August 25 – Trico Marine Services Inc. (OTCPK:TRMA.Q), a marine transportation and ship rental company, filed a voluntary petition for reorganization under Chapter 11 in the U.S. Bankruptcy Court for the District of Delaware.
August 20 – Alon USA Energy, Inc. (NYSE:ALJ), a company engaged in the refining and marketing of petroleum products, was downgraded from B+/Negative to B/Stable by Standard & Poor’s.
August 18 – Boston Generating, LLC, an owner and operator of power plants, filed a voluntary petition for reorganization under Chapter 11 in the U.S. Bankruptcy Court in the Southern District of New York.
August 17 – Energy Future Holdings Corporation, which manages a portfolio of regulated energy businesses in Texas, was downgraded to SD/‐‐NR from CC/Negative/NR by Standard and Poor’s.
August 12 – Caribbean Petroleum Corporation, which owns and operates oil refineries and gas stations in Puerto Rico, filed a voluntary petition for reorganization under Chapter 11 in the U.S. Bankruptcy Court for the District of Delaware.
August 10 – Abbot Group Limited, which provides development drilling services and rig operation to oil companies, was downgraded from B‐/Watch Neg. to CCC/Negative by Standard & Poor’s.
July 13 – Auditors for Earth Search Sciences, Inc. (OTCBB:ESSE), a company focused on the extraction of oil and gas from oil shale in Wyoming and Colorado, expressed going concern doubts in the company’s financial statements.

November, 2010 To the Clients and Friends of Navigant Capital Advisors, LLC: We are pleased to share with you Navigant Capital Advisors’ Distressed Energy Quarterly Dialogue for the third quarter of 2010, which provides coverage of valuation metrics and distressed news (e.g. bankruptcies, credit downgrades, guidance revisions and other events), as well as M&A and capital markets activity in the four primary sectors that compose the NCA Distressed Energy universe: (i) Energy Assets and Services, (ii) Independent Power Producers (“IPPs”)/Merchant Generators, (iii) Oil and Gas Refining and Marketing, and (iv) Oil and Gas Transportation and Storage. As indicated throughout this report, the energy markets by and large have continued to experience negative domestic fundamentals of continuing weak economic activity, including supply patterns that outpace demand and, in general, weak pricing levels. Recent newsworthy items include the following:
• The White House lifted the deep water drilling moratorium in the Gulf of Mexico in advance of the November expiration date, which was certainly welcome. However, industry players remain skeptical about the pace of offshore drilling activity given the lack of clarity of the new rules and liabilities under which such activity will be conducted. Even the newly formed Bureau of Ocean Energy Management, Regulation and Enforcement) admitted that it couldn’t give a clear timeline for resumption of offshore drilling.
• With an abundance of cheap domestic natural gas and significant excess LNG import terminal capacity, industry chatter has increased about the potential conversion of import terminals to export facilities. While a difficult choice given the required regulatory review and approval for building associated liquefaction facilities, the greater challenges will likely be finding a U.S. producer to commit its resources to the project or an international buyer who is willing to buy long‐term gas in what has historically been a volatile U.S. market.
• The Republican Party will assume control of the House of Representatives in January, thus taking “Cap and Trade” legislation off the table and making any meaningful energy reform in the near term unlikely. That would appear to be particularly good news for power producers that had criticized recent legislation as having singled them out for more onerous regulation.

Standard & Poorʹs distress ratio decreased marginally to 11.8% on Sept. 15. The distress ratio is lower than its long‐term average of 15.7% following a prolonged period at more elevated levels. This steady decline in the distress ratio has pushed the 12‐month moving average down to 12.3% from 25.6% six months ago, indicating an extended period of more favorable lending conditions.
