Wyllie defined his works as“scul?ture,’ as he believed that thequestion mark was at the centre ofeverything. This idiosyncratic artistbecame a much-loved public figurein Glasgow and is remembered forhis range of works based in andaround the city. Permanentscul?tures Clydebank Clock andMonument to Maternity remain aseveryday sights and markers ofmeaning for Glaswegians, lingeringin the cultural heritage. While, twotemporary public artworks StrawLocomotive (a full-size steamlocomotive, made entirely fromstraw, suspended from theFinnieston Crane before beingceremonially burned) and PaperBoat (an 80-foot structure whichsailed the Clyde, Thames andHudson rivers as a memorial to thecity’s ship-building heritage),captured local hearts andimagination through their strikingsymbolism of the decline of thecity’s industrial heritage.
Born in Shettleston in 1921, Wyllieserved in the Royal Navy andworked in the Post Office and as acustoms and excise officer, laterdeveloping his creativity andlearning welding at a collegeevening course before finallycommitting to his art full-time in1979, when he was nearly in hissixties. He quickly gained a place inthe Scottish art-world, creatingdefinitive works, befriendingcultural figures including RichardDemarco, Liz Lochhead and JosephBeuys, and serving as president ofthe Society of Scottish Artists. Thispopularity was confirmed with hisaward of an MBE in 2005.

Throughout the course of theartist’s long life – Haig died in2009 at the grand age of 91 –he quietly produced a body ofartwork which is nowrecognised as a significantcontribution to the 20thcentury Modern landscapetradition. He spent much ofhis life based at his family’sseat in the Scottish Borders,Bemersyde near Melrose,showing regularly withEdinburgh’s Scottish Galleryfrom the late 1940s. Paintingexcursions took himfrequently to Venice, Italy andthe Dolomites and these
locations feature prominentlyin his output.
His career as an artist was inmany ways hard won. The sonof Field Marshal Haig, thecommander in chief of theBritish army during WW1, asomewhat sickly young Haigstruggled with the large bootshe felt had been left to fillupon his father’s death whenhe was 10 years old. Inaddition, his father’s tacticsand reputation came undermuch scrutiny and criticism inthe period immediately afterthe War, which weighedheavily on his son.
He eventually found anindividual sense of purposeand identity through artthough the revelation of hiscreative talent came about ina somewhat curious way,during his incarceration as aPoW in Italy and latterlySaxony for three years duringWW2. Having begun to sketchand paint while confined, hewent on to attend theCamberwell School of Artupon his return to Britain,studying under artistsincluding William Johnstoneand Victor Pasmore.
Though it is obvious he avidly
absorbed these surroundinginfluences, his work has adistinctive vision andsubsequently a consistencywhich is unusual, particularlyfor an artist whose careerspans such a long period.Haig’s art speaks fluently ofhis great love for his naturalsurroundings and hisfractured, reductiveinterpretation of thelandscape combines cubistand expressionistic values tohighly individual, idiosyncraticeffect.

ODINIGWE BENEDICTCHUKWUKADIBIABONAVENTURE ENWONWUis recognised as one ofAfrica’s eminent artists of the20th century and animportant figure in NigerianModernist painting. Further,he is widely considered tohave pioneered theappreciation of this movementin the period post-colonialization and hasenjoyed internationalrepresentation in citiesincluding London, Lagos,Milan, New York, WashingtonD.C., and Boston.
Though sometimes working inthe medium of sculpture andoften inspired by thelandscape of his homecountry, his work is largelyfigurative and a favouritesubject was the depiction oftraditional dancers, usingstylised forms to create asense of movement andrhythm. The work shown herefor sale is a typical example,executed shortly after he hadfinished his artistic training.
His studies were extensive;beginning under Kenneth C.Murray at GovernmentColleges, Ibadan andUmuahia, 1934–37. Enwonwuthen went on to gainqualifications from GoldsmithCollege, London, in 1944,Ruskin College, Oxford, from1944 to 1946 and ultimatelythe Slade School of Fine Arts,Oxford, 1946–48, from whichhe graduated with first-classhonours.
His career has been bothfascinating and at timesexceptional. Enwonwu has, forexample, had a bronzeportrait commissioneddirectly by Queen Elizabeth IIin 1956, and has undertaken apostgraduate in Anthropologyfrom the University CollegeLondon. Perhaps mostfantastically of all, theEnwonwu crater on planetMercury is named in hishonour.

Peter Howson’s distinctivecharacters and strong,figurative style are instantlyrecognisable. His depictionsof a violent, working-class,predominantly masculineGlasgow world are favouredby celebrity collectors such asMadonna, Mick Jagger andDavid Bowie and havefeatured on a range of albumcovers for bands includingThe Beautiful South.
Howson trained at GlasgowSchool of Art, paintingalongside other popularcontemporary artists; AdrianWiszniewski, Steven Campbelland Ken Currie. Recognisedfor his commitment to warpainting through his role ofBritish official war artist forthe 1993 Bosnian Civil War forthe Imperial War Museumand then official war painterat the Kosovo War for theLondon Times. The publicrecognition of Howson’s workwas cemented on hisappointment as Officer of theOrder of the British Empire in2009.
Figure by the Sea dates from1987, relatively early inHowson’s career and before
his key war paintingassignments. The compositionis dominated by the burly,boxer figure that recursthroughout his oeuvre but asopposed to later works herethe figure is positioned in arural sea-side location,highlighted in bright, colourful
tones. This location re-appears in a range of large-scale works in oil thatHowson created in this yearincluding The Sisters of Mercyand Flag of Despair. Stillquintessentially Howson in itstechnique and character, thebrighter, rural backdrop is a
welcome tonic to hispredominantly gritty, urbanlocations and speaks of a veryparticular moment in hiscareer.

Callum Innes is an artist verymuch concerned with theprocess of painting and thephysical properties of paintitself.
Born in Edinburgh in 1962and trained at Gray’s Schoolof Art, Aberdeen and theEdinburgh College of Art, herose to prominence afterhaving two major solo showsin public institutions in 1992;at the Institute ofContemporary Art, Londonand the Scottish NationalGallery of Modern Art,Edinburgh before being short-listed for the Turner Prize in1995, which was subsequentlywon by Damien Hirst. He nowexhibits internationally andhis work features in publiccollections across the world,though his studio practice
remains in Edinburgh.
Following his art-schooltraining, Innes was working ina figurative manner until ascholarship opportunity inAmsterdam in 1987-88exposed him to the boldabstract work of artists suchas Barnett Newman andLucio Fontana. He quicklyabandoned his figurative styleand became focused on thepursuit of clarity in painting.This radical break in hispractice makes Self-Portraitof 1987, an abstractcomposition with a lingeringfigurative quality all the morerare and striking, positionedas it is on the cusp ofbreakthrough into theapproach that wouldcharacterise his oeuvre forthe following twenty years.
Innes is best known for hisExposed Paintings series, thestriking, meditative worksthat are created by a refinedprocess of addition andsubtraction; adding layers ofpaint to the canvas that arethen gradually stripped awayusing turpentine to leave onlyghostly traces of pigment.Innes thinks of these worksas a process of unveiling,rather than having destructiveconnotations and has likenedit to alchemy; thetransformation of work-a-daymaterials into precious gold.
This deliberate andconsidered approach totechnique is consistent inInnes’ practice, across avariety of series: AgitatedVerticals, Resonance, IsolatedForms, and Monologue, all of
which he established between1989-1992 and has continuedworking on, refining andevolving ever since. Thisdeliberation and dedicationalso crosses over into thewatercolour medium, whereInnes uses various brushesand sponges to layer andremove washes of colour,with only hints of the full-strength colour left lingeringaround the edges, as inMagenta/Charcoal of 2000. Inthe Identified Forms series,rather than strip the paintaway using turpentine loadedbrushes, rags or sponges,Innes flicked turpentine on tothe not-quite-dry paint,allowing the solvent to dripdown the surface, dissolvingthe paint and leaving onlytraces of pigment in its wake.

Born in Bombay (nowMumbai), India in 1954, AnishKapoor has since the 1970slived and worked in London,studying at Hornsey College ofArt and Chelsea School of Artthroughout that decade. Hisintensely distinctive sculpturalworks have made him a nameacross the creative andconnoisseurial worlds, and itis no exaggeration to describehim as one of the mostinfluential artists of our time.Representing Britain at theXLIV Venice Biennale in 1990,Kapoor went on to win theTurner Prize in 1991, wasawarded a C.B.E. in 2003 anda knighthood in 2013, forservices to the visual arts. Hehas had solo shows in suchinstitutions as the RoyalAcademy of Arts and theTurbine Hall at Tate Modern.
Kapoor’s simultaneousgravitas and popularity maybe attributed to theinstantaneous grasp hissculpture achieves over theviewer‘s mind and feelings;the work asks of you bothengagement andastonishment, casting a spellon their audience on severallevels, and they are oftentheatrical, as the word“audience” suggests.Frequently executed atextremes of scale, Kapoor’swork is both a feat ofengineering and oftransmutation of form. Heworks in the most physical,tangible and earthly ofmaterials – pigment, stainlesssteel, stone, resin and wax –yet his sculptures utiliseunderstanding of what mightbe termed the physical
sciences through art tosuggest, through the utterlyphysical, the unutterable, andeventually the metaphysical.
The concave (therefore alsoconvex) disc, perhaps thesculptural form at which hiswork most comes to restphilosophically, is the modelor epitome of these qualities.The viewer is drawn to lookinto the strangebottomlessness of thereflective surface, absorbedby the work through its depthof pigmentation and theendlessly shape-shiftingforms created within the lowbowl. This mesmerising,dream-holding quality meansthat the viewer experiencesand feels the work asopposed to merely observingit; the sculpture engages itsviewer, or holder, at asuggestive and psychological,as well as a pleasing physical,level. This work is the productof the artist’s profoundcapacity to render in form hiscontinuing conversation withthe world that speaks aboutlight and darkness, presenceand absence, the solid andthe intangible.
The work illustrated here forsale is one such classic discform. Created as one of asmall, exclusive limitededition run for the recipientsof a prestigious arts award inthe UK in 2011, it is one of thefew examples in this seriescoloured in the blood-redpigment which is soimportant in Kapoor’s work.
The domestic scale is also ahighly unusual and desirablequality given the morefamiliar and all but“untameable”, vastproportions of Kapoor’s work.

Prints & Multiples
Whilst many artists arecontent to establish anartistic territory and workwithin it, Bruce McLean haskept moving. Like manyseminal artists, including hisart school contemporariesGilbert and George, McLeanrebelled against what he sawas formal academicismpropagated by the teaching ofAnthony Caro and Phillip Kingduring his time at St. Martin’sSchool of Art.
It was this discontent withinstitutionalised art thatprovoked such an unusualartistic trajectory. Sculpture,
photography or complexperformance art; McLeanseems to skip freely acrossany categorisation. He waseven in a band for a time,Nice Style, playing alongsidethe Kinks and Ian Drury intheir 1970’s heyday. Hispractise has increasinglyturned towards painting andprintmaking; suitable vehiclesfor his parodies of theexpressionistic style popularin the 1980s and suited to hissomewhat punky aesthetictendencies.
Influenced by the AmericanPop Art movement, McLean
employs irreverent humour totackle the pretensions of theart world and manages toconfront wider social issueswithout being sanctimonious.A typical instance was in 1972when the artist was offeredan exhibition at the TateGallery and McLean, in aperfect example of hissatirical style, elected for a‘retrospective’ lasting merelyone day.

Elspeth Lamb is an expertprintmaker with a long-standing commitment to thedevelopment of printmakingthrough her diverse repertoireof silkscreen, collage,lithograph, screen-printingand papermaking. Lambtrained at the Glasgow Schoolof Art, ManchesterMetropolitan University andthe Tamarind Institute ofLithography, University ofNew Mexico. She then spenttwenty years teaching atEdinburgh College of Art,latterly as Head of thePrintmaking Department,before ending all heracademic teachingcommitments in 1999 to focus
on her freelance work asartist and educator. Sincethen she has organised anddelivered printmaking andpapermaking workshopsacross Scotland andundertaken residenciesinternationally.
Fairy tales, myths and thetheme of enchantment arelong-standing inspirations forLamb. While a long-heldfascination with Japaneseculture was given the spaceto expand with a ten-weekresidency in Japan in 2000.Once there she studied undermaster craftsmen to learnmoku hanga, traditionalwoodcut printing using water-based inks to create vivid
colours and transparencies.She returned to Japan againin 2002 to undertake researchfor her successful book,Papermaking forPrintmakers. Around thesame time, Lamb alsoproduced an artist’s bookNagasawa Cantrips. Cantripsis an old Scots word formagic, while Nagasawa is therural area where she stayed,so literally Nagasawa Magic.This title reveals the dualinfluences of the prints:incorporating traditional andmodern printmakingtechniques and referencingboth Eastern and Westernthinking on arts, alongsidesome of Lamb’s own favouritethemes and emblems.
Lamb is an R.S.A.Academician, and an electedmember of the Society ofScottish Artists and RoyalGlasgow Institute. Her work isincluded in majorinternational collectionsincluding the JapaneseConsular Collection, TheBritish Council and the JoanMiro Foundation Collection.The five works offered herefrom private collectionsclearly demonstrate hermodern approach andcommitment to vibrant colourand texture.

1. DEFINITIONS
In these Conditions of Sale (Sellers):
“Auctioneer” means Lyon & Turnbull Ltdor its authorised auctioneer, asappropriate;
“Buyer“ is the person who makes thehighest possible bid or offer accepted bythe auctioneer, and/or such person’sprincipal where bidding as agent;
“Buyer‘s Premium” is the commissionpayable by the Buyer on the HammerPrice at the rates set out in the SaleCatalogue Guide to Prospective Buyersand an amount in respect of applicableVAT;
“Hammer Price” is the highest bidaccepted by the auctioneer by the fall ofthe hammer or in the case of a post-auction sale, the agreed sale price;
“Item” means each and every itemconsigned for sale following expresswritten agreement between Lyon &Turnbull and the Seller;
“Lot“ means each Item offered for saleby Lyon & Turnbull;
“Lower Estimate” means the lowestimate provided by Lyon & Turnbull tothe Seller in relation to each Item, or inrelation to any Item which Lyon &Turnbull holds on behalf of the Seller;
“Lyon & Turnbull” means the companywhich has its registered office at 33Broughton Place, Edinburgh, EHI 3RRregistered in Scotland No. 191166
“Net Sale Proceeds” are the HammerPrice, less commissions and othercharges, of the Lot sold, to the extentreceived by Lyon & Turnbull in clearedfunds;
“Proposed Sale” means the intendedsale through which the items will besold on
“Purchase Price” is the Hammer Priceand applicable Buyer‘s Premium;
“Reserve” means the lowest price belowwhich an item cannot be sold;
“Upper Estimate” means the highestimate provided by Lyon & Turnbull tothe Seller in relation to each Item, or inrelation to any Item which Lyon &Turnbull holds on behalf of the Seller;
“Terms of consignment” means thestipulated terms and rates ofcommission on which the Auctioneeraccepts instructions from Sellers ortheir agents;
“You”, “Your” means the seller
“Us”, “Our”, “We” etc refers to Lyon &Turnbull Ltd
The singular includes the plural andvice versa as appropriate.
2. WARRANTY OF TITLE ANDAVAILABILITY
The Seller warrants:-
(a) that you are the true owner of theproperty consigned or are properlyauthorised by the true owner to consignit for sale and are able to transfer goodand marketable title to the property freefrom any third party claims.
(b) that all requirements have beencomplied with, legal or otherwise,relating to any export or import of theproperty consigned, all duties and taxesin respect of the export or import of thelot have (unless agreed in writing withus) been paid and, so far as you and any
principal for whom they are acting inrelation to the lot are aware, all thirdparties have complied with suchrequirements in the past.
(c) that you have provided Lyon &Turnbull with any and all informationconcerning the item’s provenance orany concerns expressed by thirdparties concerning its ownership,condition, authenticity, attribution, andexport or import history; and
(d) Unless the Seller advises Lyon &Turnbull in writing to the contrary ondelivery of the item to Lyon & Turnbull,there are no restrictions on Lyon &Turnbull rights to reproducephotographs or other images of theitem in connection with the sale or anyother marketing which will be done inaccordance with good taste anddecency.
3. PREPARATION FOR SALE
(a) Lyon & Turnbull shall decide theway in which a lot may be included inthe sale, how any lot is described andillustrated in the catalogue or anyreport, and the marketing, promotion,date, place and conduct of the sale.
(b) Lyon & Turnbull will instruct,consult with, and rely on, any outsideexperts or restorers, agents or otherthird parties, and carry out such otherdue diligence, inquiries, research ortests in relation to the property or itsprovenance, either before theProposed Sale as it may deemappropriate in its reasonable discretion.
(c) Any oral or written estimate orevaluation or report provided by Lyon& Turnbull is a genuinely held opiniononly. It may not be relied on as aprediction of the selling price or value ofthe Item, and may in Lyon & Turnbull’sabsolute discretion be revised fromtime to time.
(d) The Seller acknowledges thatattribution of Items is a matter ofopinion and not of fact, and isdependent upon (amongst other things)information provided by the Seller, thecondition of the property, the degree ofresearch, examination or testing that ispossible or practical in thecircumstances, and the status ofgenerally accepted expert opinion at thetime of cataloguing
4. TERMS OF SALE
The Seller acknowledges that lots aresold subject to these Conditions and onthe Terms of Consignment as notified tothe consignor at the time of the entry ofthe lot.
5. STANDARD SELLER FEES ANDCHARGES (Subject to VAT)
(1) Commission: 15% is charged on theselling price of each lot, (subject to aminimum charge of £30). Loss anddamage warranty: 1.5% on value of lotssold. Photography: min charge £30.Online Listing: £10 per lot.
(2) Transport: Items for sale must beconsigned to the sale room by anystated deadline and at your expense. Wemay be able to assist you with thisprocess. When organised on theSeller’s behalf the provision of transportwill be contracted to third parties. Feesfor transport will be deducted at theinitial settlement.
(3) Illustrations: The cost of any
illustrations will be borne by the Seller ,unless agreed otherwise prior. Thecopyright in respect of such illustrationsshall be the property of us, theauctioneers, as is the text of thecatalogue.
6. RESERVES
(a) You are entitled to place, prior to theauction, a reserve on any lot consigned,being the minimum hammer price atwhich that lot may be sold. Reservesmust be reasonable and we may declineto offer goods which in our opinionwould be subject to an unreasonablyhigh reserve.
(b) Firm reserves may be no greaterthan lower pre-sale estimate level.
(c) A reserve once set cannot bechanged except with our agreement.
(d) You may not bid or instruct or permitany other person to bid on your behalfon your own property. If the Sellerbreaches this prohibition, Lyon &Turnbull may treat the Seller as boundas Seller and as Buyer but withoutthe benefit of Lyon & TurnbullAuthenticity Guarantee or the reserve,and/or pursue other remedies.
(e) We may sell lots below the reserveprovided we account to you for the samesale proceeds as you would havereceived had the reserve been thehammer price.
7. LOSS & DAMAGE WARRANTY
(a) Subject to condition 7(c) below Lyon& Turnbull will assume liability for lossor damage to an item, commencing atthe time that item is taken into physicalcontrol and possession by Lyon &Turnbull and ceasing on the earliestdate of;
(i) when risk passes to the Buyer of thelot following its sale;
(ii) for unsold lots, when the lot isreleased to the Seller, or, within 3months of the sale;or
(iii) 6 months from the date of delivery toLyon & Turnbull for items still in thepossession of Lyon & Turnbull but notconsigned for sale (unless part of along-term storage agreement).
(b) Lyon & Turnbull shall charge a lossand damage warranty fee of 1.5% of thehammer price, plus VAT.
(c) If any loss or damage should occurto the lot during the period identified inparagraphs (a) above, Lyon & Turnbull’sliability to compensate the Seller inrespect of that loss shall be restricted toa maximum of the upper estimate, oractual loss incurred, whichever is lower.This compensation will be subject to adeduction of a 1.5% loss & warranty fee(subject to VAT).
8. UNSOLD ITEMS
(1) If an item is unsold it may, with yourconsent, be re-offered at a future sale.Where in our opinion an item is notsuitable for a future sale we may eitherrequest (a) you collect such items fromthe saleroom promptly on being soinformed. We shall be entitled to chargeyou for storage costs, charges shall bemade at a reasonable daily rate; or (b)suggest that the item be transferred toa secondary saleroom for sale withoutreserve. All transferred lots will be soldfor the best price on the day, this maynot bear any reflection on the item’s
original estimate. Lyon & Turnbull arenot liable for any items (whether it beselling price or loss & damage) whentransferred.
(2) Aftersales: We reserve the right toaccept an after-auction offer on a lot onbehalf of the seller, at the agreedreserve price or above, for up to 48hours after the original auction. Inwhich case the same charges will bepayable as if such lots had been sold atauction and so far as appropriate theseConditions apply.
9. LOT WITHDRAWAL
If a Seller wishes to withdraw a lotorganised for sale, a withdrawal fee willapply;
(a) if withdrawn over 28 working daysprior to the sale, this will be charged at10% of the mid estimate along with anyancillary charges incurred (such asphotography), all subject to VAT at thecurrent rate.
(b) if withdrawn within 28 working daysof the sale, this will be charged at 20%of the mid estimate along with anyancillary charges incurred (such asphotography), all subject to VAT at thecurrent rate.
(c) Lyon & Turnbull may withdraw a lotfrom the proposed sale without anyliability if:
(i) Lyon & Turnbull reasonably believesthat there is any doubt as to the lot‘sauthenticity or attribution; or
(ii) it reasonably doubts the accuracy ofany of the Seller’s warranties; or
(iii) the Seller breaches any provisions ofthe Conditions of Sale in any materialrespect; or
(iv) the lot suffers from loss or damageso that it is not in the state in which itwas when Lyon & Turnbull took deliveryof it.
(d) if an item is withdrawn from saleunder Condition 9(c) (i), or (iv), the Sellershall not be charged a withdrawal feeand the item shall be returned to theSeller or dealt with pursuant to Clause8, as the Seller decides.
10. AUTHORITY TO DEDUCTCOMMISSION AND EXPENSES ANDRETAIN PREMIUM AND INTEREST.
The Seller authorises us to deductcommission at the stated rate, and allexpenses incurred for your accountfrom the hammer price, and consents toour right to retain beneficially thepremium paid by the Buyer inaccordance with these Conditions ofSale and any interest earned on the saleproceeds until the date of settlement.
11. NON-PAYMENT BY THE BUYER
(a) Lyon & Turnbull will, where itconsiders appropriate, take reasonablesteps to investigate the ability of biddersto pay for lots and will use reasonableendeavours, in consultation with theSeller, to enforce payment of theHammer Price by any Buyer.
(b) Lyon & Turnbull, in consultation withthe Seller, will decide whether to pursueany of the remedies available to it,including those set out in Condition 10of the Condition of Sale (Buyers)including the right to cancel the saleand return the property to the Seller.Lyon & Turnbull will inform the Seller ofany action which it contemplates taking

17. DATA PROTECTION
In connection with the management andoperation of our business and themarketing and supply of Lyon &Turnbull’s services, or as required bylaw, we may ask the Seller to providepersonal information about themselvesor obtain information about the Sellerfrom third parties (e.g. creditinformation). Lyon & Turnbull will notgive out personal information except asmay be required by law.

18. LAW AND JURISDICTION
(a) Governing Law: These Conditions ofSale and all aspects of all matters,transactions or disputes to which theyrelate or apply shall be governed by, andinterpreted in accordance with, Scotslaw
(b) Jurisdiction: The Seller agrees thatthe Courts of Scotland are to haveexclusive jurisdiction to settle alldisputes arising in connection with allaspects of all matters or transactions towhich these Conditions of Sale relate orapply.

(d) The Seller hereby agrees to informLyon & Turnbull of any action which itchooses to take against the Buyer toenforce payment of the amount due tothe Seller.
(e) In the event that a Buyer fails to payfor a lot in accordance with theConditions of Sale for Buyers, that lotwill be treated in the same way as anunsold or collected lot.
12. SETTLEMENT PAYMENTS
Subject to full payment by the Buyer,payment of the net proceeds of sale dueto you will be made over to you 28working days following a sale. Providedwe have received cleared funds.Payment will be made by cheque orBACS (if requested).
13. SALE BY PRIVATE TREATY
(a) The same Conditions of Sale (Sellers)shall apply to sales by private treaty.
(b) Private treaty sales made underthese Conditions are deemed to besales by auction and subject to ouragreed charges for Sellers and Buyers.
(c) Lyon & Turnbull undertakes toinform the Seller of any offers itreceives in relation to an item prior toany Proposed Sale, excluding thenormal method of commission bids.
(d) For the purposes of a private treatysale, if a lot is sold in any othercurrency than Sterling, the exchangerate is to be taken on the date of sale.
14. THIRD PARTY LIABILITY
All members of the public on ourpremises are there at their own risk andmust note the lay-out of theaccommodation and securityarrangements. Accordingly neither theauctioneer nor our employees or agentsshall incur liability for death or personalinjury (except as required by law byreason of our negligence) or similarlyfor the safety of the property of personsvisiting prior to or at a sale.
15. GENERAL
(a) We shall have the right at ourdiscretion, to refuse admission to ourpremises or attendance at our auctionsby any person.
(b) Any notice to any Buyer, Seller,bidder or viewer may be given by email,or if not available then first class mail,in which case it shall be deemed to havebeen received by the addressee 48hours after posting.
(c) Notices to Lyon & Turnbull should bein writing and addressed to NickCurnow at 33 Broughton Place,Edinburgh EH1 3RR, quoting thereference number specified at thebeginning of the sale catalogue.
(d) Should any provision of theseConditions of Sale be heldunenforceable for any reason, theremaining provisions shall remain in fullforce and effect.
(e) These Conditions of Sale are notassignable by either party without theother’s prior written consent, but arebinding on the seller’s successor andrepresentatives. No act, omission ordelay by Lyon & Turnbull shall bedeemed a waiver or release of any of itsrights.
(f) The contract between the parties maybe varied by the parties by agreementand in writing.
16. AGENCY

CONDITIONS OF SALE (Buyers)
The Auctioneer carries on business withbidders, Buyers and all those present inthe auction room prior to, or in connectionwith, a sale on the following GeneralConditions and on such other terms,conditions and notices as may be referredto herein..
1. DEFINITIONS
In these Conditions of Sale (Buyers):
"Auctioneer" means Lyon & Turnbull Ltdor its authorised auctioneer, asappropriate;
"Hammer price" means the level ofbidding reached (at or above any reserve)when the Auctioneer brings down thehammer;
"Lot" means each Item offered for sale byLyon & Turnbull;
"Purchase Price" is the Hammer Priceand applicable Buyer's Premium;
"Reserve" means the lowest price belowwhich an item cannot be sold;
"Total amount due" means the hammerprice in respect of the lot sold togetherwith any premium, Value Added Tax orother taxes chargeable and any additionalcharges payable by a defaulting Buyerunder these Conditions;
“You”, “Your” means the Buyer
“Us”, “Our”, “We” etc. refers to Lyon &Turnbull Ltd
The singular includes the plural and viceversa as appropriate.

3. BIDDING PROCEDURES AND THEBUYER
(a) Bidders are required to register theirparticulars before bidding and to satisfyany security and credit references orarrangements before entering the auctionroom to view or bid;
(b) The maker of the highest bid acceptedby the Auctioneer conducting the saleshall be the Buyer and any dispute shallbe settled at the Auctioneer's absolutediscretion.
(c) Once made, no bid may be withdrawn.
(d) Our right to bid on behalf of Sellers isexpressly reserved up to the amount of anyreserve.
(e) The right to refuse any bid is alsoreserved.
(f) Commission Bids: While prospectiveBuyers are strongly advised to attend theauction and are always responsible for anydecision to bid for a particular lot andshall be assumed to have carefullyinspected and satisfied themselves as toits condition we shall, if so instructed,clearly and in writing execute bids on theirbehalf. Neither the Auctioneer nor ouremployees nor agents shall be responsiblefor any failure to do so. Where two or morecommission bids at the same level arerecorded we reserve the right in ourabsolute discretion to prefer the first bidso made.
(g) Telephone Bids: If a prospective Buyermakes arrangements with us prior to thecommencement of the sale we will usereasonable efforts to contact them toenable them to participate in bidding bytelephone. We do not accept liability forfailure to do so or for errors andomissions in connections.
(h) Online Bidding: We will use reasonable
efforts to carry out online bids and do notaccept liability for equipment failure,inability to access the internet or softwaremalfunctions related to execution of onlinebids/ live bidding.
4. INCREMENTS
Bidding increments shall be at theAuctioneer's sole discretion.
5. THE PURCHASE PRICE
For each lot purchased a Buyer'sPremium of 25% is payable on the first£50,000 of the hammer price, 20%thereafter. VAT at the appropriate rate ischarged on the Buyer's Premium. No VATis payable on the hammer price orpremium for printed books or unframedmaps bought at auction.
Live online bidding is subject to anadditional 3% premium (charged by thelive bidding service provider Invaluable).This additional premium is subject to VATat the appropriate rate as above.
6. VALUE ADDED TAX
Value Added Tax is charged at theappropriate rate prevailing by law at thedate of sale and is payable by Buyers ofrelevant lots.
(1) Lots affixed with (†): Value Added Taxon the hammer price is imposed by law onall items affixed with a dagger (†). Thisimposition of VAT maybe because theSeller is registered for VAT within theEuropean Union and is not operatingunder a Margin Scheme.
(2) Lots affixed with (*): A reduced rate ofValue Added Tax on the hammer price of5% is payable. This indicates that a lothas been imported from outwith theEuropean Union. This reduced rate isapplicable to Antique items.
(3) Lots affixed with [Ω]: Standard rate ofValue Added Tax on the hammer price andpremium is payable. This applies to itemsthat have been imported from outwith the
European Union and do not fall within thereduced rate category outlined above.
7. DROIT de SUITE
This symbol § indicates works which maybe subject to the Droit de Suite or Artist'sResale Right, which took effect in theUnited Kingdom on 14th February 2006.We are required to collect a royaltypayment for all qualifying works of art.Under new legislation which came intoeffect on 1st January 2012 this applies toliving artists and artists who have died inthe last 70 years. This royalty will becharged to the Buyer on the hammer priceand in addition to the Buyer’s premium. Itwill not apply to works where the hammerprice is less than €1,000 (euros). Thecharge for works of art sold at and above€1,000 (euros) and below €50,000 (euros)is 4%. For items selling above €50,000(euros), charges are calculated on asliding scale. All royalty charges are paidto the Design and Artists Copyright Society(‘DACS’) and no handling costs oradditional fees are retained by theauctioneer. Resale royalties are notsubject to VAT. Please note that the royaltypayment is calculated on the rate ofexchange at the European Central Bankon the date of the sale. More informationon Droit de Suite is available atwww.dacs.org.uk.
8. PAYMENT
(1) Within 7 days of a lot being sold youwill:
(a) Pay to us the total amount due in cashor by such other method as is agreed byus. We accept cash, bank transfer (detailson request), debit cards and Visa orMasterCard credit cards. We do not acceptAmerican Express.
(b) Please note there is a surcharge of 2%when using credit cards.
(c) Please note that under The MoneyLaundering Regulations 2007 we cannot

16. GENERAL

Lyon &Turnbull will not give out personalinformation except as may be required bylaw.

The Buyer hereby agrees to the release byLyon & Turnbull of the Buyer’s name andcontact details to the seller or the seller’ssolicitor in the event of any disputebetween Lyon & Turnbull and the Buyerand/or Lyon & Turnbull and the Seller.Lyon & Turnbull will give prior writtennotice of the release of any such details tothe Seller of the Seller’s solicitor.
18. FORCE MAJEURE
Lyon & Turnbull shall be under no liabilityif they shall be unable to carry out anyprovision of the Contract of Sale for anyreason beyond their control including(without limiting the foregoing) an act ofGod, legislation, war, fire, flood, drought,failure of power supply, lock-out, strike orother action taken by employees incontemplation or furtherance of a disputeor owing to any inability to procurematerials required for the performance ofthe contract.
19. LAW AND JURISDICTION
(a) Governing Law: These Conditions ofSale and all aspects of all matters,transactions or disputes to which theyrelate or apply shall be governed by, andinterpreted in accordance with, Scots law
(b) Jurisdiction: The Buyer agrees that theCourts of Scotland are to have exclusivejurisdiction to settle all disputes arising inconnection with all aspects of all mattersor transactions to which these Conditionsof Sale relate or apply.

9. TITLE AND COLLECTION OFPURCHASES
(1) The ownership of any lots purchasedshall not pass to you until you have madepayment in full to us of the total amountdue.
(2) You shall at your own risk and expensetake away any lots that you havepurchased and paid for not later than 7working days following the day of theauction or upon the clearance of anycheque used for payment whichever islater. We can provide you with a list ofshippers. However, we will not beresponsible for the acts or omissions ofcarriers or packers whether or notrecommended by us.
(3) No purchase can be claimed orremoved until it has been paid for.
(4) It is the Buyer’s responsibility toascertain collection procedures,particularly if the sale is not being held atour main sale room and the potentialstorage charges for lots not collected bythe appropriate time.
(5) Export of goods: Buyers intending toexport goods should ascertain (a) whetheran export licence is required and (b)whether there is any specific prohibitionon importing goods of that character, e.g.items that may contain prohibitedmaterials such as ivory or rhino horn. Itis the buyer’s sole responsibility to obtainany relevant export or import licence. Thedenial of any licence or any delay inobtaining licences shall neither justify therecession of any sale not any delay inmaking full payment for the lot.
10. REMEDIES FOR NON·PAYMENT ORFAILURE TO COLLECT PURCHASES
(1) If any lot is not paid for in full and takenaway in accordance with these Conditionsor if there is any other breach of theseConditions, we, as agent for the Sellersand on their behalf, shall at our absolutediscretion and without prejudice to anyother rights we may have, be entitled toexercise one or more of the followingrights and remedies:
(a) to proceed against you for damages forbreach of contract;
(b) to rescind the contract for sale of thatlot and/or any other lots sold by us to you;
(c) to resell the lot (by auction or privatetreaty) in which case you shall beresponsible for any resulting deficiency inthe total amount due (after crediting anypart payment and adding any resale costs).
(d) to remove, store and insure the lot inthe case of storage, either at our premisesor elsewhere and to recover from you allcosts incurred in respect thereof;
(e) to charge interest at a rate notexceeding 1.5% per month above thecurrent base rate on all sums outstandingfor more than 7 working days after thesale;
(f) to retain that or any other lot sold to youuntil you pay the total amount due;
(g) to reject or ignore bids from you oryour agent at future auctions or to imposeconditions before any such bids shall beaccepted;
(h) to apply any proceeds of sale of otherlots due or which become due to youtowards the settlement of the total amountdue by you and to exercise a lien over anyof your property in our possession for any
purpose until the debt due issatisfied.satisfied.
11. DESCRIPTIONS AND CONDITION
(1) Whilst we seek to describe lotsaccurately, it may be impractical for us tocarry out exhaustive due diligence on eachlot. Prospective Buyers are given ampleopportunities to view and inspect beforeany sale and they (and any independentexperts on their behalf) must satisfythemselves as to the accuracy of anydescription applied to a lot. ProspectiveBuyers also bid on the understanding that,inevitably, representations or statementsby us as to authorship, genuineness,origin, date, age, provenance, condition orestimated selling price involve matters ofopinion. We undertake that any suchopinion shall be honestly and reasonablyheld and only accept liability for opinionsgiven negligently or fraudulently. Subjectto the foregoing neither we the auctioneeror our employees or agents accept liabilityfor the correctness of such opinions andno warranties, whether relating todescription, condition or quality of lots,express, implied or statutory, are given.Please note that photographs/imagesprovided may not be fully representative ofthe condition of the lot and should not berelied upon as indicative of the overallcondition of the lot.
(2) Condition reports: Condition reportsare provided on our website or uponrequest. The absence of a report does notimply that a lot is without imperfections.Large numbers of such requests arereceived shortly before each sale anddepartment specialists and administrationwill endeavor to respond to all requestsalthough we offer no guarantee. Anystatement in relation to the lot is merelyan expression of opinion of the Seller orLyon & Turnbull and should not be reliedupon as an inducement to bid on the lot.Lots are available for inspection prior tothe sale and you are strongly advised toexamine any lot in which you areinterested prior to the sale. Our conditionreports are not prepared by professionalconservators, restorers or engineers. Ourcondition report does not form anycontract between Lyon & Turnbull and theBuyer. The Condition Reports do not affectthe Seller’s obligations in any way.
(3) Estimates: Estimates are placed oneach lot to help Buyers gauge the sumsinvolved for the purchase of a particularlot. Estimates do not include the Buyer’sPremium or VAT. Estimates are a matterof opinion and prepared in advance.Estimates may be subject to change andare for guidance only and should not berelied upon.
(4) Catalogue Alterations: Lot descriptionsand estimates are prepared in advance ofthe sale and may be subject to change.Any alterations will be announced on thecatalogue alteration sheet, made availableprior to the sale. It is the responsibility ofthe Buyer to make themselves aware toany alterations which may have occurred.
(5) Electrical Goods: are sold as “works ofart” only and if bought for use must bechecked over for compliance with safetyregulations by a qualified electrician first.Use of such goods is entirely at the risk ofthe Buyer and no warranties as to safetyof the goods are given.
(6) Upholstered items: are sold as “worksof art” only and if bought for use must bechecked over for compliance with currentsafety regulation. Use of such goods isentirely at the risk of the Buyer and nowarranties as to safety of the goods aregiven. Lyon & Turnbull provide noguarantee as to the originality of anywood/material contained within the item.
(7) Special terms may be used in
catalogue descriptions of particularclasses of items (Books, Jewellery,Paintings, Guns, Firearms etc.) in whichcase the descriptions must be interpretedin accordance with any glossary appearingin the catalogue. These notices and termswill also form part of our terms andconditions of sales.
12. BOOKS, CLOCKS & WATCHES
(1) Books-Collation: If on collation anyNAMED item in the sale catalogue provesdefective, in text or illustration the Buyermay reject the lot provided he returns itwithin 21 days of the sale stating thedefect in writing. This, however, shall notapply in the case of unnamed items,periodicals, autographed letters, musicM.M.S., maps, drawings NOR in respect ofdamage to bindings, stains, foxing,marginal worm holes or other defects notaffecting the completeness of the text NORin respect of Defects mentioned in thecatalogue, or at the time of sale, NOR inrespect of lots sold for less than £300.
(2) Clocks & Watches: All lots are sold “asseen”, and the absence of any reference tothe condition of a clock or watch does notimply the lot is in good condition andwithout defects, repairs or restorations.Most clocks and watches will have beenrepaired during their normal lifetime andmay now incorporate additional/newerparts. Furthermore, Lyon & Turnbullmakes no representation or warranty thatany clock or watch is in working order. Asclocks and watches often contain fine andcomplex mechanisms, Buyers should beaware that a general service, change ofbattery or further repair work, for whichthe Buyer is solely responsible, may benecessary. Buyers should also be awarethat Lyon & Turnbull cannot guarantee awatch will remain waterproof if the back isremoved. Buyers should be aware that theimporting watches such as Rolex, FrankMuller and Corum into the United States ishighly restricted. These watches cannot beshipped to the USA and only importedpersonally.
13. CITES
Please be aware that all lots marked withthe symbol Y are subject to CITESregulations when exporting these itemsoutside the EU. These regulations may befound at http://www.defra.gov.uk/ahvla-en/imports-exports/cites/
Lyon & Turnbull accepts no liability for anylots which may be subject to CITES buthave not be identified as such.
