That on or about 27th day of October , 2013, in the City of Baguio, Philippines and within the jurisdiction of this Honorable Court, the above-named accused, being the armed with 12 inches dagger with intent to kill, did then and there willfully, unlawfully and feloniously, treacherously attack, assault and stabbed Dwayne Wade Y Shooter, thereby inflicting upon the latter stab wound on the neck (nape), which injury directly caused his death. The undersigned accuses Lebron James Y Dunker of the crime of Murder, committed as follows:

That on or about 9:00 o’clock in the evening at the #555 Upper Bonifaco St. Baguio City, Lebron James Y Dunker stabbed to death Dwayne Wade Y Shooter with the use of 12 inches dagger wounding the victim once in his neck (nape), which injury directly caused his death.

You are hereby to commanded to arrest Lebron James Y Dunker, who is said to be found at #23 Aurora Hill, Baguio City has been charged before me with the offense of HOMICIDE and bring HIM forthwith before me to be dealt with according to law.

The bail for the release of the accused in this case is fixed at (NO BAIL) which may be furnished by the said accused either by depositing the amount thereof with the nearest collector of internal revenue or provincial, city or municipal treasurer who should submit the same to this Court, or by furnishing a corporate surety bond or property bond subscribed by the solvent surety whose real estate must be worth at least the amount therein fixed or two or more sureties who may each justify severally in amounts less than that herein fixed, provided that the total justified is equivalent to the whole amount of bail thus fixed, whose solvency may be shown by their land tax receipts and certificate of title free from encumbrances and determined by any judge of Regional Trial Court, Municipal Trial Court, Municipal Circuit Trial Court who may accept the bail bond and submit the same to this Court. We the undersigned police officers, all of legal ages, Filipino citizens, bona fide members of the Philippines National Police, and presently assigned with the Baguio City Police Office (BCPO), Patrol Division and with a tour of duty from 8:00 o’clock in the morning to 8:00 o’clock in the evening, after having been duly sworn to under oath and in accordance with the law do hereby and state the following to wit:

That on November 1, 2013 at around 1:30 o’clock in the afternoon, we, armed with a warrant of arrest issued by Hon. Judge David B. Stern of the Regional Trial of Court, First Judicial Region, Brach 69, purposely and solely went to the house of the suspect at #23 Aurora Hill, Baguio City

That at around 1:30 in the afternoon, a suspect went out from the said house; we immediately recognized him that he is Lebron James Y Dunker, the suspect of killing incident at #555 Upper Bonifacio St. Baguio City.

That after sometime, we put the said male person under arrest where I (SPO3 Tim B. Duncan) informed him of his constitutional rights, likewise explained the nature and cause of arrest in dialect that he clearly understood and subsequently brought him at Station 7 on board of mobile car.

That at the police station, with his counsel, Atty, Kobe Bryant, the suspect confessed that he stabbed to death Dwayne Wade Y Shooter.

That we are executing this joint affidavit of arrest to attest the truthfulness of the foregoing facts.

Date : October 27, 2013 .

1.Reference: a. Police Blotter entry no. 69 dated October 27, 2013.

2. On or about 9 o’clock in the evening of October 27, 2013 at # 555 Upper Bonifacio St., Baguio City, Dwayne Wade Y Shooter, 18 years old, single, student and a resident of the said place was stabbed to death. A male person described to be 18-20 years old , standing 6’5-6’7 with a pink t-shirt and blue pants and armed with a 12 inches dagger with his left hand walking casually into the house. Investigation disclosed that the victim was seen when all of a sudden a loud scream was heard. After that the victim was seen sprawled on the living room with blood oozing from his head and still breathing. Initial investigation disclosed that a person named Lebron James Y Dunker, 18 years old, single was seen before a crime scene before the killing incident waiting for policeman. Investigation finally disclosed that the personnel of Baguio City Emergency Medical Service on Board an ambulance came afterwards and rushed the victim to the Baguio General Hospital. SOCO team lead by PS/INSP SCOTTY S. PIPPEN also responded at the scene wherein a 12 inches dagger recovered which is now on their custody. The victim’s attending physician Dr. Larry Bird informed that the victim already expired and declared dead on arrival due to a stab wound on hi right neck. Motive still ascertained. 3. In the autopsy report #33 dated October 28, 2013 and signed by Dr. Derrick C. Bulls, Medico Legal Officer , PNP Crime Laboratory shows that the cause of death was duen to stab wound that penetrated his right neck (nape).

2. In connection with above references on or about 1:30 in the afternoon Lebron James Y Dunker was arrested at # 23 Aurora Hill, Baguio City and was brought at Baguio City Jail.

3.The case was forwarded on November 5, 2013 to the Baguio City Prosecutor’s Office for their further study, evaluation and final disposition.

SWORN STATEMENT OF MICHAEL JORDAN Y CHAMP, EXECUTED BEFORE SPO4 JULIUS P. ERVING IN THE PRESENCE OF HIS COUNSEL ATTY. KOBE BRYANT BY WAY OF QUESTION AND ANSWER IN THE ENGLISH LANGUAGE AND CAREFULLY TRANSLATED IN TAGALOG DIALECT WHICH THE AFFIANT SPEAKS AND FULLY UNDERSTAND THIS OCTOBER 30, 2013. .

PRELIMINARY: Mr. Michael Jordan, I would like to inform you that you are under investigation regarding the killing incident on October 27, 2013 at #555 Upper Bonifacio St. Baguio City. But before asking you any question ,I would like to inform you your constitutional rights; that you have the right to remain silent , that anything you say may use against you in the Court of Law and ; that you have the right to a competent and independent counsel, preferably of your own choice and if you cannot afford the services of a counsel, the state will provide you one.

2. What prompted you to proceed here this morning?A: I would like to give my testimony regarding the stabbing incident at #555 Upper Bonifacio St., Baguio City.

3. Q: Why are you giving your statement?A: I am giving my statement in support of any complaint that may be filed against the person who shot my neighbor to death.

4. Q: Kindly identify the person or the victim you are referring to?A: He was Dwayne Wade Y Shooter, 18 years old, single, student and a resident of #555 Upper Bonifacio St., Baguio City.

5. Q: How are you related to the victim?A: Dwayne Wade was a good friend of mine, since I lived here in Baguio.

6. Q: How was the victim killed by the perpetrator?A: The victim was stabbed to death by the suspect at the right neck.

7. Q: Where was the incident happened?A: It all happened inside the house of the victim, exactly at the living room.

8. Q: When was this incident committed?A: On or about 9:00 o’clock in the evening of October 27, 2013.

9. Q: Where are you during the crime was happening?A: I was also at the same house but I was hiding at the C.R. while the suspect was killing the victim.

10.Q: What are you doing at the victim’s house?A: I regularly visit him and talked with him every night.

11.Q: Do you know the identity of the perpetrator who killed your friend?A: Yes Sir, he was also a friend of mine.

12.Q: Can you identify who he was?A: He was Mr. Lebron James, 18 years old, single and student. He lives at #23 Aurora Hill, Baguio City.

13.Q: What is the relationship between the victim and the suspect?A: We are all friend, they are classmates since 1st year college.

14. Q: You said that during the incident you are also at the same house, particularly at the C.R. How are you able to witness the incident if you are at the C.R.?A: I was watching them how it all happened, because I slightly opened the door of the C.R.

15.Q: Will you please state how it happened?A: I was peeing at the C.R. when suddenly I heard a slamming of the door and I heard a man shouting. I slightly opened the door and I saw a man named Lebron James pointing a knife to Dwayne Wade and saying “ Walang hiya ka pati syota ko sinulot mo. Gago ka!”.

16.Q: What was then the reaction of the victim?A: Initially the victim was shocked and suddenly laughed while saying the words “Pare mali iniisip mo. Kaibigan ko lang si Marian.”

17. Q: Do you know who this Marian was?A: She was Marian Rivera, I think she was the longtime girlfriend of Lebron James.

18.Q: Do you know about this love affair?A: I know nothing about it Sir, all I know was she’s the girlfriend of Lebron James.

19. Q: After the words stated by the victim, what was the next event?A: Wade turned his back on James while saying the words “Magingat ka sa mga pinagsasabi mo, wag ka magbibintang ng walang proweba.”

20.Q: What did James do then? A: He walked towards Wade and grabbed the hair of it, without words he stabbed him at the right neck of the victim. And I saw how the victim lied down the floor holding his wound. He stared at me and I could not stand that situation.

21. Q: What happened next at the crime scene?A: James dropped the weapon and immediately ran outside the house.

22.Q: Why didn’t you help Wade in protecting himself?A: I was scared, because I know that James was a known trouble person.

23.Q: What did you do then?A: After James ran away, I walked near Wade and covered his wound with a piece of cloth. The victim look at me and saying “tulong.” I ran outside and ask for assistance. Someone called the police and within 10 minutes they responded.

24. Q: When the police arrived, what did they do?A: They immediately render a first aid and deliver the victim at Baguio General Hospital. They cordoned the crime scene with a police line, photograph the crime scene and recovered the evidence.

25.Q: What did the police recovered from the crime scene?A: They were able to discover a 12 inches dagger full of blood, after photographing, they put it into a container.

26.Q: To whom you first gave your statement?A: To the first responder, who was also the SOCO team leader, PS/INSP. SCOTTY PIPPEN.

27.Q: What did you tell him? A: I told him everything I saw just like what I told you today.

28.Q: The investigator has nothing to ask you at present, do you have more to say, add or retract from your sworn statement?A: No more Sir.

NARRATIVE OF INCIDENT:

That on or about 2100H 27 October 2013, at # 555 Upper Bonifacio St., Baguio City, after receiving a call police officer responded at the incident at the said place.

Acting on the request, the SOCO team led PS/INSP Scotty Pippen proceed at the incident with coordination with SPO3 Magic Johnson who was the first responder of the scene regarding the status of the cases.

The SOCO team processed the crime scene and assessed that the person stabbed was Dwayne Wade Y Shooter, 18 years old, single, student. Recovered from the scene was a swabbed blood sample on the floor of the living room and a 12 inches dagger also full of blood. The victim was immediately rushed at the Baguio General Hospital for medical treatment but declared dead on arrival. Photographs were taken and sketches were drawn for documentation purposes.
