Anticipat- ing an opening of the transfer sta- tion on Friday May 1, and that will take right into summer hours. Activity Center – L. Henry re- ported Chelsea has been cleaning and hoping for a re-opening for May 4th with guide lines. Fire – L. Henry reported on the City Hall project, they are putting in the window this week. Police – No report. Auditor Report – R. Hoffarth reported she is starting to work on budget. She’s done some research on the multiple businesses in one building; years ago the extra busi- ness would pay $12 for water and paid a full garbage fee. No decision was made at this point. Unfinished Business: Trees on Main Street – B. Mehl- hoff present to discuss what the commission is thinking for the spots where the trees where and adopt a planter will continue for this year. Moore Engineering – Phase 1 - Sewer, Water, Storm Water Im- provements – RD Project (Quam Construction) • Will need to perform a correc- tion period walk-through sometime in the next week or two. Phase 2 - Sewer, Water, Storm Water Improvements – RD Project (Spruce Valley) • Spruce Valley has been in town to blade the non-paved streets • They are evaluating the situa- tion as to when a crew will be com- ing into town Sidewalk Project – CDBG Project (Plummer Construction) • Will need to take a look at the issue with the “popouts” on the sidewalk at the Activity Center and determine potential options; plan- ning to do this on the same trip at the Phase 1 walk through. Other Items - State Water Com- mission cost-share planning forms for the next biennium are due by May 20, 2020. The next biennium starts July 1, 2021. In anticipation of potential stimulus program fund- ing, have prepared a submittal on Langdon’s behalf of potential Phase 3 project to the Army Corps for their Environmental Infrastructure pro- gram. New Business: Janelle Schefter requesting City cost share for curb and gutter in front of her business. Marty will go look at this and decide what the City can do to assist. Tabled until next meeting. Jocelyn Jennings – present over phone to ask about an Electrolysis home based business at 1212 5th Street. Quentin looked over ordi- nances and the board sees no reason to deny the business. City land for bid by D. Crock- ett’s car wash – M. Tetrault asked the commission if they would be willing to put this section of land up on bids, there has been an in- terest. It was discussed and by L. The bond must run to the govern- ing body, but any person having a lawful claim against the contractor or any subcontractor may sue on the bond. No bid shall be read or considered unless a copy of a valid North Dakota contractor’s license or certificate of renewal thereof is enclosed in the envelope containing the bid bond.

§ 48-01.2-10 Unless otherwise provided under this chapter, a gov-erning body authorized to enter a contract for the construction of a public improvement in excess of one hundred thousand dollars shall take from the contractor a bond be-fore permitting any work to be done on the contract. The bond must be for an amount equal at least to the price stated in the contract. The bond must be conditioned to be void if the contractor and all subcontrac-tors fully perform all terms, condi-tions, and provisions of the contract and pay all bills or claims on ac-count of labor performed and any supplies, and materials furnished and used in the performance of the contract, including all demands of subcontractors. The requirement that bills and claims be paid must include the requirement that inter-

est of the amount authorized under section 13-01-14 be paid on bills and claims not paid within ninety days. The bond is security for all bills, claims, and demands until fully paid, with preference to labor and material suppliers as to payment. The bond must run to the govern-ing body, but any person having a lawful claim against the contractor or any subcontractor may sue on the bond.

No bid will be read or considered if it does not fully comply with the terms hereof. Any deficient bid will be resealed and returned to the bid-der immediately.

All contracts shall contain a pro-vision requiring compliance with Executive Order 11246, entitled “Equal Employment Opportunity,” as amended by Executive Order 11375 and as supplemented in De-partment of Labor regulations (42 CFR Part 60).

The Pembina Gorge Foundation reserves the right to reject any bid or to waive irregularity in the bids and in the bidding. The Pembina Gorge Foundation further reserves the right to hold all legitimate bids for a period of sixty (60) days after the date fixed for the opening there-of.
