Councilor David McKendrick explained his position regarding his position regarding the removal of coal from Badallan Farm via the railhead at Morningside and why that was more preferable option,

And asked that the Community Council support his position on this matter.

Tom Young stated that it was obvious that it would be the best option for the majority of the people living in Ward 16 for the coal from Badallan Farm opencast site go via the railhead at Morningside,

Brendan McGhee seconded the proposal, the committee voted in favour of the proposal.

Chairman John Harper asked to be abstained from the voting process.

Councillor David McKendrick agreed to do so.

David Johnstone asked if the coal from Badallan would be crushed on site or at Morningside.

Councilor David McKendrick stated that the coal would be crushed at Badallan site.

John Harper Proposed that Tom Young continue as the Community Council’s representive for Bancep,

Edwina McAlpine seconded the proposal.

Tom Young was re-elected to be the Community Council’s representive for Bancep.

Tom Young asked if it were possible to have an article for the Wishaw press regarding the forthcoming Community Council Elections,

There was a good debate with various ideas which we could try to drum up intrest in local people.

Councilor David McKendrick sayed that he could arrange for an offical to come to a meeting and explain about any grants that we could apply for from various sources.

Secretary Brendan McGhee was asked to write to various banks asking if they would consider setting up a banking facility in Newmains.

Wednesday 13‘’’ October 2004

Chairman Tom Young opened tlie meeting, and welcomed all present, especially those newly elected for tlie first time, and the two co-opted members. Chair said he wanted to make it clear to all from the start of his chairmanship that all Community Councillors and all present at our meetings are entitled to be treated with courtesy and respect, even if sometimes there are different views being expressed, and that he would do his best to ensure there would be no acrimony at any meetings. Chair then started the agenda of the meeting.

Police Report. Const Muir went through the month’s statistics, and noted that the numbers of “crimes” were up, but detections somewhat down. It is again noted that a large proportion of the offences requiring police attention involve youths misbehaving. The statistics are attached to this minute. Serious crime reinailis at a low level. Const Muir said that there was some progress towards the creation of the new police base in Newmains. This would provide a better point of contact with community Police Officers than before. Other matters included the ongoing situation of improper car parking in Manse Road. to which there still seeins to be little prospect of resolution. Motorists seem prepared to park in any place close to tlie shops, including

The “Safer Scotland’’ campaign required officers to wear high visibility jackets at all times. which seems to do little good, and enables errant youths to spot officers froin a greater distance. Chair thanked Const Muir for his report and police efforts generally.

Correspondence

Papers were received regarding potential amendment to National Planning Policy Guidelines 16, dealing with Opencast Mining planning matters. Chairman read a suininary of the proposals, and meeting agreed it was very much in our interests to seek to be a party to the consultation process.

Post Office notification of the proposed closure of the sub-PO at West Crindledyke has been received. Meeting felt this closure would be a blow to the residents of the area. Meeting decided to refer the matter 10 KLC Cllr Janies Martin, and to seek from him or NLC, statistics of the age-bands of residents of the area. The question was asked. if the present PO operators want to retain the PO

franchise. This can be found out by asking directly, and asking if the present operator would like us to try to persuade tlie PO keep the West Crindledyke Sub-PO going. .

Volunteer Centre News received, and a note of a range of Volunteer and Groups Training Opportunities. Brendan McGhee will look at these matters as usual.

Noted invitation to Coalfield Communities Campaign conference. This appears to b e a commercially run conference of little relevance to us, and is expensive. No offers to attend.

CAVOC letter and matters therein to be dealt with by Brendan McGhee.

WICKSTEED Leisure wrote offering services relating to disabled access to outdoor play areas. It was not though our area has any difficulty in this filed, that cannot be locally solved. No action required.

NLC OPEN SPACE STRATEGY (papers not to hand) After some discussion, it was thought that the strategy ideas could be useful in dealing with the inessy vacant site in Manse Road between the old Police Station and the Library, and perhaps also is iiialtiiig better access to and leisure use of the bing at Crindledyke.

ANY OTHER COMPETENT BUSINESS

There were two short i t e m mentioned, 1. to note that there is no disabled parking laid aside in Manse Road. and 2. to note that there have been reports of people riding horses on pavements notably between Morningside and Newmains, causing annoyance to pedestrians, and fouling tlie footpath with horse- dung. It a specific offence (Roads (Scotland) Act 1984 s.129) to ride a horse on a footpath.

4. Matters Arising (a) the proposed closure of the PO at West Crindledyke. Secretary reported contact twice with the PO operator Mr Saleem, and had written to Mr Saleein inviting hiin to come to the meeting. Mr Saleem had phoned secretary this morning to say he could iiot come. but that he would like the PO to stay open. It seeiiis that the PO is putting some pressure on Mr Saleeiii to agree to close the PO. Meeting agreed to try to reverse the closure decision in the interests of the folk of the area. Secretary has already written to Wishaw Press, and has had a good response. .An Article in support is probable. Meeting agreed to continue this action. Secretary will action.

(b) Volunteer Centre News Breiidaii McGhee had attended a good meeting in kfotherwell, titled a 50-50 conference, where equal numbers of old folks and young folks were meeting up t i i share their views. Brendan reported this was a good meeting enjoyed by all. There was a North Lanarltshire Youth Council presentation, which had been well done.

(c) “Ci-indledyke Bing” Breiidaii McGhee noted that access for the public to the bing area was poor, and the area was little used as cl result. Tom Young added that what access there ti ,IS has been made rather difficult because horse iiders use the access paths which get churned up b q horses’ hooves. Meeting was told that what pitli\\ays there are on the area seeiii to go no-wlisre, anci that it would be iiiucli better for all if the paths actuall) started and ended where people were likelj to want to walk froin aiid to, such as all the way ~liro~igli from Braedale to Moriiingside as an example. Just a few basic firin walking ibotpaths would be n good start. Secretary to write to NLC to ask what might be possible.

Meeting noted that the Aucliter Water is in need oi‘being cleared out of broken branches and debris. 11 is thought that SEPA may be responsible for attending to this.

Meeting agreed to authorise the setting up of this fLmd with E200.00.

7 . Any Other Competent Business

Tom Young suggested N&DCC might wish to be represented at Remembrance Day events, possibly even to lay a wreath at the War Memorial in Newmains. Meeting felt this was a worthy idea, aiid agreed to consider the matter again in good time for Remembrance Day 2005

John Harper noted that the meeting had been ready to start well before 7.30, and it was clear there was some interest in reverting to a 7 o’clock start. Chair led a discussion on this, and noted that the extra half hour would usually be helpful at the ends of meetings to stop a rush to finisli meetings by the 9 o’clocl\: deadline. As the caretaker is not affected by this, aiid as the room IS bo01ted through, meeting agreed that from iiow on the srart time should be 7 o’cloclc.

Toin Young raised matters about the proposal to continue tlie railhead in Morningside. He showed the backs of some letters lie said were from people in Morningside castigating him personally for being minuted in the June N&DCC meeting minutes as suggesting and supporting the coal from Badallaii and Headless Cross going though Morningside. The iniiiute concerned was approved at the next meeting (Sept ’04), and must stand. Toin did NOT show or read out any of the letters, nor would lie say who had sent them. The source and content of the alleged letters remains ltnown only to Toiii. Toiii then told meeting that secretary “had sent an unauthorised letter” to NLC regarding tlie planning application, and remarked that there was no room for a “loose caiinoii” (apparently a reference to the secretary) and that lie had “no coiifidence in the secretary”, but that lie (Tom Young) would not be resigning. Secretary expressed surprise at this outburst in which Mr McGiiee also took part. at the 2nd of all otlieruisc pleasant meeting, and stated that he could easil!. give up his post if the N&DCC so wished. but that he would certainly fi-ilfil liis office at least until the next meeting, that is, he would attend to the minutes aiid the matters arising that required attention this month. No-one resigned, and no iiiotioii seeking that was made. The status quo therefore prevails, and will continue unless other action occurs. (Secretary lias written privately to Chairman regarding this matter).

Newmains & District Community Council

November 2004 Now that we have all had time to draw breath after our election or co-option to OUR coininunity council, my task as secretary includes reminding us what the AIM of our little council is, and pointing out some of the rules under which we must operate.

We have a formal CONSTITUTION. We decided at our inaugural meeting on 13‘” October 2004 to adopt the standard model constitution offered by North Lanarkshire Council. We may apply to amend this, but NLC would have to agree any changes. We must m e n d it to INCLUDE our extra office of “Vice Chairman”. It IS unlikely we would need to seek other changes.

The OBJECTIVES of the community council are stated in the CONSTITIITION: “The objectives of the Council shall be:

(a) to ascertain, co-ordinate and express the view of the community which it serves to North Lanarkshire Council concerning matters for which NLC is responsible;

(b) to ascertain, co-ordinate and express the views of the community which it serves to public bodies and industrial concerns which have an effect on the conimunity from an administrative, social or economic point of view;

(e) to take such action in the interests of the community which it serves as appears to the (community) Council to be expedient and practicable, and

(d) to seek financial support from any source for projects which further the foregoing objectives.

Items (c) and (d) above are very widely worded, and in effect the community council inay do just about anything that it feels is in the “interests of the community which it serves”. We have an “Area of Operation”, which is our defined coininunity council area. We should not involve ourselves in matters outwith our area, unless of course they also affect us.

Initially, members are elected. During the four year period between elections new ineinbers inay be CO-OPTED to the council, being elected by the existing members, both elected and co-opted. At the very most we a r e allowed to have ELEVEN ELECTED, and TEN CO-OPTED, community councillors, and all have equal voting rights. There seeins to be a provision to have mid-term elections to replace “lost” elected members; but this is not explained in the papers currently held.

At every meeting of the community council we MUST have present, BEFORE a formal meeting can be held, one third or more of all the community councillors of whom not less than THREE must be Elected members. At the time of writing (November 2004) we have fourteen members in all, so the minimum quorum must be FIVE members, of whom three or more must be elected. There is no provision to allow the Chair a casting vote i n the event of tied decisions. It is most important that no “decision” is taken at any meeting which is “inquorate”.

If a coininunity councillor does not attend any meeting during a period of six months, that member shall cease to be a inember of the coininunity council. However, in that rule it is made clear that the community council may approve the reason for a councillor’s absence, and excuse him, thus NOT including that meeting in the six moiitlis absence period. What this means is simple - if you notify the secretary or cheir in advance that you caiiiiot at’end d meeting, and give a 4mple reason (perham best not “Football.. . .!”) then the six month period, and tlie requirement to strike off a member, need not occur.

Meetings of Community Councils shall be held in public. Any inember of the public inay attend our meetings. lMeinbers of the public have no RIGHT to speak or be heard, but there is no reason why they cannot be invited to speak should the council so wish, through the chair. In two circumstances only, meetings inay be held in private session. This would require the meeting to approve a forinal motion to do so. The circuinstances are (1) if public discussion of the business would not be beneficial to tlie community, or ( 2 ) if the subject matter is confidential to an individual. Private meetings are best avoided.

NLC Councillors for the area shall receive Agenda, Notices and Minutes of our meetings, and are entitled to attend, participate in and address our meetings, but shall not be entitled to vote. They may NOT become elected or co-opted meiiibers.

The CHAIRMAN (whom failing the Vice CIirrirnznn) shall conduct all meetings of the council, and shall co-operate with the SECRETARY in arranging the agenda for meetings. The SECRETARY shall arrange for a minute of all meetings of the council to be taken: and prepared for approval ofthe council. The TREASURER shall attend to all money matters, and keep records for audit. Every cheque must be ONLY signed by the treasurer A N D one of the chairman, vice-chair, or secretary. Ms Sliirley Lintoii (SL): Told meeting in outline how a plaiiiiiiig application was handled The railhead application had been received in September 2004, was registered in October, and was for the continued use of the railway siding at Moriiiiigside. Plaiiiiiiig staff consult a iiuiiiber of iiiteriial aiid external (such as SEPA) agencies, a i d arrange for a public notice to appear in the local press. In this case, Planning Dept has asked the applicants to supply further inforiiiatioii. Meaiitiiiie aiiyoiie caii still iiialte representations to the council about tlie application. and aiiyoiie caii ask to be heard by the coininittee on the iiiatter. The earliest possible date for tlie iiiatter to reach coiniiiittee seems to be early February 2005. which failing March 2005. Two matters the applicants have been asked to provide iiiore iiiforinatioii on are regarding vehicle iiioveineiits, aiid noise assessiiieiits.

Ms Lorna MacCalluiii (LM): Said the couiicil (NLC) doesn’t have a lot of iiiforiiiation on this application. It‘s oiily for the use of the r a i l u q line itself, and not the other area that was used by 14.I Banks & Co. The key facts about the application are: HOUS of work applied for are 7 am to 7 pm Moiidays to Fridays, and 7 alii to iioon Saturdays. They have indicated two traiiis per day would leave the site, aiid one on Saturdays. Access to the site is to be from tlie rouiidabout at Moriiiiigside on the A71 trunk road. The application is not limited to COAL, 1101 to coal only from Badallan. Haulage traffic to the site could come from any direction, including from the Newmains side. Noted that the number of vehicle movements per day would be 30 each way (30 full in aiid 30 empty out) that vehicle size would be 28 tonnes load i.e. 44 tonnes gross vehicle weight. and noted that the source of materials is possibly from Badallaii / Headless Cross but is not restricted to these. Noted that Badallaii permission not to be issued until legal agreements have been concluded and bond lodged. I-Ieadless Cross has not yet beeii considered hy the planning coininittee so 110 decision has been rakcn oii that ap p li cati o 11.

Asked by (MR) Drew Smith uShy tlie iie\v owners of new homes in Scliool Road Morningside liad not been informed of the railhead plans, LM stated that those houses were not close eiiougli to tlie proposals to warrant being iiiforiiied at the time. A lady (MR) stated that none of tlie lieu homes at School Road are even shown 011 the applicant’s plans, and said “it’s as if we don‘t even exist”. LM Replied that point is agreed, aiid the new houses don’t appear on tlie Ordiiaiice Survey plans yet. Plaiiiiiiig can iiot therefore insist the applicant shows them. However, the distances from the new houses to the proposed site has been worked out, and tlie closest home is 66 metres away. It was specifically NOT restricted to aiiy one opencast mine such as Badallaii, and also not only to coal. The Lady (MR) then said 110-one ever mentioned any of this as a possibilit3 when they were looking into buyiiig their iiew homes. Chair stated “We’ve been discussing this for a couple of’ years”. Chair asked it be iiiiiiuted that Cllr McKendrick was present but iiot taking part in view of his membership of’ the relevant plaiiiiiiig committee.

( M R ) Drew Smith asked for coiifiriiiatioii that tlie original coal route’from Badallaii was to be to Mosseiid. Chair stated originally it liad been decided to take the coal to Morningside through the village. and enter to tlie railhead from an access opposite and a little north of the Mill Road junction. Chair stated lie liad been on picltet lilies opposing this. However, Secretary read from the origiiial Badallan Revised Transportation Chapter October 2002 which states the route from Badallan was to be on A71 west through Allanton to its junction with A73 at Newmains Cross, and then up Westwood Road on the A73 north to its junction with M8 J6 at Newhouse, and then M8 to Mossend. Nowhere was there any mention of using the Morningside railhead. (MR) Drew Smith noted that West Lothian couiicil liad refused to allow tlie coal traffic to use tlieir roads, aiid had threatened to object to Badallaii unless tlie coal went westwards into NLC area. aiid reiniiided meeting that it isn’t just Badallaii coal involved in this application - it could be coal aiid whatever else coming from anywhere. aiid it could go on for inaiiy years. Chair stated that tlie extra iiiforiiiatioii was not available until very recently. (MR) Drew Smith asked chair what was the stance of N8tDCC now in light of tlie new iiiformatioii. Chair stated that all such decisions would have to be talteii by tlie NLC councillors at the plaiiiiiiig committee. Breiidaii McGliee re-stated his opinion that the original route plaiiiied was to be through the village itself. ‘To date. no records indicating this have been sho\vn.

( M R ) M. MacFarlaiie pointed out that the Badallaii traffic alone would oiily be a tiny iiicrease of 0 3% of the total IiGV traffic on tlie roads over tlie next 5 >ears, but as tlie application was IION to be Linliiiiited, it

could turn out to be a lot more than that. it could ail end up coining through Newmains, and it could go on ror 25 years or more. Chair stated that he didn’t know all tlie extra information about additional sites from M hich coal might come until \fery receiitlq . aiid that tlie N&DCC Decision was based on oiily coal. and only li-otii tlie Badallaii site. E McAlpiiie (Treas) asked if all those lorries are coming. uould they n o t need to upgrade the railhead? L M Replied that the present application was only for the sealed platform on the grouiid. an area of hard staiidiiig in other words. and not for anything iiiore.

B McGliee asked if there liad been aiiy objectioiis from Newmains. LM replied yes. two so far.

(MR) Drew Smith re-stated tlie point that if granted this site could be in operation for 25 years or more, \vitli coal coming from opencast sites iiorrli of ?4ewmains. Chair stated that he wouldn‘t expect coal from Airdrie direction to go to Newmains, and thought it would go to Mossend. Lh4 stated this could not be assumed as coal Goiii the Airdrie area has previously been talteii to Ravenstruther even though Mossend existed at the time aiid was much closer tliaii Ravenstruther. ’The coiiipanies iuvoliwl decide for commercial reasons how their coal is moved aiid handled. LM reiiiiiided all present that if such an application was granted. the coal and other goods could come to the site from absolutely anywhere. The applicaiits ~vould also be able later to apply to aineiid aiiy planning coiiditions if they felt tlie need to do so.

C ’ l i a i r asked 1,M aiid SL about the MTM House builders application to vary conditions about the restricted use of School Road, and noted that when consent \vas granted is was on coiiditioii access to most of the liotises \vas to be taken from tlie ad,jacent site. Lh4 agreed that was the situation a i d MT,M were applying to change i t so that all access to and from tlie School Road site of soiiie 60 homes niid the nursing home w o ~ l d be through School Road. LM noted that tlie present use of School Road was supposed to be temporary and

This condition was applied because it was felt at the time that School Road could not safely handle the traffic. That planning department view has not changed. (MR) Dren Smith stated it was clear to all that it was not acceptable that 50+ lieu homes and the N ~ i r ~ i i i g Home should be forced to use only School Road, and noted the difficulty that traffic has now at School times. which could cause great difficulty for emergency services such as Fire Brigade aiid aiiibulaiices. (MR) .losephiiie Steel said School Road is so narrow aiid busy 1i01-v that it is simply not possible or acceptable to allow tlie situation to continue loiiger than necessary, and noted that the ne\?, residents were proiiiised that they ~ ' o i i l d have proper access as soon as possible froiii the other side

Lh4 asked to malte two points clear: First. that he notification procedures for planning ~~pplications meant that some peopie \\.ere informecl l d o r e tlie appiicatioii went in, because these people are "neighbours" to the proposal, aiici also agreed h,lorniiigside Primary School was not told. Only the last tWo houses iii School Road needed to be told at that time. as neighbours. Second. the School Road aineiidineiit application is a DELEGATED oiie. which officials could grant if they were so minded, but officials would have to refer to the planning coiiiinittee if they were iiiiiided to recommend reftisal. or if there were representations / oh-jectioiis.

Nearly always the committee \\ i l l allow Iiearings to be held. Any request that a matter be dealt with by a hearing should be in writing.

Another (MR) asked if the proposed coal haul road wah compatible with providing access for tlie housing doelolxiieiits. Lh4 said the original plans show clearly the access for the iiiajority of the School Road housing development was to be into tlie new site wliich would then access to Moriiiiigside Road at a new roundabout sited about where Hydrachrome works was

A Barrat's Developnieiit (BD) resident Stewart said there are two groups iiivolved in all this, aiid this iit'w possibility of extra coal traffic coming from tlie Newhouse side was all new to them and they are wholly r?pposed to any de\dopii1ei1t that iiicreases the traffic through the roundabout on the north end or Newmains. LM said that if the couiicil was to be able to take account of these co~iceriis, the parties would have to write in to K l L Plaiining with their coiiceriis. One (BD) resident asked LM if conditions could be applied restricting routes for such traffic. LM said YES. but conditions cannot apply that t ry to stop people using public roads. hence the probleiiis at School Road h4orningside. C'liair noted that this discussion had lasted a good hour regarding the railhead aiid School Road apphcations, m d asked for any more questions. Cliair suggested all those with coiicei-iis can state their cases, b~i t must do so in writing to NLC Planning. One resident then raised tlie subsideiice risks in Westwood Road. LM said the couiicil coiisulted with all authorities on such matters, but as it is a trunk route (A 73 T) it would be cli fficult to attempt any restrictions oii movements for that reason. Chair noted also that even tlie library liad suffered from subsidence as well as many other parts of tlie area.
