As per direction of the Hon’ble High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13 of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, clarification letter was issued to the institution on 16.06.2014. In response to the clarification letter, the institution submitted its reply dt. 12.07.2014 to the ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 12.07.2014 submitted by the institution, the matter was discussed in detail and observed as under: i. As per NCTE norms, the academic staff of the institution( including part time staff) shall be paid such salary in such scale of pay as may be prescribed by the UGC/University from time to time, through account payee cheque or as per advice as per advice into the bank account of employee specifically opened for the purpose. The supporting shall be paid as per the UGC/State Government/Central Government pay scale structure. ii. The institution is required to submit the 3 months Bank statement clearly stating that amount has been deposited in the bank account of the staff. i. The educational/professional certificates of the appointed Librarian is required alongwith appointment letter. In view of the above, the committee decided as under: A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter before the Committee takes final decision.

Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 5th

August, 2014 at Conference Hall, ERC, NCTE,

15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below

were present at the time of the 174th ERC Meeting.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, clarification letter was issued to the

institution on 16.06.2014.

In response to the clarification letter, the institution submitted its reply dt. 12.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 12.07.2014

submitted by the institution, the matter was discussed in detail and observed as under:

i. As per NCTE norms, the academic staff of the institution( including part time staff) shall be paid

such salary in such scale of pay as may be prescribed by the UGC/University from time to time,

through account payee cheque or as per advice as per advice into the bank account of employee

specifically opened for the purpose. The supporting shall be paid as per the UGC/State

Government/Central Government pay scale structure.

ii. The institution is required to submit the 3 months Bank statement clearly stating that amount has

been deposited in the bank account of the staff.

i. The educational/professional certificates of the appointed Librarian is required alongwith

appointment letter.

In view of the above, the committee decided as under:

A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter

In response to the clarification letter, the institution submitted its reply dt. 02.07.2014

dated 02.07.2014 submitted by the institution, the matter was discussed in detail and observed as under:

i. As per NCTE norms, the academic staff of the institution( including part time staff) shall be paid

such salary in such scale of pay as may be prescribed by the UGC/University from time to time,

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, clarification letter was issued to the

institution 0n 16.06.2014.

In response to the clarification letter, the institution submitted its reply dt. 27.06.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 27.06.2014

submitted by the institution, the matter was discussed in detail and observed as under:

(i) The lecturer in Mathematics is to be appointed following due procedure.

(ii) The institution is required to submit the fresh faculty list adding the name of the newly

appointed lecturer duly approved by the Registrar of the concerned university.

In view of the above, the committee decided as under:

Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on

the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act

1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee

takes final decision.

Jasidih B.Ed. College, Plot No. 23 Part & 24 Part, Town – Jasidih, Po- Jasidih,

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 03.07.2014.

In response to the show cause notice, the institution submitted its reply dt. 10.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 10.07.2014

submitted by the institution, the matter was discussed in detail and observed as under:

1. The institution has failed to observe the NCTE prescribed norms related to instructional facilities

and engagement of academic and supporting staff as it does not have.

(i) Well demarcated campus.

(ii) Appropriately equipped Resource Rooms.

(iii) Regular HOD.

(iv) The required Teaching and supporting staff on regular basis.

(v) It is not maintaining Endowment and Reserve Funds jointly with the Regional Director,

ERC, Bhubaneswar, as required.

In view of the above, the committee decided as under:

Last opportunity is given to the institution to submit the compliance within 30 days from the publication of

minutes in the ERC website, failing which, the recognition of the institution will be withdrawn as per NCTE

norms.

A copy of the above show cause notice to be issued to the institution be endorsed to the Principal Secretary,

Ministry of HRD Govt of Jharkhand and Registrar of the concerned university for information and necessary

action.

submitted by the institution, the matter was discussed in detail and observed as under:

i. The supporting documents for appointment like minutes of selection committee, individual

affidavit along with educational & professional certificate etc. of newly appointed lecturers are

not submitted. Also the institution has not submitted the cause of removal/resignation of the

previous lecturers.

In view of the above, the committee decided as under:

A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter

before the Committee takes final decision.

submitted by the institution, the matter was discussed in detail and observed as under:

i. As per NCTE norms, the academic staff of the institution( including part time staff) shall be paid

such salary in such scale of pay as may be prescribed by the UGC/University from time to time,

through account payee cheque or as per advice as per advice into the bank account of employee

specifically opened for the purpose. The supporting staff shall be paid as per the UGC/State

Government/Central Government pay scale structure.

ii. The institution is required to submit the 3 months Bank statement clearly stating that amount has

been deposited in the bank account of the staff.

iii. As salary statement only 05 lecturers (1+4) is projected in place of seven full time and two part-

time lecturers.

iv. The faculty list duly approved by the Registrar of the concerned university is to be submitted.

In response to the show cause notice, the institution submitted its reply dt. 24.06.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 24.06.2014

submitted by the institution, the matter was discussed in detail and observed as under:

i. The institution has not submitted the building plan indicating size of different rooms as per the

requirement of NCTE norms duly approved the Govt/University Engineer,

ii. Multipurpose hall is 1259 sq.ft only which is less than the required 2000 sq.ft. as norms.

iii. The size of Psychology & Computer lab is 164.9 sq.ft which is less as per requirement.

iv. The institution has not appointed the Principal & three more lecturers as per requirement of

NCTE norms.

v. All teaching faculty must be appointed on regular basis.

vi. The part-time lecturers for Arts/Music and Physical Education have not been appointed.

vii. A fresh faculty list duly approved by the Registrar of the concerned university is to be submitted.

In view of the above, the committee decided as under:

Last opportunity is given to the institution to submit the compliance within 30 days from the publication of

minutes in the ERC website, failing which, the recognition of the institution will be withdrawn as per NCTE

i. Dr. Brahmananda Sahu, existing principal has resigned recently. The institution is required to

appoint a new principal following due procedure and submit a fresh faculty list duly approved by

the Registrar of the concerned university adding the name of the newly appointed principal.

ii. As per recognition order, the affiliating body of the institution was Ranchi university, as per the

letter head and other submitted documents the affiliating body is shown Nilamber Pitamber

University. The permission for change of university is not granted by the ERC, NCTE,

Bhubaneswar.

iii. The institution is required to submit a certificate of change of affiliating body issued from

Nilamber Pitamber University and NOC issued form Ranchi university.

In view of the above, the committee decided as under:

Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on

the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 17.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 14.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply submitted by the

institution, the matter was discussed in detail and observed as under:

(i) The Foundation/Trust runs a school and the B.Ed College in the same campus which is contravent

to the NCTE Norms and Regulations.

(ii) As per the VT report Library is housed in a small room having seating capacity of 15 persons and

not suitable for a B.Ed college. The ICT Resource Centre has also been setup in a small room

which is not fit for a computer lab. The Psychology lab set up in a class room does not have the

required number of tests.

(iii) The facilities actually created for the school have been claimed to be the facilities of the B.Ed

college. Thus the institution is very deficient in terms of infrastructures and instructional

facilities. (iv) The institution is not having a qualified Principal.

by the Register of the University nor having information regarding the qualifications of the their

eligibility as per norms.

(vi) There is no qualified regular Librarian in the institution.

In view of the above, the committee decided as under:

The committee concluded that the institution is running the B.Ed course violating the NCTE Norms and

Regulation 2009. The committee, therefore, decided to withdraw the recognition of the institution for B.Ed

course under Section 17(1) of the NCTE Act, 1993 from the academic session 2015-16.

4. Part-time lecturers for Fine Art/Music and Physical Education are not available.

6. The institution is required to appoint the qualified and required faculty as NCTE norms on regular

basis and submit a fresh faculty list duly approved by the Registrar of the concerned university.

i. The institution is not having infrastructure and instructional facilities as per the NCTE norms. The

institution was to shift to its own premises within three years from the date of recognition i.e. by

19.05.2008. But even after more than 8 years, it is continuing at the same place. However, the

constitution of new building has been completed.

ii. The institution does not fulfill the prescribed norms regarding engagement of teaching and supporting

staff and also in respect of service conditions of staff.

iii. The institution is required to appoint the qualified and required faculty as per NCTE norms on regular

basis and submit a fresh faculty list duly approved by the Registrar of the concerned university.

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, the NCTE Hqrs issued a clarification letter

dated 16.06.2014.

In response to the clarification letter, the institution submitted its reply dated 26.06.2014 to the ERC, NCTE,

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 18.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 16.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply submitted by the

institution, the matter was discussed in detail and observed as under:

(i) During the hearing of the appeal, the institution submitted that its intention was to conduct the

B.Ed course temporarily in the leased premises having a built up area of 1500 sq.mts. on a plot of

land measuring 0.509 acres of 2396.94 sq.mt. and to shift to its permanent premises with an area

of 2569 sq.mts. to be constructed on a plot No. 311/3 under khata No. 37, Thana No 172, Thana

– Hazaribag measuring 3973.88 sq.m. Necessary documentary evidence namely land documents ,

approved building plan etc in this regard were also submitted by the institution during the appeal.

Keeping in view the above, the appeal was accordingly accepted on 11.06.2009 leading to finally

granting recognition the institution.

(ii) During the special inspection it is revealed that the institution is still functioning in the leased

ground floor building of the temporary premises which do not fulfill the requirement as per the

NCTE norms. The area of the land is only 2396.94 sq.m which is less then the required 2500

sq.m. The area of the multipurpose hall is 99.864 sq.m. or 1075 sq.ft which is less then the

required 2000 sq.ft.

(iii) Further, the institution handed over photo-copies of another sale deed executed on 10.06.2011 to

VT measuring 1 acre of land on plot No. 1 under khasra No. 1014 & 1015 in Babhanbai,

Hazaribad stated to have been purchased by the institution for construction of a new building for

the institution alongwith a approved building plan.

(iv) The proposed new premises is different from the permanent premises of land measuring 3973.88

sq.m. on which a 2-storey building having 2569 sq,m. was proposed to be constructed as per the

submission made before the Appeal Committee alongwith documentary evidence on 15.09.2009,

The institution obtained recognition by submitting false documents.

(v) The new sale deed dated 10.09.2011 now submitted cannot be accepted.

(vi) The institution engaged one principal and five lecturers. English lecturer has not been appointed.

In view of the above, the committee decided as under:

The committee concluded that the institution is running the B.Ed course violating the NCTE Norms and

Regulation 2009. The committee, therefore, decided to withdraw the recognition of the institution for B.Ed

course under Section 17(1) of the NCTE Act, 1993 from the academic session 2015-16.

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 18.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 16.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply submitted by the

institution, the matter was discussed in detail and observed as under:

i. At the time of submission of application the institution was having land at Plot No. 732, 738.

739, 418/2149, 418/2184, Khata No. 31 & 32 under Mauza No. 179 Mauza- Kapasara, P.S-

Gobindpur, Dhanbad measuring land area 5.19 acres in favour of Smt Tanuja Chowdhary,

Secretary, Sanajik Kalyan Sansthan and the instititon submitted a copy of the sale deed dated

30.09.2005. The institution had submitted a building plan for construction of a 3-storey

building on the said plots of land but the total land area, total built up area, plot nos khata nos

were not indicated. However, an affidavit on Rs. 100/- stamp paper dated 01.05.2007

subsequently submitted by the institution indicated that the society was in possession of land

measuring 21010.8 sq.m. and built up area of 2245 sq.m. for the Vishwashwaraiya B.Ed college

at the aforesaid plots. Accordingly, the ERC, NCTE, Bhubaneswar granted recognition to the

Vishwashwaraiya B.Ed college vide order dated 21.08.2008.

ii. As special inspection conducted on 28.09.2013, the institution is functioning from a building

with a built-up area 2529.73 sq.m. in 3 floors constructed on plot Nos. 1548(P), 1561(P),

1562(P), 1569(P) under Mausa No. 198, Khata No. 29 situated in Mausa- Deoli,

P.S.Govindpur, Dhanbad. The said property has been sold by the society namely samajik

Kalyan Santhan in favour of the Vishweshwaraiya B.Ed college vide sale deed executed on

16.12.2009 i.e after granting recognition by the ERC, NCTE, BBSR.

iii. The institution is not functioning in the land and building where the recognition was granted to

the Vishweshwaraiya B.Ed college on 21.08.2008. The institution shifted the premises to a

new place without obtaining approval of the ERC, Bhubaneswar and, thus, violated Regulation

No. 8(11) of the NCTE Regulation 2009.

In view of the above, the committee decided as under:

The committee concluded that the institution is running the B.Ed course violating the NCTE Norms and

Regulation 2009. The committee, therefore, decided to withdraw the recognition of the institution for B.Ed

course under Section 17(1) of the NCTE Act, 1993 from the academic session 2015-16.

sq.ft. which is less then the required 1500 sq.mts

2. The Multipurpose hall, staff room, common room for girls and boys and Art & Work Experience

room are not available.

3. No land and building is specifically earmarked for the B.Ed course.

4. One of the condition stipulated in the recognition order dated 12.05.2005 was that the institution

shall shift to its own premises within three years from the date of recognition. The institution has

failed to fulfill this condition even after more than eight years of recognition.

5. The new building for B.Ed programme is under construction.

6. Books in the library are only 748 which is less then the required 3000.

7. The institution does not have its own Science Resource Center, ICT or Educational Technology

Resource Center. Art and Craft Resource Center have not been setup.

8. The recruited lecturers are on contractual basis which is against the rules. Faculty must be appointed

on Regular basis.

9. Principal/HOD is not appointed. Mathematic lecturer is also not appointed.

In view of the above, the committee decided as under:

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 16.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 08.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply submitted by the

institution, the matter was discussed in detail and observed as under:

(i) The institution is functioning as a department of the General Degree College.

(ii) The principal of the Guru Nanak College, Dhanbad has also submitted an undertaking dated

08.10.2004 on non-judicial stamp paper that the infrastructural, instructional and other facilities will be provided for B.Ed course as per norms.

(iii) As per special Inspection Report, the institution does not have adequate infrastructural facilities as

required as per the prescribed norms. Out of three classrooms available for B.Ed. course, two

classrooms have a space of 437 Sq. ft. which is less than the required 500 Sq. ft. as per NCTE norms.

Thus, only one classroom is only as per NCTE norms as against the requirement of a minimum two

classrooms with an area of minimum 500 Sq. ft. each.

(iv) The multipurpose hall available is having an area of 1890 Sq. ft. as against the requirement of a

minimum of 2000 Sq. ft. as per NCTE norms.

(v) The library is 420 Sq. ft., science lab 150 sq. ft. and computer lab 228 Sq. ft. are very small and

inadequate as per norms. Psychology lab is not available in the institution.

(vi) Thus, infrastructural facilities available with the institution are inadequate for running B.Ed. course.

(vii) During the special inspection it is found that khalsa college and Khalsa school are running in the same

campus which is against the rules.

In view of the above, the committee decided as under:

The committee concluded that the institution is running the B.Ed course violating the NCTE Norms and

Regulation 2009. The committee, therefore, decided to withdraw the recognition of the institution for B.Ed

course under Section 17(1) of the NCTE Act, 1993 from the academic session 2015-16.

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 26.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 09.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 09.07.2014

submitted by the institution, the matter was discussed in detail and observed as under:

1. The institution has not submitted any proposal for shifting of the B.Ed department in the new

constructing building alongwith other relating documents.

2. As per special inspection of the institution, it is revealed that B.Ed course is still being conducted in a

portion of the buildingof Godda College. The available built up area for the B.Ed college is only

3500 sq.ft. as against the requirement of minimum pf 16146 sq.t. or 1500 sq,m.

3. The teaching faculty appointed on contractual basis. As per NCTE norms the teaching faculty must

be appointed on regular basis.

4. The post of HOD and two lecturers are vacant.

5. The size of Psychology lab, ET lab is inadequate.

6. The Multipurpose hall of the college is under construction.

In view of the above, the committee decided as under:

Last opportunity is given to the institution to submit the compliance within 30 days from the publication of

minutes in the ERC website, failing which, the recognition of the institution will be withdrawn as per NCTE

norms.

A copy of the above show cause notice to be issued to the institution be endorsed to the Principal Secretary,

Ministry of HRD Govt of Jharkhand and Registrar of the concerned university for information and necessary

action.

Municipal Holing No. 400 of ward No. 1 (old) and ward No. 2 (new ) of Giridih

Municipality, situated at Barganda, Makatpur, Girdih, Thana No. 95, Thoka No. 228, PS-

Giridih, Dist-Girdih.

ii. As per application form, the postal address of the trust is “Ruby Lodge, Barganda, Distt-

Girdih, Jharkhand-815301.

iii. As per Certificate signed by Ajay Bagaria it is clearly indicated that the land measuring 3

Bighas and 6 chataks comprised in Municipal Holing No. 400 of ward No. 1 (old) and ward

No. 2 (new ) Tauzi No. 15/11, Thoka No. 326, Plot No. 326, Thana No. 95 situated in

Mohalla- Makatpur, Dist- Girdih in favour of M/S Ratan Mica Export Pvt Ltd has given on

lease for the period of 10 years to Bagaria Jan Kalyan Trust for opening of Teacher Training

at Girdih.

iv. Alongwith this certificate the institution submitted a Sale Deed measuring 3 Bighas and 6

chataks comprised in Municipal Holing No. 400 of ward No. 1 (old) and ward No. 2 (new )

Tauzi No. 15/11, Thoka No. 326, Plot No. 326, Thana No. 95 situated in Mohalla- Makatpur,

Dist- Girdih which is in favour of M/S Ratan Mica Export Pvt Ltd i.e. the same land was

taken on lease basis for a period of 10 years executed on 04.01.2005 between M/S Ratan

Mica Exports Pvt Ltd and the Bagaria Jan Kalyan Trust but during lease agreement the

Tauzi No. 15/11, Thoka No. 326, Plot No. 326 had not been mentioned in the submitted

Lease Deed.

v. No other land document had been submitted by institution at the time of submission of

application and till the date of first inspection which was conducted on 14.12.2005.

vi. The inspection letter 30.09.2005 was issued to the institution at the address : G.D. Bagaria

Teachr Training college, At-Aerodoms Road (Near Residance of Sarfaraz Ahmaed)

P.O./Dist Girdih-815301, Jharkhand. However, the previous address as per land document

& Certificate comprised in Municipal Holing No. No. 400 of ward No. 1 (oled) and ward No.

2 (new) of Giridih Municipality, situated at Barganda, Makatpur, Girdih, Thana No. 95,

Thoka No. 228, PS-Giridih, Dist-Girdih was not mentioned in the inspection.

vii. Avedently, the inspection was conducted at G.D. Bagaria Teacher Training College. At-

Aerodome Road, PO/Dist Giridih whereas the address as per land document submitted

initially is different.

viii. During 1st inspection conducted on 14.12.2005 a copy of two Lease Deed between Sangita

Bagaria & G.D Bagaria Teacher Training College, Girdih situated in Mauza Boro, P.S.

Girdih under Thana No. 91, Tauzi No. 15/11, Khata No. 37, Plot No. 708 having land land

area 11 ¾ decimal and another Lease Deed between Sangita Bagaria & G.D Bagaria

Teacher Training College, Girdih situated in Mauza Boro, P.S. Girdih (M) under Thana No.

91, Khata No. 1/120, Plot No. 856 measuring land land area 5 ¼ acre submitted to the VT

experts during the 1st inspection.

ix. As per Special Inspection conducted u/s 13 on 28.09.2013 by the NCTE Hqrs, the institution

is functioning in another premises gifted by one Sangeetha Bagaria to G.D. Bagaria Teachers

Training College, Girdih namely a plot of land measuring 1.15 acres (Plot No. 856, 849, 850

under Khata No. 01A/P1/20/71) situated in Mouza- Boro commonly known as

AERODRAMME Road (Boro). This gift deed was executed on 07th January 2010 whereas

the institution is recognized from 04.10.2006.

x. The institution shifted to a new premises without obtaining prior approval of the ERC,

NCTE, Bhubaneswar in violation of Regulation 8 (11) of the NCTE Regulations, 2009.

In view of the above, the committee decided as under:

The committee concluded that the institution is running the B.Ed course violating the NCTE Norms and

Regulation 2009. The committee, therefore, decided to withdraw the recognition of the institution for B.Ed course under Section 17(1) of the NCTE Act, 1993 from the academic session 2015-16.

A Public Interest Litigation vide W.P. (PIL) No. 327 of 2011 has been filed by Shiv Shankar Munda – Vs -

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 27.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 23.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply dated 23.07.2014

submitted by the institution, the matter was discussed in detail and observed as under:

1. The institution has not submitted any proposal for shifting of the B.Ed Dept in the new building

constructed by the Dept.

2. Before granting the recognition to the institution, the principal of the college has given an undertaing

to the effect that he would move the authorities to demarcate 5 acre of land from the available land of

college for B.Ed section exclusively.

3. During Special inspection of the college conducted on 23.10.2013 reveled that the B.Ed course is

conducted in a portion of the building of the General College namely the Jagannath Jain college.

Only two classrooms, one language lab and one office room aggregating to a total area of around

2334 dq.ft. are exclusively available for conducting the B.Ed course as against the requirement of a

minimum of 1500 sq. mts. as per the prescribed NCTE norms. All other facilities are shared with the

General college. Thus, the available infrastructure facilities are inadequate for conducting B.Ed

course as per the prescribed NCTE norms. The construction of the

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 27.06.2014.

1. At the time of submission of application dated 28.01.2004 submitted to the ERC, NCTE for recognition

of B.Ed course, the institution had indicatd that it was having 5.18 acre of land with a 4-storey building

having a built up area of 46,707 sq.ft. The proposal was to run the proposed B.Ed course in the existing

building of the Karim city college till consturuction of new building at Mango, Jamshedpur was

completed. A resolution dated 27.12.2004 in this regard passed by the college Governing Boday was

submitted to the ERC. An affidavit dated 27.12.2004 attested by notary stating that infrastructural,

instructional and other facilities will be provided as per the NCTE norms, was also submitted to the ERC,

NCTE, Bhubaneswar.

2. During special inspection of the institution conducted on 26.09.2013 reveals that the institution is now

functioning at Kapali Link Road, Zakir Nagar (W) P.P. Azad Nagar, Jamshedpur and not at Karim City

College, Sakchi, Jamshedpur where the recognition for conducting B.Ed. course was granted on

25.07.2005.

3. The Principal, Karim City College has handed over an undertaking dated 26.09.2013 inter-alia, stating

that from the session 2013-14 onwards, the B.Ed course has been shifted to the new building and that

they will inform the ERC, Bhubanesw at the earliest.

4. The institution had not submitted any application before conducting the special inspection i.e. upto

26.09.2013.

5. Now, the institution submitted it application for shifting of premises on 28.05.2014 alongwith a DD of

Rs. 40,000/- i.e after the special inspection. The process of all pending file is banned from 3rd

March,

2014 as per the direction of the Honble Supreme Court of India.

6. As per the sub-regulation (ii) of Regulation 8 of the NCTE, Regulations 2009, in case of change of

premises, prior approval of the Regional Committee concerned after due inspection of the instititon at the

new site is required.

7. The institution has shifted to a new place without obtaining prior permission of ERC, NCTE,

Bhubaneswar in violation of Regulation 8(II) of NCTE Regulation 2009.

In view of the above, the committee decided as under:

The committee concluded that the institution is running the B.Ed course violating the NCTE Norms and

Regulation 2009. The committee, therefore, decided to withdraw the recognition of the institution for B.Ed

i. The B.Ed department is located in a part of the college building with a covered area of 443 sq.m.

which is less then the required 1500 sq,m. as per NCTE norms.

ii. The institution has failed to create the required instructional facilities. For instance, Science

Resource Center does not have the required apparatuses and the required consumables and

chemicals are not available. Psychology Resource Centre has not been created. No separate ICT

Resource Centre has been set up. Arc and Craft Resource Centre has not been created. No

separate provision has been made for Health and Physical Education.

iii. The departmental library has a stock of 800 books which is less then the required 3000 as per

NCTE norms.

iv. In short, the institution is very deficient in respect of instructional facilities prescribed by the

NCTE.

v. The University has recruited eight lecturers on contractual basis for 11 months for the year 2013-

14 and posted them in this college on 03.09.2013. The services of the staff are terminated after 11

months and fresh appointments are made in the beginning of a session. However, the institution

has not appointed teaching faculty on regular basis till date.

In view of the above, the committee decided as under:

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, Show cause notice u/s 17(1) was issued to

the institution on 27.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 24.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply submitted by the

institution, the matter was discussed in detail and observed as under:

i. As per NCTE norms, the academic staff of the institution( including part time staff) shall be paid

such salary in such scale of pay as may be prescribed by the UGC/University from time to time,

through account payee cheque or as per advice as per advice into the bank account of employee

specifically opened for the purpose. The supporting staff shall be paid as per the UGC/State

Government/Central Government pay scale structure.

ii. The institution is required to submit the 3 months Bank statement clearly stating that amount has

been deposited in the bank account of the staff.

In view of the above, the committee decided as under:

A clarification letter be issued to the institution to submit its reply within 30 days from the issue of the letter

before the Committee takes final decision.

Chairperson NCTE & Ors in the Hon’ble High Court of Jharkhand at Ranchi. As per direction of the Hon’ble

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, clarification letter was issued to the

institution on 16.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 07.07.2014 to the ERC, NCTE,

Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply submitted by the

institution, the matter was discussed in detail and observed as under:

i. The institution has not appointed the part-time lecturers for Physical Education & Fine

Arts/Music.

In view of the above, the committee decided as under:

Show Cause notice be issued to the institution as to why the recognition to the institution be not withdrawn on

the above points. The Committee therefore, provides an opportunity under section 17(1) of the NCTE Act

1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee

takes final decision.

High Court of Jharkhand, the said institution was inspected by the NCTE Hqrs., New Delhi under section 13

of the NCTE Act 1993 and Rule 8 of NCTE Rules. Accordingly, clarification letter was issued to the

institution on 26.06.2014.

In response to the show cause notice, the institution submitted its reply dt. 11.07.2014 & 18.07.2014 to the

ERC, NCTE, Bhubaneswar. The committee considered the report of the NCTE Hqrs as well as reply

submitted by the institution, the matter was discussed in detail and observed as under:

(i) The B.Ed Department does not have a separate campus.

(ii) The college does not have its own Multipurpose hall and adequate number of rooms for various

laboratories and play ground required for the B.Ed course.

(iii) Library has a stock of 1788 books only which is less than the required 3000 books.

(iv) The Art and Craft Centre has not has not been set up.

(v) The staff is selected by the university on contractual basis for a period of 11 months and their

services are automatically terminated on the expiry of the contract period. The staff must be

appointed on regular basis as NCTE rules.

(vi) The resources of GLA college, though available for B.Ed Department, also are not appropriate for

conducting B.Ed. programme.

(vii) The institution does not maintain Endowment and Reserve Funds, in Joint Account with ERC,

Bhubaneswar.

In view of the above, the committee decided as under:

Last opportunity is given to the institution to submit the compliance within 30 days from the publication of

minutes in the ERC website, failing which, the recognition of the institution will be withdrawn as per NCTE

norms.

A copy of the above show cause notice to be issued to the institution be endorsed to the Principal Secretary,

Ministry of HRD Govt of Jharkhand and Registrar of the concerned university for information and necessary

action.

guidelines issued by NCTE Hqrs. VTR, the Committee discussed the matter in detail and observed as under:

Another institution named Barkeswar Teacher Training Institution (ERCAPP177/2012) had been

given recognition in the same land.

While comparing the CD of both the institutions, it seems that the building is one and the same for

both the institutions.

In view of the above, the committee decided as under that – A letter to be written to the D.L. & L.R.O. of the

concerned District to verify whether both the institution are having separate land and building or running in

the same land and building. Accordingly, a letter to the DL & LRO issued on 20.02.2014

In response to the ERC letter dated 20.02.2014 issued as per the decision taken in 169th meeting the ADM,

Birbhum vide its letter dated 20.03.2014 received in this office on 07.04.2014 has informed that the matter has

been enquired into by the concerned BL & LRO , Dubrajpur, Birbhum and a copy of the report which is self

explanatory is sent herewith.

(i.) As per the report of the BL & LRO it is stated that Bakreswar College of Education is situated at

plot no.347 of mouza Anderbuni on 0.70 acre area which is recorded at Khatian no. 234 and

Bakreswar Teachers Training institution is situated on the same plot but in separate building

bounded by boundary wall on an area of 1.00 acre of plot no. 347, mouza Anderbuni JL no.141

which is recorded in khatian no. 208. Both the institutes are running on the same plot no.347 but

on separate buildings, both buildings are bounded by separate boundary wall, each having

separate entrance and between the two building there is a gap of 15 feet space.

In view of the above, the committee decided as under:

As per Supreme Court order the application will be process as per the new regulation which is yet to be

notified.
