Greetings from your LIBA Board Chair!

Southeast Community College (SCC)SCC has plans for a $369 million bond issue which would build a new $75 million campus near the new Telegraph District development in Lincoln. The bond would also build a new $125 million

campus in Beatrice, would provide $89 million in funding to Milford for new facilities, renovations to existing facilities on all campuses, and provide 6 learning centers across the 15 county territory that SCC serves.

SCC plays a vital role in educating students for careers in skilled trades, and also is a more affordable “prep” school for those seeking to transfer credits in some core classes in route to a 4-year degree.

Currently SCC owns property at 88th & O St, its main Lincoln campus, the Education Square in Downtown Lincoln (formerly Energy Square and the Centrum), and the Jack Huck Continuing Education Center, 301 S 68th St (formerly SRI/Gallup).

I don’t question the educational goals and the desire to reinvest across the territory to please all constituents, but I do wonder if anyone is taking a fiscally conservative and responsible look at how the tax dollars are spent. The $369 million bond issue appears to be everything on SCC’s wish list. If these funds were available, SCC could have every new facility and every renovation desired.

Dear LIBA Members:Is SCC fully utilizing available space? There are non-SCC tenants in the Education Square facility downtown currently. The Career Academy which launched in 2015 as a joint venture with LPS has rooms that aren’t fully utilized after LPS hours. Currently SCC has a 2-year waiting list for students interested in a career in welding. Why can’t these students be trained in the Career Academy space after LPS students have vacated?

Is a new Lincoln Campus feasible? The plans for the campus in the Telegraph District will require rezoning of park ground and the elimination of the Lewis baseball fields. Is a new campus in Lincoln cost effective, as compared to expanding on the existing 88th & O campus? If space closer to UNL campus is considered critical, have other unused spaces been explored?

Is a new campus in Beatrice a sound investment? Plans call for spending $125 million on a campus that houses 1,200 – 1,400 students. That’s $89,285/student at 1,400 students. Enrollment is currently smaller than any Lincoln Public High School. The new campus would have capacity for 2,000 students. While facilities may be beyond their useful life in Beatrice, there must be more cost effective alternatives. There are large manufacturing facilities in Beatrice that are vacant.

I have more questions than answers on this matter. We want to support SCC in its educational role, but they need to educate the public on the demand and the need to spend $369 million on facilities before voters approve a 30-year tax increase.

The new federal minimum salary for employees to be exempt from overtime pay is going to go into effect any day now. Is your business ready for this momentous change? The new salary threshold rule will amend the federal Fair Labor Standards Act (FLSA) regulations. The rule will raise the current salary threshold of $455 per week (about $23,600 per year) to an anticipated

$970 per week (about $50,000 per year) for exempt (salaried) employees.

This rule requires employees earning less than the new salary amount (about $970 weekly) must be paid overtime after working over 40 hours in a work week. An employee classified as non-exempt must track all hours worked. The minimum hourly rate of pay in Nebraska is currently $9 per hour.

Businesses should evaluate their workforce to identify any employee who earns less than $970 per week and is classified as exempt (e.g., not paid overtime). In addition to recording daily hours worked, these employees will need to be paid at least $9 per hour and at least 1½ times their regular hourly rate for all overtime hours.

Some of the options available to deal with this change include: increasing an exempt employee’s pay to satisfy the new salary threshold, initiating a fluctuating week pay plan, hiring additional employees to alleviate the need for current employees to work overtime, and converting salaried employees to hourly pay. The disadvantages of hiring more employees include a likely reduction in pay for current employees and/or increased labor cost to the company. If a business decides to convert exempt employees from salaried to non-exempt hourly, the business should also decide whether to allow or prohibit overtime. An employer may prohibit employees from working over 40 hours per week and

discipline an employee for working overtime, but the employee must nonetheless be paid for all overtime hours worked.

The new regulation allows employers to adjust the salaried employee’s pay from salary to hourly so the employee will receive the same amount of pay for the same amount of hours worked. In order to accurately convert an employee from exempt-salaried to non-exempt hourly, a business will need to know about how many hours the employee currently works each week. The following is an example of the calculation: Current salary for exempt employee: $35,0132,080 hours worked per year (40 hours per week x 52 weeks)460 hours overtime allocated for employee (46 weeks x 10 hours overtime per week) 460 hours overtime x 1.5 (rate required for overtime) = 690 regular (straight time) hours

2,080 regular hours + 690 regular hours = 2,770 straight hours

$35,013 ÷ 2,770 total hours = $12.64 new hourly rate$12.64 x 2,080 hours = $26,291.20 regular pay$18.96 x 460 overtime hours = $8,721.60 overtime pay

With successful conversion, the company may avoid increased labor costs and reducing a current employee’s rate of pay. LIBA members should consider requiring their exempt salaried employees paid less than the new $50,000 annual salary to track their hours worked now to allow for an accurate conversion calculation based on anticipated overtime hours. Get ready, the new rule is expected to become effective any day.

A friend of mine just started an important new job in Chicago as the Director of Government Affairs for a medium-sized business. Like any of us would be, she was very excited about her move and the new opportunity. As her friend and an employment law attorney, can you guess what was the first question I asked her?...

Of course, I questioned whether her employer gave her a thorough, written job description, with enough information to ensure she would succeed at the new job. I wanted to make sure she had a clear indication of the metrics her performance would be critiqued and graded. Did she have an adequate description of the daily and long-term expectations for her new career? Further, if someone requested she change or expand her job description, from whom should she seek confirmation?

In my friend’s case, the Company had only discussed the position with her and placed the advertisement she had responded, which contained a fairly elementary description of the position. I was not surprised she was never provided a thorough, written job description prior to accepting. Many employers do not do a good job providing information and feedback to employees on what is really important to them, a risk to employer and employee.

One of the many reasons employees sue their employers after termination is because they were surprised. They speculate whether it was connected to an unlawful reason, like their gender or age, because an employer has done a terrible job communicating regarding the essential functions of the job

and their perception the employee failed to meet them. Sometimes other employees have given them incorrect instructions. Without thoughtful direction, or with conflicting direction from other employees, an employee may mistakenly believe he or she is doing a good job up until the day the employee is terminated. This is unfortunate because often bad habits can be corrected and hiring and training new employees is expensive.

A well-written job description, which incorporates all the essential functions of a job, describes the process for regular evaluations, and informs the employee of the office hierarchy is good for the employee. Job candidates must know the essential functions of a job so that they can determine whether they can meet them, with or without a reasonable accommodation, and a clear job description should generally be developed and provided to candidates prior to hiring for the position.

Further, smart employees should request and smart employers should demand regular performance reviews, while reviewing their job descriptions, as part of an ongoing performance evaluation, to ensure all the parties are in like mind on how the team is performing. A 360 degree interview.

If you have an employer who has not provided you a written job description or has never reviewed it with you as part of an employee evaluation, you should request one. You might be surprised by what you learn.

Message from the School Liaison Committee ChairBy Coby Mach

The following letter was submitted by the Chair of LIBA’s School Liaison Committee and I wanted to share it here. Enjoy!

Last week, the Lincoln Journal Star Editorial Board wrote that the decision by the Lincoln Public Schools Board of Education last fall to place $10 million of unneeded tax money into a savings account demonstrated “prudence” as the district looks poised to avoid funding shortfalls heading into the budget session this summer. The Editorial Board praised setting aside this $10 million for its

ability to address a “somewhat less than $2.6 million decrease” in state aid funding expected this year, and criticized groups like the Lincoln Independent Business Association (LIBA) for suggesting that taking $10 million was too much. Simple math suggests that the Editorial Board’s criticism may be too strong, considering that placing $10 million in savings is nearly four times the amount needed to meet a projected $2.6 million shortfall. But the point that it is important for the district to have sufficient reserves to cover potential shortfalls is well-taken.

LIBA is glad to see that the district is in solid financial condition. As we consider future budgets, though, LIBA will continue to call on members of the School Board to look for ways to provide tax relief when possible and warranted. And with the passage of a couple of education spending bills in the Nebraska legislature this year, we are happy to say that the School Board might have more opportunities to offer property taxpayers some relief.

One of LIBA’s priority bills this year was LB 959, which changed provisions of the formula that determines how much state aid schools receive. In the past, LPS has been hesitant to reduce its tax levy because doing so may result in lost state aid under the formula. LB 959 will make it so that LPS could lower its tax levy without affecting the amount of state aid it receives. This should have the beneficial result of freeing Board members from the fear of losing state aid if they provide property tax relief in the future.

Another of LIBA’s priority bills was LB 930, which replaced NeSA’s state-specific tests for high school juniors with a college entrance exam such as the ACT or SAT. This bill will have the benefits of reducing the number of tests students must miss class time to take and opening up new opportunities to pursue higher education, while also providing teachers, administrators, parents, and the public with understandable metrics by which to measure the success of our schools.

With these important policy changes being implemented at the state level, LIBA believes its efforts at the Capitol will result in major benefits to the LPS Board and to Lincoln taxpayers moving forward. Make no mistake, LIBA is glad to see LPS avoid the financial situations faced by other school districts in our state. But to suggest that maximizing taxes year after year is the only way to avoid such situations is disingenuous and irresponsible in light of the fiduciary duty School Board members have as stewards of public tax dollars. As taxpayers and parents, LIBA members are committed to continuing to work with LPS and state officials to find ways to ensure the success of our students while also promoting the responsible use of our hard-earned tax dollars.

Public Relations CommitteeThe Public Relations Committee began discussing a potential LIBA website update and considered some design and content options. Over the next few months, the Committee will continue to discuss whether the liba.org website can and should be updated. Any updates would be made with the hope of increasing the marketing functionality of the website for new members, and increasing the ease of use for finding updates on events and on policy activity. The Committee also considered ways of promoting LIBA’s legislative success this year, which saw the passage of two of LIBA’s priority bills.

Legislative Action CommitteeThe Legislative Action Committee this month considered the creation of a list of city legislative priorities. For years, LIBA has created and promoted a legislative agenda for policy positions or changes to promote on the state level during the Unicameral’s legislative session. The Committee has determined that taking the same approach to city issues may be worthwhile. A number of potential items to be included on the list of priorities was discussed at length. The Committee members determined to review the list individually and produce a priority order, ranking them from highest to lowest. At the May meeting, the Committee will review this ranking and determine which priorities to send to the LIBA Board of Directors for consideration. Aside from the city priority conversation, the Committee also discussed the highlights of the recent legislative session. LIBA saw two of its priority bills pass and recieve approval from Governor Ricketts. LIBA was also

successful in stopping a number of bills from moving forward, and was able to get some important bills amended to be more favorable for Lincoln taxpayers. The Committee also heard a report of the interim studies a few senators have introduced at LIBA’s request, and will hear a presentation in the near future about the legislative studies to be conducted this summer that will impact taxpayer and business interests.

Budget Monitoring CommitteeThe Budget Monitoring Committee heard a presentation from representatives of Southeast Community College about the proposed bond issue they may ask voters to approve this fall. The total bond amount is $369 million and includes the construction of a new campus in Lincoln’s downtown telegraph district, as well as improvements to the East O Street campus and the Beatrice campus. The bonds would be paid back over a 30-year period. The tax levy to cover the bonds would be 3.9 cents per $100 of property valuation. This means that someone who owns a home worth $150,000 would need to pay about $59 each year in additional property taxes. Following the presentation, the Committee discussed the proposal and determined to send a follow-up letter to SCC to answer some additional questions raised during discussion.

School Liaison CommitteeThe School Liaison Committee toured the new Career Academy this month and received an update on the enrollment and success of the Academy since opening last fall. Reports across the board seem to be positive, with a number of kids expressing interest. The Academy will grow in numbers

as of this upcoming fall. Some of the most popular programs include the health care professionals career track and the business track. During May, the Committee will tour the LPS Baccalaureate Program at Lincoln High.

Bizco BiznetLIBA’s May Bizco Biznet will be hosted by Culinary Underground at 803 Q Street on Thursday, May 12th, 2016, from 4:30 to 6:30 p.m. Drinks and hors d’oeuvres will be served. This event is open to all LIBA members and their guests. Bring a friend and enjoy some great food, drinks, and networking!

GP Customs Coffee & ContactsVon Minden Wealth Solutions of Raymond James will host LIBA members at their location at 8700 Executive Woods Drive, Suite 300, for our GP Customs Coffee and Contacts on Tuesday, May 24, 2016, from 7:30 to 9:00 a.m. This networking event is free to attend. Bring a guest and come enjoy coffee and company.

LIBA LuncheonThis month’s LIBA Luncheon is scheduled for Tuesday, May 17th, 2016, at the Holiday Inn Downtown. Our speakers will be Blake Lawrence and Adi Kunalic of opendorse, an online platform that connects marketers with athletes to build endorsement campaigns. We will also be announcing our 2016 LIBA Free Enterprise Scholarship winners. Lunch is $12, begins at 11:30 a.m., and is served buffet style. If you do not wish to eat, the luncheon is free and open to the public. Parking is also free in the Holiday Inn parking garage as long as it is available.
