MI-IjNGjEIAj2015j03 dated 21.02.2015 and subsequent letter dated 04.06.2015, SUbmitting the above mentioned proposal to this Ministry for grant of Environmental and Cl~Z Clearance in term of the provisions of the Environment Impact Assessment (Ii:TA) Notification, 2006 and Coastal Regulation Zone (CI~Z) Notification, 2011 under the .Environment (Protection), Act, 1986. 2. The proposal for 'All weather Greenfield Jetty' at Nandgaon of Taluka Palghar, District Thane (Maharashtra) by MIs JSW Infrastructure Ltd, was considered by the Expert Appraisal Committee (Ji-::AC)in the Ministry for Infrastructure Development, Coastal Regulation Zone, Buildingj Construction and Miscellaneous projects, in its meetings held on 23 rci -- 24th April, 2015 and 24th - 26 th June, 2015. 3. The details of the proj ect, as per the documents su bmi ttcd by the proj cct proponents (PP), and also as informed during the above said EAC meetings, are reported to be as under:- (i) The project was accorded TOR vide letter no. F.No.11-85j2011-IA-III dated 17.02.2012. (ii) The proposal involves development of All-weather Multi Cargo Captive .Ictty in green field site in village Nandgaon of Taluk Palghar, Disrrict Thane (Maharashtra). It would be breakwaters protected, dragged basin type of port. (iii) The proposed jetty at Nandgaon, Maharashtra, would cater to the local demands of the MIDC as well as the partial demand of the nation as far as the container traffic is concerned at a later date, when the Dedicated Freight Corridor is operational. The proposed jetty is expected to handle about 8.4 million tons of cargo, which is to be increased to 16.7 million tons in next 10 years. r

This has reference to your letter no MI-IjNGjEIAj2015j03 dated21022015 and subsequent letter dated 04062015 SUbmitting the abovementioned proposal to this Ministry for grant of Environmental and Cl~ZClearance in term of the provisions of the Environment Impact Assessment (IiTA)Notification 2006 and Coastal Regulation Zone (CI~Z) Notification 2011 underthe Environment (Protection) Act 1986

2 The proposal for All weather Greenfield Jetty at Nandgaon of TalukaPalghar District Thane (Maharashtra) by MIs JSW Infrastructure Ltd wasconsidered by the Expert Appraisal Committee (Ji-AC)in the Ministry forInfrastructure Development Coastal Regulation Zone Buildingj Constructionand Miscellaneous projects in its meetings held on 23rci -- 24th April 2015 and24th - 26th June 2015

3 The details of the proj ect as per the documents su bmi ttcd by the proj cctproponents (PP) and also as informed during the above said EAC meetings arereported to be as under-

(i) The project was accorded TOR vide letter no FNo11-85j2011-IA-III dated17022012(ii) The proposal involves development of All-weather Multi Cargo Captive Icttyin green field site in village Nandgaon of Taluk Palghar Disrrict Thane(Maharashtra) It would be breakwaters protected dragged basin type of port(iii) The proposed jetty at Nandgaon Maharashtra would cater to the localdemands of the MIDC as well as the partial demand of the nation as far as thecontainer traffic is concerned at a later date when the Dedicated Freight Corridoris operational The proposed jetty is expected to handle about 84 million tons ofcargo which is to be increased to 167 million tons in next 10 years r

(iv) The cargo to be handled in the first phase would mainly consist of solidcargo such as coal coking coal fertiliser cement and Clinker iron and steelcontainers automobiles miscellaneous cargo such as food grains shulpursugar pulp newsprint scrap and liquid cargo such as LNG Chemicals and POL(v) Alternative sites were examined along with coastline spanning between theMumbai region and the Maharashtra - Gujarat Boarder After multi-criteriaanalysis site at Nanadgaon has been selected The location is 110 km north ofMumbai and is about 8 km from Boisar railway station and 23 km from NationalHighway No8 The approximate geographical coordinate of the Port lies betweenLat 1go 45 44 and 1go 47 03 North (root of south breakwater) and Long 720

41 10 East (root of north breakwater](vi) There are no mangrovcs in the proposed jetty area The nearest mangrovepatch is about 5 km way from the proposed project site No destruction ofmangroves is envisaged due to proposed port development(vii) The shoreline in the vicinity of the proposed location is generally rocky andfronts a narrow beach The rocky outcrop on the coastline affords protection fromthe northern side from waves coming from the southern side (monsoon period)(viii) At the location the udal flat is 300m to 400m wide The beach is sandy andpebbles can be seen on the beach The area behind the tidal flat is lightly builtup The area would be suitable for creating areas of storage and transit shedwhich would be created by reclamation(ix) The jetty will be designed to handle Panamax sized vessels in the firstphase and cape size carriers in the final phase Six berths for solid cargo such ascoal coking coal fertiliser cement and clinker iron and steel containers andliquid cargo handling is proposed during Phase-I with total continuous quaylength of about 1500 meter Tn addition to this there would be a dedicated berthfor coal LNG and three berths for chemicals and other liquid cargo(x) The jctty will have two breakwaters protecting the berths and to maintaintranquillity North Breakwater is approximately 65 km and the SouthBreakwater is approximately 52 km(xi) The first phase channel will have a navigable depth of around 15 m whichwould be increased to 198 m in the final phase The channel will be 15 meterdeep 200 meters wide and approximately 42 meters long The handlingequipments would be fully or semi-meehanised and fully equipped to preventpollution while achicving high degree of efficiency(xii) The capital dredging to a quantity of 10 million m shall be carried out tofacilitate the navigation It is proposed to utilise the dredged spoil for reclamationwherever possible It is proposed to reclaim an area of approximately 210hectares for the development The maintenance dredging is likely to be 12million m-(xiii) Water requirement is 800 m3 d which will be met through MIDCWastewater generation will be 336 m day The treated water will be used forgardening and sprinkling in the jetty premises(xiv) 33( of the land would be reserved for green belt development(xv) The utilities and amenities to be developed will include Gate complexstorm water drainages STP internal road fircfighting facility workshopelectrical substation canteen and administrative offices rail siding portcommunication and navigational aid(xvi) The shoreline erosion and accretion study prepared by the Institute ofOcean Management (IC)M) Anna University Chennai and the Model study onLittoral drift and shoreline changes done by CWPRS Pune suggest that theshoreline arc in low erosion and medium accretion zone The study also suggestsadverse impacts on the shoreline 1ECampCI~ JSWIL Jetty Na ndgaon f-- ) Page ~ of C)

(xvii) IRS Chennai has demarcated HTLLTL for the project The project site fallsin CRZ-I (B) CRZ-III and CRZ-IV As per the demarcation the LNCl Jetty PC)LJetty Tankage area comes under CRZ-IV area and remaining allied activities fallsin CRZ l(B) and CRZ-Ill(xviii) InvestmentCost The total cost of the project is Rs 1175 crores(xix) SCZMA Approval The Maharashtra Coastal Zone Management Authority(MCZMA) has recommended the project vide letter No CRZ-2012CR-242TC-4dated 24022015(xx) Public Hearing The Public Hearing was conducted by MaharashtraPollution Control Board on 07102012 at Tarapur Vidya Mandir MIDC Tarapur(xxi) Commissioner of Fisheries Government of Maharashtra vide letter dated13012014 has accorded NOC to the project with certain specific and generalconditions(xxii) Employment potential The project IS expected to generate theemployment opportunity(xxiii) Benefits of the project The local people will be benefited through CSRactivities Socio-economic condition of the local people shall improve Green beltaround the project will improve the aesthetic of the area and revenue generationto the state government

4 The EAC in its meeting held on 23rd - 24th April 2015 sought informationbasis of ranking assigning numerical values to various parameters used inmatrix for site selection Dredging Plan and details of plants to be used fordevelopment of G-reen belt The Project Proponent (PP) submitted information andinformed that

(i) Basis of ranking and assigning numerical values to various parameters usedin Matrix for site selection and evaluation procedure for alternative sites wereexplained to EAC The PP informed that alternative sites for the proposedGreenfield Jetty (Port Phase I) were examined in the hinterland Accordinglycoast line from the Mumbai in the south to the Gujarat border in the northwas studied However choice limited to the Maharashtra coastline as it isnear to Mumbai Besides favourable concession terms are offered from theMaharashtra Maritime Board Therefore of the various alternatives examinedalong these coastlines only three options as below were considered for thefinal evaluation of the site

a Lagoon Harbour near Wadhvan Pointb ()uter Harbour to the North of the Virar Creekc Outer Harbour at Nandgaon

(ii)The positive attributes associated with Wadhvan point are no breakwaterconstruction good founding soil condition reduced the cost and relativelydeeper contours (depth) located close to shoreline However the drawbackassociated with this site includes rocky soil condition blasting required forcreation of harbour basin close proximity of Dahanu Eco-scrrsitivc area (~7km) and private land required to be acquired for the development

(iii)The positive attributes associated with Virar Creek Site includes no exposedrocks soft strata dredgeble and deeper depth in the ncar shore region Thedraw backs arc ie site is close to Sanjay Garidhi National Park and MMRregion which may pose traffic constraints on secondary and primaryevacuation routes and high siltation rates due to creek sediment load Thedrawbacks associated with the proposed project site are ic deep water is farfrom the shore and the length of breakwater will be more The positiveattributes for this sites are namely that the site is located on an qmbayment

with a stable shoreline the foreshore area is rocky with a wide rockyintertidal zone 0 m contour is about 15 km from the shoreline coastalharbour is proposed with reclaimed area for port backup proximity to rail androad network land is to be acquired for road and rail access only

(iv)Regarding dredging plan PP informed that total quantity envisaged fordredging is 10OOO000m3 The number of berths considered for dredging is10 The design depth is 150 m below CD The Channel width will be 200 mwith Turning circle of 700 meter in diameter and channel length of 3000meters It is proposed to deploy one Cutter Suction Dredger which is suitablefor near-shore low draft (-18 m CD) dredging one Backhoe Dredgersupported by dumb SP barges which is suitable for hard stratal rock and twoTrailer Suction Hopper Dredger which arc suitable for channel dredging up to(-22 m CD) It is proposed to complete the dredging works in one fair weatherseason ie during October to March

(v) Regarding plants to be used for green belt PP informed that species selectedarc from working plan of Forest Department Dahanu and in consultation withthe concerned Regional Forest Officer The outer boundary will includeplantation of Pinc z Sur u Asopalav ChinchImli The Middle fringe will haveMango Shirish Jarnbul The Inner area will have Gulmohur Karanj Ghaneriand Morning glory This is proposed to have evergreen deciduous indigenousand ecologically compatible and agro - climatically suitable green belt Thebel t will be hardy dust capturing and wind breaking

5 The EAC informed Pl that the Ministry has received a complaint allegingthat the project has been opposed by the farmers of 40 villages in vicinity to theproposed project sites IACrequested to provide details of issues raised duringPublic Hearing and the proposed Environment Management Plan PP informedthat during the public hearing they were not provided with the opportunity todescribe about the project and benefits from the project offered by the proponentto villages The major issue that emerged during public hearing arc

(a) Unemployment due to loss of livelihood sources based on the fishingactivities business

(b) fishing net will be destroyed due to vessel movement in the Port area(c) blockage in the creeks and it will impact on the fishing activity(d) development of roads and widening of existing road is proposed the private

land be acquired for the purpose(e) land acquisition on large scale is propose thus displacement of fisherman

communityCD reclamation may change the water current direction may cause

destruction and risk to the villages in coastal area(g) breakwaters will be constructed on northern as well as southern side thus

the tide flow would be difficult to analyze and may pose danger to thefishermen

(h) shoreline change in terms of erosion and accretion in the proposed projectarea

(i) intertidal zone is most fertile and rich biodiversity that will be destroyeddue to land reclamation

U) project require 800 m3 day of water during the operation phase But thereis no water supply either in Nandgaon or the nearby villages and

(k) spillage of oil and waste water will occur during the ship movement due tothis the fish activity will be destroyed

6 The EAC enquired about the activities proposed under the Corporate SocialResponsibility (CSR) In response PP informed that the CSI~ activity is plannedfor the social benefit of the local fisherman and farm community The adequatejob opportunities both direct and indirect would be created for the local youthsby the way of implementation 0 this project Preference for small jobs will begiven to the locals based on their qualification and expertise Education sectorwill be improved with the adequate CSR plan Free scholarships will be given tothe poor students Regarding other issues raised during the hearing by localfishermen PP informed that vessels will move in well-defined channels markedwith buoys to avoid any damage to fishing nets The spillage of oil and wastewater is prohibited and would be monitored by the DG shipping and MPCB Asper modelling study by CWPRS Pune no adverse impact on fishing active orshoreline is envisaged The construction of the breakwater will create tranquilconditions inside the harbor by dissipating the higher wave energies Thebreakwaters do not have any other impacts on the tidal heights or any othermarine parameters The road and the rail corridor will be developed withou taffecting the present roads The present roads wherever necessary would bestrengthened and widened through the Public Works Department The landrequirement for such roads is much less and if any private land is involved it willbe purchased from the land owners directly through negotiations Even if thegovernment acquisition is necessitated providing adequate compensation wouldbe JSWILsmoral obligation

7 Project Proponent and the EIA Consultant namely M s Wapcos India Ltdhave presented EIA EMP report as per the TOR EAC has found the EIA EMPReport and additional information to be adequate and in full consonance with thepresented TORsThe EAC after detailed deliberation recommended the project inits meeting held on 24th - 26th June 2015 and 18th - 20th November 2015 forgrant of Environmental and CRZ Clearance As per the recommendations of I~ACthe Ministry of Environment Forest amp Climate Change hereby accordsEnvironmental and CRZ Clearance for the above-mentioned project All weatherGreenfield Jetty at Nandgaon of Taluka Palghar District Thane(Maharashtra) by M s JSW Infrastructure Ltd under the provisions of theEnvironment Impact Assessment Notification 2006 amp Coastal Regulation Zone(CI~Z)Notification 2011 and amendments thereto and Circulars issued thereonand subject to the compliance of the following specific conditions in addition tothe general conditions mentioned below

A SPECIFIC CONDITIONS

(i) Consent for Establish shall be obtained from State Pollution Control Board under the Air(Prevention and Control of Pollution) Act 1981 and the Water (Prevention and Control otPollution) Act 1974

(ii) The dredging shall be as per committed Dredging Plan and the dredging works shall becompleted in one fair weather season ie during October to March

(iii) Reclamation embankment shall be constructed and all the reclamation material shall bedumped therein so that no general turbidity in the area is created

(iv) Periodical study on shore line changes shall be conducted and mitigation carried out ifnecessary The details shall be submitted along with the six monthly monitoring report

(v) The Project Proponent shall take up and earmark adequate fund for socio-economicdevelopment and welfare measures as proposed under the CSR Programme This shall betaken up on priority

(vi) The fishing activities by the fishermen living near to the project site and along the creekshall not be hindered and mechanisms shall be evolved for the movement of shipping boatsvis-a-vis shipping activities

(vii) It shall be ensured by the Project Proponent that the activities does not cause disturbanceto the fishing activity movements of fishing boats and destruction to mangroves during theconstruction and operation phase

(viii) The project shall not be commissioned till the requisite water supply for operational phase isarranged by MIDC or by the PP from other sources There shall be no withdrawal of groundwater in CRZ area

(ix) No product other than permitted under the CRZ Notification 2011 shall be stored in theCRZ area

(x) The project affected people if any due to the land acquisition shall be rehabilitated orcompensated as per the norms laid down by the concerned agency of State CentralGovernment

(xi) In order to control dust emission during handling of the bulk cargoes (such as coal cokeiron ore limestone and bauxite) mechanized handling system and other associatedequipments such as hopper belt conveyors stacker cum reclaimers alongwith integrateddust suppression system shall be installed Stack yard shall be provided with water sprayingsystem

(xii) Dust suppression system shall be provided at the hooper and at the point of discharge onthe berth conveyor as the feeder underneath hopper at ship un loader as well as transferpoints in the conveying and transfer systems Mist and fog sprayers shall be used for thispurpose

(xiii) 15 m wide greenbelt shall be developed in the periphery of the facilities for dust arrestingpurposes

(xiv) As committed a windshield with a wire mesh fencing with fast growing creepers up to aheight of 14 m around the coalother bulk stack yard shall be provided for control of windgenerated dust

(xv) Wagon loading system shall be complying with the zero emission standards

(xvi) The gaseous emissions from DG set shall be dispersed through adequate stack height asper CPCB standards Acoustic enclosure shall be provided to the DG sets to mitigate thenoise pollution

(xvii) The PP shall undertake the environmental monitoring programme as committed in the EIAstudy

(xviii) Necessary arrangements as committed under the EIA study for the treatment of effluentsand solid wastes shall be made and it shall be ensured that the untreated effluents and solidwastes are not discharged into the waterCRZ area

(xix) There shall be no discharge of untreated effluent in marine water All liquid containing oilshall pass into sea only via oil separation system and meet the standards prescribed by theSPCBCPCB Effluent from Coal stack yard shall be treated in the settling lagoon Treatedeffluent shall be reused for water sprinkling in coal yard Sewage generated will be treatedin the STP

ir)

(xx) The quality of treated effluents solid wastes emissions and noise levels and the like fromthe project area must conform to the standards laid down by the competent authoritiesincluding the Central or State Pollution Control Board and under the Environment(Protection) Act 1986

(xxi) All the mitigation measures suggested in the EIA report and the marine environment studyof CWPRS Pune shall be implemented The compliance for each of these measures shalbe submitted to concerned SPCS and RO of this Ministry along with six monthlycompliance reports

(xxii) All the conditions stipulated by the Maharashtra Coastal Zone Management Authority(MCZMA) vide letter No CRZ-2012CR-242TC-4 dated 24022015 shall be strictlycomplied with

(xxiii) There shall be no drawal of ground water in CRZ area

(xxiv) Spillage of fuelengine oil and lubricants from the construction site are a source of organicpollution which impacts marine life particularly benthos This shall be prevented by suitableprecautions and also by providing necessary mechanisms to trap the spillage Dredging etcwill be carried out in the confined manner to reduce the impacts on marine environment

(xxv) All the recommendation of the EMP including the dust control at storage and handling ofcargos shall be complied with letter and spirit The Project Proponent may be asked tosubmit all the EMPs mentioned in the EIA report and during the subsequent presentationsmade before the EAC shall be submitted in a tabular format with budgetary provisions andthe same shall be submitted to Ministry and with a copy to RO MoEFCC within twomonths

(xxvi) All the conditions stipulated by Commissioner of Fisheries Government of Maharashtra videletter dated 13012014 shall be complied with

(xxvii) The project proponent shall set up separate environmental management cell for effectiveimplementation of the stipulated environmental safeguards under the supervision of aSenior Executive

(xxviii) The funds earmarked for environment management plan shall be included in the budgeand this shall not be diverted for any other purposes

(xxix) The environmental monitoring programme of the project shall be continuously carried outand NCSCM (National Centre for Sustainable Coastal Management) Chennai for whicrfunding shall be done by the PP

(xxx) Creeks shall not altered in terms of width depth and shoreline characteristics A monitoringmechanism has to be put in place through satellite imagery and bathymetry measurements

(xxxi) The responsescommitments made to the issues raised during public hearing shall becomplied with in letter and spirit A hard copy of the action taken shall be submitted to theMinistry

(xxxii) The proponent shall abide by all the commitments and recommendations made in theEIAEMP report so also during their presentation to the EAC

(xxxiii) Corporate Social Responsibility

a The Company shall have a well laid down Environment Policy approved by the Board ofDirectors

b The Environment Policy shall prescribe for standard operating processprocedures tobring into focus any infringements deviationviolation of the environmental or forestnorms conditions X~

c The hierarchical system or Administrative Order of the company to deal withenvironmental issues and for ensuring compliance with the environmental clearanceconditions shall be furnished

d To have proper checks and balances the company shall have a well laid down systemof reporting of non-compliances violations of environmental norms to the Board ofDirectors of the company andor shareholders or stakeholders at large

B GENERAL CONDITIONS

(i) Appropriate measures must be taken while undertaking digging activities to avoid any likelydegradation of water quality

(ii) Full support shall be extended to the officers of this Ministry Regional Office at Nagpur bythe project proponent during inspection of the project for monitoring purposes by furnishingfull details and action plan including action taken reports in respect of mitigation measuresand other environmental protection activities

(iii) A six-Monthly monitoring report shall need to be submitted by the project proponents to theRegional Office of this Ministry at Nagpur regarding the implementation of the stipulatedconditions

(iv) Ministry of Environment Forest and Climate Change or any other competent authority maystipulate any additional conditions or modify the existing ones if necessary in the interestof environment and the same shall be complied with

(v) The Ministry reserves the right to revoke this clearance if any of the conditions stipulatedare not complied with the satisfaction of the Ministry

(vi) In the event of a change in project profile or change in the implementation agency a freshreference shall be made to the Ministry of Environment Forest and Climate Change

(vii) The project proponents shall inform the Regional Office as well as the Ministry the date offinancial closure and final approval of the project by the concerned authorities and the dateof start of land development work

(viii) A copy of the clearance letter shall be marked to concerned Panchayatlocal NGO if anyfrom whom any suggestion representation has been made received while processing theproposal

Ox) A copy of the environmental clearance letter shall also be displayed on the website of theconcerned State Pollution Control Board The EC letter shall also be displayed at theRegional Office District Industries centre and Collectors Office Tehsildars office for 30days

8 These stipulations would be enforced among others under the provisrons of Water(Prevention and Control of Pollution) Act 1974 the Air (Prevention and Control of Pollution) Act1981 the Environment (Protection) Act 1986 the Public Liability (Insurance) Act 1991 and EIANotification 1994 including the amendments and rules made thereafter

9 All other statutory clearances such as the approvals for storage of diesel from ChiefController of Explosives Fire Department Civil Aviation Department Forest Conservation Act1980 and Wildlife (Protection) Act 1972 etc shall be obtained as applicable by project proponentsfrom the respective competent authorities

10 The project proponent shall advertise in at least two local Newspapers widely circulated inthe region one of which shall be in the vernacular language informing that the project has beenaccorded Environmental and CRZ Clearance and copies of clearance letters are available with theState Pollution Control Board and may also be seen on the website of the Ministry of EnvironmentForest and Climate Change at IlVpllwwwenvfornicin The advertisement should be made withinECampCI~ JSWIL Jetty Nandgaon 477 Page 8 of 9__

Seven days from the date of receipt of the Clearance letter and a copy of the same should beforwarded to the Regional office of this Ministry at Nagpur

(iv) The cargo to be handled in the first phase would mainly consist of solidcargo such as coal coking coal fertiliser cement and Clinker iron and steelcontainers automobiles miscellaneous cargo such as food grains shulpursugar pulp newsprint scrap and liquid cargo such as LNG Chemicals and POL(v) Alternative sites were examined along with coastline spanning between theMumbai region and the Maharashtra - Gujarat Boarder After multi-criteriaanalysis site at Nanadgaon has been selected The location is 110 km north ofMumbai and is about 8 km from Boisar railway station and 23 km from NationalHighway No8 The approximate geographical coordinate of the Port lies betweenLat 1go 45 44 and 1go 47 03 North (root of south breakwater) and Long 720

41 10 East (root of north breakwater](vi) There are no mangrovcs in the proposed jetty area The nearest mangrovepatch is about 5 km way from the proposed project site No destruction ofmangroves is envisaged due to proposed port development(vii) The shoreline in the vicinity of the proposed location is generally rocky andfronts a narrow beach The rocky outcrop on the coastline affords protection fromthe northern side from waves coming from the southern side (monsoon period)(viii) At the location the udal flat is 300m to 400m wide The beach is sandy andpebbles can be seen on the beach The area behind the tidal flat is lightly builtup The area would be suitable for creating areas of storage and transit shedwhich would be created by reclamation(ix) The jetty will be designed to handle Panamax sized vessels in the firstphase and cape size carriers in the final phase Six berths for solid cargo such ascoal coking coal fertiliser cement and clinker iron and steel containers andliquid cargo handling is proposed during Phase-I with total continuous quaylength of about 1500 meter Tn addition to this there would be a dedicated berthfor coal LNG and three berths for chemicals and other liquid cargo(x) The jctty will have two breakwaters protecting the berths and to maintaintranquillity North Breakwater is approximately 65 km and the SouthBreakwater is approximately 52 km(xi) The first phase channel will have a navigable depth of around 15 m whichwould be increased to 198 m in the final phase The channel will be 15 meterdeep 200 meters wide and approximately 42 meters long The handlingequipments would be fully or semi-meehanised and fully equipped to preventpollution while achicving high degree of efficiency(xii) The capital dredging to a quantity of 10 million m shall be carried out tofacilitate the navigation It is proposed to utilise the dredged spoil for reclamationwherever possible It is proposed to reclaim an area of approximately 210hectares for the development The maintenance dredging is likely to be 12million m-(xiii) Water requirement is 800 m3 d which will be met through MIDCWastewater generation will be 336 m day The treated water will be used forgardening and sprinkling in the jetty premises(xiv) 33( of the land would be reserved for green belt development(xv) The utilities and amenities to be developed will include Gate complexstorm water drainages STP internal road fircfighting facility workshopelectrical substation canteen and administrative offices rail siding portcommunication and navigational aid(xvi) The shoreline erosion and accretion study prepared by the Institute ofOcean Management (IC)M) Anna University Chennai and the Model study onLittoral drift and shoreline changes done by CWPRS Pune suggest that theshoreline arc in low erosion and medium accretion zone The study also suggestsadverse impacts on the shoreline 1ECampCI~ JSWIL Jetty Na ndgaon f-- ) Page ~ of C)

(xvii) IRS Chennai has demarcated HTLLTL for the project The project site fallsin CRZ-I (B) CRZ-III and CRZ-IV As per the demarcation the LNCl Jetty PC)LJetty Tankage area comes under CRZ-IV area and remaining allied activities fallsin CRZ l(B) and CRZ-Ill(xviii) InvestmentCost The total cost of the project is Rs 1175 crores(xix) SCZMA Approval The Maharashtra Coastal Zone Management Authority(MCZMA) has recommended the project vide letter No CRZ-2012CR-242TC-4dated 24022015(xx) Public Hearing The Public Hearing was conducted by MaharashtraPollution Control Board on 07102012 at Tarapur Vidya Mandir MIDC Tarapur(xxi) Commissioner of Fisheries Government of Maharashtra vide letter dated13012014 has accorded NOC to the project with certain specific and generalconditions(xxii) Employment potential The project IS expected to generate theemployment opportunity(xxiii) Benefits of the project The local people will be benefited through CSRactivities Socio-economic condition of the local people shall improve Green beltaround the project will improve the aesthetic of the area and revenue generationto the state government

4 The EAC in its meeting held on 23rd - 24th April 2015 sought informationbasis of ranking assigning numerical values to various parameters used inmatrix for site selection Dredging Plan and details of plants to be used fordevelopment of G-reen belt The Project Proponent (PP) submitted information andinformed that

(i) Basis of ranking and assigning numerical values to various parameters usedin Matrix for site selection and evaluation procedure for alternative sites wereexplained to EAC The PP informed that alternative sites for the proposedGreenfield Jetty (Port Phase I) were examined in the hinterland Accordinglycoast line from the Mumbai in the south to the Gujarat border in the northwas studied However choice limited to the Maharashtra coastline as it isnear to Mumbai Besides favourable concession terms are offered from theMaharashtra Maritime Board Therefore of the various alternatives examinedalong these coastlines only three options as below were considered for thefinal evaluation of the site

a Lagoon Harbour near Wadhvan Pointb ()uter Harbour to the North of the Virar Creekc Outer Harbour at Nandgaon

(ii)The positive attributes associated with Wadhvan point are no breakwaterconstruction good founding soil condition reduced the cost and relativelydeeper contours (depth) located close to shoreline However the drawbackassociated with this site includes rocky soil condition blasting required forcreation of harbour basin close proximity of Dahanu Eco-scrrsitivc area (~7km) and private land required to be acquired for the development

(iii)The positive attributes associated with Virar Creek Site includes no exposedrocks soft strata dredgeble and deeper depth in the ncar shore region Thedraw backs arc ie site is close to Sanjay Garidhi National Park and MMRregion which may pose traffic constraints on secondary and primaryevacuation routes and high siltation rates due to creek sediment load Thedrawbacks associated with the proposed project site are ic deep water is farfrom the shore and the length of breakwater will be more The positiveattributes for this sites are namely that the site is located on an qmbayment

with a stable shoreline the foreshore area is rocky with a wide rockyintertidal zone 0 m contour is about 15 km from the shoreline coastalharbour is proposed with reclaimed area for port backup proximity to rail androad network land is to be acquired for road and rail access only

(iv)Regarding dredging plan PP informed that total quantity envisaged fordredging is 10OOO000m3 The number of berths considered for dredging is10 The design depth is 150 m below CD The Channel width will be 200 mwith Turning circle of 700 meter in diameter and channel length of 3000meters It is proposed to deploy one Cutter Suction Dredger which is suitablefor near-shore low draft (-18 m CD) dredging one Backhoe Dredgersupported by dumb SP barges which is suitable for hard stratal rock and twoTrailer Suction Hopper Dredger which arc suitable for channel dredging up to(-22 m CD) It is proposed to complete the dredging works in one fair weatherseason ie during October to March

(v) Regarding plants to be used for green belt PP informed that species selectedarc from working plan of Forest Department Dahanu and in consultation withthe concerned Regional Forest Officer The outer boundary will includeplantation of Pinc z Sur u Asopalav ChinchImli The Middle fringe will haveMango Shirish Jarnbul The Inner area will have Gulmohur Karanj Ghaneriand Morning glory This is proposed to have evergreen deciduous indigenousand ecologically compatible and agro - climatically suitable green belt Thebel t will be hardy dust capturing and wind breaking

5 The EAC informed Pl that the Ministry has received a complaint allegingthat the project has been opposed by the farmers of 40 villages in vicinity to theproposed project sites IACrequested to provide details of issues raised duringPublic Hearing and the proposed Environment Management Plan PP informedthat during the public hearing they were not provided with the opportunity todescribe about the project and benefits from the project offered by the proponentto villages The major issue that emerged during public hearing arc

(a) Unemployment due to loss of livelihood sources based on the fishingactivities business

(b) fishing net will be destroyed due to vessel movement in the Port area(c) blockage in the creeks and it will impact on the fishing activity(d) development of roads and widening of existing road is proposed the private

land be acquired for the purpose(e) land acquisition on large scale is propose thus displacement of fisherman

communityCD reclamation may change the water current direction may cause

destruction and risk to the villages in coastal area(g) breakwaters will be constructed on northern as well as southern side thus

the tide flow would be difficult to analyze and may pose danger to thefishermen

(h) shoreline change in terms of erosion and accretion in the proposed projectarea

(i) intertidal zone is most fertile and rich biodiversity that will be destroyeddue to land reclamation

U) project require 800 m3 day of water during the operation phase But thereis no water supply either in Nandgaon or the nearby villages and

(k) spillage of oil and waste water will occur during the ship movement due tothis the fish activity will be destroyed

6 The EAC enquired about the activities proposed under the Corporate SocialResponsibility (CSR) In response PP informed that the CSI~ activity is plannedfor the social benefit of the local fisherman and farm community The adequatejob opportunities both direct and indirect would be created for the local youthsby the way of implementation 0 this project Preference for small jobs will begiven to the locals based on their qualification and expertise Education sectorwill be improved with the adequate CSR plan Free scholarships will be given tothe poor students Regarding other issues raised during the hearing by localfishermen PP informed that vessels will move in well-defined channels markedwith buoys to avoid any damage to fishing nets The spillage of oil and wastewater is prohibited and would be monitored by the DG shipping and MPCB Asper modelling study by CWPRS Pune no adverse impact on fishing active orshoreline is envisaged The construction of the breakwater will create tranquilconditions inside the harbor by dissipating the higher wave energies Thebreakwaters do not have any other impacts on the tidal heights or any othermarine parameters The road and the rail corridor will be developed withou taffecting the present roads The present roads wherever necessary would bestrengthened and widened through the Public Works Department The landrequirement for such roads is much less and if any private land is involved it willbe purchased from the land owners directly through negotiations Even if thegovernment acquisition is necessitated providing adequate compensation wouldbe JSWILsmoral obligation

7 Project Proponent and the EIA Consultant namely M s Wapcos India Ltdhave presented EIA EMP report as per the TOR EAC has found the EIA EMPReport and additional information to be adequate and in full consonance with thepresented TORsThe EAC after detailed deliberation recommended the project inits meeting held on 24th - 26th June 2015 and 18th - 20th November 2015 forgrant of Environmental and CRZ Clearance As per the recommendations of I~ACthe Ministry of Environment Forest amp Climate Change hereby accordsEnvironmental and CRZ Clearance for the above-mentioned project All weatherGreenfield Jetty at Nandgaon of Taluka Palghar District Thane(Maharashtra) by M s JSW Infrastructure Ltd under the provisions of theEnvironment Impact Assessment Notification 2006 amp Coastal Regulation Zone(CI~Z)Notification 2011 and amendments thereto and Circulars issued thereonand subject to the compliance of the following specific conditions in addition tothe general conditions mentioned below

A SPECIFIC CONDITIONS

(i) Consent for Establish shall be obtained from State Pollution Control Board under the Air(Prevention and Control of Pollution) Act 1981 and the Water (Prevention and Control otPollution) Act 1974

(ii) The dredging shall be as per committed Dredging Plan and the dredging works shall becompleted in one fair weather season ie during October to March

(iii) Reclamation embankment shall be constructed and all the reclamation material shall bedumped therein so that no general turbidity in the area is created

(iv) Periodical study on shore line changes shall be conducted and mitigation carried out ifnecessary The details shall be submitted along with the six monthly monitoring report

(v) The Project Proponent shall take up and earmark adequate fund for socio-economicdevelopment and welfare measures as proposed under the CSR Programme This shall betaken up on priority

(vi) The fishing activities by the fishermen living near to the project site and along the creekshall not be hindered and mechanisms shall be evolved for the movement of shipping boatsvis-a-vis shipping activities

(vii) It shall be ensured by the Project Proponent that the activities does not cause disturbanceto the fishing activity movements of fishing boats and destruction to mangroves during theconstruction and operation phase

(viii) The project shall not be commissioned till the requisite water supply for operational phase isarranged by MIDC or by the PP from other sources There shall be no withdrawal of groundwater in CRZ area

(ix) No product other than permitted under the CRZ Notification 2011 shall be stored in theCRZ area

(x) The project affected people if any due to the land acquisition shall be rehabilitated orcompensated as per the norms laid down by the concerned agency of State CentralGovernment

(xi) In order to control dust emission during handling of the bulk cargoes (such as coal cokeiron ore limestone and bauxite) mechanized handling system and other associatedequipments such as hopper belt conveyors stacker cum reclaimers alongwith integrateddust suppression system shall be installed Stack yard shall be provided with water sprayingsystem

(xii) Dust suppression system shall be provided at the hooper and at the point of discharge onthe berth conveyor as the feeder underneath hopper at ship un loader as well as transferpoints in the conveying and transfer systems Mist and fog sprayers shall be used for thispurpose

(xiii) 15 m wide greenbelt shall be developed in the periphery of the facilities for dust arrestingpurposes

(xiv) As committed a windshield with a wire mesh fencing with fast growing creepers up to aheight of 14 m around the coalother bulk stack yard shall be provided for control of windgenerated dust

(xv) Wagon loading system shall be complying with the zero emission standards

(xvi) The gaseous emissions from DG set shall be dispersed through adequate stack height asper CPCB standards Acoustic enclosure shall be provided to the DG sets to mitigate thenoise pollution

(xvii) The PP shall undertake the environmental monitoring programme as committed in the EIAstudy

(xviii) Necessary arrangements as committed under the EIA study for the treatment of effluentsand solid wastes shall be made and it shall be ensured that the untreated effluents and solidwastes are not discharged into the waterCRZ area

(xix) There shall be no discharge of untreated effluent in marine water All liquid containing oilshall pass into sea only via oil separation system and meet the standards prescribed by theSPCBCPCB Effluent from Coal stack yard shall be treated in the settling lagoon Treatedeffluent shall be reused for water sprinkling in coal yard Sewage generated will be treatedin the STP

ir)

(xx) The quality of treated effluents solid wastes emissions and noise levels and the like fromthe project area must conform to the standards laid down by the competent authoritiesincluding the Central or State Pollution Control Board and under the Environment(Protection) Act 1986

(xxi) All the mitigation measures suggested in the EIA report and the marine environment studyof CWPRS Pune shall be implemented The compliance for each of these measures shalbe submitted to concerned SPCS and RO of this Ministry along with six monthlycompliance reports

(xxii) All the conditions stipulated by the Maharashtra Coastal Zone Management Authority(MCZMA) vide letter No CRZ-2012CR-242TC-4 dated 24022015 shall be strictlycomplied with

(xxiii) There shall be no drawal of ground water in CRZ area

(xxiv) Spillage of fuelengine oil and lubricants from the construction site are a source of organicpollution which impacts marine life particularly benthos This shall be prevented by suitableprecautions and also by providing necessary mechanisms to trap the spillage Dredging etcwill be carried out in the confined manner to reduce the impacts on marine environment

(xxv) All the recommendation of the EMP including the dust control at storage and handling ofcargos shall be complied with letter and spirit The Project Proponent may be asked tosubmit all the EMPs mentioned in the EIA report and during the subsequent presentationsmade before the EAC shall be submitted in a tabular format with budgetary provisions andthe same shall be submitted to Ministry and with a copy to RO MoEFCC within twomonths

(xxvi) All the conditions stipulated by Commissioner of Fisheries Government of Maharashtra videletter dated 13012014 shall be complied with

(xxvii) The project proponent shall set up separate environmental management cell for effectiveimplementation of the stipulated environmental safeguards under the supervision of aSenior Executive

(xxviii) The funds earmarked for environment management plan shall be included in the budgeand this shall not be diverted for any other purposes

(xxix) The environmental monitoring programme of the project shall be continuously carried outand NCSCM (National Centre for Sustainable Coastal Management) Chennai for whicrfunding shall be done by the PP

(xxx) Creeks shall not altered in terms of width depth and shoreline characteristics A monitoringmechanism has to be put in place through satellite imagery and bathymetry measurements

(xxxi) The responsescommitments made to the issues raised during public hearing shall becomplied with in letter and spirit A hard copy of the action taken shall be submitted to theMinistry

(xxxii) The proponent shall abide by all the commitments and recommendations made in theEIAEMP report so also during their presentation to the EAC

(xxxiii) Corporate Social Responsibility

a The Company shall have a well laid down Environment Policy approved by the Board ofDirectors

b The Environment Policy shall prescribe for standard operating processprocedures tobring into focus any infringements deviationviolation of the environmental or forestnorms conditions X~

c The hierarchical system or Administrative Order of the company to deal withenvironmental issues and for ensuring compliance with the environmental clearanceconditions shall be furnished

d To have proper checks and balances the company shall have a well laid down systemof reporting of non-compliances violations of environmental norms to the Board ofDirectors of the company andor shareholders or stakeholders at large

B GENERAL CONDITIONS

(i) Appropriate measures must be taken while undertaking digging activities to avoid any likelydegradation of water quality

(ii) Full support shall be extended to the officers of this Ministry Regional Office at Nagpur bythe project proponent during inspection of the project for monitoring purposes by furnishingfull details and action plan including action taken reports in respect of mitigation measuresand other environmental protection activities

(iii) A six-Monthly monitoring report shall need to be submitted by the project proponents to theRegional Office of this Ministry at Nagpur regarding the implementation of the stipulatedconditions

(iv) Ministry of Environment Forest and Climate Change or any other competent authority maystipulate any additional conditions or modify the existing ones if necessary in the interestof environment and the same shall be complied with

(v) The Ministry reserves the right to revoke this clearance if any of the conditions stipulatedare not complied with the satisfaction of the Ministry

(vi) In the event of a change in project profile or change in the implementation agency a freshreference shall be made to the Ministry of Environment Forest and Climate Change

(vii) The project proponents shall inform the Regional Office as well as the Ministry the date offinancial closure and final approval of the project by the concerned authorities and the dateof start of land development work

(viii) A copy of the clearance letter shall be marked to concerned Panchayatlocal NGO if anyfrom whom any suggestion representation has been made received while processing theproposal

Ox) A copy of the environmental clearance letter shall also be displayed on the website of theconcerned State Pollution Control Board The EC letter shall also be displayed at theRegional Office District Industries centre and Collectors Office Tehsildars office for 30days

8 These stipulations would be enforced among others under the provisrons of Water(Prevention and Control of Pollution) Act 1974 the Air (Prevention and Control of Pollution) Act1981 the Environment (Protection) Act 1986 the Public Liability (Insurance) Act 1991 and EIANotification 1994 including the amendments and rules made thereafter

9 All other statutory clearances such as the approvals for storage of diesel from ChiefController of Explosives Fire Department Civil Aviation Department Forest Conservation Act1980 and Wildlife (Protection) Act 1972 etc shall be obtained as applicable by project proponentsfrom the respective competent authorities

10 The project proponent shall advertise in at least two local Newspapers widely circulated inthe region one of which shall be in the vernacular language informing that the project has beenaccorded Environmental and CRZ Clearance and copies of clearance letters are available with theState Pollution Control Board and may also be seen on the website of the Ministry of EnvironmentForest and Climate Change at IlVpllwwwenvfornicin The advertisement should be made withinECampCI~ JSWIL Jetty Nandgaon 477 Page 8 of 9__

Seven days from the date of receipt of the Clearance letter and a copy of the same should beforwarded to the Regional office of this Ministry at Nagpur

(xvii) IRS Chennai has demarcated HTLLTL for the project The project site fallsin CRZ-I (B) CRZ-III and CRZ-IV As per the demarcation the LNCl Jetty PC)LJetty Tankage area comes under CRZ-IV area and remaining allied activities fallsin CRZ l(B) and CRZ-Ill(xviii) InvestmentCost The total cost of the project is Rs 1175 crores(xix) SCZMA Approval The Maharashtra Coastal Zone Management Authority(MCZMA) has recommended the project vide letter No CRZ-2012CR-242TC-4dated 24022015(xx) Public Hearing The Public Hearing was conducted by MaharashtraPollution Control Board on 07102012 at Tarapur Vidya Mandir MIDC Tarapur(xxi) Commissioner of Fisheries Government of Maharashtra vide letter dated13012014 has accorded NOC to the project with certain specific and generalconditions(xxii) Employment potential The project IS expected to generate theemployment opportunity(xxiii) Benefits of the project The local people will be benefited through CSRactivities Socio-economic condition of the local people shall improve Green beltaround the project will improve the aesthetic of the area and revenue generationto the state government

4 The EAC in its meeting held on 23rd - 24th April 2015 sought informationbasis of ranking assigning numerical values to various parameters used inmatrix for site selection Dredging Plan and details of plants to be used fordevelopment of G-reen belt The Project Proponent (PP) submitted information andinformed that

(i) Basis of ranking and assigning numerical values to various parameters usedin Matrix for site selection and evaluation procedure for alternative sites wereexplained to EAC The PP informed that alternative sites for the proposedGreenfield Jetty (Port Phase I) were examined in the hinterland Accordinglycoast line from the Mumbai in the south to the Gujarat border in the northwas studied However choice limited to the Maharashtra coastline as it isnear to Mumbai Besides favourable concession terms are offered from theMaharashtra Maritime Board Therefore of the various alternatives examinedalong these coastlines only three options as below were considered for thefinal evaluation of the site

a Lagoon Harbour near Wadhvan Pointb ()uter Harbour to the North of the Virar Creekc Outer Harbour at Nandgaon

(ii)The positive attributes associated with Wadhvan point are no breakwaterconstruction good founding soil condition reduced the cost and relativelydeeper contours (depth) located close to shoreline However the drawbackassociated with this site includes rocky soil condition blasting required forcreation of harbour basin close proximity of Dahanu Eco-scrrsitivc area (~7km) and private land required to be acquired for the development

(iii)The positive attributes associated with Virar Creek Site includes no exposedrocks soft strata dredgeble and deeper depth in the ncar shore region Thedraw backs arc ie site is close to Sanjay Garidhi National Park and MMRregion which may pose traffic constraints on secondary and primaryevacuation routes and high siltation rates due to creek sediment load Thedrawbacks associated with the proposed project site are ic deep water is farfrom the shore and the length of breakwater will be more The positiveattributes for this sites are namely that the site is located on an qmbayment

(iv)Regarding dredging plan PP informed that total quantity envisaged fordredging is 10OOO000m3 The number of berths considered for dredging is10 The design depth is 150 m below CD The Channel width will be 200 mwith Turning circle of 700 meter in diameter and channel length of 3000meters It is proposed to deploy one Cutter Suction Dredger which is suitablefor near-shore low draft (-18 m CD) dredging one Backhoe Dredgersupported by dumb SP barges which is suitable for hard stratal rock and twoTrailer Suction Hopper Dredger which arc suitable for channel dredging up to(-22 m CD) It is proposed to complete the dredging works in one fair weatherseason ie during October to March

(v) Regarding plants to be used for green belt PP informed that species selectedarc from working plan of Forest Department Dahanu and in consultation withthe concerned Regional Forest Officer The outer boundary will includeplantation of Pinc z Sur u Asopalav ChinchImli The Middle fringe will haveMango Shirish Jarnbul The Inner area will have Gulmohur Karanj Ghaneriand Morning glory This is proposed to have evergreen deciduous indigenousand ecologically compatible and agro - climatically suitable green belt Thebel t will be hardy dust capturing and wind breaking

5 The EAC informed Pl that the Ministry has received a complaint allegingthat the project has been opposed by the farmers of 40 villages in vicinity to theproposed project sites IACrequested to provide details of issues raised duringPublic Hearing and the proposed Environment Management Plan PP informedthat during the public hearing they were not provided with the opportunity todescribe about the project and benefits from the project offered by the proponentto villages The major issue that emerged during public hearing arc

(a) Unemployment due to loss of livelihood sources based on the fishingactivities business

(b) fishing net will be destroyed due to vessel movement in the Port area(c) blockage in the creeks and it will impact on the fishing activity(d) development of roads and widening of existing road is proposed the private

land be acquired for the purpose(e) land acquisition on large scale is propose thus displacement of fisherman

communityCD reclamation may change the water current direction may cause

destruction and risk to the villages in coastal area(g) breakwaters will be constructed on northern as well as southern side thus

the tide flow would be difficult to analyze and may pose danger to thefishermen

(h) shoreline change in terms of erosion and accretion in the proposed projectarea

(i) intertidal zone is most fertile and rich biodiversity that will be destroyeddue to land reclamation

U) project require 800 m3 day of water during the operation phase But thereis no water supply either in Nandgaon or the nearby villages and

(k) spillage of oil and waste water will occur during the ship movement due tothis the fish activity will be destroyed

6 The EAC enquired about the activities proposed under the Corporate SocialResponsibility (CSR) In response PP informed that the CSI~ activity is plannedfor the social benefit of the local fisherman and farm community The adequatejob opportunities both direct and indirect would be created for the local youthsby the way of implementation 0 this project Preference for small jobs will begiven to the locals based on their qualification and expertise Education sectorwill be improved with the adequate CSR plan Free scholarships will be given tothe poor students Regarding other issues raised during the hearing by localfishermen PP informed that vessels will move in well-defined channels markedwith buoys to avoid any damage to fishing nets The spillage of oil and wastewater is prohibited and would be monitored by the DG shipping and MPCB Asper modelling study by CWPRS Pune no adverse impact on fishing active orshoreline is envisaged The construction of the breakwater will create tranquilconditions inside the harbor by dissipating the higher wave energies Thebreakwaters do not have any other impacts on the tidal heights or any othermarine parameters The road and the rail corridor will be developed withou taffecting the present roads The present roads wherever necessary would bestrengthened and widened through the Public Works Department The landrequirement for such roads is much less and if any private land is involved it willbe purchased from the land owners directly through negotiations Even if thegovernment acquisition is necessitated providing adequate compensation wouldbe JSWILsmoral obligation

7 Project Proponent and the EIA Consultant namely M s Wapcos India Ltdhave presented EIA EMP report as per the TOR EAC has found the EIA EMPReport and additional information to be adequate and in full consonance with thepresented TORsThe EAC after detailed deliberation recommended the project inits meeting held on 24th - 26th June 2015 and 18th - 20th November 2015 forgrant of Environmental and CRZ Clearance As per the recommendations of I~ACthe Ministry of Environment Forest amp Climate Change hereby accordsEnvironmental and CRZ Clearance for the above-mentioned project All weatherGreenfield Jetty at Nandgaon of Taluka Palghar District Thane(Maharashtra) by M s JSW Infrastructure Ltd under the provisions of theEnvironment Impact Assessment Notification 2006 amp Coastal Regulation Zone(CI~Z)Notification 2011 and amendments thereto and Circulars issued thereonand subject to the compliance of the following specific conditions in addition tothe general conditions mentioned below

A SPECIFIC CONDITIONS

(i) Consent for Establish shall be obtained from State Pollution Control Board under the Air(Prevention and Control of Pollution) Act 1981 and the Water (Prevention and Control otPollution) Act 1974

(ii) The dredging shall be as per committed Dredging Plan and the dredging works shall becompleted in one fair weather season ie during October to March

(iii) Reclamation embankment shall be constructed and all the reclamation material shall bedumped therein so that no general turbidity in the area is created

(iv) Periodical study on shore line changes shall be conducted and mitigation carried out ifnecessary The details shall be submitted along with the six monthly monitoring report

(v) The Project Proponent shall take up and earmark adequate fund for socio-economicdevelopment and welfare measures as proposed under the CSR Programme This shall betaken up on priority

(vi) The fishing activities by the fishermen living near to the project site and along the creekshall not be hindered and mechanisms shall be evolved for the movement of shipping boatsvis-a-vis shipping activities

(vii) It shall be ensured by the Project Proponent that the activities does not cause disturbanceto the fishing activity movements of fishing boats and destruction to mangroves during theconstruction and operation phase

(viii) The project shall not be commissioned till the requisite water supply for operational phase isarranged by MIDC or by the PP from other sources There shall be no withdrawal of groundwater in CRZ area

(ix) No product other than permitted under the CRZ Notification 2011 shall be stored in theCRZ area

(x) The project affected people if any due to the land acquisition shall be rehabilitated orcompensated as per the norms laid down by the concerned agency of State CentralGovernment

(xi) In order to control dust emission during handling of the bulk cargoes (such as coal cokeiron ore limestone and bauxite) mechanized handling system and other associatedequipments such as hopper belt conveyors stacker cum reclaimers alongwith integrateddust suppression system shall be installed Stack yard shall be provided with water sprayingsystem

(xii) Dust suppression system shall be provided at the hooper and at the point of discharge onthe berth conveyor as the feeder underneath hopper at ship un loader as well as transferpoints in the conveying and transfer systems Mist and fog sprayers shall be used for thispurpose

(xiii) 15 m wide greenbelt shall be developed in the periphery of the facilities for dust arrestingpurposes

(xiv) As committed a windshield with a wire mesh fencing with fast growing creepers up to aheight of 14 m around the coalother bulk stack yard shall be provided for control of windgenerated dust

(xv) Wagon loading system shall be complying with the zero emission standards

(xvi) The gaseous emissions from DG set shall be dispersed through adequate stack height asper CPCB standards Acoustic enclosure shall be provided to the DG sets to mitigate thenoise pollution

(xvii) The PP shall undertake the environmental monitoring programme as committed in the EIAstudy

(xviii) Necessary arrangements as committed under the EIA study for the treatment of effluentsand solid wastes shall be made and it shall be ensured that the untreated effluents and solidwastes are not discharged into the waterCRZ area

(xix) There shall be no discharge of untreated effluent in marine water All liquid containing oilshall pass into sea only via oil separation system and meet the standards prescribed by theSPCBCPCB Effluent from Coal stack yard shall be treated in the settling lagoon Treatedeffluent shall be reused for water sprinkling in coal yard Sewage generated will be treatedin the STP

ir)

(xx) The quality of treated effluents solid wastes emissions and noise levels and the like fromthe project area must conform to the standards laid down by the competent authoritiesincluding the Central or State Pollution Control Board and under the Environment(Protection) Act 1986

(xxi) All the mitigation measures suggested in the EIA report and the marine environment studyof CWPRS Pune shall be implemented The compliance for each of these measures shalbe submitted to concerned SPCS and RO of this Ministry along with six monthlycompliance reports

(xxii) All the conditions stipulated by the Maharashtra Coastal Zone Management Authority(MCZMA) vide letter No CRZ-2012CR-242TC-4 dated 24022015 shall be strictlycomplied with

(xxiii) There shall be no drawal of ground water in CRZ area

(xxiv) Spillage of fuelengine oil and lubricants from the construction site are a source of organicpollution which impacts marine life particularly benthos This shall be prevented by suitableprecautions and also by providing necessary mechanisms to trap the spillage Dredging etcwill be carried out in the confined manner to reduce the impacts on marine environment

(xxv) All the recommendation of the EMP including the dust control at storage and handling ofcargos shall be complied with letter and spirit The Project Proponent may be asked tosubmit all the EMPs mentioned in the EIA report and during the subsequent presentationsmade before the EAC shall be submitted in a tabular format with budgetary provisions andthe same shall be submitted to Ministry and with a copy to RO MoEFCC within twomonths

(xxvi) All the conditions stipulated by Commissioner of Fisheries Government of Maharashtra videletter dated 13012014 shall be complied with

(xxvii) The project proponent shall set up separate environmental management cell for effectiveimplementation of the stipulated environmental safeguards under the supervision of aSenior Executive

(xxviii) The funds earmarked for environment management plan shall be included in the budgeand this shall not be diverted for any other purposes

(xxix) The environmental monitoring programme of the project shall be continuously carried outand NCSCM (National Centre for Sustainable Coastal Management) Chennai for whicrfunding shall be done by the PP

(xxx) Creeks shall not altered in terms of width depth and shoreline characteristics A monitoringmechanism has to be put in place through satellite imagery and bathymetry measurements

(xxxi) The responsescommitments made to the issues raised during public hearing shall becomplied with in letter and spirit A hard copy of the action taken shall be submitted to theMinistry

(xxxii) The proponent shall abide by all the commitments and recommendations made in theEIAEMP report so also during their presentation to the EAC

(xxxiii) Corporate Social Responsibility

a The Company shall have a well laid down Environment Policy approved by the Board ofDirectors

b The Environment Policy shall prescribe for standard operating processprocedures tobring into focus any infringements deviationviolation of the environmental or forestnorms conditions X~

c The hierarchical system or Administrative Order of the company to deal withenvironmental issues and for ensuring compliance with the environmental clearanceconditions shall be furnished

d To have proper checks and balances the company shall have a well laid down systemof reporting of non-compliances violations of environmental norms to the Board ofDirectors of the company andor shareholders or stakeholders at large

B GENERAL CONDITIONS

(i) Appropriate measures must be taken while undertaking digging activities to avoid any likelydegradation of water quality

(ii) Full support shall be extended to the officers of this Ministry Regional Office at Nagpur bythe project proponent during inspection of the project for monitoring purposes by furnishingfull details and action plan including action taken reports in respect of mitigation measuresand other environmental protection activities

(iii) A six-Monthly monitoring report shall need to be submitted by the project proponents to theRegional Office of this Ministry at Nagpur regarding the implementation of the stipulatedconditions

(iv) Ministry of Environment Forest and Climate Change or any other competent authority maystipulate any additional conditions or modify the existing ones if necessary in the interestof environment and the same shall be complied with

(v) The Ministry reserves the right to revoke this clearance if any of the conditions stipulatedare not complied with the satisfaction of the Ministry

(vi) In the event of a change in project profile or change in the implementation agency a freshreference shall be made to the Ministry of Environment Forest and Climate Change

(vii) The project proponents shall inform the Regional Office as well as the Ministry the date offinancial closure and final approval of the project by the concerned authorities and the dateof start of land development work

(viii) A copy of the clearance letter shall be marked to concerned Panchayatlocal NGO if anyfrom whom any suggestion representation has been made received while processing theproposal

Ox) A copy of the environmental clearance letter shall also be displayed on the website of theconcerned State Pollution Control Board The EC letter shall also be displayed at theRegional Office District Industries centre and Collectors Office Tehsildars office for 30days

8 These stipulations would be enforced among others under the provisrons of Water(Prevention and Control of Pollution) Act 1974 the Air (Prevention and Control of Pollution) Act1981 the Environment (Protection) Act 1986 the Public Liability (Insurance) Act 1991 and EIANotification 1994 including the amendments and rules made thereafter

9 All other statutory clearances such as the approvals for storage of diesel from ChiefController of Explosives Fire Department Civil Aviation Department Forest Conservation Act1980 and Wildlife (Protection) Act 1972 etc shall be obtained as applicable by project proponentsfrom the respective competent authorities

10 The project proponent shall advertise in at least two local Newspapers widely circulated inthe region one of which shall be in the vernacular language informing that the project has beenaccorded Environmental and CRZ Clearance and copies of clearance letters are available with theState Pollution Control Board and may also be seen on the website of the Ministry of EnvironmentForest and Climate Change at IlVpllwwwenvfornicin The advertisement should be made withinECampCI~ JSWIL Jetty Nandgaon 477 Page 8 of 9__

Seven days from the date of receipt of the Clearance letter and a copy of the same should beforwarded to the Regional office of this Ministry at Nagpur

11 This Clearance is subject to final order of the Honble Supreme Court of India in the matterof Goa Foundation Vs Union of India in Writ Petition (Civil) No460 of 2004 as may be applicable tothis project

12 Status of compliance to the various stipulated environmental conditions and environmentalsafeguards will be uploaded by the project proponent in its website

13 Any appeal against this Clearance shall lie with the National Green Tribunal if preferredwithin a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act2010

14 A copy of the clearance letter shall be sent by the proponent to concerned Panchayat ZillaParisadMunicipal Corporation Urban Local Body and the Local NGO if any from whomsuggestionsrepresentations if any were received while processing the proposal The clearanceletter shall also be put on the website of the company by the proponent

15 The proponent shall upload the status of compliance of the stipulated EC conditionsincluding results of monitored data on their website and shall update the same periodically It shallsimultaneously be sent to the Regional Office of MoEFCC the respective Zonal Office of CPCBand the SPCB

16 The environmental statement for each financial year ending 31 st March in Form-Vas ismandated to be submitted by the project proponent to the concerned State Pollution Control Boardas prescribed under the Environment (Protection) Rules 1986 as amended subsequently shallalso be put on the website of the company along with the status of compliance of EC conditionsand shall also be sent to the respective Regional Offices of MoEFCC bye-mail

(vi) The fishing activities by the fishermen living near to the project site and along the creekshall not be hindered and mechanisms shall be evolved for the movement of shipping boatsvis-a-vis shipping activities

(vii) It shall be ensured by the Project Proponent that the activities does not cause disturbanceto the fishing activity movements of fishing boats and destruction to mangroves during theconstruction and operation phase

(viii) The project shall not be commissioned till the requisite water supply for operational phase isarranged by MIDC or by the PP from other sources There shall be no withdrawal of groundwater in CRZ area

(ix) No product other than permitted under the CRZ Notification 2011 shall be stored in theCRZ area

(x) The project affected people if any due to the land acquisition shall be rehabilitated orcompensated as per the norms laid down by the concerned agency of State CentralGovernment

(xi) In order to control dust emission during handling of the bulk cargoes (such as coal cokeiron ore limestone and bauxite) mechanized handling system and other associatedequipments such as hopper belt conveyors stacker cum reclaimers alongwith integrateddust suppression system shall be installed Stack yard shall be provided with water sprayingsystem

(xii) Dust suppression system shall be provided at the hooper and at the point of discharge onthe berth conveyor as the feeder underneath hopper at ship un loader as well as transferpoints in the conveying and transfer systems Mist and fog sprayers shall be used for thispurpose

(xiii) 15 m wide greenbelt shall be developed in the periphery of the facilities for dust arrestingpurposes

(xiv) As committed a windshield with a wire mesh fencing with fast growing creepers up to aheight of 14 m around the coalother bulk stack yard shall be provided for control of windgenerated dust

(xv) Wagon loading system shall be complying with the zero emission standards

(xvi) The gaseous emissions from DG set shall be dispersed through adequate stack height asper CPCB standards Acoustic enclosure shall be provided to the DG sets to mitigate thenoise pollution

(xvii) The PP shall undertake the environmental monitoring programme as committed in the EIAstudy

(xviii) Necessary arrangements as committed under the EIA study for the treatment of effluentsand solid wastes shall be made and it shall be ensured that the untreated effluents and solidwastes are not discharged into the waterCRZ area

(xix) There shall be no discharge of untreated effluent in marine water All liquid containing oilshall pass into sea only via oil separation system and meet the standards prescribed by theSPCBCPCB Effluent from Coal stack yard shall be treated in the settling lagoon Treatedeffluent shall be reused for water sprinkling in coal yard Sewage generated will be treatedin the STP

ir)

(xx) The quality of treated effluents solid wastes emissions and noise levels and the like fromthe project area must conform to the standards laid down by the competent authoritiesincluding the Central or State Pollution Control Board and under the Environment(Protection) Act 1986

(xxi) All the mitigation measures suggested in the EIA report and the marine environment studyof CWPRS Pune shall be implemented The compliance for each of these measures shalbe submitted to concerned SPCS and RO of this Ministry along with six monthlycompliance reports

(xxii) All the conditions stipulated by the Maharashtra Coastal Zone Management Authority(MCZMA) vide letter No CRZ-2012CR-242TC-4 dated 24022015 shall be strictlycomplied with

(xxiii) There shall be no drawal of ground water in CRZ area

(xxiv) Spillage of fuelengine oil and lubricants from the construction site are a source of organicpollution which impacts marine life particularly benthos This shall be prevented by suitableprecautions and also by providing necessary mechanisms to trap the spillage Dredging etcwill be carried out in the confined manner to reduce the impacts on marine environment

(xxv) All the recommendation of the EMP including the dust control at storage and handling ofcargos shall be complied with letter and spirit The Project Proponent may be asked tosubmit all the EMPs mentioned in the EIA report and during the subsequent presentationsmade before the EAC shall be submitted in a tabular format with budgetary provisions andthe same shall be submitted to Ministry and with a copy to RO MoEFCC within twomonths

(xxvi) All the conditions stipulated by Commissioner of Fisheries Government of Maharashtra videletter dated 13012014 shall be complied with

(xxvii) The project proponent shall set up separate environmental management cell for effectiveimplementation of the stipulated environmental safeguards under the supervision of aSenior Executive

(xxviii) The funds earmarked for environment management plan shall be included in the budgeand this shall not be diverted for any other purposes

(xxix) The environmental monitoring programme of the project shall be continuously carried outand NCSCM (National Centre for Sustainable Coastal Management) Chennai for whicrfunding shall be done by the PP

(xxx) Creeks shall not altered in terms of width depth and shoreline characteristics A monitoringmechanism has to be put in place through satellite imagery and bathymetry measurements

(xxxi) The responsescommitments made to the issues raised during public hearing shall becomplied with in letter and spirit A hard copy of the action taken shall be submitted to theMinistry

(xxxii) The proponent shall abide by all the commitments and recommendations made in theEIAEMP report so also during their presentation to the EAC

(xxxiii) Corporate Social Responsibility

a The Company shall have a well laid down Environment Policy approved by the Board ofDirectors

b The Environment Policy shall prescribe for standard operating processprocedures tobring into focus any infringements deviationviolation of the environmental or forestnorms conditions X~

d To have proper checks and balances the company shall have a well laid down systemof reporting of non-compliances violations of environmental norms to the Board ofDirectors of the company andor shareholders or stakeholders at large

B GENERAL CONDITIONS

(i) Appropriate measures must be taken while undertaking digging activities to avoid any likelydegradation of water quality

(ii) Full support shall be extended to the officers of this Ministry Regional Office at Nagpur bythe project proponent during inspection of the project for monitoring purposes by furnishingfull details and action plan including action taken reports in respect of mitigation measuresand other environmental protection activities

(iii) A six-Monthly monitoring report shall need to be submitted by the project proponents to theRegional Office of this Ministry at Nagpur regarding the implementation of the stipulatedconditions

(iv) Ministry of Environment Forest and Climate Change or any other competent authority maystipulate any additional conditions or modify the existing ones if necessary in the interestof environment and the same shall be complied with

(v) The Ministry reserves the right to revoke this clearance if any of the conditions stipulatedare not complied with the satisfaction of the Ministry

(vi) In the event of a change in project profile or change in the implementation agency a freshreference shall be made to the Ministry of Environment Forest and Climate Change

(vii) The project proponents shall inform the Regional Office as well as the Ministry the date offinancial closure and final approval of the project by the concerned authorities and the dateof start of land development work

(viii) A copy of the clearance letter shall be marked to concerned Panchayatlocal NGO if anyfrom whom any suggestion representation has been made received while processing theproposal

Ox) A copy of the environmental clearance letter shall also be displayed on the website of theconcerned State Pollution Control Board The EC letter shall also be displayed at theRegional Office District Industries centre and Collectors Office Tehsildars office for 30days

8 These stipulations would be enforced among others under the provisrons of Water(Prevention and Control of Pollution) Act 1974 the Air (Prevention and Control of Pollution) Act1981 the Environment (Protection) Act 1986 the Public Liability (Insurance) Act 1991 and EIANotification 1994 including the amendments and rules made thereafter

9 All other statutory clearances such as the approvals for storage of diesel from ChiefController of Explosives Fire Department Civil Aviation Department Forest Conservation Act1980 and Wildlife (Protection) Act 1972 etc shall be obtained as applicable by project proponentsfrom the respective competent authorities

11 This Clearance is subject to final order of the Honble Supreme Court of India in the matterof Goa Foundation Vs Union of India in Writ Petition (Civil) No460 of 2004 as may be applicable tothis project

12 Status of compliance to the various stipulated environmental conditions and environmentalsafeguards will be uploaded by the project proponent in its website

13 Any appeal against this Clearance shall lie with the National Green Tribunal if preferredwithin a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act2010

6 The EAC enquired about the activities proposed under the Corporate SocialResponsibility (CSR) In response PP informed that the CSI~ activity is plannedfor the social benefit of the local fisherman and farm community The adequatejob opportunities both direct and indirect would be created for the local youthsby the way of implementation 0 this project Preference for small jobs will begiven to the locals based on their qualification and expertise Education sectorwill be improved with the adequate CSR plan Free scholarships will be given tothe poor students Regarding other issues raised during the hearing by localfishermen PP informed that vessels will move in well-defined channels markedwith buoys to avoid any damage to fishing nets The spillage of oil and wastewater is prohibited and would be monitored by the DG shipping and MPCB Asper modelling study by CWPRS Pune no adverse impact on fishing active orshoreline is envisaged The construction of the breakwater will create tranquilconditions inside the harbor by dissipating the higher wave energies Thebreakwaters do not have any other impacts on the tidal heights or any othermarine parameters The road and the rail corridor will be developed withou taffecting the present roads The present roads wherever necessary would bestrengthened and widened through the Public Works Department The landrequirement for such roads is much less and if any private land is involved it willbe purchased from the land owners directly through negotiations Even if thegovernment acquisition is necessitated providing adequate compensation wouldbe JSWILsmoral obligation

7 Project Proponent and the EIA Consultant namely M s Wapcos India Ltdhave presented EIA EMP report as per the TOR EAC has found the EIA EMPReport and additional information to be adequate and in full consonance with thepresented TORsThe EAC after detailed deliberation recommended the project inits meeting held on 24th - 26th June 2015 and 18th - 20th November 2015 forgrant of Environmental and CRZ Clearance As per the recommendations of I~ACthe Ministry of Environment Forest amp Climate Change hereby accordsEnvironmental and CRZ Clearance for the above-mentioned project All weatherGreenfield Jetty at Nandgaon of Taluka Palghar District Thane(Maharashtra) by M s JSW Infrastructure Ltd under the provisions of theEnvironment Impact Assessment Notification 2006 amp Coastal Regulation Zone(CI~Z)Notification 2011 and amendments thereto and Circulars issued thereonand subject to the compliance of the following specific conditions in addition tothe general conditions mentioned below

A SPECIFIC CONDITIONS

(i) Consent for Establish shall be obtained from State Pollution Control Board under the Air(Prevention and Control of Pollution) Act 1981 and the Water (Prevention and Control otPollution) Act 1974

(ii) The dredging shall be as per committed Dredging Plan and the dredging works shall becompleted in one fair weather season ie during October to March

(iii) Reclamation embankment shall be constructed and all the reclamation material shall bedumped therein so that no general turbidity in the area is created

(iv) Periodical study on shore line changes shall be conducted and mitigation carried out ifnecessary The details shall be submitted along with the six monthly monitoring report

(xi) In order to control dust emission during handling of the bulk cargoes (such as coal cokeiron ore limestone and bauxite) mechanized handling system and other associatedequipments such as hopper belt conveyors stacker cum reclaimers alongwith integrateddust suppression system shall be installed Stack yard shall be provided with water sprayingsystem

(xii) Dust suppression system shall be provided at the hooper and at the point of discharge onthe berth conveyor as the feeder underneath hopper at ship un loader as well as transferpoints in the conveying and transfer systems Mist and fog sprayers shall be used for thispurpose

(xiii) 15 m wide greenbelt shall be developed in the periphery of the facilities for dust arrestingpurposes

(xiv) As committed a windshield with a wire mesh fencing with fast growing creepers up to aheight of 14 m around the coalother bulk stack yard shall be provided for control of windgenerated dust

(xv) Wagon loading system shall be complying with the zero emission standards

(xvi) The gaseous emissions from DG set shall be dispersed through adequate stack height asper CPCB standards Acoustic enclosure shall be provided to the DG sets to mitigate thenoise pollution

(xvii) The PP shall undertake the environmental monitoring programme as committed in the EIAstudy

(xviii) Necessary arrangements as committed under the EIA study for the treatment of effluentsand solid wastes shall be made and it shall be ensured that the untreated effluents and solidwastes are not discharged into the waterCRZ area

(xix) There shall be no discharge of untreated effluent in marine water All liquid containing oilshall pass into sea only via oil separation system and meet the standards prescribed by theSPCBCPCB Effluent from Coal stack yard shall be treated in the settling lagoon Treatedeffluent shall be reused for water sprinkling in coal yard Sewage generated will be treatedin the STP

ir)

(xx) The quality of treated effluents solid wastes emissions and noise levels and the like fromthe project area must conform to the standards laid down by the competent authoritiesincluding the Central or State Pollution Control Board and under the Environment(Protection) Act 1986

(xxi) All the mitigation measures suggested in the EIA report and the marine environment studyof CWPRS Pune shall be implemented The compliance for each of these measures shalbe submitted to concerned SPCS and RO of this Ministry along with six monthlycompliance reports

(xxii) All the conditions stipulated by the Maharashtra Coastal Zone Management Authority(MCZMA) vide letter No CRZ-2012CR-242TC-4 dated 24022015 shall be strictlycomplied with

(xxiii) There shall be no drawal of ground water in CRZ area

(xxiv) Spillage of fuelengine oil and lubricants from the construction site are a source of organicpollution which impacts marine life particularly benthos This shall be prevented by suitableprecautions and also by providing necessary mechanisms to trap the spillage Dredging etcwill be carried out in the confined manner to reduce the impacts on marine environment

(xxv) All the recommendation of the EMP including the dust control at storage and handling ofcargos shall be complied with letter and spirit The Project Proponent may be asked tosubmit all the EMPs mentioned in the EIA report and during the subsequent presentationsmade before the EAC shall be submitted in a tabular format with budgetary provisions andthe same shall be submitted to Ministry and with a copy to RO MoEFCC within twomonths

(xxvi) All the conditions stipulated by Commissioner of Fisheries Government of Maharashtra videletter dated 13012014 shall be complied with

(xxvii) The project proponent shall set up separate environmental management cell for effectiveimplementation of the stipulated environmental safeguards under the supervision of aSenior Executive

(xxviii) The funds earmarked for environment management plan shall be included in the budgeand this shall not be diverted for any other purposes

(xxix) The environmental monitoring programme of the project shall be continuously carried outand NCSCM (National Centre for Sustainable Coastal Management) Chennai for whicrfunding shall be done by the PP

(xxx) Creeks shall not altered in terms of width depth and shoreline characteristics A monitoringmechanism has to be put in place through satellite imagery and bathymetry measurements

(xxxi) The responsescommitments made to the issues raised during public hearing shall becomplied with in letter and spirit A hard copy of the action taken shall be submitted to theMinistry

(xxxii) The proponent shall abide by all the commitments and recommendations made in theEIAEMP report so also during their presentation to the EAC

(xxxiii) Corporate Social Responsibility

a The Company shall have a well laid down Environment Policy approved by the Board ofDirectors

b The Environment Policy shall prescribe for standard operating processprocedures tobring into focus any infringements deviationviolation of the environmental or forestnorms conditions X~

B GENERAL CONDITIONS

(i) Appropriate measures must be taken while undertaking digging activities to avoid any likelydegradation of water quality

(ii) Full support shall be extended to the officers of this Ministry Regional Office at Nagpur bythe project proponent during inspection of the project for monitoring purposes by furnishingfull details and action plan including action taken reports in respect of mitigation measuresand other environmental protection activities

(iii) A six-Monthly monitoring report shall need to be submitted by the project proponents to theRegional Office of this Ministry at Nagpur regarding the implementation of the stipulatedconditions

(iv) Ministry of Environment Forest and Climate Change or any other competent authority maystipulate any additional conditions or modify the existing ones if necessary in the interestof environment and the same shall be complied with

(v) The Ministry reserves the right to revoke this clearance if any of the conditions stipulatedare not complied with the satisfaction of the Ministry

(vi) In the event of a change in project profile or change in the implementation agency a freshreference shall be made to the Ministry of Environment Forest and Climate Change

(vii) The project proponents shall inform the Regional Office as well as the Ministry the date offinancial closure and final approval of the project by the concerned authorities and the dateof start of land development work

(viii) A copy of the clearance letter shall be marked to concerned Panchayatlocal NGO if anyfrom whom any suggestion representation has been made received while processing theproposal

Ox) A copy of the environmental clearance letter shall also be displayed on the website of theconcerned State Pollution Control Board The EC letter shall also be displayed at theRegional Office District Industries centre and Collectors Office Tehsildars office for 30days

8 These stipulations would be enforced among others under the provisrons of Water(Prevention and Control of Pollution) Act 1974 the Air (Prevention and Control of Pollution) Act1981 the Environment (Protection) Act 1986 the Public Liability (Insurance) Act 1991 and EIANotification 1994 including the amendments and rules made thereafter
