(f) any correspondence between the Minister for Transport or the Department of Transport and Transport for NSW in relation to tendering of Sydney metropolitan bus service contracts; and

(g) any document that records or refers to the production of documents as a result of this order of the House.

Transport for NSW has reviewed its relevant files for the purposes of determining whether it holds any documents, other than Cabinet documents, that fall within the terms of the Resolution. I note all agencies are obliged to protect the confidentiality of Cabinet documents and not produce or refer to any such documents in complying with the Resolution.

Enclosed with this letter are the documents which Transport for NSW produces in response to the Resolution. Transport for NSW has prepared, in accordance with Standing Order 52, an index of the documents produced.

BASIS FOR CLAIMS OF PRIVILEGE

Office of the Minister for Transport

Order for papers (17 October 2013)- Sydney Metropolitan Bus Contracts

Privilege has been claimed on the basis of public interest immunity in respect of documents, the disclosure of which is covered by Parliamentary Privilege.

PARLIAMENTARY PRIVILEGE

The documents in this category are subject to public interest immunity by reason of falling into the limb of Parliamentary Privilege as it is to be conclusively presumed that there is an overriding public interest against the disclosure of government information prepared in confidence to a Minister of the Crown by their officers because:

1. The documents are House Folder Notes and are confidential documents that were prepared, or contain or record a confidential communication between the Minister for Transport and her department- Transport for NSW for the dominant purpose of being provided advice to the Minister in the Parliament.

2. The documents have been prepared for Parliamentary debate or questions on notice, and any disclosure would infringe the privilege of Parliament.

3. House Folder Notes have been recognised under the Government Information (Public Access) Act 2009 as documents that attract public interest immunity under the limb of Parliamentary Privilege and the principle was accepted by Austin J in Opel Networks Pty Ltd (in Liq) (2010) 77 NSWLR 128 at [118].

BASIS OF PRODUCTION

The Office of the Minister for Transport produces these documents under compulsion of law and is not wavering privilege in respect of the privileged documents by producing them.
