Inconnection with the new ‘pointof consumption regime’, theGambling Commission hasalready implemented a raft ofchanges to licensingconditions that remotegambling operators will haveto adhere to. Further changes

to the gambling softwarelicensing regime do not takeeffect until March 31, 2015.After the verdict wasannounced, a spokespersonfor the GBGA said that theywere disappointed with JusticeGreen’s ruling. He said that theUK had an opportunity tointroduce a cross-borderregulatory regime which wouldbenefit consumers and theindustry alike. The GBGAmaintains that the newlegislation is not in the bestinterests of UK gamblers, but itwill not appeal the verdict.

RLMS Sales is aiming to dispelwhat might be described as an

urban myth at this week’sAutumn Coin-op Show at Stam-ford Bridge, namely that the gameof poker is less popular outsideof big cities like London. Takingup the story was managing direc-tor Phil Boulton who has assem-bled a strong line-up of pokerthemed Cat C products for theinaugural ACOS.

r Justice Green has rejectedthe GBGA’s legal challengeto the UK (Licensing and

Advertising) Gambling Act 2014.The Act requires remote gam-

bling operators not physicallylocated in the UK to obtain licencesto provide an online gambling serv-ice to UK gamblers and to pay apoint of consumption tax of 15 percent on the profitsmade from theirUK operations.

Legislation was due to take effecton October 1 but, after the legalchallenge to the Act by the GBGA, ahearing took place at the RoyalCourts of Justice in London andimplementation of the legislationwas delayed until November 1.

The GBGA represents a numberof remote operators based inGibraltar, including 888, Bet365,Betfair, Bwin, Ladbrokes, VictorChandler and William Hill.

On behalf of these firms, theGBGA took legal action on thegrounds that the implementationof a 15 per cent tax would create anunfair advantage to UK-based oper-ators and that the UK Gambling Actwas illegitimate, disproportionateand discriminatory interferencewith the right to free movement ofservices guaranteed by Article 56of the Treaty of the Functioning ofthe European Union.

The GBGA suggested an alter-native “passport solution” for regu-lating online gambling in the UKthat would create a consistency ofregulation between what wasalready in place in Gibraltar andwhat was being proposed in thenew Act. The GBGA also claimedthat this solution would impose amore proportionate burden on itsmembers.

After the two-day hearing at theend of September, Mr JusticeNicholas Green announced that hewould not be able to make a deci-sion on the case until after October1. The Act was delayed by one

month pending his verdict, and onOctober 10 Justice Green releaseda 96 page decision rejecting theGBGA arguments.

In the paper, Justice Green foundthat the GBGA had failed to showthat the new legislation was unlaw-ful under UK or EU law - pointingout that Gibraltar was not a fullmember of the EU anyway. Thejudge wrote that the UK GamblingAct served a series of legitimateobjectives and was neither dispro-portionate nor discriminatory.

In respect of the GBGA’s pro-posed passport solution, Greenwrote that it would fail to meet theobjectives of the Act or prove effec-tive or achievable without signifi-cant bureaucracy or extra cost. Heconcluded by dismissing theGBGA’s concerns that the UK reg-ulator will find it difficult to holdcompanies to account in jurisdic-tions outside the EU.

The DCMS said the delayedreforms will now becomeeffective from November 1,2014. “We welcome thejudgment,” a DCMSspokesperson said in astatement. “We now lookforward to thecommencement of theGambling (Licensing andAdvertising) Act on November1, which will strengthenprotection for consumers inBritain by ensuring that allremote gambling operatorswill be subject to robust andconsistent regulation.”

Needham has said that thoseblocking the proposed five-star casino and leisure com-plex in Belfast are preventingpeople from enjoying them-selves responsibly.

New Social DevelopmentMinister Mervyn Storey, how-ever, told the Belfast Telegraphthat he will not scrap currentlegislation banning casinosoperating in Northern Ireland.

Needham, who sits as a non-executive member on theboard at Rank, the gamblingcompany behind the plans,said that opponents of themove are denying NorthernIreland a world-class attraction‘blindly’ without taking timeto examine the facts.

Needham urged BelfastCity Council to fight for thepower to grant the casino agambling licence. Currently,such a move can only be madeby the Department for SocialDevelopment.

Rank Group claims the£25m facility would include abowling alley, cinema andrestaurants as well as a casino.

The development would alsoinclude a hotel. Rank said theinitiative would create 200jobs for people from socially-deprived areas of the city.

Former Under-Secretary ofState for Northern IrelandNeedham said he believed achange in the law would bringa boost to the economy andthat the casino was just onepart of the sprawling com-plex outlined.

New Social DevelopmentMinister Storey signalled thathe will take a tough stanceover the licensing of casinos,however. He stated: “Casinogaming is generally regardedas the hardest form of gam-bling and is highly suscepti-ble to abuse by criminalelements. I have a duty to pro-tect vulnerable people andtheir families. Legalising casi-nos would bring with it thepotential for people here tolose large amounts of money -just on the single throw of adice. A gambling prevalencesurvey commissioned by mydepartment in 2010 hasshown that the level of prob-lem gambling here is overthree times higher than in the

rest of the UK; this equates toover 2 per cent of the popula-tion. In simple terms thismeans that one in every 50people here has a gamblingproblem.

“In bringing forward pro-posals for gambling regula-tion, my priority is to minimiseits effects. I intend to includemeasures to protect the vul-nerable and ensure fairness forconsumers. However, on theissue of casinos there is nostrong demand for casinoshere.”

Needham countered:“There are still too manyvoices heckling from the past,disrupting progress for thesake of maintaining their his-toric grievances. Some ofthese voices are part of theopposition to the creation ofan international entertain-ments complex which wouldcreate 200 jobs. These samevoices would deny Belfast CityCouncil of benefiting from upto £2m annually in rates.

“They argue that such afive-star entertainmentsattraction with bowlingalleys, art house cinema,restaurants, casino and bingo

hall should be bannedbecause gaming is sinful anddamaging to the gambler.Such puritanical nonsense!

“Rank was founded by aMethodist minister 80 yearsago when Arthur Rank wasmaking films extolling thevirtues of good living. But hequickly realised that makingentertainment, somethingfrowned upon then just ascasinos and gambling arefrowned upon now by thosesame custodians of our fragilemoral fibre, was much moreenjoyable as well as profitable.

“I urge the council to takeadvantage of the investmentopportunity and to take thefight to the DSD, which con-trols the gambling laws ofNorthern Ireland.”

Needham concluded: “Allwe need is Belfast City Coun-cil to agree to adopt the pro-posal as a component of thecity redevelopment projectand to aim for a derogationfrom DSD to allow it to createits own gambling licence. IfBelfast City Council canlicense pubs, clubs, bookies,arcades and music venues,why not a casino?”

operators is too onerous andthen the machines are supposedto stay on the same piece ofcarpet for years and years to beupdated with new games.

“We believe that by treatingvideo Cat C in the same way asanalogue and moving themachines through operators’estates, we can get past the barri-ers of acceptance to the concept.In effect, rather than trying tochange the market in order toincrease video Cat C penetration,we are adapting our strategy tofit the current commercials. Crit-

ically, there will be no majorinvestment necessary.

“Operators can just take it onrental. In addition, we have some-thing that most other suppliersdon’t - a suite of retailer-approved games, including HotShots, Fiddle A Fortune, Best ofBritish and Galloping Jackpots tospearhead the product, backedby successful poker and slot-based games,” Stott concluded.

BACTA CEO John White has praisedthe Gambling Commission’s will-

ingness to enter into discussionregarding UK licensing conditions.Having attended the Gambling Com-mission’s Consultation event on theLCCP last week, White stated: “Iapplaud the Commission for usingmore than just a desk exercise in get-ting industry’s views on the proposedchanges. For some of the proposedchanges there was lively debate, forothers less so. Many were rightly quitefearful of some of the proposals.”

White believes that the Commis-sion was quite forthcoming and rea-sonable in explaining their rationalebehind the draft changes, whilst hefelt the industry, which had experi-

enced first-hand how a number of theexisting LCCP conditions ‘worked’ inpractice, saw them as less benign.

He added: “BACTA is still workingon its response and I therefore con-tributed where I had a good under-standing of members’ positions(members were there too and able tocontribute). Key questions for meremain - is there good evidence tosupport any change, is it proportion-ate and, crucially will it work? Ourresponse will be mediated by theseconsiderations.”

White concluded: “BACTA is veryshortly going to issue its updatedtoolkit for AGCs and FECs. This is theindustry bible of good practice and itcontinues to be well regarded by ourRegulator. We took the opportunityof the new sector specific LCCP thatcame in in August to give the docu-ment an overhaul. It will of course befree to members.”

Police in Cumbria have warnedoperators in the county to

beware after a man and womanused a key device to emptymachine cashboxes at a holidaypark amusement arcade.

The raid took place on theafternoon of September 30 at theSolway Holiday Village in Silloth,operated by Hagan Leisure.

Officers have not said howmany of the arcade’s coin-opmachines were targeted or howmuch money the couple got awaywith, but they did confirm thatthose machines were emptied.

Police have issued detaileddescriptions of the suspects, whothey say were armed with a keythat allowed them to open themachines.

The man was white, tall, thin,

with light-coloured hair, clean-shaven and under 25-years-old.He wore a distinctive long-sleeved top that bore a MickeyMouse logo.

The woman was also white andunder 25-years-old, and wore adark-coloured thigh-length coatthat had a white-lined hood. Shehad long dark hair and was wear-ing white plimsols.

A spokesman for Cumbria said:

“They knew to target the caravanpark when it was not busy.”

He asked amusement arcadeowners in the county to protectthemselves from travelling crimi-nals by using additional lockingdevices on slot machines, warn-ing that many can be opened witha generic key.

Scottish town Stranraer could bein line for a brand new ten-pin

bowling and laser game facility. Dum-fries and Galloway Council agreed tosupport investigations into a Wig-townshire Community SportsCentre, an idea which has been onthe cards for many years but whichhas never been pinned down to a setlocation. The facility will include anindoor bowling facility, ten-pin bowl-ing alleys, laser games, café and amulti-purpose function room.

Council officers have been work-ing with the sports centre commit-tee, which is made up of members ofthe public from the local community,to develop a business plan which isnow complete, but the next task is toidentify a suitable location for thecentre.

Several sites have been suggested,including the East Pier and PortRodie Frontage. With Stena Line and

the council still receiving tendersfrom organisations interested indeveloping the pier site, however, noplans can be determined until all ten-ders are in.

So instead, councillors suggestedtwo additional sites for consideration- land adjacent to Agnew Park Pavil-ion and the former Marine Lake area,for which the council has already ear-marked £410,000 in upgrades. Coun-cillors agreed to look more at thepotential for Agnew Park to host thefacility, but agreed it could be prob-lematic with planning issues andcould impact on the park’s ability tohold larger events.

Twenty million gamersare expected to take part inthe first VGWC. Should themaximum subscription of128 players per week, percountry and per game beachieved, the world cham-pion, for each game, standsto receive a cheque worthmore than $1m.

Each week, competitorswill have the chance toqualify for the nationalfinals in one of two ways.

Players can either qualifydirectly by winning one ofthe weekly national tour-naments or by topping thenational game rankingduring the regular season,which will run for a total of29 weeks from its launchon 10 November 2014 to31 May 2015.

Different national com-petitions will start eachweek. Players will competeagainst each other onlineusing their own consolesand computers, and savetheir sessions once com-pleted. Only 128 competi-tors may take part perweek, per country and pergame. There will be a maxi-mum of 32 teams for multi-player games. The

registration fee is $30 for aqualifying week and 40 percent of the funds collected(of which $12 will be with-held at source upon regis-tration) will be paid asbonuses.

At the end of the 29-week regular season, thewinners will be invited tocompete in the nationalfinals, to be held in eachcountry between 1 and 21June 2015. The final roundswill be composed of 32players in eight pools offour teams each, i.e. 29 win-ners, together with thebest player of the regularseason and two wildcards.The overall nationalwinner in each countrywill be awarded a cheque

for over $10,000.National champions will

compete in the continen-tal finals from 22 to 28 June2015. One player per con-tinent and per game will becrowned the continentalchampion and will receivea cheque for over$100,000.

All continental champi-ons will compete in theWorld Cup Final to be heldfrom 3 to 5 July 2015 at aprestigious venue in NewYork with all air fares andhotel costs covered by theorganisers. The venue forthe final will be announcedby January 1, 2015.

he Dreamland Trusthas unveiled itsplans for the first

phase of the redevelop-ment of Margate’s iconicamusement park.

The new ‘heritage’amusement park is due toopen next year and hasreceived a total of £18mfrom Thanet District Coun-cil, the Heritage LotteryFund and the government’sSea Change programme.

Around 150 people willbe employed by Dream-land during peak seasonaccording to the Trust,alongside another 50employed indirectly onconcession stands, bring-ing the number of new jobscreated at the resort toaround 200.

The centrepiece of the

new attraction will be thereconstructed Grade II-listed Scenic Railway roller-coaster.

Speaking at the launch ofthe plans last week, projectdirector Eddie Kemsleysaid: “The Scenic Railwaytook half a million visitorsin its first few weeks ofopening, it was so iconicand important on a nationallevel that people visitedfrom all over the country toride it.

“It’s beautiful, it’s visuallybrilliant and makes a greatnoise as the cars go alongthe track because it’s old.

“We’ve got wonderfulvintage rides all over thecountry in workshopsbeing restored. Some ofthem are nearly finished,some of them are in various

stages of repair.”Although entry costs

have yet to be announced,membership schemes areplanned for the local com-munity to offer it as muchuse as possible from thesite.

Kemsley revealed thatthe design and branding ofits redevelopment is beingled by renowned designerWayne Hemingway, addingthat there wouldn’t be asingle area of the new parkthat hadn’t been touchedby an artist or designer.

She explained: “Visitorswon’t sit on a bench, they’ll

sit on a reclaimed dodgemcar that’s been upcycledand turned into a bench.

“There won’t be ordi-nary queues with posts andropes to go on a ride, it’ll bebits of letters from an oldillumination from Black-pool which will create thequeue line.

“Wayne Hemingwaywants every single view tobe an Instagram momentwhich can be posted onlineand look really interesting.”

Although the Trust isaiming for a vintage style forthe new park, Kemsley saidit would incorporateplenty of modern ele-ments.

She commented: “Fromthe front the site will looklike a really cool modernleisure complex, with all

the cool architecture toremind us of the past, butthen visitors will walk pastmodern bits that have beeninterpreted in a differentway.

“The entrance will havethe yellow and black colourscheme which will runthroughout the whole proj-ect.

“The cafes will have acool mix of modern andvintage and the formerdancehall can cater forweddings, corporateevents and Christmas par-ties.

“And no seaside amuse-ment park would be com-plete without a vintagepinball parlour - and ourswill be the biggest andrarest collection in Europe,and maybe the world.”

Aviolent robber whostole thousands of

pounds from an amuse-ment arcade of the Isle ofSheppy in Kent has beenjailed.

Jonathon Finnegan, 25,broke into Mr Gs in Leys-down-on-Sea with twoarmed accomplices andtook almost £3,000 from itssafe on June 29 last year.

The three men then fledin a black BMW, forcingarmed officers and a policehelicopter to sweep thearea and close the SheppeyCrossing to try and pre-

vent them from leaving theisland.

Finnegan, from westLondon, pleaded guilty tothe robbery at MaidstoneCrown Court on March 11this year and received his

sentence at IsleworthCrown Court last week.

He was given 18-and-a-half-years in prison for theraid, as well as a further twoattempted robberies, onerobbery, aggravated bur-

glary, possession of an imi-tation firearm, attemptedkidnap and drugs offences.

Dail Sillah, 30, who helpedFinnegan rob a PortobelloRoad market stall-holder atgunpoint in her own westLondon home, was jailed fora total of 12 years.

Speaking after the sen-tencing, Detective Consta-ble Tony Dunne said:“Finnegan and Sillah havebeen handed significantsentences for a number ofviolent offences includingthe attempted robbery of amother in front of her five-year-old son which left himtraumatised.

“Finnegan’s recklessefforts to escape policewere stopped due to thebravery of a member of thepublic, who had thecourage to stand up to histhreats bringing his crimespree to an end.

“Finnegan and Sillah’soffences were violent andthey have now received thelong custodial sentencethey fully deserve.”

One of Finnegan’saccomplices in the Mr Gsraid, 26-year-old GaryGrannells, was sentencedto six years and eightmonths at IsleworthCrown Court in August.

Aman was killed lastweek after he was hit

by falling masonry fromthe roof of an amusementarcade during a storm atthe Yorkshire resort ofBridlington.

An ambulance crew,the fire brigade and policeall attended the scenenear the Pleasurelandarcade, but the 61-year-old, thought to be a taxidriver, died as a result ofhis injuries.

According to the MetOffice, a strong gale, withgusts of up to 48mph, wasrecorded in Bridlington atthe time of the incident,but it is not known if thiswas the cause of the inci-dent.

Another taxi driver,who witnessed the acci-dent, described what hesaw: “It came down onthe top of the car and hewas walking towards theamusement arcade. Hewas straight outside mycar and I watched him godown.

“He was minding hisown business and justwalking towards Plea-sureland Amusements.The falling masonry camefrom the pointing on thetop of the building. That’swhere it all came from.

“It quite a new buildingand it’s been there forunder ten years. Appar-ently somebody saw itwobble a few weeks ago.It’s not an old building.”

nity building and club hascaused concern with the Cam-paign for Real Ale and Mexbor-ough councillor Andy Pickering.

Doncaster CAMRA commu-nity pubs officer Peter Kennedysaid: “Working Men’s Clubs havea big role in the community, justlike pubs, and this is part of thesame sort of trend for pubs beingshut down. It is a shame to see itgo and I’m sure a lot of people inthe community will be sad to seeit lost. We want to see the tax on

beer put at the same level assupermarkets so that places likethis can compete.”

Cllr Pickering agreed, andpledged his support for localpaper The Star’s campaign tokeep community pubs and clubsalive.

He said: “It is very sad and Iknow the members of the club’scommittee tried very hard tokeep North Gate afloat. It was awell-loved and well used venuein its heyday. We need to have a

level playing field for pubs andclubs and supermarkets in termsof tax. I support the Star’s SaveOur Pubs campaign.”

He said North Gate may havesuffered from its location, whichwas on an estate rather than inthe town centre. Last orderswere called at the once popularworking men’s club for the finaltime in February 2010 aftermore than 80 years. The site hasbeen boarded up for more thanfour years.

he first ever Autumn Coin-op Show (ACOS) hits westLondon at a time when money is once again, slowly,beginning to flow around the industry. And despite per-

sisting difficulties, Astra’s director of sales, Alan Rogers, believesthat there are reasons for hope. “There has been an improvedappetite across the board for investing in the business andthere’s a willingness on the part of stakeholders to explore newideas and open up to fresh concepts,” he said.

Nevertheless, we remain a sizeable distance from the hey-days of old and there’s plenty of ground to still be gained. “Ithink that the industry finds itself in a challenging position atthe moment,” said Rogers. “There is a stability of sorts in so far aswe’ve had things a lot worse in the past, but then again we canall recall times when we’ve had things much better.”

ACOS could well be a catalyst in that rejuvenation project,but Rogers warns that it will require a communal effort to makethe show, and its positive effects, a lasting success. “Accordingto the theory,” he said, “an autumn exhibition should providethe perfect setting for industry stakeholders to gather and pre-pare for any opportunities that might emerge when the showseason proper kicks off in January. The hard part, of course, isencouraging everyone to subscribe to that theory and to getinto the spirit of the event.”

On an individual level, Astra will ultimately judge the showon sales. “All shows are judged to some extent by what’s in theorder book after the doors have closed,” noted Rogers. How-ever, there are other valuable rewards to be taken from eachand every show, and with ACOS slotting in ahead of the majorshow season, simply allowing customers to get eyes on prod-uct may prove equally as valuable.

“Sales form a vital element of the exhibition process,” saidRogers, “and we’ll be looking to sell as much product as we canover the two days at ACOS, to lay down the foundations for fur-ther orders at EAG and ICE. But as any exhibitor will testify, ahealthy order book on its own does not always signify a suc-cessful show. There are other factors such as the number andquality of visitors who attend.”

In depth discussions, both with customers and competitors,also form a major component of any good show and Rogersbelieves that coin-op folk have a natural aptitude for produc-tive conversation. “Networking has always been one of the coin-op industry’s strongest points,” he noted. “In good times andbad, stakeholders and competitors have come together to talkover the challenges, threats and opportunities faced by thebusiness.”

This fosters a spirit of lively debate, without causing bitterdivisions between rival businesses. “We might not always agreeon everything,” he said, “but as an industry we are very good atworking together to find solutions.”

For this reason, Rogers will ensure that he and his colleaguesretain focus on networking throughout the two-day event.“From an Astra perspective, we always take time out to talk withour customers at shows,” he said, “and ACOS will be no excep-tion. It helps to forge new relationships and strengthen exist-ing ones, and the feedback we get is invaluable.”

The British Association of Pool Table Operators (BAPTO)is firm in its belief that the newly minted Autumn Coin-

op Show will be a worthwhile endeavour, not only for itsmembers, but for the industry as a whole. “ACOS will be asuccessful show,” stated a confident Bob Blakeborough.

With the summer fading from view, operators and sup-pliers will be on the prowl for the latest proven products,searching for games and machines that are still new tomarket, but that have shown evidence of success in thefield. “In introducing new ranges of equipment which arereadily available,” said association treasurer, Blakeborough,“the Autumn Show gives an opportunity for visitors tokeep right up to date with new products and innovations.”

The coin-op pool sector has traditionally relied heavilyon support from pubs and the recent decline of wet-ledestablishments has impacted BAPTO’s members. “The cur-rent state of the market could realistically be described aschallenging,” said Blakeborough, “largely due to the vast

number of public houses that have closed in recent years.”He also believes that, as the options for the pool-playing

public have decreased, players are lost as they are unableor unwilling to seek out new venues. “There’s also a feel-ing that the customers from those closed down locationsdo not have significantly boosted trade at other locations,”said Blakeborough. “Also, the trend to cater towards foodrather than games does not enhance coin-op machine tak-ings.”

However, from behind the scenes at ACOS, show organ-iser Karen Cooke has reported a surprisingly strong uptakefrom the pub sector that could signal a shift in pool’s favour.“One area I wasn’t anticipating such a strong responsewas pubs,” she told Coinslot. “There’s been a great deal ofinterest from pubs and club people which is really encour-aging for the machines sector.”

This plays well into BAPTO’s plan of action, to helpvenues promote pool to their customers. “BAPTO is cur-

rently focused on promoting pool for the grass roots pubplayer and has this year given every member a selection ofpromotional kits to assist in this effort,” said Blakeborough.

The Association is also working hard at providing attrac-tive offers to pool operators around the country. “We arealso seeking discounts from suppliers, to our members,aimed at savings greater than our annual subscription,”said Blakeborough, and the networking opportunitiesafforded by ACOS will undoubtedly play a role in its efforts.

ohn Powell’s credentials are impres-sive. A fellow of the Institute of Char-tered and Certified Accountants, he

has over 35 years’ experience of workingin the gaming and amusement machineindustry. Currently serving as BACTA’s hon-orary treasurer, Powell is also chairman ofthe Independent Operators Association(IOA Group), a specialist marketing andpurchasing organisation comprised of 15independent gaming machine suppliers.Amongst his busy schedule, he also findstime to serve as managing director of S ELeisure Ltd, who supply over 5,000 amuse-ment machines to the pub and club sector.

Armed with a wealth of industry know-how, we asked Powell how important hejudged the upcoming Autumn Coin OpShow to be.

“It’s very important,” he replied. “Previ-ously, there was a substantial gap in thetrade-show calendar since the previousautumn show ceased some years ago.There’s too long a period to go from oneEAG to another, so ACOS fills the void thatwas created quite nicely.”

Whilst anticipation for ACOS amongstsuppliers and operators alike remains high,Powell was conscious of the wider sectorenvironment that forms the backdrop tothe event. “It’s still very difficult,” he said,“especially as far as single-site venue oper-ation is going.” He outlined a particular areaof flux underlying the industry obstacleshis business is facing: “The marketplace ischanging, and the key thing is the fact thatthere are now less pubs operatingmachines.” How did he explain this slow-down in the pub sector? Powell was defini-tive: “What it comes down to is a widerchange in peoples’ social habits.”

In spite of the challenges, Powell valuesACOS as one of the industry’s premieropportunities for forging closer businesslinks: “The networking potential at ACOS is

incredibly useful”, he commented. Regard-ing the criteria of what he would considerto be a successful attendance, he stated: “It’sa question of who attended, who we meetand the reaction we get to our products. SELeisure will be showcasing the latestmachine under our G Squared banner - ifthat leads onto approvals then we’ll con-sider it a major success.”

Bill Simmonds comes to the Autumn Coin-op Show with a discerning eye born out

of decades of experience: “We’ve been inbusiness fifty years, and I’ve been here forthe duration,” said Simmonds, who was some-thing of an early-starter. “I’ve been going toamusement trade-shows since I was twelveyears old.”

He’ll be well-placed to survey the show’slatest offerings: his business has experiencedsomething of an upturn in recent months.“Business is good at the moment, we’reslowly picking it up,” he noted, “in general,the sector seems to be up and down, a bit

unpredictable, but in the long term I’m stilloptimistic.”

To his mind, the success of a show hingesupon the quality of its exhibitors: “Looking atthe brochure, I’m particularly optimisticabout this year.” He commented. “It looks likeit’ll shape up to be a real success.”

Simmonds echoes a familiar sentiment asto the timely occurrence of ACOS in regardsto the industry calendar: “We needed some-thing around this time in the year,” he stated -there’s been a gap around this time of theyear for quite some time, and so ACOS seemsthe logical way forward.”

The benefits of attending are twofold, heargued: “It’s a networking opportunity for usmainly, but it’s also useful to see if there’s any-thing really new and different on the market.”

With his business specialising in thesupply and operation of machines to the pubsector, the prospect of new product acquisi-tion may be tempered against that specificsector’s challenges:

“A major obstacle that we’re facing at themoment is trying to get enough rent for ourmachines,” he explained. “The brewers wantthe best products with the latest features butaren’t willing to match the cost of leasing

these newer machines. We’re constantly bat-tling the uphill struggle of reaching a fairprice on the rent of our units.”

Whilst ACOS represents one of the bestopportunities to take in the industry’s latestinnovations, for Simmonds, the event wouldbenefit from additional SWP games: “It’s notthe fault of the show - it’s the governmentlegislation which has essentially taken awhole ream of SWP games out the running,”he said. “The industry requires support fromthe government, not the passing of measureswhich detract from its earnings.”

Industry leaders urged the gov-ernment to commit to tourism

and do more to promoteemployment in the sector duringa debate held at the Conserva-tive Party Conference in Birm-ingham, according toBighospitality.co.uk.

British Hospitality Associa-tion chief executive Ufi Ibrahimand Travelodge chief executivePeter Gowers were among thespeakers addressing an audi-ence of MPs, parliamentary can-didates and NGOs at the event,which focused on the growthpotential of ‘unexploited sec-tors’ in the UK economy.

Gowers said that a ‘broad-based economic recovery’ -which delivers social mobilityand raises living standards forall - would be dependent ongrowth in all sectors, not justthose requiring a high level ofacademic skill.

He underlined the importanceof tourism to job creation, withthe sector creating a third of allnew jobs since 2010 and Trav-elodge alone helping 3,000unemployed people back intowork through its partnership

with the Job Centre since 2007.“One in ten people in the UK

work in travel and tourism, and alot of people in this room todaylook surprised by this. This is a£127bn sector that provides fan-tastic career opportunities andwhat we need is a governmentwho celebrate the role tourismcan play and stands up for theindustry,” he said.

Gowers also argued thattourism offers excellent careerprogression, and called on thegovernment to do more toencourage lifelong learning insectors currently below the‘national radar’.

In response, Nick Boles MP,minister of State for Skills andEqualities, acknowledged therole that tourism plays in theeconomy, and said it was a‘huge priority’ for the govern-ment.

He argued that the industryshould play a role in highlightingopportunities, because it was‘more in touch than politiciansabout what employees need’,but agreed that more needed tobe done to improve access tolifelong learning.

The debate then turned tointernational competitiveness,with BHA chief executive UfiIbrahim warning the objectivesput forward by Prime MinisterDavid Cameron were at risk ofbeing missed without furthergovernment action.

Dr Gerard Lyons, chief eco-nomic advisor to the Mayor ofLondon also took to the stage toargue the importance of tacklingbusiness taxes, regulation andtransport to help tourism busi-nesses succeed, while BaronessNeville-Rolfe DBE CMG, Parlia-mentary Under Secretary ofState for Business, Innovationand Skills, called for the govern-ment to adopt a ‘long-termvision’ on infrastructure.

Elsewhere, an Asian bettinggroup submits plans to trans-form vacant office building intonew betting shop, bar andrestaurant venue, according tothe Birmingham Post. Onlinegaming company 138.com iseyeing a disused office buildingin Birmingham’s Southside dis-trict to create a mixed-useentertainment complex.

“The property attracted onlya limited number of viewingsfrom potential office occu-piers,” it added.

“None of these resulted in anoffer to occupy the building inoffice use (therefore) it isextremely unlikely it will attractan office occupier. Whilst not asuitable property for manyoffice occupiers, the building isof interest to leisure and enter-tainment operators given itslocation on the edge of theArcadian Centre.”

Mr Justice Green has handeddown his eagerly awaited judge-

ment in the judicial review proceed-ings brought by the Gibraltar Bettingand Gaming Association.

In a 96 page judgement, Mr Jus-tice Green rejected the GBGA’sclaim that the Gambling (Licensingand Advertising) Act 2014 infringedEU or domestic law. In what he statedwas in his judgment “a clear cut case”he ruled that the new regime was:

“…neither disproportionate, nordiscriminatory, nor is it irrational.The new regime serves a series oflegitimate objectives. There is noreason to doubt Parliament’s judge-ment that it will achieve a reason-able degree of effectiveness andthere is no proper basis for conclud-ing that it is or will be discriminatoryin its effects. Further, I reject the sub-mission that the new regime willcreate perverse incentives and leadto the creation of an illicit market ofunscrupulous service providers.”

In his judgement, the documen-tary evidence from 2010 onwards(when the UK government began toconsult over changes to the licens-ing regime) recorded “a strong andconsistent justification based uponconsumer protection and the pro-tection of public order” and that“these were objectives the Govern-ment and Parliament were entitledto pursue”.

He concluded that: “Consumerswant to avoid being cheated. Theywant winnings to be paid. They wanttheir personal data to be kept confi-dential. They want to have confi-dence that the operators withwhom they deal are properly regu-lated in these respects and that inthe event of a problem they can con-tact the regulator easily. The Statewants consumers to be protectedfrom addiction and wants those who

profit from gambling to assumesome level of responsibility for thesocial ills that gambling can lead to.In my view a regime that does nomore than bring service providerswithin the confines of a consumerand public order oriented regime inthe State that they target servesentirely legitimate objectives.”

For those within the industry whobelieve the new regime is reallyabout tax revenues, Mr Justice Greennoted the explanation of the UK gov-ernment that the exposure of off-shore operators to the domestic taxregime “was a by-product of theregime not its principal justifica-tion”. For his purposes, he excludedany economic considerations indetermining that there was suffi-cient justification for the new regimebased only upon legitimate con-sumer and/or public order grounds.

For those within the industry whobelieve the new regime will prove tobe unenforceable, Mr Justice Greensaid that: “First, there is no evidenceor reason to believe that there will bea major enforcement problem. Sec-ondly, even if there are limitations inthe enforcement regime, the Govern-ment and Parliament were entitled totake the view that the suite of enforce-ment powers available to the GCwould be sufficient, at least in largemeasure, to meet the licensing objec-tives. Thirdly, the Government hasacknowledged that if and insofar asthis proves not to be the case that itwould review the law and take stepsto strengthen enforcement powers.”

No application was made in courtfor leave to appeal, as we would ordi-narily have expected if there hadbeen any intention on the part of theGBGA to appeal. In terms of whatthis means for operators, the newregime will go ahead, as planned, on1 November 2014.
