Definitions - 1 (KY)
AGREEMENT
In return for payment of the premium and subject to all
the terms of this policy, we agree with you as follows:
DEFINITIONS
The terms defined below have the following meaning
when they appear in bold type throughout this policy,
whether in the singular, plural or possessive:
A. "You" and "Your" refer to the named insured,
which includes all individuals named on the Decla-
rations Page, and that person's spouse if a resi-
dent of the same household.
If the spouse ceases to be a resident of the same
household during the policy period or prior to the
inception of this policy, the spouse will be consid-
ered "you" and "your" under this policy but only
until the earlier of:
1. The end of 90 days following the spouse's
change of residency;
2. The effective date of another policy listing the
spouse as a named insured; or
3. The end of the policy period.
B. "We", "us" and "our" refer to Grange Property &
Casualty Insurance Company.
C. "Bodily injury" means bodily harm, sickness or
disease, including death resulting therefrom.
D. "Business" includes trade, profession, or
occupation.
E. "Family member" means a person related to you
by blood, marriage or adoption and whose principal
residence is at the location shown on the Declara-
tions Page.
F. "Occupying" means in, upon, getting in, on, out or
off.
G. "Owned" and "Own" mean the person:
1. Has legal title;
2. Has possession under a written lease agree-
ment for a continuous period of at least 6
months; or
3. Has possession subject to a lien or security
agreement.
H. "Property damage" means physical injury to, de-
struction of, or loss of use of tangible property.
I. "Trailer" means a vehicle designed to be pulled by
a:
1. Private passenger auto; or
2. Pickup or van.
It also means a farm wagon or farm implement
while towed by a vehicle listed in 1. or 2.
above.
J. "Your covered auto" means:
1. Any vehicle shown on the Declarations Page.
2. Any of the following types of vehicles, acquired
during the policy period, on the date you be-
come the owner:
a. a private passenger auto; or
b. a pickup or van for which no other insur-
ance provides coverage and that has a
Gross Vehicle Weight of less than 12,000
lbs. according to the manufacturer's
specifications.
If the vehicle you acquire replaces one shown on
the Declarations Page, you must ask us to insure
that replacement vehicle within 30 days after you
become the owner. Until you notify us, within that
30 day period, the replacement vehicle will have
the same coverage as the vehicle it replaced.
If the vehicle you acquire is in addition to any
shown on the Declarations Page, you must ask us
to insure that additional vehicle within 30 days after
you become the owner. Until you notify us, within
that 30 day period, the additional vehicle will have
the broadest coverage limits we now provide for
any vehicle shown on the Declarations Page.
Changes to the policy resulting from additional or
replacement vehicles, which you ask us to insure
within 30 days of becoming the owner, will be
made effective on the date you became the
owner.
Changes to the policy resulting from additional or
replacement vehicles, which you ask us to insure
on or after 30 days of becoming the owner, will be
effective on the date you first notify us.
3. Any trailer you own.

4. Any auto or trailer you do not own that is
not in excess of 12,000 lbs. Gross Vehicle

e. destruction.

PART A - LIABILITY COVERAGE
Insuring Agreement
A. Subject to the limit of liability, if you pay the
premium when due, we will pay compensatory
damages for bodily injury or property damage
for which any insured becomes legally responsible
because of an auto accident. Damages include
pre-judgment interest awarded against the
insured. We will settle or defend, as we consider
appropriate, any claim or suit asking for these
damages. In addition to our limit of liability, we pay
all defense costs we incur. We reserve the right to
recover from any party to whom we have provided
a defense, any defense costs incurred by us
should a court of competent jurisdiction conclude
that we had no duty to provide a defense to that
party. Our duty to settle or defend ends when our
limit of liability for this coverage has been
exhausted by payment of judgment or settlements.
We have no duty to defend any suit or settle any
claim for bodily injury or property damage not
covered under this policy.
B. "Insured" as used in this part means:
1. You or any family member for the ownership,
maintenance or use of any auto or trailer.
2. Any person using your covered auto.
3. For any auto or trailer, other than your
covered auto, any person or organization but
only with respect to legal responsibility for acts
or omissions of you or any family member for
whom coverage is afforded under this Part.
This provision (B.3.) applies only if the person
or organization does not own or hire the auto
or trailer.
However, "insured" as used in this Part does not
include the following:
1. The United States of America or any of its
agencies.
2. Any person with respect to bodily injury or
property damage resulting from the operation
of an auto by that person while acting within
the scope of their office or employment of the
United States Government as an employee.
This applies only if the provisions of Section
2679 of Title 28, United States Code as
amended, require the Attorney General of the
United States to defend that person in any civil
action which may be brought for the bodily
injury or property damage.
Supplementary Payments
In addition to our limit of liability, at our insured's
request, we will pay on behalf of an insured:
1. Up to $500 for the cost of bail bonds required
because of an accident, including related
traffic law violations. The accident must result
in bodily injury or property damage covered
under this policy. We are not required to apply
for or furnish these bonds.
2. Premiums on appeal bonds and bonds to
release attachments in any suit we defend,
provided such bonds shall not exceed our limit
of liability. We are not required to apply for or
furnish these bonds.
3. Interest accruing after a judgment is entered in
any suit we defend. Our duty to pay interest
ends when we offer to pay that part of the
judgment which does not exceed our limit of
liability for this coverage.
4. All reasonable expenses incurred by the
insured at our request to assist us in the
investigation or defense of a lawsuit, including
actual loss of earnings up to $200 a day
because of time off from work for attendance
at hearings or trials.
5. Other reasonable expenses incurred at our
request.
Exclusions
A. We do not provide Liability Coverage for any
person:
1. Who intentionally causes or directs another to
cause the bodily injury or property damage.
2. For property damage to property owned or
being transported by that person.
3. For property damage to property:
a. rented to;
b. used by; or

c. in the care of that person.
This exclusion (A.3.) does not apply to
property damage to a residence or private
garage.
4. For bodily injury to an employee of that
person during the course of employment. This
exclusion (A.4.) does not apply to bodily
injury to a domestic employee unless workers'
compensation benefits are required or
available for that domestic employee.
5. For that person's liability arising out of the
ownership or operation of a vehicle while it is
being used to carry persons or property for
compensation or a fee, or otherwise available
for hire. This exclusion (A.5.) does not apply to
a share-the-expense car pool.
6. While employed or otherwise engaged in the
business of:
a. selling;
b. repairing;
c. servicing;
d. storing;
e. parking; or
f. washing;
vehicles designed for use mainly on public
highways. This includes road testing and
delivery. This exclusion (A.6.) does not apply
to the ownership, maintenance or use of your
covered auto by;
a. you;
b. any family member; or
c. any partner, agent or employee of you or
any family member.
7. Maintaining or using any vehicle while that
person is employed or otherwise engaged in
any business (other than farming or ranching)
not described in Exclusion A.6. This exclusion
(A.7.) does not apply to the maintenance or
use of a:
a. private passenger auto;
b. pickup or van that you own; or
c. trailer used with a vehicle described in
(a.).
8. Using a vehicle without a reasonable belief
that that person is entitled to do so. This
exclusion (A.8.) does not apply to a family
member using your covered auto which is
owned by you.
9. For bodily injury or property damage for
which that person:
a. is an insured under a nuclear energy
liability policy; or
b. would be an insured under a nuclear
energy liability policy but for its termination
upon exhaustion of its limit of liability.
A nuclear energy liability policy is a policy
issued by any of the following or their
successors:
a. Nuclear Energy Liability Insurance
Association;
b. Mutual Atomic Energy Liability
Underwriters; or
c. Nuclear Insurance Association of Canada.
10. For bodily injury or property damage caused
by your covered auto when it is driven,
operated or used with your permission by a
person other than a family member whom you
know:
a. is under the minimum age to obtain a
driver's license;
b. does not have a valid driver's license;
c. has a suspended driver's license;
d. has a revoked driver's license; or

e. has a restricted driver's license and is
operating a vehicle beyond the scope of
such restriction.
This exclusion (A.10.) does not apply when it
is not required for a person to obtain a driver's
license to operate your covered auto.
11. For bodily injury or property damage caused
by, or reasonably expected to result from, a
criminal act or omission of an insured. This
exclusion applies regardless of whether that
insured is actually charged with, or convicted
of, a crime. For purposes of this exclusion,
criminal acts or omissions do not include traffic
violations.
12. For any liability assumed under any contract or
agreement by you or a family member.
B. We do not provide Liability Coverage for the
ownership, maintenance, or use of:
1. Any motorized vehicle having fewer than four
wheels or designed mainly for use off public
roads. However, this exclusion (B.1.) does not
apply to any insured using:
a. any trailer; or
b. any non-owned golf cart.
2. Any vehicle, other than your covered auto,
which is:
a. owned by you; or
b. furnished or available for your regular use.
3. Any vehicle, other than your covered auto,
which is;
a. owned by any family member; or
b. furnished or available for the regular use
of any family member.
However, this exclusion (B.3.) does not apply
to you while you are maintaining or
occupying any vehicle which is:
a. owned by a family member; or
b. furnished or available for the regular use
of a family member.
4. Any vehicle, for the purpose of:
a. competing in; or
b. practicing or preparing for;
any prearranged or organized racing, or
involvement in any hill climb, demolition,
stunting or speed contest.
5. Any vehicle, other than your covered auto,
which:
a. is not of the private passenger auto,
pickup body, or cargo van type: and
b. has a Gross Vehicle Weight of 12,000 lbs.
or more according to the manufacturer's
specifications.
C. Even if excluded in the policy the following items
will be covered for persons insured by the policy to
the extent of the minimum required tort liability and
basic reparation benefits insurance required by
KRS Chapter 304.39:
1. Intentional acts.
2. Punitive damages to the extent that the total
amount for compensatory and punitive
damages combined does not exceed the per
person or per occurrence liability limits of the
policy.
3. Use of the automobile described in the policy
by anyone when the automobile is used in an
automobile business owned by the insured.
4. Damage to the environment or damage
caused by nuclear materials.
5. Use of the automobile described in the policy
to carry persons for hire.
6. Damage to the property of others in the care,
custody, and control of the insured for which
the insured might be found legally liable.

7. Use of the automobile by an employee of the
United States Government in the course of
duty.
8. Business use of the automobile described in
the policy when this use is within uses
acceptable in the insurer's underwriting
guidelines for private passenger automobiles.
Limit of Liability
A. The limit of liability shown on the Declarations
Page for "each person" for Bodily Injury Liability is
our maximum limit of liability for all damages due
to a bodily injury, including damages for care,
loss of services, loss of consortium, loss of
companionship or death, arising out of bodily
injury sustained by any one person in any one
auto accident. Subject to this limit for "each
person", the limit of liability shown on the
Declarations Page for "each accident" for Bodily
Injury Liability is our maximum limit of liability
under this coverage for all damages for bodily
injury resulting from any one accident. The limit of
liability shown on the Declarations Page for "each
accident" for Property Damage Liability is our
maximum limit of liability under this coverage for all
property damage resulting from any one auto
accident.
These limits are the most we will pay regardless of
the number of:
1. Insureds;
2. Claimants or injured persons;
3. Claims made;
4. Vehicles or premiums shown on the
Declarations Page; or
5. Vehicles involved in the auto accident.
B. We will apply the limit of liability to provide any
separate limits required by law for bodily injury
and property damage liability. However, this
provision (B.) will not change our total limit of
liability.
C. No one will be entitled to receive duplicate
payments under this policy for the same elements
of damages.
D. To the extent that the limits of liability for this
coverage exceed the limits of liability required by
the Kentucky Motor Vehicle Reparations Act,
damages payable under this coverage are
compensatory damages; they do not include
punitive or exemplary damages.
Out of State Coverage
If an auto accident to which this policy applies occurs
in any state or province other than the one in which
your covered auto is principally garaged, we will
interpret the bodily injury liability and property
damage liability coverage of your policy for that
accident as follows:
A. If the state or province has:
1. A financial responsibility or similar law
requiring limits of liability for bodily injury or
property damage higher than the Liability
Coverage limit shown on the Declarations
Page, your policy will provide the higher
specified limit.
2. A compulsory bodily injury liability or
property damage liability insurance or similar
law requiring a nonresident to maintain liability
insurance whenever the nonresident uses a
vehicle in that state or province, your policy
will provide at least the required minimum
amounts of bodily injury or property damage
liability coverages.
B. No one will be entitled to duplicate payments for
the same elements of loss.
Financial Responsibility
When this policy is certified as future proof of financial
responsibility, this policy shall comply with the law to
the extent required.
Other Insurance
If there is other applicable liability insurance we will pay
only our share of the loss. Our share is the proportion
that our limit of liability bears to the total of all
applicable limits.
Any insurance we provide for a vehicle you do not
own, including any vehicle while used as a temporary
substitute for your covered auto, shall be excess over
any other collectible insurance or self-insurance
whether primary, excess or contingent. However, any

insurance we provide for a vehicle you do not own
shall be primary if:
1. Such vehicle is loaned by a person, firm or
corporation engaged in the business of selling,

because of its breakdown, repair or servicing, and
3. The bodily injury or property damage results
from an auto accident caused by the negligence of
you or any family member.

PART B - MEDICAL PAYMENTS COVERAGE
Insuring Agreement
A. Part B - Medical Payments Coverage is provided
where a premium is shown on the Declarations
Page for the vehicle and coverage. Subject to the
Limits of Liability shown on the Declarations Page
for Part B - Medical Payments Coverage, if you
pay the premium when due, we will pay reason-
able expenses incurred by the insured for neces-
sary medical and funeral services because of
bodily injury:
1. Caused by an auto accident; and
2. Sustained by an insured.
We pay only those expenses incurred within 1 year
from the date of the accident.
B. We have the right to utilize outside sources,
vendors, experts, consultants and software tools of
our choosing to review the medical expense invoi-
ces and medical treatment records to assist us in
determining, among other things, if the expenses
and treatment are reasonable and necessary.
C. "Insured" as used in this Part B - Medical Pay-
ments Coverage means:
1. You or any family member:
a. while occupying; or
b. as a pedestrian when struck by;
a motor vehicle designed for use mainly on
public roads or a trailer of any type.
2. Any other person while occupying your cov-
ered auto.
D. "Reasonable" as used in this Part, means ex-
penses that are consistent with the usual charges
of the majority of similar medical providers in the
geographic area in which the expenses were in-
curred for the specific medical service.
E. "Necessary" as used in this Part, means services
that are rendered by a medical provider within the
legally authorized scope of the provider's practice
and are recognized within that practice as being
appropriate treatment in achieving maximum medi-
cal improvement for the bodily injury sustained in
the accident.
Exclusions
We do not provide any coverage under this Part B -
Medical Payments Coverage for any insured for bod-
ily injury:
1. Sustained while occupying any vehicle having
fewer than four wheels.
2. Sustained while occupying your covered
auto when it is being used to carry persons or
property for compensation or a fee, or other-
wise available for hire. This exclusion (2.) does
not apply to your covered auto under this
Part B - Medical Payments Coverage while
used in a share-the- expense car pool.
3. Sustained while occupying any vehicle being
used as a residence or premises.
4. Occurring during the course of employment if
benefits are payable, required to be provided,
or available for the bodily injury under a
workers' compensation or disability benefits
law or any similar law.
5. Sustained while occupying, or when struck
by, any vehicle (other than your covered
auto) which is:
a. owned by you; or
b. furnished or available for your regular use.
6. Sustained while occupying, or when struck
by, any vehicle other than your covered auto
which is:
a. owned by any family member; or
b. furnished or available for the regular use
of any family member.
However, this exclusion (6.) does not apply to
you.
7. Sustained while occupying a vehicle other
than your covered auto without the express
or implied permission of the owner, or if the
use exceeds the scope of that permission.

8. Sustained by someone other than you or a
family member while occupying your cov-
ered auto without express or implied permis-
sion from you or a family member, or if the
use exceeds the scope of that permission.
9. Sustained while occupying a vehicle when it
is being used in the business of an insured.
This exclusion (8.) does not apply to bodily
injury sustained while occupying a:
a. private passenger auto;
b. pickup or van; or
c. trailer used with a vehicle described in a.
or b. above.
10. Caused by or as a consequence of:
a. discharge of nuclear device (even if
accidental);
b. war (declared or undeclared);
c. civil war;
d. insurrection; or
e. rebellion or revolution.
11. From or as a consequence of the following,
whether controlled or uncontrolled, or however
caused:
a. nuclear reaction;
b. radiation; or
c. radioactive contamination.
12. From or as a consequence of fungus, mold,
mildew or spores, regardless of the factors
causing or contributing to its growth.
13. Sustained while occupying any vehicle, for
the purpose of:
a. participating in; or
b. practicing or preparing for;
any prearranged, organized or spontaneous
race, speed, hill climb, demolition, or stunting
activity.
14. Sustained while occupying any vehicle being
operated on a driving track in a facility de-
signed for racing vehicles.
15. Caused by, or reasonably expected to result
from, a criminal act or omission of an insured.
This exclusion applies regardless of whether
that insured is actually charged with, or con-
victed of, a crime. For purposes of this
exclusion, criminal acts or omissions do not
include traffic violations.
16. Sustained out of the ownership, maintenance
or use of any vehicle while rented, loaned or
leased to others or given in exchange for any
compensation by an insured.
17. Intentionally caused by an insured, or at the
direction of an insured, even if the actual in-
jury or damage is different than that which was
intended or expected.
18. Sustained out of an accident involving a ve-
hicle while being maintained or used by an
insured while engaged in any auto business
operations, but this exclusion (A. 18.) does not
apply to the ownership, maintenance or use of
your covered auto in auto business opera-
tions by you, a family member, or any
partner, agent or employee of you or a family
member.
19. Caused by or arising from the transmission of
a sexually transmitted disease by an insured.
20. Caused by or arising out of the involvement of
an insured in sexual molestation or any sex-
ual activity, corporal punishment, physical or
mental abuse, harassment, including sexual
harassment, whether actual, alleged or
threatened.
21. Caused by or arising out of the use, sale,
manufacture, delivery, transfer or possession
by any person of a Controlled Substance(s) as
defined by the Federal Food and Drug Law at
21 U.S.C.A. Sections 811 and 812. Controlled
Substances include but are not limited to
cocaine, LSD, marijuana and all narcotic
drugs. However, this exclusion does not apply
to the legitimate use of prescription drugs by a

person following the orders of a licensed
physician.
22. Sustained while occupying or using a motor-
cycle or recreational motor vehicle. Recrea-
tional motor vehicle means any land motor
vehicle designed for recreational use off public
roads.
Limit of Liability
A. The limit of liability shown on the Declarations
Page for this coverage is our maximum limit of
liability for each person injured in any one accident.
This is the most we will pay regardless of the num-
ber of:
1. Insureds;
2. Claims made;
3. Vehicles or premiums shown on the Declara-
tions Page; or
4. Vehicles involved in the accident.
B. We will pay under Part B - Medical Payments
Coverage, the lesser of:
1. reasonable expenses incurred by the insured
for necessary medical and funeral services
because of bodily injury; or
2. any negotiated reduced rate accepted by a
medical provider.
C. We do not owe payment to the insured or medical
provider for any balance bill received by the in-
sured if the medical provider has agreed to reduce
the charge for services after a review by us. We
may make payment under this coverage to the
insured or to the medical provider or on behalf of
the insured.
D. We will not pay for the same medical expense
under more than one coverage. If an insured is
entitled to recover for medical expenses under
Part B - Medical Payments Coverage, we will pay
for those expenses under that coverage. We will
not pay for those same expenses under Part A -
Liability Coverage or Part C - Uninsured Motorists
Coverage if an insured is entitled to recover these
expenses under Part B - Medical Payments
Coverage.
E. No payment will be made unless the injured per-
son or that person's legal representative agrees in
writing that any payment shall be applied toward
any settlement or judgment that person receives
under Part A - Liability or Part C - Uninsured Moto-
rists Coverage.
F. In no event will an insured be entitled to receive
duplicate payments for the same element of loss.
G. If the limit of liability shown on the Declarations
Page for Part B - Medical Payments Coverage is
more than $10,000, the most we will pay for any
funeral services or expense is $10,000 for each
person.
H. This coverage shall not apply directly or indirectly
to benefit any insurer or self-insurer. No insurer or
self-insurer will be subrogated to any right of re-
covery under this coverage.
We may make payment under this coverage to the
insured or to the medical provider on behalf of the
insured.
Disputes Regarding Expenses
A. If the insured does not agree with our determina-
tion that an expense is not reasonable, necessary,
or related to the automobile accident and wishes to
contest our decision, the insured may make a
written demand for arbitration. In this event, each
party shall select a competent and impartial
arbitrator. The two arbitrators shall select a third. A
decision agreed to by at least two of the arbitrators
will be binding on all parties.
B. Each party to the arbitration will:
1. Pay the expense it incurs;
2. Bear the expense of the third arbitrator equally.
However, should the arbitrators determine that our
determination was incorrect, we will pay all reasonable
costs related to the arbitration, including the expense
of all arbitrators.
Any arbitrations against us will be barred unless com-
menced within 180 days after the date you are advised
of our determination.

Other Insurance
If there is other applicable auto medical payments in-
surance we will pay only our share of the expenses
incurred by the insured for medical and funeral

PART C - UNINSURED MOTORISTS
COVERAGE
Insuring Agreement
A. Subject to the limit of liability, if you pay the premi-
um when due, we will pay damages which an in-
sured is legally entitled to recover from the owner
or operator of an uninsured motor vehicle be-
cause of bodily injury:
1. Sustained by an insured; and
2. Caused by accident.
The owner's or operator's liability for these dam-
ages must arise out of the ownership,
maintenance, or use of the uninsured motor
vehicle.
Any judgment for damages arising out of a suit
brought without our written consent is not binding
on us.
To the extent that the limits of liability for this cov-
erage exceed the limits of liability required by the
Kentucky Motor Vehicle Reparations Act, damages
payable under this coverage are compensatory
damages, they do not include punitive or exem-
plary damages.
B. "Insured" as used in the Part means:
1. You;
2. Any family member who does not own a mo-
tor vehicle;
3. Any other person while occupying your cov-
ered auto with a reasonable belief that that
person is entitled to do so.
C. Uninsured Motor Vehicle means a land motor
vehicle or trailer of any type:
1. To which no bodily injury liability bond or policy
applies at the time of the accident.
2. To which a liability bond or policy applies at the
time of the accident. In this case its limit for
bodily injury liability must be less than the
minimum limit for bodily injury liability speci-
fied by the financial responsibility law of the
state in which your covered auto is principally
garaged.
3. Which is a hit and run vehicle whose operator
or owner cannot be identified causing injury to
an insured.
4. To which a bodily injury liability bond or policy
applies at the time of the accident but the
bonding or insuring company:
a. denies coverage; or
b. is or becomes insolvent.
Excluded Motor Vehicles
However, uninsured motor vehicle does not include
any vehicle or equipment:
1. Owned by or furnished for the regular use of
you or any family member.
2. Owned or operated by a self-insurer under any
applicable motor vehicle law.
3. Owned by any governmental unit or agency.
4. Operated on rails or crawler treads.
5. Designed mainly for use off public roads while
not on public roads.
6. While located for use as a residence or
premises.
Exclusions
A. We do not provide Uninsured Motorists Coverage
for bodily injury sustained by any person:
1. While occupying or when struck by, any mo-
tor vehicle owned by, furnished to, or available
for the regular use of you or any family
member, a resident of your household, or any
driver listed on the Rating Information Page of
this policy, which is not insured for this cover-
age under this policy. This includes a trailer of
any type used with that vehicle.
2. If that person or legal representative settles
the bodily injury claim without our consent.

3. While occupying your covered auto when it
is being used to carry persons or property for a
fee. This exclusion (A.3.) does not apply to a
share-the-expense car pool.
4. Using a vehicle without a reasonable belief
that that person is entitled to do so.
B. This coverage shall not apply directly or indirectly
to benefit any insurer or self-insurer under any of
the following or similar law:
1. worker's compensation law; or
2. disability benefits law.
Limit of Liability
A. The limit of liability shown in the Declarations for
"each person" for Uninsured Motorists Coverage is
our maximum limit of liability for all damages for
care, loss of services or death, arising out of bod-
ily injury sustained by any one insured in any one
auto accident.
Subject to this limit for "each person", the limit of
liability shown in the Declarations for "each
accident" for Uninsured Motorists Coverage is our
maximum limit of liability for all damages for bodily
injury sustained by two or more insureds result-
ing from any one accident.
This is most we will pay regardless of the number
of:
1. Insureds:
2. Claims made;
3. Vehicles or premiums shown on the Declara-
tions Page; or
4. Vehicles involved in the accident.
B. The amount payable shall be reduced by all sums:
1. Paid because of bodily injury by or on behalf
of persons or organizations who may be legally
responsible.
This includes all sums paid under Part A of the
policy; and
2. Paid or payable because of bodily injury
under any of the following or similar law:
a. worker's compensation law; or
b. disability benefits law.
C. Any payment under this coverage will reduce any
amount that person is entitled to recover for the
same damages under Part A Liability Coverage of
this policy.
Other Insurance
If there is other applicable similar insurance we will pay
only our share of the loss. Our share is the proportion
that our limit of liability bears to the total of all applica-
ble limits. However, any insurance we provide with re-
spect to a vehicle you do not own shall be excess over
any other collectible insurance.
Arbitration
If we and the insured do not agree:
1. Whether that person is legally entitled to dam-
ages from the owner or operator of an unin-
sured motor vehicle; or
2. As to the amount of damages:
both parties may agree to arbitration. In this event,
each party will select an arbitrator. The two arbitrators
will select a third. If they cannot agree within 30 days,
either may request that selection be made by a judge
of a court having jurisdiction.
Each party will:
1. Pay the expenses it incurs; and
2. Bear the expenses of the third arbitrator
equally.
Unless both parties agree otherwise, arbitration will
take place in the county in which the insured lives.
Local rules of law as to procedure and evidence will
apply. A decision agreed to by two of the arbitrators will
be binding.
No questions as to whether your loss is covered by
this policy will be submitted to arbitration.

So long as the insured has not prejudiced our right of
subrogation, any suit against us will be barred unless
commenced within 2 years (TWO YEARS) after the
date of the accident causing the bodily injury,
sickness, disease or death, or within one year after the
liability insurer for the owner or operator of the motor
vehicle liable to the insured has become the subject of
insolvency proceedings in any state, whichever is later.
PART C - UNDERINSURED MOTORISTS
COVERAGE
Your policy provides the following additional coverage
if a specific charge for such coverage(s) is indicated on
the Declarations Page.
Insuring Agreement
A. We will pay damages which an insured is legally
entitled to recover for an underinsured motorist
because of bodily injury:
1. Sustained by an insured; and
2. Caused by a motor vehicle accident.
We must be notified at least 30 days before any
settlement, trial or judgment with or against the
tortfeasor.
To the extent that the limits for this coverage ex-
ceed the limits of liability required by the Kentucky
Motor Vehicle Reparations Act damages payable
under this coverage are compensatory damages,
they do not include punitive or exemplary
damages.
B. "Insured" as used in this endorsement means you
or any family member.
C. "Underinsured Motorists" means a party with
motor vehicle liability insurance coverage in an
amount less than a judgment recovered against
that party for damages on account of injury due to
a motor vehicle accident.
Excluded Motor Vehicles
However, "underinsured motorist" does not in-
clude anyone using a motor vehicle that is:
1. Owned or operated by a self-insurer under any
applicable motor vehicle law.
2. Owned by any governmental unit or agency.
3. Operated on rails or crawler treads.
4. Designed mainly for use off public roads, while
not on public roads.
5. Located for use as a residence or premises.
6. A vehicle to which a bodily injury bond or policy
applies at the time of the accident but the
bonding or insuring company:
a. denies coverage; or
b. is or becomes insolvent.
7. Owned by or furnished or available for the reg-
ular use of you or any family member.
Exclusions
A. We do not provide Underinsured Motorist Cover-
age for bodily injury sustained by any insured
while occupying any motor vehicle owned by you
or any family member that is not insured for this
coverage under this policy.
B. This coverage shall not apply directly or indirectly
to benefit any insurer or self-insurer under any of
the following or similar law:
1. workers' compensation law; or
2. disability benefits law.
Limit of Liability
A. The limit of liability shown on the Declarations
Page for "each person" for Underinsured Motorists

dered on behalf of the insured or the settlement

Other Insurance

PART D - COVERAGE FOR DAMAGE TO
YOUR AUTO
Insuring Agreement
A. Subject to the limit of liability, if you pay the
premium when due, we will pay for sudden, direct
and accidental loss to your covered auto or any
non-owned auto, including its equipment,
reduced by the applicable deductible shown on the
Declarations Page. We will pay for loss to your
covered auto caused by:
1. Other than Collision if the Declarations Page
indicates that Other Than Collision Coverage
is provided for that auto.
2. Collision if the Declarations Page indicates
that Collision is provided for that auto.
If there is a loss to a non-owned auto, we will
provide the broadest coverage applicable to any of
your covered autos shown on the Declarations
Page.
We will not subtract the deductible amount if:
1. your covered auto collides with another
motor vehicle insured by us or an insurer that
is a subsidiary of Grange Mutual Casualty
Company or affiliate of ours.
2. your covered auto is involved in a loss that
results in the vehicle's safety equipment
being repaired or replaced.
B. "Collision" means the upset of your covered
auto or a non-owned auto or their impact with
another vehicle or object.
Loss caused by Other Than Collision includes,
but is not limited to:
1. Missiles or falling objects;
2. Fire;
3. Theft or larceny;
4. Explosion or earthquake;
5. Windstorm;
6. Malicious mischief or vandalism;
7. Hail, water or flood;
8. Riot or civil commotion;
9. Contact with bird or animal; or
10. Breakage of glass.
If breakage of glass is caused by a collision, you
may elect to have it considered a loss by collision.
C. "Non-owned auto" means:
1. Any private passenger auto, pickup or trailer
not owned by or furnished to, or available for
the regular use of, you or any family member
while in the custody of or being operated by
you or any family member with the
permission of its owner; or
2. Any auto or trailer while used as a temporary
substitute for your covered auto which is out
of normal use because of:
a. breakdown;
b. repair;
c. servicing;
d. loss; or
e. destruction.
Nonowned auto does not include any vehicle
which requires an operator to obtain a special
license, other than the standard driver's
license issued to operate your covered auto,
in order to legally operate the vehicle. This
applies regardless if the operator has actively
obtained or possesses such license.
3. Any vehicle 12,000 lbs. or more in Gross
Vehicle Weight only if it is a pickup or van.
Vehicles 12,000 lbs. or more in Gross Vehicle
Weight such as, but not limited to, motor
homes, dump trucks, moving trucks or vans,
step-vans, delivery trucks or vans, cargo
cutaway vans or other vans or trucks with cabs
separate from the cargo area, are not
considered non-owned autos.

D. "Safety Equipment" as used in this provision, and
as required in Kentucky Revised Statutes, means
the:
1. Glass used in windshields, windows and
doors; and
2. Glass, plastic or other materials used in lights.
E. "Custom equipment" means any type of
equipment, accessories or changes other than
those offered either by the manufacturer
specifically for your covered auto or non-owned
auto, or that are installed by the dealership as part
of the original sale, that:
1. are permanently installed on your covered
auto or non-owned auto; and
2. alter the appearance or performance of your
covered auto or non-owned auto.
Custom equipment includes, but is not limited to:
a. caps, bedliners, tool compartments or
winches;
b. custom murals, paintings or other similar
decals or graphics;
c. facilities for cooking or cleaning;
d. height extending roofs;
e. custom wheels, light bars, exhaust
systems or suspensions; or
f. special carpeting or insulation, furniture or
bars.
Electronic equipment and its accessories that are
necessary for the normal operation of the auto or the
monitoring of the auto's operating systems and
permanently installed in or on your covered auto or
any non-owned auto, is considered part of that
vehicle and not considered custom equipment.
Transportation Expenses
If the Declarations Page indicates that Other Than
Collision Coverage is provided for your covered auto,
we will also pay, without application of a deductible, the
lesser of $30 per day, up to $900; for:
1. Transportation expenses incurred by you in
the event of the total theft of your covered
auto if Other Than Collision Coverage is
provided for that auto.
2. Loss of use expenses for which you become
legally responsible in the event of the total theft
of a non-owned auto. This applies only if the
Declarations Page indicate that Other Than
Collision Coverage is provided for your
covered auto.
We will pay only the expenses incurred beginning 24
hours after the theft.
Our payment under Transportation Expenses will be
limited to the earliest of the following:
1. When your covered auto has been returned
to you;
2. When your covered auto has been repaired;
3. When your covered auto has been replaced;
or
4. 72 hours after we make an offer to settle the
loss if your covered auto is deemed by us to
be a total loss.
You must provide us written proof of your rental
charges to be reimbursed.
Exclusions
We will not pay for:
1. Loss to your covered auto or any
non-owned auto which occurs while it is
being used to carry persons or property for
compensation, fee or otherwise for hire. This
exclusion (1.) does not apply to a
share-the-expense car pool.
2. Damage or loss due to or resulting from:
a. wear and tear or deterioration;
b. freezing;
c. mechanical, electrical, or electronic
breakdown or failure;

d. inherent vice or latent defect;
e. smog, rust or other corrosion; or
f. road damage to tires.
This exclusion does not apply if the damage
results from the total theft of your covered
auto or non-owned auto.
3. Loss due to or as a consequence of:
a. radioactive contamination;
b. discharge of any nuclear weapon (even if
accidental);
c. war (declared or undeclared);
d. civil war;
e. insurrection; or
f. rebellion or revolution.
4. Loss caused by fungus, mold, mildew or
spores, regardless of the factors causing or
contributing to its growth, including, hail, water,
moisture or flood damage.
5. Loss caused directly or indirectly by any:
a. accidental or intentional discharge, disper-
sal or release of pathogenic or poisonous
biological material; or
b. intentional discharge, dispersal or release
of chemical or hazardous material for any
purpose other than its safe and useful
purpose. However, this exclusion does not
apply to any loss resulting from an act of
vandalism that is directed solely at your
covered auto.
6. Loss to:
a. any electronic equipment designed for the
reproduction of sound, including, but not
limit to:
(1) radios, stereos, iPods, MP3 players
and similar devices;
(2) tape decks and similar devices; or
(3) compact disc players;
b. any other electronic equipment that
receives or transmits audio, visual or data
signals, including, but not limited to:
(1) citizens band radios;
(2) telephones;
(3) two-way mobile radios;
(4) scanning monitor receivers;
(5) televisions and television monitors;
(6) DVD, VCR or any other video device;
(7) audio cassette recorders; or
(8) personal computers;
c. tapes, records, discs, or other media used
with equipment described in a. or b.; or
d. any other accessories used with
equipment described in a. or b.
This exclusion (6.) does not apply to:
i. items listed in 6.a., b. and d. of this
exclusion provided such equipment
and accessories are permanently
installed, by the original manufacturer
or dealership as part of the original
sale, in or on your covered auto or
any non-owned auto;
ii. items listed in 6.a., b. and d. of this
exclusion, up to $1,000, that are
permanently installed by someone
other than the original manufacturer or
dealership as part of the original sale,
in or on your covered auto or any
non-owned auto; or
iii. any other electronic equipment and its
accessories that are:

1. necessary for the normal
operation of the auto or the
monitoring of the auto's operating
systems; and
2. permanently installed in or on
your covered auto or any
non-owned auto.
7. Loss to your covered auto or any
non-owned auto due to destruction or
confiscation by governmental or civil
authorities because you or any family
member:
a. engaged in illegal activities; or
b. failed to comply with Environmental
Protection Agency or Department of
Transportation standards.
This exclusion (7.) does not apply to the
interests of Loss Payees in your covered
auto.
8. Loss to a camper body or trailer you own
which is not shown on the Declarations Page.
This exclusion does not apply to a camper
body or trailer you:
1. acquire during the policy period; and
2. ask us to insure within 30 days after you
become the owner.
9. Loss to any non-owned auto or any vehicle
used as a temporary substitute for a vehicle
you own, when used by you or any family
member without permission of the owner.
10. Loss to:
a. awnings or cabanas; or
b. equipment designed to create additional
living facilities.
11. Loss to any equipment or device designed or
used for the detection or location of speed
measuring equipment such as radar or laser
detectors and any jamming apparatus
intended to elude or disrupt speed measuring
equipment.
12. Loss to any non-owned auto being
maintained or used by any person while
employed or otherwise engaged in the
business of:
a. selling;
b. repairing;
c. servicing;
d. storing;
e. parking; or
f. washing
vehicles designed for use on public highways.
This includes road testing and delivery.
13. Loss to any non-owned auto being
maintained or used by any person while
employed or otherwise engaged in any
business not described in exclusion 12. This
exclusion (13.) does not apply to the
maintenance or use by you or any family
member of a non-owned auto which is a
private passenger auto or trailer.
14. Loss to your covered auto or any
non-owned auto that occurs while:
a. participating in; or
b. practicing or preparing for;
Any prearranged, organized or spontaneous
race, or speed, hill climb, demolition or
stunting activity.
15. Loss to your covered auto or any
non-owned auto that occurs while being
operated on a driving track in a facility
designed for racing vehicles.
16. Loss to any equipment designed for racing,
which is installed in or upon your covered
auto or non-owned auto. This includes, but is
not limited to, nitrous oxide systems, roll
cages, or air intake modifications.
17. Loss to hoists, air compressors, generators, or
any other similar devices.

18. Loss to your covered auto or non-owned
auto while used off public roads for 4-wheeling
purposes.
19. Loss to your covered auto, non-owned auto
or trailer while rented, leased, loaned, or given
in exchange for any compensation to others by
you, a family member, the owner of the
vehicle, a resident of your household using a
vehicle with your permission, or a driver using
a vehicle with the permission of you, a family
member, the owner of the auto, or a resident
of your household.
20. Loss to your covered auto, a trailer or any
non-owned auto caused by or reasonably
expected to result from, an intentional act by,
or at the direction of you, a family member,
the owner of the auto, a resident of your
household, or any driver listed on the Rating
Information Page of this policy. However, this
exclusion does not apply to a loss to your
covered auto to the extent of the legal interest
of you or a family member who:
a. sustained the loss as the result of family
violence by:
1. You;
2. A family member;
3. A former spouse; or
4. Any person who resides in or has
resided in your household;
b. Did not direct, participate in, or consent to
the intentional act causing the loss; and
c. Filed a family violence complaint against
the person who caused the violence
resulting in the loss.
21. Loss to your covered auto or non-owned
auto when it is driven, operated or used with
your permission by a person other than a
family member whom you know:
a. is under the minimum age to obtain a
driver's license;
b. does not have a valid driver's license;
c. has a suspended driver's license;
d. has a revoked driver's license;
e. has a restricted driver's license and is
operating a vehicle beyond the scope of
such restriction.
This exclusion (21.) does not apply when it is
not required for a person to obtain a driver's
license to operate your covered auto or
non-owned auto. For purposes of this
exclusion, a driver's license includes a
temporary learner's permit.
22. Loss to your covered auto or a non-owned
auto caused by, or reasonably expected to
result from, a criminal act of you, a family
member, the owner of the auto, a resident of
your household using a vehicle with your
permission, or a driver using a vehicle with the
permission of you, a family member, the
owner of the auto, or a resident of your
household. This exclusion applies regardless
of whether that person is actually charged with,
or convicted of, a crime. For purposes of this
exclusion, criminal acts do not include traffic
violations.
Limit of Liability
A. Our limit of liability for the loss will be the lesser of
the:
1. Actual cash value of the stolen or damaged
property, reduced by the salvage value if you
or the owner retain the salvage; or
2. Amount necessary to repair or replace the
property using parts from the vehicle's
manufacturers or parts from other
manufacturers;
Reduced by any applicable deductible.
The most we will pay for loss to custom equipment is
$1,000 unless you purchased additional Custom
Equipment Coverage and it is shown on the
Declarations Page. If you purchased additional
Custom Equipment Coverage, the most we will pay is
the amount listed on the Declarations Page.

Custom Equipment Coverage applies only if either
Other Than Collision Coverage or Collision Coverage
has been purchased for your covered auto and the
loss is covered under the purchased coverage.
If the custom equipment takes the place of any
equipment that was included on your covered auto or
non-owned auto by the original manufacturer or the
dealership as part of the original sale, no credit will be
given for the value of the corresponding original
equipment in the payment of the loss.
You are required to maintain and upon demand from
us, promptly present proof of ownership for any
custom equipment to which this coverage applies.
Proof of custom equipment ownership includes, but is
not limited to, receipts, pictures, owner's manual.
This policy does not cover a claim for any actual or
perceived diminished market value of your covered
auto or non-owned auto.
The most we will pay for loss to any non-owned auto
that is a trailer is $500.
B. An adjustment for depreciation and physical
condition will be made in determining the actual
cash value of your covered auto or non-owned
auto at the time of the loss.
C. If a repair or replacement results in better than like
kind or quality, we will not pay for the amount of
the increase in value. The amount for which you
will be responsible includes the value relating to
the increase in useful life of replaced parts that
have a limited useful life and the increase in value
from the repair of prior damage.
D. We will provide coverage for replacement of a child
restraint system that was in use by a child during
an accident to which this policy applies.
Payment of Loss
We may, at our option, pay to repair or replace the
damaged or stolen property. We may, at our expense,
return any stolen property to:
1. You; or
2. The address shown in this policy.
If we return stolen property we will pay for any damage
resulting from the theft. We may keep all or part of the
property at an agreed or appraised value.
No Benefit To Bailee
This insurance shall not directly or indirectly benefit any
carrier or other bailee for hire.
Other Sources of Recovery
If other sources of recovery also cover the loss, we
pay only our share of the loss. Our share is the
proportion that our limit of liability bears to the total of
all applicable limits. However, any insurance we
provide:
1. For your covered auto shall be excess to that of a
person engaged in the business of:
a. storing;
b. parking;
c. servicing; or
d. repairing;
motor vehicles. If the loss occurs while the vehicle
is in that person's control or the control of that
person's employee or agent.
2. With respect to a non-owned auto shall be
excess over any other collectible source of
recovery including, but not limited to:
a. any coverage provided by the owner of the
non-owned auto;
b. any other applicable physical damage
insurance;
c. any other source of recovery applicable to the
loss.
Appraisal
A. If we and you do not agree on the actual cash
value of the vehicle, either party may demand an
appraisal of the loss. In this event, each party will
select a competent and impartial appraiser. The
two appraisers will select a competent and
impartial umpire. The appraisers will state
separately the actual cash value and the amount of

the loss. If they fail to agree, they will submit their
differences to the umpire. A decision agreed to by
any two will be binding. Each party will:
1. Pay its chosen appraiser; and
2. Bear the expenses of the appraisal and umpire
equally.
B. We do not waive any of our rights under this policy
by agreeing to an appraisal.
Loss Payable Clause
If a loss payee is shown on the Declarations Page:
Loss or damage shall be paid, as interest may appear,
to you and the loss payee shown on the Declarations
Page. Payment may be made separately to each
interested party.
This insurance with respect to the interest of the loss
payee, shall not become invalid because of your acts
or omissions unless the loss results from:
a. Conversion, secretion, embezzlement or willful
damaging or destruction, of your covered
auto by or at the direction of you, a family
member, or the owner of your covered auto;
or
b. A criminal act or omission of you, a family
member, or the owner of your covered auto.
This applies regardless of whether you, the
family member, or the owner of your
covered auto is actually charged with, or
convicted of, a crime. For purposes of this
clause, criminal acts or omissions do not
include traffic violations.
We reserve the right to cancel, nonrenew or void the
policy as permitted by policy terms. The cancellation,
nonrenewing or voiding shall terminate this agreement
as to the loss payee's interest. We will give notice of
cancellation to the loss payee shown on the
Declarations Page. If this policy is cancelled,
nonrenewed, or voided, the interest of any lienholder
under this agreement will also terminate effective the
date and time the policy is cancelled, nonrenewed or
voided.
When we pay the loss payee we shall, to the extent of
payment, be subrogated to the loss payee's rights of
recovery.

PART E - DUTIES AFTER AN ACCIDENT OR
LOSS
We have no duty to provide coverage under this policy
unless you have paid the required premium when due
and there has been full compliance with the following
duties:
A. We must be notified promptly of how, when and
where the accident or loss happened. Notice
should also include the names and addresses of
any injured persons and of any witnesses.
B. A person seeking any coverage must:
1. Cooperate with us in the investigation,
settlement or defense of any claim or suit.
2. Promptly send us copies of any notices or
legal papers received in connection with the
accident or loss.
3. Submit, as often as we reasonably require:
a. to physical and/or medical exams at our
expense by physicians we select at our
expense; and
b. to examination under oath and sign the
transcribed statements.
4. Authorize us to obtain directly from the
medical provider or custodian of medical
records:
a. medical reports and records; and
b. other pertinent records.
5. Submit a signed, notarized statement in proof
of loss within 60 days of a request by us.
6. Make your covered auto available to us for
inspection at our request. We have the right
as part of our inspection to extract and
analyze any part of your vehicle, including but
not limited to, its fluids or data recorded by
your covered auto's Event Data Recorder or
similar device.
7. Allow us to take signed or recorded
statements, and answer all reasonable
questions we may ask, when and as often as
we may reasonably require.
8. Produce employees, members of your
household, or the household of an insured, or
others for statements or examination under
oath to the extent that it is within your power
to do so.
9. Attend hearings and trials as we require.
10. Authorize us to move any damaged auto
covered by this policy to a storage facility of
our choice at our expense.
11. Authorize us to obtain residency,
employment, earning, phone or other
communication, pharmacy, or any other
records that we deem appropriate for
investigation of any claim, damage or injury.
C. A person seeking Uninsured Motorists Coverage
must also:
1. Promptly notify the police if a hit and run
driver is involved.
2. Promptly send us copies of the legal papers if
a suit is brought.
D. A person seeking Coverage for Damage To Your
Auto must also:
1. Take reasonable steps after loss to protect
your covered auto or any non-owned auto
and their equipment from further loss. We will
pay reasonable expenses incurred to do this.
If you or the person in legal possession of
your covered auto or non-owned auto does
not protect it, further loss is not covered.
2. Promptly notify the police if your covered
auto or any non-owned auto is stolen.
3. Permit us to inspect and appraise the
damaged property before its repair or
disposal.

PART F - GENERAL PROVISIONS
Bankruptcy
Bankruptcy or insolvency of the insured shall not
relieve us of any obligation under this policy.
Misrepresentations
To determine eligibility for coverage under this policy
and to determine the premium, we relied upon the
statements provided to us in the application, including
but not limited to information regarding licensing and
driving history of you, family members, drivers listed
on the Rating Information Page, all residents in your
household, registered owners of the vehicle to be
insured, the description of the vehicles to be insured,
the use of the vehicles to be insured, the location of
the principal place of garaging, and your place of
residence. We may void this policy from inception,
deny coverage under this policy, or, at our election,
assert any other remedy available under applicable
law, if at the time of application, any time during the
policy period, or in connection with the presentation or
settlement of any claim you, a family member, a
driver listed on the Rating Information Page, a resident
in your household or any insured person seeking
coverage under this policy:
A. Made incorrect statements to us with regard to any
material fact or circumstance;
B. Concealed or misrepresented any material fact or
circumstance; or
C. Engaged in fraudulent conduct.
If we void your policy, the premium you have paid will
be refunded.
Following an accident or loss, we may still void this
policy or deny coverage at any time for incorrect,
concealed or misrepresented material facts, provided
to us at any time, or fraud.
However, we will provide liability coverage, but only in
that amount required to meet the minimum limits of
coverage required by Kentucky Financial Responsibility
Law, if said loss occurs during the policy period prior to
the time that we first become aware of the insured's
fraudulent statement.
If we void this policy from inception, or deny coverage
as permitted by this Misrepresentations section, we will
not be liable for any claim that would otherwise be
covered.
To the extent that we make any payment to any party
under this policy and our subsequent investigation
reveals your, a family member's, a driver on the
Rating Information Page, any resident of your
household, or any insured's involvement in fraud or
misrepresentation in the application or form submitted
to us for this insurance, or with regard to any other
aspect of this insurance, including, but not limited to
procurement of this policy, or in the presentation of a
claim, you must indemnify us for all payments made.
Changes
A. This policy, the Application, the Declarations Page
and any endorsements issued by us contains all of
the agreements between you and us. These terms
may not be changed or waived except by
endorsement issued by us.
B. If there is a change to the information used to
develop the policy premium, we may adjust your
premium. Changes during the policy period that
may result in a premium increase or decrease
include, but are not limited to, changes in:
1. The number, type, or use classification of
insured vehicles;
2. Operators using insured vehicles;
3. The place of principal garaging of insured
vehicles; and
4. Coverage, deductible, or limits.
If a change resulting from A. or B. requires a
premium adjustment, we will make the premium
adjustment in accordance with our manual rules
effective the date of the change. You agree to
promptly notify us if you have made any material
changes, including, but not limited to, those listed
above.
C. If we make a change which broadens coverage
under this edition of your policy without additional
premium charges, that change will automatically
apply to your policy as of the date we implement
the change in your state. This paragraph (C.) does
not apply to changes implemented with a general
program revision that includes both broadenings
and restrictions in coverage, whether that general

program revision is implemented through
introduction of:
1. A subsequent edition of your policy; or
2. An Amendatory Endorsement.
Conformity to State Law
Any policy provision contrary to laws of the state in
which this policy is issued is amended to conform to
such laws.
Fraud
We do not provide coverage for any insured who has
made fraudulent statements or engaged in fraudulent
conduct in connection with any accident or loss for
which coverage is sought under this policy. However,
we will provide liability coverage, but only in that
amount required to meet the minimum limits of
coverage required by Kentucky Financial Responsibility
Law, if said loss occurs during the policy period prior to
the time that we first become aware of the insured's
fraudulent statement. If we void this policy, you must
indemnify us for all payment made.
Legal Action Against Us
A. No legal action may be brought against us, and we
may not be sued unless there is full compliance
with all the terms, provisions and conditions of this
policy. In addition, under Part A, no legal action
may be brought against us until:
1. We agree in writing that the insured has an
obligation to pay; or
2. The amount of that obligation has finally been
determined by judgment after trial.
B. No person or organization has any right under this
policy to bring us into any action to determine the
liability of an insured.
Payment of Premium
If you fail to make your initial payment or if you make
your initial premium payment by check, draft,
electronic funds transfer, or any remittance other than
cash, and it is nonnegotiable or not honored on
presentment to the bank or other financial institution,
we may void this policy from inception. Coverage
under this policy is conditioned upon the initial payment
and/or the initial check, draft, electronic funds transfer,
or remittance being honored upon presentment to the
bank or other financial institution. This means we will
not be liable under this policy for any claims or
damages that would otherwise be covered if the initial
payment had been received or if the initial check, draft,
electronic funds transfer, or similar form of remittance
had been honored by the financial institution. This
includes any claims reported to us prior to receiving
notice of the non-sufficient funds payment.
If you fail to make your renewal payment or if you
make a premium payment for a renewal of your policy
using a nonnegotiable instrument or any type of
payment that is not honored upon presentment to the
bank or other financial institution, our offer of policy
renewal is deemed rejected by you and the policy
terminated without renewal.
Examples of nonnegotiable instruments include, but
are not limited to:
1. Checks dishonored due to insufficient funds;
2. Checks drawn from closed accounts; and
3. Invalid credit or debit cards.
Our Right To Recover Payment
A. If we make a payment under this policy and the
person to or for whom payment was made has a
right to recover damages from another, we shall
be subrogated to that right. That person shall do:
1. Whatever is necessary to enable us to
exercise our rights; and
2. Nothing after loss to prejudice them.
B. If we make a payment under this policy and the
person to or for whom payment is made recovers
damages from another, that person shall:
1. Hold in trust for us the proceeds of the
recovery; and
2. Reimburse us to the extent of our payment
regardless of the total amount of damages
sustained by the insured irrespective of
whether any such settlement or judgment may
or may not provide reimbursement for all
injuries, illnesses, or other damages (including,
without limitation, pain and suffering,
consequential, punitive, exemplary or other

damages, whether alleged, proven in a court
of law or otherwise substantiated)
C. We are not responsible for any fees, including, but
not limited to, attorney fees or court costs incurred
to recover our subrogated interest unless we have
agreed in writing, in advance, to be responsible for
those fees.
D. Our rights do not apply under Paragraph A. with
respect to Uninsured Motorists Coverage if we:
1. Have been given prompt written notice of a
tentative settlement between an insured and
the insurer of a vehicle described in Paragraph
C.4. of the definitions of uninsured motor
vehicle; and
2. Fail to advance payment to the insured in an
amount equal to the tentative settlement within
90 days after receipt of notification.
If we advance payment to the insured in an
amount equal to the tentative settlement within 90
days after receipt of notification:
1. That payment will be separate from any
amount the insured is entitled to recover
under the provisions of Uninsured Motorists
Coverage.
2. We also have a right to recover the advanced
payment.
Policy Period, Territory and Interpretation
A. This policy applies only to accidents and losses
which occur:
1. During the policy period as shown on the
Declarations Page; and
2. Within the policy territory.
B. The policy territory is:
1. The United States of America, its territories or
possessions;
2. Puerto Rico; or
3. Canada.
This policy also applies to losses to, or accidents
involving, your covered auto while being
transported between their ports.

VEHICLE IN MEXICO
Car accidents in Mexico are subject to the laws of
Mexico, NOT the United States. The Republic of
Mexico considers a car accident to be both a criminal
offense and a civil matter. Car insurance should be
secured from a licensed Mexican insurance company
before driving into Mexico to avoid the risk of being
jailed and possibly having a vehicle covered by this
policy impounded.
NO COVERAGE IS PROVIDED UNDER THIS
POLICY WHILE USING OR OCCUPYING ANY
VEHICLE IN MEXICO
C. This agreement shall be governed by, and
interpreted in accordance with the laws of the state
in which the insured resides as reflected on the
policy Declarations Page.
Termination
A. Cancellation. This policy may be cancelled during
the policy period as follows:
1. The named insured shown on the Declarations
Page may cancel by:
a. returning this policy to us; or
b. giving us advance notice of the date
cancellation is to take effect.
2. We may cancel by mailing to the named
insured shown on the Declarations Page at the
address shown in this policy:
a. at least 14 days notice if cancellation is for
nonpayment of premiums; or
b. at least 14 days notice in all other cases,
including if notice is mailed during the first
60 days this policy is in effect and this is
not a renewal or continuation policy.
3. If the policy provides coverage under any part,
and after this policy is in effect for 60 days, or
if this is a renewal policy, we will not cancel

these coverages except for one or more of the
following reasons:
a. for nonpayment of premium; or
b. if a driver's license issued to you, any
driver in your household, or any driver
who customarily uses your covered auto
has been suspended or revoked.
This must have occurred:
(1) during the policy period; or
(2) since the last anniversary of the
original effective date if the policy
period is other than 1 year.
c. discovery of fraud or material
misrepresentation made by or with the
knowledge of the named insured in
obtaining the policy, continuing the policy,
or in presenting a claim under the policy;
d. determination by the commissioner of
insurance that continuation of the policy
would place the insurer in violation of
Kentucky rules or administrative
regulations of the commissioner of
insurance.
B. Nonrenewal. If we decide not to renew or
continue this policy, we will mail notice to the
named insured shown on the Declarations Page at
the address shown in this policy. Notice will be
mailed at least 75 days before the end of the policy
period.
C. Other Termination Provisions
If we request cancellation, you may be entitled to
a premium refund. If so, we will send you the
refund. The premium refund, if any, will be
computed on a pro rata basis.
If cancellation is for non-payment of premium or at
your request, the earned premium shall be
calculated on a short rate basis. Coverage will
cease on the effective date of your cancellation.
However, making or offering to make the refund is
not a condition of cancellation.
Transfer Of Your Interest In This Policy
Your interest, rights or duties under this policy may not
be assigned or transferred without our written consent.
However, if a named insured shown on the
Declarations Page dies, coverage will be provided for:
1. Your surviving spouse if a resident in the same
household at the time of death. Coverage applies
to the spouse as if a named insured shown on the
Declarations Page; and
2. The legal representative of the deceased person
as if a named insured shown on the Declarations
Page. This applies only with respect to the
representative's legal responsibility to maintain or
use your covered auto.
Coverage will only be provided until the end of the
policy period.
Two Or More Auto Policies
If this policy and any other auto insurance issued to
you by us, or by any of our affiliated companies, apply
to the same accident, the maximum limit of our liability
under all policies shall not exceed the highest
applicable limit of liability under any one policy.
This provision does not apply to Uninsured Motorists
Coverage. No one will be entitled to receive duplicate
payments for the same elements of loss under
Uninsured Motorists Coverage.
Our Right to Recompute Premium
We established the premium for this policy based on
the statements you made in the application for
insurance. We have the right to recompute the
premium if we later obtain information which affects
the premium we charged.
Known Loss
We do not provide coverage for any loss or
occurrence which was known to any insured person
and occurred prior to the time you signed the
application for coverage, or asked us or our agent to
provide coverage, even if the loss or occurrence falls
within the period covered by the policy.

Fees
In addition to premium, fees may be charged on your
policy. We may charge fees for installment payments,
late payments and other transactions. Payments made
on your policy will be applied to fees first, then to the
premium due.
Our Right to Use Other Resources
You and any insured seeking coverage under this
policy agree that we have the right to utilize outside
sources, vendors, experts, consultants and software
tools of our choosing to assist us in underwriting, pric-
ing and issuing our insurance policies and to assist us
in adjusting claims.
ADDITIONAL POLICY COVERAGES
Your policy provides the following additional
coverage(s) if a specific premium charge or charge for
such coverage(s) is indicated on the Declarations
Page. The provisions and exclusions that apply to Part
D also apply to these additional policy coverages ex-
cept as changed below.
Towing And Labor Costs
If your covered auto or non-owned auto is disabled,
we will pay up to the limit shown on the Declarations
Page for this coverage, the cost incurred for:
1. mechanical labor at the place of its
breakdown;
2. towing to the nearest place where the neces-
sary repairs can be made during regular busi-
ness hours if it will not run;
3. towing it out if stuck on or immediately next to
a public highway; and
4. delivery of gas, oil, loaned battery, or change
of tire. We do not pay for the cost of these
items.
Rental Reimbursement/Transportation Expenses
When there is loss to one of your covered autos de-
scribed on the Declarations Page:
A. We will reimburse you for expenses you incur to
rent a substitute auto. This coverage applies only
if:
1. Your covered auto is withdrawn from use for
more than 24 hours; and
2. The loss is caused by collision, or covered
under Part D of this policy.
However, this coverage does not apply when there
is total theft of the auto.
B. The Transportation Expenses provision of Part D
is replaced by the following:
In addition, we will pay up to the lower of the daily or
maximum limit stated on the Declarations Page for
transportation expenses incurred by you. This applies
only in the event of the total theft of your covered
auto. We will pay only transportation expenses in-
curred beginning 24 hours after the theft.
C. Our payment under paragraph A. and B. of Rental
Reimbursement/Transportation Expenses will be
limited to the earliest of the following:
1. When your covered auto has been returned
to you;
2. When your covered auto has been repaired;
3. When your covered auto has been replaced;
or
4. 72 hours after we make an offer to settle the
loss if your covered auto is deemed by us to
be a total loss.
You must provide us written proof of your rental
charges to be reimbursed.

2. If there is a loss to a non-owned auto, we will provide the broadest coverage applicable to any of your covered autos shown on the Declarations Page.
3. We will not subtract the deductible amount if:
a. your covered auto collides with another motor vehicle insured by us or an insurer that is a subsidiary or affiliate of ours; or
b. your covered auto is involved in a loss that results in the vehicle's safety equipment being repaired or replaced.

d. Facilities for cooking or cleaning;
e. Height extending roofs;
f. Custom wheels, light bars, exhaust systems or suspensions; or
g. Special carpeting or insulation, furniture or bars.
Electronic equipment and its accessories that are necessary for the normal operation of the auto or the monitoring of the auto's operating systems and permanently installed in or on your covered auto or any non-owned auto, is considered part of that vehicle and not considered custom equipment .

Personal Effects Coverage
The provisions and exclusions that apply to Part D -Coverage for Damage to Your Auto also apply to thisendorsement except the Limit of Liability and OtherSources of Recovery provisions and any deductible.
We will pay for sudden, direct and accidental loss topersonal effects while used in, on or in connectionwith your covered auto for which a specific premiumcharge indicates that Personal Effects Coverage isprovided.
"Personal Effects" means personal propertybelonging to you or a family member. Personaleffects do not include:
1. accessories or equipment of your covered auto.
2. motorized or self-propelled vehicles, aircraft,watercraft, mobile homes and trailers includingtheir accessories or equipment.
3. money. This means currency, coins, bank notes,money orders, travelers checks, bullion, creditcards and similar items.
4. securities. These are negotiable agreements inwriting, that have value. They include revenuestamps, other stamps in current use, tokens ortickets.
5. accounts, documents, records, passports,manuscripts, bills, deeds, an evidence of debt orother valuable papers.
6. contact lenses, hearing aids, artificial limbs orteeth.
7. all animals including birds and fish.
8. salesmen’s samples, merchandise for sale orexhibition, or the business property of you or afamily member.
9. property of guests, boarders or employees.
Limit of Liabil ity
Our limit of liability for loss will be the lesser of the:
1. Stated amount shown on the Declarations Page;
2. Actual cash value of the stolen or damagedproperty; or

Limitations On Theft
Theft, including larceny, robbery, burglary or pilferageis limited to 10% of the amount of insurance shown onthe Declarations Page for this endorsement for eachof the following categories of personal property:
1. coin collections or other numismatic property;
2. transportation tickets;
3. any single article of jewelry, watches, preciousand semi-precious stones, art, heirlooms or fur,including any article containing fur whichrepresents its principal value.
Each loss caused by theft is subject to a $50deductible.
Additional Exclusions
We will not pay for loss or damage caused by:
1. marring, scratching or breakage unless resultingfrom damage to or loss of your covered auto.
2. deterioration, insects, vermin or inherent vice.
3. animals or birds owned or kept by you or a familymember. We do cover direct loss that followscaused by fire, explosion or smoke.

I. Definitions
The Definitions Section is amended as follows:
A. For the purpose of the coverage provided by this endorsement "miscellaneous type vehicle " means:
1. A motor home, all terrain vehicle, dune buggy, golf cart, amphibious vehicle, hovercraft or go-cart.
2. A private passenger auto owned jointly by 2 or more:
a. relatives, other than husband and wife; or
b. resident individuals.
B. The definition of your covered auto is replaced by the following:
"Your covered auto" means:
1. Any miscellaneous type vehicle shown on the Declarations Page.
2. Any of the following types of vehicles on the date you become the owner:
a. a private passenger auto;
b. a pickup or van that has a Gross Vehicle Weight of less than 12,000 pounds; or
c. any miscellaneous type vehicle of the same type shown on the Declarations Page.
This provision applies only if:
a. you acquire the vehicle during the policy period;
b. you ask us to insure it within 30 days after you become the owner; and
c. with respect to a pickup or van, no other insurance policy provides coverage for that vehicle.
If the vehicle you acquire replaces one of the same type shown on the Declarations Page, it will have the same coverage as the vehicle it replaced. You must ask us to insure a replacement vehicle within 30 days only if you wish to add or continue Coverage for Damage to Your Auto.
If the vehicle you acquire is in addition to any of the same type shown on the Declarations Page, it will have the broadest coverage we now provide for any vehicle of that type shown on the Declarations Page.
3. Any trailer you own.
4. Any miscellaneous type vehicle or auto you do not own while used as a temporary substitute for any other vehicle described in this definition which is out of normal use because of its:

A. For the purpose of the coverage provided by this endorsement, the terms "auto", "motor vehicle" and "vehicle" are replaced by the term snowmobile except for Uninsured Motorists Coverage. In Uninsured Motorists Coverage, the term uninsured motor vehicle includes a snowmobile.
B. The following definition is added:
"Snowmobile" means:
1. A land motor vehicle which is:
a. designed for use mainly off public roads on snow or ice; and
b. propelled solely by means of the following or similar mechanical devices:
1) wheels;
2) crawler-type treads; or
3) belts.
2. A trailer designed for being towed by, but not for transporting, a vehicle described in 1. above.
However, snowmobile does not include any vehicle which is propelled by airplane type propellers or fans.
C. The term your covered auto is replaced by the term your covered snowmobile. Your covered snowmobile means:

3. For your covered snowmobile, any person or organization but only with respect to legal responsibility for whom coverage is afforded under this Part.

For any snowmobile, other than your covered snowmobile, any person or organization but only with respect to legal responsibility for acts or omissions of you or any family member for whom coverage is afforded under this Part. This provision applies only if the person or organization does not own or hire the snowmobile.

Our limit of liability for any one loss to the your covered auto to which this Agreed Value Coverage applies will be:

B. The Payment of Loss provision is replaced by the following:
Payment of Loss
1. If a repair or replacement necessitates the use of replacement parts that are in better condition than what the damaged property was prior to the loss, we will cover the amount of that betterment.
2. Our liability for the amount necessary to repair the damaged property shall be determined by:
a. The prevailing competitive labor rates for the type of damaged property in the area where the property is to be repaired as agreed to by you and us ; and
b. The cost of replacement parts reasonably specified by us in accordance with applicable laws and government regulations. The replacement parts may be new, used, refurbished or restored, and may be made by original equipment manufacturers or by non-original equipment manufacturers. This shall be determined by agreement between you and us .
If we use a part made by a non-original equipment manufacturer, it shall have a manufacturer's warranty that is equal to or greater than the warranty offered by the original equipment manufacturer of the same type of part.
3. The determination of our liability shall not be affected by the amount actually expended to repair the damaged property.
4. In the event of a total loss, we will pay the Agreed Value shown on the Declarations Page in money. For other than a total loss and at our option, we may pay for loss in money or repair or replace the stolen or damaged property.
We may, at our expense, return the stolen property to you at the address shown on the Declarations Page. If we return stolen property, we will pay for any damages resulting from the theft. We may keep all of the property at the Agreed Value shown on the Declarations Page or part of the property at an appraised value.
5. If we pay for loss in money, our payment will include applicable sales tax for the damaged or stolen property.

BASIC PERSONAL INJURY PROTECTION
COVERAGE
The Company agrees with the named insured,
subject to all of the provisions of this coverage and to
all of the provisions of the policy except as modified
herein, as follows:
SECTION I
PERSONAL INJURY PROTECTION COVERAGE
The Company will pay, in accordance with Kentucky
Revised Statutes Chapter 304, Sub Title 39, personal
injury protection benefits for:
(a) medical expense,
(b) work loss,
(c) replacement services loss,
(d) survivor's economic loss,
(e) survivor's replacement services loss, and
(f) funeral expense
incurred with respect to bodily injury sustained by an
eligible injured person and caused by an accident
arising out of the operation, maintenance or use of a
motor vehicle as a vehicle.
Exclusions
This coverage does not apply:
(a) to bodily injury sustained by the named
insured or any relative while occupying any
motor vehicle owned by the named insured
which is not an insured motor vehicle;
(b) to bodily injury sustained by a relative while
occupying any motor vehicle owned by such
relative with respect to which the security
required by the Kentucky Revised Statutes
Chapter 304, Sub Title 39, is not in effect;
(c) to bodily injury sustained by the named
insured or any relative, who has not rejected
his tort limitation pursuant to Kentucky Revised
Statutes Chapter 304, Sub Title 39, while
occupying or while a pedestrian through
being struck by any motor vehicle, other than
the insured motor vehicle, with respect to
which the security required under the Kentucky
Revised Statutes Chapter 304, Sub Title 39, is
in effect unless the provider of such security
fails to make payment for loss within 30 days
of reasonable proof of the fact and the amount
of loss sustained;
(d) to bodily injury sustained by any person if
such injury arises from his conduct within the
course of a business of repairing, servicing or
otherwise maintaining motor vehicles unless
such conduct occurs off the business
premises;
(e) to bodily injury sustained by any person
arising from conduct in the course of loading
or unloading any motor vehicle unless such
conduct occurs while occupying such motor
vehicle;
(f) to bodily injury sustained by any person other
than the named insured or any relative which
arises from the operation, maintenance or use
of a motor vehicle without a good faith belief
that he is legally entitled to do so;
(g) to any benefits any person would otherwise be
entitled to receive hereunder for bodily injury
intentionally caused by such person or arising
out of his intentionally attempting to cause
bodily injury, and, if any person dies as a
result of intentionally causing or attempting to
cause bodily injury to himself, his survivors
are not entitled to any survivor's economic
loss or survivor's replacement services
loss benefits;
(h) to bodily injury sustained by any pedestrian,
other than the named insured or any relative,
outside the Commonwealth of Kentucky;
(i) to bodily injury in excess of the Kentucky
specified minimum limit of liability sustained by
any person, other than the named insured or
any relative while occupying a motor vehicle

which is regularly used in the course of the
business of transporting persons or property
and which is one of five or more motor
vehicles under common ownership, or a
motor vehicle owned by a government other
than the Commonwealth of Kentucky, its
political subdivisions, municipal corporations,
or public agencies, if the accident occurs
outside the Commonwealth of Kentucky;
Additionally, if the accident causing bodily
injury occurs outside the Commonwealth of
Kentucky, but within the United States, its
territories and possessions, or Canada, the
driver and other occupants of a bus, who have
not rejected the limitation upon their tort rights,
are Kentucky residents, and boarded a bus in
Kentucky, suffer loss from injury arising out of
maintenance of use of a motor vehicle have a
right to basic reparation benefits if the bus is a:
1. A secured vehicle;
2. registered in Kentucky;
3. regularly used in the course of business of
transporting persons or property; and
4. one (1) of five (5) or more vehicles under
common ownership.
(j) to bodily injury sustained by any person
arising out of the use of any motor vehicle
while located as a residence or premises;
(k) to bodily injury due to war, whether or not
declared, civil war, insurrection, rebellion or
revolution, or to any act or condition incident to
any of the foregoing;
(l) to bodily injury resulting from the radioactive,
toxic, explosive or other hazardous properties
of nuclear materials;
(m) to bodily injury sustained by any person while
occupying a motorcycle.
Definitions
When used in reference to this coverage:
"bodily injury" means bodily harm, sickness, disease,
or death;
"Eligible injured person" means:
(a) the named insured or any relative who
sustains bodily injury while occupying or
while a pedestrian through being struck by
any motor vehicle, provided that, if such
person has rejected the limitation upon his tort
rights pursuant to Kentucky Revised Statutes
Chapter 304, Sub Title 39, he shall not be an
eligible injured person, unless basic
personal injury protection coverage has
subsequently been purchased for such person
under this policy, or
(b) any other person who sustains bodily injury
while occupying or while a pedestrian
through being struck by the insured motor
vehicle, provided that, if such person has
rejected the limitation upon his tort rights
pursuant to Kentucky Revised Statutes
Chapter 304, Sub Title 39, he shall not be an
eligible injured person,
however, any rejection of tort limitations applicable
solely to motorcycles shall not affect the status of any
person as an eligible injured person with respect to any
motor vehicle other than a motorcycle;
"funeral expense" means reasonable charges
incurred for expenses in any way related to funeral,
cremation or burial;
"insured motor vehicle" means a motor vehicle with
respect to which:
(a) the bodily injury liability insurance of the
policy applies and for which a specific
premium is charged, and
(b) the named insured is required to maintain
security under the provisions of Kentucky
Revised Statutes chapter 304, Sub Title 39;
"medical expense" means reasonable charges
incurred for reasonably needed products, services, and
accommodation, including those for medical care,
physical rehabilitation, rehabilitative occupational
training, licensed ambulance services and other
remedial treatment and care, any nonmedical remedial
treatment rendered in accordance with a recognized
religious methods of healing, and any healing arts
professions of a type licensed by the Commonwealth

of Kentucky, provided that medical expense shall not
include that portion of a charge for a room in a
hospital, clinic, convalescent or nursing home, or any
other institution engaged in providing nursing care and
related services, in excess of a reasonable and
customary charge for semi-private accommodations,
unless intensive care is medically required;
"motor vehicle" means a vehicle as defined in
Kentucky Revised Statutes Chapter 304, Sub Title 39;
"named insured" means the person or organization
named in the Declarations;
"occupying" means in or upon, entering into or
alighting from;
"pedestrian" means a person who is not occupying a
motor vehicle at the time the injury occurs;
"relative" means the spouse and any person related to
the named insured by blood, marriage, or adoption
including a minor in the custody of the named
insured, spouse or such related person who is a
resident of the same household as the named
insured, whether or not temporarily residing
elsewhere, but does not include any such person who
is the named insured under any other policy providing
the security under Kentucky Revised Statutes Chapter
304, Sub Title 39;
"replacement services loss" means expenses
reasonably incurred in obtaining ordinary and
necessary services in lieu of those the eligible injured
person would have performed, not for income, but for
the benefit of himself or his family if he had not been
injured;
"survivor" means a person identified in Kentucky
Revised Statutes Section 411.130 as one entitled to
receive benefits by reason of the death of another
person;
"survivor's economic loss" means loss after the
eligible injured person's death of contributions of
things of economic value to his survivors, not
including services they would have received from the
eligible injured person had he not suffered the fatal
injury, less expenses of the survivors avoided by
reason of eligible injured person's death;
"survivor's replacement services loss" means
expenses reasonably incurred by survivors after the
eligible injured person's death in obtaining ordinary
and necessary services in lieu of those the eligible
injured person would have performed for their benefit
had he not suffered the fatal injury, less expenses of
the survivors avoided by reason of the eligible
injured person's death and not subtracted in
calculating survivor's economic loss;
"work loss" means loss of income from work the
eligible injured person would probably have
performed if he had not been injured, and expenses
reasonably incurred by him in obtaining services in lieu
of those he would have performed for income, reduced
by any income from substitute work actually performed
by him.
Policy Period; Territory
This coverage applies only to accidents which occur on
or after July 1, 1975 during the policy period and within
the United States of America, its territories or
possessions, or Canada.
Limits of Liability
Regardless of the number of persons insured, policies
or approved plans of self-insurance applicable, claims
made or insured motor vehicles to which this
coverage applies, the Company's liability for personal
injury protection benefits with respect to bodily injury
sustained by any one eligible injured person in any
one motor vehicle accident shall not exceed $10,000
in the aggregate, and subject to such aggregate limit:
1. the maximum amount payable for work loss,
replacement services loss, survivor's
economic loss, and survivor's replacement
services loss shall not exceed $200 per week
in the aggregate prorated for any lesser period,
provided that if the eligible injured person's
earnings or work are seasonal or irregular, the
weekly limit shall be equitably adjusted or
apportioned on an annual basis;
2. the maximum amount payable for funeral
expense shall not exceed $1,000.
Any amount payable by the Company under the terms
of this coverage shall be reduced by any applicable

deductible set forth in the Declarations Page, but only
with respect to bodily injury sustained by the named
insured or any relative, providing that, if two or more
such persons sustain bodily injury in the same motor
vehicle accident, such deductible applicable to all of
them shall not exceed such deductible amount and
such amount shall be allocated equally among them.
Provided further that, a named insured or relative is
entitled to receive under this coverage the difference
between this deductible and a greater deductible
applicable under another policy applying to personal
injury protection coverage pursuant to Kentucky
Revised Statutes Chapter 304, Sub Title 39.
In calculating loss or expense from which personal
injury protection benefits are payable under this
coverage, a reduction shall be made in the amount of:
1. all benefits or advantages a person receives or
is entitled to receive from social security
(excluding benefits under Medicare or
Medicaid) and workmen's compensation,
unless these benefits or advantages have not
been received before personal injury protection
benefits are overdue or the claim is paid;
2. any income tax saving resulting from benefits
or advantages received for loss of income
under this coverage or from like benefits or
advantages received under social security or
workmen's compensation which are not
considered taxable income, provided that the
maximum reduction may not exceed 15% of
the loss of income and shall be in lesser
amount if the claimant furnishes to the
Company reasonable proof of a lower value of
the income tax advantage.
Conditions
A. Action Against Company. No action shall lie
against the Company unless as a condition
precedent thereto, there shall have been full
compliance with all the terms of this coverage.
B. Notice. In the event of an accident, written notice
containing particulars sufficient to identify the
eligible injured person, and also reasonably
obtainable information respecting the time, place
and circumstances of the accident shall be given
by or on behalf of each eligible injured person to
the Company or any of its authorized agents as
soon as practicable.
With respect to Personal Injury Protection
Coverage Item C. Conditions replaces Item B.3.
from Part 5 - Duties After an Accident or Loss.
C. Medical Reports; Proof of Claim. As soon as
practicable, the eligible injured person or
someone on his behalf shall give to the Company
written proof of claim, under oath if required,
including full particulars of the nature and extent of
the bodily injury, treatment and rehabilitation
received and contemplated, and such other
information as may assist the Company in
determining the amount due and payable.
The eligible injured person shall submit to
physical and mental examination by physicians
provided the Company has petitioned the circuit
court for an order directing the eligible injured
person to submit to a mental or physical
examination by a physician. The order shall specify
the time, place, manner, conditions, scope of the
examination and the physician by whom it is to be
made.
D. Subrogation. Subject to the provisions of the
Kentucky Revised Statutes Chapter 304, Sub Title
39, in the event of any payment under this
coverage, the Company is subrogated to the rights
of the person to whom or for whose benefit such
payments were made to the extent of such
payments. Such person shall execute and deliver
the instruments and papers and do whatever else
is necessary to secure such rights. Such person
shall do nothing after loss to prejudice such rights.
E. Reimbursement and Trust Agreement. Subject
to the provisions of the Kentucky Revised Statutes
Chapter 304, Sub Title 39, in the event of the
payment to any person under this coverage:
1. the Company shall be entitled to the extent of
such payment to the proceeds of any
settlement or judgment that may result from
the exercise of any rights of recovery of such
person against any person or organization
legally responsible for the bodily injury
because of which such payment is made, and
the Company shall have a lien to the extent of
such payment, notice of which may be given to
the person or organization causing such

bodily injury, his agent, his insurer or a court
having jurisdiction in the matter;
2. such person shall hold in trust for the benefit of
the Company all rights of recovery which he
shall have against such other person or
organization because of such other person or
organization because of such bodily injury;
3. such person shall do whatever is proper to
secure and shall do nothing after loss to
prejudice such rights; and
4. such person shall execute and deliver to the
Company instruments and papers as may be
appropriate to secure the rights and
obligations of such person and the Company
established by this provision.
F. Non-Duplication of Benefits; Priority of
Payments; Other Insurance.
No eligible injured person shall recover duplicate
benefits for the same elements of loss under this
or any similar insurance, including approved
self-insurance plans. In the event an eligible
injured person has other similar insurance,
including approved self-insurance plans, available
and applicable to the accident, the maximum
recovery under all such insurance shall not exceed
the amount which would have been payable under
the provisions of the insurance providing the
highest dollar limit, and the Company shall not be
liable for a greater proportion of any loss to which
this coverage applies than the limit of liability
hereunder bears to the sum of the applicable limit
of liability of this coverage and such other
insurance.
SECTION II
In consideration of the coverage afforded under
Section II and the adjustment of applicable rates any
amount payable under uninsured motorists coverage
or automobile medical payments or expense
coverages afforded under this policy shall be excess
over any personal injury protection benefits paid or
payable but for the application of a deductible under
this or any other automobile insurance policy because
of bodily injury sustained by an eligible injured
person.
However, no eligible injured person may recover
duplicate benefits for the same element of loss.
SECTION III
Constitutionality Clause
The premium for and the coverages of the policy have
been established in reliance upon the Provisions of the
Kentucky Revised Statutes Chapter 304, Sub Title 39.
In the event a court of competent jurisdiction declares,
or enters a judgment the effect of which is to render,
the provisions of such statutes invalid or unenforceable
in whole or in part, the Company shall have the right to
recompute the premium payable for the policy and the
provisions of this endorsement shall be voidable or
subject to amendment at the option of the Company.
Notice to Policyholders
Acceptance of the coverage described in Kentucky
Revised Statutes Chapter 304, Sub Title 39, places
some limitations on your right to bring suit for bodily
injury, KRS 304.39-060 reads in part:
"(1) Any person who registers, operates, maintains
or uses a motor vehicle on the public roadways of
this Commonwealth shall, as a condition of such
registration, operation, maintenance or use of such
motor vehicle and use of the public roadways, be
deemed to have accepted the provisions of this
act, and in particular those provisions which are
contained in this Section.
(2)(a)Tort liability with respect to accidents
occurring in this Commonwealth and arising from
the ownership, maintenance, or use of a motor
vehicle is abolished for damages because of bodily
injury, sickness or disease to the extent the basic
reparation benefits provided in this Act are payable
therefor, or that would be payable but for any
deductible authorized by this Act, under any
insurance policy or other method of security
complying with the requirements of this Act, except
to the extent non-economic detriment qualifies
under subsection (2)(b) hereof.
(b)In any action of tort brought against the owner,
registrant, operator or occupant of a motor vehicle
with respect to which security has been provided
as required in this Act, or against any person or
organization legally responsible for his acts or

omissions, a plaintiff may recover damages in tort
for pain, suffering, mental anguish and
inconvenience because of bodily injury, sickness
or disease arising out of the ownership,
maintenance, operation or use of such motor
vehicle only in the event that the benefits which are
payable for such injury as medical expense or
which would be payable but for any exclusion or
deductible authorized by this Act exceed $1,000.00
or the injury or disease consists in whole or in part
of permanent disfigurement, a fracture to a
weight-bearing bone, a compound, comminuted,
displaced or compressed fracture, loss of a body
member, permanent injury within reasonable
medical probability, permanent loss of bodily
function or death. Any person who is entitled to
receive free medical and surgical benefits shall be
deemed in compliance with the requirements of
this subsection upon a showing that the medical
treatment received has an equivalent value of at
least $1,000.
(c)Tort liability is not so limited for injury to a
person who is not an owner, operator, maintainer
or user of a motor vehicle within subsection (1) of
this Section.
(3)Any person may refuse to consent to the
limitations of this tort rights and liabilities as
contained in this Section. Such rejection must be in
writing in a form to be prescribed by the
Department of Insurance and must have been

COVERAGE
It is agreed that the Basic Personal Injury Protection is
amended as shown in the Declarations, but only with
respect to any amount payable there under because of
bodily injury to an eligible injured person who is a
named insured or relative.
1. The absence of an entry in the Declarations
indicates no change in the limits shown in the
Basic Personal Injury Protection for such
benefit.
2. This coverage does not apply to bodily injury
sustained by any person while occupying or
while a pedestrian through having been
struck by a motor vehicle owned by such
person with respect to which the coverage
provided by Additional Personal Injury
Protection Coverage is not in effect.
3. Exclusion C of the Basic Personal Injury

Identity Theft Coverage
When this endorsement appears on the DeclarationsPage of your policy, we agree to provide thecoverage explained in this endorsement for anadditional premium and your agreement to all of theconditions contained in this endorsement.
1. Definition
a. When used in this endorsement,"identitytheft" means the unlawful, unauthorized useof your identity or a family member’s identitywith the intent to commit activities that arestatutorily defined as fraud or theft.
2. Coverage Provided
a. We will pay the following expenses, up to$10,000 as a result of any one occurrence,incurred by you or a family member as aresult of identity theft:
(1) costs incurred for notarizing fraudaffidavits or other similar financialinstitution documents.
(2) certified mail costs associated with thenotification of law enforcement agencies,credit agencies, financial institutions orsimilar credit grantors.
(3) lost wages due to time taken off work tomeet with, or talk to, law enforcementagencies, credit agencies or legal counsel.Up to a maximum payment of $500 perweek for a maximum period of fourweeks.
(4) duplicate loan application fees, if theoriginal application has been rejectedbecause the lender received incorrectcredit information.
(5) with our prior consent, reasonableattorney fees incurred for:
(a) defense of lawsuits brought againstyou or a family member bymerchants or their collectionagencies;
(b) the removal of any criminal or civiljudgments wrongly entered againstyou or a family member; and

3. Exclusions
a. Under this coverage, we will not pay for any:
(1) loss arising out of business pursuits ofyou or a family member; or
(2) expenses incurred due to any intentional,fraudulent, dishonest or criminal act byyou or a family member or any personacting in connection with you or a familymember, whether acting alone or togetherwith others.
4. Part E - Duties After an Accident or Loss
In addition to the duties listed in your policy underPart E - Duties After an Accident or Loss, a personseeking Identity Theft Coverage must alsoproduce receipts, bills or other records thatsupport the claim for expenses under thiscoverage.

Personal Auto Deductible Waiver
With respect to the coverage provided by this
endorsement and in consideration of the additional

For the purposes of this endorsement, a total loss is
when the amount necessary to repair or replace the
damaged property is equal to or exceeds its actual
cash value.
A. Waiver of Deductible - Collision, Other Than
Collision and Uninsured Motorists Property
Damage
For a your covered auto to which this
endorsement applies, as shown on the
Declarations Page, we will not subtract the
deductible for a covered loss under Part D -
Coverage for Damage to Your Auto, or Part C -
Uninsured Motorists Property Damage in the
following situations:
1. When the loss is a total loss; or
2. When you or a family member collide with
an uninsured motor vehicle. The operator of
the uninsured motor vehicle must be
positively identified and at least 50% at fault.
For the purposes of this coverage, an uninsured
motor vehicle does not include an underinsured
motor vehicle.
B. Waiver of Deductible - Other Personal Property
Coverages
If a loss covered by Part D - Coverage for
Damage to Your Auto occurs that also involves
loss to your personal property, insured by us or
an insurer who is a subsidiary or affiliate of ours,
while being transported by a your covered auto
to which this endorsement applies, the only
deductible that will apply to the entire property
loss is the applicable Collision or Other Than
Collision deductible for your covered auto. This
coverage does not apply to loss by theft except
when there is a total theft of the auto.
C. Waiver of Deductible for the Same Loss -
Damage to Your Covered Autos
When the same loss event covered under Other
Than Collision coverage of Part D - Coverage for
Damage to Your Auto of this policy results in
damage to more than one your covered auto
owned by you or a family member and insured
for Other Than Collision coverage by us or an
insurer who is a subsidiary or affiliate of ours, we
will apply one deductible amount to the entire loss
involving the covered damaged vehicles. The
deductible amount applied to the loss will be the
highest Other Than Collision deductible, shown on
the Declarations Page for the damaged vehicles.
The following provision stated in Part D -
Coverage For Damage To Your Auto of your
policy continues to apply:
We will not subtract the deductible amount for
breakage of glass if the glass is repaired and not
replaced.
D. Tax, Title, and Fees Coverage
In the event of a total loss to your covered auto
to which this endorsement applies as shown on
the Declarations Page, we will reimburse you, up
to a maximum of $1,000, for expenses you incur
for taxes, title, and fees in purchasing a
replacement vehicle.
The loss must be covered by Part D - Coverage
for Damage to Your Auto of this policy and, the
replacement vehicle must be purchased within
sixty days of the date that we reach a settlement
with you on the vehicle that is being replaced.
You must submit proper receipts to us for
expenses claimed under this coverage.

A. Electronic Equipment and Accessories

Players)
The provisions and exclusions that apply to Part D
- Coverage for Damage to Your Auto of the
policy also apply to this coverage except as
modified by this endorsement.
With respect to the vehicles shown on the
Declarations Page as subject to this endorsement,
we will pay for direct and accidental loss to:
1. Radios, compact disc players, cell phones
and smartphones, iPods, mp3 players,
electronic tablets and readers, and other
similar devices; and
2. Accessories to these devices, including
protective covers, adapter plugs or cords, ear
pieces or headphones, antennas, compact
discs and records.
B. This coverage applies only if the electronic
equipment and accessories described above:
1. Is your property or that of a family member;
2. At the time of loss is in your covered auto or
any non-owned auto; and
3. Is not permanently installed in your covered
auto or any non-owned auto.
C. The limit of our liability for all losses as a result of
any one occurrence shall not exceed $1,000,
regardless of the number of items damaged,
subject to a $100 deductible.
We will not pay for more than 1 claim or loss
under this coverage during the policy term.
D. Any person seeking coverage under this
endorsement must:
1. Promptly notify the police and complete a
police report for any item that is stolen;
2. Make an inventory of all damaged, destroyed
or stolen property showing in detail the:
quantity, cost, description, actual cash value
and amount of loss claimed. Attach all bills,
receipts and related documents that justify the
figures in the inventory;
3. Produce for examination, with permission to
copy, all books of account, bills, invoices,
receipts and other vouchers as we may
reasonably require, that support ownership of
the damaged, destroyed or stolen property.
E. Exclusions
In addition to the Part D - Coverage for Damage
to Your Auto Exclusion that apply to your policy,
the following exclusion also applies to this
coverage:
We will not pay for:
1. Loss or damage to, or the cost to restore,
programs, software, applications, songs,
games or any similar content contained in or
on the device or that the device accesses or
uses.
2. Loss or damage to devices covered by this
endorsement if the device was being used by
the driver to text messages while driving, or in
violation of the law.
3. Loss or damage to any equipment or devices
designed or used for the detection or location
of speed measuring equipment such as radar
or laser detectors and any jamming apparatus
intended to elude or disrupt speed
measurement equipment.

Personal Auto Pet Injury Coverage
With respect to the coverage provided by this

A. Pet Injury Coverage
1. Insuring Agreement
If a domestic dog or cat owned by you or a
family member sustains injury or death as a
result of a loss covered by this policy while
that domestic dog or cat is inside the
passenger compartment of your covered
auto or a non-owned auto, we will pay up to
$1,000 for:
a. Reasonable and customary veterinary
expenses incurred by you or a family
member as a result of injuries:
(1) Sustained by the domestic dog or cat
owned by you or a family member;
and
(2) Arising from the covered accident.
b. Replacement cost of your domestic dog
or cat if it dies in the covered accident.
2. Definitions
“Replacement cost” as used in this Pet Injury
Coverage means the cost actually incurred to
replace the deceased dog or cat within 90
days of the covered loss with one of like kind
and quality. It does not include any amounts
for veterinary bills, training, or any other
amounts other than the cost to replace the pet
itself.
3. Limits of Liability
Our limit of liability for any one covered loss
under this Pet Injury Coverage will be limited
to the least of the following:
a. The replacement cost of the deceased
dog or cat;
b. The amount actually paid for reasonable
and customary veterinary expenses
incurred by you or a family member
within 90 days from the date of loss;
c. The combination of 3.a. and 3.b. above;
or
d. $1,000.
Regardless of the number of domestic dogs or
cats owned by you or a family member that
are injured or die in the covered accident, our
total payment for any one loss is limited to
$1,000.
No deductible applies to this Pet Injury
Coverage.

Coverage
With respect to the coverage provided by this

For the purposes of this endorsement, a total loss is
when the amount necessary to repair or replace the
damaged property is equal to or exceeds its actual
cash value.
A. New Auto Replacement Cost Coverage
In the event of a covered total loss to your
covered auto to which this endorsement applies
as shown on the Declarations Page, we will pay to
replace that vehicle as explained in this coverage.
This New Auto Replacement Cost Coverage
applies if you are the original owner of the vehicle
and the vehicle was not previously titled. This
New Auto Replacement Cost Coverage does not
apply to:
1. Your covered auto that is a motor home,
snowmobile, golf cart, all-terrain vehicle, dune
buggy, go-cart, hovercraft, or similar type
vehicle;
2. A leased vehicle; and
3. Your covered auto if it is more than 2 years
old as determined by the purchase date on
your original title for that vehicle and the date
of loss.
B. The amount we will pay to replace your covered
auto will not exceed the cost of a new vehicle of
the same make and model with the same
equipment or, if a new vehicle of the same make
and model with the same equipment is not
available, the cost of a new vehicle that is similar
in:
1. Size, class, body type and equipment; and
2. Price you paid for your covered auto being
replaced, as adjusted for inflation, but not to
exceed an amount equal to 125% of the
Manufacturer's Suggested Retail Price of the
vehicle being replaced.
A new vehicle is one that has not been previously
titled and is of the latest model year available at
the time of the loss.
C. Any amounts payable under this New Auto
Replacement Cost Coverage will be reduced by:
1. Any amount paid or payable under Part D -
Coverage for Damage to Your Auto for
Other Than Collision, or Collision coverage of
this policy;
2. Any deductible for which you are responsible
under Part D - Coverage for Damage to
Your Auto for Other Than Collision, or
Collision coverage of this policy; and
3. The dollar amount of unrepaired damage
which occurred prior to the total loss of the
vehicle.

Coverages
With respect to the coverage provided by this
endorsement and in consideration of the additional

This Personal Auto Towing and Labor Costs
Coverages apply to a your covered auto to which
this endorsement applies and for which a specific
premium charge is made as shown on the
Declarations Page. This coverage also applies to a
non-owned auto while operated or used by you.
A. Towing and Labor Costs
1. If your covered auto or a non-owned auto
is disabled, we will pay the fair cost incurred
for:
a. Mechanical labor at the place of its
breakdown;
b. Towing to the nearest place where
necessary repairs can be made during
regular business hours if it will not run;
c. Towing it out if stuck on or immediately
next to a public highway; and
d. Delivery of gas, oil, loaned battery, or
change of tire. We do not pay for the cost
of these items.
B. Locksmith Coverage
We will reimburse you for the cost of emergency
locksmith services performed at the location of the
vehicle disablement, by a professional locksmith.
We will not pay more than $75 for each
occurrence. You must submit proper receipts to
us for expenses claimed under this coverage.
C. Lodging Coverage
When a loss covered by Part D - Coverage for
Damage to Your Auto of the policy occurs more
than 100 miles from the address shown on the
Declarations Page, we will reimburse you up to
$40 per day, up to a maximum of $200, for
lodging expenses you incur. The loss must
disable an auto to which this endorsement applies.
You must submit proper receipts to us for
expenses claimed under this coverage.
D. Air Bag Replacement Coverage
If an air bag of a vehicle to which this
endorsement applies deploys without the auto
being involved in an accident, we will reimburse
you for the cost of replacing the air bag.

This Personal Auto Rental Reimbursement /
Transportation Expenses Coverage applies to a your
covered auto to which this endorsement applies and
for which a specific premium charge is made as shown
on the Declarations Page.
A. Rental Reimbursement / Transportation
Expenses
1. We will reimburse you for expenses you incur
to rent a substitute auto. This coverage applies
only if:
a. Your covered auto is withdrawn from use
for more than 24 hours; and
b. The loss is caused by collision, or is
covered under Part D - Coverage for
Damage to Your Auto of this policy.
However, this coverage does not apply when
there is a total theft of the auto.
2. The Transportation Expenses coverage of Part
D - Coverage for Damage to Your Auto, is
replaced by the following:
a. In addition, we will pay up to the lower of
the daily or maximum limit stated on the
Declarations Page for transportation
expenses incurred by you. This applies
only in the event of the total theft of your
covered auto. We will pay only
transportation expenses incurred
beginning 24 hours after the theft.
3. Our payment under paragraph A.1. and A.2. of
this Rental Reimbursement / Transportation
Expense will be limited to the earliest of the
following:
a. When your covered auto has been
returned to you;
b. When your covered auto has been
repaired;
c. When your covered auto has been
replaced;
d. That period of time reasonably required to
repair your covered auto; or
e. 72 hours after we make an offer to settle
the loss if your covered auto is deemed

rental charges to be reimbursed.
B. Rental Car Loss of Use Coverage
If there is a covered Collision or Other Than
Collision loss to a private passenger auto that you
rent from a licensed rental car agency, we will
reimburse you up to $1,000 for the rental fee,
which would have been paid had the rental car not
been damaged, subject to the following conditions:
1. You must be liable by contract to continue
payment of the rental fee as the result of a
covered loss, that would prevent rental of this
private passenger auto to others by the
licensed rental agency.
2. The coverage period will begin the day
following the date of the loss, which resulted in
the rental car being unavailable for use,
provided that you have promptly notified us of
the loss or damage. The coverage period will
end, regardless of the expiration of the policy
term:
a. The day the repairs are completed; or
b. The day we make payment for
replacement of the rental car; or

Dear Policyholder:
Kentucky House Bill 497 (Effective July 12, 2012) requires insurers that use credit information to provide
reasonable exceptions to its rates, rating classifications, company/tier placement, or underwriting rules and/or
guidelines to an insurance policyholder whose credit has been directly and adversely influenced by any of the
following events:
· Catastrophic events, as declared by the state or federal government;
· Serious illness or injury, or serious illness or injury to an immediate family member;
· Death of spouse, child, or parent;
· Divorce or involuntary interruption of legally-owed alimony or support payments;
· Identity theft;
· Temporary loss of employment for a period of three (3) months or more resulting from involuntary
termination; or
· Military deployment overseas.
If a policyholder submits a request for an exception within sixty (60) days from the date of the application or
renewal (if applicable), we may require the person to provide reasonable documentation to verify the event and
demonstrate that the event negatively impacted the policyholder's insurance score. Within thirty (30) days of
receipt of the documentation verifying the event, we shall notify the policyholder about the outcome of the
request.

Personal Auto Plus Endorsement
1.For the additional premium charged for eachvehicle, the provisions and exclusions that apply tothe policy also apply to this endorsement, except asmodified by this endorsement.
You must be liable by contract to continuepayment of the rental fee as the result of acovered loss, that would prevent rental of thisprivate passenger auto to others by thelicensed rental agency.
For the purposes of this endorsement, a total loss iswhen the amount necessary to repair or replace thedamaged property is equal to or exceeds its actualcash value.
2. The coverage period will begin the dayfollowing the date of the loss, which resultedin the rental car being unavailable for use,provided that you have promptly notified usof the loss or damage. The coverage periodwill end, regardless of the expiration of thepolicy term:
A. Waiver of Deductible - Collision and OtherThan Collision
We will not subtract the deductible for a coveredloss in the following situations:
a. the day the repairs are completed; or1. When the loss is a total loss; or, b. the day we make payment for replacement
of the rental car; or2. When you collide with an uninsured motorvehicle. The operator of the uninsured motorvehicle must be positively identified and atleast 50% at fault.
c. thirty days after the date that this coverageperiod begins;
whichever comes first. However, coverage willnot exceed a period longer than that requiredwith the exercise of due diligence and dispatchto repair or replace the rental car.
For the purposes of this coverage, an uninsuredmotor vehicle does not include an underinsuredmotor vehicle.
B. Waiver of Deductible - Other Personal PropertyCoverages
You must submit proper receipts to us forexpenses claimed under this coverage.
If a loss covered by Part D occurs, that alsoinvolves loss to your personal property insuredby us, while being transported by an auto towhich this endorsement applies, the onlydeductible that will apply to the entire propertyloss is the Collision or Other Than Collisiondeductible for the covered auto. This coveragedoes not apply to loss by theft except when thereis a total theft of the auto.
Tax, Title, and Fees CoverageD.
In the event of a total loss to a vehicle to whichthis endorsement applies, we will reimburse you,up to a maximum of $1,000, for expenses youincur for taxes, title, and fees in purchasing areplacement auto.
The loss must be covered by Part D of this policyand, the replacement auto must be purchasedwithin sixty days of the date that we reach asettlement with you on the auto that is beingreplaced.
C. Rental Car Loss of Use Coverage
If there is a Collision or Other Than Collisionloss to a private passenger auto that you rentfrom a licensed rental car agency, we willreimburse you up to $1,000 for the rental fee,which would have been paid had the rental carnot been damaged, subject to the followingconditions:

Lodging CoverageF.I. New Auto Replacement Cost Coverage
When a loss covered by Part D of the policyoccurs more than 100 miles from the addressshown in the Declarations, we will reimburse youup to $40 per day, up to a maximum of $200, forlodging expenses you incur. The loss must disablean auto to which this endorsement applies.
In the event of a covered total loss to yourcovered auto to which this endorsement appliesas shown on the Declarations Page, we will payto replace that vehicle as explained in thiscoverage. This New Auto Replacement CostCoverage applies if you are the original owner ofthe vehicle and the vehicle was not previouslytitled. This New Auto Replacement CostCoverage does not apply to:

G. Electronic Equipment and Accessories
The provisions and exclusions that apply to PartD of the policy also apply to this section of thisendorsement except Exclusion 4. and anydeductible.

Personal Auto Plus Endorsement
A new vehicle is one that has not beenpreviously titled and is of the latest model yearavailable at the time of the loss.
Any amounts payable under this New AutoReplacement Cost Coverage will be reduced by:
1. any amount paid or payable under Part D -Coverage for Damage to Your Auto for OtherThan Collision, or Collision coverage of thispolicy;
2. any deductible for which you are responsibleunder Part D - Coverage for Damage to YourAuto for Other Than Collision, or Collisioncoverage of this policy; and
3. the dollar amount of unrepaired damagewhich occurred prior to the total loss of thevehicle.
J. Waiver of Deductible for the Same Loss -Damage to Your Covered Autos
When the same loss event covered under OtherThan Collision coverage of Part D of this policyresults in damage to more than one vehicleowned by you or a family member and insuredfor Other Than Collision coverage by us or aninsurer who is a subsidiary or affiliate of ours,we will apply one deductible amount to theentire loss involving the covered damagedvehicles. The deductible amount applied to theloss will be the highest Other Than Collisiondeductible, shown on the Declarations Page forthe damaged vehicles.
The following provision stated in Part D of yourpolicy continues to apply:
We will not subtract the deductible amount forbreakage of glass if the glass is repaired and notreplaced.
