[Session  1]  Public  Policy  Challenges  in  the  Market  Societies  

Professor  Dr  Takashi  Yanagawa  (Kobe  University)  Professor  Dr  Takashi  Yanagawa  has  been  a  professor  at  the  Graduate  School  of  Economics  at  Kobe  University  since  2004  and  the  Director  of  Interfaculty  Initiative  in  the  Social  Sciences  at  Kobe  University  since  2014.  He  received  his  Ph.D.  from  the  University  of  North  Carolina  at  Chapel  Hill  in  1993.  He  worked  at  Nagoya  Gakuin  University  from  1992-­‐99,  and  has  been  a  faculty  at  Kobe  University  since  1999.  He  was  a  visiting  researcher  at  the  London  School  of  Economics  from  1996-­‐97,  the  University  of  California  at  Berkeley  2004-­‐05,  and  the  Japan  Fair  Trade  Commission  2008-­‐11.  He  has  been  a  managing  director  of  the  Japan  Economic  Policy  Association  since  2010.  

Mr.  Ragunath  Kesavan  (Commissioner  of  Competition  Law  Commission,  Malaysia)  Ragunath   has   been   a   legal   practitioner   for   more   than   23   years   and   has  previously  served  as  the  President  of  the  Malaysian  Bar  Council   from  2009  to   2011.   He   had   previously   served   as   Secretary   of   the   Bar   Council.   He  qualified  as  a  Barrister-­‐at-­‐Law  at  Gray’s   Inn,   London  and  was  called   to   the  Bar   of   England   &  Wales   in   1990.   He   graduated   with   a   Bachelor’s   Degree  (Genetics)  from  University  of  Malaya  in  1985,  LLB  from  University  of  Wales  Abertyswyth   in   1989   and   LLM   from  University   of  Malaya   in   1995.  He  was  awarded  the  Calcott  Pryce  Award  in  Public  International  Law  in  his  LLB  finals  and  graduated  with  a  2.1  degree.  

Professor  Narufumi  Kadomatsu  (Kobe  University)  Professor   Narufumi   Kadomatsu   is   a   Professor   of   Administrative   Law   at  Graduate  School  of  Law,  Kobe  University.  After  graduating   from  University  of  Tokyo  in  1986,  he  studied  at  Master’s  and  Doctoral  Program  at  Graduate  School.   He   also   worked   as   a   Research   Associate   at   Institute   of   Social  Science.   He  was   appointed   as   Associate   Professor   at   Kyushu   University   in  1996   and   transferred   to   Kobe   University   as   a   Professor   in   2005.   He   also  studied   one   year   at   the   University   of   Hamburg   (1998-­‐1999)   and   taught  Japanese  Law  at  the  University  of  Munich  (2003-­‐2004).  

Professor  Dr.  Rawshan  Ara  Begum  (Universiti  Kebangsaan  Malaysia)  Dr.  Rawshan  Ara  Begum  is  currently  an  associate  professor  at  the  Institute  of  Climate   Change   (IPI)   in   the   National   University   of   Malaysia   (UKM).   She  received   her   PhD   in   Environment   &   Development   from   the   Institute   for  Environment  and  Development  (LESTARI),  UKM.  Her  research  interests  are  in  the   areas   of   environmental   and   natural   resource   economics   specifically  environmental  valuation;  waste  management;  economics  of  climate  change;  and   issues   of   sustainability.   She   served   as   Contributing   Author   (CA)   for  Chapter  24:  Asia,  of  the  Working  Group  II  to  the  Intergovernmental  Panel  on  Climate  Change  (IPCC)  Fifth  Assessment  (2011-­‐2014).  She  has  published  more  than  100  articles  in  the  refereed  international  and  national  journals,  chapters  in  Book  as  well  as  conference  proceedings.

[Session  2]  Private  Ordering  Challenges:  Value  Creation  by  Complex  Transaction    Mr.  Kenny  Poon  (Senior  Partner,  Jeff  Leong  Poon  &  Wong)      Kenny   Poon   is   a   senior   partner   of   Messrs   Jeff   Leong,   Poon   &   Wong   in   Kuala  Lumpur  and  he  has  been  in  active  legal  practice  for  over  20  years.  He  read  law  at  the   University   of   Leeds   in   the   UK   where   he   was   the   recipient   of   the   Hughes  Discretionary   Award   in   1987.   He   was   called   to   the   English   Bar   in   1990,   the  Malaysian   Bar   in   1991   and   the   Singapore   Bar   in   1994.   He   practised   for   several  years  with  a  regional   law  firm  in  Singapore  before  returning  to  Malaysia   in  1996.  Kenny   currently   advises   on   initial   public   offerings   and   listings,   foreign   direct  investment,  joint  ventures,  acquisitions,  takeovers  and  corporate  restructurings.  

     

 Professor  HIdefusa  Iida  (Kobe  University)    Professor  Hidefusa  Iida   is  the  Associate  Professor  at  the  Graduate  School  of  Law,  Kobe  University.  He  received  his  LL.M  from  Harvard  Law  School  and  University  of  Tokyo,  and  LL.B.  from  University  of  Tokyo.  Before  joining  Kobe  University,  he  was  an   associate   at   Iida,   Kuriu  &  Wasemoto,   specializing   in   business   law   and   patent  law  for  six  months,  and  a  research  associate  at  University  of  Tokyo  for  two  years.  His   research   focuses   on   mergers   and   acquisitions,   corporate   governance,  securities   regulation,   and   law   and   economics.   He   coauthored   a   chapter   on  corporate   law   in  Econo-­‐Legal   Studies:   Thinking   through   the   Lenses   of   Economics  and  Law.  

 

     

 Mr.  Aminursyed  Mahpop  (Universiti  Kebangsaan  Malaysia)    Aminurasyed   Mahpop   is   a   Fellow   in   Law   at   the   Faculty   of   Law,   The   National  University   of   Malaysia   (UKM)   and   also   an   Associate   Member   of   the   Research  Center  for  Islamic  Economics  and  Finance  (EKONIS-­‐UKM).  He  is  also  an  Accredited  Mediator  of  Malaysian  Mediation  Centre.  Prior  to  joining  UKM  in  2012,  he  was  an  Advocate  &  Solicitor  of  the  High  Court  of  Malaya  and  Syarie  Counsel  of  the  Federal  Territories  for  13  years  practising,  among  others,  banking  (both  conventional  and  Islamic),   commercial   contracts   and   litigation  matters.  He   received  his   LLB   (Hons)  and  Diploma  in  Islamic  Judicial  Administration  and  Legal  Profession  and  Masters  in  Islamic   Economics   from   UKM;   and   Masters   in   Law   from   University   of   Malaya.  During  his  practice,  he  was  instrumental  to  the  preparing  and  drafting  Islamic  and  conventional   banking   legal   documentation   of   various   products   for   Hong   Leong  Islamic  Bank  Berhad  and  OCBC  Al-­‐Amin  Bank  Berhad.  He  was  also  responsible  for  the   advisory   of   a  wide   range   of   banking   and   financing   facilities   for   a   number   of  Malaysian   financial   institutions,   ranging   from   retail   to   syndicated   loan/financing.  Currently,   he   is   undertaking   consultation   works   for   United   Overseas   Bank   (M)  Berhad   for   review   and   translation   of   the   banking   documentation   of   various  products.   His   current   researches   are   Governance   of   Contract   Documentation   in  Islamic   Banking   Products   and   Harmonization   of   Contractual   Relationship   in  Mudarabah  Investment.

Professor  Ruzian  Markom  (Universiti  Kebangsaan  Malaysia)    Professor   Ruzian   Markom   obtained   her   PhD   in   Law   from   the   International  Islamic  University  of  Malaysia   (IIUM)  on  her   thesis  of  Financing  Build  Operate  Transfer  (BOT)  Projects:  An  Islamic  Legal  Analysis.    She  is  currently  an  Associate  Professor   and   the   Deputy   Dean   of   Undergraduates,   Alumni   and   Society  Relations   at   the   Faculty   of   Law  Universiti   Kebangsaan  Malaysia   (The  National  University  of  Malaysia),  where  she  teaches  Muamalat  (Islamic  Transaction),  the  Law   of   Islamic   Banking   and   Takaful   and   Islamic   Financial   System   at   both  undergraduate   and   postgraduate   levels.   Her   research   interest   is   in   financial  consumer  protection,  Islamic  law  of  transactions  and  Islamic  financial  services.  Her   publications   include   articles   in   some   journals   and   periodicals   in  Malaysia  and  international.  She  received  prestigious  awards  for  her  writing  and  research  in  the  area  of  Islamic  finance.

 [Session  3]  Econo-­‐Legal  Studies  and  Interdisciplinary  Education    Professor  Hiroshi  Takahashi    (Kobe  University)    Professor   Hiroshi   Takahashi   studied   the   sociology   of   law   and   received  Master’s   degree   in   Laws   from   the   University   of   Tokyo.   He   lectured   at  Kwansei   Gakuin   University,   and   is   now   professor   at   Kobe   University,  Graduate   School   of   Law.   His   research   interests   include   the   sociological  analysis   of   ADR,   legal   profession   and   judicial   statistics.   His   publications  include:   “Career   Patterns   of   Japanese   Judges,”   Choi   &   Rokumoto   (eds.)  Judicial   System   Transformation   in   the   Globalizing  World   (Seoul   National  University   Press,   2007);   “Career   Judiciary,   Judicial   Reform   and   Practicing  Attorney,”   Journal   of   Japanese   Law,   No.   27   (2009);   and   “Toward   an  Understanding   of   the   “Japanese”   Way   of   Dispute   Resolution,”  Vanoverbeke   (et   al)   (eds.)   The   Changing   Role   of   Law   in   Japan   (Edward  Elger,  2014).    

                               

 Mr.  Jeff  Leong    (Senior  Partner,  Jeff  Leong  Poon  &  Wong)    Mr  Jeff  Leong  has  been  collaborating  with  Kobe  University  on  research  related  to  value  creation  by  business  lawyers,  transaction  cost  economics,  relational  contracts  and  interdisciplinary  problem  solving.    He  has  been  a  visiting  lecturer  for  Kobe  University’s  Asian  Law  Course  since  2010  and  is  supervising  a  highly  successful  visiting  internship  program  for  law  students  from  Kobe  University.      To  date,  some  80  law  students  from  Kobe  University  and  other  universities  in  the  Kansai  region  have  been  trained  through  the  program.    He  has  also  travelled  extensively  throughout  Japan  for  over  15  years,  and  enjoys  various  aspects  of  Japanese  society,  food  and  culture.  In  his  work  as  a  business  lawyer  in  ASEAN,  he  specialises  in  IPOs,  capital  raisings  and  other  corporate  exercises  on  Stock  Exchanges  as  well  as  domestic  and  cross-­‐border  merger  and  acquisition  transactions,  joint  ventures,  venture  capital  investment  and  foreign  investment  transactions  in  ASEAN.    

                               

 Professor  Akira  Saito    (Kobe  University)  *Chair  of  Session  2/3    Professor   Akira   Saito   is   the   Director   of   Kobe  University   Center   for   Asian  Studies   as   well   as   a   professor   of   international   business   law   in   Kobe  University   School   of   Law.   He   graduated   from   Kobe   University.   After  working   in  Mitsui  OSK  Lines,  he  decided  to  resume  his   law  studies   in   the  graduate   school   of   Kobe   University.   Then,   he   continued   his   academic  exploration   in   the   University   of   Aberdeen,   which   keeps   its   distinct  tradition  of  Civil   Law  as  well   as  Common  Law.  His   thesis  on   comparative  analysis  of  the  duty  to  mitigate  damages  led  to  his  receiving  LL.M  in  Scots  Law.   The   experience   gave   him   the   capacity   to   deal   with   legal   problems  from  wider  context  of  cultural,  historical  and  economical  background.  As  a  practitioner,   he   has   been  working   as  Mediator   in   the   Kobe   Family   Court  for  12  years.  He  also  was  appointed  as  Expert  Witness  of  Japanese  Law  in  a  large   ICC   international   arbitration   case   concerning   cross   border   M&A  between  Asian  companies.
