THE DEPARTMENT OP DEFENSE OP THE UNXTED STATES OP AKERICA

AND THE UDAINIAN STATE COMMITTEE ON NUCLEARAND RADIATION SAFETY

CONCERNING DEVELOPMENT OF STATE SYSTEMS OP CONTROL ACCOUNTING AND PHYSICAL PROTECTION OP NUCLEAR MATERIALS

TO PROMOTE THE PREVENTION OP NUCLEAR WEAPONS PROLIFERATION FROM UDAINE

The Department of Defense of the United States of America and the Ukrainian State Committee on Nuclear and Radiation Safety hereinafter referred to as the Parties

Noting that Ukraine will take all measures to achieve the status in the future of a non-nuclear weapons state

Desiring to facilitate control accounting and physicaLprotection of nuclear materials used for peaceful purposes in Ukraine in order to assist in the prevention of nuclear weapons proliferation

Have agreed as follows

ARTICLE I

1 In order to assist Ukraine in the creation of a national system for the prevention of nuclear weaponsproliferation through control accounting and physical protection of nuclear materials used for peaceful purposes the Department of Defense of the United States of America or its designated agent shall provide at no cost to the Ukrainian State Committee on Nuclear and Radiation Safety or its designated agent technical assistance in the form of equipm~nt propertysupplies systems support training and services in accordance with the terms of this Agreement and conforming to technical specifications established by the United States of America

2 The Ukrainian State Committee on Nuclear and Radiation Safety shall use all equipment property supplies systems support training and services provided inmiddot accordance with this Agreement exclusively for the purpose of providing effective measures of control accounting and physical protection of nuclear materials in use transit or storage in order to assist in the prevention of nuclear weapons proliferation

J In implementing this Agreement the Department of Defense of the United States of America or its designated agentshall take into account the recommendations of the Ukrainian State committee on Nuclear and Radiation Safety or its designated agent and the results of technical discussions between the Parties Upon agreement by the Parties jointworking groups of technical experts ~hall be established to exchange technical information and to advise the Parties with respect to technical issues related to the effective implementation of the Agreement

4 The Department of Defense of the United states of America and the United States of America shall not be responsibleeither for ensuring the proper use of equipment propertysupplies systems support training or services provided in accordance with this Agreement or for not achieving planned results

1 Each Party to this Agreement shall have the rightfollowing written notification to the other Party to delegateresponsibilities for the implementation of this Agreement to other agencies departments or units of its respectiveGovernment

2 Each Party to this Agreement shall have the right following written notification to the other Party to designatetechnical liaison representatives for equipment propertysupplies systems support training andmiddotservices provided pursuant to this Agreement

1 The total cost to the Department of Defense of the United States of America of all equipment property supplies systems support training and services prov~ded pursuant to this Agreement and associated expenses including costs related to the transportation of equipment property supplies systems supportand personnel to and from Ukraine and to and from the United States of America shall not exceed 75 million US dollars

2 The equipment property supplies systems supporttraining and services to be provided to the Ukrainian State Committee on Nuclear and Radiation Safety or its designated agent pursuant to this Agreement in order to assist in the prevention of nuclear weapons proliferation may include as mutually agreed by the Parties consultations and technical assistance related to the following

a Development and implementation of regulatory programs for nuclear material control and accountingand for physical protection including technical assistance in drafting regulations and guidelines and in developing licensing review and inspectionprocedures and programs and associated training for regulatory personnel

b Development and implementation of a national tracking and reporting system for nuclear materials

c Development and implementation of a program of technical support for national regulatory programs and for facility nuclear material control and accounting and physical protection systems including assistance in the areas of implementing nuclear materials measurement methods and providing appropriateinstrumentation physical protectionequipment and systems and associated training programs middot

d Development and implementation of nuclear material control and accounting and physical protection systems at selected facilities including technical assistance in system design integration test and evaluation installation and implementation

e Provision and installation of equipmentincluding appropriate computer hardware and software for both national and facilitylevels of nuclear material control and accounting and physical protection systemsand associated training for facility operating personnel and

f Evaluation of facility nuclear material control and accounting and physical protection system performance and the development and implementation of systemenhancements based on the results of such evaluations

3 All equipment property supplies and systems support to be provided pursuant to this Agreement shall be delivered according to a mutually agreed upon schedule to Kiev unless the Parties otherwise agree The Department of Defense of the United States of America or its designated agent shall notify the Ukrainian State Committee on Nuclear and Radiation Safety or its designated agent of the planned date of each shipment at least

seven days in advance The UArainian state Committee on Nuclear and Radiation Safety or its desiqnated aqent shall receive and take immediate physical control of all such equipment propertysupplies and systems support upon its arrival at the point of entry in Ukraine At that time such equipment property supplies and systems support shall become the property of Ukraine

4 Neither the Department of Defense of the United States

of America nor its desiqnated aqent shall be responsible for providinq or bearinq the cost of any Ukrainian goods and services including site preparation or facility ~odification associated with the installation or implementation of anyequipment

5 The Ukrainian State Committee on Nuclear and Radiation Safety shall be solely responsible for the salaries of all personnel they employ in any activity undertaken pursuant to this Agreement Salaries for Ukrainian personnel participatinq in any training assignments or internships provided for under this Agreement shall remain the sole responsibility of the Ukrainian State Committee on Nuclear and Radiation Safety travel costs and other expenses of Ukrainian personnel participating in such training assignments or internships or working group meetings in the United states of America may be paid by the Department of Defense of the United states of America

6 Consistent with the terms of this Agreement the Department of Defense of the United States of America or its designated agent in mandatory consultation with the Ukrainian State Committee on Nuclear and Radiation Safety may revise the type and amount of assistance to be provided under this Agreement and related schedules for the delivery of such assistance Further the scope and schedule of the assistance to the Ukrainian State Committee on Nuclear and Radiation Safety under this Agreement are contingent upon the availability of Ukrainian resources required for the level of effort contemplated for assistance by the United States of America

7 In order to facilitate the effective implementation of this Agreement the Ukrainian state Committee on Nuclear and Radiation Safety shall provide representatives of the Department of Defense of the United States of America or its designated agent access to all facilities selected in accordance with Article III2d and to appropriate information includinq drawings and layouts maps flow diagrams nuclear material inventory data and procedures which are relevant to the desiqn and implementation of nuclear material control and accounting and physical protection systems and regulatory programs

ARTZCLB XV

1 The Ukrainian state Committee on Nuclear and Radiation Safety shall examine all equipment property supplies and systems support received pursuant to this Agreement and provideconfirmation to the Department of Defense of the United States of America within ten days of receipt that it conforms with the specifications developed by the Depaitment of Defense of the United States of America in consultation with the Ukrainian State committee on Nuclear and Radiation Safety and made available in advance to the Ukrainian State Committee on Nuclear and Radiation Safety Any equipment property supplies or systems support failing to conform with these specificationsshall be returned to the United States of America through the Embassy of the United States of America at Kiev within thirtydays of receipt for replacement

2 Based on consultations with the Ukrainian State Committee on Nuclear and Radiation Safety the Department of Defense of the United States of America shall provide as appropriate initial maintenance consultation services as well as repair parts for the operation of equipment and systems support provided under this Agreement for a period of three years from the date of their receipt by the Ukrainian State Committee on Nuclear and Radiation Safety

3 The Department of Defense of the United States of America or its designated agent shall provide to the Ukrainian State committee on Nuclear and Radiation Safety or to its designated agent technical manuals on the use of equipment and systems support provided under this Agreement Technical manuals and personnel training shall be provided as necessary upondelivery of the equipment and systems support

ARTXCLB V

As necessary the Parties may enter into implementing agreements or other arrangements to carry out the provisions of this Agreement In case of any inconsistency between this Agreement and any such agreements or arrangements the provisions of this Agreement shall prevail

ARTXCLB VI

This Agreement and all activities undertaken in accordance with this Agreement shall be subject to the provisions of the Agreement Between the United States of America and Ukraine Concerning Assistance to Ukraine in the Elimination of Strategic Nuclear Arms and the Prevention of Proliferation of Weapons of Mass Destruction of October 25 1993

l This Agreement shall enter into force upon the entryinto force of the Agreement Between the United States of America and Ukraine Concerning Assistance to Ukraine in the Elimination of StrategicNuclear Arms and the Prevention of Proliferation of Weapons of Mass Destruction of October 25 1993 and shall remain in force for five years or for the ddration of the AgreementBetween the United States of America and Ukraine ConcerningAssistance to Ukraine in the Elimination of Strategic Nuclear Arms and the Prevention of Proliferation of Weapons of Mass Destruction of October 25 1993 whichever terminates earlier

2 This Agreement may be amended or extended by the written agreement of the Parties and may be terminated by either Party upon ninety days written notification to the other Party of its intention to do so

DONE at Washington DC this 18th day of December 1993 in two copies each in the English and Ukrainian languages both texts being equally authentic

CONTROL ACCOUNTING AND PHYSICAL PROTECTION OF NUCLEAR MATERIALS TO PROMOTE THE PREVENTION OF NUCLEAR WEAPONS

PROLIFERATION FROM UKRAINE OF DECEMBER 18 1993

Pursuant to Article VII paragraph 2 of the Agreement Between the Department of Defense of the United States of America and the Ukrainian State Committee on Nuclear and Radiation Safety Concerning Development of State Systems of Control Accounting and Physical Protection of Nuclear Materials to Promote the Prevention of Nuclear Weapons Proliferation from Ukraine of December 18 1993 the Department of Defense of the United States of America and the Ukrainian State Committee on Nuclear and Radiation Safety hereby agree to amend the Agreement by deleting the phrase 75 million US dollars in Article III paragraph 1 and by inserting in its place the phrase 125 million US dollars

This Amendment shall enter into force upon signature and shall remain in force for the duration of the Agreement

DONE at Kiev Ukraine this 2( day of March 1994 in two copies each in the English and Ukrainian languages both texts being equally authentic

to Promote the Prevention of Nuclear Weapons Proliferation From Ukraine

Pursuant to Article VII (2) of the Agreement Between the Department ofDefense of the United States of America and the Ministry of Environmental Protection and Nuclear Safety of Ukraine Concerning Development of State Systems of Control Accounting and Physical Protection ofNuclear Materials to Promote the Prevention ofNuclear Weapons Proliferation From Ukraine ofDecember 18 1993 as amended March 21 1994 and June 27 1995 and extended July 7 1999 hereinafter referred to as the Agreement the Department of Defense of the United States of America and the Ministry of Fuel and Energy of Ukraine acting as the successor entity for the Ministry ofEnvironmental Protection and Nuclear Safety ofUkraine hereby agree to amend the Agreement by

(A) Deleting the words Ministry of Environmental Protection and Nuclear Safety of Ukraine and inserting in their place the words Ministry ofFuel and Energy of Ukraine throughout the Agreement

(B) Deleting the words 225 million US dollars in Article III paragraph 1 and inserting in their place the words 475 million US dollars and

(C) Adding a comma followed by the phrase hereinafter referred to as the 1993 Agreement following the first rendition of the title of the 1993 Agreement deleting the words for five years or deleting the second rendition of the title of the 1993 Agreement and replacing it with the words the 1993 Agreement and deleting the words whichever terminates earlier in Article VII paragraph 1 so that Article VII paragraph 1 as amended shall read as follows

1 This Agreement shall enter into force upon the entry into force of the Agreement Between the United States of America and Ukraine Concerning Assistance to Ukraine in the Elimination of Strategic Nuclear Arms and the Prevention of Proliferation of Weapons of Mass Destruction ofOctober 25 1993 hereinafter referred to as the 1993 Agreement and shall remain in force for the duration of the 1993 Agreement

This amendment shall enter into force upon signature by both Parties and shall remain in force for the duration of the Agreement

EXTENSION OF THE AGREEMENT BETWEEN

THE DEPARTMENT OF DEFENSE OF THE UNITED STATES OF AMERICA

AND THE MINISTRY OF ENVIRONMENTAL PROTECTION

AND NUCLEAR SAFETY OF UKRAINE CONCERNING DEVELOPMENT OF STATE SYSTEMS OF CONTROL

ACCOUNTING AND PHYSICAL PROTECTION OF NUCLEAR MATERIALS TO PROMOTE THE PREVENTION OF NUCLEAR WEAPONS


Pursuant to Article VIl(2) of the Agreement ofDecember 18 1993 between the Department of Defense of the United States ofAmerica and the Ministry of Environmental Protection and Nuclear Safety ofUkraine Concerning Development of State Systems of Control Accounting and Physical Protection ofNuclear Materials to Promote the Prevention ofNuclear Weapons Proliferation from Ukraine (hereinafter the Agreement) the Department ofDefense of the United States ofAmerica and the Ministry ofEnvironmental Protection and Nuclear Safety ofUkraine hereby agree to extend the Agreement until December 31 2005

Pursuant to Article II ofthe Agreement the Department of Defense also hereby notifies the Ministry ofEnvironmental Protection and Nuclear Safety ofUkraine that it delegates responsibility for the implementation ofthis Agreement to the Department of Energy of the United States ofAmerica The Department ofDefense retains the sole right and responsibility for entering into implementing agreements or other agreements under Article V and amending and extending the Agreement under Article VII

This extension shall enter into force upon signature by both parties with effect from December 18 1998

DONE at Kiev this 7 day of Jflf~ 1999 in two copies each in the English and Ukrainian languages both texts being equally authentic
