MLA probed overuse of vote records A POLITICIAN is under investi-gation ater challenging constit-uents over their ailure to vote.
By doing so, Upper Bann MLA Sam Gardiner revealed that he was checking electoral records tosee whether those who contactedhim or help had voted.
Last night the Electoral Ofceconfrmed to the News Letterthat it is investigating the UUP veteran, who is Stormont’s old-est MLA at 71, over his use o electoral registers.
The case centres on allega-tions by two o Mr Gardiner’sconstituents – Peter Marks andDylan Lyness – that the MLA was less than helpul when theyasked or assistance and that on
both occasions the reason given was that they had not voted inMay’s elections.
It is legal or MLAs to have ac-cess to electoral registers whichshow who has voted – thoughnot how they voted – or elector-al reasons and parties use theseto target non-voters with litera-ture.
However, under The Represen-tation o the People (Northern
Ireland) Regulations 2008, anyother use o the registers is an o-ence which attracts a maximumfne o £5,000.
Mr Gardiner, who said he had“a record o helping everyone”,has apologised to the two men who complained and said thatboth incidents had been mis-takes.
