The proposal was considered by the EAC in its 143 rd meeting held on 6 th - 7thJanuary, 2015 and the proponent has informed that: 1. The project proponent is State Industries Promotion Corporation of Tamil Nadu(SIPCOT) which is the Industrial Infrastructure promoting organization of Government of Tamil Nadu (GoTN).SIPCOTis the nodal agency of Government of Tamil Nadu, established in the year 1971 to develop industrial Zones with developed lands for promoting industrial growth in Tamil Nadu. The objective of SIPCOT is to establish, develop, maintain and manage industrial complexes, parks and growth centres at various places across the State of Tamil Nadu. 11. The proposed Industrial Park at Tuticorin in the Southern Tamil Nadu is an initiative of the Government to support the growth of Industries in cluster as an Environmentally Balancing Industrial Complex (EBIC). This IP will be complimented for growth by the nearby Port and mushrooming Power Plant projects in the project location. iii. The proposed Industrial park is envisaged to accommodate industries that fall under listed Project Activities or Sectors under the purview of Environmental Clearance viz., Thermal Power Plants l(d), Metallurgical Industries 3(a), Chemical Fertilizers 5(a), Synthetic Organic Chemicals 5(~, Induction/ Arc Furnaces/Cupola Furnaces 5TPH or more 5(k) and Isolated Storage & Handling of Hazardous Chemicals 6(b). However, in the case of Thermal Power Plants (ld), only Category B will be given land allotment; where as in the rest of the five proposed Sectors, both A and B as categorized in EIA Notification, 2006 and amendments thereof, will be ToR_SIPCOT_ Tu ticorin. Sir,

This has reference to your letter No. D/EIA/Tuticorin/2014 dated27.10.2014 forwarding along with application seeking for Terms of Reference forthe aforesaid project.

2. The proposal was considered by the EAC in its 143rd meeting held on 6th -7thJanuary, 2015 and the proponent has informed that:

1. The project proponent is State Industries Promotion Corporation of TamilNadu(SIPCOT) which is the Industrial Infrastructure promotingorganization of Government of Tamil Nadu (GoTN).SIPCOTis the nodalagency of Government of Tamil Nadu, established in the year 1971 todevelop industrial Zones with developed lands for promoting industrialgrowth in Tamil Nadu. The objective of SIPCOT is to establish, develop,maintain and manage industrial complexes, parks and growth centres atvarious places across the State of Tamil Nadu.

11. The proposed Industrial Park at Tuticorin in the Southern Tamil Nadu isan initiative of the Government to support the growth of Industries incluster as an Environmentally Balancing Industrial Complex (EBIC). iii. considered for allotment. The Park will also accommodate other industriesthat are not classified in the EIA Notification but classified by Tamil NaduPollution Control Board (TNPCB)viz. red, ultra red, orange or green.

iv. The total land area of the Industrial Park would be 654.42 Ha of landsfalling in the revenue villages of Therkuveerapandiyapuram andMeelavittan Villages, Ottapidaram Taluk, Tuticorin District.

v. It is assessed that 2 MGD will be the requirement of water and it will bemade available from the approved withdrawal for SIPCOT from RiverTamiraparani. Member industries will be mandated to submit a "ZeroDisposal" Scheme on a detailed effluent management plan.

vi. The effluent must be collected, treated, and reused by recycling. Anyresidues out of solids-separation (sludge) will be disposed off throughapproved TSDF. The common facilities like Water, Power, Roads, Stormwater lines and the like will be fully managed by SIPCOT.The entire 654.42Ha property, which is measured for 27000 m periphery line, will beprovided with green belt of 20m width, all along. This will ensure 270000sqm (3.86% of the plot area 654.42 Ha) of green belt.

vii.The environmental monitoring of the member industries will be jointlycarried out with respective industries, PCB and a coordinator from SIPCOT.

viii.The time schedule of project execution, of land development and getting theIE commissioned, is proposed for 2 years. The Budgetary Estimate of theproject is assessed for Rs.250 Crore.

ix. Wildlife issues: It is not located within 10 km of Eco-Sensitive areas.x. There are no court cases/violation pending with the project proponent.

3. The Expert Appraisal Committee (EAC)has considered the proposal in its143rd meeting held on 6th - 7th January, 2015 and recommended for the TORwith the following specific TOR with general conditions for preparation of theEnvironment Impact Assessment (EIA) Report and Environment ManagementPlan (EMP)in respect of the Development of SIPCOTIndustrial Park Tuticorinat Therkuveerapandiyapuram, Meelavittan, Sillanatham, Nainapuram,Swaminatham, Pudiampattu, Tamil Nadu by M/s State Industries PromotionCorporation of Tamil Nadu Limited:

(i) Reasons for selecting the site with details of alternate sitesexamined/rejected/ selected on merit with comparative statementand reason/basis for selection. The examination should justify thesite suitability in terms of environmental damages, resourcessustainability associated with selected site as compared to rejectedsites. The analysis should include parameters considered along withweightage criteria for short-listing selected site.

(ii) Details of the land use break-up for the proposed project. Details ofland use around 10 km radius of the project site. Analysis should bemade based on latest satellite imagery for land use with raw imagesbe submitted.

(iii) Details of environmentally sensitive places, land acquisition status,rehabilitation of communities/ villages and present status of suchactivities be submitted.

(iv) Examine the impact of proposed project on the nearest settlements.ToR_SIPCOT_Tuticorin. Page 2 of6

(v) Examine baseline environmental quality along with projectedincremental load due to the project taking into account of theexisting developments nearby.

(vi) Environmental data to be considered in relation to the projectdevelopment would be (a) land, (b) groundwater, (c) surface water, (d)air, (e) bio-diversity, (f) noise and vibrations, (g) socio economic andhealth.

(vii) Submit a copy of the contour plan with slopes, drainage pattern ofthe site and surrounding area.

(viii) Details regarding project boundary passing through any eco-sensitive area and within 10 km from eco- sensitive area.

(ix) Green buffer in the form of green belt to a width of 15 meters shouldbe provided all along the periphery of the industrial area. Theindividual units should keep 33% of the allotted area as a green area.

(x) Submit the details of the trees to be felled for the project.

(xi) Submit the details of the infrastructure to be developed.

(xii) Submit the present land use and permission required for anyconversion such as forest, agriculture etc.

(xiii) Submit details regarding R&Rinvolved in the project.

(xiv) Zoning of the area in terms of 'type of industries' coming-up in theindustrial area based on the resource requirement along with likelypollutants with quantity from the various industries.

(xv) The project boundary area and study area for which the base linedata is generated should be indicated through a suitable map.Justification of the parameters, frequency and locations shall bediscussed in the EIA.

(xvi) Submit legal frame work for the implementation of EnvironmentalClearance conditions - to be clearly spelt out in the EIA report.

(xvii) Submit roles and responsibility of the developer etc for compliance ofenvironmental regulations under the provisions of EP Act.

(xviii) Site justification of the identified industry sectors fromenvironmental angel and the details of the studies conducted if any.

(xix) Ground water classification as per the Central Ground WaterAuthority.

(xx) Submit the source of water, requirement vis-a-vis waste water to begenerated along with treatment facilities, use of treated waste wateralong with water balance chart.

(xxi) Rain water harvesting proposals should be made with duesafeguards for ground water quality. Maximize recycling of water andutilization of rain water. Examine details.

(xxii) Examine soil characteristics and depth of ground water table forrainwater harvesting.

(xxiii) Examine details of solid waste generation treatment and its disposal.

(xxiv) Examine and submit details of use of solar energy and alternativesource of energy to reduce the fossil energy consumption.

(xxv) DG sets are likely to be used during construction and operationalphase of the project. Emissions from DG sets must be taken intoconsideration while estimating the impacts on air environment.Examine and submit details.

(xxvi) Examine road/rail connectivity to the project site and impact on thetraffic due to the proposed project. Present and future traffic andtransport facilities for the region should be analysed with measuresfor preventing traffic congestion and providing faster trouble freesystem to reach different destinations in the city.

(xxvii)A detailed traffic and transportation study should be made forexisting and projected passenger and cargo traffic.

(xxviii)Examine the details of transport of materials for construction whichshould include source and availability.

(xxix) Examine the details of National Highways/State Highways/expressways falling along the corridor and the impact of thedevelopment on them.

(xxx) Examine noise levels - present and future with noise abatementmeasures.

(xxxi) Identify, predict and assess the environmental and sociologicalimpacts on account of the project. A detailed description with costsestimates of CSR should be incorporated in the EIA / EMP report.

(xxxii)Examine separately the details for construction and operation phasesboth for Environmental Management Plan and EnvironmentalMonitoring Plan with cost and parameters.

(xxxiii)Submit details of a comprehensive Disaster Management Planincluding emergency evacuation during natural and man-madedisaster.

General Guidelines

(i) The EIA document shall be printed on both sides, as for as possible.

(ii) All documents should be properly indexed, page numbered.

(iii) Period/ date of data collection should be clearly indicated.

(iv) Authenticated English translation of all material provided in Regionallanguages.

(v) The letter/application for EC should quote the MoEF&CC File No.and also attach a copy of the letter prescribing the TOR.

(vi) The copy of the letter received from the Ministry on the TORprescribed for the project should be attached as an annexure to thefinal EIA-EMPReport.

(vii) The final EIA-EMPreport submitted to the Ministry must incorporatethe issues in TOR and that raised in Public Hearing. The index of thefinal EIA-EMPreport, must indicate the specific chapter and page no.of the EIA-EMPReport where the specific TOR prescribed by Ministryand the issue raised in the P.H. have been incorporated.Questionnaire related to the project (posted on MoEF&CC website)with all sections duly filled in shall also be submitted at the time ofapplying for EC.

(viii) Grant of TOR does not mean grant of EC.

(ix) Grant of TOR/EC to the present project does not mean grant ofapprovals in other regulations such as the Forest (Conservation) Act1980 or the Wildlife (Protection) Act, 1972.

(x) Grant of EC is also subject to Circulars issued under the EIANotification 2006, which are available on the MoEF&CC website:www.envfor.nic.in.

(xi) The status of accreditation of the EIA consultant with NABET/ QC]shall be specifically mentioned. The consultant shall certify that hisaccreditation is for the sector for which this EIA is prepared.

(xii) On the front page of EIA/EMP reports, the name of theconsultant/ consultancy firm along with their complete detailsincluding their accreditation, if any shall be indicated. Theconsultant while submitting the EIA/EMP report shall give anundertaking to the effect that the prescribed TORs (TORproposed bythe project proponent and additional TOR given by the MoEF) havebeen complied with and the data submitted is factually correct (ReferMoEF office memorandum dated 4th August, 2009).

(xiii) While submitting the EIA/EMP reports, the name of the expertsassociated with/involved in the preparation of these reports and thelaboratories through which the samples have been got analysedshould be stated in the report. It shall clearly be indicated whetherthese laboratories are approved under the Environment (Protection)Act, 1986 and the rules made there under (Please refer MoEF officememorandum dated 4th August, 2009). The project leader of the EIAstudy shall also be mentioned.

(xiv) All the TOR points as presented before the Expert AppraisalCommittee (EAC)shall be covered.

4. A detailed draft EIA/EMP report should be prepared in terms of the aboveadditional ToRs and should be submitted to the State Pollution Control Board forconduct of Public Hearing. Public Hearing to be conducted for the project inaccordance with the provisions of Environmental Impact Assessment Notification,2006 and the issues raised by the public should be addressed in theEnvironmental Management Plan. The Public Hearing should be conducted basedon the ToR letter issued by the Ministry and not on the basis of Minutes of theMeeting available on the web-site.

5. You are required to submit the detailed final EIA/EMP prepared as perToRs including issues raised during Public Hearing to the Ministry for consideringthe proposal for environmental clearance within 3 years as per the MoEF&CCO.M. No.J-11013/41/2006-IA-II(I) (P)dated 08.10.2014.

6. The consultants involved in the preparation of EIA/EMP report afteraccreditation with Quality Council of India/National Accreditation Board ofEducation and Training (QCI/NABET)would need to include a certificate in thisregard in the EIA/EMP reports prepared by them and data provided by otherOrganization(s)/Laboratories including their status of approvals etc. videnotification of the MoEF dated 19.07.2013.

7. The prescribed ToRs would be valid for a period of three years forsubmission of the EIA/EMP Reports.
