen days from the issue of such letter, whichever is later.

unsealed tenders will not be accepted.

tenders with any conditions, additions, alternations. omissions, overwriting etc. will not be accepted. corrections if any should be dully signed.

work will be inspected and joint measurements will be taken by the bank engineer and certified by the architect before making final payments.

mode of measurements will be as per indian institute of architects guide line/bureau of indian standards.

contractors are requested to inspect the work site before quoting the rates.

in case of any municipal / local authorities or any other government bodies approval is necessary, it will be the contractors responsibility to obtain the same at his cost, based on the drawings submitted by the architect’s office.

on completion of work the contractor shall clean the entire premises to the bank's satisfaction prior to handing over the premises.

contractor shall acquaint himself with, the site conditions, local traffic regulations, local authority regulation, availability of material, labour law rules and quote the rate accordingly. no extra charge/ increase in the rate shall be considered on any account.

contractor will have to make his own arrangements for watch and warn at all times. bank will not be responsible for materials / work until official taken over by bank.

contractor or his authorized representative will attend all meetings and the decision taken in the meeting will be binding on the contractor.

free electric power/ water, required for execution, will be made available at one point in the premises. the contractor will have to make his own arrangements for carrying the same where ever required at his own cost.

at least 7 days curing is to be done for all cement concreting and brick work and plaster before proceeding further.

if rates quoted by the contractor are found inconsistent and overall quotation is abnormally low or high for any specific items, the architect and the bank reserves the right to reject such tenders, or ask for proper rectification to be done, even after the work has been allotted and the work is in progress.

the tenderers shall peruse carefully the instructions laid in general conditions of the contract and all other relevant documents before tendering for the work.

the approximate quantity of each type of work to be executed, is given with a view to enable the tenderer to quote his overall rate for each class of work in the tender form and for a uniform comparison of tenders. it shall be definitely understood that, both the client and the architect, do not accept any responsibility for correctness or completeness by omissions, deductions or additions and the same is at the discretion of accepting authority and the architect.

the client expects quality work, using best of the materials available in the market and employing best skilled workmen. further the contractor is instructed to bear in mind that only the materials specifically mentioned in the tender should be used.

only the architect is at a liberty to change the design or specifications to any other material. If the contractor changes specifications or design without the written consent of the architect, he will be required to remove the change and reinstate the original, at his own cost. further the contractor is requested to note that if any item is changed, after the receipt of work order, or during the progress of work, the contractor will be asked to give proportional discount, if the specification is reduced.

the offer shall be valid for a period of 180 days from the date of opening of the tender.

retention money from each running bill, an amount at the rate of 10% of the gross value of the running bill shall be recovered as retention money, till the total retention amount including the emd and isd amounts, already with the bank, become 5% of the value of the contract amount. this amount is called as total security deposit, which consists of three components :

emd – earnest money deposit

isd – initial security deposit

rm – retention money

the total security deposit will be kept with the bank. 50% of the total security deposit amount shall be refunded without interest to the contractor on issue of virtual completion certificate by the architect / premises dept. and the contractors’ removal of his materials, equipment, labour force, temporary sheds, stores, site office etc.

the remaining 50% of the total security deposit may be refunded 15 days after the end of the defects liability period, which shall be treated as twelve months from the date of virtual completion, provided he has satisfactorily carried out all the works and attended to rectification of all defects in accordance with the conditions of the contract.

the electrical and air-conditioning work if any, shall be carried out, by separate tender from contractors on approved panel of state bank of india. further the main contractor and the electrical and a.c. contractors, shall both be responsible to carry out the work together without hindering each other’s progress and / or damaging each other’s work. however, the main interior contractor shall be responsible to see that the overall work is not damaged in any respect and that it happens as per schedule and that there is no delay thereof. if either delay or bad workmanship is noticed, the contractor is to bring it to the notice of the bank and the architect.

appendix a

this agreement made this day 2017 between the state bank of india

(hereinafter called 'the employer' which expression shall include his heirs, executors, administrators and assigns) of the one part and

hereinafter called 'the contractor' which term shall include (his heirs, executors, administrators and assigns) as well as his personal representative of the other part.

whereas the employer has decided to do the proposed interior of treasury branch, solapur for state bank of india,

inclusive of the scope of work involves demolition of walls, dismantling of existing partitions and furniture, creation of new partitions, false ceiling, furniture, painting of walls, polishing etc. as mentioned in the b.o.q. attached herewith.

(hereinafter referred to as 'the works') and has caused drawings and specifications, describing the work to be done, to be prepared by m/s cooper and associates, of pune, as architects (hereinafter referred to as the architect) and whereas the said specifications and priced schedule of quantities, have been signed by or on behalf of the parties hereto and whereas the contractor has agreed to execute the work upon and subject to the conditions set herein (hereinafter referred to as "the said conditions"), the works, shown upon "the said drawings" and described in "the said specifications" and "the said priced schedule of quantities" at the respective rates mentioned in "the priced schedule of quantities".

whereas the contractor has deposited with the employer the sum of 1% of the total cost of the tender filled by him as earnest money and has given the employer a lien over such as retention money for the due fulfillment of this contract.

now therefore this agreement witnesseth and the parties thereto hereby agree as follows : 1. in this agreement and expressions shall have the same meanings as are respectively assigned to them in the conditions of contract hereinafter

referred to. 2. the following documents shall be deemed to form and be read, construed, as part of this agreement, namely.

a) the said tenders. b) the drawings. c) the conditions of contract (general and special) with attached appendices. d) the specification. e) the bills of quantities (only in respect of the description of work and rates contained therein). f) addenda to the tender documents, if any.

true copies of the above documents only attested by the executants of this agreement are attached herewith for the purpose of indentification.

3. in consideration of the payments to be made by the employer to the contractor as hereinafter mentioned the contractor hereby covenants with

the employer to construct, complete and maintain the works in conformity in all respects with the provisions of the contract. and as shown in the drawings and such further detail drawings, as may be furnished to him by the architects and described in the said specifications and the said priced schedule of quantities.….

4. the employer hereby covenants to pay the contractor in consideration of the construction, completion and maintenance of the works in contract price at the times and in the manner prescribed by the contract.

5. the term "the architects" in the said condition shall mean the said m/s. cooper and associates or in the event of their death or ceasing to be the architects for the purpose of the contract, such other person or persons as shall be nominated for the purpose by employer, not being a person to whom the contractor shall object for reasons considered to be sufficient by the employer. provided always that no persons subsequently appointed to be architects under this contract shall be entitled to disregard or overrule any decision or approval or direction given or expressed in writing by the architects for the time being.

6. the within plans, agreement and documents above mentioned shall form the basis of this contract and the decision of the said architects or other architects, for the time being, as mentioned in the conditions of contract in reference to all matters of dispute as to material, workmanship or account and as to the intended interpretation of the clauses of this agreement, or any other document attached hereto shall be final and binding on both parties and may be made rule of court.

7. the said conditions shall be read and construed as forming part of this agreement, and the parties hereto will respectively abide by and submit themselves to the conditions and stipulations and perform the agreement on their parts respectively in such conditions contained.

8. all disputes arising out of or in any way connected with this agreement shall be deemed to have arisen in pune and only the courts in pune shall have jurisdiction to determine the same.

9. in the event of any dispute arising concerning the details and specifications, the details and specifications mentioned in the tender will be treated as final.

10. in the event of any item of work not included in the schedule, the employer agrees to pay to the contractor, the actual cost of the item (cost of materials, labour and hire charge for plant and equipment) plus 15 % (fifteen percent) which shall include the contractor's overheads and profit.

11. the contractor shall, immediately upon starting the work, get the samples of all the teakwood, plys, particle boards, veneers, laminates to be used approved by the architect before bringing on site.

12. the contractor shall take care that all teakwood or any other wood used shall be well seasoned and no kucha wood should be used, under any circumstances, even for internal framing.

13. the contractor shall line out the entire work, inclusive of marking the positions of the electrical switch boards, etc., and get them approved by the architect and the electrical switch board and work from the electrical consultant, before commencing erection of any item.

14. the contractor shall within a week of commencing the work get the samples of all the fixtures and fittings, approved by the architect before bringing on site.

15. the contractor shall be responsible for writing out the detail measurement sheets and shall have the same checked by the architect.

16. the contractor shall give in writing to the client as well as the architect, when all the items to be supplied by the client, are to be brought on site.

17. the contractor should take special note that the items for flooring tiles, skirting, bathroom tiles and dado, as well as fixtures and fittings and wherever basic rate is mentioned, the final selection will be done by the committee appointed by the client. for the purpose of quoting basic rate of materials have been mentioned for these specific items. the contractor to note that wherever basic rate has been mentioned, payment will be made, considering the difference plus or minus from the basic rate mentioned for that item.

instructions to contractor for tendering 1. the tenderer shall examine closely the relevant isi codes, relevant clauses of the standard preliminary specifications, drawing, specifications,

general conditions and special conditions of contract and all the documents which form part of the agreement to be entered into by the accepted tenderer before submitting his tender for unit rates which shall be for finished work on site.

2. each tenderer is expected to inspect the site of the proposed work before quoting his rates, to acquaint himself with the site conditions and

rules and regulations as specified by the client. 3. the best class of materials shall be used on the work and they must comply with the relevant standard specifications. samples of materials as

called for in the standard specifications, or in this tender notice, or as required by the engineer-in-charge, should have the proper approval before the supply to site of work, is begun.

4. time shall be considered as the essence of the contract. the rate of progress as mutually agreed to, is required to be maintained. date of

commencement of this project will be the date of issue of work order. 5. each tenderer must send a current income-tax clearance certificate from the appropriate income-tax authority in the form prescribed therefore.

in the case of proprietary or partnership firm, it will be necessary to produce the certificate aforementioned for the proprietor or proprietors and for each of the partners as the case may be. any tender received without a certificate, as mentioned will be liable for rejection.

6. tenderer should quote specific rates for each item of work in the schedule and rates should be in rupees and paise. the units and rates should

be written both in words and figures. the schedule accompanying the tender shall be written legibly and free from overwriting or corrections of figures. corrections where unavoidable should be made by crossing out, initialling, dating and re-writing.

7. no alteration which is made by the tenderer in the agreement form, the conditions of agreement, the drawings or specifications accompanying

the same, will be recognised and if any such alterations are made the tender will be void. 8. the tenderer should ensure adherence of all statutory requirements under the state and central rules in force.

1. we understand that if our tender is accepted the priced bills of quantities will constitute part of the contract only in respect of the description of work and rates contained therein.

2. we undertake, if our tender is accepted, to commence the works or the part thereof which constitutes the subject of our tender within the period

stated in the memorandum. 3. we undertake, if our tender is accepted, to complete the whole of the works or the part thereof which constitutes the subject of our tender

within the period stated in the memorandum. 4. we agree to abide by this tender for a period of 60 days from the date fixed for receiving of same and it shall remain binding on us or any

additional period agreed by us in writing. 5. we agree, that our prices stated for all items are all inclusive. they include the cost of materials, labour, overheads and profits, octroi

and any other tax/duty applicable, including works contract tax, excise and vat, etc. 6. unless and until a formal agreement is prepared and executed, this tender, together with the employer's written acceptance thereof, subject to

our tender being accepted within the aforesaid 60 days period or extended period, agreed by us in writing shall constitute a binding contract between us and shall be deemed for all purposes to be the contract agreement.

7. we agree that the sum of earnest money, in the form of demand draft submitted herewith, shall be forfeited by the employer without prejudice

to any other rights or remedies of the employer, should we withdraw our tender during the period of validity stated in clause 5 hereof or if our tender is accepted, should we fail to commence the works within the period stipulated in our tender, or fail to conclude the agreement.

8. we agree that all the clauses mentioned in the tender notice, articles of agreement, shall be applicable and agree to abide by this undertaking.

9. we understand that you are not bound to accept the lowest or any tender, which you may receive not to assign any reasons for such

rejections.

10. we agree to take special note, that the items for flooring tiles, skirting, bathroom tiles and dado, as well as fixtures and fittings and wherever basic rate is mentioned, the final selection will be done by the committee appointed by the client. for the purpose of quoting, the basic rate of materials have been mentioned for these specific items. we note that wherever basic rate has been mentioned, payment will be made, considering the difference plus or minus from the basic rate mentioned for that item.

11. we agree that, only the architect is at a liberty to change the design and/or specifications to any other material. If the contractor

changes specifications or design without the written consent of the architect, he will be required to remove the change and reinstate the original, at his own cost. further the contractor is requested to note that if any item is changed, after the receipt of work order, or during the progress of work, the contractor will be asked to give proportional discount, if the specification is reduced.

general conditions

1. all the intending contractors should study the following conditions before quoting for the works. these general conditions will form part of the contract.

2. the contractor should acquaint himself with the site conditions, local authority regulations availability of materials, labour laws, etc. and quote

the rates accordingly. 3. the rates quoted shall also cover for the work to be carried out basically after office hours and on holidays and in stages.

4. the contract will be item rate contract. the quantities mentioned in the schedule of quantities will be approximate quantities as guidelines.

however, the contractor will be paid on the basis of actual works done. 5. the contractor will have a competent supervisor on the site at all times.

6. the contractor will have to make his own arrangements for watch and ward at all times. the owner will not be responsible for materials / works

till officially taken over by the bank. 7. the contractor will attend all the meetings whenever called for.

following items will not be paid separately (contractor to quote accordingly for the tender items)

1. provision for office space for architect's assistant and the clerks of works including furnitures and telephone with one peon full time and facility

of drinking water, drawing board, etc., if specifically asked for.

2. provision for removal of the debris dumped by all category of contractors during the total project duration, during the time of the day when

heavy vehicles are allowed in the construction sites / as required by the construction, or as required by the architect/bank's engineer.

3. providing a carpenter for a period of one year for planing of doors, windows, drawers, etc. to counteract the effects of humidity.

4. to arrange noise reduction partition for work during late hours of the day without causing disturbance to the neighbourhood as and when

required.

5. provision for non destructive testing of quality of existing concrete wherever necessary and as and when called for.

6. provision for a standby electric generator, of sufficient capacity, to carry out the work effectively, in all working areas of the building. this will be

used by all category of contractors at the discretion of the architect/bank's engineer.

7. provision of godown for stores, including pilfer-proof doors, and locks.

8. cost of levelling unevenness if the existing floor to accommodate carpet, vinyl tiles, etc. as and when required.

9. cost of mock-ups of granite/marble wall cladding with pattern, lift jambs and rendering on walls, etc. wherever specified. each item 5 sq.m. all

required samples must be shown at one time in seven days time after taking over the site.

10. cost of 3 sets of 10" x 12" photographs, done by a reputed professional photographer, of the completed work.

11. all loose concrete, according to the ndt examination shall be removed and epoxy mortar treatment shall be given on the exposed bars

wherever required as directed.

12. provision for making good the patch work and punctures in the walls created by other service contractors, such as plumbing, electrical and a/c,

wherever required.
