    AND IN THE MATTER OF the Premises known as Municipal number 102 Highway #8,formerly in the City of Stoney Creek, now in the City of Hamilton and in a "SC2"(Community Shopping Centre) district;

    AND IN THE MATTER OF AN APPLICATION by the agent Zelinka Priamo Ltd. (lanRutledge) on behalf of the owner CP Reit ON Limited Partnership, for relief from theprovisions of the Zoning By-Law No. 3692-92, under Section 45 of The Planning Act,R.S.O. 1990, c.     4. An outdoor garden centre (outside storage) shall occupy 19 required parkingspaces notwithstanding outside storage is not permitted to be located on landsspecifically provided as required parking;

    5. Parking spaces shall be located 3.3 metres from the westerly lot line abutting acommercial use (GC-6 zone) instead of providing a minimum distance of 5.0 metres fromany parking space to any lot line;

    6. The loading spaces for "Building G" and "Building H" shall be provided within a sideyard notwithstanding loading spaces are not permitted to be located within a front yard ora side yard;

    It should be noted that insufficient information was provided to confirm complianceregarding several outstanding items as stated in Building comments dated December22, 2014, provided for review of Site Plan control application DA-14-138.   • To The Variance Committe:

    We are applying for a variance to the property at 549 Stonechurch Rd East. The Unit we are

    applying for the variance for currently has a Pizza take out establishment in the front half of theunit that has been allocated half of the said unit, for its business by City Hall.

    The back half of the unit therefore remains vacant.

    The unit we are applying for the variance for at one time before it became vacant was a

    bar/restaurant. A liquor license has already been approved for the unit in the former tenants

    name. We could assume that liquor licence but would prefer to re-establish it and start from

    fresh.

    We have approached the owner of the unit (he also owns the rest of the Mall) and he is

    agreeable to renting us the back of the unit as a Lounge/Bar.

    The Pizza establishment also has no concerns with renting us the back half as a Bar, as this will

    help create business for them as well ie: customers.

    We would like to make the back half of the unit a comfortable, classy place where customers

    can come to relax--a modern take on a classic tradition.

    We want to restrict the age of customers to over 25 yrs old, as well to limit potential conflicts

    that can occur in the under 25 yr old age group.

    Our hours will also be limited as we will only be operating from 4pm till closing, unless there is a

    special event during the day ie: Sports, as well to ensure that the highschool in proximity has

    closed and students have all made it home before opening time.

    Our business will also increase revenue for the variety store next door as well.

    The parking should not be an issue as the Lounge will only be open at night and all the other

    businesses in the plaza will be closed except for the variety store and the Pizza Place.

    We feel that this type of establishment will provide the neighbourhood with a place that people

    can come together to socialize, as currently there is not an establishment such as this in the

    area, plus offer a safe environment which people can walk to and enjoy fine spirits, great

    service and atmosphere without driving.

    We have lived right behind this establishment for over 26 years and we respect our neighbours

    in regards to loud music and noise, there will be no live bands or loud music allowed. We want

    our neighbourhood to be proud of our establishment.

  • We have spoken to a number of people in the area and have so far not had any concerns, but

    we have had alot of enthusiasm from people, in that they will finally have a place to go, away

    from their homes and socialize, enjoy a night out, and go to see sporting events as well as other

    celebratory occassions etc.

    The owner of the Mall, Pizza Place and Variety Store are also eager to see our establishment in

    place because it will increase their business, and they are confident in our ability to make the

    Lounge a respectable place in the community. Our location will be the closest establishment of

    its kind to turner park and we wish to offer sponserships to sports teams as well.
