CRP-12-01/11-97500011 Tower One Fifty-Five 133 - 199 E. Boca Raton Road

Presently, the site is occupied by professional offices located at 133, 155, 165 and 199 East Boca Raton Road, all of which will be demolished. Upon demolition of the structures, a unity of title will be recorded in the public records to join all subject parcels.

This development consists of 87,084 square feet of office equivalent development and 65,516 square feet of net office equivalent development [after adjustment of existing development and demolitions (21 ,568 square feet)}, leaving a total of approximately 106,509 square feet of office equivalent development remaining in Downtown Subarea B. The anticipated net annual tax increment revenue generated by this proposed development is projected to be $ 430,932.00

PROJECT DESCRIPTION

The project is essentially a 9-story, E-shaped single-use residential building. This design gives the south fagade of the structure strong articulation, conveying an appearance of three separate sections of buildings that visually reduce the building mass along East Boca Raton Road. The main entrance to the building features a signature entryway at the mid-point of the project along East Boca Raton Road. The east end of the first floor includes six (6), one- and two-bedroom townhomes with main entrances oriented to the internal private patio around the pool, and rear walled patio areas facing Northeast Mizner Boulevard. To the west of the townhomes is the walled private pool and patio area for residents, the residential lobby, the main entrance into the parking garage and the walled/enclosed first floor of the parking structure. On the second story of the building, seven (7) one- and two-bedroom units serve as liner uses to screen the parking garage from view from Northeast Mizner Boulevard. The remaining 196 apartments are provided from the third to the ninth stories of the building.

The 209 units in the building will consist of:

• 6 townhome units (ranging from 880 - 1 ,363 SF) • 7 studio apartments (643 SF) • 105 one-bedroom units (ranging from 751 - 866 SF) • 89 two-bedroom units (ranging from 991 -1,219 SF) • 2 three-bedroom units (1 ,475 SF)

Amenities

The ground level lobby provides access to the residential amenities, including a cyber cafe, concierge services, multi-purpose room and leasing office. An outdoor swimming pool and sundeck area with patio bar are also proposed. An exercise room is planned in the upper townhome level (the level between the first floor and second floor) and an outdoor spa, bar, seating areas and cabanas are proposed for the roof deck. A building service court just east of the driveway and adjacent to the dumpster location and alley has been designated on the site plan as a loading area for residents.

Setbacks and Open Space

The Downtown Development Order requires a 6 foot setback to East Boca Raton Road and Northeast Mizner Boulevard for the first 30 feet of building height, a 20 foot setback for the portion of the building between 30 feet and 50 feet in height and a 30 foot setback for the portion of the building in excess of 50 feet. The proposed building meets or exceeds all of the setback requirements. In addition, the building is setback 24.91 feet from Northeast Mizner Boulevard (in excess of the minimum 6 foot required) to maintain compatibility with the setback for the post office to the north.

side of the pathway (e.g. a building having windows, storefronts, and opportunities for pedestrian interaction at the street level). Benches to encourage public seating areas are provided at the entry of the public pedestrian pathway and at the corner of the intersection of Northeast Mizner Boulevard and East Boca Raton Road.

Architectural Design/UDA Review

Although the project is submitted under the 1992 Design Guidelines, UDA has reviewed the proposed plans for conformance with design principles that were identified in the 2007 Downtown Master Plan Update where appropriate. UDA met with the applicant and shared its comments on the project drawings at a working session at the Petitioner's office in September, 2012. The Petitioner worked with UDA to provide additional fac;:ade and roofline articulation and incorporate the north­south pedestrian pathway along the west side of the building.

Tower 155 reflects an interpretation of the Mizner architectural style utilizing art deco features. UDA finds that "the building is well designed and at an appropriate scale to the street." UDA commented that "the project includes a series of buildings that create a remarkable assembly of facades at a pedestrian scale identified in the 2007 Downtown Master Plan Update."

DEPARTMENT AND PUBLIC REVIEW

On December 18, 2012, the Community Appearance Board (CAB) reviewed the proposed petition and voted unanimously (7 -0) to recommend approval.

The Planning and Zoning Board reviewed the proposed petition at a public hearing held on January 3, 2013. The Board unanimously recommended approval (7 -0) subject to the conditions · recommended by Staff.

RECOMMENDATION

Based on the Development Services Department Staff report and recommendation and the recommendation of the Planning and Zoning Board, I recommend approval of IDA CRP-12-01 with a technical deviation subject to the conditions in the attached Individual Development Approval.

FISCAL IMPACT

There is no fiscal impact associated with this Individual Development Approval.

Recommendation for APPROVAL of CRP-12-01/12-97500011, a Resolution of the City of Boca Raton Community Redevelopment Agency considering an Individual Development Approval for Tower One Fifty-Five, generally located on 1.25 acres at 133-199 East Boca Raton Road, consisting of a 9-story, 209-unit residential building with a maximum height not to exceed 100 feet, with 127,744 square feet of structured parking with a technical deviation from the Boca Raton Downtown Development of Regional Impact (DDRI) Development Order paragraph 2(4)(b)1 to allow a reduction in the number of required parking spaces; resulting in approximately 106,509 square feet of office equivalent development remaining in Downtown Subarea B.

WHEREAS, the applicant for CRP-12-01/12-97500011 has appeared before the Planning and Zoning Board to review petition CRP-12-01/12-97500011, and

WHEREAS, a Notice of Public Hearing was sent to property owners of record within 500 feet and posted on the property. The notice was published on December 19, 2012, and

WHEREAS, the Planning and Zoning Board conducted a public hearing on January 3, 2013, and

WHEREAS, the Planning and Zoning Board finds that this project has been reviewed for impacts to the City's Comprehensive Plan public facilities (roads, water, sewer, drainage, solid waste, parks, schools) level of service standards and finds that issuance of a development order does not degrade the Comprehensive Plan levels-of-service standards, and

WHEREAS, the Planning and Zoning Board has found the petition to be consistent with the Comprehensive Plan, the City's Land Development regulations, Ordinance 4035 as amended, and the Rules of the Community Redevelopment Agency, and

Thank you for the opportunity to review this key project in Downtown Boca Raton. We are pleased to assist the city in reviewing new development for conformance with Design Principles that were identified in the Master Plan Update Process.

Tower 155 is located on the northwest corner of Boca Raton Road and NE Mizner Blvd. The project comprises the south side of the block (one half of a city block in depth), and backs up to a service alley. The project site comprises of an agglomeration of individual parcels.

This project is submitted under the 1992 Design Guidelines. Although these guidelines do not include substantial regulations for architecture, we remain committed to considering issues that relate to our work in the Master Plan Update process where it is appropriate.

In our design review, we thoughtfully consider the following three criteria:

A. Strong and Active Streetscape - From the point of view of a pedestrian in Downtown, there are great improvements to be made in Boca Raton. Walking along a downtown street should be a lively and animated experience with well-designed facades at the lower floors, supporting pedestrian activity.
