Notice to Applicants: This notice is acomplete application package. Togetherwith the statute authorizing the programand the Education Department GeneralAdministrative Regulations (EDGAR),this notice contains all of theinformation, application forms, andinstructions needed to apply for anaward under this program. The statutoryauthorization for this program, and theapplication requirements that apply tothis competition, are contained insections 7113 and 7116 of theElementary and Secondary EducationAct of 1965, as amended by theImproving America’s Schools Act of1994 (Pub. L. 103–382, enacted October20, 1994 (the Act) (20 U.S.C. 7423 and7426)).

Purpose of Program: The purpose ofthis program is to provide grants tocarry out highly focused, innovative,locally designed projects to expand orenhance existing bilingual education orspecial alternative instructionalprograms for limited English proficient(LEP) students.

Eligible Applicants: (1) One or morelocal educational agencies (LEAs); (2)one or more LEAs in collaboration withan institution of higher education (IHE),community-based organization (CBO),or a state educational agency (SEA); or(3) a CBO or an IHE that has anapplication approved by the LEA todevelop and implement early childhoodeducation or family education programsor to conduct an instructional programthat supplements the educationalservices provided by an LEA.

Deadline for Transmittal ofApplications: February 16, 1999.

Deadline for IntergovernmentalReview: April 19, 1999.

Available Funds: $10 million.Estimated Range of Awards:

$100,000–$150,000.Estimated Average Size of Awards:

$125,000.Estimated Number of Awards: 80.Note: The Department is not bound by any

Project Period: 24 months.Applicable Regulations: (a) The

Education Department GeneralAdministrative Regulations (EDGAR) in34 CFR parts 74, 75, 77, 79, 80, 81, 82,85, and 86; and (b) 34 CFR part 299.

Description of ProgramUnder this section grantees are

authorized to improve the education ofLEP children and youth and theirfamilies by, among other things:implementing family educationprograms, improving the instructionalprogram for LEP children, compensatingpersonnel who have been trained—orare being trained—to serve LEP childrenand youth, providing tutorials andacademic or career counseling for LEPchildren and youth, and providingintensified instruction. Also, grantsawarded under this section may be usedto provide inservice training toclassroom teachers, administrators, orother school or community-basedorganization personnel to improve theinstruction and assessment of language-minority and LEP students.

PrioritiesCompetitive Priority: The Secretary,

under 34 CFR 75.105(c)(2)(i) and 34 CFR299.3(b), gives preference toapplications that meet the followingcompetitive priority. The Secretaryawards 5 points to an application thatmeets this competitive priority. Thesepoints are in addition to any points theapplication earns under the selectioncriteria for the program:

Projects that will contribute tosystemic educational reform in anEmpowerment Zone, including aSupplemental Empowerment Zone, oran Enterprise Community designated bythe United States Department ofHousing and Urban Development or theUnited States Department ofAgriculture, and are made an integralpart of the Zone’s or Community’scomprehensive communityrevitalization strategies.

A list of areas that have beendesignated as Empowerment Zones andEnterprise Communities is provided atthe end of this notice.

Invitational Priorities: The Secretaryis particularly interested in applicationsthat meet one or more of the followinginvitational priorities. However, under34 CFR 75.105(c)(1), an application thatmeets one or more of these invitationalpriorities does not receive competitiveor absolute preference over otherapplications:

Invitational Priority 1—ReadingProjects that focus on assisting limited

English proficient students to readindependently and well by the end ofthird grade.

Invitational Priority 2—MathematicsProjects that focus on assisting limited

English proficient students to masterchallenging mathematics, including the

foundations of algebra and geometry, bythe end of eighth grade.

Invitational Priority 3—Preparation forPostsecondary Education

Projects that focus on motivating andacademically preparing limited Englishproficient students for successfulparticipation in college and otherpostsecondary education.

Selection Criteria

(a)(1) The Secretary uses the followingselection criteria in 34 CFR 75.210 andsections 7116 and 7123 of the Act toevaluate applications for new grantsunder this competition.

(2) The maximum score for all ofthese criteria is 100 points.

(3) The maximum score for eachcriterion is indicated in parentheses.

(b) The criteria -(1) Need for theproject. (15 points) The Secretaryconsiders the need for the proposedproject. In determining the need for theproposed project, the Secretaryconsiders the following factors: (i) Thenumber of children and youth of limitedEnglish proficiency in the school orschool district to be served, and (ii) Thecharacteristics of those children andyouth, such as—

(A) Language spoken;(B) Dropout rates;(C) Proficiency in English and the

native language;(D) Academic standing in relation to

the English proficient peers of thosechildren and youth; and

(E) If applicable, the recency ofimmigration.(Authority: 20 U.S.C. 7426(g)(1)(A)).

(2) Quality of the project design. (25points)

(i) The Secretary considers the qualityof the design of the proposed project.

(ii) In determining the quality of thedesign of the proposed project, theSecretary considers the followingfactors:

(A) The extent to which the goals,objectives, and outcomes to be achievedby the proposed project are clearlyspecified and measurable.

(B) The extent to which the design ofthe proposed project is appropriate to,and will successfully address, the needsof the target population or otheridentified needs.

(C) The extent to which the proposedproject is part of a comprehensive effortto improve teaching and learning andsupport rigorous academic standards forstudents.

(D) The extent to which the proposedproject is designed to build capacity andyield results that will extend beyond theperiod of Federal financial assistance.

(E) The extent to which the proposedproject will be coordinated with similaror related efforts, and with otherappropriate community, State, andFederal resources.

(F) The extent to which the proposedproject encourages parentalinvolvement.(Authority: 34 CFR 75.210(c)(2)(i), (ii), (xii),(xvi), (xviii), and (xix)).

(3) Quality of project services. (15points)

(i) The Secretary considers the qualityof the services to be provided by theproposed project.

(ii) In determining the quality of theservices to be provided by the proposedproject, the Secretary considers thequality and sufficiency of strategies forensuring equal access and treatment foreligible project participants who aremembers of groups that havetraditionally been underrepresentedbased on race, color, national origin,gender, age, or disability.

(iii) In addition, the Secretaryconsiders the following factors:

(A) The extent to which the servicesto be provided by the proposed projectare appropriate to the needs of theintended recipients or beneficiaries ofthose services.

(B) The extent to which the trainingor professional development services tobe provided by the proposed project areof sufficient quality, intensity, andduration to lead to improvements inpractice among the recipients of thoseservices.

(C) The likelihood that the services tobe provided by the proposed projectwill lead to improvements in theachievement of students as measuredagainst rigorous academic standards.(Authority: 34 CFR 75.210 (d)(1),(2),(3)(i),(v)and (vii)).

(4) Proficiency in English and anotherlanguage. (3 points) The Secretaryreviews each application to determinethe extent to which the proposed projectwill provide for the development ofbilingual proficiency both in Englishand another language for allparticipating students.(Authority: 20 U.S.C. 7426(i)(1)).

(5) Quality of project personnel. (7points)

(i) The Secretary considers the qualityof the personnel who will carry out theproposed project.

(ii) In determining the quality ofproject personnel, the Secretaryconsiders the extent to which theapplicant encourages applications foremployment from persons who aremembers of groups that havetraditionally been underrepresented

based on race, color, national origin,gender, age, or disability.

(iii) In addition, the Secretaryconsiders the following factors:

(A) The qualifications, includingrelevant training and experience, of theproject director or principalinvestigator.

(B) The qualifications, includingrelevant training and experience, of keyproject personnel.(Authority: 34 CFR 75.210(e)(1)–(3)(i) and(ii)).

(6) Adequacy of resources. (10 points)(i) The Secretary considers the

adequacy of resources for the proposedproject.

(ii) In determining the adequacy ofresources for the proposed project, theSecretary considers the followingfactors:

(A) The extent to which the budget isadequate to support the proposedproject.

(B) The extent to which the costs arereasonable in relation to the objectives,design, and potential significance of theproposed project.

(C) The extent to which the costs arereasonable in relation to the number ofpersons to be served and to theanticipated results and benefits.

(D) The potential for continuedsupport of the project after Federalfunding ends, including, as appropriate,the demonstrated commitment ofappropriate entities to such support.(Authority: 34 CFR 75.210(f)(1), (2)(iii), (iv),(v), and (vi)).

(7) Quality of the management plan.(15 points)

(i) The Secretary considers the qualityof the management plan for theproposed project.

(ii) In determining the quality of themanagement plan for the proposedproject, the Secretary considers thefollowing factors:

(A) The adequacy of the managementplan to achieve the objectives of theproposed project on time and withinbudget, including clearly definedresponsibilities, timelines, andmilestones for accomplishing projecttasks.

(B) The extent to which the timecommitments of the project director andprincipal investigator and other keyproject personnel are appropriate andadequate to meet the objectives of theproposed project.

(C) How the applicant will ensure thata diversity of perspectives are brought tobear in the operation of the proposedproject, including those of parents,teachers, the business community, avariety of disciplinary and professional

fields, recipients or beneficiaries ofservices, or others, as appropriate.(Authority: 34 CFR 75.210(g)(1), (2)(i), (iv)and (v)).

(8) Quality of project evaluation plan.(10 points) The Secretary reviews eachapplication to determine how well theproposed project’s evaluation will meetthe following requirements:

(i) Student evaluation and assessmentprocedures must be valid, reliable, andfair for limited English proficientstudents.

(ii) The evaluation must include—(A) How students are achieving the

State student performance standards, ifany, including data comparing childrenand youth of limited English proficiencywith nonlimited English proficientchildren and youth with regard toschool retention, academicachievement, and gains in English (and,if applicable, native language)proficiency;

(B) Program implementationindicators that provide information forinforming and improving programmanagement and effectiveness,including data on appropriateness ofcurriculum in relationship to grade andcourse requirements, appropriateness ofprogram management, appropriatenessof the program’s staff professionaldevelopment, and appropriateness ofthe language of instruction; and

(C) Program context indicators thatdescribe the relationship of theactivities funded under the grant to theoverall school program and otherFederal, State, or local programs servingchildren and youth of limited Englishproficiency.(Authority: 20 U.S.C. 7426(h)(3) and7433(c)(1)–(3)).

Intergovernmental Review of FederalPrograms

This program is subject to therequirements of Executive Order 12372(Intergovernmental Review of FederalPrograms) and the regulations in 34 CFRpart 79. The objective of the Executiveorder is to foster an intergovernmentalpartnership and to strengthenfederalism by relying on State and localprocesses for State and localgovernment coordination and review ofproposed Federal financial assistance.Applicants must contact the appropriateState Single Point of Contact to find outabout, and to comply with, the State’sprocess under Executive order 12372.Applicants proposing to performactivities in more than one State shouldimmediately contact the Single Point ofContact for each of those States andfollow the procedure established in eachState under the Executive order. In States that have not established aprocess or chosen a program for review,State, areawide, regional, and localentities may submit comments directlyto the Department.

Instructions for Transmittal ofApplications

Notice To All Applicants

The purpose of this enclosure is toinform you about a new provision in theDepartment of Education’s GeneralEducation Provisions Act (GEPA) thatapplies to applicants for new grantawards under Department programs.This provision is section 427 of GEPA,enacted as part of the ImprovingAmerica’s Schools Act of 1994 (Pub. L.103–382).

To Whom Does This Provision Apply?

Section 427 of GEPA affectsapplicants for new discretionary grantawards under this program. ALLAPPLICANTS FOR NEW AWARDSMUST INCLUDE INFORMATION INTHEIR APPLICATIONS TO ADDRESSTHIS NEW PROVISION IN ORDER TORECEIVE FUNDING UNDER THISPROGRAM.

(If this program is a State-formulagrant program, a State needs to providethis description only for projects oractivities that it carries out with fundsreserved for State-level uses. Inaddition, local school districts or othereligible applicants that apply to theState for funding need to provide thisdescription in their applications to theState for funding. The State would beresponsible for ensuring that the schooldistrict or other local entity hassubmitted a sufficient section 427statement as described below.)

What Does This Provision Require?

Section 427 requires each applicantfor funds (other than an individualperson) to include in its application adescription of the steps the applicant

proposes to take to ensure equitableaccess to, and participation in, itsfederally-assisted program for students,teachers, and other programbeneficiaries with special needs.

This provision allows applicantsdiscretion in developing the requireddescription. The statute highlights sixtypes of barriers that can impedeequitable access or participation thatyou may address: gender, race, nationalorigin, color, disability, or age. Based onlocal circumstances, you can determinewhether these or other barriers mayprevent your students, teachers, etc.from equitable access or participation.Your description need not be lengthy;you may provide a clear and succinctdescription of how you plan to addressthose barriers that are applicable to yourcircumstances. In addition, theinformation may be provided in a singlenarrative, or, if appropriate, may bediscussed in connection with relatedtopics in the application.

Section 427 is not intended toduplicate the requirements of civilrights statutes, but rather to ensure that,in designing their projects, applicantsfor Federal funds address equityconcerns that may affect the ability ofcertain potential beneficiaries to fullyparticipate in the project and to achieveto high standards. Consistent withprogram requirements and its approvedapplication, an applicant may use theFederal funds awarded to it to eliminatebarriers it identifies.

What Are Examples of How anApplicant Might Satisfy theRequirements of This Provision?

The following examples may helpillustrate how an applicant may complywith section 427.

(1) An applicant that proposes tocarry out an adult literacy project

serving, among others, adults withlimited English proficiency, mightdescribe in its application how itintends to distribute a brochure aboutthe proposed project to such potentialparticipants in their native language.

(2) An applicant that proposes todevelop instructional materials forclassroom use might describe how itwill make the materials available onaudio tape or in braille for students whoare blind.

(3) An applicant that proposes tocarry out a model science program forsecondary students and is concernedthat girls may be less likely than boysto enroll in the course, might indicatehow it intends to conduct ‘‘outreach’’efforts to girls, to encourage theirenrollment.

We recognize that many applicantsmay already be implementing effectivesteps to ensure equity of access andparticipation in their grant programs,and we appreciate your cooperation inresponding to the requirements of thisprovision.

The narrative is the section of theapplication where you address theselection criteria used by reviewers inevaluating the application. You mustlimit the narrative to the equivalent ofno more than 30 pages, using thefollowing standards:

(1) A page is 8.5′′ × 11′′, on one sideonly with 1′ margins at the top, bottom,and both sides.

(2) You must double space (no morethan three lines per vertical inch) alltext in the application narrative,

including titles, headings, footnotes,quotations, references, and charts,tables, figures, and graphs.

If you use a proportional computerfont, you may not use a font smallerthan a 12-point font. If you use a non-proportional font or a typewriter, youmay not use more than 12 characters perinch.

AbstractThe narrative section should be

preceded by a one-page abstract thatincludes a short description of thepopulation to be served by the project,project objectives, and planned projectactivities.

Selection CriteriaThe narrative should address fully all

aspects of the selection criteria in theorder listed and should give detailinformation regarding each criterion. Donot simply paraphrase the criteria. Donot include resumes or curriculum vitaefor project personnel; provide positiondescriptions instead. Do not includebibliographies, letters of support, orappendices in your application.

Empowerment Zone/EnterpriseCommunity Priority

Applicants that wish to be consideredunder the competitive priority forEmpowerment Zones and EnterpriseCommunities, as specified in a previoussection of this notice, should identify inSection D of the Project DocumentationForm the applicable EmpowermentZone or Enterprise Community. Theapplication narrative should describethe extent to which the proposed projectwill contribute to systemic educationalreform in the particular EmpowermentZone or Enterprise Community and bean integral part of the Zone’s orCommunity’s comprehensiverevitalization strategies. A list of areasthat have been designated asEmpowerment Zones and Enterprise

Communities is provided at the end ofthis notice.

Budget

Budget line items must support thegoals and objectives of the proposedproject and must be directly related tothe instructional design and all otherproject components.

Final Application Preparation

Use the Checklist for Applicants toverify that your application is complete.Submit three copies of the application,including an original copy containingan original signature for each formrequiring the signature of the authorizedrepresentative. Do not use elaboratebindings or covers. The applicationpackage must be mailed or hand-delivered to the Application ControlCenter (ACC) and postmarked by thedeadline date.

Submission of Application to StateEducational Agency

Section 7116(a)(2) of the authorizingstatute (Elementary and SecondaryEducation Act of 1965, as amended bythe Improving America’s Schools Act of1994, Pub. L. 103–382) requires allapplicants except schools funded by theBureau of Indian Affairs to submit acopy of their application to their Stateeducational agency (SEA) for reviewand comment (20 U.S.C. 7426(a)(2)).Section 75.156 of the EducationDepartment General AdministrativeRegulations (EDGAR) requires theseapplicants to submit their application tothe SEA on or before the deadline datefor submitting their application to theDepartment of Education. This sectionof EDGAR also requires applicants toattach to their application a copy oftheir letter that requests the SEA tocomment on the application (34 CFR75.156). A copy of this letter should beattached to the Project DocumentationForm contained in this applicationpackage. APPLICANTS THAT DO NOTSUBMIT A COPY OF THEIRAPPLICATION TO THEIR STATEEDUCATIONAL AGENCY INACCORDANCE WITH THESESTATUTORY AND REGULATORYREQUIREMENTS WILL NOT BECONSIDERED FOR FUNDING.
