CEIS Required
• If State identifies significant dis-proportionality based on race or ethnicity with respect to: identification of children as children with disabilities; the identification of specific disability categories; placement of children in a particular educational setting; or, the taking of certain disciplinary action

Voluntary CEIS
• LEAs may use up to 15% of IDEA funds to develop and provide CEIS
• Allowable activities include: professional development for teachers / staff; educational and behavioral evaluations, services, and supports
• Two years after the service year, LEA must report to the state: the number of children receiving CEIS, the number of children who subsequently needed special education services

Maintenance of Effort
• The amount of local, or state and local, funds expended for the education of children with disabilities
• This amount establishes the level of expenditure to be maintained from year to year and establishes the MOE level

MOE Exceptions
• Federal regulations provide exceptions for: voluntary departure of special education or related service personnel; decrease in the enrollment of children with disabilities; termination of costly equipment acquisition; termination of an exceptionally costly obligation to a particular child
