3. Facility description

Archer Daniels Midland Co. (ADM or Permittee) owns and operates an oilseed crushing and vegetable oil refining facility (facility) in Red Wing, Minnesota. The facility consists of emission units for oilseed receiving, storage, processing, solvent extraction/recovery, meal processing, oil refining, and steam production. The facility receives various raw oilseeds and processes them in part using hexane to extract vegetable oil. The crude vegetable oil is separated from the hexane and is further refined, stored, loaded and shipped. The remaining solids are processed into meal by de-solventizing, drying, and cooling. The meal is stored prior to shipping to customers for animal feed.

The facility emits particulate matter (PM), particulate matter less than 10 microns in size (PM10), PM less than 2.5 microns in size (PM2.5), volatile organic compounds (VOC), sulfur dioxide (SO2), carbon monoxide (CO), nitrogen oxides (NOx) and hazardous air pollutants (HAPs). PM/PM10/PM2.5 emissions are emitted from the handling and processing of the seeds, the meal system, and the refinery. PM/PM10/PM2.5, SO2, CO, NOx and VOC emissions are emitted from the boilers. Hexane emissions (which are both VOC and HAP emissions) are released from the hexane extraction and recovery systems. The facility is a major source under federal New Source Review (NSR), the federal Operating Permit Program (40 CFR pt. 70), and federal National Emission Standards for Hazardous Air Pollutants (NESHAPs, 40 CFR pt. 63).

Amendment Description

The Permittee will construct a new belt conveyor (EQUI 247), a new rail elevator leg (EQUI 248), two new belt conveyors (EQUIs 249 and 250), and will modify the enclosed drag conveyor (EQUI 246). These changes will increase the railcar loading and conveying capacity to 30,000 bushels per hour (bph). The Permittee’s overall annual throughput will not be affected by these changes and no other downstream units will be affected.

The Permittee is also authorized to construct a fabric filter (TREA 28) to control emissions from STRU 5, and will remove CE 009 which currently controls emissions vented to STRU 5. Flexibility provisions have also been added to the permit which makes existing Title I Conditions applicable to future new or modified control equipment, potentially allowing the Permittee to replace control equipment without a major permit amendment.

This amendment will be issued in two stages. Stage 1 authorizes construction, modification, and operation of the project described by the amendment. Stage 2 of the issuance provides authorization to operate the remainder of the facility. In addition, a previously submitted permit re-opening (DQ 2384) and an administrative amendment (DQ 5033) are also incorporated into this permit action. 5. Limits and other requirements

5.1.1 Compliance Ratio: Volatile Organic Compounds <= 0.90 (no units) for previous 12-month operating period. Where: Compliance Ratio = Actual Solvent Loss/Sum[(Crushi)*(SLFi)]; Actual Solvent Loss = Gallons of actual solvent loss during previous 12 operating months excluding any allowable losses during malfunction periods as defined in the requirement entitled "Malfunction" below; Crushi = tons of each oilseed type "i" processed during the previous 12 operating months; and SLFi = The corresponding solvent loss factor (gal/ton) for oilseed "i" as listed in Table 1 of 40 CFR 63.2840. ADM shall account for solvent loss and quantity of oilseeds processed to comply with the VOC SLR limit immediately upon proposal of the final SLR limit. [CAAA of 1990, Minn. 5.1.2 Malfunctions: ADM may apply the provisions of 40 CFR pt. 63, subp. GGGG pertaining to malfunction periods only when the following two conditions are met: 1) The malfunction results in total plant shutdown. A "total plant shutdown" means a shutdown of the solvent extraction system. 2) Cumulative solvent losses during malfunction periods at a plant do not exceed 4,000 gallons in a 12-month period. At all other times, ADM must include all solvent losses when determining compliance with its VOC SLR limit. During a malfunction period, ADM shall comply with the startup, shutdown and malfunction (SSM) plan as required under Subpart GGGG for the plant. The solvent loss corresponding to a malfunction period will be calculated as the difference in the total solvent inventories for the day before the malfunction period began and the day the plant resumes normal operation. 5.1.3 SLR LIMIT: Compliance with the VOC SLR limit shall be determined in accordance with 40 CFR Part 63, Subpart GGGG with the following exceptions: 1) Provisions pertaining to HAP content shall not apply. 2) Monitoring and recordkeeping of solvent losses shall be conducted daily. 3) Solvent losses and quantities of oilseed produced during startup and shutdown periods shall not be excluded in determining solvent losses.

5.1.5 Daily Grain Throughput Recordkeeping: For each 24-hour period beginning at 7 A.M., the Permittee shall calculate, record, and maintain records of the daily grain accepted by the facility for the previous 24-hour period (7 A.M. - 7 A.M.). 5.1.6 Daily Recordkeeping: On each day of operation, the Permittee shall record, and maintain the total hexane usage. This shall be based on throughput logs, meters, and/or delivery records. 5.1.7 Daily Recordkeeping: On each day of operation, the Permittee shall record, and maintain the total process throughput for each seed type. The Permittee shall record and maintain the records as required by 40 CFR pt. 63, subp. GGGG on quantity of oilseed processed, and defined later in this section. [CAAA of 1990, Minn. 5.1.8 Monthly Recordkeeping and Calculation of Production: By the end of each calendar month, following an operating month, for each seed type calculate and record the throughput for the previous month and the 12-month Rolling Sum. An operating month is any calendar month with at least one normal operating period. It does not include malfunction period. A normal operating period is defined in 40 CFR Section 63.2872. 5.1.10 Annual Compliance Certification: due by July 1 of each calendar year for the 12-month period beginning May 1 and ending April 30. The compliance certification shall include: 1) The name and address of the Permittee; 2) The physical address of the vegetable oil production process; 3) Each listed oilseed type processed during the 12 calendar month period covered by the report; 4) Each HAP identified under 40 CFR 63.2854(a) as being present in concentrations greater than 1 percent by volume in each delivery of solvent received during the 12 calendar month period covered by the report; 5) A statement designating the source as a major source of HAP; and 6) A compliance certification to indicate whether the source was in compliance for each compliance determination made during the 12 calendar month period covered by the report, including: a) A certification that the Permittee is following the procedures described in the plan for demonstrating compliance; and b) A certification that the compliance ratio is less than or equal to 0.90. 5.1.11 These requirements apply if a reasonable possibility (RP) as defined in 40 CFR Section 52.21(r)(6)(vi) exists that a proposed project, analyzed using the actual-to-projected-actual (ATPA) test (either by itself or as part of the hybrid test at Section 52.21(a)(2)(iv)(f)) and found to not be part of a major modification, may result in a significant emissions increase (SEI). If the ATPA test is not used for the project, or if there is no RP that the proposed project could result in a SEI, these requirements do not apply to that project. The Permittee is only subject to the Preconstruction Documentation requirement for a project where a RP occurs only within the meaning of Section 52.21(r)(6)(vi)(b). Even though a particular modification is not subject to New Source Review (NSR), or where there isn't a RP that a proposed project could result in a SEI, a permit amendment, recordkeeping, or notification may still be required by Minn. 5.1.12 Preconstruction Documentation -- Before beginning actual construction on a project, the Permittee shall document the following: 1. Project description 2. Identification of any emission unit whose emissions of an

Pre-change potential emissions of any affected existing emission unit, and the projected post-change potential emissions of any affected existing or new emission unit. 4. A description of the applicability test used to determine that the project is not a major modification for any regulated NSR pollutant, including the baseline actual emissions, the projected actual emissions, the amount of emissions excluded due to increases not associated with the modification and that the emission unit could have accommodated during the baseline period, an explanation of why the amounts were excluded, and any creditable contemporaneous increases and decreases that were considered in the determination. 5.1.13 The Permittee shall monitor the actual emissions of any regulated NSR pollutant that could increase as a result of the project and that were analyzed using the ATPA test, and the potential emissions of any regulated NSR pollutant that could increase as a result of the project and that were analyzed using potential emissions in the hybrid test. The Permittee shall calculate and maintain a record of the sum of the actual and potential (if the hybrid test was used in the analysis) emissions of the regulated pollutant, in tons per year on a calendar year basis, for a period of 5 years following resumption of regular operations after the change, or for a period of 10 years following resumption of regular operations after the change if the project increases the design capacity of or potential to emit of any unit associated with the project. 5.1.14 The Permittee must submit a report to the Agency if the annual summed (actual, plus potential if used in hybrid test) emissions differ from the preconstruction projection and exceed the baseline actual emissions by a significant amount as listed at 40 CFR Section 52.21(b)(23). Such report shall be submitted to the Agency within 60 days after the end of the year in which the exceedances occur. The report shall contain: a. The name and ID number of the Facility, and the name and telephone number of the Facility contact person b. The annual emissions (actual, plus potential if any part of the project was analyzed using the hybrid test) for each pollutant for which the preconstruction projection and significant emissions increase are exceeded. c. Any other information, such as an explanation as to why the summed emissions differ from the preconstruction projection. [Minn. 5.1.16 PERMIT SHIELD: Subject to the limitations in Minn. R. 7007.1800, compliance with the conditions of this permit shall be deemed compliance with the specific provision of the applicable requirement identified in the permit as the basis of each condition. Subject to the limitations of Minn. R. 7007.1800 and 7017.0100, subp. 2, notwithstanding the conditions of this permit specifying compliance practices for applicable requirements, any person (including the Permittee) may also use other credible evidence to establish compliance or noncompliance with applicable requirements. This permit shall not alter or affect the liability of the Permittee for any violation of applicable requirements prior to or at the time of permit issuance. [Minn. R. 7007.1800, (A)(2)]

5.1.17 The Permittee shall comply with National Primary and Secondary Ambient Air Quality Standards, 40 CFR pt. 50, and the Minnesota Ambient Air Quality Standards, Minn. R. 7009.0010 to 7009.0080. 5.1.18 Circumvention: Do not install or use a device or means that conceals or dilutes emissions, which would otherwise violate a federal or state air pollution control rule, without reducing the total amount of pollutant emitted. [Minn. R. 7011.0020]

5.1.19 Operation and Maintenance Plan: Retain at the stationary source an operation and maintenance plan for all air pollution control equipment. At a minimum, the O & M plan shall identify all air pollution control equipment and control practices and shall include a preventative maintenance program for the equipment and practices, a description of (the minimum but not necessarily the only) corrective actions to be taken to restore the equipment and practices to proper operation to meet applicable permit conditions, a description of the employee training program for proper operation and maintenance of the control equipment and practices, and the records kept to demonstrate plan implementation. 5.1.20 Operation Changes: In any shutdown, breakdown, or deviation the Permittee shall immediately take all practical steps to

The Commissioner may require feasible and practical modifications in the operation to reduce emissions of air pollutants. No emissions units that have an unreasonable shutdown or breakdown frequency of process or control equipment shall be permitted to operate. [Minn. R. 7019.1000, subp. 4]

5.1.21 Fugitive Emissions: Do not cause or permit the handling, use, transporting, or storage of any material in a manner which may allow avoidable amounts of particulate matter to become airborne. Comply with all other requirements listed in Minn. R. 7011.0150. [Minn. R. 7011.0150]

5.1.22 Comply with Fugitive Emission Control Plan: The Permittee shall follow the actions and recordkeeping specified in the control plan. The plan may be amended by the Permittee with the Commissioner's approval. If the Commissioner determines the Permittee is out of compliance with Minn. R. 7011.0150 or the fugitive control plan, then the Permittee may be required to amend the control plan and/or to install and operate particulate matter ambient monitors as requested by the Commissioner. 5.1.23 Permittee shall clean up commodities spilled on the driveway and other facility property as required to minimize fugitive emissions to a level consistent with RACT and maintain air pollution control equipment in proper operating condition and utilize the air pollution control systems as designed. Comply with all other requirements listed in Minn. R. 7011.1005. [Minn. R. 7011.1005]

5.1.24 Permittee may not operate or maintain a facility that creates a public nuisance. [Minn. R. 7011.1010]

5.1.25 Permittee must comply with the control requirements listed in Minn. R. 7011.1015. [Minn. R. 7011.1015]

5.1.26 Inspections: The Permittee shall comply with the inspection procedures and requirements as found in Minn. R. 7007.0800, subp. 9(A). [Minn. R. 7007.0800, subp. 9(A)]

5.1.27 Air Pollution Control Equipment: Operate all pollution control equipment whenever the corresponding process equipment and emission units are operated. [Minn. R. 7007.0800, subp. 16(J), Minn. R. 7007.0800, subp. 2]

5.1.28 Noise: The Permittee shall comply with the noise standards set forth in Minn. R. 7030.0010 to 7030.0080 at all times during the operation of any emission units. This is a state only requirement and is not enforceable by the EPA Administrator or citizens under the Clean Air Act. [Minn. R. 7030.0010-7030.0080]

5.1.29 The Permittee shall comply with the General Conditions listed in Minn. R. 7007.0800, subp. 16. [Minn. R. 7007.0800, subp. 16]

MPCA a 30-day notification if the Permittee has to perform a Method 9 test based on periodic visible emission monitoring unless more immediate testing is required by this permit. The Method 9 test shall be conducted a minimum of 1 hour. [Minn. R. 7007.0800, subp. 6]

5.1.31 Monitoring Equipment Calibration - The Permittee shall either: 1. Calibrate or replace required monitoring equipment every 12 months; or 2. Calibrate at the frequency stated in the manufacturer's specifications. For each monitor, the Permittee shall maintain a record of all calibrations, including the date conducted, and any corrective action that resulted. The Permittee shall include the calibration frequencies, procedures, and manufacturer's specifications (if applicable) in the Operations and Maintenance Plan. Any requirements applying to continuous emission monitors are listed separately in this permit. [Minn. R. 7007.0800, subp. 4(D)]

5.1.32 Operation of Monitoring Equipment: Unless noted elsewhere in this permit, monitoring a process or control equipment connected to that process is not necessary during periods when the process is shutdown, or during checks of the monitoring systems, such as calibration checks and zero and span adjustments. If monitoring records are required, they should reflect any such periods of process shutdown or checks of the monitoring system. [Minn. R. 7007.0800, subp. 4(D)]

5.1.33 Visible emissions training: The Permittee shall ensure at all times that at least one plant employee be certified in USEPA Method 9 visible emission evaluation procedures. This person will train other plant employees to perform the daily visible emissions check. [Minn. R. 7007.0800, subp. 4(D)]

5.1.34 The Permittee shall conduct visible emission checks once each operating day. If inclement weather is present, the Permittee shall record the pressure drop. Visible emissions checks are required at STRUs 2, 3, 4, 5, 8, 9, 12, 13, 14, 15, 16, 17, and 18. [Minn. R. 7007.0800, subp. 4(D)]

5.1.35 If visible emissions are observed, the Permittee shall conduct corrective actions to restore 0% opacity. [Minn. R. 7007.0800, subp. 4(D)]

5.1.36 If after exhausting all corrective actions visible emissions remain, the Permittee shall conduct a Method 9 test according to Minnesota rules. [Minn. R. 7007.0800, subp. 4(D)]

5.1.37 Performance Testing: Conduct all performance tests in accordance with Minn. R. ch. 7017 unless otherwise noted in this permit. [Minn. R. ch. 7017]

5.1.38 Performance Test Notifications and Submittals: Performance Tests are due as outlined in this permit.

5.1.39 Limits set as a result of a performance test (conducted before or after permit issuance) apply until superseded as stated in the MPCA's Notice of Compliance letter granting preliminary approval. Preliminary approval is based on formal review of a subsequent performance test on the same unit as specified by Minn. R. 7017.2025, subp. 3. The limit is final upon issuance of a permit amendment incorporating the change. [Minn. R. 7017.2025, subp. 3]

5.1.40 If the Permittee performs a Method 9 test and the results indicate opacity readings at or above the permitted limit, the Permittee shall contact a certified third party to conduct a second Method 9 test. The results of the second Method 9 test shall be submitted to the MPCA. [Minn. R. 7007.0800, subp. 4(D)]

5.1.41 All visible emissions shall be reported on the semiannual deviations report. [Minn. R. 7007.0800, subp. 4(D)]

5.1.42 Recordkeeping: Retain all records at the stationary source, unless otherwise specified within this permit, for a period of five (5) years from the date of monitoring, sample, measurement, or report. Records which must be retained at this location include all calibration and maintenance records, all original recordings for continuous monitoring instrumentation, and copies of all reports required by the permit. Records must conform to the requirements listed in Minn. R. 7007.0800, subp. 5(A). [Minn. R. 7007.0800, subp. 5(C)]

5.1.43 Recordkeeping: Maintain records describing any insignificant modifications (as required by Minn. R. 7007.1250, subp. 3) or changes contravening permit terms (as required by Minn. R. 7007.1350, subp. 2), including records of the emissions resulting from those changes. [Minn. R. 7007.0800, subp. 5(B)]

5.1.44 If the Permittee determines that no permit amendment or notification is required prior to making a change, the Permittee must retain records of all calculations required under Minn. R. 7007.1200. These records shall be kept for a period of five

5.1.45 Shutdown Notifications: Notify the Commissioner at least 24 hours in advance of a planned shutdown of any control equipment or process equipment if the shutdown would cause any increase in the emissions of any regulated air pollutant. If the Permittee does not have advance knowledge of the shutdown, notification shall be made to the Commissioner as soon as possible after the shutdown. However, notification is not required in the circumstances outlined in Items A, B and C of Minn. R. 7019.1000, subp. 3. At the time of notification, the Permittee shall inform the Commissioner of the cause of the shutdown and the estimated duration. The Permittee shall notify the Commissioner when the shutdown is over. [Minn. R. 7019.1000, subp. 3]

5.1.46 Breakdown Notifications: Notify the Commissioner within 24 hours of a breakdown of more than one-hour duration of any control equipment or process equipment if the breakdown causes any increase in the emissions of any regulated air pollutant. The 24-hour time period starts when the breakdown was discovered or reasonably should have been discovered by the Permittee. However, notification is not required in the circumstances outlined in Items A, B and C of Minn. R. 7019.1000, subp. 2. At the time of notification or as soon as possible thereafter, the Permittee shall inform the Commissioner of the cause of the breakdown and the estimated duration. The Permittee shall notify the Commissioner when the breakdown is over. [Minn. R. 7019.1000, subp. 2]

5.1.47 Notification of Deviations Endangering Human Health or the Environment: As soon as possible after discovery, notify the Commissioner or the state duty officer, either orally or by facsimile, of any deviation from permit conditions which could endanger human health or the environment. [Minn. R. 7019.1000, subp. 1]

5.1.48 Notification of Deviations Endangering Human Health or the Environment Report: Within 2 working days of discovery, notify the Commissioner in writing of any deviation from permit conditions which could endanger human health or the environment. Include the following information in this written

5.1.49 Application for Permit Amendment: If a permit amendment is needed, submit an application in accordance with the requirements of Minn. R. 7007.1150 through Minn. R. 7007.1500. Submittal dates vary, depending on the type of amendment needed. Upon adoption of a new or amended federal applicable requirement, and if there are more than 3 years remaining in the permit term, the Permittee shall file an application for an amendment within nine months of promulgation of the applicable requirement, pursuant to Minn. R. 7007.0400, subp. 3. [Minn. R. 7007.0400, subp. 3, Minn. R. 7007.1150 - 7007.1500]

5.1.50 Extension Requests: The Permittee may apply for an Administrative Amendment to extend a deadline in a permit by no more than 120 days, provided the proposed deadline extension meets the requirements of Minn. R. 7007.1400, subp. 1(H). Performance testing deadlines from the General Provisions of 40 CFR pt. 60 and pt. 63 are examples of deadlines for which the MPCA does not have authority to grant extensions and therefore do not meet the requirements of Minn. 5.1.51 Emission Inventory Report: due on or before April 1 of each calendar year following permit issuance, to be submitted on a form approved by the Commissioner. [Minn. R. 7019.3000-7019.3100]

5.1.64 Plan for Startup, Shutdown, and Malfunction (SSM): The Permittee shall develop and implement a written SSM plan. At a minimum, this plan is to include: 1. a detailed procedure for operating and maintain the facility to minimize emissions during any SSM event, periods of non-operation associated with a SSM event, and periods of initial startup operation; and 2. a specified program of corrective action for malfunctioning process and air pollution control equipment; and 3) specified procedures for estimating solvent loss during each such SSM event. 5.1.67 Recording - Average HAP Content: By the end of each calendar month following an operating month, record the following information for the average HAP content in the extraction solvent, for the previous operating month: 1. The gallons of extraction solvent received in each delivery; 2. The volume fraction of each HAP exceeding 1 percent by volume in each delivery of extraction solvent, and 3. The weighted average volume fraction of HAP in extraction solvent received since the end of the last operating month as determined in 40 CFR Section 63.2854 (b)(2). [40 CFR 63.2862(c)(2)]

5.1.68 Recording - Seed Processed Weight: At a minimum record the following: 1. The dates that define each operating status period. These dates must be the same as the dates entered for the extraction solvent inventory; 2. On the log for each type of listed oilseed that is not being processed during a normal operating period, you must record which type of listed oilseed is being processed in addition to the source operating status; 3. 5.1.73 Recordkeeping of compliance status: By the end of each calendar month following an operating month, you must record a statement of whether the source is in compliance with all of the requirements of subpart GGGG. 5.1.74 Recordkeeping of each SSM event: For each SSM event subject to a malfunction period, you must record the following by the end of the calendar month following each month in which a malfunction period occurred: 1. A description and date of the SSM event, its duration, and reason it qualifies as a malfunction; 2. An estimate of the solvent loss in gallons for the duration of the malfunction period with supporting document; and 3. A checklist or other mechanism to indicate whether the SSM plan was followed during the malfunction period. [40 CFR 63.2862(e)]

5.1.75 Notification of Deviation Report: The deviation notification report must be submitted for each operating month, in which the compliance ratio exceeds 1.00. The report must be submitted by the end of the month following the calendar month in which the deviation occurred. This report must include the compliance ratio comprising the deviation. (1) The name and address of the Permittee; (2) The physical address of the vegetable oil production process; (3) Each listed oilseed type processed during the 12 operating

5.1.76 Periodic SSM Report: By the end of the calendar month, submit a periodic startup, shutdown or malfunction (SSM) report for the previous month during which the source has been operated under an initial startup period or a malfunction period. The name, title, and signature of the source's responsible official who is certifying that the report accurately states that all actions taken during the initial startup or malfunction period were consistent with the SSM plan; 2. A description of events occurring during the time period, the date and duration of the events, and reason the time interval qualifies as an initial startup or malfunction period; 3. 5.1.77 Immediate SSM Reports: Within 2 working days after commencing actions inconsistent with the SSM plan, submit an immediate SSM report consisting of a telephone call or facsimile transmission followed by a letter within 7 working days of the event. The SSM report must include the following: 1. The name, title, and signature of the source's responsible official who is certifying the accuracy of the report, an explanation of the event, and the reasons for not following the SSM Plan; 2. A description and date of the SSM event, its duration, and reason it qualifies as a SSM; and 3. An estimate of the solvent loss for the duration of the SSM event with supporting documentation. 5.1.78 The records kept on-site by the Permittee are subject to the following: (a) Your records must be in a form suitable and readily available for review in accordance with 40 CFR Section 63.10(b)(1); (b) As specified in40 CFR Section 63.10(b)(1), you must keep each record for 5 years following the date of each occurrence, measurement, maintenance, corrective action, report or record; and (c) You must keep each record on-site for at least 2 years after the date of each occurrence, measurement, maintenance, corrective action, report, or record, in accordance with 40 CFR Section 3.10(b)(1). The new range shall be implemented upon receipt of the Notice of Compliance letter granting preliminary approval. The range is final upon issuance of a permit amendment incorporating the change. If the recorded pressure drop reading is outside the required range, the emissions during that time shall be considered uncontrolled until the pressure drop reading is once again within the required range. Emission units venting to STRU 4, 5, and 13, and River Bin 17 and 18 (EQUI 252 and 253) must vent emissions to a fabric filter that meets the requirements of COMG 1 fabric filters (TREAs 14, 15, 16, 20 and 28). 5.2.7 [Stage 1] The Permittee shall vent emissions from EQUI 252, EQUI 253, and any emission units that vent to STRU 4, STRU 5 or STRU 13 to a fabric filter that meets the requirements of COMG 1 whenever EQUI 252, EQUI 253 and any emission unit that vents to STRU 4, STRU 5, or STRU 13 operates. The Permittee shall operate and maintain a fabric filter that meets the requirements of COMG 1 at all times that any emissions vent to it. The Permittee shall document periods of non-operation of the control equipment whenever the process equipment is operating. 5.2.8 [Stage 1] If the Permittee replaces TREA 14, TREA 15, TREA 16, TREA 20, or TREA 29, the replacement control must meet or exceed the control efficiency requirements listed in COMG 1 as well as comply with all other requirements of COMG 1. Additionally, the Permittee shall do the following: 1) If the Permittee replaces TREA 20, the Permittee shall submit a notification of the date of initial startup to the Agency; 2) If the Permittee replaces TREA 20, the replacement control is subject to testing requirements under STRU 13, in sections 5 and 6 of this permit; 3) The Permittee is authorized by this permit action to replace TREA 29 with TREA 28. The replacement control is subject to testing requirements under STRU 5, in sections 5 and 6 of this permit; 4) If the Permittee replaces TREA 28, the Permittee shall submit a notification of the date of initial startup to the Agency; and 5) If the Permittee replaces TREA 28, the replacement control is subject to testing requirements under STRU 5, in sections 5 and 6 of this permit. Prior to making such a change, the Permittee shall apply for and obtain the appropriate permit amendment following Minn. R. 7007.1150-7007.1500, as applicable. If no amendment is needed for the replacement, the Permittee shall

5.2.10 Recordkeeping of Pressure Drop: Once each 24-hour period, the Permittee shall record the time and date of each pressure drop reading and whether or not the observed pressure drop was within the range specified in this permit. The presence of visible emissions or recorded values outside the range specified in this permit are considered deviations as defined by Minn. R. 7007.0100, subp. 8a. [Minn. R. 7007.0800, subps. 4-5]

5.2.11 Corrective Actions: The Permittee shall take corrective action as soon as possible if any of the following occur: - visible emissions are observed; - the recorded pressure drop is outside the required operating range; or - the fabric filter or any of its components are found during the inspections to need repair. Corrective actions shall return the pressure drop to within the permitted range, eliminate visible emissions, and/or include completion of necessary repairs identified during the inspection, as applicable. Corrective actions include, but are not limited to, those outlined in the O & M Plan for the fabric filter. 5.2.12 Monitoring Equipment: The Permittee shall install and maintain the necessary monitoring equipment for measuring and recording pressure drop as required by this permit. The monitoring equipment must be installed, in use, and properly maintained when the monitored fabric filter is in operation. [Minn. R. 7007.0800, subp. 4]

5.2.13 Periodic Inspections: At least once per calendar quarter, or more frequently as required by the manufacturing specifications, the Permittee shall inspect the control equipment components. If inspection frequency is based upon manufacturer's specifications, the manufacturer specifications supporting the frequency must be included in the Operation and Maintenance plan. The Permittee shall document periods of non-operation of TREAs 13, 19, 21, and 30 whenever the process equipment is operating. The act of entering into a contractual agreement with a supplier of natural gas established for curtailment purposes does not constitute a reason that is under the control of a facility for the purposes of this definition. 5.5.6 The Permittee shall keep records of the total hours per calendar year that fuel oil #2 is burned and the total hours per calendar year that EQUI 76 is operated during periods of gas curtailment or gas supply emergencies. At units where entry into a piece of process equipment or into a storage vessel is required to complete the tune-up inspections, inspections are required only during planned entries into the storage vessel or process equipment; (ii) Inspect the flame pattern, as applicable, and adjust the burner as necessary to optimize the flame pattern. The adjustment should be consistent with the manufacturer's specifications, if available; (iii) Inspect the system controlling the air-to-fuel ratio, as applicable, and ensure that it is correctly calibrated and functioning properly (the Permittee may delay the inspection until the next scheduled unit shutdown). (iv) Optimize total emissions of CO. This optimization should be consistent with the manufacturer's specifications, if available, and with any NOx requirement to which the unit is subject; (v) Measure the concentrations in the effluent stream of CO in parts per million, by volume, and oxygen in volume percent, before and after the adjustments are made (measurements may be either on a dry or wet basis, as long as it is the same basis before and after the adjustments are made). Average throughput is defined as the average of the operating throughput rates recorded during the required number of test runs. 1) If the Permittee test results are less than or equal to 80% of all STRU 3 emission limits, and the test is conducted at greater than or equal to 90% of the short-term process throughput limit identified in STRU 3, the short-term process throughput limit may be reset to increased by 110% of the measured average throughput rate measured during the test runs, up to a maximum of 171 tons/hr. 2) If the test is conducted at less than 90% of the process throughput limit identified in STRU 3, the short-term process throughput limit will be reset to the average throughput rate measured during testing. 5.20.5 The Permittee shall limit Short-Term Process Throughput <= 128.2 tons per hour 3-hour average of grain received unless a new limit is set pursuant to Minn. R. 7017.2025, subp. 3 based on the average throughput recorded during the most recent MPCA-approved performance tests where compliance was demonstrated for all pollutants. Average throughput is defined as the average of the operating throughput rates recorded during the required number of test runs. 1) If the Permittee test results are less than or equal to 80% of all STRU 5 emission limits, and the test is conducted at greater than or equal to 90% of the short-term process throughput limit identified in STRU 5, the short-term process throughput limit may be reset to increase by 110% of the measured average throughput rate measured during the test runs, up to a maximum of 128.2 tons/hr. 2) If the test is conducted at less than 90% of the process throughput limit identified in STRU 5, the short-term process throughput limit will be reset to the average throughput rate measured during testing. Changes in the process throughput limit shall be implemented upon receipt of the Notice of Compliance letter granting preliminary approval. The limit is final upon issuance of a permit amendment incorporating the change. This operating parameter must remain in the permit to define the maximum capacity of the process on an hourly basis, as well as to reflect process throughput rates established during performance testing. The Permittee shall maintain at the facility adequate records to demonstrate continuous compliance with these operating condition limitations. [Minn. 5.31.11 Visible Emissions: The Permittee shall check the fabric filter stack for any visible emissions once each day of operation during daylight hours. During inclement weather, the Permittee shall read and record the pressure drop across the fabric filter, once each day of operation. [Minn. R. 7007.0800, subps. 4-5]

5.31.12 The Permittee shall operate and maintain the fabric filter in accordance with the Operation and Maintenance (O & M) Plan. The Permittee shall keep copies of the O & M Plan available onsite for use by staff and MPCA staff. [Minn. R. 7007.0800, subp. 14]

5.31.13 Corrective Actions: The Permittee shall take corrective action as soon as possible if any of the following occur: - visible emissions are observed; - the recorded pressure drop is outside the required operating range; or - the fabric filter or any of its components are found during the inspections to need repair. Corrective actions shall return the pressure drop to within the permitted range, eliminate visible emissions, and/or include completion of necessary repairs identified during the inspection, as applicable. Corrective actions include, but are not limited to, those outlined in the O & M Plan for the fabric filter. 5.31.14 Monitoring Equipment: The Permittee shall install and maintain the necessary monitoring equipment for measuring and recording pressure drop as required by this permit. The monitoring equipment must be installed, in use, and properly maintained when the monitored fabric filter is in operation. [Minn. R. 7007.0800, subp. 4]

5.31.15 Periodic Inspections: At least once per calendar quarter, or more frequently as required by the manufacturing specifications, the Permittee shall inspect the control equipment components. 5.31.16 Annual Hood Evaluation: The Permittee shall measure and record at least once every 12 months the fan rotation speed, fan power draw, or face velocity of each hood, or other comparable air flow parameter that was measured during the most recent hood certification to verify each hood design and operation parameters meet or exceed the parameters measured during the most recent hood evaluation conducted according to Minn. R. 7011.0072, subps. 2 & 3 as required by Minn. R. 7011.0072, subp. 4. The Permittee shall maintain a copy of the annual evaluations on site for 5 years. [Minn. R.

Corrective actions shall return the pressure drop to within the permitted range, eliminate visible emissions, and/or include completion of necessary repairs identified during the inspection, as applicable. 6.1.3 The Permittee shall submit a compliance certification: Due annually, by the 31st of January (for the previous calendar year). 6.1.6 The Permittee shall submit a report: Due 180 calendar days after Permit Issuance Date. The report shall contain a process flow diagram (PFD) that identifies the flow of material and air emissions with sufficient specificity to identify all applicable requirements and application of emission factors. All subject items must be identified using the Tempo convention (EQUI/STRU/TREA numbers) defined in the current permit. In addition, the Permittee shall certify the report by using MPCA form SCP-01. The report shall contain updates to the calculations that address the following: 1) Identify all emission units and emission points; 2) Include calculations for PM2.5 emissions; 3) Provide basis of emission factors and control efficiencies; 4) Based on updated PTE calculations, identify controls which are subject to CAM; and 5) Ensure that the updated calculations demonstrate that major source thresholds for PSD were not exceeded in the analysis for Air Permit 04900001-101.
