Question

We are writing for some clarifications concerning the renewal of the Paul-Henri Spaak building’s competition.

At Chapter 2, Article III 2.2., it is stated :

“Candidates must provide at least three references for projects for which they are the designer or the associate designer, at least one of which must relate to a built project in connection with multifunctional buildings in urban areas and with a minimum total surface area (three projects) of 120 000 m², carried out and/or built over the last 10 years as of the closing date for applications. Built projects can substitute for unbuilt projects.”

1. Can you please confirm that the minimum total surface of 120.000 m² should be related to no more than three projects?

2. From the above statement, it seems it is possible to present more than three references : is this correct ?

3. Can you please confirm that at least one of the presented references should be a built project while the others can also be projects under construction ?

1. Nous confirmons que la surface totale de 120 000 m² se réfère à un maximum de trois projets même si les candidats sont autorisés à présenter plus de trois références.

2. Nous confirmons que plus de 3 références peuvent être présentées. Néanmoins, nous ne tiendrons compte que des 3 références relatives aux trois projets concernant des bâtiments dont la somme des surfaces est égale à 120 000 m² minimum.

1. We confirm that the minimum total surface of 120.000 m² must relate to no more than three projects even if candidates are allowed to submit more than three references.

2. We confirm that more than three references can be presented. However, only the 3 references that reach together the minimum of 120.000 m2 will be taken into account.

3. We confirm that at least one project must have been built (handed over or in use) within the period of 10 years preceding the submission deadline. The other projects must have had at least one of the following phases underway in the period of 10 years preceding the submission deadline:

o Pre-Design ;

Dans le fichier-type 2 (références de projets), l’expression « date de début de projet » de la cellule F37 doit être comprise dans le sens du travail des auteurs de projet, comme par exemple la phase d’esquisse ou de conception, et non pas la date du début du projet de construction (travaux).

Question 1

In relation with the technical and professional criteria, could you kindly clarify the following:

1. Does the minimum total surface required of 120.000 m2 corresponds to the addition of the three projects? 2. Where it says “Built projects can substitute for unbuilt projects”, does this mean that it is not necessary that they are built projects? Does any of the

three need to be built? 3. Do all three projects need to comply with the requirements of being carried out or built over the last 10 years? 4. Will additional references be considered?

1. La surface minimale de 120 000 m² peut effectivement être atteinte en additionnant les surfaces des immeubles objets de trois références présentées.

2. Parmi les références présentées, l’une doit se référer à un projet construit. Les 2 autres peuvent concerner, au choix, soit des projets construits, soit des projets en cours.

3. Les 3 projets doivent avoir été construits ou réalisés au cours de la période de 10 années qui précède la date limite de remise des candidatures.

4. Bien que plus de 3 références peuvent être présentées, il ne sera tenu compte que des 3 références relatives aux trois projets concernant des bâtiments dont la somme des surfaces est égale à 120 000 m² minimum.

Answer:

1. The minimum surface of 120 000 m² can be reached by adding the surfaces of the three projects, used as references.

2. Among the references that are presented, one of the project must be built. The other two may be either in progress or built.

3. All three projects need to comply with the requirements of being carried out or built over the last 10 years.

4. Additional references may be presented; however only the three references whose total surface achieve the total of 120 000 m² will be considered.

Question 2

Will the basis for the renovation/refurbishment and reconstruction categories will be explained with more detail for the shortlisted competitors? The explanation provided in Article IV.3.1 is too broad. Are there any particular standards to be followed to clearly distinguish these two categories?

La distinction entre rénovation et reconstruction est définie à l’article IV.3.1 du Règlement du concours. Le critère auquel ce texte fait référence est le SEUL critère qui sera utilisé pour opérer la distinction entre un projet en rénovation, et un projet en démolition/reconstruction. Aucun autre critère sera ajouté ultérieurement.

The distinction between renovation and demolition/reconstruction is specified in article IV.3.1 of the Competition Rules. This criteria mentioned in the Rules is the ONLY ONE that will be applied in order to make the distinction between a project following the renovation option, the one that follows the demolition/reconstruction option. No other criteria will later be added.

Question 3

Kindly confirm the time limit for receipt of request to participate is 16/12/2019 as in the initial notice it was stated 10/12/2019?

Question 4

Kindly confirm if it is necessary to carry out any registration process prior to the submission of the “request to participate” documentation to be submitted 16/12?

Nous confirmons qu’il n’y a pas d’enregistrement préalable à réaliser AVANT la remise du dossier de candidature le 16 décembre 2019.

We confirm that there is no registration process PRIOR to the submission of the “request to participate” documentation to be submitted by 16 December 2019.




Question

At page 17 of the Dutch version of the competition rules of the Paul-Henri Spaak building’s competition, it is stated: “Criteria for economic and financial status Applicants must prove that they have achieved a minimum turnover of EUR 1.000.000.000 in the architectural sector in each of the financial years 2016, 2017 and 2018. In the case of a combination, the candidate's turnover is the sum of the turnover achieved by all members of the combination in the architectural sector during those financial years.”

1. Is this requirement of EUR 1.000.000.000 a mistake in the selection guide?

Réponse:

Il s’agit effectivement d’une erreur de traduction. Le seuil minimal est fixé à la somme de 1.000.000 EUR pour les années fiscales 2016, 2017, 2018.

Par ailleurs, nous rappelons qu’en cas de doute sur les traductions, seule la version française fait foi (art II.1.10 du Règlement de concours).

Answer:

It is indeed a translation mistake. The minimum requirement is EUR 1 000 000 for the 2016, 2017, and 2018 fiscal years.

Furthermore, we remind that where translations give rise to doubts, only the French version will be authoritative (art II.1.10 of the Competition Rules).




Question :

Le concours vise à sélectionner deux concepts … qui seront soumis au Bureau du Parlement européen qui choisira le concept qui sera ensuite développé en détail par un opérateur design & build indépendant de l’auteur dudit concept. Cela signifie-t-il que l’auteur du concept qui sera retenu par le Bureau du Parlement européen ne peut pas faire partie, dans la deuxième phase, du groupement de l’opérateur design & build ?

Réponse:

À l’issue de la décision du Bureau, un concept sera choisi par le Parlement pour être mis en œuvre. Le Parlement garantit à l’opérateur économique ayant présenté le concept retenu par le Bureau d’engager avec lui une procédure négociée au sens des dispositions de l’article 11.1 de l’annexe I au RÈGLEMENT (UE, Euratom) 2018/1046 DU PARLEMENT EUROPÉEN ET DU CONSEIL du 18 juillet 2018 aux fins de signature d’un contrat de services ayant pour objet une mission de suivi du concept jusqu’à la fin du projet (voir Art V.2.1 et suivant du Règlement de concours). L’auteur du concept retenu, suivant la définition donnée dans le premier paragraphe de l’article II.1.7 du Règlement, ne pourra participer à la procédure de Dialogue Compétitif que le Parlement se propose d’engager à l’issue du concours pour parvenir à la signature d’un contrat « Design&Build », ni directement ni en tant que membre d’un groupement d’opérateurs économiques participant à la procédure.

À ce titre, les clauses du contrat de service qui sera conclu à l’issue de la procédure négociée ci-avant visée, pour assurer la mission de suivi, empêcheront le signataire du contrat de participer de quelque manière que ce soit à la procédure de marché (Dialogue Compétitif), ainsi qu’à l’exécution du dit marché (Design&Build), au titre des clauses relatives aux conflits d'intérêt. Cette clause d’exclusion ne s’appliquera pas aux éventuels sous-traitants du signataire du contrat de service à moins qu'ils n'aient été certifiés comme auteur.

Les auteurs de projet et les opérateurs économiques ayant participé au concours, soit directement soit en tant que membres d’un groupement

Answer:

Following the Bureau decision, Parliament will choose one concept to be implemented. Parliament guarantees the economic operator that has presented the concept chosen by the Bureau to engage into a negotiated procedure, following the dispositions of article 11.1 of Annex I to the REGULATION (EU, Euratom) 2018/1046 OF THE EUROPEAN PARLIAMENT AND THE COUNCIL dated 18 July 2018, in order to sign a service contract for the follow-up mission until the end of the project (see art V.2.1 and following of the Competition Rules). The creators, following the definition hereof made in article II.1.7 first paragraph, of the chosen concept cannot take part, neither directly nor as a member of a group of economic operators taking part in the procedure, into the Competitive Dialogue that Parliament intends to launch following the Design Competition.

The provisions of the service contract that will be signed following the negotiated procedure mentioned here above, will forbid the signatory of the contract to participate in whatever way or mean to the tender procedure (Competitive Dialogue), as well as the execution of the Design&Build contract, in order to avoid any conflict of interest. This exclusion provision does not apply to the eventual subcontractors, unless they have been put up as creator.

The design creators and the economic operators that have taken part into the competition, either directly or as member of a group of economic operators, and whose concept has not been chosen, will be free to participate in the

Questions:

“Each project will be presented on a form made up of a maximum of six A4 pages, printed on one side only, containing the text to be evaluated and illustrations.” 1. Is the presentation template rigid or can the panels be changed in size? 2. Are images to be inserted to accompany the text or can they be inserted at the end? 3. In the second phase if competitors decide to submit two different project proposals will they receive double remuneration?

1. le nombre de pages et le format sont spécifiés par les dispositions du règlement et ce pour chacun des éléments composant le dossier à remettre par les concurrents. En ce qui concerne les dimensions, il est possible de remplacer 2 formats A4 par 1 format A3. Il n’est pas possible de modifier les formats A1 des 6 panneaux de présentation.

2. Le texte à évaluer et les illustrations peuvent être mélangés indifféremment. Le nombre de page est fixe quelle que soit l'organisation du texte à évaluer et des illustrations

3. Les concurrents ont la possibilité de soumettre deux esquisses (une pour chacun des processus constructif). Si les esquisses sont conformes, la rétribution est de 75 000 EUR HTVA (voir Article II.1.4 du Règlement de Concours).

Answers:

1. The number of pages and the format are specified in the articles of the Competition Rules, for every single elements that are parts of the file to be handed over by the competitors. Concerning the dimensions, it is possible to replace 2 A4 formats by 1 A3 format. It is not allowed to change the A1 format of the 6 presentation panels.

2. The text to be evaluated and illustrations can be mixed together under a single answer, following the competitors’ desire. The number of pages is fixed whatever the way texts and illustrations are mixed together.

3. Competitors are allowed to present two sketches (one for each of the constructive process). If the sketches are of sufficient quality, and are recognized as complying with the competition rules, the remuneration will be 75 000 EUR net of VAT (see article II.1.4 of the Competitions Rules)




Question:

Could you explain if these 120.000 m² for the 3 references is brutto, netto or usable area of the building?

Réponse:

Il s’agit des surfaces de plancher brutes (SPB), reprises comme BGF dans la version allemande de la DIN 277.

La SPB s'arrête aux limites physiques du bâtiment qui marquent la séparation entre l'immeuble et son environnement externe. C'est la surface dite "extra-muros".

La SPB d'un niveau est la surface de la polyligne fermée enveloppant le plancher et dont les côtés sont constitués par :

- les faces extérieures des éléments de façade délimitant le contour des espaces fermés situés au niveau considéré

- l'axe des murs mitoyens entre bâtiments différents

- l'axe des éléments de construction séparant les copropriétaires éventuels

Answer:

We are speaking of gross floor area (GFA), known as BGF in the German version of DIN 277.

The GFA extends to the physical limits of the building which mark the separation between the building and its external environment. It is the area known as "extra-muros".

The GFA of a level is the area of the closed polyline surrounding the floor. Its sides are formed of:

- exterior faces of façade features delimiting the edge of enclosed spaces on the level under consideration

- the line of party walls between different buildings

- the line of construction features separating possible co-owners


Questions:

1. What should be understood under “group of economic operators”? 2. Are they all subcontractors? 3. What kind of deliverables must they submit? 4. Should they submit the references and CVs



Réponses:

1. Les groupements d’opérateurs économiques sont des associations d’opérateurs économiques (architectes indépendants, ateliers d’architecture, …). Dans un groupement, les références, les moyens humains, les chiffres d’affaire, de chacun des membres du groupement peuvent être ajoutés afin d’atteindre les critères de sélections. Les membres d’un groupement sont liés par une convention et solidaires entre eux. Voir article II.1.3 du Règlement. Les membres du groupement ne peuvent pas changer en cours de projet, ils sont fixés jusqu’à la fin du processus.

2. Ils ne sont pas sous-traitants, ils font partie du groupement. Les sous-traitants ne peuvent pas proposer leurs références ou leurs moyens pour atteindre les critères de sélection. Les sous-traitants peuvent changer en cours de projet.

3. Les entités individuelles qui composent un groupement doivent toutes renseigner les documents justifiant le respect des critères d’exclusion (art II.2.1) et de sélection (art II.2.2). Les sous-traitants ne doivent fournir que les documents relatifs aux critères d’exclusion.

Answers:

1. Groups of economic operators are associations of economic operators (independent architects, architecture studios, …). In a group, the references, human means, the turnover of each member can be added in order to fulfil the selection criteria. The members of a group must be jointly and severally liable. See article II.1.3 of the Rules. Members of a group cannot change during the project; they are linked until the end of the process.

2. They are not subcontractors, they are part of the group. Subcontractors cannot propose their references, nor their means, in order to fulfil the selection criteria of the candidate. Subcontractors may change in the course of the project.

3. Individual economic operators that are composing a group must individually turn in the documents that justify the compliance with the exclusion (art II.2.1) and selection (Art II.2.2) criteria. Subcontractors must only fill the documents related to the exclusion criteria.


Question :

Concerning D Criteria relating to references (page 20). How many references do we need to present as the template (standard form) consists of 6 references? 6 references? or 3 (at least 3?)

Le formulaire donne la possibilité de remplir 6 références, mais seules 3 références dont la somme des surfaces atteint 120 000 m² seront prises en compte.

The template document gives the possibility to fill in 6 references. However, only 3 references will be taken into account in order to reach the minimum of 120 000 m².

Question :

Please explain what you understand under the word ‚”architect” in the following sentence: ”the legal representative of the group must be an architect” (Rules, Page 7.) Do we need to provide the certification that this person is an architect or university diploma?

Nous souhaitons obtenir la garantie que le responsable du groupement est une personne ayant le droit d’exercer la profession d’architecte, dans le pays où il travaille officiellement. Suivant les législations nationales de chaque pays, ce droit est donné par une inscription valable auprès de l’ordre des architectes du pays, ou un diplôme, …

Answer:

We would like to receive the guarantee that the leader of a group taking part into the competition is a person who has legally the right to work as an architect, in the land where he is working officially. Different countries have different legislations concerning that matter: it may be an official registration to a professional order of Architects, or a diploma, …




Question1 :

Will the selected project be binding for the design&build operator called to develop it or can it be modified.

Réponse:

Le concept choisi sera une contrainte pour l’opérateur Design&Build. Il devra suivre le concept choisi pendant tout le développement du projet.

Cependant, nous prévoyons que comme dans tout projet, qui plus est de cette complexité et de cette taille, il pourrait y avoir des moments durant le développement du projet où le concept initial se révèle incompatible avec certaines exigences, ou que le Parlement modifie ou rajoute des exigences. Dans de tels cas, le concept pourrait devoir être adapté afin de répondre à ces exigences. Si de tels changements s’avèrent nécessaires, l’auteur de projet, par sa mission de suivi du concept, sera en position de s’assurer que les changements sont effectivement inévitables, et dans ce cas, l’auteur sera en mesure de proposer lui-même un changement de concept.

Answer:

The selected project concept will be binding for the design&build operator. They will have to follow the concept through the development of the project.

However, we foresee that, as in any project, moreover for a project of that size and complexity, there might be moments during the development of the project when the initial concept reveals itself to be incompatible with a specific requirement of the project, or that Parliament puts in new requirements, or changes existing ones. When such occasion occurs, the concept might need to be adapted in order to fit those requirements. If such change proofs itself necessary, the creator of the concept, through its follow up mission during the project, will be in a position to make sure that the changes are inevitable, and if so, the original creator will be able to propose himself a concept change.

Question 2 :

What will be the value of the overall supervision of the project, if any, entrusted to the winner ?.

Réponse:

Les contours exacts de la mission de suivi seront définis ultérieurement. Le montant de la mission sera abordé lors de la procédure négociée qui suivra la désignation du concept qui sera mis en œuvre. Néanmoins, au stade actuel, nous estimons que la mission sur la durée du projet nécessitera environ 12 000 heures de prestation effective, sur base d'une estimation raisonnable.

Answer:

The exact scope of the follow-up mission will later be defined. The value of the mission will be discussed during the negotiated procedure that will follow the choice of the concept to be implemented. However, at this stage, we estimate that the mission over the course of the whole project will induce more or less 12 000 hours of actual services, based on a reasonable assumption.




Question1 :

In regards to the documentation to be submitted as described in Competition Rules, Part III, Chapter 3 Content and presentation of the application file, we would like to ask the following: 1. Folder I-CAND: It is requested to submit (a) a cover letter and (b) a document setting out identity, postal address, email address and contact person. Can we

combine these two documents into just one cover letter, including all the information requested for both (a) and (b)? 2. Subfolder III-JUSTIF-SEL\5Crit_Tech_pro\A-Crit_Eq: This subfolder refers to Point A, paragraph 3 in Article III.2.3 (Documents and evidence required). In this

Point A, we understand we need to include (a) Rules Form 3 as per article II.1.12 and Rules Form 4 as per article II.1.12 . Is it also mandatory to include EUROPASS format CV for all the disciplines’ team members that make up the team in charge of developing the project? Would it be sufficient to include Rules Form 4 for all team members and EUROPASS format only for those CV of the key personnel in the team (coordinator, lead architect, BIM manager, structural engineer and MEP lead engineer)?

1. La lettre de couverture et le document identifiant le candidat peuvent être fusionnés en un document unique à condition que ce dernier reprenne l'intégralité des renseignements requis.

2. Comme stipulé par les dispositions des articles III.2.3 et III.3.2 du règlement du concours, le sous-répertoire III - JUSTIF-SEL\5Crit_Tech_Pro\A- Crit_Eq devra contenir les documents suivants :

une note exposant le choix des personnes qui seront amenées à réaliser l’esquisse en cas de sélection et les raisons de ce choix. Cette note est établie sur base du formulaire type fourni au nombre des documents de la procédure (Voir article II.1.12).

une liste des membres de l’équipe qui sera chargée, en cas de sélection du candidat, de la réalisation de l’esquisse sous forme d’un tableau Excel dont le modèle est fourni au nombre des documents de la procédure (Voir article II.1.12).

Suite à l’avis modificatif référence 2019/S 233-570473, publié le 3 décembre, il n’est PLUS nécessaire d’inclure les Curricula vitae des membres de l’équipe.

Answer:

1. The cover letter and the document identifying the candidate can be merged into one single document, at the condition that it includes all the requested information.

2. As stated in the provision of articles III.2.3 et III.3.2 of the Competition Rules, the sub-directory III - JUSTIF-SEL\5Crit_Tech_Pro\A- Crit_Eq shall contain the following documents :

A note outlining the choice of individuals who will be tasked with producing the sketch, if they are selected, and the reasons for choosing them. This note must be drawn up on the basis of the standard form provided along with the procedure documents (Voir article II.1.12).

a list of team members who, if they are selected, will be responsible for producing the sketch, in the form of an Excel table, a model of which is included in the procedure documents (see Article II.1.12).

Following the corrigendum ref. 2019/S 233-570473 dated 3/12/2019, it is NO LONGER necessary to include the members’ CV’s.



Question 2 :

Regarding Chapter 2, III.2.2 Selection criteria, under Technical and professional capacity criteria, in point 1. Unweighted selection criteria, it says: Candidates must demonstrate that they have at least the following staff on their organizational chart: - Four architects with a minimum of 10 years’ experience, as of the closing date for applications, in new build and/or renovation and/or urban planning; - Two architects with a maximum of five years’ professional experience, as of the closing date for applications, in new build and/or renovation and/or urban

planning. In the case of groups, the organizational charts of all members of the group will be taken into consideration when assessing the application in the light of the above criteria.

1. Shall we provide management organizational charts? Shall these charts include all personnel from the firm? Shall these charts include only the requested personnel above cited (six architects)?

2. When it says maximum five years for the two architects, does this mean that they cannot have experience beyond five years? Would it be acceptable to have experience between five and ten years?

1. Les organigrammes ne sont pas exigés, seuls les CV des 6 architectes doivent être communiqués.

2. Les deux architectes avec une expérience de moins de 5 ans NE PEUVENT PAS être remplacés par des architectes avec une expérience comprise entre 5 et 10 ans.

Answers:

1. The organizational charts should not be provided ; only the CV’s of the 6 architects are.

2. The two architects with an experience of less than 5 years CANNOT be replaced by architects with an experience between 5 and 10 years.


Question :

L’article V.2.3 stipule que les auteurs de projet choisis par le Parlement européen ne pourront pas participer ultérieurement à la procédure de dialogue compétitif. Ceci implique que l’auteur de projet gagnant ne peut participer au Design&Build.



1. Cela s’applique-t-il aussi pour les Bureaux d’Études qui accompagnent l’auteur architecte ou peuvent-ils se présenter dans une équipe lors du Dialogue Compétitif dans un second temps ?

2. Il y a-t’-il une différence si les Bureaux d’Études sont des sous-traitants ou s’ils sont cotraitants ?

Réponse:

1. Cette exclusion ne s’applique par pour les Bureaux d’Études aux conditions suivantes : a. Le Bureau d’Études n’est pas repris comme auteur du projet.

et b. Dans le marché de mission de suivi du concept, le Bureau d’Études ne

peut être le contractant du Parlement européen ni directement ni indirectement (par exemple par son appartenance au groupement d’opérateurs économiques déclaré attributaire).

2. Il existe une différence pour les Bureaux d’Études entre le statut de sous-

Answer:

1. This exclusion does not apply to Engineers and other building specialists if the following conditions are met:

a. The Engineer is not referenced as Creator of the concept And

b. In the contract for the concept follow up mission, the Engineers cannot be Parliament’s contractor, directly nor indirectly (as for instance by being part of the group of economic operators to whom the contract has been awarded to).

2. There exists a difference for Engineers, and other building specialists between the status of subcontractor, and the status of group member. As sub-contractor, and not mentioned as Creator of the concept, they have the liberty to participate to both the Design Competition and the Competitive Dialogue.

Furthermore, if the Creator, or the Engineers ARE NOT part of the team whose concept is chosen by Parliament to be implemented, then they are free to participate to the Competitive Dialogue and the execution of the Design&Build contract.
