F.I.R.P.T.A. is an acronym for Foreign Invest-ment in Real Property Tax Act. Now what does it mean? If you are buying a property from an owner that is not a US citizen or a US residentAlien then you may be subject to F.I.R.P.T.A. Tax. In Arizona on the Ari-zona Residential Real Estate Contract you will !nd a section in the contract that reads: “Seller agrees to comply with the IRS report-ing requirements. If applicable, seller agrees to complete, sign, and deliver to Escrow Company a certi!cate indicating whether the seller is a foreign person or a nonresident alien pursuant to the Foreign Investment in Real Property Tax Act (“FIRPTA”). Buyer and seller acknowledge that if the seller is a foreign person, the buyer must withhold tax equal to 10% of the purchase price, unless an exemption applies.”Now that 10% would be due to the IRS with-in 20 days of closing. "e only way around that would be if PRIOR to closing the IRS re-ceives all thedocumentation necessary to re-view for request of a withholding certi!cate. A withholding certi!cate would be issued only if the IRS feels there is no tax liability, example of this would be due to loss at sale. Otherwise if that money is not in the IRS’s hands on that 20th day there will be penal-ties and late fees added to the 10%. "is is really a very costly oversight if it is not dis-closedand handled properly. Another way toavoid this tax withholding would be if one of the Ten Exemptions to withholding apply. Otherwise you must follow the IRS guide-lines in paying this tax. Your best resource should you !nd yourself in a situation where you have to address FIRPTA tax is the IRS web page www.IRS.gov. All the informa-tion and forms are right at your !nger tips and they come with detailed instructions. "e forms on this IRS web page are also

designed to be !llable so you can keep them neat and clean. My last bit of advice is to always con-sult your tax professional when you have to deal with any tax issue.

If you use the phone book and choose a Realtor from the yellow pages, you probably couldn’t make a better decision than if you used the telephone book to choose a brain surgeon.When you tell anyone that you want to purchase a house, you will be surprised at the number of real estate people who want to represent you. Agents come out of the thin air. Perhaps you, like me, thought we’d never again see the kind of madcap competition to buy homes that was common in the housing boom. I’m thinking of lotteries, not to win a home but just a chance to buy one. I’m remembering bidding wars and home shoppers so desperate to buy that they’d camp overnight outside new subdi-visions to be !rst in the door the next day. Never say never.In some parts of the country, this kind of red-hot competition for homes, especially new homes, is back. Boom-era respons-es like camping in line overnight, home-builder lotteries and buying homes sight unseen are making a reappearance. "at’s how intensely demand is rising in some cities.So far, this the new run-up in prices is con!ned to a handful of cities and regions, particularly coastal California markets, Phoenix and Tucson, Las Vegas, Denver, Boston, Seattle, Portland, the Washington, D.C. metro and several Florida markets.Authors of the CoreLogic Case-Shiller Home Price Index say prices rose nation-ally 7.3% in 2012 and could jump an addi-tional 3% this year.In Silicon Valley, few jaws drop any-more when a nice-but-nothing-special 986-square foot Palo Alto cottage like list-ed at $1.25 million, inspires 20 o%ers and sells for $1.73 million. Nearby, in the only slightly less-expensive town of Sunnyvale,

50 or so eager, pre-quali!ed home shop-pers began camping out overnight for a chance to buy newly completed units in a 228-unit condo development.To inject more fairness -- and less dis-comfort-- into the buying process, many builders revived the boom era practice of holding lotteries that gave winners the chance to buy. SMOKED & PULLED PORK NACHOSINGREDIENTS:Pulled pork (recipe below) 1 cup pico de gollo1 cup block bean puree 1 cup sour cream(recipe below) 8 oz. jock cheese12 corn tortillas, fried 4 sprigs cilantro1 cup guacamole

PULLED PORKIngredients:2 oz. applewood chips 2 cloves garlic. whole(soaked in water for 1 shallot, whole30 minutes) 5 sprigs thyme2 lbs. pork butt I bay leafTo taste salt and pepper 1 /2 cup light beerI carrot, diced 1 cup orange juice1 sweet onion, diced

Prepare the Pulled Pork:Preheat oven to 275 degrees. Season the pork butt with salt and pepper. Using a stove-top smoker on high heat. place the soaked wood chips in the bottom of the pan. Place the pork on the rack, cover and smoke for 30 minutes. In a saute pan, saute the carrots, onion, garlic and shallot until soft. Add the beer and orange juice and bring to a simmer.

Place the smoked pork butt into a braising pan and cover with the onion mixture. Add the bay leaf and thyme. Cover with aluminum foil and cook for four hours. Remove from the oven. allow to cool and shred the pork. Pour some of the braising liquid on the pork to keep it moist.

BLACK BEAN PUREEIngredients:1/2 lb. dry black beans 1 tsp. cuminpreferred (or one con) 1 jolopeno, diced1 red onion, diced To taste salt and pepper1 bunch cilantro

Prepare the Black Bean Puree:Place the black beans in a container and cover with water. Soak overnight. Remove the beans from the water and place in a large pot. Cover with fresh water. Add the onion. cilantro, cumin, jala-peno and a little salt. Cook until the beans are tender. Using a hand-held mixer, puree the beans until they are smooth. Season with salt and pepper.

On the bottom of the plate, make a round circle of the black bean puree. Driule sour cream across the plate. Starting with the crispy corn tortilla, spread the guacamole on it. Place pork on top and sprinkle with the jock cheese and pico de gallo. Repeat with two more tortillas. Stack all three tortillas one on top of the other, and place in the center of the plate. Garnish with more cheese, pico de gallo and a cilantro sprig. Serves: 4
