With the permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. Confirmed Discussing about the confirmation of the proceeding of the 170 th ERC meeting held on 28.02.2014 and 01.03.2014 the Regional Director apprised the cases of 04 institutions i.e Bishupriya College of Education ERCAPP-1613, Chittaranjan Smriti PTTI ERCAPP-1838, Kandi PTTI ERCAPP-1690 and Bihar College of Education ERCAPP-37/2012 where the committee decided to issued formal recognition order under clause 7(11) of the NCTE Regulation 2009 for the applied course from the session 2014-15, after submission of DFRs of Rs. 5.00 lakh and Rs. 3.00 lakh in the joint name of institution/society/trust and RD, ERC, NCTE, Bhubaneshwar. Though the orders were reported to be signed by 3 rd March, 2014 not dispatched due to some official formalities. All the four institutions submitted the converted FDRs on 31.03.2014, 27.03.2014, 24.03.2014 and 07.03.2014 respectively. In between the NCTE HQrs called for some files along with the above files due to some complaint made related to some files. Meanwhile, the Kandi PTTI filed a Writ Petition WP1394(W)/2014 in the Hon’ble High Court of Kolkata. The Hon’ble High Court has inter alia directed the Respondents to decide the matter within 4 weeks from date or by 15.06.2014 and communicate to the same to petitioner. As stated by the Regional Director, he was also alleged by the complainant in the complaint send to the NCTE Hqrs, he has forwarded the Writ Petition and court order to the Member Secretary, NCTE, Hqrs who is also a respondent in this case to defend the case and/or for appropriate direction. the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the

permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the

Committee for its due consideration and appropriate decision.

Discussing about the confirmation of the proceeding of the 170

th ERC meeting held on 28.02.2014 and

01.03.2014 the Regional Director apprised the cases of 04 institutions i.e Bishupriya College of Education

ERCAPP-1613, Chittaranjan Smriti PTTI ERCAPP-1838, Kandi PTTI ERCAPP-1690 and Bihar College of

Education ERCAPP-37/2012 where the committee decided to issued formal recognition order under clause

7(11) of the NCTE Regulation 2009 for the applied course from the session 2014-15, after submission of

DFRs of Rs. 5.00 lakh and Rs. 3.00 lakh in the joint name of institution/society/trust and RD, ERC, NCTE,

Bhubaneshwar. Though the orders were reported to be signed by 3rd

March, 2014 not dispatched due to some

official formalities. All the four institutions submitted the converted FDRs on 31.03.2014, 27.03.2014,

24.03.2014 and 07.03.2014 respectively.

In between the NCTE HQrs called for some files along with the above files due to some complaint made

related to some files.

Meanwhile, the Kandi PTTI filed a Writ Petition WP1394(W)/2014 in the Hon’ble High Court of Kolkata.

The Hon’ble High Court has inter alia directed the Respondents to decide the matter within 4 weeks from date

or by 15.06.2014 and communicate to the same to petitioner.

As stated by the Regional Director, he was also alleged by the complainant in the complaint send to the NCTE

Hqrs, he has forwarded the Writ Petition and court order to the Member Secretary, NCTE, Hqrs who is also a

respondent in this case to defend the case and/or for appropriate direction.

The NCTE Hqrs may be requested to take appropriate action on or before 15.06.2014 in the line of the order

of the Honble High Court of Kolkata.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs. VTR and reply received on 02.01.2014 in response to

clarification issued after notice u/s 17, the Committee discussed the matter in detail and observed as under:

List of the faculty recruited on 16.12.13 as stated by the institution vide letter dated 2.1.2014 be submitted

duly approved by the Registrar of the University along with educational/professional certificates of the

recruited faculty members.

In view of the above, the committee decided as under:

A clarification letter be issued to the university to submit its reply within 30 days from the issue of the letter

before the Committee takes final decision.

Court Case:

Inspection conducted by the NCTE Hqrs. U/S 13 on the basis of direction

given by the Hon’ble High Court of Jharkhand.

A Public Interest Litigation vide W.P.(PIL) No.327 of 2011 has been filed by Shiv

Shankar Munda - Vs - Chairperson NCTE & Ors in the Hon’ble High Court of

Jharkhand at Ranchi.

As per direction of the Hon’ble High Court of Jharkhand, the 95 institutions were inspected by the NCTE

Hqrs., New Delhi under section 13 of the NCTE Act 1993. The inspection reports of all 95 institutions were

examined at the NCTE Hqrs level and same was forwarded to ERC, NCTE for taking appropriate action in the

matter.

The committee considered the report of the NCTE Hqrs and decided as under:

Copy of the VTRs may be obtained from NCTE Hqrs for assessing the deficiencies objectively.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

22/2014/NCTE/Insp/A85677 dated 07.04.2014.

1. A copy of the fee structure duly approved/counter signed by the affiliating university/state govt is to be

submitted by the institution.

2. Faculty list duly approved by the Registrar of the concerned university along with the list of the other

staff, minutes of the selection committee, individual affidavit, education/professional certificates of the

appointed faculty is to be submitted.

3. Salary to the faculty and staff is not paid through bank.

4. Proof of EPF deduction/statement of deposit of EPF not submitted.

The committee considered the representation of the institution and decided as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

64/2014/NCTE/Insp/A87042 dated 11.04.2014.

1. The institution be asked to submit the faculty list duly approved by the Registrar of the concerned

university along with the list of the other staff, minutes of the selection committee, individual

affidavit, and education/professional certificates of the appointed faculty.

2. The institution submitted the list of 03 practice teaching schools. The list of 07 more practice

teaching schools is to be submitted along with the consent letter issued from the principal of the

concerned schools.

The committee considered the representation of the institution and decided as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

32/2014/NCTE/Insp/A85687 dated 09.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 03.05.2014 to the ERC, NCTE, Bhubaneswar.

The committee considered the representation of the institution and decided as under:

Institution be asked to submit resolution of the Management Committee for increase of the salary of staff

along with notarized copy from May 2014 within 30 days from issue of the letter.

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

116/2014/NCTE/Insp/A87051 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 19.05.2014 to the ERC, NCTE, Bhubaneswar.

The committee considered the representation of the institution and observed as under:

1. Institution be asked to submit the faculty list duly approved by the Registrar of the concerned

university along with the list of the other staff, minutes of the selection committee, individual

affidavit, education/professional certificates.

2. Proof of development of IT and Psychology lab to be submitted.

In view of the above, the committee decided as under:

A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter

before the Committee takes final decision.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda –

Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section

13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency

letter No.93-38/2014/NCTE/Insp/A86401 dated 30.03.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification

vide letter dated 16.05.2014 to the ERC, NCTE, Bhubaneswar.

The committee considered the representation of the institution and observed as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda –

Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section

13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency

letter No.93-56/2014/NCTE/Insp/A86657 dated 01.05.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification

vide letter dated 21.05.2014 to the ERC, NCTE, Bhubaneswar.

The committee considered the representation of the institution and observed as under:

(i) Principal/HOD has not been appointed.

(ii) Appointed teachers are on contractual basis which is against the norms.

(iii) The built up area is only 5200 sq.ft. which is less than required 1500 sq,mts.(16146 dq.ft.).

(iv) Multipurpose hall and Art & Craft Resource Center are not available.

(i) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh is not submitted towards endowment fund and

reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE,

Bhubaneswar.

In view of the above, the committee decided as under:

Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on

the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act

1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee

takes final decision.

(Management:Private) (A.B.- Ranchi University) (Code No. ERCAPP948)

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda –

Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section

13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency

letter No.93-48/2014/NCTE/Insp/A86661 dated 01.05.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification

vide letter dated 10.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the

representation of the institution and observed as under: (i) Librarian has not been appointed.

(ii) One principal and 03 lecturers on regular basis were selected through selection committee just 03

days prior to the special inspection. No appointment letters were issued to the selected candidates

and not submitted the joining report. It seems that the required faculty was not available in the

institution before conducting the special inspection.

(iii) The institution is required to appoint the required faculty as per NCTE norms submit a fresh

faculty list duly approved by the Registrar of the concerned university alongwith the relevant

documents like copy of advertisement, minutes of the selection committee, educational and

professional certificates of the newly appointed principal and lecturers.

In view of the above, the committee decided as under:

A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter

before the Committee takes final decision.

G.D. Bagaria Teacher’s Training College, At. Aerodrome Road, Boro, P.O. &

Dist. Giridih, Jharkhand – 815301 (Course: B.Ed.) (Management: Private)

(Vinoba Bhave University) (Code No.APE00473)

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda –

Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section

13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency

letter No.93-71/2014/NCTE/Insp/A86419 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification

vide letter dated 19.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the

representation of the institution and observed as under: (i) As per VT report the institution is not functioning on the plot in Municipal holding No. 400 of

Ward No. 1 (old) of Giridih situated at Barganda, Makatpur, Thana No. 95, Thoka No. 228, PS

Giridih where recognition was grante. The institution is now functioning in another premises

namely a plot of land measuring 1.15 acre plot No. 856,849, 850 under Khata No. 1A/P 1/20/71

gifted by one Sangeetha Bagaria to GD Bagaria Teacher Training College. Thus the institution

has shifted to the new premises without permission of ERC which is against the rules.

(ii) The institution has not appointed a qualified librarian and part time teachers for Art Education

and Physical Education.

(iii) The institution has not converted FDRs in respect of Endowment and Reserve fund into joint

accounts with Regional Director, ERC,NCTE.

In view of the above, the committee decided as under:

Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on

the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act

1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda –

Vs - Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section

13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency

letter No.93-36/2014/NCTE/Insp/A85679 dated 29.06.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification

vide letter dated 06.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the

representation of the institution and observed as under: (i) The institution functions as a wing of the degree college. Its own building out of the B.Ed. fund is

still under construction.

(ii) The institution has failed to engage teaching and non-teaching staff on regular basis.

(iii) The institution has also failed to provide the necessary instructional facilities.

(iv) In the absence of a regular HOD, the institution is not managed professionally.

(v) While endowment fund of Rs. 5.00 lakhs is maintained in joint accounts with the Regional Director,

tally to each other. As per VT report the institution has shifted the premises of the institution

without getting permission from the ERC, NCTE, Bhubaneswar.

(iii) The institution in its representation has mentioned that the previous principal has quit from the

institution and another principal Dr. Miss Quyam Zehar was appointed. The institution has not

submitted the copy of advertisement, minutes of the selection committee, individual affidavit,

educational & professional certificates of the newly appointed principal alongwith the fresh

faculty list duly approved by the Registrar of the concerned university.

As per 150th ERC meeting held on 8-9 February 2013, refusal order u/c 7(1-A)(ii) was issued to the institution

vide letter No. 16664 dated 02.03.2013.

The institution preferred an appeal to NCTE Hqrs against the ERC’s order dated 02.03.2014. The Appellate

Authority vide its order No. 89-258/2013-Appeal/4th Meeting-2014/A86472 dated 28.04.2014 has remanded

the case to ERC with a direction to conduct a re-check of the records and ensure that appellant institution is

not deprived of its legal right to be considered simply because of misplacing or mix up of the documents in

some other file as claimed by the appellant. Also to make a through search for the other copies of the

application which might have been mixed up as the documents returned with the refusal order pertain to some

other institution.

The committee noted the direction and found as under:

The committee re-checked the file and found that the ground for summarily rejection was correct. There was

no mix up with file kept in the office. The institution itself submitted some other document alongwith an

affidavit dated 29.04.2014. Only one set of application was received. The committee stands with the

rejection order. The institution may apply a fresh as per new regulation.

As per the request of West Bengal Board of Primary Education, Dr. U.N. Singh has been nominated by ERC

as a member of the Joint Inquiry Committee. The committee conducted the Inquiry and submitted the report.

The report was placed before the committee for consideration. During the discussion Dr. Manik

Bhattacharya, State Representative of West Bengal as well as President West Bengal Board of Primary

Education shown a letter received from NCTE Hqrs wherein the NCTE decided to conduct an inspection

under section 13 of NCTE Act 1993 alongwith the representative of West Bengal Board of Primary

Education.

In view of the above, The committee decided as under:

Defer the case till the report received from NCTE Hqrs. Report of the Joint Inquiry committee be forwarded

(iii) The size of Computer lab and Psychology lab is very small.

(iv) The institution has engaged only 04 lecturers on contractual basis. One position of

HOD/principal and 03 positions of lecturers are vacant.

(v) Part-time lecturers for Art and Craft and Physical Eduction have not been appointed.

(vi) The institution does not fulfill the prescribed norms by not appointing a qualified HOD on

regular basis, by keeping three positions of lecturers vacant and by not appointing part-time

lecturers for physical Education and Art and Craft.

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

107/2014/NCTE/Insp/A87049 dated 22.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 28.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of

the institution and observed as under:

(i) In the VT report dated 25.05.2005 of the inspection conducted prior to grant of recognition

indicated that the proposal of the institution was to conduct the B.Ed course for the present

identified classrooms, hall, office room etc. alongwith other courses of the institution. There was

proposal for construction of a separate 4-storey building exclusively for the B.Ed department

within the campus. Land was also earmarked for the B.Ed department. The principal of the

institution also gave an undertaking dated 06.12.2004 that infrastructural, instructional and other

facilities will be provided as per the NCTE norms.

(ii) During special inspection of the institution, it is reveals that B.Ed course is still being conducted

in a very old double storey building having only 06 rooms with inadequate facilities. The

furniture are not proper.

(iii) There is no science lab, psychology lab, language lab, Art and works experience room

exclusively for B.Ed course.

(iv) There is no Multipurpose hall in this institution.

(v) The size of the library is only 246.5 sq.ft. having 1285 books only which is less as per norms.

(vi) Principal and two part-time lecturers for Physical education and fine art/music is not available.

(vii) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh is not submitted towards endowment fund and

reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE,

Bhubaneswar.

In view of the above, the committee decided as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

60/2014/NCTE/Insp/A85685 dated 07.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 03.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of

the institution and observed as under:

(i) During the hearing of the appeal, the institution submitted that its intention was to conduct the

B.Ed course temporarily in the leased premises having a built up area of 1500 sq.mts. on a plot of

land measuring 0.509 acres of 2396.94 sq.mt. and to shift to its permanent premises with an area

of 2569 sq.mts. to be constructed on a plot No. 311/3 under khata No. 37, Thana No 172, Thana

– Hazaribag measuring 3973.88 sq.m. Necessary documentary evidence namely land documents ,

approved building plan etc in this regard were also submitted by the institution during the appeal.

Keeping in view the above, the appeal was accordingly accepted on 11.06.2009 leading to finally

granting recognition the institution.

(ii) Now, during the special inspection it is revealed that the institution is still functioning in the

leased ground floor building of the temporary premises which do not fulfill the requirement as

per the NCTE norms. The area of the land is only 2396.94 sq.m which is less then the required

2500 sq.m. The area of the multipurpose hall is 99.864 sq.m. or 1075 sq.ft which is less then the

required 2000 sq.ft.

(iii) Further, the institution handed over photo-copies of another sale deed executed on 10.06.2011 to

VT measuring 1 acre of land on plot No. 1 under khasra No. 1014 & 1015 in Babhanbai,

Hazaribad stated to have been purchased by the institution for construction of a new building for

the institution alongwith a approved building plan.

(iv) The proposed new premises is different from the permanent premises of land measuring 3973.88

sq.m. on which a 2-storey building having 2569 sq,m. was proposed to be constructed as per the

submission made before the Appeal Committee alongwith documentary evidence on 15.09.2009,

on the basis of which the appeal was accepted leading to grant of recognition to the institution.

The institution obtained recognition by submitting false documents.

(v) The new sale deed dated 10.09.2011 now submitted cannot be accepted.

(vi) The institution engaged one principal and five lecturers. As per requirements 01 full time

lecturer has not appointed.

(vii) Original copy of faculty list is not submitted with due approval of the Registrar of the concerned

university alongwith minutes of the selection committee, copy of news paper cutting, consent

from the appointed faculty, individual affidavit, bio-data and all educational/professional

certificates.

In view of the above, the committee decided as under:

Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on

the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act

1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee

takes final decision.

43. 171.2(ii).28 Guru Nanak College, Dhanbad, Post Box No. 93, Dist.-Dhanbad, Jharkhand-

826001 (Course:B.Ed.) (Vinoba Bhave University) (Code No.APE00429)

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

91/2014/NCTE/Insp/A86659 dated 01.05.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 26.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of the institution and observed as under:

(i) The institution is functioning as a department of the General Degree college. The principal of the

Guru Nanak College, Dhanbad has also submitted an undertaking dated 08.10.2004 on non-

judicial stamp paper that the infrastructural, instructional and other facilities will be provided for

B.Ed course as norms.

(ii) Now, during the special inspection it is found that khalsa college and Khalsa school are ruunng in

the same campus which is against the rules. Two class rooms have a space only 437 sq.ft. each as

against the requirement of 500 . Size of multipurpose hall is only 1890 sq,ft, only which is less

then the required 2000 sq.ft. The size of library, science lab and computer lab are very small and

inadequate. Psychology lab is not available in the institution. The Art and Craft room is available

but it has not been equipped with relevant material.

(iii) Encyclopedia is not available in the library.

(iv) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh is not submitted towards endowment fund and

reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE,

Bhubaneswar.

In view of the above, the committee decided as under:

Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on

the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act

1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee

takes final decision.

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

107/2014/NCTE/Insp/A87049 dated 01.05.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 28.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of

the institution and observed as under:

(i) The B.Ed course is being conducted in one portion of the existing building of the general college

namely the Mahila college. The existing B.Ed block has nine room with a built up area of 3831

sq.ft. which is less then the required 1500 sq.mts

(ii) The Multipurpose hall, staff room, common room for girls and boys and Art & Work Experience

room are not available.

(iii) No land and building is specifically earmarked for the B.Ed course.

(iv) One of the condition stipulated in the recognition order dated 12.05.2005 was that the institution

shall shift to its own premises within three years from the date of recognition. The institution has

failed to fulfill this condition even after more than eight years of recognition.

(v) The new building for B.Ed programe is under construction.

(vi) Books in the library are only 748 which is less then the required 3000.

(vii) The institution does not have its own Science Resource Center, ICT or Educational Technology

Resource Center. Art and Craft Resource Center have not been setup.

(viii) The recruited lecturers are on contractual basis which is against the rules. Faculty must be

appointed on Regular basis.

(ix) Principal/HOD is not appointed. Mathematic lecturer is also not appointed.

(x) Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh is not submitted towards endowment fund and

reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE,

Bhubaneswar.

In view of the above, the committee decided as under:

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

58/2014/NCTE/Insp/A86446 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 28.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of

the institution and observed as under:

1. The institution is required to appoint one more lecturer and submit a fresh faculty list duly approved

by the Registrar of the concerned university adding the name of newly appointed lecturer.

2. The part-time lecturers for Physical education and Fine Art/Music have not been appointed.

3. Salary statement of staff last 3 months and EPF deduction to be submitted.

The application of the institution had been refused for the applied course B.Ed under clause 14(3)(b) of NCTE

Act 1993. Appeal committee has also confirmed the order of the ERC.

The petitioner institution preferred writ petition before the Hon’ble High court at Calcutta in W.P. No. 33782

(w) of 2013 challenging the order dated 15.10.2013 passed by the Appellate Authority i.e NCTE Hqrs.

The Hon’ble High Court of Calcutta vide its order dated 27.01.2014 has disposed of the writ application with

a direction inter alia “Accordingly I set aside the order dated 15th

October,2013 and directed the respondent

authority to re hear out the appeal on merit upon giving the parties an opportunity of hearing and to pass a

reasoned order within eight weeks from the date of communication of this order and to communicate the

reasoned order by two weeks from the date of passing such order”.

In view of the above, the committee decided as under:

As per the court order, the committee authorized the Regional Director to call the petitioner for hearing their

case and thereafter a reasoned order communicate to the petitioner.

The SDL&LRO vide letter dated 26.02.2014 submitted that a physical inquiry was held along with

BL&LRO, Lalgola, it is seen that 67 dec of land in plot No. 811, 812 & 813 J.L. No. 15, Mouza-

Gouridaspur is recorded in favour of Secretary, Agnibina College of Education and the college authority has

built up college building theron. Now, the allegation of land where the petitioners claimed that an

unauthorized construction has been made, used for drainage of water of village house. At present there is no

construction or boundary wall in the alleged portion through it appears that an effort was made to start a

construction in that portion. The spokesman of the college authority informed us that they had the work but

did not proceed. However, the college authority are warned not encroach the drain in future.

1. Complaint letter dtd. 11.08.2013 received in this office on 16.08.2013 from Isha Md. Chowdhury,

Treasurer, Ehasan Mandal Memorial Trust & Agnibina College of Education regarding Land

Documents and Endowment Fund, Reserve Fund and Bank Account defective in favour of application

code No. ERCAPP1654. This approved construction of building plan of Agnibina College of

Education of 16000 sq. Ft. As a NCTE Norms. But existing building of 12000 sq. Ft. As a illegal

2. Complaint letter dtd. Nil received in this office on 05.07.2013 from Samaun Sk. Regarding

information regarding an illegal construction of (Agnibina College of Education, Plot No. 811, 812 and

813, J.L. No. 15-15, Mouza Garidaspur) (Code No. ERCAPP1654) Not contiguous in nature of land.

In view of following a copy of the application seeking grant of recognition for conducting of D.El.Ed.

course submitted by the Agnibina College of Education of autheised Chairperson Mr Jahangir Alam.

Plot No. 811, 812 and 813 total land area 0.67 acres and area not contiguous in nature of land. It is

shown that the building of the college is being built in three plots, plot no. 811, 812 and 813 total land

area 0.67 acre the other two plots 812 and 813 belongs to other person and area not contiguous in

nature of land.

In view of the above the above, the committee decided as under:

A copy of the inquiry report received from SD&LRO be sent to complainants and institution for record and

future action. A copy be sent to the Secretary, West Bengal Board of Primary Education for information and

necessary action.

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

23/2014/NCTE/Insp/A85325 dated 13.03.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 21.04.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of

the institution and observed as under:

(i) The Foundation/Trust runs a school and the B.Ed College in the same campus and shares many

facilities with the school. Separate land and building are not demarcated for B.Ed course required

as per norms.

(ii) Library is housed in a small room having seating capacity of 15 persons and not suitable for a

B.Ed college.

(iii) The ICT Resource Centre has also been setup in a small room which is not fit for a computer lab.

(iv) The Psychology lab set up in a class room does not have the required number of tests.

(v) As per VTR , the facilities actually created for the school have been claimed to be the facilities of

the B.Ed college. Thus the institution is very deficient in terms of instructional facilities.

(vi) The institution is not having a qualified Principal. There is no qualified regular Librarian in the

institution.

(vii) The institution is having only 04 lecturers out of which 03 are on adhoc basis. As per norms

faculty must be appointed on Regular basis. The teaching faculty is not appointed as per

requirement of norms. Non of the faculty member is approved by the affiliating university as on

the date of inspection. Thus violated the norms regarding appointment of faculty.

(viii) Salary to the staff are not being paid as per norms.

(ix) Only 5 practice teaching schools are arranged.

(x) The institution has not maintained the FDRs of RS. 5.00 and Rs. 3.00 lakh into the joint

operation as stipulated in the recognition order.

In view of the above, the committee decided as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

109/2014/NCTE/Insp/A87019 dated 30.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 29.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of

the institution and observed as under:

1. The institution is required to appoint two lecturers and one librarian on Regular basis.

2. Fresh faculty list duly signed by Registrar of the concerned university alongwith other related

documents i.e. minutes of the selection committee, individual affidavit, educational/professional

certificates etc.

3. Salary statement of staff last 3 months and EPF deduction to be submitted.

In view of the above, the committee decided as under:

A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter

before the Committee takes final decision.

1. Original FDRs of Rs. 5.00 lakh and Rs. 3.00 lakh is to be submitted towards endowment fund and

reserve fund respectively into joint account in the name of institution and RD, ERC, NCTE,

Bhubaneswar.

as one time major with following direction.

“The procedure for processing the request of the Government of Odisha would be initiated; the

formal letter of approval would however, be issued subject to the following to conditions:

a. All staff as per the norms and standards of NCTEis in place by February 2014.

b. There is an adequate budgetary allocation in the budget of the State Government for the year

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the High

Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the

NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a deficiency letter No.93-

111/2014/NCTE/Insp/A87035 dated 23.04.2014.

In response to the deficiency letter issued by the NCTE Hqrs, the institution submitted its clarification vide

letter dated 24.05.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the representation of

the institution and observed as under:

(i) As per special inspection report, the institution is not having proper land documents.

(ii) Building plan approved by any Govt Engineer mentioning plot Nos, total area of land, total built

up area, measurement of rooms etc alongwith an unedited CD covering whole area of the land

and building is to be submitted.

(iii) The required equipments and consumable items are not available in the Science and Mathematics

laboratories.

(iv) Facilities for Art and Craft laboratories are not available.

(v) The institution organized fresh interview on 04.09.2013 that is, a few days before of the special

inspection and selected one principal and six lecturers.

(iii) It appears that the required faculty was not available before the special inspection. The

institution is required to submit the previous faculty list alongwith cause of removal/resignation

of the previous faculty members.

(vi) Institution is also required to submit the fresh faculty list duly approved by the Registrar of the

concerned university alongwith the list of the other staff, minutes of the selection committee,

individual affidavit, education/professional certificates of the appointed faculty.

(vii) The institution is required to submit a blue print of the building plan mentioning total built up

area and measurement of rooms and halls duly approved by any Govt Engineer alongwith an

unedited CD covering whole area of the building specially rooms and halls.

(viii) Building completion certificate issued from any Govt Engineer.

In view of the above, the committee decided as under:

A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter

before the Committee takes final decision.
