The order by Judge Bert Bam followed an urgent application by the civil business watchdog AfriSake. It sought to prevent the city council to pay even more tax payer money over for the controversial contract which had been cancelled in May last year. In terms of the deal between Tshwane and Peu, the latter would install 800 000 prepaid smart electricity meters in the metro, run the system and collect fees. For doing this, Peu was being paid 19,5 cents for every rand of electricity used in the city – an amount way above the accepted market rate which was between 7 and 9,5 cents per rand. However, Peu installed only 12 700 smart meters before the city cancelled the contract. Peu still had to maintain and service the metering service until such time as a new service provider was appointed and for this Tshwane was about to pay over R950- million to Peu – a move halted in an urgent application by AfriSake. At the time, of cancelling the contract, Tshwane mayor Kgosientso Ramokgopa said the termination decision had largely been based on the negative nancial eco- nomic impact of the project on the metro. Tshwane has been stopped from paying R950-million to the company contracted to roll-out its ill-fated prepaid smart electricity metering system.

An order to this effect was made by the High Court in Pretoria last week.

The court also ordered that a date for a review application regarding the contract with Peu Capital Partners be urgently ob-tained.

It instructed that the original contract between the metro and the service provider and also an evaluation report be made avail-able.

Peu still had to maintain and service the metering service until such time as a new service provider was appointed and for

this Tshwane was about to pay over R950-million to Peu – a move halted in an urgent application by AfriSake.

At the time, of cancelling the contract, Tshwane mayor Kgosientso Ramokgopa said the termination decision had largely been based on the negative fi nancial eco-nomic impact of the project on the metro.

Since the roll-out of the smart metres, which began in October 2013, Tshwane had paid the Peu more than R830-million.

Before granting the interdict, Bam said the more he read about the matter in court documents, the more concerned he became.

The judge will deliver a full judgment within a week, clarifying his reasons for halting the payment.

According to the metro, the payment to Peu was for among others, smart metering infrastructure.

The order further provides that neither millions of rands in a dedicated account, nor any other money would be paid to PEU for such infrastructure.

PEU would however continue to provide the smart metering services and be com-pensated for it until the fi nalisation of the review application.

That would prevent any disruption to the supply of electricity to the almost 13 000 Tshwane consumers who currently got their electricity supply via the PEU system.

This includes about 6 500 large power us-ers and represents 55% of the city’s electric-ity revenue.

Ons het hom by Kalafong-hos-pitaal gekry waar hy klaar dood was.”

Sewe jaar terug is my broer deur ’n booswig geskiet by dieselfde sentrum.”

“Sekuriteit by die sentrum is 100%.

“Almal voel beter noudat die man toegesluit is.

“My vriendin werk by ’n drankwinkel naby dié asblik.

Woordvoerder Blessing Manalse sê on-derhandelinge in hierdie verband duur voort.

Foto’s: Verskaf

The right of up to 30 000 Afrikaans speak-ing students at the University of South Af-rica (Unisa) to study in their mother tongue, could soon be tested in a court of law.

In the past months, Unisa was one of three universities, including the University of Pretoria and the University of Stellen-bosch, to scrap Afrikaans as a language of instruction.

The legal battle looms after the civil rights watchdog AfriForum challenged the decision by Unisa earlier this year that Eng-lish would from 2017 be the only language of instruction

The university council and senior management were given time to issue an unequivocal undertaking to Unisa’s Forum for Afrikaans and to AfriForum that the implementation of its decision that English

would in future be the only language of tui-tion, be provisionally suspended.

At the time of going to print, it could not be established whether such an undertaking had been given.

Unisa in April this year decided that Eng-lish would in future be the only language of tuition at the distance training university.

Between 20 000 and 30 000 of Unisa’s enrolled students were Afrikaans mother-tongue speaking, according to AfriForum’s deputy CEO responsible for language rights, Alana Bailey.

“The decision to scrap Afrikaans was taken despite urgent written objections by Unisa’s Forum for Afrikaans,” Bailey said.

She said that her organisation now sup-ported the forum in the legal process against Unisa to halt the unconstitutional deci-sion and to protect the rights of Afrikaans students.

Scrapping of Afrikaans at Unisa could head to court

A police captain recently created a vertical garden, using an old mattress picked up du-ring a clean-up operation in the Moot.

Villieria police went on a clean-up opera-tion in a veld near Bosloerie Street close to the N1 Stormvoël off-ramp on Friday, where spokesperson Captain Coba Brits found the mattress and decided to transfer herbs from her garden to it.

“I created a vertical garden using the springs in the mattress,” she said.

“Sometimes I try to blow new life into old things.

Every plant in the garden represents a new life on earth.”

She said the new garden also represented how the police aimed to blow new life into the community every day.

“The police try to give and preserve life in situations that are not always that nice.”

Brits said the police seized housebreaking tools such as screwdrivers and wrenches, as well as dangerous weapons like knives.

“We also seized drugs such as dagga from vagrants living in this veld.”

Police arrested 13 people for charges ranging from possession of drugs to illegal immigration as well as pedestrians who posed a danger to motorists.

“We would like to warn the public to be vigilant in the area around the Stormvoël off and onramps to the N1 freeway.”

The arrested would appear in court soon.

Wat ’n onwaarskyn-like einde.

(Genesis 45).

Dit is hoe geloof en hoop werk. Laat daar nooit van jou gesê word

dat jy moed opgegee het nie.

Beste Rekord-redakteur,Ek wil graag my kommer uitspreek oor

Hierdie sluipslapers is veral ’n probleem in Codonialaan waar daar heelwat sake-ondernemings is.

Dear Editor,This might come to shock a few, but this

is my opinion on the golden boy that turned out not to be so golden – Oscar Pistorious:

I would fi rstly like to disagree with the way he is being grilled.

People only had an opinion on him and his crime because he is well known.

I believe Oscar is human and the harsh words directed at him by many in the country are unfair.

The justice system gave the best verdict it could in the circumstances.

The aim of prison is to rehabilitate a prisoner, not to break his dignity and human

spirit and this was what everybody expected the judge to do.

People are so quick to judge Oscar, but where were they to raise their voices in similar cases that were not of such a high profi le?

It was embarras-sing enough when the ANC women’s league were in full support of Reeva Steenkamp and her family, but yet mixed up names in a press statement they gave. I

think that proves how quick we are to judge as humans.

We lack facts, but have so much to say. Anonymous

Who are we to judge others?

The justice system gave the best verdict it could on the circumstances.

Hul agterklein-dogter, Sanet Liebenberg, sê haar grootouers verjaar slegs ’n maand uit-mekaar.

Tafels

A Sinoville resident is determined to give the homeless some warmth this winter.

Dave Cousins (67), a member of the Pretoria South Lions Club, is going around town collecting newspapers. Not for reading, but to create something new – sleeping bags made entirely out of recyclable materials.

“Serving the community is something I am passionate about,” said Cousins.

“That is also our motto at the Lions Club: ‘We serve’.”

Cousins said the idea for the sleeping bags made from newspapers and plastic sheets was born in Cape Town.

“A woman, also a member of the Lions International Club, came up with the idea and some of the other clubs adopted the initiative.”

Cousins said project sleep tight, or Snuggler, is going to make a difference to the man on the street having to sleep beneath cardboard and sheets of paper to keep warm at night.

Cousins said one sleeping bag is made out of 24 newspapers – 10 sheets each, covered by thick plastic that keeps warmth in and cold and rain out.

Cousins demonstrated by getting into one of the sleeping bags – large enough for a tall man.

“And you can take this wherever you go,” Cousins said, folding the sleeping bag into one square and tucking it under his arm.

Cousins said the Pretoria South Lions Club (28 members) is involved with many other community projects in the area.

“Lions clubs meet the needs of local

communities and the world. The 1,3 mil-lion members of the volunteer organisa-tion in 205 countries and geographic areas are different in many ways, but share a core belief: community is what we make it.”

Centurion’s SPCA opens a vet clinicEliot Mahlase

The SPCA in Centurion celebrated the opening of a veterinary clinic in the area on Saturday.

The event included a presentation on how the clinic developed and animal lovers attending were given the opportu-nity to donate blankets.

The new clinic only offers sterilisation of animals adopted at the SPCA, but the society said it would like to expand services offered in the future.

The Centurion clinic only operates once a week.

Centurion branch manager Christina Masemola said having the veterinary clin-ic in Centurion was a relief for everyone.

“Our aim is to make sure we check whether the dogs are looked after pro-perly. It is very important to ensure every-thing is cleaned before you do an opera-tion on an animal to avoid infections.”

Dr Marianna Bergh, head veterinarian at SPCA Waltloo and Centurion, said: “We are so pleased to be in a position to offer this service at the Centurion branch now.”

“This means people adopting their furry friends will not have to wait too long before they can take them home.”

Event organiser and volunteer at the SPCA Charlotte Tiley said it was a privilege for the SPCA to have a grand opening.

“We just want to do what is best for animals and, through this clinic, I believe we would create more awareness about the SPCA.” She said the objective was to change the public’s perception of the once-ailing SPCA.

“This clinic would make a huge diffe-rence for us because in the past, we had to transport animals to Waltloo for opera-tions. Now it would be a lot easier as the animals will be treated here.”

Martie Preller, skrywer, verduide-lik elke karaktertjie

het ’n bondel mens-like eienskappe.

Dié versameling sluit Diep, Diep in

Romantic comedy drama of the yearMe Before You – the highly anticipated fi lm version of the New York Timesbestseller by Jojo Moyes – released at Nu Metro Menlyn Park and Woodlands in Pretoria, along with other cinemas nation-wide, last Friday.

Louisa “Lou” Clark (Emilia Clarke) lives in the English countryside. With no clear direction in life, the quirky and crea-tive 26-year-old goes from one job to the next in order to help her tight-knit family make ends meet.

Her normally cheery outlook is put to the test when she faces her latest career challenge: a job as caregiver and com-panion to Will Traynor (Sam Clafl in), a wealthy young banker who became wheelchair bound after an accident, and whose whole world changed dramatically in the blink of an eye.

No longer an adventurous soul, the now cynical Will has all but given up.

That is, until Lou decides to show Will that life is worth living.

Embarking on a series of adventures, both Lou and Will get more than they bargained for, and fi nd their lives – and hearts – changing in ways neither could have imagined.

Me Before You is one of those movies destined to seduce cinemagoers with its heart-warming story, delivered by two shining young stars.

It is a touching movie romance that hits the spot, bitter and sweet – the per-fect companion to a beautiful winter date night out.

And yes, pack your Kleenex – the movie includes quite a few tearjerker moments, which pull on the heartstrings with sincere emotion.

PRETORIA MOOT REKORD FRIDAY JULY 15, 2016 11

Winter remains a good time for sectional title schemes improvements or renovations.

The usually dry and sunny days mean anything from painting and varnishing to fencing could take less time in winter, says Andrew Schaefer, MD of national property management company Trafalgar.

It may also cost less because this is a slower period for many contractors.

However, contractors should never be ap-pointed on price alone or in haste.

It is important for the trustees to check that they are properly qualifi ed, properly insured and have a verifi able track record of completed projects similar in size and scope to the one being contemplated.

Schaefer says large and well-known contractors may not be set up to undertake the work planned for a smaller sectional title scheme.

Trustees also need to remember it is not uncommon for smaller companies to get in over their heads when trying to generate work – no matter how good their intentions.

When calling for quotes, he says, the trustees will also need to provide contractors with a clear and detailed brief of the work envisaged, so they will be able to compare “apples with apples” when the estimates come in.

“And if the project involves building or any other work that could affect the structure of the buildings in the scheme and thus the building insurance premiums or cover, it might in fact be a good idea to have the work brief written by a specialist maintenance advisor such as Curasure (www.curasure.

When it comes to renting out a property, a home inspection is vital to ensure the interests of both the landlord and tenant are protected, says Grant Rea, RE/MAX living rental specialist.

He adds that while it may seem like ths could be a tedious exercise, not doing a proper inspection will leave landlords with little, or in fact no legal recourse should their asset be damaged in anyway.

“Landlords or rental agents who have not conducted a property inspection when the tenant takes occupation will not be able to take any action in the event that the rental unit has been damaged during the course of the tenancy,” advises Rea.

Generally, landlords or rental manage-ment agents will be able to withhold the rental deposit to mitigate any fi nancial cost of repairing any damage to the rental unit.

However, if no property inspection was done beforehand, they will not be within their legal rights to do so and will have to absorb the full cost of the repair.

Elly Stavros, operations and market-ing director of Property Sprout, a com-pany that specialises in streamlining the

property inspection process, says South African legislation through the Rental Housing, Unfair Practices Regulations and Consumer Protection acts, dictate the practice around home inspections and the refund of the damages deposit.

“According to the Rental House Act, when a property is rented, it is required that an agreed-upon, documented ingoing and outgoing inspection is undertaken by both the landlord and the tenant. If either party is unable to attend, it may send a representative,” says Stavros.

“The act also stipulates that tenants may pay the damage deposit before they take occupancy of the rental unit.”

She adds that it is not just in the land-lord’s best interest to undertake a property inspection.

Tenants benefi t in that they cannot be held liable for any damage that was there prior to them moving in to the property.

“Although there is a long list of things that tenants would rather do than attend a property inspection, if they don’t they are making themselves vulnerable by accep-ting the landlord’s version of the state and condition of the property.”

R

co.za) and the quotes checked by that same specialist.”

This will minimise the risk to the owners in the scheme and help to ensure the winning contractor delivers a top quality job with the fewest hitches.

For larger projects, Schaefer says, the trustees should make use of formal (JCBB) building contracts.

Even on smaller ones they should ensure that any contract they sign contains the con-tractor’s contact information and physical address, proof of any professional member-ships or affi liations, a project schedule, and any building plans, permits and guarantees or warranties that are necessary.

There should also be a schedule of pay-ments, and once work begins, the trustees must never give in to any requests to deviate from this and make advance payments.

This is often a danger sign that the con-tractor has a cash fl ow problem and needs “quick money” to pay wages or supply bills so that he can stay in business.

Final whistle for Pta referee and mentor One of the most infl uential people in South African rugby referees ranks, Kosie Horn, died recently.

He had been in hospital for just over two weeks with a lung infection and was to be moved from ICU when he suffered a stroke and died.

He was 63.Many peo-

ple will have expe rienced his cheerful kindness in his 12-year stint as manager of the Blue Bulls referees and then as the Blue Bulls’ training and education manager.

Jacobus Daniel Horn, known to every-body as Kosie, was born on 29 August 1952 in Frankfort on the banks of the Wilge river in the Eastern Free State. But he grew up in Durban, moving there when he was young and attended Dirkie Uys on the Bluff.

He played scrumhalf at school and joined the police force in 1971.

In 1978 he started refereeing, joining the Durban Referees Society.

The next year the young policeman was transferred to Ladybrand and then Bloemfontein and then on to Pretoria where he stayed until he died this year.

As a referee Horn became a fi rst league referee in 1979 and from 1985 to 1994 he was a provincial referee, reaching Currie Cup status.

In 1994 his duties shifted to Pretoria and in 1995 bowed out of active refereeing.

In 1996 he became the secretary of the Blue Bulls Referees Society, becoming its fi rst full-time manager in 1998 after taking early retirement from the police force.

He ceased to be the referees manager in 2009 to take up the role of Blue Bulls training and education manager.

Horn is survived by his wife, a son, a daughter and his grandson.

The late Kosie Horn.

Rob Walter, the most successful domestic cricket coach the past two seasons has re-signed as coach at the Northerns franchise.

He had been responsible for the trans-formation of The Unlimited Titans into a local powerhouse again.

Walter has taken up the position of head coach of Otago in New Zealand and will start his new tenure on 1 September.

Under the astute guidance of Walter, a former SA conditioning coach, The Unli-mited Titans shared the Momentum One Day Cup with the Cape Cobras in 2013/14.

They took sole ownership of the same limited-overs trophy in 2014/15, beating the same foes in comprehensive fashion.

Subsequently, they achieved the coveted domestic double last season by triumphing in the Ram Slam T20 Challenge and the Sunfoil Series.

“Rob pioneered a new spirit in The Unlimited Titans cricketing family,” said Jacques Faul, chief executive offi cer of The Unlimited Titans.

“It was a value and person-centred ap-proach to raise the standards of fi tness and cohesion while setting goals in association with each player in order to maximise an individual’s potential.

“This approach has proven infi nitely

successful. He has transformed the fran-chise in many ways. It was evident in the way the franchise batting improved the past two seasons, as our top and middle-or-der produced 22 centuries in two seasons. We also improved our consistency in the bowling department.”

Many players blossomed under Walter’s watch.

“The Titans were explosive and attack-minded,” said the CEO.

“They pursued wins but encapsulated the spirit and values of good sportsman-ship. The work ethic throughout the year was fi ve-star.”

There were also several barn-storming performances by junior and senior stal-warts which caught the eye.

“Rob was an exponent of developing individuals and in creating a healthy com-petitive squad system,” Faul said.

Losing a coach of Rob’s stature was a dark day for Titans.

He left the team in a healthy position with a strong work ethic.

“We want to pay tribute to his enormous contribution,” Faul said.

“We wish him and his family well when they embark on a new chapter of his crick-eting odyssey in Otago, New Zealand.”

Walter’s resignation a blow for much-improved Titans cricket

Local tennis seniors in top form at the world champsAs they say in the classics, the older you get, the better and wiser you get and this was so true for the South African Senior tennis team who impressed at the ITF Senior World Individual Championships which ended in Helsinki, Finland recently.

The best result came in the 60+ age group doubles where Ronnie van ‘t Hof of Cape Town and his Pretoria partner, Marius Genis won a gold medal beating Australians Ste-phen Myers and Stephen Packham 6-3, 6-4 in the fi nal. South Africa won a silver medal in the 60+ age group mixed doubles when Karin Boshoff and Stephen Bryant of Kwa-Zulu-Natal to reach the fi nal.

Ross Persons and Tina Kawarsky of USA,

seeded four, beat fi fth seeded Boshoff and Bryant 6-3, 3-6, 10-7 for gold.

In the same age group, Capetonians Japie Klaasen and Jenny Cerff reached the mixed doubles semi-fi nals.

In the singles 55+ age group Elna Botha of Gauteng Central reached the quarter-fi nals where she lost to second seed American Susan Wright but upset sixth seeded Wanda Howes of Australia in the third round.

Other doubles quarter fi nalists were Elna Botha and her Australian doubles partner Kerry Lonergan (55+ age group), Lynn van ‘t Hof (WP) and Annelie Celliers (Gauteng North) and well as Jenny Cerff and Karin Boshoff (both 55+ age group).

Get ready for SPAR challengeThe sight of 25 000 runners making their way along Centurion’s streets each year is often referred to as “a sea of colour”.

This year, some Pretoria residents might be under the impression that spring has ar-rived early as bright green was revealed as the 2016 T-shirt colour.

Over the years many women running the race have brightened up the race route with their own customised version of the SPAR Women’s Challenge race T-shirt.

This year SPAR encouraged everyone to glam up their shirts any way they like. Post a picture of how you took your shirt from drab to fab on the SPAR Women’s Challenge Pretoria Facebook page and you could walk away with your share of thou-sands in SPAR store vouchers.

“This year we are celebrating a race tra-dition that was started by our race partici-pants,” said SPAR North Rand Marketing Director, Jerome Jacobs.

“We love the way that the runners show their enthusiasm and love for the race by making the offi cial T-shirt their own.”

There are tons of ways to customise your shirt from cutting a fringed edge or turning your shirt into a tank top to creating a racer back or decorating it with stencils or rhinestones.

You could even add the 2016 race theme, #I’mGrateful, to your shirt and write what you are most grateful for in your life on the back of it.

Visit the Glam Your Tee board on the SPAR Women’s Challenge Pinterest page where long-time race partner, Isigidi, will be posting tips and inspiration.

The 2016 Pretoria SPAR Women’s Challenge takes place on 3 September at SuperSport Park Stadium.

Entries are now available in selected SPAR Stores and online at www.sparla-diespta.co.za.

The Blue Bulls u.16 team last week proved their worth as the top team in the u.16 Grant Khomo tournament when they overcame a challenging fi nal round encounter to remain unbeaten.

The Blue Bulls pipped the Sharks 23-20 in the unoffi cial “fi nal” of this tournament.

This grand fi nale of the u.16 Grant Kho-mo week was tight. The Sharks dominated territory and possession early on and showed patience on attack, and this paid off as they scored the fi rst points compliments of a try by Celimpilo Gumede.

The Blue Bulls levelled the scores at 7-7 three minutes later as Jurich Claasens touched down for them. With neither team giving an inch on defence, both sides opted

for penalty goals to infl ate their scores as the half progressed, with the Blue Bulls slotting over two penalties to only one by the Sharks for a 13-10 halftime lead.

The Blue Bulls added their third penalty after the break and then added their second try after a series of phases to stretch their score to 23 points.

The Sharks, however, showed composure on attack by taking a penalty before fi ght-ing back with a try in the corner minutes before full-time to reduce the defi cit on the scoreboard to 23-20.

In a thrilling end to the match the Sharks opted for a penalty goal on the stroke of full time, but the attempt fell short, which sealed the three-point win for the Pretoria side.

With a fi nal score of 50-3 and a bonus point in the bag after seven tries, the Bulls beat the Sunwolves at Loftus Versfeld on Saturday night.

From the kick-off the Bulls showed they intended to hunt the line in their fi nal home game of the 2016 SupeRugby season.

The Bulls managed to put the visitors un-der suffi cient pressure in the fi rst ten minutes and set up camp in the opponent’s 22 meters area. After about 12 minutes the dam wall broke and Lappies Labuschagne could barge through to score the home team’s fi rst try.

The Sunwolves courageously tried to fi ght back and even put their fi rst (and only) points on the scoreboard when fl y-half Yu Tamura kicked a penalty, 15 minutes into the game.

Brummer answered with a penalty of his own and followed the try of Dries Swane-poel, which was made possible with brilliant running rugby by the home team.

This try ushered in the fi nal twenty min-utes of the fi rst half, dominated by the Bulls.

As a result, another two tries were scored by the Bulls before the half-time whistle. First up was Jannes Kirsten with a move after the ball had been carried through many phases.

Then followed a brilliant piece of indivi-dual play by Francois Brummer.

He scored under the posts after control-ling the ball with an educated boot of a soccer player.

This try moved the half-time score to 31-3 in favour of the Bulls.

It took the Bulls only two minutes for a fi rst try after half time, when captain Adriaan Strauss crashed over the goal line, following a driving maul.

Although the Bulls still dominated play, they could not manage to get over the line.

Bulls too good for Sunwolves

This demonstrated improved effort by the Sunwolves on defence.

In the fi nal ten minutes the visitors how-ever could not shut all the gaps and Travis Ismaiel used the opportunities for two good

tries. His second, for which he had to run 40 metres, clinched the score for the Bulls at a half century.

Although the Bulls theoretically still have an opportunity to qualify for the play-off

rounds of the SupeRugby competition, the chances, however, are slim.

For this to realise, the Sharks have to loose against the Sunwolves in Durban this weekend.
