AMERICAN CONSERVATIVE UNION’S 2015 Ratings of Massachusetts

Dear Fellow Conservatives,

I am pleased to present the American Conservative Union Foundation’s ratings for the 2015 meeting of the Massachusetts Legislature. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Massachusetts legislators with the strongest scores voted most consistently with the ideals articulated in the US Constitution: limited and transparent government, individual rights, personal responsibility, and a healthy culture.

The 2014 election completed a political transformation that began in 2010 and resulted in voters of almost half the states, 23 in all, entrusting Republicans with the governorships as well as control of both chambers in the respective state, the biggest sweep since the first half of the 20th Century.

By examining all our State Ratings (which cover a wide variety of issues) we can see which states have best used their Republican majorities to apply conservative principles, how others have struggled, and in yet other states, how conservatives have stood up against liberal majorities. I know that this guide will provide you with the most comprehensive evaluative tool to learn how your legislators measure up.

1. S 6 Tarr Amendment Government Transparency. The Tarr amendment to the Rules of the Senate requires that budget spending reports include a report on how much spending relies on one-time revenues and the nature and amount of relied on federal revenues relied. The amendment also requires that a proposed tax increase be posted on the Senate website 7 days prior to voting. ACU supports reforms that increase transparency to taxpayers and supported this amendment. The Senate defeated the amendment on January 21, 2015 by a vote of 7-31.

2. H 2017 Tarr Amendment Regulatory Reform. The Tarr amendment to the joint rules of the House and Senate requires each committee to review the cost-effectiveness of administrative regulations and programs to determine if they should be curtailed or eliminated. ACU supports regulatory reform and supported this amendment. The Senate defeated the amendment on February 12, 2015 by a vote of 6-30.

3. H 3401 Fattman Amendment Death Tax Repeal. The Fattman amendment to the appropriations bill repeals the estate tax in Massachusetts. ACU supports the repeal of this unfair tax – known as the Death Tax – which hits small businesses and farms the hardest, and supported this amendment. The Senate defeated the amendment on May 19, 2015 by a vote of 7-31.

4. H 3401 Amendment Education Tax Credits. This amendment to the appropriations bill increases the exemption for tax credits to help save for a prepaid tuition plan or college savings program. ACU supports tax relief to help pay for education and supported this amendment. The Senate defeated the amendment on May 19, 2015 by a vote of 11-27.

5. Taxpayer Funded Abortion. The Senate voted on the Governor’s recommended $600,000 cut to a $5.6 million appropriations for family planning services. ACU opposed this funding, opposes the use of government funds for organizations such as Planned Parenthood that perform abortions, and supported this modest reduction. The Senate voted to override the Governor’s recommended reduction on July 29, 2015 by a vote of 37-1. A “No” vote supported the ACU position.

6. Manufacturing Business Subsidies. The Senate voted on the Governor’s recommended $500,000 cut to the $2 million appropriation for the Manufacturing Extension Partnership Program. ACU opposes programs that gives subsidies to businesses favored by the government and supported the recommended spending reduction. The Senate voted to reject the Governor’s recommended reduction on July 29, 2015 by a vote of 36-2. A “No” vote supported the ACU position.

7. Earmarks for Local Projects. The Senate voted on the Governor’s recommendation to reduce by $5 million a $15 million appropriation for dozens of earmarked projects under the Office of Travel and Tourism with many projects having little to do with travel or tourism. ACU opposes these earmark programs that allow taxpayer funds to be allocated based on political influence and supported the Governor’s reduction. The Senate voted to reject the Governor’s reduction on July 30, 2015 by a vote of 35-3. A “No” vote supported the ACU position.

8. S 882 Eldridge Amendment Housing Mandate. The Eldridge amendment to a housing bill mandates that those living in houses under foreclosure would have the right to rent that house until the property is actually sold by the bank. ACU opposes this government interference in the free market and opposed this amendment. The Senate defeated the amendment on September 17, 2015 by a vote of 15-23.

9. S 2025 Donnelly Amendment Ambulance Price Controls. The Donnelly amendment to the Supplemental Appropriations Bill provides for extensive regulation of ambulances and prohibits them charging a rate less than that established by the federal government’s Center for Medicare and Medicaid Services. ACU opposes price controls and opposed this amendment. The Senate passed the amendment on October 8, 2015 by a vote of 23-12.

10. S 967 Tarr Amendment Tort Reform. The Tarr amendment to a bill regarding enhanced enforcement of civil penalties provides that if a violation of the wage laws is found to be not willful, the award to the plaintiff shall be limited to lost wages, benefits, and attorneys’ fees rather than the triple damages now allowed. ACU supports tort reform to lessen the lawsuit burden on businesses and supported this amendment. The Senate defeated the amendment on October 22, 2015 by a vote of 12-26.

11. S 2048 Tarr Amendment Parental Rights. The Tarr amendment to the “Healthy Youth” bill requires that parental permission be required for sex education courses in schools and also allows for those teachers and employees who believe the curriculum violates their religious beliefs to refuse to participate. ACU supports parental rights in education and supported this amendment. The Senate defeated the amendment on November 18, 2015 by a vote of 9-29.

1. H 2015 O’Connell Amendment House Audits. The O’Connell amendment to the Rules of the House requires an outside, independent audit of House financial accounts each fiscal year. ACU supports taxpayer accountability and supported this amendment. The House defeated the amendment on January 29, 2015 by a vote of 38-118.

2. H 2015 Kuros Amendment Omnibus Bills. The Kuros amendment to the Rules of the House limits each vote in the House to a single subject area. ACU opposes omnibus bills that force legislators to take a single vote on many different subject areas and supported this amendment. The House defeated the amendment on January 29, 2015 by a vote of 34-122.

3. H 3400 Jones Amendment Tort Reform. The Jones amendment to the general appropriations bill provides that if a violation of the wage laws is found to be not willful, the award to the plaintiff shall be limited to lost wages, benefits, and attorneys’ fees rather than the triple damages now allowed. ACU supports tort reform to lessen the lawsuit burden on businesses and supported this amendment. The House defeated the amendment on April 27, 2015 by a vote of 37-122.

4. H 3400 O’Connell Amendment Welfare Reform. The O’Connell amendment to the general appropriations bill requires a social security number or alien registration number to apply for government housing. ACU supports restricting welfare benefits to those in the U.S. legally and supported this amendment. The House voted to gut this amendment with language calling for a study of the problem on April 27, 2015 by a vote of 115-44. A “No” vote supported the ACU position.

5. H 3400 Pre-Kindergarten Funding. The House voted on the Governor’s recommended $2 million reduction in increased spending on “birth through pre-school programs” called for in the General Appropriations Bill. ACU supported the Governor’s more fiscally sound recommendations and supported the reduction. The House voted to override the Governor’s recommendation on July 29, 2015 by a vote of 146-10.

6. H 3650 State Climatologist. The House voted on the Governor’s veto of funding for the office of State Climatologist. ACU believes that government should not be in competition with the private enterprise that has a thriving climatology sector and supported the Governor’s veto. The House voted to override the veto on July 29, 2015 by a vote of 118-37.

7. H 3650 Pre-School Partnership Initiative. The House voted on the Governors’ veto of the pre-school partnership initiative, a new government program to plan for “opportunities for pre-school” for children as young as 2 years old in the general Appropriations Bill. ACU supported the Governor’s veto of a new unneeded government program. The House voted to override the veto on July 29, 2015 by a vote of 142-13.

8. H 3650 Earmark for Cultural Center. The House voted on the veto of an earmark to provide funding for the Berkshire Cultural Resource Center. ACU opposes these earmarks that pick one facility over another based on political influence and supported the Governors’ veto. The House voted to override the veto on July 29, 2015 by a vote of 120-34.

9. H 3650 Office of Travel and Tourism Funding. The House voted on the Governor’s recommended $5 million reduction from the $14.5 million in funding for the state Office of Travel and Tourism in the General Appropriations Bill. ACU supported the Governor’s recommended cut for a program full of dozens of earmarks for wasteful programs such as a new public radio station and supported the governor’s recommendation. The House voted to override the Governor’s recommendation on July 29, 2015 by a vote of 146-8.
