    Chairman Porcari called the meeting of the Maryland TransportationAuthority to order at 9:22 a.m.At 9:22 a.m., motion was made by Mr. Whitson and seconded by

    Mr. Marks, with unanimous approval of the members, to move into ClosedSession pursuant to Section 10-508 (a) of the State Government Article of theAnnotated Code of Maryland to: (5) to consider the investment of public funds(toll revenue bond sale, ICC cash flow update; (6) to consider the marketing ofpublic securities (toll revenue bond issuance review, acquisition of surety policyand ICC cash flow update); (7) to consult with counsel to obtain legal advice(Daisy Concrete, Inc. of Maryland v. Maryland Transportation Authority et al); (8)to consult with staff, consultants, or other individuals about pending or potentiallitigation (Daisy Concrete, Inc. of Maryland v. Maryland Transportation Authority,et al); and, (10) to discuss public security, because the Authority determined thatpublic discussion would constitute a risk to the public or to public security,including: (i) the deployment of fire and police services and staff (security andpolice update).

    (At 9:31 a.m., Rev. Dr. Calhoun arrived at the meeting).ACTION TAKEN DURING CLOSED SESSION

    The following action was taken during closed session: Toll Revenue Bonds - Debt Service ReserveUpon motion by Ms. Hoblitzell and seconded by Mr. Lewin, membersunanimously approved the acquisition of surety policy to substitute for bondproceeds for the final debt service reserve.At 9:38 a.m., motion was made by Mr. Basso, seconded by Rev. Dr.

    Calhoun, and unanimously approved, to move to Open Session.

    RATIFICATION OF ACTION TAKEN DURING CLOSED SESSIONUpon motion by Mr. Marks and seconded by Mr. Basso, membersunanimously ratified the above-recorded action taken in Closed Session.

    AVI DECALS - THOMAS J. HATEM MEMORIAL BRIDGEUpon motion by Mr. Woodford and seconded by Mr. Marks, membersunanimously approved the renewal of the AVI decals at no cost to the customersduring the redecking of the Thomas J. Hatem Memorial Bridge. This

    commitment was made by the previous Maryland Department of TransportationSecretary Robert Flanagan during the 2006 legislative session. Approval iscontingent upon the acknowledgement in writing by the affected delegates andsenator that this period of cost-free renewal is temporary and will end at thecompletion of the Hatem Bridge redecking project. The Authority will finalize thenecessary operational details for the implementation of this proposal.APPROVAL OF OPEN AND CLOSED SESSION MINUTES

    Upon motion by Ms. Hoblitzell and seconded by Rev. Dr. Calhoun,members unanimously approved the Open and Closed Session minutes of boththe February 26,2008 meeting, as amended, and the conference call Authoritymeeting of March 12, 2008.DECLARING PROPERTY EXCESS TO THE AUTHORITY'S NEEDS ANDRECOMMENDING A DONATION

    Mr. McMullen presented this agenda item for member approval. TheMaryland Transit Administration has requested donation of one dump salt truckfrom the Authority's out-of-service vehicles. The City of Havre de Grace PoliceDepartment has requested to purchase the body armor of a Authority policeofficer who is beginning employment with the City of Havre de Grace PoliceDepartment.

    Upon motion by Rev. Dr. Calhoun and seconded by Mr. Marks, membersunanimously declared the dump salt vehicle and the body armor to be excess tothe Authority's operational needs and recommended the donation of the truckand the sale of the body armor as proposed.CONTRACT NO. 10431234 - PROPERTY MANAGEMENT AND LEASINGAGENT SERVICES

    Mr. Freeland presented this agenda item for member approval. TheAuthority is engaged in a four-year contract with Manekin, LLC, the companyresponsible for managing the Point Breeze headquarters building. The propertyand facilities being managed under this contract no longer includes privatetenants or leaseholders; the contract specifications have been adjusted to reflectthose changes. Approval is requested to exercise the first of two, one-yearrenewal options and modify the existing contract by deleting the services forleasing agent and tenant services. This contract modification option exercisewill require approval of the Board of Public Works.

    Upon motion by Mr. Woodford and seconded by Mr. Whitson, membersunanimously approved, as modified, the first of two, one-year renewal options

    Ms. Moran provided an overview of proposed legislatlon that possiblycould directly impact the Authority:SB 182 Bonding Authority

    Status: Different amended bills have passed the House andSenate. The Senate would not accept the Houseamendments and has appointed conference committeemembers (Curry, DeGrange, Kasemeyer).

    SB 538 Maryland Transportation Authority - Fixing or RevisingTolls - Legislative Approval Required.Status: Bill reported unfavorably by the Senate Budget andTaxation Committee on March 12.

    SB 301/HB 364 Procurement - Small Business Reserve Program-Eligibility Modifications.Status: Bills reported out of House and Senate; nowbeing considered in other houses. Passage likely.

    HB 349 State Government - Open Meetings - Votes of a PublicBodyStatus: Bill reported unfavorably by House Health andGovernment Operations Committee on March 20.

    HB 769 Maryland Transportation Authority - CompositionStatus: The House Environmental Matters Committeereported the bill unfavorably on March 22. ChairmanPorcari sent letters to sponsors concerning futureappointments.

    HB 793/SB644 Baltimore Regional Transportation Authority Study TaskForceStatus: Bill reported unfavorable by House EnvironmentalMatters Committee.

    Status: Heard in both houses. Senate Finance Committeereported the bill unfavorably on March 25. No action on theHouse bill.

    HB 1380 Maryland Transportation Authority - Intestate 95 Study -JurisdictionStatus: Withdrawn by sponsor.Intercounty Connector -Impact on GlobalWarming -StudyStatus: Reported unfavorably by House EnvironmentalMatters Committee on March 20.

    Members will continue to be updated.INVESTMENT GROUP SUMMARY

    Mr. Garman reported on the progress and continuing work on variousaspects of the Investment Group. The Investment Group was created to focuson issues with the Authority's investment management process. Ms. Hoblitzellnoted that real progress has been made, particularly in light of the more

    conservative approach to the Authority's investments and the focus on thesecurity of the Authority's principal. This item was presented for information only.Members will continue to be updated.LONG RANGE CAPITAL NEEDS STUDY

    Mr. Simpson presented the Long. Range Capital. Needs Study (LRCNS) formember information only. The report was previously shared with the Financeand Capital Committee members. The LRCNS provides a financially concisesummary of capital needs over the next 2.0years including the six-yearConsolidated Transportation Program (CTP) and is used to determine additionsand/or revisions in the development of the annual CTP.. Plans are to update thestudy next year.REPORT OF COUNSEL

    Ms. Donohue presented the Report of Counsel to members for theirinformation. She reported that a hearing on the defendant's Motion for Recusa1and for Reconsideration of Motions Denied on December 12, 2007 in the case ofMaryland Transportation AuthorityPolice Lodge 34 and the F.O.P., et al v. Stateof Maryland,. et al will be held on March 31, 2008 in the Circuit Court forBaltimore County.laTTA ANNUAL MEETING OVERVIEW

    Mr. McMullen provided a brief overview on the International Bridge Tunneland Turnpike Association's (IBTTA)'s 2008 annual meeting .. The MarylandTransportation Authority will host the 76th Annual Meeting and Exhibition atBaltimore's Marriott Waterfront Hotel September 20 through September 24,2008. Mr. McMullen wlll continue to update the chairman and members on theirrole as the program/schedule develops.EXPRESS TOLL LANE (ETL) PRESENTATION

    Mr. LaBella, the Authority's Express Toll Lane (ETL) project manager,provided an overview of the ETL project. The overview included a description ofthe project, progress and timetine as well as a video simulation. Following thepresentation, members toured the ETL project.Mr. Curt EspOSito, director of operations, advised members that he will beretiring from the Maryland Transportation Authority effective April 30, 2008.Members thanked Curt for his dedication and commitment to the Authority. MsHoblltzell suggested that an exit interview be arranged. Executive Secretary RonFreeland indicated that Mr. Esposito has agreed to assist the Authority on aconsulting basis when he becomes eligible to do so.

    There being no further business, the meeting of the MarylandTransportation Authority was adjourned, by general consensus, withoutobjection, at 10:40 a.rn. upon motion by Rev. Dr. Calhoun and seconded by Mr.Basso.

    The next meeting of the Maryland Transportation Authority will be held onWednesday, April 23,2008 at 9:00 a.rn. at the Point Breeze Complex in themember conference room.

    A luncheon to honor former Authority member Carolyn Peoples will followthe meeting ..
