Glenn: Thanks for providing me your requests for additional information for Lot 2 of the Wooden Deer ADU application. I have the following comments: Updated Deed for property. It is my understanding that you now have that in your possession.

LLC Manager's Signature. You already have the signature for one of the owners (Brad Crawford) on the original application. I have sent a copy of a Land Use Change Application form to Vicki Peterson to get her signature also. As an FYI, she is traveling with Brad Crawford, but I expect that signature to be scanned and returned within the next few days.

Mineral Rights. I reviewed the Title Commitment for the property dated 4-28-17. The B-2 exceptions did not list any oil/ gas leases or have any other notations or documents related to mineral rights or oil/gas interests. I took that to mean that no such leases were recorded. The Title work was included in Section 4 of the submitted application.

In addition, the Wooden Deer property went through Land Use Entitlements for subdivision in the early to mid-1990's. As this application was approved with no protests that we are aware of, we assumed that there were no outstanding mineral/oil/gas leases or persons and organizations with any such interests that protested at that time -and if such protests did occur then appropriate actions or solution occurred at that time.

Access off CR Road 1014. CR 104 is known as Blue Road at the southern fringes of the Wooden Deer Subdivision. Lots 21 and 22 are adjacent to Blue Road but do not access off of that road. They, and all lots in Wooden Deer have direct access off of Wooden Deer Drive. No lots have access off of Blue Road.

Ability to provide water service to ADU's in Wooden Deer. To be provided.

I am the Operator in Responsible Charge (ORC) for the Wooden Deer Homeowners Association community water system. I have operated the system since March 1997. There are 22 lots in the subdivision of which 11 have been developed with single-family residential units. The system is operated in conformance with all requirements of the Colorado Department of Public Health and Environment (CDPHE). Tbe water quality in the subdivision is good and meets all requirements of the CDPHE. Water purification for the subdivision includes injection of sodium hypochlorite on a continuous basis. A minimum of 0.2 ppm chlorine is injected at the entry point to the water system and a chlorine residual of 0.2 ppm is maintained at the extremities of the water system.

A single well pumps to a 50,000 gallon storage tank located at the high point of the subdivision. Water is gravity fed from the tank to each of the taps on the lots. Each lot is required to have a water meter to measure use and lots are billed based upon water consumption. Fire protection in the subdivision is provided by strategically located 10,000 gallon cisterns and fire hydrants. Water mains in the system are 6 inches in diameter. The Wooden Deer Water system supply is adequate for the 22 lots and for outside irrigation.

In addition to monthly total coliform bacteriological tests to ensure portability, other tests are completed in accordance with a schedule produced annually by CDPHE. A copy of this schedule is attached to this letter. Most recently in August the following tests were completed: lead & copper, nitrate, fluoride, inorganics group, synthetic organics group and volatile organics group. A copy of these test results is included with this letter.

Annually, Consumer Confidence Reports (CCR) are completed and mailed to each property owner by June 30. There is reports show that there have been no "violations" on the system and they disclose the testing completed and confirm that there have been no issues with water quality. A copy of the June 2017 CCR 's is included with this letter for your information.

In summary, water system is adequate in terms of both physical and legal supply for the 22 lots at buildout and the water meets all CDPHE standards for quaJity and portability. Please do not hesitate to contact me if you have any questions about this information.

PRELIMINARY WAIVER REQUEST FOR ADU - LOT 2 - WOODEN DEER

Roadway Standards - section 7 - 107. This is for Wooden Deer Drive. I have elaborated on the driveway standard.

Section 4 - 203 (M). Central Water Supply and Distribution Plan. I have asked the HOA Pres. for engineering background and initial pump test for the single well for the Wooden Dear water system. If I don't get this by Tuesday morning, I will come in and review original project file.

• Am receiving information on normal testing procedures, system background and a copy of Consumer Confidence Report from system operator (Davis Farrar).

Section 4 - 203 (Traffic Study). This is for background traffic for the subdivision itself -I can calculate this but I can't sign it as an engineer. I will elaborate on traffic generated by the ADU.

Section 4 - 203 (G.3) soils. I did get the original soils report from HP Kumar, though this is just for Lot 2 not the overriding soils (or Geotech) analysis for the subdivision is all. Soils test was done purely related to single-family home construction, foundation, suitability for septic etc.

Section 4 - 203 (G.4). Geology and Hazard. As noted above, I don't have this initial report.

Section 4 - 203 (G.6) - Environmental Impacts. This is essentially because I cannot find a suitable map on the Colorado Parks and Wildlife homepage. There are some wildlife maps, but the scale was so large I cannot determine precise impact for this subdivision area of Missouri Heights. It looks like there is Mule deer Winter Range and appears to be Elk Winter Concentration area. However, if it is correct mapping of area for elk, it just doesn't seem logical. Most of the winter concentration areas for elk are in open areas near Valley bottom. I spent two hours looking for an appropriate map. Do you have a specific link for this??

1. Applicant's Signature. I am attaching the signature of Vicki Crawford. The signature is on the Land Use Change Permit signatory block. I have dated it and noted under the signature that it is signed as one of the Managing Partners as noted in the BVC Wooden Deer Statement of Authority. The Statement of Authority was recorded on May 18, 2017. I can send you a copy of the recorded SOA at your request.

2. Mineral Rights. As I noted in a previous discussion, I started my research related to mineral rights by reviewing the Title Commitment issued with the property sale documents. The Title Commitment was included as part of the Land Use Change Permit application. There were no oil and gas leases noted in the Title Commitment. I then did a search in the Garfield County Clerk and Recorder's Office. I searched recorded documents for any oil and gas leases are related documents using the following owners' names as granters or grantees. Those specific names were:

• BVC Wooden Deer LLC • Vicki and Brad Crawford • Carbondale capital and Develop Corporation (Developer of Wooden

Deer Subdivision)

I found no evidence of oil and gas leases under any of those names as noted above. I have not had the opportunity to look at the previous owner's name for the Wooden Deer Subdivision property. I will do that upon my return from vacation. I return on October 30th.
