    “If this document contains any restriction based on sex, gender identity, genderexpression, familial status, race, color, religion, ancestry, national origin, disability,medical condition, genetic information, marital status, sexual orientation, citizenship,primary language, immigration status or source of income as defined in subdivision (p)of Section 12955 of the Government Code, or ancestry, that restriction violates state andfederal fair housing laws and is void, and may be removed pursuant to Section 12956.2of the Government Code. Lawful restrictions under state and federal law on the age ofoccupants in senior housing or housing for older persons shall not be construed asrestrictions based on familial status.”

    FORLA FLORENTINE AT RENAISSANCE-LA JOLLA ASSOCIATION

    This First Amendment to First Restated Declaration of Covenants, Conditions andRestrictions of La Florentine at Renaissance-La Jolla Association is made as of the date hereinaftershown by a majority of the total voting power of La Florentine at Renaissance-La Jolla Associationas provided in Article 12, Section 12.1 of the First Restated Declaration of Covenants, Conditionsand Restrictions of La Florentine at Renaissance-La Jolla Association hereinafter described.

    Recitals

    A. WHEREAS, the La Florentine at Renaissance - La Jolla Association is the entityestablished to maintain, operate and manage the real property legally described in Exhibit “A” tothis First Amendment;

    B. WHEREAS, a First Restated Declaration of Covenants, Conditions & Restrictions of LaFlorentine at Renaissance - La Jolla Association was recorded on June 12, 2007, as Instrument No.2007-0396067, in the Office of the County Recorder of the County of San Diego (“First RestatedDeclaration”), that superceded and replaced the Original Declaration, making the property legallydescribed in Exhibit “A” hereto subject to same;

    C. WHEREAS, the membership of the Association hereby approves this First Amendment tothe First Restated Declaration as follows:

    1. Article 6, Section 6.1(C) (Lessee/Tenant Bound by Governing Documents) isamended to read as follows:

    Section 6.1(C). Lessee/Tenant Bound by Governing Documents. Twelve months afterpurchasing his or her Unit, each Owner shall have the right to lease his or her Unit, garageand interest in the Common Area together, provided that such lease is in writing andprovides that the tenant shall be bound by and obligated to the provisions of thisDeclaration, the Bylaws and the Rules and Regulations of the Board; no such lease shallbe for transient or hotel purposes. Any such lease which is either for a period of less thantwelve (12) months or pursuant to which the Lessor provides any services normallyassociated with a hotel shall be deemed to be for transient or hotel purposes.

    For the purpose of this amendment, the purchase of a Unit does not include title transfersdue to such events as the transfer of the property into or out of a trust, or transfers betweenfamily or current Owners of the Unit.

    This amendment applies to all Owners who purchase a Unit after the recording date of thisFirst Amendment, or to those Owners who agree, in writing, to be bound by this restriction.

    Except as expressly amended herein, the provisions of the First RestatedDeclaration shall remain in full force and effect.2.
