Transportation: The use proposed in this SLU is much less intense that the area isdesigned to support. As such, no adverse traffic issues are:anticipated. This use does not, however, maximize the use of thetransportation infrasteucture which was put in, place to supportcommercial activities on this site.

ANALYSIS

Section 1282.03(f)(1)-(2) sets forth the criteria which must be used. to evaluate a Special LandUse permit request The criteria and evaluation are as follows.

7:. Is the proposed special land use designed, constructed, operated and maintained in amanner harmonious with the character of adjacent property and the surroundingarea?

The proposed site is within. an exiting shopping center that houses retail and service relateduses. A church in such an environment is perceived to have a negligible impact onsurrounding uses, particularly since there is more than adequate parking available on. the site.Furthermore, the church is typically in use at times that do not conflict with peak hours forother businesses and activities are generally confined to indoors. The greatest potentialimpact on its harmony with the surrounding commercial area could be the .conflict betweenthe church and future liquoriicenses. This is described in greater detail under item. 3 below.

Will the proposed special land use change the essential character of the surroundingarea?

The proposed church will not change the essential character of the area. The church will belocated in an existing commercial facility and, as described in item 1., should not have anynegative impacts on. the surrounding area.

Will the proposed special land use interfere with the enjoyment of adjacent property?

The primary concern with churches in terms of interfering with the enjoyment of adjacentproperties is the potential conflicts with liquor licenses. By state law, a church has anopportunity to object to all new liquor licenses within 500 feet of the church property. Inthis. case, there are several commercially zoned properties within 5Q0 :feet of the subjectproperty. Since this is a predominately commercial district, the applicant should agree, inwriting, that it will not object to the issuance of liquor licenses in the.area.

4. Will the proposed special land use represent an improvement to the use or character ofproperty under consideration and the surrounding area in general, and will the use bein keeping with the natural environment of the lot?

The. proposed use of this site for a church will .nothave any negative environmental impactson the site or the surrounding: area in general. In fact, the proposed . church. could have apositive impact 01 tile.facilityby providing aviable'use ofanOtherwise Vacant portion of.ashopping center. With regard to the natural environment, no changes are proposed for thesite.

5. Will the proposed special. land use be hazardous to adjacent property or involve uses,activities, materials or equipment which are detrimental to the health, safety or welfareof persons or property through the excessive production oftraffic, noise, smoke, odor,fumes or.glare?

The. church will not generate any nuisances .or'bo7ardoris conditions.

6. Will the proposed special land use be adequately served by essential public facilitiesand services, or is it demonstrated thatthe person responsible for the proposed specialland use is able to continually provide adequately for the services and facilities deemedessential to the special land use under consideration?

The subject property is. currently served by all necessary public services and utilities. Nonegative comments have been received fromany of the reviewing departments or agencies.Inspections may be necessary to determine if the structure complies With current buildingcode and fire code requirements for an assembly use.

Will the proposed special land use place demand on public services and facilities inexcess of current capacity?

The proposed special land use is not expected to increase the demand on public services .andfacilities in excess of current capacity

Is the proposed special land use consistent with the intent and purpose of this ZoningCode and the objectives of any currently adopted Comprehensive Plan?

The comprehensive plan and the zoning ordinance both designate the subject property forcommercial use. Churches are permitted in commercial districts, subject to obtaining aspecial land use permit. In many respects, churches have a similar impact on the surroundingarea as most 'Commercial' uses in that passenger parking is the only regular activityoccurring on the site, outside of the building.

Will the proposed special land use meet the dimensional requirements of the district inwhich. the property is located?

The only dimensional requirement that applies to. this request is parking. Section1284.13.(b)(1) of the Zoning Ordinance requires 1 parking space.for each 3 seats in the mainsanctuary. Since the :applicant would like to have seating for 30 people in the sanctuary, l0parking spaces are required. There. are several hundred parking spaces on the site, most of'which are rarely ever used.. There are numerous vacancies: in the shopping center. and. even atfull capacity, there is more than adequate parking to accommodate the needs and f dill the.Zoning Ordinance requirements for a shopping center.

Section 1268.04(b) of the Zoning Ordinance states that churches in the "F" Commercialdistrict, must be. located on a collector, principal or minor arterial. Holmes Road isdesignated as.a:minorr arterial and S. MLK is designated as a major arterial. Therefore, therequest complies with the condition.

SUMMARY

This is -a request by Esteban R. 'Chavez to utilize 1122 W. Holmes Road, Suite 3 (Logan SquareShopping Center) for a church. Churohes are-permitted in the "F" Commercial district, which is thedesignation of the subject property, if a Special Land Use permit is. approved by the Lansing CityCouncil. The church has been established for 6 years and has a membership of approximately 30individuals. -Services are held on Sunday from 10-11:30 n.m. Wednesday services, Friday youthactivities and other special events and outreach services are also provided.

Based on the findings contained in. this staff report, the proposal complies with all of the criteria ofSection 1282;03(f)(1)-(9) of the Zoning Code for evaluating `Special Land 'Usepermits.

Staff recommends approval of SLU-2-2011., based upon the findings of fact as outlined in this staffeport, subject to the applicant agreeing, in w-iting, that it will not object to the issuance of liquor

licenses in the area.

FUTURE: As we know the future in unknown to us, however, we do hopeto double in the next three years.

ACTIVITIES: Sunday services 10am to 1 I:30am. Wednesday prayerservice. Friday youth service. During spring and summer we do outsideactivities to help the community with back-to school needs, food baskets,clothes, and whatever other needs we can help the community with. Wehope to provide tutoring in the near future to those who need it, as we havefound. the need is .great and have been able to provide this help on a very lowscale. Our goal is to help families be better, stronger; and provide them witha sense of purpose for their lives through encoura

personnel faith. Theend result of this personnel faith, are families and communities makingbetter choices for the longevity of their life, free from drugs and alcoholabuse, We understand that its not always the case, but for those whocontinue to keep their faith, end up in a better place in life.

The records of the City Assessor indicate that you are an owner of, or party with an interest in, property which isincluded in this proposed special assessment roll. The Principal Shopping District is a public improvementestablished to develop, redevelop and promote economic activity in all zones, and provide for maintenance inZone A. By ordinance adopted by the Lansing City Council, Chapter 1020, Section 1026.08 (a-f), of the Code ofOrdinances, I am directed to provide you with the following information regarding the project:

PUBLIC HEARING INFORMATIONThe City Council will hold a Public Hearing in the City Council Chambers, 10th Floor-City Hall, on

Thursday, July 07, 2011 at 1:30 p.m.

to consider any concerns or objections that there may be with respect to this improvement or the assessment.

APPLICATION FOR NON-PROFIT AGENCIES WITH 501(c)(3) DESIGNATIONApplications for non-profit agencies with 501(c)(3) designations are available in the Lansing Assessor's Office,3rd Floor-City Hall, 124 W. Michigan Ave., Lansing, MI 48933. Applications must be filed in the City Assessor'sOffice no later than August 16, 2011 . Failure to file by the deadline will disqualify your parcel from anassessment reduction prescribed by City Council. An application must be filed for each parcel number. A copyof your status from the Internal Revenue Service must be attached to each application.

APPEAL INFORMATIONAppearance and protest at this hearing is required if you wish to seek further or higher appeal status with theMichigan Tax Tribunal. A property owner, party with interest, or his or her agent, may appear in person at thehearing to protest the special assessment, or they may file his or her appearance by letter delivered to the CityClerk, 9th Floor-City Hall, prior to the close of said hearing. The property owner or any person having an interestin the property subject to the proposed special assessment, may file a written appeal of the special assessmentwith the Michigan Tax Tribunal, 611 W. Ottawa Street, P.O. Box 30232, Lansing, MI 48909 within thirty(30) days after confirmation of the special assessment roll, if that special assessment was protested at thishearing.

The Lansing Planning Board, at a special meeting held on June 23, 2011, voted (5-0) to recommendapproval of the request by the Neogen Corporation to rezone the property at 601 N. PennsylvaniaAvenue from "DM-3" Residential District to "D-1" Professional Office District. The intent of therezoning is to allow the building at this location to be used for administrative offices for the NeogenCorporation.

The Planning Board found, based on testimony, evidence and the staff report that the proposedrezoning would be consistent with the established zoning and land use patterns in the area. Theboard also found that the rezoning would not create any adverse impacts on traffic, the environmentor future patterns of development in the area.

At the Planning Board public hearing held on June 21, 2011, the applicant spoke in favor of therequest and no other comments were received.

COMPLIANCE WITH MASTER PLAN

The Northeast Area Comprehensive Plan, as amended in 1986, designates the subjectproperty for office use. Therefore, the request is in compliance with the land use patternbeing advanced in the Master Plan.

IMPACT ON VEHICULAR AND PEDESTRIAN TRAFFIC

No adverse impacts on vehicular and pedestrian traffic are anticipated to result from theproposed rezoning. Pennsylvania Avenue is a minor arterial that is designed to carry arelatively high volume of traffic. In addition, there is already a strong mix of residential andnonresidential traffic in the area.

The applicant intends to utilize the existing building at 601 N. Pennsylvania for "overflow"office space to support the Neogen operations that are headquartered in the former OakPark Elementary School building located approximately 200 feet northwest of the subjectproperty. The required number of parking spaces will be based upon the amount of usablefloor area in the building. The ordinance requires 1 parking space for each 200 square feetof usable floor area. The existing building has a gross floor area of 836 square feet.Therefore, if 75% of the building will be considered usable floor area, 3 parking spaces willbe required. Required parking spaces must be located either on-site or within 300 feet ofthe site. While the subject property is too small to accommodate 3 parking spaces thatwould meet the dimensional requirements of the Zoning Ordinance, Neogen owns twolarge properties to the west that are well within 300 feet and have ample parking toaccommodate the required parking spaces for this proposal.

Since the property is currently zoned "DM-3" Residential, based upon the lot size 2 2-bedroom apartments would be permitted. The traffic generated by these apartments wouldlikely be equal to or exceed the traffic generated by the proposed office uses.

ENVIRONMENTAL IMPACT

There are no physical changes proposed for the site and therefore, the rezoning willhave no impact on the natural environment.

IMPACT ON FUTURE PATTERNS OF DEVELOPMENT

The request to rezone the subject property to "D-1" Professional Office will not adverselyaffect the land use patterns in the area. There is already a very strong presence of officezoning and land uses in this area. In fact, the property located directly west of the subjectproperty is currently zoned "D-1" Professional Office district and is owned and utilized bythe applicant for this proposal (Neogen Corporation).

The Neogen Corporation has been an excellent neighbor of the east side of Lansing formany years. The company is actively involved in several neighborhood organizations andthe business has had a positive impact on the neighborhoods in which it is located. TheNeogen operations have also proven to be very compatible with adjoining residential uses,as they are low impact uses that do not generate much traffic, noise and other. potentialnuisances. There are several properties owned and operated by Neogen on the east sideof Lansing and most, if not all, are located in predominantly residential neighborhoods.There have been no complaints of noise, fumes, odors, excessive traffic or any other typeof problems.

Neogen is proposing to utilize the building at 601 N. Pennsylvania Avenue for offices whichshould not interfere with the enjoyment of the adjacent residential properties. Office usesin general are considered compatible with residential neighborhoods since they typicallygenerate a low volume of traffic and do not create much noise or other nuisances

SUMMARY

This is a request by the Neogen Corporation to rezone the property at 601 N. PennsylvaniaAve., more specifically described as:

Lot 19, Block 1, Assessors Plat No 7, City of Lansing, Ingham Co., MI

from "DM-3" Residential District to "D-1" Professional Office District. The purpose of therezoning is to allow the building at this location to be used for administrative offices for theNeogen Corporation.

The proposed rezoning is consistent with the land use pattern being advanced in themaster plan and with the zoning and land use patterns already established in the area. Inaddition, no adverse impacts on vehicular and pedestrian traffic, the environment or futurepatterns of development are anticipated to result from approval of this rezoning.

RECOMMENDATION

Pursuant to the findings described above, the following recommendation is offered forthe Planning Board's consideration:

Recommend that Z-1-11 be approved to rezone the property at 601 N.Pennsylvania Avenue from "DM-3" Residential District to "D-1" Professional OfficeDistrict, based on the findings of fact as outlined in this staff report.

ANALYSIS

COMPATIBILITY WITH SURROUNDING LAND USE

The proposed rezoning will have no negative impacts on the surrounding land uses. Thecurrent zoning pattern was an attempt to provide a transition between the residentialzoning to the west and the commercial zoning to the east. The "J" Parking district wascommonly used in the past by the City as a means for limiting the use of specified sectionsof a parcel for parking only. In this manner, a commercial building or commercial activitiesexterior to the building (other than parking) could not be located in proximity to an abuttingresidential use. As evidenced by the attached zoning map, there are a fewl other instancesof this transitional zoning pattern on the east side of N. Larch/N. East Streets, although it isunclear as to why this pattern is only used sporadically along the corridor. In some cases,the elimination of transitional zoning and placement of commercial buildings and activitiescloser to a residential district could have a negative impact on these neighboring uses. Inthis case, however, the area of the site to be rezoned is adjacent to Gier Park as opposedto a residential use. The proposed rezoning will have no negative impacts on Gier Park.Any construction on the area of the site currently zoned "J" Parking will be required tomaintain a 20 foot building setback from the west/rear property line. Furthermore, thesubject property is the only commercial property that adjoins Gier Park that includes the "J"Parking transitional strip along its west border. Therefore, the proposed rezoning willactually eliminate an inconsistency in the zoning pattern in this area.

ENVIRONMENTAL IMPACT

There are no negative environmental impacts anticipated from this request.

IMPACTONPUBLICFACILITIES:

The subject property is currently served by all necessary utilities. Any future constructionwill require site plan review at which time the adequacy of the utility systems toaccommodate the proposed development will be evaluated.

IMPACTON FUTURE PATTERNS OF DEVELOPMENT

The proposed rezoning is not anticipated to have any negative impacts on future patternsof development in the area. The rezoning will eliminate a spot zone of "J" Parking whichmake will make the property more consistent with the zoning pattern that has already beenestablished in the area. In this particular case, the "J" Parking district serves no purposeas a transitional zone, as described above, since the area of the site that is zoned "J"Parking adjoins Gier Park rather than a residential use. Furthermore, none of the otherproperties in this area that adjoin Gier Park have a "J" Parking buffer.

SUMMARY

Pursuant to the findings described above, the following recommendation is offered forthe Planning Board's consideration:

Recommend that Z-2-11 be approved to rezone the portion of the property at 2331N. Larch Street that is currently zoned "J" Parking District to "F" Commercial District,based on the findings of fact as outlined in this staff report.

The Planning Board, at its meeting on June 23, 2011, voted unanimously (4-0) to recommend thedistribution of the Design Lansing Comprehensive Plan draft to neighboring jurisdictions (e.g. City ofEast Lansing; Lansing, Delta, Meridian Twps.); railroads; and utilities, in accordance with theMichigan Planning Enabling Act (P.A. 33 of 2008). Section 41 of this statute (attached) requires thatmunicipalities distribute draft copies of the proposed plan to adjacent jurisdictions for their review andcomment.

Authorization for distributing this draft must come from Council. Upon their approval, we will sendthose contacts a letter as required, with the web link (www.designlansing.net) for the plan. This willbegin their 63 day review & comment period, during which the Planning Board can discuss the MasterPlan draft and take public comments at its meetings prior to recommending adoption.

We are preparing the mailing list with the assistance of Tri-County Planning Commission, and willdistribute the Plan upon receiving authorization to do so.

Following your review of this item, please forward it to City Council for their consideration.

BY RESOLVED BY THE CITY COUNCIL OF THE CITY OF LANSING

RE: Distribution of Design Lansing Comprehensive Plan draft to neighboringjurisdictions.

WHEREAS, Section 41 of the Michigan Planning Enabling Act (P.A. 33 of 2008)requires that municipalities distribute draft copies of their proposed comprehensive plansto adjacent jurisdictions, railroads and utilities during the process of adoption; and

WHEREAS, these entities have a 63 day period for review and comment on the DesignLansing Comprehensive Plan draft; and

WHEREAS, the Planning Board considers those comments received prior torecommending the Plan for adoption; and

WHEREAS, the draft Plan is available on the web at www.designlansing.net, andPlanning Board intends to discuss the Master Plan draft and take public comments at eachof its meetings before recommending adoption; and

WHEREAS, the Planning Board, at its meeting on June 23, 2011, voted unanimously (4-0) to recommend the distribution of the Design Lansing Comprehensive Plan draft toneighboring jurisdictions (e.g. City of East Lansing; Lansing, Delta, Meridian Twps.);railroads; and utilities, in accordance with the Michigan Planning Enabling Act (P.A. 33of 2008); and

WHEREAS, distribution of the draft Plan is a step in the plan adoption process, and doesnot constitute adoption of the Plan; and

WHEREAS, the Committee on Development and Planning has reviewed therecommendation of the Planning Board and concurs therewith;

NOW, THEREFORE BE IT RESOLVED, that the Lansing City Council herebyauthorizes the distribution of the Design Lansing Comprehensive Plan draft toneighboring jurisdictions, railroads, utilities, and any other entities, as required by theMichigan Planning Enabling Act (P.A. 33 of 2008).

MICHIGAN PLANNING ENABLING ACT (EXCERPT)Act 33 of 2008

125.3841 Preparation of proposed master plan; submission to legislative body for review andcomment; approval required; notice; submission of comments; statements as advisory.Sec. 41. (1) After preparing a proposed master plan, a planning commission shall submit the proposed

master plan to the legislative body for review and comment. The process of adopting a master plan shall notproceed further unless the legislative body approves the distribution of the proposed master plan.

(2) If the legislative body approves the distribution of the proposed master plan, it shall notify the secretaryof the planning commission, and the secretary of the planning commission shall submit, in the mannerprovided in section 39(3), a copy of the proposed master plan, for review and comment, to all of thefollowing:

(a) For any local unit of government proposing a master plan, the planning commission, or if there is noplanning commission, the legislative body, of each municipality located within or contiguous to the local unitof government.

(b) For a county proposing a master plan, the regional planning commission for the region in which thecounty is located, if any.

(c) For a county proposing a master plan, the county planning commission, or if there is no countyplanning commission, the county board of commissioners, for each county located contiguous to the county.

(d) For a municipality proposing a master plan, the regional planning commission for the region in whichthe municipality is located, if there is no county planning commission for the county in which that local unitof government is located. If there is a county planning commission, the secretary of the municipal planningcommission may submit a copy of the proposed master plan to the regional planning commission but is notrequired to do so.

(e) For a municipality proposing a master plan, the county planning commission, or if there is no countyplanning commission, the county board of commissioners, for the county in which that municipality islocated. The secretary of the municipal planning commission shall concurrently submit to the county planningcommission, in the manner provided in section 39(3), a statement that the requirements of subdivision (a)have been met or, if there is no county planning commission, shall submit to the county board ofcommissioners, in the manner provided in section 39(3), a statement that the requirements of subdivisions (a)and (d) have been met. The statement shall be signed by the secretary and shall include the name and addressof each planning commission or legislative body to which a copy of the proposed master plan was submittedunder subdivision (a) or (d), as applicable, and the date of submittal.

(f) For any local unit of government proposing a master plan, each public utility company, railroadcompany, and public transportation agency owning or operating a public utility, railroad, or publictransportation system within the local unit of government, and any government entity that registers its nameand address for this purpose with the secretary of the planning commission. An entity described in thissubdivision that receives a copy of a proposed master plan, or of a final master plan as provided in section43(5), shall reimburse the local unit of government for any copying and postage costs thereby incurred.

(g) If the proposed master plan is or includes a proposed master street plan, the county road commissionand the state transportation department.

(3) An entity described in subsection (2) may submit comments on the proposed master plan to theplanning commission in the manner provided in section 39(3) within 63 days after the proposed master planwas submitted to that entity under subsection (2). If the county planning commission or the county board ofcommissioners that receives a copy of a proposed master plan under subsection (2)(e) submits comments, thecomments shall include, but need not be limited to, both of the following, as applicable:

(a) A statement whether the county planning commission or county board of commissioners considers theproposed master plan to be inconsistent with the master plan of any municipality or region described insubsection (2)(a) or (d).

(b) If the county has a county master plan, a statement whether the county planning commission considersthe proposed master plan to be inconsistent with the county master plan.
