in person and represented by counsel, Terrence Rudes; andcame the
following named persons as jurors, to wit:

On the 4th day of Deceinber , 1.991, came the Prosecuting
Attorney on behalf of the State of Ohio and also came the defendant
in person and represented by counsel, Terrence Rudes; defendant
havirg heretofore been found "guilty" by a jury trial for the
offense of Aggravated Murder (O.R.C. Sec. 2903.01) as charged in
Count No. 1 subject to a penalty of life in prison; further, the
Prosecuting Attorney, with leave of Court on good cause shown,
thereupon entered a NOLLE PROSEQUI on Count No. 2 of the indictment
filed herein; the Ccurt having before it a presentence
^ investigation report inquired. of the defendant if he had anything
