Structural engineering consultant Rob Young, hired by Singh to investi- gate the collapse, told the commission of inquiry on Friday that the design of the mall was “materially flawed”. The commission was set up by the De- partment of Labour to investigate what led to the collapse of the semi- constructed R300 million mall on 19 November 2013. Days earlier, a Dur- ban High Court order was obtained by the eThekwini Metro ordering con- struction to be halted for failing to have building permission. The order was ignored. Two people were killed and 29 injured when a three-storey section of the mall pancaked while, according to eyewitnesses, the sup- ports were being removed. Young, who was the lead engineer at the King Shaka International Airport, said the manner in which the mall col- lapsed was unusual. “We have conducted a desktop analy- sis of the drawing and found defects that could have led to the collapse. Usually in a collapse one panel goes and the others follow but here there was a trigger and the slab swivelled and came down in one uniform piece.” He told the commission that for a thorough and safe investigation on location, it would take at least six weeks and would include a controlled demolition of the large concrete slab lying on the ground. Commissioner Phumudzo Maphala said if all went according to plan, he will be able to make his findings in August with Singh interrogated in early June. “The last person I am likely to cross examine is Singh once we have seen all the findings and reports as he has been mentioned on numerous occa- sions throughout the inquiry.” Also on Friday at the Durban High Court, mall developer Rectangle Property Investments, run by Singh’s son Ravi Jagadasan, had its contempt of court hearing postponed. The city wants the mall demolished. The Weekly has learned that Singh has no intention of demolishing the entire mall and plans on keeping ar- eas that have not collapsed. A MEMBER of Reaction UnitSouth Africa (RUSA) escapeddeath after coming under

heavy gunfire from eight armedrobbers on Friday last week.

According to RUSA head PremBalram eight suspects armed withAK47's and 9mm pistols stormedthe Brookdale Shell garage in Phoe-nix robbing the store of cash, air-time and cigarettes.

The suspects then allegedly hi-jacked a vehicle after assaulting apatron and opened fire on a RUSAofficer who was at the garage.

One person was treated for inju-ries and transported to hospital.

Balram said that the reactionofficer had arrived at the garage afew minutes prior to the robberyand had conducted an inspectionfor the night security guard.

“The officer then purchased acan of energy drink and returned tohis vehicle when the suspects sur-rounded the garage and enteredthe store.

“The video footage shows thesuspects enter the busy shop, drawpistols and point the AK47's at cus-tomers while two suspects armedwith AK47's remain outside the ga-rage.”

Balram said the reaction officer,

in a fully marked RUSA vehicle, no-ticed the robbery in progress andreversed his vehicle, getting out totake cover when the suspectsopened fire on him.

“In the CCTV video footage theofficer is seen reaching for his ra-dio while running for cover and hethen returns fire with his 9mm pis-tols.

“It appeared that one of the sus-pects firearm had jammed.”

Balram added that during theshooting a Toyota Corolla drove in-to the garage and was shot at ap-proximately 10 times.

“The driver was the then pulledout of the vehicle assaulted and isvehicle was taken.”

An undisclosed amount of cash,airtime and cigarettes were stolenand the suspects fled in a white carresembling a Golf 5 or Peugot, a

pital after he suffered facial inju-ries. In February last year twomembers of RUSA were shot withAK47's after they responded to arobbery in progress at a BP Garagein Verulam.

Deon Chinnian and Ruba Reddywere attacked by six AK47 wieldinggunmen. Their response vehicleswere shot a total of 15 times andone officer was shot fivetimes.

Part of the officers hand wasblown off and later had to be am-putated.

Balram said that both officersreturned to work after recoveringfrom their injuries, adding that allreaction officers will now be issuedwith rifles and other high calibreweapons to defend themselveswhen attacked.

Police are investigating.

ACANCER survivor has spoken out about the valueofhopeinthefaceofadversity­encouragingoth­ers like herself to "keep the faith".

Local resident Janet Govender (54) had been diag­nosed with a tumour in her thigh in July last year andwas told by several doctors that she would have to haveher leg amputated.

Govender, a homemaker and part time caregiver ofchildren, did not lose hope and waited for orthopaedicsurgeon Dr Kamalesh Naik, who practices at MediclinicVictoria, to return from his leave.Dr Naik, together with Cape Town based orthopaedicre­constructive expert Dr Keith Hoskings managed to

save Govender's leg and remove the tumour in a fourhour operation.

Govender said she persevered through prayer toovercome her struggles.

“It is through God that such an incredible things hashappened to me. I am very thankful to the doctors andstaff at the hospital as well as my family and friendsfor their continuous prayer and support.”

Asked what advice she would give other cancer pa­tients, she said “hope is the key”.

“Since realising I had this disease I have remainedpositive. There can be a lot of anxiety when one is facingsuch mortality. But with the support of so many goodpeople at the hospital as well as the church, family andfriends, I have overcome this.”

A FOREIGN national waskilled after two men and awoman allegedly approachedthe victim and his friend dur-ing the early hours of Sundaymorning.

TWO men were injured, one of themcritically, when they fell fromscaffolding in the Tongaat CBD onMonday.

According to Netcare 911 spokesmanChris Botha they were working when

they fell several metres and landedon an elevated area.

“Paramedics and firemen immobilisedthe patients in specialised stretchersbefore using a rope system to lower themto the road level.” The cause of their fallwas not immediately known.The police are investigating, Botha said.

THE heavily debated Sunhills -Emona housing project ap-pears to finally be underway

after a number of contractors metwithward 61 councillor to tender forthe project on Friday last week.

The project is set to build 1 082houses for residents in the area.

The Departments of Public Works

and Education have also come oneboard to build a primary school.Thedevelopmentwill also see a com-munity hall, crèche and two worshipsites earmarked for the com-munity.

According to ward councillor Mi-chaelAbrahamoneof the reasons forthedelay of theprojectwas themeth-ane gas pipeline which passes fromBelvedere along side the boundary of

Emona.“Although this pipeline poses no

threat to the community, the latestlegislation passed by our Parliamentdictates that certain protective mea-sures must be in place before anybuilding operations begin.”

The contractors who have attend-ed the sitemeeting and briefing haveuntil the 7 March to return their ten-derdocuments.Thereafter,adjudica-tion of the tenders will begin.

OVERFISHING can severely impact on our eco­system if left unchecked and unmonitored.Many fisherman in KZN practically live of the

sea as it is a source of income in these tough economictimes.In some families fishing has been passed on from gen­eration to generation and is considered a heritage. .Like all the resources in our country, our marine re­sources also need to be protected.Hence, the Marine Living Resources and AmendmentBill has been promulgated and ready to be passed asearly as next month.This bill has limitations on bag limit which is restrictedto ten. Fisherman would have designated areaswhere they will be allowed to fish with the possibilityof catching nothing as fish follow the current. Pre­scribed quotas will have a devastating effect on sub­sistence fisherman who are reliant on their catchesto put food on the table and sell surplus fish to payoff other expenses incurred.The challenge is to find middle ground in this situationwhere there can be a compromise and a win­win situ­ation can prevail. If government wants this bill to beeffective, there has to be a buy in and a consultativeprocess with the major role players who are the fisher­man. No groups rights must take precedence over an­other in the interests of fairness and giving credibilityto the process. How can a situation emanate wherebywehaveChinese,JapaneseandEuropeantrawlersus­ing nets, suck up all the fish while the ordinary subsis­

tence fisherman has so many impedi­ments such as costly licences and specialbait that has to be used imposed onthem?The challenge lies in the ability to sustainthe fishing stock thereby making surethat no fish is netted or fished to a levelwhere there survival will be in jeopardy.

There has to be a well balanced and finetuning process with all stakeholders ac­knowledging the continued sustain­ability of the fishing stock well into thefuture. A total and unequivocal com­mitment is required in this regard, any­thing less will be a travesty.

Overfishing to our detriment

WHEN a baby begins taking their first steps,they stumble and usually fall over after theirfirst step or two.

However, this does not stop them fromstanding up and trying again. Each attemptat walking sends feedback to their brain,telling their bodies what works and whatdoesn’t. To hold up their arms to increase

balance, or to keep their heads up. It takestime for their brains to learn about balance,walking up stairs or down a hill. Until oneday, they are able to walk with no consciousthought of it at all.

When is it that you became so fearful oftaking a new step? Do you remember howfearless you were when you began walking?When did your feedback become negative?As a parent, spouse, business owner or man­ager, are you unknowingly teaching peopleto fear failure? If we were naturally fearful,none of us would be walking, nobody woulddrive cars, fly aeroplanes, have friends, fallin love, create children. But somewherealong our journey through life, we learneda behaviour that we named ‘fear.’ Just likeyou learned how to walk and drive a car, youlearned how to be fearful. Fear of failure isnot real. How do you know you will fail, whenit is impossible to fail.

Just as a child learns to walk and receivesfeedback, our adult brains can be re­trained

to do the same. If our first attempt doesn’tgo as planned, analyse the feedback re­ceived and make adjustments until you findthe right equilibrium. Did you know that Edi­son famously invented 1,000 light bulbs be­fore creating one that worked? Did youknow Walt Disney was fired by a newspapereditor because he “lacked imagination andhad no good ideas.” And did you know thatAlbert Einstein didn’t speak until age fourand didn’t read until age seven. His teacherslabelled him “slow” and “mentally handi­capped.”

But all of these people, and many more,used feedback they received and had un­wavering belief in their ability to overcometheir challenges along the way.

AN alleged robber has been shotandwoundedandanotherarrestedinconnection with a cash-in-transitheist, KwaZulu-Natal police said on

Monday.Police received information on

Sunday night that the two were trav-elling on theN2 in a bakkie used dur-ing a robbery last year, KZN SAPSspokesperson Captain ThulaniZwane said.

“Police approached the vehicle atthe Tongaat Toll Plaza where two al-

leged suspects alighted and fled onfoot while shooting at the police,”Zwane said. “Police retaliated and(wounded)onesuspect,whowas tak-en to hospital for medical attentionunder police guard, and the secondone was arrested.”

Police believed the two had beeninvolved inaheist inGreytown inNo-

vember last year.They tookanundis-closed amount of cash at gunpointfrom security guards.

On Sunday, police recovered thebakkieused in theGreytownrobbery,andtwofirearmswiththeserialnum-bers filed off.

The Great Train Race is on!

THE North Coast-Zululand Great Train Race,which includes cycling and running racesagainst a freight train, is on track to take placeon Saturday 8 March.

The event - which was originally set for thelast quarter of 2013 - was postponed due toclashes with other sports events. Thus, thisyearseesits inauguration.Therace-backedbyKwaDukuza, Mandeni, Uthungulu, Umlalaziand Umhlatuze municipalities - is supportedandfacilitatedbyEnterprise iLembeandspon-sored by a number of private businesses. TheDepartmentofTransportandTransnetarealsoon board.

“Weareveryexcitedtobebringingthisorigi-nalsportseventtothearea,”saideventco-ordi-nator and project manager, Diane Wessels.

“We are positive about the economic andtourismspin-offs theracewill create,” sheadd-ed.

She said the event was started due to a de-mand for such an event.

The main start line is at New Guelderland

railwaystationnearKwaDukuza,andthemainfinish is at Empangeni station. There will be anumber of aspects to the race.

The longest will be the Iron Man runningrace,whichwill span the full distance betweenstations (106,7km).

TheMTB racewill take place off road alongdistrict roads, starting at 8am at the Nyonistore, and is about 77km. There will be a five-person relay race of about 21km.

There will also be shorter fun runs in andaround Empangeni. The main races will takeplace along the scenic R102, and detourthroughinlandtowns.Theracewillworkonanup run, down run format - this year is up.

The freight trainwill runonexistingrailwaytracks.Whoeverarrives first,manor train,willbedeclared thewinner.Therewill alsobeplen-tyofentertainment,with formerEastCoastRa-dioDJDaveGuselli asmaster of ceremonies atthe start line, and sport commentator KeithEaton at the finish. Live bands, food and drinkand fun for kiddies also on.

AN excited band of Checkout Verulam Fal­cons runners participated in the first 2014comrade’s qualifier over the past weekend.

The NOSA 42km and 21km race tradi­tionally attracts a large field with runnerseagerly wanting to secure an early qualifi­er. The race organised by Hillcrest Villagerspresented runners with a familiar two laproute with the last quarter of the race sap­ping out all runner resources with runnershaving to conquer a series of hills to the fin­ish. Compounded with the hills, the ex­tremely hot morning did not offer any re­spite for participants.

This did not deter Dhiren Govender whowas in sizzling and explosive form record­

ing his personal best time with a superla­tive time of 3.53.
