CALL MEETING TO ORDER

The meeting was called to order at 5:30 pm. A quorum was established.

Adoption of Minutes of April 25, 2019

Councilmember Sebesky moved adoption of the minutes of May 30, 2019. Councilmember Wolfeseconded. Motion passed 2/0.

Presentation: Transportation Planning Update

Ms. Delhomme presented an update on the City’ transportation planning program and upcoming City Council resolutions endorsing state and federal funding applications in September and November 2019. Staff reviewed active transportation projects and their potential funding sources. The Committee discussed the status of design for Grant Avenue and the roundabout at Route 28 and Sudley as well as traffic signal optimization set to begin in September.

Closed Session: Consideration of a Resolution Authorizing a Closed Session on Subjects in Accordance with the amended Freedom of Information Act and Certification after the Closed Session has occurred.

Councilmember Wolfe moved that the Land Use Committee of the City Council convene in closed session concerning a prospective business or businesses since no previous announcement has been made of the business’ interest in locating or expanding in the City as permitted by Virginia Code 2.2-3711 Paragraph A (5) for which the Virginia Freedom of Information Act permits discussion in closed session. Seconded by Councilmember Sebesky. Included in the Closed Session were the Committee, Mayor and Council and Staff present.

CERTIFICATION MOTION AFTER RECONVENING IN PUBLIC SESSION

Councilmember Wolfe moved that the Land Use Committee of the City Council certify that, in the closed session just concluded, nothing was discussed except the matter (1) specifically identified in the motion to convene in closed session and (2) lawfully permitted to be discussed under the provisions of the Virginia Freedom of Information act cited in the motion. Seconded by Councilmember Ellis.

LAND USE COMMITTEE UPDATES

Mr. Arcieri announced that the comprehensive plan update was on track and that the draft plan would be released in mid-September. The Planning Commission has scheduled a worksession on September 25, 2019 to review the draft and determine if additional work is needed prior to proceeding to Public Hearings.

Motion: I move that the Façade Grant for Old Town Center be approved in the amount of $15,000.00.

Summary and/orComments:

Old Town Center has applied for a façade grant in the amount of $15,000.00. The condo association is making improvements to 9427-9439 Main Street and 9416-9422 Old Town Court that includes replacing the existing roofing shingles. The FIG program stipulates that roofing work may be included with other improvements because roofing work is generally partially or completely hidden from the right-of-way. The roof on this building, however, is pitched and completely visible from the public right-of-way, adjacent sidewalk and the City parking deck. It consists of mismatched shingles on the individual units and is unsightly. The remainder of the façade, the parking lot, and signage are all otherwise in workmanlike condition and not in need of improvements. For these reasons, staff recommends approval. The total roofing project is estimated to cost $45,035.00.

New state law HB 2752 authorizes localities to regulate the operation of companies providing motorized skateboards or scooters for hire. At this time, no scooters companies have approached the City; however, per the new law the City must adopt an ordinance by January 1, 2020 or it will not be able to regulate future requests. City staff is drafting an ordinance with the City Attorney to:

1) require a license for companies providing motorized skateboards or scooters for hire to operate within the City; and2) authorize the City Manager to issue regulations governing the operation of motorized skateboards or scooters prior to issuing any license.

A local business owner has requested that the City approve a zoning change permitting Tattoo Parlors/Body Piercing Salons as a by-right or special use permit in the B-3 (downtown) zoning district. The use is currently only permitted by-right in the B-4 general commercial zoning district.

In 2011, Tattoo Parlor and Body Piercing Salons uses were prohibited in the B-3 district. In 2015, the comprehensive zoning update left this prohibition in place. In 2018, the Planning Commission also reviewed this request but did not recommend any change to the ordinance.
