Insu rance offer and contractual relationships

TA P offers the insurance "Chubb Travel In surance" w ithin the scope of flight bookings of future p assengers and their

r elatives exclusively from Chubb In surance (Switzerland) Ltd. (Chubb) a nd has concluded a cooperation agreement

w ith Chubb for this purpose. TAP is a t ied agent within the meaning of the federal supervision of brokers.

Pa yment of com pensation for mediation activities

Du e to the referral of customers to Chubb, TAP r eceives compensation from Chubb, which is r etained by TAP a s

com pensation for its expenses. This compensation is included in the insurance premium.

Lia bility

For n egligence, errors or incorrect information by TAP in connection with the distribution of the insurance "Chubb

Tr avel In surance" Chubb is liable to the customer.

prevails in case of litigation.

Th e following provides y ou with an ov erview of the insurance in accordance with the pr ov isions of Art. 3 of the Swiss In surance Contract Act (VVG). Th is information is not ex haustive. The full content of the contract can be found in the policy (where y ou will also find th e agreed insurance benefits, insured sums and the insured person(s)) and the enclosed Com prehensive Conditions of In surance (which contain the legally applicable precise definitions).

1. The Insurer

Th e In surer is Chubb In surance (Switzerland) Limited, h ereinafter r eferred to as "Chubb". Ch ubb is a limited company under Swiss law and has its registered office a t Bärengasse 32, 8 001 Zurich.

Ch ubb In surance (Switzerland) Limited (“CISL”) is a su bsidiary of Chubb Limited (a NYSE listed company). CISL is part of the Chubb Group of companies and may be subject to certain US la ws and regulations in a ddition to UN and Swiss sanctions restrictions which may pr oh ibit it from prov iding cov er or paying claims to certain individuals or entities, and from in suring certain types of a ctivities in or connected with certain countries and territories such a s, but not limited to, Ir an, Sy ria, North Korea, North Sudan, Cuba and Crimea.

2. Who is insured?

Per sons who have their place of r esidence in Switzerland may be insured.

Th e insured persons are specified in the policy and the General Conditions of In surance.

3. What is insured?

Th e insurance product you have chosen, Travel In surance including Cancellation, Travel In su rance excluding Cancellation or Cancellation Insurance, is shown on your Policy.

A Tr ip Abroad during the period of in surance that takes place entirely within the area of tr avel stated in the Policy, as long a s a return flight back to Switzerland has been booked before the commencement of the insurance cover.

2. Ca ncellation Insurance

2.1 Rou n d Trip

A Tr ip Abroad during the period of in surance that takes place entirely within the area of tr avel stated in the Policy.

2.2 On e way Trip

A Tr ip Abroad during the period of in surance that takes place entirely within the area of tr avel stated in the Policy but has no scheduled return date.

Th e insured r isks and the scope of cov er are specified in the policy and the General Conditions of In su rance. For some policies, an excess shall a pply. Please r efer to the ov erview of insurance cov er in y our Policy regarding this.

4. Who and what is not insured?

COV ID- 19 Specia l Exclusion

Th is Policy does not cov er and we will not (under any sections) pay for claims of a ny kind directly or indirectly arising from, r elating to or in any way connected with the Coronavirus Disease 19 (COVID-19) (or any mutation or variation thereof) and / or its ou tbreak. To the extent that any term or condition in the Policy may be inconsistent with this exclusion, this exclusion shall pr ev ail.

No insurance cov er exists for losses:

• in curred as a r esult of carrying out the following a ctivities on the trip:

­ r iding;

­ jet skiing;

­ m otorcycling (motorcycles are deemed to be a ll motorbikes, scooters, quads or trikes with an engine capacity of more

th an 50 cc);

­ spor ts diving and diving beyond the maximum depth permitted for the diving certificate achieved;

• in curred in connection with manual work during the trip;

• th at had a lready occurred or should have been known at the time the insurance was concluded or the trip was booked;

• th at were intentionally caused by you or other insured persons;

• th at you or the other insured persons have caused as a r esult of or during the deliberate commission of a criminal offence

or th e deliberate attempt to commit such an offence;

• th at have been caused either directly or indirectly by acts of war or civil war. Please refer to the Conditions of In surance for

definitions of the abov e terms;

• in r elation to which the external loss a djuster such a s e.g. a doctor is a direct beneficiary or is related to you or the other

in sured person by blood or marriage;

• w h ich are incurred under the direct influence of drugs, medication, n arcotics or medicinal products;

• w h ich occur during active participation in:

• com petitions, races and rallies or training for such races with motor vehicles or boats;

• com petitions and training as a professional sportsperson or in connection with an extreme sport (e.g. skydiving, high

m ountain tours);

• da n gerous acts by which a person knowingly exposes himself to a particularly great da nger.

• In a ddition to the general exclusions, specific exclusions also a pply to the individual types of cov er.

• In curred on a trip where winter sports is the main r eason for your trip.

I. Medical costs abroad: • Ben efits for illnesses or accidents which had already occurred at the start of the trip. There is an exception for any

u n foreseen a cute worsening of h ealth due to a chronic condition

• A ny sy mptoms or illnesses existing a t the start of the trip and the consequences and complications of such

• Ex a minations and medical treatment due to pregnancy as well as childbirth and termination of pregnancy unless these

become n ecessary a s a result of an unforeseen a cute worsening of the health of the mother or of the unborn child

• Retention costs and statutory social security franchises

II. Accident endowment: • A ccidents suffered by the insured person as a result of mental disorders or impaire d consciousness a s well a s accidents

su ffered as a r esult of epileptic fits or other seizures which a ffect the insured person’s entire body

• Da m age to intervertebral discs a s well a s bleeding from internal organs and brain haemorrhages , unless these are caused

by an accident

• For v iolent a cts by third parties

• In fections, unless these are caused by therapeutic treatments or surgery necessitated by an accident

• Poison ing a s a result of or ally taking solid or liquid su bstances

• A bnormal disorders a s a result of psy chological reactions which cannot be directly and causally a ttributed to a physical

in jury / a physical loss, ev en if these are caused by an a ccident

III. Cancellation and curtailment of the trip:

IV. Baggage and travel incidents: • Losses a s a r esult of you or other insured persons not taking the usual precautions to ensure the security of y our personal

ba ggage and property e.g. whilst this is a t a publicly a ccessible place and n ot in y our direct care

• Losses ca used by a bandonment, leaving property hanging, leaving property behind or dropping

• Da m age to or loss of:

­ g la sses, contact lenses, hearing aids, all kinds of pr osthesis;

­ da mage to securities, bonds, debentures, stamps;

­ documents of any kind;

­ da mage to a nimals;

­ m usical instruments;

­ g la ss, porcelain, antiques;

­ items a t trade fairs and exhibitions;

­ pictures;

­ spor ts equipment while in u se, bicycles;

­ items u sed for carrying out trade or business activities unless defined a s business equipment;

­ telev isions;

­ v ehicles or accessories;

­ boa ts and / or auxiliary equipment;

­ to items loaned or entrusted to the insured person or hired by him;

­ for w hich we have n ot been provided with the police report or the public transport company’s report;

­ per sonal items of baggage during transportation that are n ot reported to the public transport company immediately;

­ a s a r esult of civil disturbances, rebellion, revolution, terrorism, military or unauthorised seizure of power;

­ a ll kinds of w eapons.

• Losses a s a r esult of seizure or confiscation by customs authorities or any other public authority

• Da m age or destruction

V. Personal liability:

No in surance cov er exists for liability claims:

• if th ey exceed the scope of your statutory liability due to the contract or express commitments;

• a r ising from loss ev ents suffered by persons who are close to you and who live together with you as a household;

• between sev eral persons insured under the same insurance contract;

• du e to losses to third party property and a ll pecuniary losses resulting from such property losses if you or the other insured

per sons have rented, leased, borrowed su ch property or have a cquired it by infringement of property rights or if it is the

su bject of a separate contract of safe custody;

• da mage to r ented rooms / h ouses and their fixtures a nd fittings is included in a ccordance with Clause 3.7 (damage to

r en ted property). The following remain excluded:

• lia bility claims for wear and tear and excessive use;

• r esulting from the exchange, the transmission or the prov ision of electronic data a s long as this relates to:

­ th e deletion, suppression, destruction or modification of data;

­ n on -recording or failed saving of data;

­ th e disturbance of a ccess to electronic data exchange;

­ th e transmission of confidential data or information;

• r esulting from losses arising from the infringement of personality r ights or name rights;

• r esulting from losses arising from hostility, bullying, harassment, unequal treatment or other discrimination;

• r esulting from bodily harm arising from the transmission of an illness suffered by the insured person.

Th is list contains only the most common exclusions. Other exclusions can be found in the General Conditions of In surance, the Special Conditions and the Swiss In surance Contract A ct (VVG).

5. How is the premium calculated?

Th e amount of the premium is determined on the day of the conclusion of the In surance Contract on the basis of the risk a ssessment that was made by u s; the Insurance Premium is dependent on:

– th e insurance period;

– th e individual risk a ssessment that is made by us on the basis of the information r eceived;

– n umber of Persons In sured.

If cir cumstances are disclosed which significantly change the likelihood of a Claim, each party to the In surance Contract (i.e. both You and Us) may demand an appropriate change in the amount of the Insurance Premium from the t ime the circumstance occurred, though not earlier than from the beginning of the current insurance period.

Th e amount of the premium is specified in the application and can be found in the insurance policy.

6. What are the payment terms?

Th e premium must be paid as a single sum immediately following the conclusion of the contract. Please r efer to your insurance policy for the amount of the premium.

7. What duties and obligations do you have as Policyholder?

Obligations are duties (before the conclusion of the contract, during the term of the contract and in the ev ent of benefits becoming payable) which you must observe without fail in or der to ensure that you do n ot lose cov er either partially or in full.

You must:

• befor e the conclusion of the contract:

­ a n swer all qu estions in the application form truthfully and fully (pre-contractual duty of disclosure).

• du r ing the term of the contract: ­ pa y the premium on t ime;

­ r eport any changes to your a ddress or name;

­ r eport any changes to the facts stated in the application which are relevant for a ssessing risk (increased risk).

• a fter an insured ev ent:

­ v isit a doctor a s soon as possible and follow his or ders;

­ in form Chubb immediately.

Oth er duties can be found in the contract conditions and the Swiss In surance Contract A ct (VVG).

8. What is the term of the contract?

Th e commencement and end of the insurance are specified in the application form and set out in the policy.

9. How does Chubb handle your data?

Ch ubb processes data obtained from the contract documents or from performing the contract and uses such data particularly for determining the premium, for investigating r isk, for processing insured ev ents, for statistical ev aluations and for marketing pu r poses. Hard or electronic copies of the data are stored. TAP and Chubb may forward data to both national and foreign third pa r ties involved with performing the contract where n ecessary, particularly to co-insurers and reinsurers and to both national a n d foreign Chubb companies for processing. Chubb may also obtain relevant information, particularly relating to the claims h istory, from official a gencies and further third parties. Thi s applies irrespective of whether the contract is concluded. The in sured person has the right to r equest from Chubb the information prescribed by law r egarding the processing of the data con cerning h im.

Introduction

Th is insurance policy prov ides both protection from the financial consequences of v arious risks r elating to travel as well as a ct ive emergency aid via Assistance.

Th ere are three cov er options available. The insurance cov er for each package differs considerably in places. Please therefore en sure that you read through the following Conditions of In surance carefully.

You are the Policyholder and thus our contractual partner. You and / or y our family members may b e insured persons as long a s th ey have n ot attained the age of 65 years at the time the contract is concluded. The insured persons are specified in the booking con firmation from your a irline and / or the insurance policy.

Part 1. General Conditions of Insurance ("Consolidated Conditions")

Ch ubb In surance (Switzerland) Limited, Bä rengasse 32, 8 001 Zurich, hereinafter referred to as "Chubb", is liable for the benefits a g reed with the Policyholder and specified in this insurance document and the policy. The benefits are specified in the General Con ditions of In surance and also by the prov isions of the Swiss In surance Contract Law (VVG).

Th e Consolidated Conditions for a ll insurance components on ly a pply insofar as no prov isions to the contrary are prov ided in th e Special Conditions for the individual insurance components.

1. Wh o is insured?

Cov er exists for those persons who are specified as being insured in the flight confirmation document and / or the Policyhold er's policy . The insurance policy is valid exclusively for trips a broad for a duration of u p to 30 days. Please note Part 1. Clause 9 “ When is there no insurance cov er?”.

2. Wh ere does the insurance apply?

Th e insurance a pplies to a trip a broad during the period of in surance and to the area of travel as stated in your policy of in surance. Please refer to the clauses "Un insured ev ents" (see Part 2., sections B to K, each clause IV . “Uninsured ev ents”).

3. Com m encement and end of the insurance cover

3.1 Ca n cellation cov er

You r insurance cov er for travel cancellation commences upon purchasing the policy or upon the date of commencement of in surance specified in the policy, whichever is the later. This insurance cover ends upon leaving to commence the trip.

3.2 Oth er than cancellation cover

In su rance cover under all other sections operates for a trip during the period of cov er as stated in y our policy.

4. Wh en does the contract commence a nd end?

Th e contract is concluded for the period set out in the policy. The contract shall end without r equiring any n otice of termination on th e specified date.

4.1 If a r eturn trip is impossible:

4.1 .1 a s a r esult of a dverse weather conditions, strike or other employ ment measures or technical pr oblems, the policy shall be extended for up to a maximum of 14 days w ithout any a dditional premium.

4.1 .2 du e to unfitness to travel supported by a medical certificate a nd treatment beyond the end of the in surance contract is consequently necessary; or

4.1 .3 du e to the medical n ecessity to stay with any other insured person, the duty to prov ide any benefit u n der this contract will continue to exist until fitness to travel is r estored, but for no longer than 30 days.

4.2 You r right of r escission:

You have the right to terminate the insurance contract within 14 days following its conclusion without having to g ive any r ea son. We shall refund your premium. If y ou r eport any insured ev ent during this t ime, it will not be possible to rescind.

4.3 Termination following an insured ev ent

Follow ing an insured ev ent for which we have prov ided benefit, the insurance contract may be terminated in writing by y ou by no later than 14 days a fter obtaining knowledge that we have prov ided our benefit, and by us by n o later than pr ov iding the agreed benefit. If y ou give n otice of termination, insurance cov er shall lapse 14 days after we have r eceived su ch notice. If w e g ive notice of termination, insurance cov er shall lapse 30 days a fter y ou have received such notice.

5. Wh at a re y our obligations in an insured event?

5.1 You , or other insured persons, are under a duty:

– to do ev erything possible to contribute to the mitigation of the loss and to investigate the circumstances of su ch

loss (du ty to mitigate loss);

– to fu lly comply with y our contractual or statutory duties relating to reporting, information or conduct (including

immediately reporting the insured event to the contact address specified in Clause 16).

5 .2 If th e loss occurs a s a result of a n illness or injury, you or the other insured persons must ensure that the treating doctors are r eleased from their duty of confidentiality and authorised to prov ide information to Chubb.

5 .3 In a n ev ent of death we must be informed in such good time as to enable u s to arrange a post-mortem at our ex pense before the funeral if it is possible that the cause of death may have been something other than the a ccident.

5 .4 You must r eport insured events occasioned by criminal offences (e.g. burglary, r obbery, malicious damage, bodily h a rm) to the r esponsible police station immediately and you must have the report certified.

5 .5 A dv ance payments made by us or Chubb A ssistance must be r epaid within 30 days after returning to the place of r esidence.

5 .6 You must inform us of the existence of other insurance policies or claims, e.g. with transport or travel companies, u n der which you can claim indemnity for the insured ev ent in qu estion; y ou must also inform us of claims made

a n d indemnity payments received under such insurance a s well a s any third parties' obligations to prov ide in demnity.

5 .7 If y ou or other insured persons are also a ble to claim benefits which have been prov ided by Chubb from a third pa r ty, these claims must be safeguarded and assigned to Chubb.

5 .8 Th e claim for insurance benefits from us must be made in written or electronic form.

6. Wh at a re the consequences of a breach of obligations in an insured event?

If a ny duties to r eport or duties as to conduct are culpably breached and if this affects the establishment or the sev erity o f the con sequences of the loss, we shall be entitled to reduce our benefits. There shall be no reduction if it can be proved that the con duct in breach of this contract did n ot influence the establishment and the sev erity of the consequences of the loss.

7. Wh at is required for claims against third parties (subsidiarity)?

If th ere are multiple insurance policies, our duty to prov ide benefit shall be secondary to that of other insurers. If the insured ev ent is reported to us first, we shall provide advance benefits. The right of recourse shall devolve upon u s to the extent that we h av e prov ided indemnity. This shall also a pply if there is a duty for any social insurance or obligatory insurance to prov ide ben efit (Swiss Federal Law on A ccident Insurance (UVG), Swiss Federal Law on Health Insurance (KVG)). If a ny other company a lso pr ovides their benefits on a subsidiary basis, then the r espe ctive companies shall be responsible for the costs in proportion to th eir insured sums. Claims under accident endowment insurance policies are excluded from this.

8. Wh at amount must you bear yourself? (Excess)

A n excess a pplies to individual benefits. This sum shall always be deducted from the amount of any benefits provided by Chubb in a n insured ev ent and you must bear this excess y ourself.

9. Wh en is there no insurance cov er?

9.1 We sh all not provide any insurance cov er and shall not be obliged to pay any damages or insurance benefits under th is contract if such insurance cov er, damages payment or benefit would expose us or our parent or holding com pany to a sanction, prohibition or restriction in accordance with UN resolutions or trade or financial sa n ctions, statutes or regulations by Switzerland, the EU or the USA.

9.2 In a ddition to the restrictions and exclusions specified in the Special Conditions of In surance, there is in principle n o in surance cov er for losses incurred as a result of carrying out the following activities on the trip:

– r iding;

– jet skiing;

– m otorcycling (motorcycles are deemed to be a ll motorbikes, scooters, quads or trikes with an engine capacity of

m or e than 50 cc);

– spor ts diving and diving beyond the maximum depth permitted for the diving certificate achieved.

9.3 in curred in connection with trips during which manual work is undertaken;

9.4 in curred in connection with trips whereby the activity is undertaken in or der to perform medical, cosmetic or oth er clinical treatments (e.g. dental treatments)

9.5 in curred in connection with cruises;

9.6 in curred on a trip where winter sports is the main r eason for y our trip;

9.7 th at had a lready occurred or should have been known at the time the insurance was concluded or the trip was booked;

9.8 ben efits for illnesses or accidents which had already occurred a t the start of the trip. There is an exception for any u n foreseen a cute worsening of h ealth due to a chronic condition;

9.9 a ny sy mptoms or illnesses existing at the start of the trip and the consequences and complications of such sy mptoms or illnesses;

9.10 th at were intentionally caused by you or other insured persons;

9.11 th at you or the other insured persons have caused as a r esult of or during the deliberate commission of a criminal offen ce or the deliberate a ttempt to commit such an offence;

9.12 th at have been caused either directly or indirectly by acts of war or civil war.

How ev er, insurance cov er exists for losses which you or any other insured person experience a s a result of a cts of war if y ou are not actively participating in the war or civil war (passive war risk).

A per son a lso actively participates if he delivers, remov es or in any other way handles equipment, dev ices, a pparatus, v ehicles, weapons or any other materials designed for warfare on the side of a war -making party.

Losses ca used by terrorist attacks are a lso insured if such attacks are in connection with a war or civil war which is ca rried out outside of the war-making parties' territories.

Th e insurance cov er excludes in any event losses caused: – by ABC weapons (atomic, biological or chemical weapons);

– in connection with a war or warlike conditions between China, Ger many, France, Great Br itain, Japan, Russia and

th e USA;

– stay s or trips in countries or regions for which the Swiss Federal Department for Foreign Affairs (EDA) had

a lready issued a travel warning or partial travel warning (regions) before the commencement of the trip;

– in connection with a war or civil war if Switzerland is involved as a war-making country or if the acts of war are

ta king place on Swiss territory.

9.13 in r elation to which the external loss a djuster such a s e.g. a doctor is a direct beneficiary or is related to you or the oth er insured person by blood or marriage;

9.14 w h ich are incurred under the direct influence of drugs, medication, n arcotics or medicinal products;

9.15 w h ich occur during active participation in:

– com petitions, races and rallies or training for such races with motor vehicles or boats;

9.16 com petitions and training as a professional sportsperson or in connection with an extreme sport (e.g. skydiving, h igh mountain tours);

9.17 da n gerous acts by which a person knowingly exposes himself to a particularly great danger;

9.18 a s th e pilot of an a ircraft (including sports aircraft pilot), as long a s a permit is required for this under Swiss law, or a s a ny other crew member of a n aircraft;

9.19 th at are caused by ionising radiation of any kind, particularly nuclear transmutation.

10. Definitions (where a pplicable a nd u sed)

10.1 Per sons close to the insured person are:

– r elatives (spouse, parents, children, parents-in-law, grandparents and siblings);

– pa r tners and their parents and children;

– ca regivers for m inor children who are not travelling or dependants who require care.

10.2 Close colleague / h oliday cov er

A close colleague / h oliday cov er is a person with whom y ou work and who is necessarily obliged to be present at work du r ing your holiday.

10.3 Cr uise

A cruise is a trip on a ship lasting longer than 3 days for which the transport and accommodation is primarily located on a n ocean or r iver.

10.4 A dv erse weather conditions

Wea ther conditions in which the police or other a ppropriate authorities a dvise that it is not safe to use the originally pla nned travel route using public communication channels (including TV and radio).

10.5 A broad

Ou tside of Switzerland.

10.6 Tr ip

A tr ip is a private stay abroad of more than on e day’s duration. The maximum duration of a trip within the sense of these Gen eral Conditions of In surance is limited to a total of 30 days. There is no cov er for carrying out a manual work of a ny kin d.

10.7 V a luables

V a luables means jewellery, furs, valuables containing precious metals or precious stones, clocks and watches, music play ers of any kind (MP3 player, iPod, smart phones or similar), binoculars, audio sy stems, photographic equipment and v ideo sy stems, printers, personal organisers or tablets and g ames consoles .

10.8 Ca sh equivalents

Ca sh equivalents means cash and Travellers Cheques exclusively

10.9 Docu ments

Docu ments are passports and identity cards as well as driving licences

10.10 Tr avel company

A travel company is the a irline company with which y ou have booked your flight for your trip.

10.11 Pu blic transport

Pu blic transport is a ny means of transportation which runs r egularly according to a t imetable and for the use of which a t icket must be bought. Public transport does not include taxis and rental cars.

A br eakdown is any sudden and unforeseen failure of the insured v ehicle as a r esult of a n electrical or mechanical defect w h ich makes it impossible for the trip to be continued or on the g rounds of which it would be unlawful to continue the tr ip. The following are a lso deemed to be a breakdown: tyre failure; lack of fu el; vehicle keys locked inside the vehicle; or fla t battery. Loss or damage to v ehicle keys or u sing the wrong type of fuel do n ot constitute a breakdown and are n ot cov ered.

10.13 A ccident

A ny sudden involuntarily harmful impact of a n unusual external factor on the human body is deemed to be an a ccident. A n a ccident is a lso deemed to occur if, due to excessive exertion on the limbs or the spine, a joint is sprained or muscles, ten dons, ligaments, or joint capsules are strained or torn, or in the ev ent of drowning or death by asphyxia under water as w ell a s damage to health typical to diving (decompression sickness, barotrauma) without being able to establish an a ccident event.

10.14 Motor v ehicle

A ny damage to an insured motor vehicle caused by a sudden and v iolent external ev ent making it impossible for the trip to be con tinued or causing it to be unlawful to c ontinue the trip is deemed to be an accident. This particularly includes ev ents caused by impact, collision, ov erturning, crashing or sinking.

10.15 Ser ious illness / ser ious accident consequences

Illn esses or a ccident consequences are deemed to be serious if th ey r esult in a temporary or permanent incapacity for w or k or if they result in a compelling inability to travel.

10.16 Win ter Sports

Big foot skiing, bobsleighing, cross-country skiing, g lacier skiing, heli -skiing, kite snowboarding, langlauf, luging, mono-skiing, skidooing, skiing, ski acrobatics, ski flying, ski jumping, ski racing, ski touring, sledging, snow blading, sn ow boarding, snowmobiling, speed skating, tobogganing.

10.17 Rou n d Trip (outward and r eturn flight):

Is a Tr ip that commences upon leaving your home including any stopov ers on y our outward Trip to y our destination and r eturn Trip home of u p to 24 h ours, and ends upon your return to your place of r esidence su bject to a maximum duration of 3 0 days.

10.18 On e way Trip (outward flight on ly):

Is a Tr ip that commences upon leaving your home and ends 3 hours after leaving passport control at y our destination, in cluding any stopov ers on y our Trip to y our destination of up to 24 hours.

11. Wh en are the benefits payable?

If th e legal basis of ou r duty to prov ide benefit and the amount of benefit is established, then payment of the benefit must be m a de within two weeks unless the Special Conditions state otherwise.

12. In wh ich currency a re benefits paid?

We a lways pay our benefits in Swiss Francs (CHF). For the conversion of for eign currencies the exchange rate for the day on w h ich the costs were paid by y ou or any other insured person shall be a pplied.

13. Lim itation

Th e claims arising from the insurance contract shall lapse two years after the occurrence of the ev ent establishing the duty to pr ov ide benefit.

14. Hierarchy of con ditions

Th e Special Conditions for the individual insurance components shall take precedence ov er the Consolidated Conditions for a ll in surance components.

15. Ju risdiction and a pplicable law

Cla ims against Chubb may be su bmitted to the court with jurisdiction for the company´s registered office or your place of r esidence in Switzerland or that of any other person entitled to make a claim. The Swiss In surance Contract Act (VVG) shall a lso a pply in addition to these Conditions.

Part 2. Special Conditions for the individual insurance components

A Assistance

I. What is insured?

Th e provision of assistance services which become n ecessary during a trip a broad with and without meeting costs is insured.

Precon ditions for providing benefits:

It is a pr econdition for the provision of a ssistance and the reimbursement of the a ssociated financial benefits (if insured) that y ou or an authorised person contacts Chubb Assistance following the occurrence of the insured ev ent and agrees to the further cou rse of action.

Ch ubb Assistance is responsible for deciding whether and in what manner to prov ide a ssistance services together with the pa r ties concerned (e.g. the treating doctor). You have a ccess to an emergency h otline 24 h ours a day, 7 days a week. Please refer to y our insurance policy for the relevant telephone number.

Th e information, or ganisation and agency services provided by the assister are insured. Costs incurred in connection with the a g ency / or ganisation services arranged by the service provider (e.g. for doctors, patient transport, a ccommodation costs etc .) sh a ll only be reimbursed if the appropriate insurance module has been concluded.

In th e event that third parties are commissioned r esulting in costs accruing which are not cov ered by this insurance policy, the a ssister has the right to claim a ppropriate financial gu arantees from the Policyholder or the insured person. The assister shall determine in what form and to what amount this shall take place.

Th is does n ot apply if the reimbursement of costs is explicitly specified below.

II. Insurance benefits

1. Medica l assistance and support

Plea se n ote that you are n ot obliged to make any payment for advice and support. However, if any costs are incurred as a result of A ssistance, you are obliged to make payment if the costs are not insured as part of a n insured ev ent under the following t ypes of cov er a t B - K below.

1 .1 Gu arantee of meeting the hospital or medical costs and paying invoices up to the amount specified in the policy.

1 .2 Meeting the costs up to the amount specified in the policy for the medically reasonable transport of the insured per son by means of a medically suitable means of transport (ambulance or aircraft). The following are insured:

– tr ansport to the nearest hospital appropriate for treatment or to a specialist h ospital;

– r eturn transport to insured person’s place of r esidence or to t he nearest a ppropriate h ospital to the insured

per son's place of r esidence a s soon as such return transport is medically adv isable and reasonable a s well as any

tr ansfers between h ospitals within the home country necessary for this;

– r eturn transport for the insured person to his place of residence if he has been the direct victim of a terrorist

a t tack, an a ct of sabotage, a n attack or a physical assault and a s a result of this is no longer emotionally in a

posit ion to continue the trip;

1 .3 r eferral of doctors, specialist doctors, laboratories, h ospitals;

1 .4 or g anising a return call from a doctor or admittance to hospital;

1 .5 or g anising childcare for minor children if their parents are hospitalised or are incapacitated as a r esult of insured ev ent.

2. Person al A ssistance

Costs sh all not be reimbursed for the following services. You simply benefit from Chubb A ssistance’s networking and service ca pabilities h ere. If the benefits are n ot insured under the following types of cov er at B - K below , they must be refunded to Ch ubb within 30 days after returning to y our place of r esidence.

2.1 Ca sh a dvance

Ma king contact with your bank and transferring the amount made available by such bank if there is no other facility for th e transfer of funds and advancing a maximum of CHF 250 if it is not possible to make contact with the bank within 24 h ou rs.

2.2 In forming relatives / colleagues and delivering important messages in the ev ent of medical or travel problems

2.3 Su pport in the ev ent of the loss of travel documents and t ickets (no r eimbursement of costs)

2.4 Em ergency translation if the local service prov ider does not understand En glish

2.5 Cr iminal prosecution prov isions

If y ou are arrested or threatened with arrest whilst travelling during the term of the contract because you have u n intentionally contravened a law abroad, Chubb Assistance shall procure a lawyer and, if necessary, an interpreter and sh a ll meet the a ssociated court, legal and interpreting fees up to the amount specified in the policy.

B Medical costs abroad

I. Area of validity

Th e insurance a pplies to a trip during the period of insurance and to the area of travel a s stated in your policy.

II. Insurance benefits

We pr ov ide our benefits as subsidiary insurance to the Swiss statutory social insurance schemes (KVG, UVG) and any su pplementary health insurance policies y ou may have if cover under such policies is insufficient.

Th e following benefits shall be provided in a ccordance with the table of benefits upon the occurrence of a medical emergency, i.e. bodily injury or a sudden and unforeseen illness su ffered by the insured person during the stay a broad which n ecessitates immediate inpatient or outpatient treatment by a recognised doctor which cannot be postponed until the insured person has r eturned to his home country if this i s performed by a doctor / dentist or a person with appropriate operating licence:

– r eimbursement of costs for inpatient stays in a h ospital;

– costs for therapeutic treatments including medication;

– costs for hospital stays: we provide insurance cov er according to the insured person’s existing insurance cover in

th eir country of r esidence / h ome country (general, semi-private or private ward). If y ou select a higher category

th an is privately insured when you are a broad, there shall be n o claim for reimbursement unless Chubb Assistance

g r ants its a pprov al;

– em ergency dental treatment and, in the event of damage to dental prostheses, necessary measures for repairing the

a bility to chew;

– m edically reasonable transport to the nearest h ospital appropriate for treatment or to a specialist hospital;

– r eturn transport to insured person’s place of r esidence or to the nearest a ppropriate h ospital to the insured person's

pla ce of r esidence a s soon as such return transport is medically advisable and reasonable and return tr ansport for

th e insured person to his place of r esidence if he has been the direct victim of a terrorist attack, an act of sa botage,

a n a ttack or a physical a ssault and a s a result of this is no longer emotionally in a position to continue the trip.

Ch ubb Assistance may arrange any of the a bov e types of transport if it deems this to be n ecessary and safe;

– a ny additional a ccommodation costs for y ou up to a maximum of CHF 60 per day for a maximum of 10 days or CHF

6 00 plus return flight if the original arrangement extends beyond the original date of the return flight a s a result of

illness or unfitness to travel. These costs must be approved by Chubb A ssistance and shall be deemed to be the same

ty pe and quality as the original arrangement;

– a ny additional a ccommodation costs for a person close to y ou u p to a maximum of CHF 60 per day for a maximum

of 1 0 days or CHF 600 plus r eturn flight if the original arrangement extends beyond the original date of the r eturn

flight a s a result of illness or unfitness to travel. These costs must be a pprov ed by Chubb Assistance and shall be

deemed to be the same ty pe and quality as the original arrangement;

– or g anising and meeting the basic costs of the repatriation of r emains to the place of r esidence in the ev ent of death;

– costs of a funeral in the area of travel abroad.

Th e excess is CHF 50.

III. Insured event

A m edical emergency, i.e. su dden bodily injury or a sudden a nd unforeseen illness during the stay a broad, occurs during the trip th at may result in death which necessitates immediate inpatient or outpatient treatment by a recognised doctor and which ca nnot be postponed until you have r eturned to y our home country.

Con firmation of fitness to travel by a qu alified doctor is required no earlier than 5 days before departure for trips to be u n dertaken by pregnant women from the 28th week of pregnancy .

IV. Uninsured events (in addition to Clause 9. "When is there no insurance cover?" of the Consolidated Conditions)

• Ben efits for illnesses or accidents which had already occurred at the start of the trip. There is an exception for any u n foreseen a cute worsening of h ealth due to a chronic condition

• A ny sy mptoms or illnesses existing a t the start of the trip and the consequences and complications of such sy mptoms or illnesses

• Tr eatment a broad which was the sole reason or on e of the reasons for undertaking the trip

• Gen eral check-up examinations and r outine checks

• Ex a minations and medical treatment due to pregnancy as well as childbirth and termination of pregnancy unless these become n ecessary a s a result of an unforeseen a cute worsening of the health of the mother or of the unborn child

• Psy choanalytical and psy chotherapeutic treatments

• A ids (e.g. prostheses, g lasses, insoles, compression stockings etc. as well as h ealth r equisites such a s h eat lamps and th ermometers)

• Tr eatment by practitioners of a lternative medicine

• Wellness treatments e.g. massage

• Ex pen ses incurred by methods of treatment and / or medication which are n ot generally scientifically recognised either in the home country or at the place where the insured person is staying

• Tr eatments or other measures which exceed what is medically n ecessary. In such a case we are entitled to r educe the ben efit by a reasonable amount

• Retention costs and statutory social security franchises

V. Duties in the event of loss (in addition to Clause 5. "What are your obligations in an insured event?" of the Consolidated Conditions)

In or der to be able to claim benefits from Chubb, you or other insured persons a s persons entitled to claim must immediately u pon the occurrence of the insured ev ent:

– in form Chubb Assistance immediately of a ll details of a ny circumstance which could result in a duty to prov ide

ben efit;

– in form Chubb Assistance of any hospital treatment within 10 days of the start of su ch treatment;

– be ex amined by a doctor instructed by us on r equest.

C Hospital cash

I. Area of validity

Th e insurance a pplies to a trip during the period of insurance and in the area of travel a s stated in your policy.

II. Insurance benefits

For ea ch 24 h ours or part thereof that y ou are in hospital as a r esult of an insured accident, we shall pay the agreed insured sum

of CHF 15 per day up to a maximum of CHF 675.

III. Insured events You r eceive medically necessary inpatient treatment as a result of the a ccident or undergo ambulatory surgery under anaesthesia

in a h ospital as a result of the accident. Local anaesthetic shall n ot be regarded as anaesthesia within the meaning of these

Com prehensive Conditions of In surance.

IV. Uninsured events (in addition to Clause 9. "When is there no insurance cover?" of the Consolidated Conditions)

Tr eatments and stays in sanatoriums and convalescent h omes are deemed n ot to be medically n ecessary treatment.

V. Duties in the event of loss (in addition to Clause 5. "What are your obligations in an insured event?" of the Consolidated Conditions)

In or der to be able to claim benefits from Chubb, you or other insured persons a s persons entitled to claim must immediately u pon the occurrence of the insured ev ent:

– in form Chubb Assistance immediately of a ll details of a ny circumstance which could result in a duty to prov ide

ben efit;

– in form Chubb Assistance of any hospital treatment within 10 days of the start of su ch treatment;

– be ex amined by a doctor instructed by us on r equest.

D Accident endowment

I. Area of validity

Th e insurance a pplies to a trip during the period of insurance and in the area of travel a s stated in your policy.

II. Insurance benefits

We pr ov ide the agreed insurance cov er in the ev ent of accidents suffered by the insured person during the insured trip that lead to a ccident-related death or an a ccident-related permanent degree of disablement of more than 20% within 12 months of the a ccident. We pay the amount specified in the Policy in these cases. We on ly pay these insured sums once. No further claims for ben efits may be made against u s under the a ccident insurance a broad after payment of this sum.If the insured person has n ot y et attained the age of 16 years on the date of the accident, 7 5% of the insured sum specified in the Policy shall be paid.

Th e degree of disablement is calculated in accordance with clause D II. 1 . and clause D III. .

We pay the disablement benefit as a capital sum.

Th e amount of benefit is calculated based on the insured sum and the degree of disablement caused by the accident. However, th ere shall be no payment of more than 100% (even if there are sev eral damaged body parts / sen sory organs).

In th e event of the loss of or total functional incapacity of the following body parts and sensory or gans, the following degrees of disa blement shall a pply exclusively:

– A rm 70 %; Arm up to abov e the elbow joint 65 %; Arm below the elbow joint 60 %

– Ha nd 55 %; Thumbs 20 %; In dex finger 10 %; Other finger 5 %

– Leg a bove the middle of the thigh 70 % ; Leg up to the middle of the thigh 60 % ; Leg below the knee 50 %; Leg up to

th e middle of the lower leg 45 %

– Foot 4 0 %; Big toe 5 %; Other toe 2 %

– Ey e 50 %

– Hea ring in on e ear 30 %

– Sen se of smell 10 %

– Sen se of taste 5 %

For th e partial loss or partial impairment of function the corresponding portion of the respective percentage applies. For other body parts and sensory organs, the degree of disablement is measured a ccording to the degree of impairment of the normal ph y sical or mental capacity as a whole. Only medical a spects are considered in doing this.

2. A ccidental death

We pay the death benefit a s stated in the table of benefits as a capital sum.

III. Insured events

Th e physical or mental capacity of the insured person is permanently impaired as the res ult of an a ccident (disablement). An im pairment is permanent if it is likely to exist for more than three years and no change to the person's condition is expecte d.

1. T h e disablement:

1 .1 occurred within 12 months of the accident; and

1 .2 w a s diagnosed by a doctor in written or electronic form and was claimed by you by submitting a medical cer tificate to us within 15 months of the accident.

1 .3 Th ere shall be no claim for disablement benefit if death occurs as a r esult of the a ccident within on e y ear of the a ccident (accidental death).

2. Wh at a re the effects of illnesses or disabilities?

A s a n a ccident insurer, we provide benefits for consequences of a ccidents. If illnesses or disabilities have contributed to t he da mage to h ealth or consequences of su ch damage to h ealth caused by an accident ev ent, then reductions shall be made a s follow s:

– in the event of disablement, the percentage of the degree of disablement shall be reduced;

– in the event of death and, unless agreed to the contrary, in all other cases, the benefit shall b e r educed;

– in pr oportion to the illness or the disablement.

How ev er, if the proportion of contribution amounts to less than 40%, the r eduction shall n ot be applied.

IV. Uninsured events (in addition to Clause 9. "When is there no insurance cover?" of the Consolidated Conditions)

1. No insurance cov er exists for the following accidents:

A ccidents suffered by the insured person as a result of mental disorders or impaired consciousness a s well a s accidents suffered a s a r esult of epileptic fits or other seizures which affect the insured person’s entire body .

2. T h e following injuries a re also excluded:

2.1 da mage to intervertebral discs a s well a s bleeding from internal organs and brain haemorrhages, unless these are ca used by an accident;

2.2 da mage to h ealth caused by radiation unless exposure to such is a s a result of a n accident;

2.3 da mage to h ealth caused by therapeutic treatments or surgery to the body of the insured person unless such tr eatment or surgery is arranged a s a result of an insured accident;

2.4 for v iolent a cts by third parties;

2.5 in fections, unless these are caused by therapeutic treatments or surgery necessitated by an accident;

2.6 poison ing as a result of orally taking solid or liquid substances.

2.7 How ev er, poisoning caused by the on e-off ingestion of a poisonous foodstuff is included, provided that any da mage to h ealth resulting therefrom occurs within 48 hours and is medically diagnosed within this t ime;

2.8 a bn ormal disorders a s a result of psy chological r eactions which cannot be directly and causally a ttributed to a ph y sical injury / a physical loss, even if these are caused by an accident.

3.2 for a ccidents caused by impaired consciousness due to i ntoxication; however, if the accident occurs whilst driving a m otor vehicle, cov er shall only exist if the blood a lcohol level a t the t ime of the accident was below the drink -dr iv e level defined according to the local law;

3.3 for a ccidents which are triggered by a h eart attack and stroke.

V. Duties in the event of loss (in addition to Clause 5. "What are your obligations in an insured event?" of the Consolidated Conditions)

Follow ing an a ccident which is expected to r esult in an obligation to prov ide benefit, you or the insured person must immediately:

– con sult a doctor;

– follow the doctor's or ders; and

– n otify us.

If doctors are instructed by us, the insured person must also be examined by such doctors. We shall bear the necessary costs.

If th e accident results in death, we must be informed of this within 48 hours, ev en if we have a lready been informed of the a ccident. If n ecessary, we shall be granted the right to have a post-mortem examination / exhumation carried out by a doctor in structed by us.

E Cancellation costs insurance (“Cancellation”)

I. Area of validity

Th e cancellation insurance commences a t the t ime of the definitive booking and ends upon the commencement of the insured tr ip.

II. Insurance benefits

1. Ca ncellation costs

If y ou or other insured persons cancel the trip as a result of an insured ev ent, Chubb shall pay the contractually owed ca ncellation costs u p to the insured sum specified in the ov erview of insurance cov er. This includes cancellation costs for: – ov ernight arrangements;

– flights or other means of transport;

– ex cursions.

2. Excess

Th e excess is 10% of the travel price subject to a minimum of CHF 50.

III. Insured events

• Ser ious or sudden illness, quarantine as a result of a serious infection, serious a ccident, pregnancy complications or as a r esult of death, as long as the ev ent concerned occurs a fter the t ime of the booking:

– su ffered by you;

– su ffered by an a ccompanying person who has booked the same trip and has cancelled it;

– su ffered by a person close to y ou.

– If sev eral people have booked the same trip, this can be cancelled by a maximum of 10 people.

• Cov er shall on ly exist in the ev ent of psy chological conditions if: – a psy chiatrist certifies the inability to travel and incapacity for work; and

– th e incapacity for work is proven by producing a certificate of a bsence from the employer.

• Cov er shall on ly exist for chronic illnesses if the trip has to be cancelled as a result of a medically certified unexpected a cute worsening of the condition. It is a prerequisite that at th e time the trip was booked the state of h ealth was stable a n d the person was fit to travel.

• In th e event of pr egnancy, insurance cover shall only exist if incurred in an emergency as a r esult of complications w h ich are diagnosed by a Doctor who specialises in obstetrics, e.g. by a gynaecoloigst.

• If y ou miss the commencement of y our trip due to a burglary or a ttempted burglary at your place of r esidence or that of a ny other insured person and the police require your presence.

• Du e to damage caused by fire or flood at y our place of r esidence or that of a jointly insured person if such damage occurs within 7 days of the commencement of the trip.

• If y ou are unexpectedly called as a witness in court proceedings.

• A s a r esult of unexpected unemployment a fter concluding the insurance policy.

IV. Uninsured events (in addition to Clause 9. "When is there no insurance cover?" of the Consolidated Conditions)

1. Poor recov ery / pre-existing conditions or chronic illnesses

If a n illness or the consequences of a n accident, of a n operation or of a medical procedure already existed at the time of booking th e trip and n o recovery has been made by the date of travel. If n o r ecov ery has been made by the date of travel from the con sequences of a n operation / medical procedure which was planned at the t ime of booking the trip but which took place th ereafter.

2. Ca ncellation by the travel com pany or the party under a duty to provide the service (service provider)

If th e travel company or the party under a duty to provide the service (service prov ider) cannot or can on ly partially prov ide the con tractual services, cancels the trip or will have to cancel the trip on the basis of the specific circumstances and is under a sta tutory duty to prov ide a refund for the services which have not been prov ided. The specific circumstances according to which th e trip will have to be cancelled include recommendations made by the Swiss Federal Department of Foreign A ffairs n ot to tr avel to the area concerned.

3. Ot h er

If th e booked trip cannot be undertaken as planned a s a result of:

3.1 You being called a s a witness having been foreseeable in the context of y our regular professional activities (e.g. du e to working a s a loss adjuster);

3.2 You being at fault for losing your position or you have resigned your position;

3.3 You having been or being self-employed or with a temporary contract.

4. Expenses & payment in kind

4.1 Ex pen ses for administration fees and for insurance premiums shall not be r efunded.

4.2 Serv ices remunerated by way of payment in kind e.g. bonus points, air miles, time shares or similar bonus sch emes shall n ot be refunded.

F Curtailment

I. Area of validity

In su rance cover commences upon commencement of the insured trip for the period of insurance and in the area of travel a s sta ted in your policy.

II. Insurance benefits

1 .1 We sh all refund the costs for booked and contractually owed travel or accommodation services which were not

u t ilised which y ou can prov e you incurred.

1 .2 Th e compensation shall be calculated from the total price of the trip. The proportion of u nused days to the total da y s of the trip shall be calculated.

1 .3 We sh all refund additional costs which you can prove you incurred for changing the booking or alternative tr ansport in a means of transportation which is similar to that of the originally planned return trip on the most dir ect alternative route including necessary a ccommodation costs.

2. Lim it

Th e insurance benefit is limited to the amount specified in the policy.

3. Excess

Th e excess is CHF 50.

III. Insured events

Cu rtailment r easons: You or the other insured persons must curtail or a dapt the trip for one of the reasons specified in E III.

In su rance cover commences upon concluding the policy and applies for each flight specified on the booking confirmation as part of th e insured trip.

II. Insurance benefits

1. Missed departure

Th e insurance prov ides for payment of u p to the maximum insured sum in the event of delayed arrival at the place of departure for a ny necessary hotel or transport costs in order to reach the area of travel or place of r esidence.

2. Excess

Th e excess is CHF 50.

III. Insured event

1. Pu blic transport delays

Th e insured ev ent occurs due to a public transport delay a s a result of: – a br eakdown or r oad traffic a ccident involving the taxi or car supposed to transport you to the place of departure;

– th e means of transport that you intended to use to travel to the airport being delayed.

2. Specia l conditions for insurance cover

You must: – pr ov ide documentary ev idence of your a ccident / breakdown;

– pr ov ide a written statement from the public transport company regarding the type, r eas on and length of the delay.

– You must leave y our place of r esidence at a t ime that would normally enable you to arrive for your departure in

g ood t ime using public transport.

• Delay s that were caused by you or insured persons travelling with you.

• Losses in curred because you have declined an offer of an a lternative flight of a similar quality that would have arrived a t a n earlier time.

• If th e booked trip cannot be undertaken as planned a s a result of official r egulations.

• Str ikes that had already been announced or carried out when concluding the insurance policy.

• Serv ices remunerated by way of payment in kind e.g. bonus points, air miles, time shares or similar bonus schemes.

• Hotel or transport costs that were booked a t a higher class than the or iginal e.g. business class instead of economy.

• Losses in curred a s a result of v olcanic ash.

1. Flight delay

Th e insurance cov ers any n ecessary personal costs incurred in the ev ent of flight delay. From the twelfth (12th) hour of the flight being delayed, costs incurred for personal items shall be met up to an amount of CHF 75. Costs for personal food up to an a m ount of CHF 75 shall be met for each twelve (12) hours of delay thereafter. Costs incurred for personal items shall be met up to a m aximum amount of CHF 300.

In th e case of a delay of more than 24 h ours, the benefits of clause H II. 2 . apply.

2. T rip abandonment due to a delay

If y ou abandon your trip a fter a delay of at least 24 hours of the scheduled outbound international departure, we will refund y our u n used travel and accommodation costs up to the amount stated in the Ov erview of insurance cov er that You have paid or are con tracted to pay and which cannot be recov ered from a ny other source.

3. Mu t ual exclusiveness

A claim can only be made under item H.II.1 or under item H.II.2 abov e, n ot both.

III. Insured event

1. Flight delay

Th e flight is delayed by more than 12 h ours (calculated from the or iginal official departure t ime). The flight is delayed by more th an 12 hours (calculated from the original official departure t ime) on the outbound Trip or the final part of the r eturn Tri p because the scheduled departure of Pu blic Transport is affected by a strike; industrial a ction; A dverse Weather; mechanical br eakdown or grounding of a n aircraft due to mechanical or structural defect.

2. T rip abandonment

Th e outbound flight is delayed for at least 24 h ours (calculated from the or iginal official departure t ime). because the scheduled depa rture of Public Transport is affected by a strike; industrial a ction; Adverse Weather; mechanical breakdown or grounding of a n a ircraft due to mechanical or structural defect

• Delay s that were caused by you or insured persons travelling with you and l osses incurred because y ou have declined a n offer of a n alternative flight of a similar qu ality that would have arrived at an earlier t ime.

• A ny Claim Due To: – Pu blic Transport being taken out of service on the instructions of a Civil Aviation Authority, Po rt Authority or

sim ilar authority;

– a str ike if it had started or been announced before the insurance was concluded;

– a ny journey by Public Transport commencing and ending in the country of departure.

• A ny charge or expense paid for with, or settled using, any kind of promotional voucher or points, timeshare, holiday pr operty bond or holiday points scheme, or any Claim for management fees, maintenance costs or exchange fees in r elation to t imeshares or similar arrangements.

• A ny claim due to the insured person n ot allowing sufficient t ime for the journey.

• A ny expenses that: – th e insured persons can recov er from any tour operator, a irline, h otel or other service provider;

– th e insued person would normally have to pay during Your Trip.

• A ny claim for travel abandonment caused by volcanic ash.

• Th e excess if the trip is abandoned.

• Per sonal v aluables are items taken or bought by you during your trip for personal use that you usually wear on your per son or carry with y ou.

• You or other insured persons shall be paid, a fter deduction of an amount for prior wear and tear, the replacement v alue u p to the sum specified per trip in the table of benefits.

• Plea se n ote the maximum limit per item. Items that always consist of sev eral parts shall be deemed to be on e item.

• Plea se a lso refer to the table of benefits for the insured sum for valuables and cash equivalents.

• We r eimburse the replacement costs which you can prove you incurred for documents.

• Plea se r efer to the table of benefits for any applicable excess.

• If y ou or other insured persons recov er stolen or r obbed property after the benefit has been paid, you may choose w h ether you wish to pay back the benefit or surrender the property to us. We may r equest you to make this decision w ithin two weeks.

• Th e right to choose passes to us after this t ime.

III. Insured events

• You are insured if, during the course of the insure d trip, y our personal baggage, v aluables or sports equipment: – becomes lost, i.e. cannot be found or is stolen / r obbed;

– is da maged; or

– is destroy ed.

• Ca sh and valuables are on ly insured if they: – a r e worn or u sed in accordance with their intended purpose ; or

– a r e located in a locked r oom which is not publicly accessible in a safe which offers increased security even against

th e removal of the container itself; or

– a r e given ov er to a lodging company or a guarded cloakroom for sa fekeeping or are otherwise supervised.

IV. Uninsured events (in addition to Clause 9. "When is there no insurance cover?" of the Consolidated Conditions)

• Losses a s a r esult of you or other insured persons not taking the usual precautions to ensure the security of y our per sonal baggage and property/ business equipment e.g. whilst this is a t a publicly a ccessible place and n ot in y our dir ect care.

• Losses ca used by a bandonment, leaving property hanging, leaving property behind or dropping.

• Da m age to or loss of: – g la sses, contact lenses, hearing aids, all kinds of pr osthesis;

– da mage to securities, bonds, debentures, stamps;

– documents of any kind;

– da mage to a nimals;

– m usical instruments;

– g la ss, porcelain, antiques;

– items a t trade fairs and exhibitions;

– pictures;

– spor ts equipment while in u se, bicycles;

– items/tools used for carrying out business a ctivities;

– telev isions;

– v ehicles or accessories;

– boa ts and / or auxiliary equipment;

– to items loaned or entrusted to the insured person or hired by him;

– for w hich we have n ot been provided with the police report or the public transport company’s report;

– per sonal items of baggage during transportation that are n ot reported to the public transport company

immediately;

– a s a r esult of civil disturbances, rebellion, revolution, terrorism, military or u surped power;

– a ll kinds of w eapons.

• Losses a s a r esult of seizure or confiscation by customs authorities or any other public authority, damage or destruction.

• Losses a s a r esult of electrical or mechanical failure, general wear and tear, moth or vermin damage, denting.

• Losses a s a r esult of scratching or any dy eing or cleaning process.

• r eport losses which occur in the custody of a third party (e.g. commercial carriers, h otels etc.) to such third party w ithout delay or assert claims for compensation in g ood t ime;

• r eport losses caused by criminal offences (e.g. burglary, r obbery, vandalism) to the responsible police station without delay submitting a list of all lost property and obtaining written confirmation of this from the police;

• u pon request, send u s a damaged item at y our own expense by registered post with return r eceipt;

• For r ecov ered insured property: inform u s about the investigation a s to the whereabouts or the recov ery of the property w ithout delay;

• r efund any paid indemnity to us within two weeks or surrender the r ecov ered item and a ssign the property r ights to us;

• sen d u s a ll n ecessary documents at your own expense, particularly: – police certificates;

– con firmation of loss from the commercial carrier or lodging company;

– or ig inal recov ery, replacement and repair bills.

J Baggage delay

I. Area of validity

Th e insurance is v alid for the outbound flight to the area of travel specified on the booking confirmation.

II. Insurance benefits

In th e event of baggage delay of more than 12 hours, the insurance cov ers the costs incurred for clothes and toiletries that you h av e purchased after arriving in the specified area of travel. Substantiated costs of u p to CHF 200 shall be r eimbursed for each in sured person affected by the delay.

III. Insured events

You r checked-in baggage on the outbound flight is delayed at the final destination by more than 12 h ours. There is n o insurance cov er for baggage delay when returning to the place of r esidence.

IV. Uninsured events (in addition to Clause 9. "When is there no insurance cover?" of the Consolidated Conditions)

• Delay ed baggage following the return flight to your place of residence.

• Delay , detention, seizure or confiscation by customs or other officials.

V. Duties in the event of loss (in addition to Clause 5. "What are your obligations in an insured event?" of the Consolidated Conditions)

K Personal liability

I. Area of validity

Th e insurance a pplies to a trip during the period of insurance and in the area of travel a s stated in your policy.

II. Insurance benefits

1. Insu rance cover

Th e insurance cov er includes:

1 .1 in v estigating liability;

1 .2 defen ding unfounded claims for damages;

1 .3 in demnifying the Policyholder against justified liability for damages.

Lia bility for damages is justified if you or the other insured person is obliged to prov ide compensation on the basis of stat ute, a cou rt judgment, admission or settlement and we are bound by this. We shall on ly be bound by a dmissions made and set tlements r ea ched by you without our consent if there would have been a claim ev en without such admission or settlement.

If y ou are found to be liable for damages and the decision is binding on us, we must indemnify you against the third party cl aim w ithin a period of two weeks;

1 .4 defen ce counsel’s costs in a ccordance with the fee scale or greater if expressly agreed with us for the appointment of defen ce counsel a s desired or approv ed by us for you or the other insured persons in a criminal prosecution due to a n insured ev ent which may result in a liability claim for which insurance cov er exists;

1 .5 th e provision of a security or bond for you if you have a statutory obligation to prov ide security for an annuity ow ing as the result of a n insured ev ent, or if the enforcement of a court ruling against the insured person can be pr ev ented by prov iding a security or a bond;

1 .6 th e conduct of litigation in your name should an insured event r esult in litigation regarding the claim between you or oth er insured persons and the claimant or the latter’s successor in title.

1 .7 Th e costs of the litigation shall be met by u s.

2. A m ount of benefits

Ma x imum limit per loss event:

2.1 Ou r prov ision of indemnity is limited to the agreed insured sums for each insured ev ent. This a lso applies if th e in surance cover extends to sev eral parties liable to pay compensation. Several losses arising at the same t ime and fr om the same cause are treated a s on e loss ev ent. The total amount of benefit for all insured ev ents in one in surance year is limited to twice the agreed insured sum.

2.2 Th e expenditure for costs in accordance with Clause 1.5 shall n ot be deducted from the insured sum as benefits u n less the litigation takes place in the United States of America (USA) or Canada. If the justified liability claims a r ising from an insured event exceed the insured sum, we shall bear the court costs in the ratio of the insured sum to th e total amount of su ch claims. In such cases, we are entitled to discharge ourselves from prov iding further ben efits by paying the insured sum and a portion of the hitherto incurred costs corresponding to the insured a m ount.

2.3 If y ou as an insured person are obliged to pay an annuity to the claimant and if the cash value of the annuity ex ceeds the insured sum or the r emaining amount of the insured sum a fter the deduction of a ny other benefits a r ising from the same insured event, then the annuity to be paid shall only be refunded in the ratio of the insured su m or the r emaining amount thereof to the cash value of the annuity. When calculating the proportional v alue, th e cash value of the annuity and the amount of cov er shall be determined in accordance with the declaration in th e form of a business plan made to the r esponsible regulatory authority relating to this matter.

3. Ma ximum benefit for damage t o rented property

For in surance benefits resulting from damage to r ented property in accordance with Clause 3.7, the payment of compensation sh a ll be limited to the sum specified in the insurance contract per insured ev ent and per insurance year. The total amount of ben efit for all insured ev ents in on e insurance year is limited to twice the agreed insured sum.

4. Lim it to a dditional cost s attributable t o you

If th e settlement of a liability claim by acknowledgement, sa tisfaction or settlement requested by us fails due to your condu ct, th en we shall n ot be obliged to pay any additional expenses for compensation, interest and costs a ccruing from the t ime of the in sured person’s refusal.

5. Ot h er liability insurance policies

In a ccordance with Part I Clause 7, any other existing insurance cover shall take precedence ov er this Travel Persona l Liability In su rance.

6. Excess

Th e excess is CHF 50.

III. Insured events

In su rance cover exists for circumstances in which a claim for compensation is made against you or other insured persons by a th ird party under private law statutory liability prov isions because of a loss ev ent occurring during the validity of the insurance con tract which r esults in:

– th e death, injury or damage to health of people (personal injury); or

– th e damage or destruction of g oods (property damage).

1. Insu red risks

Within the scope of the following provisions, the insurance cov er extends to the statutory liability of the insured person a s a pr iv ate individual on insured trips abroad. In sured risks of ev eryday life are a ctivities, particularly

1 .1 a s th e head of a family or household (e.g. arising from the obligation to supervise minors);

1 .1 a s a cy clist;

1 .2 r elating to the participation in sport with the exception of the exclusions a t Clause 4.2;

1 .3 r elating to the legitimate private possession and u se of cutting and thrusting wea pons, firearms, munitions and pr ojectiles, but not for the purposes of hunting or criminal offences;

1 .4 a s a r ider when using h orses belonging to third parties for private purposes. Liability claims by the keeper or ow n er of the animals against the insured person are not insured;

1 .5 a s th e keeper or carer of tame domestic pets, tame small animals and bees, but not dogs, cattle, horses, other r iding and draught animals, wild animals or animals kept for commercial or agricultural purposes;

1 .6 a s th e tenant (but not the long-term tenant, leaseholder, etc.) of a partments, hotel or boarding house rooms and r esidential houses rented for the purposes of business travel.

2. Uninsured risks or risks with restricted insurance

2.1 Pr ofessional and other activities

Th e risks of a business, profession, service or office (including h onorary office), responsible work in any kind of a ssociation or an unusual or dangerous occupation are excluded.

2.2 Motor v ehicles, a ircraft and watercraft

Th e liability of the owner, possessor, keeper or operator of a motor vehicle, a ircraft or watercraft for losses caused by the u se of su ch vehicle is not insured.

How ev er, insurance cov er exists for liability for losses caused by the use of:

2.2.1 m odel aircraft, unmanned balloons and kites:

– w h ich are n ot powered by engines or propellants;

– th e total flying weight of which does n ot exceed 5 kg; and

– for w hich insurance is n ot compulsory;

Th is extension does not a pply to ev ery kind of dr one;

2.2.2 w a ter sports v ehicles, with the exception of own sailing boats and own or third party water sports v ehicles w ith engines – in cluding auxiliary or outboard motors– or propellants.

IV. Uninsured events (in addition to Clause 9. "When is there no insurance cover?" of the Consolidated Conditions)

In a ddition to the exclusions set out at Part I Clause 9, no insurance cover exists for liability claims:

• if th ey exceed the scope of your statutory liability due to the contract or express commitments;

• a r ising from losses as a result of: – h u nting;

– pa r ticipation in horse, bicycle or motor vehicle racing, boxing or wrestling or the preparation for such ev ents

(training);

• a r ising from loss ev ents suffered by persons who are close to you and who live together with you as a household;

• between sev eral persons insured under the same insurance contract;

• by legal representatives of parties without legal capacity or of parties with restricted legal capacity;

• du e to losses to third party property and a ll pecuniary losses resulting from such property losses if you or the other in sured persons have r ented, leased, borrowed such property or have acquired it by infringement of property r ights or if it is the subject of a separate contract of safe custody;

• da mage to r ented rooms / h ouses and their fixtures a nd fittings is included in a ccordance with Clause 3.7 (damage to r en ted property). The following remain excluded:

– lia bility claims for wear and tear and excessive use;

– da mage to h eating, boiler and hot water sy stems;

– to electrical and gas appliances;

– lia bility claims which are cov ered by the waiver of regress under the fire insurers’ agreement for comprehensive loss

to ow n or other property;

– w h ich are attributable to a sbestos or substances or products containing asbestos;

– w h ich are directly or indirectly connected with energy-rich ionising radiation (e.g. rays of radioactive material or X-

r ay s) and with laser and maser radiation;

– ca used by environmental influences on soil, a ir or water (including damage to bodies of water) and all further losses

a r ising from such;

• a r ising from material damage caused by: – th e gradual effect of temperature, gases, vapours or moisture, precipitation (smoke, soot, dust etc.);

– sew age, sponge formation, subsidence of land (including a structure erected upon it or a part of su ch), caused by

la n dslides, tremors r esulting from pile driving, caused by flooding of standing or flowing bodies of water;

• da mage to fields caused by g razing cattle or game;

• r esulting from the exchange, the transmission or the prov ision of electronic data a s long as this relates to: – th e deletion, suppression, destruction or modification of data;

– n on -recording or failed saving of data;

– th e disturbance of a ccess to electronic data exchange;

– th e transmission of confidential data or information;

– r esulting from losses arising from the infringement of personality r ights or name rights;

– r esulting from losses arising from hostility, bullying, harassment, unequal treatment or other discrimination;

– r esulting from bodily harm arising from the transmission of an illness suffered by the insured person.

– Th e same applies to property damage and all pecuniary losses resulting from such caused by the illness of a nimals

ow n ed by the insured person which are either kept or sold by him.

– In both cases, insurance cover exists if the insured person prov es that he acted neither intentionally nor grossly

n eg ligently.

V. Duties in the event of loss (in addition to Clause 5. "What are your obligations in an insured event?" of the Consolidated Conditions)

In a ddition to the obligations in Part l Clause 5 , you or other insured persons must observe the obligations specified below upon th e occurrence of a n insured ev ent.

1. Not ification of loss

1 .1 We m ust be informed of ev ery insured event without delay, even if n o claim for compensation has yet been made.

1 .2 You must a lso inform us without delay if a liability claim is brought against you or if a public prosecution, pr oceedings by authorities or court proceedings are commenced, a default summons is issued or the dispute is a n nounced by a court.

2. Defa ult summons / orders

You must enter an objection or any otherwise necessary legal challenge to a default summons or an order by a dministrative a u thorities to pay compensation in g ood t ime. Instructions from us are not necessary.

3. Con du ct of l itigation

If a liability claim against you is brought before a court, then he must a llow the litigation to be conducted by us. We shall a ppoint a la wyer on your behalf. You must grant the lawyer full authority and must prov ide all required information and requested documents.

4. A u thorisation

4.1 We a re deemed to be authorised to make any declarations on your behalf which a ppear to us to be appropriate for th e settlement or defence of the claim.

4.2 If y ou are granted the right to r equest the cancellation or reduction of a ny payable annuity due to a change in cir cumstances, then you are obliged to a llow us to exercise this right on y our behalf.
