Approval of Minutes of the Meeting of April 22, 2015

A motion to approve the minutes of the meeting of April 22, 2105, was made by Melissa Raby and seconded by Baljinder Gill. District Council members approved the minutes with a vote all in favor. Ayes: Errin Bass, Molly Boyatt, Curtis Martin, Angela Fairchilds, Baljinder Gill,

Dorothy Pimentel, Jim Sahlman, Joan Smith, Jill Stearns Nayes: none

Chancellor Joan Smith provided time in the meeting for DC member introductions.

2. Title IX

Director of District Security, Compliance & Emergency Preparedness John Black provided an update on Title IX. Progress is being made towards the goal to meet current legal mandates; a workgroup is meeting and reviewing policies and putting together a packet to provide updated language to the District Policies and Procedure Committee for their review. Mandatory reporter training will be provided online using ATIXA (Association of Title IX Administrators). John Black is working on MOUs with local law enforcement agencies; in addition, he is working with colleges to draft language that will be provided to students as part of their orientation packets. The goal is to efficiently provide students the information they need to get everyone including staff orientated and informed of Title IX.

3. Strategic Planning Chancellor Joan Smith informed DC members that District Council is the workgroup for the District Strategic Planning. A meeting will be scheduled in November or December to continue the strategic planning process.

4. Board Policy

Interim District Director of Public Affairs Coni Chavez provided information regarding the Policies and Procedures Constituent Review Process, the upcoming six year cycle of comprehensive chapter review, and the annual and legal review process. She went over the review cycle schedule and timeline for annual and comprehensive chapter reviews.

5. Fiscal Updates Executive Vice Chancellor Teresa Scott provided updates regarding the following items:

a. FTES Target 2015-2016 A review of FTES Targets for 2015-2016 was provided.

b. FON Projection Faculty Obligation Numbers (FON) will be changing as YCCD awaits information from the State for this fiscal year. Seven additional faculty positions have been added to MJC and three positions to Columbia College.

c. YCCD 2015-2016 General Fund Budget A high level overview of the budgets for Central Services, MJC and Columbia College was provided; the budget is being presented to the Board of Trustees at their September meeting with an amended budget likely to be presented in October. In addition the budget includes contingency transfers, including an off schedule 1% salary adjustment, and pending negotiations contingency funds.

d. YCCD Scheduled Maintenance/Instruction Material A brief report was provided on YCCD Scheduled Maintenance.

e. Mandated Cost Pay Back Allocation A brief report was provided on mandated cost pay back allocation.

6. IT Update

a. ITS Updates No update due to time constraint.

b. DTAC Membership Requests Assistant Vice Chancellor Marty Gang reported seeking members for the District Technology Advisory Committee (DTAC) to begin discussion on the IT Strategic Plan. Student Trustee Errin Bass will seek students to serve on the committee.

7. HR Update Vice Chancellor Gina Leguria provided updates regarding the following items:

a. Re-org process Human Resources is working with both colleges on the re-org process.

b. Web time entry Human Resources is moving forward on use of web-time entry for short term contracts and permanent part-time hourly employees. Students currently use web-time entry and departmental staff is already trained to facilitate and train new users. Further assistance can be provided as needed.

c. Calendar Committee Update The District/YFA Calendar Committee met yesterday; a key recommendation was to move the start date for Fall 2016 – to begin one week later on August 29. Further discussion will continue on this matter.

d. EEO Advisory Committee Human Resources is re-launching the committee in an effort to revive the group; moving forward Kathren Pritchard will be the point of contact.

e. 1% off schedule timeline The one-percent off schedule timeline was discussed; the increase will be paid on August 31, 2015; thanks were extended to Payroll for getting the task completed in a short time frame.

The next meeting of the District Council is scheduled for September 23, 2015 – 3 p.m. at Gene Bianchi Community Center, Oakdale.

Lateral Transfers/Voluntary Demotions for Classified Positions

Guidelines

Definitions:

a. Lateral transfer is defined as a change in an eligible classified employee’s position

within the same classification and not involving a promotion or demotion.

b. Voluntary demotion is defined as: a permanent change to a lower classification for

which the classified employee meets all employment qualifications as determined by

the District.

District Notification: Upon an opening for a permanent classified position the District will

announce the position via District email to all of the available lateral/voluntary opportunity.

Lateral transfers and voluntary demotions will be posted for five (5) days.

Applicant Process: All eligible classified employees must submit required documents via the

District’s online application system. The required documents include:

Review & Selection Process: Human Resources will oversee an internal interview and

selection process. Selection and recommendation for hire will be the responsibility of the

supervising manager plus one additional District employee.

a. All employees who meet the minimum qualifications shall be interviewed.

b. The hiring manager responsibilities:

1. Prepare internal interview questions and submit to HR for prior approval;

2. Identify one employee to serve with the Hiring Manager for the internal

interview; and

3. Conduct reference checks

• A reference check with current manager with the agreement of the

candidate.

• A review of official YCCD personnel file

4. The hiring manager shall give lateral transfer and voluntary demotion request

equal consideration. If the more than one candidate is identified as qualified,

seniority will be the determining factor.

c. If a current employee is identified as the successful candidate, no open recruitment

will occur.

d. The active recruitment process shall not proceed until all interviews have been

completed and bargaining unit members have notified of the decision. District email

is an acceptable form of notification.

Open Recruitment: If no current employee submits interest or a successful candidate has not

been identified, the District shall proceed to the active recruitment process.

The Yosemite Community College District Board of Trustees shall consist of seven (7) members elected 7

from seven (7) Trustee areas in the District. Members shall be elected as defined in Board Policy 2100 or 8

appointed as defined in Board Policy 2110. 9

Any person who meets the criteria contained in law is eligible to be elected or appointed a member of the 11

Board. 12

An employee of the District may not be sworn into office as an elected or appointed member of the 14

governing bBoard unless he or she resigns as an employee. 15

The Board shall include one non-voting student member who is physically enrolled in one or more of the 7

colleges of the Yosemite Community College District. The student member shall be selected in accordance 8

with rules and regulations established by the members of the elected Board of Trustees. 9

The term of office shall be one year commencing May 15 each year and concluding on the following May 11

14. 12

The student member shall be seated with the Board and shall be recognized as a full member of the Board 14

at meetings. The student member is entitled to participate in discussion of issues and receive all materials 15

presented to members of the Board (except for closed session). The student member shall be entitled to 16

any mileage allowance necessary to attend bBoard meetings to the same extent as publicly elected 17

trustees. The student member is not required to give up employment with the District. 18

The student member will be entitled to an advisory vote, although the vote shall not be included in 20

determining the vote required to carry any measure before the Board. If a student member wishes to 21

cast an advisory vote, it shall be taken prior to the Board’s vote. The student member of the Board does 22

not make and second motions; attend closed sessions; or receive compensation for meeting attendance. 23

This policy will be reviewed by the Board and either readopted, revised or repealed on or before May 15 25

The role of the student trustee is to be a representative voice of YCCD students to the Board. As such, the 4

student member shall have the following responsibilities: 5

A. Attend meetings of the Board of Trustees 7

B. Participate in a Student Trustee Orientation 9

C. Identify a mentor or advisor 11

D. Communicate regularly with Associated Student leadership at both Colleges and share the results 13

The term of office of each Trustee shall be four (4) years, commencing on the first Board meeting in 7

December, following the November election. Elections shall be held every two years, in even numbered 8

years in accordance with the Education Code and the State Elections Code. Terms of Trustees are 9

staggered so that, as nearly as practical, one half of the Trustees shall be elected at each Trustee election. 10

In the event of a tie vote among two or more candidates for the governing board, the Board of Trustees 12

hereby determines the method of deciding the winner to be by random drawing. The Board shall notify 13

the candidates who have received the tie votes to appear before it either personally or by a representative 14

at a time and place designated by the Board. The Board shall at that time and place determine the winner 15

by random drawing. 16

The Board of Trustees has provided for the election of Trustees by Trustee areas. The Board member 18

must reside in the area in which he/she represents. The Board member must also be registered to vote 19

in that area. The election of a Board member residing in and registered to vote in the Trustee area he or 20

she seeks to represent shall be only by the registered voters of the same Trustee areas. A detailed map 21

and area description of each Trustee area are attached. YCCD Trustee Area maps can be viewed at: 22

Effective July 1, 2012 the Trustee areas are as follows: 25

Area 1 District area comprised of Calaveras County, Tuolumne County, eastern Stanislaus 27

The Chancellor shall submit recommendations to the Board regarding adjustments to be made to the 19

boundaries of each Trustee area, if any adjustment is necessary, after each decennial federal census. The 20

Chancellor shall submit the recommendation in time for the Board to act as required by law. 21

Candidates who run for the office of Trustee of the Yosemite Community College District shall cover the 23

cost of printing, handling, and mailing candidates a statement of qualifications, if so desired, and are 24

responsible for submitting such statements to required officials. 25

In compliance with Board Policy 2015, one (1) non-voting student representative shall serve on the 7

Yosemite Community College District Board of Trustees subject to the following provisions: 8

Criteria for Service 10

I. The student representative shall meet all the following criteria for service on the Board of Trustees: 12

13

A. Be a legal resident of the Yosemite Community College District at the time of application and 14

during the time of service on the Board. 15

B. Be enrolled in at least five (5) units during the semester or quarter of application and during each 16

semester or quarter of service. 17

C. Be in good academic standing (not on probation) and have earned a cumulative grade point 18

average of 2.0 or more in at least twelve (12) units completed at either Columbia College or 19

Modesto Junior College prior to May 15 of the year of service on the Board. In the absence of an 20

established GPA based on prior academic work, the most recent mid-term GPA or average of 21

grades to date will be acceptable. 22

Selection of the student representative will alternate between Columbia College and Modesto Junior 24

College annually. 25

The student member shall be chosen by the students enrolled in the District as follows: 4

Election: 6

The student member shall be elected by the students enrolled in the District in a general election held for 7

that purpose. Normally, an election will be held in the spring semester so that the office is filled by May 8

15. The student member shall serve a term of one year commencing May 15 and ending May 14 of the 9

following year. Student members will alternate between Modesto Junior College and Columbia College 10

every other year. 11

An election will be conducted at each college in accordance with the administrative procedures adopted 13

by each respective associated student organization, except that all members of the student body of the 14

District shall be permitted to vote for the student member. Each qualified candidate shall be listed on the 15

ballot at each college. The successful candidate must receive a plurality of all votes cast. 16

17

The student trustee may be recalled by the students of the District in an election held for that purpose. 18

All members of the student body of the District shall be permitted to vote in the recall election. 19

20

Vacancies: 21

A special election will be held by both ASMJC and ASCC if the office becomes vacant by reason of the 22

resignation, recall, or disqualification of an elected student member, or by any other reasons. A 23

resignation must be in writing. 24

25

The process of the special election will be determined by both ASMJC and ASCC. 26

27

The Chancellor will formally notify both ASMJC and ASCC of the need to fill the student member vacancy. 28

Special elections shall be held within thirty (30) days after notice of the vacancy comes to the attention 29

of the Chancellor. The vacancy shall be filled within 45 days of the formal notification of the vacancy. 30

Exception: 32

No special election will be called if the vacancy occurs within 30 days of a regularly scheduled election. 33

Candidates for the position may nominate themselves or be nominated by others by the filing of an 34

application at their campus of residence certifying that the candidate is eligible for service under the 35

criteria set forth in California law and these policies. 36

Removal from Office: 38

The student member may be removed from office for cause by the Board of Trustees in consultation with 39

the Chancellor, student government advisor, ASMJC, ASCC and Vice President for Student Services or 40

equivalent administrator at the appropriate college. 41

Vacancies on the Board may be caused by any of the events specified in Government Code Section 1770 7

or any applicable provision in the Elections Code, or by a failure to elect. 8

A vacancy on the Board of Trustees shall be filled by governing bBoard provisional appointment or by an 10

election of the registered voters of the District called by the governing bBoard, except when the vacancy 11

occurs near the end of the term of the incumbent, as provided by law. 12

13

Within 60 days of the vacancy or filing of a deferred resignation, the Board shall determine whether to 14

order an election or make a provisional appointment to fill the vacancy. 15

16

If an election is ordered, it shall be held on the next regular election date no less than 130 days after the 17

occurrence of the vacancy. 18

19

If a provisional appointment is made, it shall be subject to the conditions in Education Code Section 5091. 20

The person appointed to the position shall hold office only until the next regularly scheduled election for 21

Board members, when the election shall be held to fill the vacancy for the remainder of the unexpired 22

term. 23

The provisional appointment will be made by a majority public vote of the bBoard members at a public 25

meeting. 26

27

Resignations from the Board shall be governed by Education Code Section 5090. 28

29

The Chancellor shall establish administrative procedures to solicit applications that assure ample publicity 30

to and information for prospective candidates. The Board will determine the schedule and appointment 31

process, which may include interviews at a public meeting. 32

When the Board determines to fill the vacancy by election or appointment, the Chancellor shall assure 4

that there is ample publicity to and information for prospective candidates. Publicity shall include posting 5

the announcement in three public places in the District and publication in a newspaper of general 6

circulation. 7

The posted notice of vacancy shall include directions regarding applications or nominations of legally 9

qualified candidates. Persons applying or nominated must meet the qualifications required by law for 10

members of the Board. 11

Persons applying for appointment to the Board shall receive a letter from the Chancellor containing 13

information about the District and the Board, and including a candidate information sheet to be 14

completed and returned by a specific date. 15

16

If the Board elects to fill a vacancy by appointment, the Board shall request personal interviews with 17

candidates. Interviews will be conducted in a public hearing scheduled for that purpose. 18

19

Each Board member will review all Candidate information sheets, with final selection made by a majority 20

vote of the Board members at a public meeting called for that purpose. 21

Whenever a provisional appointment is made, the Board shall, within 10 days of the provisional 23

appointment, post notices of both the actual vacancy or the filing of a deferred resignation and the 24

provisional appointment in three public places in the District. It shall also publish a notice in a newspaper 25

of general circulation. 26

The notice shall state the fact of the vacancy or resignation and the date of the occurrence of the vacancy 28

or the date of the filing of, and the effective date of, the resignation. It shall also contain the full name of 29

the provisional appointee to the bBoard, the date of the appointment, and a statement that unless a 30

petition calling for a special election, containing a sufficient number of signatures, is filed in the office of 31

county superintendent of schools within 30 days of the date of the provisional appointment, it shall 32

become an effective appointment. 33

A provisional appointment confers all powers and duties of a governing bBoard member upon the 35

appointee immediately following her or his appointment. 36

A person appointed to fill a vacancy shall hold office only until the next regularly scheduled election for 38

governing bBoard members. An election shall be held to fill the vacancy for the remainder of the 39

unexpired term. A person elected at an election to fill the vacancy shall hold office for the remainder of 40

the term in which the vacancy occurs or will occur. 41

The Board of Trustees shall select the Chancellor (See Policy 2431). The Board shall have the final right 7

and responsibility of making this selection, and the selection procedure will be exempt from the usual 8

District personnel selection procedures and practices. 9

In conference with the Chancellor, it is primarily the Board’s business to consider and act upon the 11

following: 12

13

1. Determine the policies of the District. 14

2. Provide its representatives guidelines and parameters for the negotiations process with 15

recognized employee bargaining units. 16

3. Authorize the employment of the staff, upon nomination by the Chancellor. 17

4. Review, revise as needed, and adopt an annual dDistrict budget of expenditures. 18

5. Authorize new projects, and determine what proposed expansions shall be made in the work 19

of the District. Annually review new programs and curriculum offerings, relying primarily on 20

the advice of the respective academic senates. 21

6. Select new college sites, employ architects when needed, and approve plans for new 22

buildings. 23

7. Keep before the public the program of the District and its needs. 24

8. Promote desirable, and seek to prevent undesirable, school legislation. 25

9. Meet regularly, and in special session as necessary, to perform all its duties as prescribed by 26

law and to transact the business of the District. 27

10. Establish a search process to fill the vacancy of college president(s) (See Policy 2431). 28

Members of the Board are expected to attend all meetings, discuss items presented on the agenda, 30

suggest other items for Board consideration, and vote upon motions and resolutions presented. If 31

members expect to be late or absent they are expected to notify the Office of the Chancellor. 32

No individual member or group of members shall exercise any authority outside of a regularly constituted 34

Board meeting, unless directed to do so by the Board. 35

At the annual organizational meeting, which is held in December, the Board shall elect from among its 7

members a Chair and Vice-Chair, and appoint a Secretary/Clerk of the Board. The terms of officers shall 8

be for one year. The Board does not have an official system of rotation of officers; it elects the officers 9

each year from among all its members. 10

The Chair of the Board of Trustees shall preside at all meetings and shall appoint committees unless 13

otherwise directed by the Board of Trustees. He or she shall have the right, as other members, to offer 14

resolutions, to make motions, to discuss questions and to vote thereon. 15

The Chair may call special meetings of the Board of Trustees. 17

The Chair shall sign official dDistrict documents that require the signature of this office. 19

F. Appoint Foundations representatives (CC, MJC, & GVM); and 23

G. Appoint representative to the Valley Insurance Program Joint Powers Authority (VIPJPA). This 25

The Board will act as committee of the whole on all items coming before it. 7

The Board may by action establish committees that it determines are necessary to assist the Board in its 9

responsibilities. Any committee established by bBoard action shall comply with the requirements of the 10

California Public Meetings Brown Act and with these policies regarding open meetings. 11

At the request of the District governing bBoard, the Chair shall appoint temporary committees comprised 13

of less than a quorum of the membership, for special purposes. These committees shall be discharged 14

upon completion of their assignments. Board committees that are composed solely of less than a quorum 15

of members of the Board, and do not have authority that may lawfully be exercised by the Board itself, 16

are not required to comply with the California Public Meetings Brown Act, or with these policies regarding 17

open meetings, unless they are standing committees. 18

Board committees have no authority or power to act on behalf of the Board. 20

Findings or recommendations shall be reported to the Board for consideration. 22

Regular meetings of the Board shall be held on the second Wednesday of each month beginning at 5:30 7

p.m. Regular meetings of the Board shall normally be held in the Board Room of the Yosemite Community 8

College District Office, 2201 Blue Gum Avenue, Modesto, California, with the exception of two meetings 9

per year which will be held at Columbia College. 10

A notice identifying the location, date, and time of each regular meeting of the Board shall be posted 12

at least ten days prior to the meeting and shall remain posted until the day and time of the meeting. 13

All regular meetings of the Board shall be held within the boundaries of the District except in cases 14

where the Board is meeting with another local agency or is meeting with its attorney to discuss pending 15

litigation if the attorney’s office is outside the District. 16

All regular and special meetings of the Board shall be open to the public, be accessible to persons with 18

disabilities, and otherwise comply with Brown Act Pprovisions, except as required or permitted by law. 19

2315 Closed Sessions 5

Closed sessions of the Board shall only be held as permitted by applicable legal provisions including but 6

not limited to the Brown Act, California Government Code and California Education Code. Matters 7

discussed in closed session may include: 8

The appointment, employment, evaluation of performance, discipline or dismissal of a public 9

employee; 10

Charges or complaints brought against a public employee by another person or employee, 11

unless the accused public employee requests that the complaints or charges be heard in an open 12

session. The employee shall be given at least 24 hours written notice of the closed session; 13

Advice of counsel on pending litigation, as defined by law; 14

Consideration of tort liability claims as part of the District’s membership in any joint powers 15

agency formed for purposes of insurance pooling; 16

Real property transactions; 17

Threats to public security; 18

Review of the District’s position regarding labor negotiations and giving instructions to the 19

District’s designated negotiator; 20

Conferring of honorary degrees; 21

Consideration of gifts from a donor who wishes to remain anonymous; 22

To consider its response to a confidential final draft audit report from the Bureau of State 23

The agenda for each regular or special meeting shall contain information regarding whether a closed 26

session will be held and shall identify the topics to be discussed in any closed session in the manner 27

required by law. 28

After any closed session, the Board shall reconvene in open session before adjourning and shall announce 30

any actions taken in closed session and the vote or abstention of every member present, when called for 31

by law. 32

Special meetings may be called by the Chair of the Board or by a majority of the members of the Board. 7

Notice of such meetings shall be posted at least 24 hours before the time of the meeting, and shall be 8

noticed in accordance with the Brown Act requirements. No business other than that included in the 9

notice may be transacted or discussed. 10

Emergency meetings may be called by the Chair of the Board when prompt action is needed because of 12

actual or threatened disruption of public facilities under such circumstances as are permitted by the 13

Brown Act, including work stoppage, crippling disasters, and other activity that severely impairs public 14

health or safety. No closed session shall be conducted during an emergency meeting, except as provided 15

for in the Brown Act to discuss a dire emergency. 16

The Chancellor shall be responsible to ensure that notice of such meetings is provided to the local news 18

media as required by law. 19

Whenever a special meeting of the governing Board is called, the Chancellor shall cause the call and 4

notice to be posted at least 24 hours prior to the meeting in a location freely accessible to the public. 5

The Chancellor shall also ensure that the following notices of the meeting are delivered either 6

personally or by other means: 7

Written notice to each member of the governing Board, including any student trustee(s). 9

10

Written notice to each local newspaper of general circulation, and each radio or television station that 11

has previously requested in writing to be provided notice of special meetings. 12

13

The written notice must be received at least 24 hours before the time of the meeting as set out in the 14

notice. The notice shall specify the time and place of the special meeting and the business to be 15

transacted or discussed. The notice may be waived by members of the governing Board in writing 16

either prior to or at the time of the meeting. 17

Whenever an emergency meeting of the governing Board is called, the Chancellor shall cause notice to 19

be provided by telephone at least one hour prior to the meeting to each local newspaper of general 20

circulation and each radio or television station that has requested notice of special meetings. If 21

telephone services are not functioning, the Chancellor shall provide the newspapers, radio stations and 22

television stations with information regarding the purpose of the meeting and any action taken at the 23

meeting as soon after the meeting as possible. 24

A quorum of the Board shall consist of no less than four members of the Board of Trustees. 7

The Board shall act by majority vote of all of the membership of the Board (no less than four of the seven 9

members), except as otherwise provided by law noted below. 10

No action shall be taken by secret ballot. The Board will publicly report any action taken in open session 12

and the vote or abstention of each individual member present. 13

14

The following actions require a two-thirds majority of all members of the Board (no less than five of the 15

seven members): 16

Resolution of intention to sell or lease real property (except where a unanimous vote is 17

required); 18

Resolution of intention to dedicate or convey an easement; 19

Resolution authorizing and directing the execution and delivery of a deed; 20

Action to declare the District exempt from the approval requirements of a planning commission 21

or other local land use body; 22

Appropriation of funds from an undistributed reserve; 23

Resolution to condemn real property. 24

The following actions require a unanimous vote of all members of the Board: 26

Resolution authorizing a sale or lease of District real property to the state, any county, city, or 27

to any other school or community college district; 28

Resolution authorizing lease of District property under a lease for the production of gas. 29
