1 Terms and Conditions CIMB BANK/CIMB ISLAMIC BANK ULTIMATE DREAM CONTESTCampaign (“Campaign”) (Amended as at 24 December 2014) These amended Terms and Conditions for CIMB Bank/CIMB Islamic Bank ‘Ultimate Dream Contest’ Campaign (“Terms and Conditions”) shall supersede the existing Terms and Conditions of the Campaign with effect from 24 December 2014. 1. Terms and Conditions CIMB BANK/CIMB ISLAMIC BANK ‘ULTIMATE DREAM CONTEST’ Campaign (“Campaign”)

(Amended as at 24 December 2014) These amended Terms and Conditions for CIMB Bank/CIMB Islamic Bank ‘Ultimate Dream Contest’ Campaign (“Terms and Conditions”) shall supersede the existing Terms and Conditions of the Campaign with effect from 24 December 2014. 1. Every mention of “CIMB” refers to either CIMB Bank Berhad (13491-P) (“CIMB

Bank”) or CIMB Islamic Bank Berhad (67138-H) (“CIMB Islamic Bank”) where applicable.

The Campaign Period

2. The CIMB Bank/CIMB Islamic Bank “Ultimate Dream Contest” Campaign (“Campaign”) shall run from 20th November 2014 to 28th February 2015, both dates inclusive (“Campaign Period”).

3. CIMB reserves the right upon giving adequate notice to change the duration and/or the commencement and/or expiry dates of the Campaign Period.

Eligibility

4. This Campaign is open exclusively to:

a) all new and existing CIMB and Direct Access Credit Card principal cardholders (collectively referred to as “CIMB Credit Cardholders”) that hold the credit card(s) issued by CIMB in Malaysia (hereinafter referred to as “CIMB Malaysia”) only; and

b) all new and existing CIMB Debit cardholders that hold the debit card(s) issued by CIMB Malaysia only; and

c) all new and existing CIMB Current Account and/or Savings Account except Current Account Flexi and Special Mudharabah Current Account-i (“Participating Account”) accountholders; and

d) all successful applicants of CIMB Property Financing; e) all successful applicants of CIMB Bank ASB Financing and/or CIMB Islamic Bank

Term Financing-i Secured by ASB Certificate; f) all successful applicants of CIMB Bank Personal Loan and/or CIMB Islamic Bank

Personal Financing; g) all successful applicants of CIMB Bank Hire Purchase loan and/or CIMB Islamic

Bank Hire Purchase financing; and h) all Malaysian citizens who invest in following CIMB’s investment products:

Structured Investment (excluding Dual Currency Investment , Gold Convertible Investment & Reinvestment of Structured Investments); and/or

Unit Trust (Participating Equity Unit Trust Funds only); and/or

Private Retirement Scheme; and/or

ASNB-Variable Funds (ASN2, ASN3, ASG) (hereinafter referred to as “Investment Products”);

(i) Permanent and/or temporary staff or employees of CIMB (including its

subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or

(ii) Representative and/or agents (including advertising and promotion agents) of CIMB, VISA Worldwide Pte. Limited, a company registered in Singapore, having its office at 30, Raffles Place, #10-00, Chevron House, Singapore 048622 (“VISA”) and MasterCard Worldwide, a company organized under the State of Delaware, having its office and principal place of business at 2000 Purchase Street, Purchase, New York, NY 10577-2509, United States of America (“MasterCard”) (including their respective subsidiaries and related companies); and/or

(iii) Representatives and/or agents (including advertising and campaign agents, 3rd

party vendors and service providers) of CIMB (including its subsidiaries and related companies) and their permanent and/or contract employees and their immediate family members (i.e. spouses, children, parents, brothers and sisters);and/or

(iv) Non-individuals including but not limited to Sole-proprietorships, Partnerships,

Charitable/Non-profit Organizations/Societies, Corporate and Commercial Customers, public listed companies, private limited companies, clubs, associations and co-operatives; and/or

(v) Individual below the age of 18 years; (vi) Individual below the age of 21 years for applicants of CIMB’s products other

than CIMB Current Account and/or Savings Account, CIMB Bank Hire Purchase Loan or CIMB Islamic Bank Hire Purchase financing and ASG fund; and/or

(vii) Non-Malaysian citizens. (hereinafter collectively referred to as the “Eligible Participant”)

5. In relation to joint accounts/joint applicants, only the first named account

holder/applicant i.e. the primary account holder/primary applicant shall be eligible to participate in this Campaign. Guarantors of Property Financing, ASB Financing/Term Financing-i Secured by ASB Certificate, Personal Loans /Financing or Hire Purchase Loans/Financing will not be eligible to participate in this Campaign.

6. For credit cards, only the principal cardholder will be eligible to participate in this

Campaign, supplementary cardholders are not eligible.

7. CIMB reserves the right to approve or reject any credit card, debit card or loan/financing applications, and/or to request for any further supporting documents as it deems fit. For the avoidance of doubt, CIMB has the sole and absolute discretion to determine whether the supporting documents are sufficiently clear for purpose of processing applications submitted to CIMB.

Prizes

8. The following prizes will be available to the selected winners of this Campaign:

(iii) For Participating Month 3 for the Grand Prize, one (1) unit of condominium at Inwood Residences, Pantai Sentral Park located at Bukit Kerinchi worth approximately RM731,800.00* (“Grand Prize 3”),

all to be selected by CIMB in its sole discretion. * The values stated above are before any discount granted by the Developer and are not based on any official valuations done by CIMB. Specifications of the above Grand Prizes are as follows:

10. The Prizes won:

(a) are provided on an “As Is” basis; (b) are neither transferable nor exchangeable for cash or credit; and (c) do not include any accessories or items that are shown in the leaflet or

website, as they are for illustration purposes only. 11. The Prizes may carry their own terms and conditions and these terms and conditions

shall be applicable in addition to the terms and conditions contained herein.

12. The Grand Prize winner will also have to comply with the following additional terms: (a) the winner must sign and return to the developer the developer’s usual

form of sale and purchase agreement, deed of mutual covenants and all related documents as may be required by the developer by 31 July 2015 or such other dates as may be determined by CIMB and notified by CIMB to the winner and comply with terms of such documents;

(b) the winner of the Grand Prize must have full legal capacity to own the Grand Prize and must not be prohibited by any law or regulation to own the Grand Prize;

(c) the Grand Prize shall be subject to all the conditions and category of land use express or implied or imposed upon the Grand Prizes. The winner shall be responsible, at its own costs and expense, for obtaining all the necessary approvals (if applicable) from the relevant authorities at its own costs and expense to enable the transfer of the Grand Prize to the winner. CIMB shall not be responsible if the winner is unable to obtain the necessary approvals to transfer the Grand Prize to them or the Grand Prizes cannot be transferred to the winner for whatsoever reason;

(d) the size of the Grand Prize stated above is only estimated and not guaranteed to be correct. CIMB shall not be responsible for any discrepancy in size of the Grand Prize;

(e) save and except for the purchase price of the Grand Prize which shall be borne by CIMB, all stamp duties, legal fees, disbursement fees, registration fees, processing fees, service charges, maintenance charges and all other incidental costs and charges incurred to acquire the Grand Prize or the preparation of any other incidental documents in relation thereto, shall be borne by the winner. The entitlement to the Grand Prize will be forfeited if the winner fails to pay such fees and charges in a timely manner or fails to comply with the terms and conditions imposed on the Grand Prize (including but not limited to the terms and conditions imposed by developer);

(f) all current and future property taxes (such as quit rent and assessment), insurance, and all other taxes, renovation costs, utilities, outgoings, costs, fees, and expenses related to the maintenance of the Grand Prize shall be the responsibility of the winner commencing from the date the Winner accepts the Grand Prize from CIMB;

(g) in the event the market value of the Grand Prize is for any reason lower than the purchase price/value stated in Clause 8 above, CIMB shall not be liable for any difference between the market value and the purchase price/value and the winner shall not make any claims in respect of such difference;

(h) the Grand Prize is under construction and will be completed within the period stated in the sale and purchase agreement; and

(i) the winner of the Grand Prize is not allowed to nominate another person/entity to receive the Grand Prize.

If the Grand Prize winner fails to strictly comply with the terms and conditions stated herein, CIMB reserves the right to forfeit the Grand Prize from the said winner and select another Grand Prize winner. In such event, CIMB will not be liable for any costs refund or losses incurred by the said winner.

13. All Prizes, value and information stated here are correct at the time of printing of the terms and conditions of the Campaign herein. Prize images shown in any marketing and advertisement collateral are for visual purposes only and colours may vary from the actual Prize received.

14. Any Consolation Prizes unclaimed within three (3) months after notification of

winners has been made will be forfeited. 15. To the fullest extent permitted by law, CIMB, VISA and MasterCard expressly exclude

and disclaim any representations, warranties or endorsement, implied or express, written or oral, of all prizes offered under this Campaign, including but not limited to any warranty of quality, merchantability, fitness for a particular purpose, health and safety. All risks, loss, damage and/or injury associated with the use of the prizes shall be assumed by the winners.

Qualifying Criteria

A) Credit Cards 16. Eligible Participants may earn an entry or entries (“Entry” or “Entries” as the case

may be) to win the Prize(s) referred to in Clause 8 above in the following manner: (i) Every cumulative RM50 retail spending charged to any of the Eligible

Participant’s participating CIMB Credit Cards during the Campaign Period and posted to the Eligible Participant’s account by the 5th day after each Participating Month entitles the principal Eligible Participant to one (1) Entry;

(ii) Every approved application of any principal or supplementary CIMB Credit

Card by CIMB Malaysia during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries;

(iii) Every new take up of 0% Easy Pay Plan during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries;

(iv) Every new sign up for auto-payment service during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries;

(v) Every approved CashLite or Balance Transfer during the Campaign Period

entitles the principal Eligible Participant to ten (10) Entries. 17. Retail spending for credit cards shall mean purchase transactions for goods and

services incurred for personal consumption and not for business purposes and shall not include betting or gaming transactions. For the avoidance of doubt, the following transactions are also herein expressly excluded and shall not be treated as eligible retail transactions or retail spending:-

i) Transactions made on CIMB’s Platinum BusinessCard and CIMB Partner

Card; ii) Quasi Cash transactions – (example: betting and/or gaming transactions); iii) Monthly instalments under any instalment payment facility provided by

CIMB or any other banks; iv) Standing instructions; v) Auto-payment service signed up prior to the Campaign Period or 0% Easy

Pay Plan taken prior to the Campaign Period; vi) Payment of annual fees or service charges, delivery charges, cash payments,

card replacement fee, government service tax, dispute charges, fraud charges or any other fees, charges or penalties whether imposed by CIMB or otherwise;

vii) Transactions for payments made towards insurance premiums and/or takaful contributions of any kind whatsoever;

viii) Cash advance/withdrawal/deposit transactions; ix) Transactions made by the Eligible Participant with any merchant associated

with or controlled by them or their family members (whether as employee, employer, shareholder or director) i.e. transactions by the Eligible Participant with any corporation or business entity in which he is and/or any of his family members are employee or employer or works with or has shares or interest in or is a director of; and

x) Qualifying purchase transactions which are subsequently cancelled or refunded, disputed, unauthorised or fraudulent transactions.

Any determination by CIMB as to what constitutes retail spending shall be conclusive and shall not be challenged in any manner whatsoever.

18. Retail spending is based on the total consolidated principal and supplementary/ies

credit cardholders’ spending. If the credit cardholder has multiple credit card accounts, the retail spending made on all credit cards by the principal credit card cardholder and his/her supplementary/ie(s) credit card cardholder(s) will be consolidated and will not be viewed individually to meet the retail spending of the Eligible Transactions and participation criteria within the Campaign Period.

19. Eligible Participants may earn an Entry or Entries to win the Prize(s) referred to in

Clause 8 above in the following manner:

(i) Every cumulative RM50 retail spending charged to any of the Eligible Participant’s participating CIMB Debit Cards during the Campaign Period and posted to the Eligible Participant’s account by the 5th day after each Participating Month entitles the principal Eligible Participant to one (1) Entry;

(ii) Every new sign up of any CIMB Debit Card by CIMB Malaysia during the

Campaign Period entitles the principal Eligible Participant to ten (10) Entries;

(iii) Every new sign up for a Participating Account (as defined in Clause 4(c) above) with minimum initial deposit entitles the Eligible Participant to ten (10) Entries;

(iv) Every Incremental Deposit in the multiple of RM1,000 in Participating Account entitles the Eligible Participant to one (1) Entry.

20. Retail spending for debit cards shall mean purchase transactions for goods and

services incurred for personal consumption and not for business purposes and shall not include betting or gaming transactions. For the avoidance of doubt, the following transactions are also herein expressly excluded and shall not be treated as eligible retail transactions or retail spending:-

vi) Transactions for payments made towards insurance premiums and/or takaful contributions of any kind whatsoever;

vii) Cash advance/withdrawal/deposit transactions; viii) Transactions made by the Eligible Participant with any merchant associated

with or controlled by them or their family members (whether as employee, employer, shareholder or director) i.e. transactions by the Eligible Participant with any corporation or business entity in which he is and/or any of his family members are employee or employer or works with or has shares or interest in or is a director of; and

ix) Qualifying purchase transactions which are subsequently cancelled or refunded, disputed, unauthorised or fraudulent transactions.

21. “Incremental Deposit” is defined as Incremental Average Balance (“IAB”) of Eligible

Participant’s Participating Account throughout the Campaign Period calculated based on monthly average balance (“MAB”) compared to “Baseline” as stated in

Table I below:

24. Deposits made for the purposes of computation of the IAB shall only apply to fresh

funds that are placed in the Participating Account during the Campaign Period. Fresh

funds herein referred to as funds that do not originate from an existing account(s)

with CIMB Bank Berhad, CIMB Islamic Bank Berhad and/or CIMB Investment Bank

Berhad.

C) Property Financing 25. Eligible Participants may earn a Entry or Entries to win the Prize(s) referred to in

Clause 8 above in the following manner: (i) Every CIMB home loan/financing or business premises loan/financing

(Under-Construction Property/Completed Property/Refinancing/Home Extra) applied under individual name(s) during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries;

(ii) Every RM1,000 loan/financing amount of any home loan/financing or business premises loan/financing (Under-Construction Property/Completed Property/Refinancing/Home Extra) applied under individual name(s) during the Campaign Period entitles the principal Eligible Participant to one (1) Entry;

subject to the following conditions:

(i) The acceptance of the Letter of Offer and execution of all loan/financing

documents must be completed by 31st March 2015; 26. Eligible Participants’ application for property financing is subject to CIMB’s standard

credit checking and the Eligible Participants’ acceptance of CIMB’s terms and conditions governing the property financing which are separate from these terms and conditions. Fees and charges will be imposed for prepayment and/or early settlement.

D) ASB Financing/Term Financing-i Secured by ASB Certificate

27. Eligible Participants may earn an Entry or Entries to win the Prize(s) referred to in

Clause 8 above in the following manner: (i) Every CIMB Bank ASB Financing or CIMB Islamic Bank Term Financing-i

Secured by ASB Certificate applied and approved during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries; and

(ii) Every RM1,000 CIMB Bank ASB Financing or CIMB Islamic Bank Term Financing-i Secured by ASB Certificate approved during the Campaign Period entitles the principal Eligible Participant to one (1) Entry;

subject to the following conditions:

(i) The ASB Financing or Term Financing-i Secured by ASB Certificate must be disbursed by 10th March 2015 otherwise Eligible Participant will not be entitled to the Entry(ies) under this Clause 27.

E) Personal Loan/Personal Financing

28. Eligible Participants may earn ten (10) Entries to win the Prize(s) referred to in

Clause 8 above with every Personal Loan/Financing applied and approved during the Campaign Period provided such Personal Loan/Financing is disbursed by 10th March 2015 otherwise Eligible Participant will not be entitled to the Entry(ies) under this Clause 28.

F) Hire Purchase Loan/Hire Purchase Financing

29. Eligible Participants may earn an Entry or Entries to win the Prize(s) referred to in

Clause 8 above in the following manner: (i) Every CIMB Hire Purchase loan/financing (excluding Hire Purchase

loan/financing taken up through Human Resource) applied and approved

during the Campaign Period entitles the principal Eligible Participant to ten (10) Entries;

(ii) Every RM1,000 Hire Purchase loan/financing (excluding Hire Purchase loan/financing taken up through Human Resource) approved during the Campaign Period entitles the principal Eligible Participant to one (1) Entry;

subject to the following conditions:

(i) The Hire Purchase loan/financing must be disbursed by 10th March 2015

otherwise Eligible Participant will not be entitled to the Entry(ies) under this Clause 29.

G) Investment Products

30. Eligible Participants may earn an Entry or Entries to win the Prize(s) referred to in

Clause 8 above in the following manner:

(i) Every new investment in Investment Products during the Campaign Period by a new investor who do not have any Investment Products with CIMB entitles the principal Eligible Participant to ten (10) Entries;

(ii) Every RM1,000 investment amount in any Investment Product by new or existing investors during the Campaign Period entitles the principal Eligible Participant to one (1) Entry;

subject to the following conditions: (i) For new Investors into Unit Trust (Participating Equity Unit Trust Funds), it is

31. The following additional terms shall also be applicable to the Eligible Participants for Investment Products: (a) In the event Eligible Participant exercises their cooling-off right, or the

investment is rejected or cancelled by any parties for whatsoever reason within the Campaign Period, the Eligible Participant shall not be entitled for the Entry under the Campaign. The “cooling-off” is a period of six (6) business days from the date of receipt of the Unit Trust application by CIMB;

(b) The Eligible Participant is required to sign all relevant standard documents and comply with all terms and conditions in respect of his/her investment in the relevant products under the Campaign, which are separate from these terms and conditions;

(c) Investments in the Unit Trust Funds are not obligation of, deposits in, guaranteed or insured by CIMB and are subject to investment risks, including the possible loss of the principal amount invested. Eligible Participants are advised to read the Prospectus of the relevant Fund(s) before investing. Eligible Participants should also consider all fees and charges involved before investing. Past performance of the relevant Fund(s) is not an indication of future performance and income distributions are not guaranteed. Eligible Participants should rely on their own evaluation to assess the merits and risks of any investment. Eligible Participants who are in doubt as to the action to be taken should consult their professional advisers immediately;

(d) The Eligible Participant is not covered by the compensation fund under section 152 of the Capital Markets and Services Act 2007 (CMSA). The compensation fund does not extend to the Eligible Participant who has suffered monetary loss as a result of a defalcation or fraudulent misuse of moneys or other property, by a director, officer, employee or representative of CIMB. Where the Eligible Participant suffers monetary loss in the above circumstances related to the acts of CIMB’s employees, the Eligible Participant may lodge a complaint with CIMB’s Customer Resolution Unit (“CRU”) as set out in clause 58. The Eligible Participant who is not satisfied with CIMB’s CRU's decision may refer the case to the Financial Mediation Bureau or the Securities Industry Dispute Resolution Centre within six (6) months of receiving a final decision from CRU. The Eligible Participant should note that his/her complaint will only be dealt with by either one of the above channel that the Eligible Participant chooses to refer his/her case to;

(e) The list of participating Equity Unit Trust Funds is available upon request and is subject to change from time to time by CIMB at its absolute discretion upon giving adequate notice;

(f) The master prospectus of the unit trust funds of ASNB dated 30 June 2014 have been registered with the Securities Commission Malaysia and are available at any office of ASNB and its agents. Units will be issued upon receipt of the registration form as enclosed in the prospectuses. Before investing, please read and understand the content of the prospectuses. Total return on the investments may go down as well as up. Investments in the funds are exposed to fund management risk, inflation risk and purchasing power risk. Winners Selection Criteria of this Campaign

Collectively for Eligible Participant to win the Prizes under the Clause 8 above 32. At the end of the Campaign Period, Eligible Participants who have earned Entries in

accordance with Clauses 16 to 31 above within a Participating Month for the Grand Prize will be randomly short-listed by an automated selection system from the total Entries earned under Clauses 16 to 31 within that Participating Month (“Shortlisted Participants For Grand Prize”)and Eligible Participants who have earned Entries in accordance with Clauses 16 to 31 above within a Participating Month for the Consolation Prize will be randomly short-listed by an automated selection system from the total Entries earned under Clauses 16 to 31 within that Participating Month (“Shortlisted Participants For Consolation Prize”) i.e. the more Entries an Eligible Participant earns in accordance with Clause 16 to 31, the Eligible Participant will stand a better chance of being selected as a Shortlisted Participant. Shortlisted Participants For Grand Prize and Shortlisted Participants For Consolation Prize are hereinafter collectively referred to as “Shortlisted Participants”.

33. For each Participating Month for the Grand Prize, a Shortlisted Participant For Grand Prize will be contacted by telephone by representatives of CIMB based on their mobile numbers in CIMB’s records and shall be required to answer two (2) questions correctly before being declared a Grand Prize winner (“Grand Prize Winner”). The Grand Prize Winners for the Participating Month 1, Participating Month 2 and Participating Month 3 for the Grand Prize will be entitled to the Grand Prize 1, Grand 2 and Grand Prize 3 respectively.

34. For each Participating Month for the Consolation Prize, a Shortlisted Participant For Consolation Prize will be contacted by telephone by representatives of CIMB based on their mobile numbers in CIMB’s records and shall be required to answer one (1) question correctly before being declared a Consolation Prize winner (“Consolation Prize Winner”). This process will be repeated until the winners for all Consolation Prizes for each of the Participating Month have been selected.

35. Any Shortlisted Participant who fails to answer the question correctly will not receive the Prize and the next Shortlisted Participant for that Participating Month will be called. All question and answer sessions will be judged and decided by a panel of judges selected by CIMB and the decision of the panel of judges selected by CIMB shall be final and binding.

36. If the Shortlisted Participant is not contactable by telephone on the first attempt for reasons including, but not limited to the following circumstances: No reply, Not interested to participate, Ended the call during conversation, Number not in use, No connection, Voice mailbox reached, another two (2) attempts shall be made to contact the Shortlisted Participant. Where the third attempt is also unsuccessful due to the circumstances set out above, CIMB reserves the right to disqualify the Shortlisted Participant and proceed to contact the next Shortlisted Participant in that Participating Month respectively for each of the Grand Prize and Consolation Prize until three (3) Grand Prize Winners fulfil the criteria as set in Clause 34 and one hundred and three (103) Consolation Prize Winners fulfil the criteria as set out in Clause 35.

37. Further and for the avoidance of any doubt, all telecommunication charges shall be borne by the Shortlisted Participant (including roaming charges incurred by the Shortlisted Participant outside Malaysia) as a result of CIMB contacting the Shortlisted Participants and CIMB shall not be liable for the same.

38. The Grand Prize Winners and the Consolation Prize Winners are hereinafter

collectively referred to as “Campaign Winners”. 39. It shall be the Shortlisted Participants’ responsibility to ensure their phone numbers

and mailing address provided are current and updated with CIMB in the event of any changes being made to the same by them. The notification and delivery of prizes by CIMB will be based on the Eligible Participant’s phone numbers and mailing address maintained in CIMB’s records. CIMB shall not be responsible to the Shortlisted Participant(s) for any loss (including loss of opportunity and consequential loss flowing there from) suffered in the event the Shortlisted Participant’s telephone number or mailing address in CIMB’s record is not current or correct.

40. CIMB has the sole discretion to fix the appointed date and time to contact the Shortlisted Participants.

41. A Shortlisted Participant shall only be entitled to win a maximum of one (1) Grand

Prize and one (1) Consolation Prize. For avoidance of doubt, Supplementary Cardholders are not entitled to win any prize under this Campaign.

42. The Campaign Winners will receive CIMB’s notification letter within 12 weeks after

the Campaign Period.

43. The winners agree and authorise CIMB to disclose the winners’ details (including but not limited to name, NRIC number, telephone number and address) to the distributor/agent who would then contact the winners regarding the delivery or redemption of the Prizes. The winners are responsible to make the necessary arrangements with CIMB and/or its distributor/agent to collect or redeem their prize(s). CIMB will not bear any accommodation and/or transportation and/or other cost that the winners may incur or have to incur in the course of redeeming or using the Prizes.

44. Winners shall be required to attend the prize presentation ceremony and/or other publicity programs as and when required at their own costs and expenses. If the winners fail to attend such ceremony and/or other publicity programs, CIMB reserves the right to forfeit the prize(s) of the winners and select another winner.

General Terms and Conditions

45. By participating in this Campaign, the Eligible Participant agrees to be bound by these Terms and Conditions and the decisions of CIMB, VISA and MasterCard. At the time of selecting the Campaign Winners, the CIMB credit card, debit card, CIMB Current and Savings account, Property Financing, ASB Financing/Term Financing-i Secured by ASB Certificate, Personal Loan/Financing or Hire Purchase loan/financing of the selected Campaign Winners MUST be in good standing and MUST NOT be in breach of any of the terms and conditions in CIMB card or account agreement or delinquent, and/or be invalid or cancelled within CIMB’s definition, otherwise they will be disqualified from participating or being the Campaign Winner in this Campaign.

46. CIMB, VISA and MasterCard shall be entitled to publish and/or display materials and/or information, including but not limited to the names, photographs and city of residence of the Eligible Participant(s) who are winners of prize(s) under this Campaign for marketing, advertising and publicity purposes in any manner it deems appropriate. By taking part in this Campaign, the Eligible Participant(s) hereby expressly authorizes CIMB, VISA and MasterCard to publish and/or display the Eligible Participant’s name, photographs and city of residence for advertising and publicity purposes. Non-compliance may result in an alternative winner being chosen.

47. Decision of CIMB and/or CIMB’s judges in relation to every aspect of the Campaign shall be final, binding and conclusive. For all further inquiries relating to the Campaign, kindly contact the CIMB Bank’s Call Centre at +1300 880 900.

48. CIMB, VISA and MasterCard will not assume any responsibility for the prizes, products and/or services offered under this Campaign. The prizes, products and/or services are offered and/or provided solely by the relevant vendors and providers, under such terms and conditions as determined by such vendors and providers, and CIMB, VISA and MasterCard accept no liability (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third party) howsoever arising whether in contract, tort, negligence or otherwise in connection with the Campaign, even if CIMB, VISA and MasterCard have been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

49. CIMB, VISA and MasterCard will not entertain any complaint whatsoever in connection with such prizes, products and/or services. The prizes, products and/or services have not been certified by CIMB, VISA or MasterCard and under no circumstances shall the inclusion of any prizes, products and/or services in this Campaign be construed as an endorsement or recommendation of such prize, product and/or service by CIMB, VISA or MasterCard. CIMB’s liability with regard to the Grand Prize is only to pay the purchase price for the same due to the developer and CIMB does not guarantee completion of the Grand Prize or that the Grand Prize is completed to the Eligible Participant’s satisfaction. CIMB shall not be responsible for any delay or failure of the Developer in observing or performing any of its obligations, covenants and undertakings in relation to the Grand Prize or in the event the Grand Prize cannot be transferred to the winner due to any reason whatsoever (whether or not due to the Developer’s default). If any Eligible Participant is dissatisfied with any of the prizes, such Eligible Participant shall seek recourse with the relevant vendor/ provider directly.

50. By acceptance or receipt of a prize, the prize winner agrees to hold harmless CIMB,

VISA and MasterCard and its affiliates and their respective directors, officers, employees and agents from and against any claim, action, proceeding, judgment, damage, loss, expense or liability suffered by CIMB, VISA and MasterCard and its affiliates and their respective directors, officers, employees and agents in connection with such prize winner’s participation in the Campaign or receipt, redemption or use of the prize.

51. CIMB, VISA and MasterCard accept no responsibility for any tax implications, goods and services tax, incidental cost and/or any other charges and/or damages caused by any of the prizes and/or non-fulfilment by any of its agents/distributors. Any tax

It is the responsibility of each Eligible Participant to seek independent advice on the possible implications this may have on his/her own financial situation.

52. CIMB shall not be liable to any Eligible Participant or any party for any loss or damage of whatsoever nature suffered by the Eligible Participant or any party (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in the Campaign.

53. CIMB shall be entitled to amend, vary, delete or add (“the Amendment”) to any of these Terms and Conditions or any part thereof and/or substitute or replace the prizes offered under this Campaign and/or to extend, modify, shorten, discontinue, cancel, terminate or suspend the Campaign by giving adequate notice to Eligible Participants. No compensation in cash or any kind shall be given to the Eligible Participants for any losses or damages suffered or incurred by the Eligible Participants as a direct or an indirect result of such variation, deletion, addition or alteration of these Terms and Conditions and/or the extension, modification, cancellation, suspension or termination of this Campaign.

54. Notification to the Eligible Participant in respect of the Amendment shall be effected at CIMB’s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Participant’s last known address or by posting a notice regarding the Amendment at each of CIMB’s branches where detail provisions regarding the Amendment may be provided in the notice itself or may be provided to the Eligible Participant upon request or by effecting an advertisement regarding the Amendment in one newspaper of CIMB’s choice, or via CIMB’s website or via electronic mail or by any other means of notice which CIMB may select and the Amendment shall be deemed as binding on the Eligible Participant as from the date of notification of the Amendment or from such other date as may be specified by CIMB in the notification.

55. These Terms and Conditions (as the same may be amended from time to time pursuant to Clause 55 shall be read in conjunction with the prevailing terms and conditions in CIMB card and/or account agreement and/or relevant products and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials advertising the Campaign.

56. Nothing in this Terms and Conditions shall be taken to be a representation that manufacturer/designer of the product(s) to be given away in this Campaign has endorsed this Terms and Conditions or CIMB’s products.

57. If there is any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the Bahasa Malaysia and English version or other language version of these Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request is made by the Eligible Participants and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of

the Campaign, then the Bahasa Malaysia version of the Terms and Conditions shall prevail.
