Many of you will have made aWill leaving your estate to yourspouse, however, for some thisis not necessarily the best way tosettle your affairs.

Each person has a “Nil Rate Band” this means thatupon death no Inheritance Tax is payable on assets upto £300,000 (for year 2007/2008) over that figurehowever, tax is payable at 40%.

Where for example a husband and wife make mirrorWills each leaving their estate to the other, only onepersons Nil Rate Band will be used. There will be noliability to Inheritance Tax upon the first death (becauseof the "spouse exemption") but there will be a liabilityto tax upon the survivor's eventual death. Tax iscalculated at a flat rate of 40% on the value of thesurvivor's estate insofar as that value exceeds the tax-free Nil Rate Band.

In short, although the first person to die does notattract Inheritance Tax on their estate, when thesecond person dies tax is payable on the whole lot.

So - if a couple have assets worth £570,000 whenthe first person dies it all passes to the survivor andthere is no Inheritance Tax. However, when thesecond person dies, at current rates, there is taxpayable on the estate over £300,000. therefore 40%on £270,000 is £108,000.

There is a way, however, that tax can be saved. Aseach spouse (husband/wife or civil partner) has a"Nil Rate Band" then it is possible for each to leavea sum up to that value to their children upon the firstdeath without incurring a tax liability. The problemwith this though is that for most people the bulk oftheir assets are formed by their property and toleave a lump sum can cause problems and mayrisk leaving the surviving spouse short of funds forthe remainder of his/her lifetime.

The way around this is for both spouses to makejoint "two year Nil Rate Band discretionary Wills",which enables a decision to be made upon theoccasion of the first death, or within two years as tohow much the surviving spouse requires to live on,and therefore how much he/she feels comfortablewith passing on to the next generation or others.

This can enable both parties' Nil Rate Bands to beutilised, so it is advantageous for Inheritance Taxplanning. Another benefit is having two years after thefirst death to consider all circumstances. For example,if the surviving spouse is no longer able to continueliving in the matrimonial home because of health orother problems, it may be best if he/she does notreceive the whole of their late spouse's estate,because that estate could be exhausted over theensuing years in meeting residential home fees, whichmay otherwise be payable by the local authority or theState.

If as most couples do, you own your house as JointTenants then both of you own the whole house andwhen one partner dies the other becomes the soleowner. As Tenants in Commoneach would own a specificshare – usually half each.If you make adiscretionary Will andwish to use your sharein the family home toreduce or

avoid a liability to Inheritance Tax it is important thatlegal title is held as ‘Tenants in Common’. Otherwisethat share will pass not under your Will but insteadimmediately upon death to the surviving co-owner, andthere will be a much more limited tax saving potential.

This may sound complicated and something that onlyolder people need to consider but sadly tragedy canstrike at anytime of life. It is sensible to look aheadand plan ahead. The alternative is that the Chancellorgets money that could otherwise go to your children.
