Kent District Library is joining otherpublic libraries, municipal governments, and public schools throughout Michiganin support of the Replace, Don’t Erasecampaign imploring state legislators toguarantee replacement revenues if thePersonal Property Tax (PPT) is elimi-nated.

An effort is underway in Lansing torepeal the PPT, which provides revenueto libraries and public schools as well asassists local governments in paying forpolice and re protection, drinking watersystems, roads and bridges, and parks.

For Kent District Library, scrapping the

PPT would mean a loss of approximately $1.1 million in revenue. The PPT makesup 7% of KDL’s 2011 operating budget.  Along with the decline in property tax  values, loss of income due to local taxcaptures, and cuts to state aid for librar-ies, KDL has already lost $1.5 million inrevenue over the last two years.

Lance Werner, Director of the KentDistrict Library, expects the library willneed to consider layoffs, reduction inoperating hours, and cuts to the collec-tion budget if the PPT is eliminated andnot replaced.

“Losing the personal property tax

would be devastating to Kent DistrictLibrary. Our branches are busier thanever with people turning to the library for job hunting, résumé writing, infor-mation, and entertainment resources,as well as community programming,”stated Werner. “It would signicantly impact KDL’s ability to deliver serviceat the level our community has come toexpect. We need supporters to contacttheir elected ofcials and let them know about how much they value their locallibraries.”

Getting a comfortable night’s sleepcan be much easier than counting dozensof sheep—thanks to new memory foamtechnology. Here are ve tips to help the57 percent of consumers planning to buy a mattress in the next three months whoare considering memory foam:

1. Getting into the thick of it. Mem-ory foam mattresses come in a variety of thicknesses. Decide which thickness you want. Thinner mattresses will be less ex-pensive but thicker ones can provide amore supportive sleep environment.

2. Comfort and support. How muchsupport do you want? If you need a rmfoundation for a good night’s sleep, com-pare levels of support.

3. All foam or some foam. Considerconstruction. Some mattresses are entire-ly made of memory foam while others area combination.

4. To ip or not to ip. Ask if yourmattress should be ipped. Some of thenew memory foam mattresses do notneed to be ipped.

5. A cool option. Ask if the mat-tress has a cooling system. Memory foammattresses are very comfortable but oneproblem that one in four consumers re-port with memory foam mattresses is thatthey retain heat and “sleep hot.” Fortu-nately, new product lines solve that prob-lem.

For example, Simmons’ ComforPedicLoft line took those complaints and usedthem to develop new memory foam tech-

nologies that address concerns. The mat-tress is designed for quick recovery—if

you press down on the foam, it promptly expands back to its original shape. Thecollection also features a sleep systemthat dissipates heat and provides cooling.

Optimal Sleeping

Temperatures“Designed to work with the memory

foam, the sleep system features a stylishmesh border so the bed can breathe,” saidScott Smalling, Simmons Specialty SleepDivision. “The mattress core gives extrasupport while the edge offers sleeping

comfort and stability right to the edge of the bed.”

Select models also include gel tech-nologies for more support and a coolinsensation.

That’s good news for anyone who  wants to get a good night’s rest. Visi

Football Coaches can be grossly negligent.

In a recent case taken to the Michigan Court of

Appeals, the defendant, a high-school’s football

coach (Coach Cry), asked the Appeals Court to

overturn the Wayne County trial court’s decision

against him. The trial court had ruled that the

case against Coach Cry should go to trial before

a jury because a reasonable juror could conclude

from the evidence that Coach Cry’s conduct andwords had allowed one student to hurt another.

The trial judge ruled that the jury would decide

whether Coach Cry had been grossly negligent

in permitting a fight between football team mem-

bers, and whether his negligence had caused se-

rious injuries suffered in the fight.

Football fight facts. The facts were offered by a

team member, Keith Gray. Gray and other team

members were in the school’s weight room,

working out. The music was on. Gray and an-

other student, Derrick Benson, disagreed on the

music being played. They began pushing each

other. (That’s mature.) Other students separated

them. Gray started leaving. Coach Cry enteredthe room. He wanted to know if the two wanted

to settle their disagreement. Gray testified that

Benson was “hyped-up”. Also, that Benson said,

“yeah, I want to fight . . . .” Coach Cry then told

the others not to hold Benson back anymore.

(That’s mature.) Coach backed off and let them

fight. In the fight that ensued, Benson violently

attacked Gray. No-one stopped the fight. (That’s

mature) Gray was badly injured.

Cry asked the trial court to decide. Gray sued

Coach Cry for gross negligence. Cry filed a mo-

tion (a request for a ruling) to throw the case out,

arguing that he had governmental immunity.

The Governmental immunity argument. Cry’simmunity argument was governed by Michigan

law, section 691.1407(2). Each employee of a

governmental agency is immune from tort li-

ability (in this case, liability for negligently al-

lowing a fight which proximately caused inju-

ries) while acting on behalf of a governmental

agency IF (a) The employee thinks he is acting

within the scope of his or her authority, (which

Cry thought he was) and (b) The governmental

agency is engaged in the exercise or discharge

of a governmental function, (Cry and the schoolteach for the government) and (c) The employ-

ee’s conduct does not amount to gross negli-

gence that is the proximate cause of the injury

or damage.

Was Coach grossly negligent? The Appeals

court didn’t analyze the question much. Pretty

much Coach Cry had been grossly negligent in

allowing the fight. But…

Was Coach’s negligence the ‘proximate’ cause

of Gray’s injuries? ‘Proximate cause’ is a legal

term of art which requires a tough legal analysis.

But in this case the analysis turned simply on

one question: What was the one most immedi-

ate, efficient, and direct – meaning proximate

- cause of Gray’s injuries? The Appeals court

used common sense, answering: Benson’s phys-

ical assault. The Appeals court said: “While we

certainly do not condone defendant’s actions…

it was Benson’s actions, not Cry’s, which caused

Gray’s injuries.” Benson beat Gray up, not Cry.

The trial court was wrong. Coach Cry had im-

munity.

Which goes to show that common sense isn’t so

common after all.

At a regular meeting of the Township Board of Croton Township, Newaygo County,

Michigan, held at the Township Hall on October 10, 2011 at 7:00 PM, the Township

Board Member Heinzman moved to adopt the following ordinance amendment,

which motion was 2nd by Township Board Member Ortwein.

SECTION 2.120 FENCES (REVISED 09/22/2011)

A. All fences, artificial walls, or landscaping and plantings shall be so arranged that

they do not obstruct any water views or the clear vision of the traveling public on

any public street or intersection of any street, alley, driveway, parking lot or other

access.

lot or parcel on which it is placed. No fences are permitted within the public right-

of-way.

1. Fences within the required front yard shall be of a type which is see-through

in nature (i.e. chain link), so as not to obscure vision at the right-of-way or

property line of the lot or parcel on which it is placed.

C. Fences shall not exceed six feet (6’) along the rear and side lot lines of an interior

lot and four feet (4’) along a front lot line. Fence height shall be measured from

the finished grade (elevation) of the ground immediately below the location of the

fence. There is no setback for a fence; however the fence must be placed on the

inside of the property line. Regulations differ for waterfront lots and corner lots.

1. A fence may be erected on a wall or berm; however the combined height of

the wall or berm and fence shall not exceed the allowable fence height.

D. All fences shall be constructed with the finished side facing the adjoining lot of

any abutting right-of-way with the support posts placed on the inside in a manner

which serves to enhance the aesthetic appearance of the neighborhood or surround-

ing area.E. Fences shall be situated so as to ensure safe ingress and egress from any lot or

property in cases of emergency.

F. No fence shall be constructed so as to prevent normal maintenance on any exist-

ing building.

SECTION 2.120 FENCES (REVISED 09/22/2011)

G. No fence in the Water Overlay Zone or on a lot with frontage on a lake, river or

tributary shall be located within thirty feet (30’) of the ordinary high water mark or

within ten feet (10’) of the break in the bank.

H. Unless specifically authorized elsewhere in this Ordinance, no fence, wall or

screen located within the side yard or rear yard in any Residential District shall ex-

ceed six feet (6’) in height from the natural grade. Fences for Agricultural use may

exceed the limitations stated in the subparagraph, if necessary, for the containment

of animals, but only with a Special Land Use permit. Fences erected for the con-

tainment of animals which are not native to the State of Michigan or which require

a State or Federal permit for said containment shall require a Special Land Use

Permit. The conditions for the Special Land Use Permit will be based on Federal

or State requirements.I. Barbed wire fence only permitted for agricultural fencing used for bona fide

farming for the containment of livestock. Except the reasonable use of barbed wire

is allowed along the top of security fences which protect the public or properties

such fences the barbed wire will be at least six feet (6’) above ground level.

J. On waterfront lots, fences, walls, screens and other structures that are located

between the main building and the waterfront shall be of an open air type and see-

to fall into disrepair or become unsightly. Fences shall be used only for the purpose

of confinement or enclosure, or for decorative purposes.

1. Fences shall not be used for billboards or advertisement of any kind, or for

other purposes that are contrary to or inconsistent with their usual and custom-

ary uses.

MONDAY,OCTOBER17,2011•RIVERVALLEYNEWSSHOPPER  11 AN OPEN LETTER TO THE REYNOLDS TOWNSHIP BOARD

ENOUGH

ISENOUGH!!Six new citations issued to John Powell in one day.

You have got to be kidding!!

It is enough for all of us to stay in business in today’s economy.

We need a township board that will work with us, not try to put us out

of business.* John Powell represents the third generation doing

business here and has been an asset to the community. For many yearsJohn has been parking his equipment and storing materials on the

south side of the road. This has never been an issue with any other

board member or zoning administrator until now. Why can’t our elected

officials and appointed officials resolve this issue by granting a variance

immediately, or simply allow it as a pre-existing business? If the laws

hinder a business man or woman from getting such a variance,

then the laws need to be changed to accommodate the businessand the whole community.

So, if you can’t work to support us then make room for those who will.*

This message paid for by 40 local businessmen and women.

Football, pumped students, a decked-out stadium, and the chance to see old classmates – for arearesidents, it seemed that nothing could be better. Fansof all ages came out for this year’s Homecoming gameat Tri County High School on Friday, September 23.Our TC Vikings faced the Packers of Fremont and, though we lost in the end (33-22), still came out ontop with winning attitudes.

As usual, the award-winning TC Band put on abeautifully choreographed, musically perfect show athalftime. Their theme this year was fan favorite “Worldof Warcraft.” Following the band’s performance werebanner and royalty festivities. Each class’s banner, including the winning Class of 2012’s, was displayedfor fans. Students put in extended hours at school inorder to show off these creative, spirited works of art.

Freshman class representatives were TylerEdwards and Hannah Warzynski; sophomore classrepresentatives were Ivy Boden and Cameron Hysell;and junior class representatives were MeghanCallender and James Abbott. Representing the Classof 2012 were Briana Snyder and Andrew Stroud; TimThielke and Cassie Vodry; Paul Bradley and ShaynaGross; Tyler Bennett and Alanna Butler; and JaxsonButler and Kaitlyn Geers. Tyler Bennett and ShaynaGross were crowned King and Queen.

In the next few weeks, your highschool student will be offered a uniqueopportunity to possibly serve on theTCAS (Tri County Area School) Boardof Education as a student representative. We, as a Board, are excited to be bringingthis our students, not only as a greatlearning experience but also as a means of opening up the lines of communicationto the students through one of theirpeers.

The process will be started with all

interested students circulating a petitionto be signed by their fellow students. Each petitioner will require 20 signaturesto qualify for the second step, whichwill give them a place on the ballot. The voting will take place on Tuesday,November 8 in correlation with the areaschools’ elections. Plans are to createa realistic scenario of what it means tobecome involved in community/localgovernment and the process of beingelected.

Ballot stations will be set up at thehigh school with every student being

given the opportunity to vote for theirfavorite candidate. The elected studentwill begin their term at the regularlyscheduled Board meeting in January, alongside the newly elected districtcandidates. The term will end after thelast regularly scheduled Board meetingin May. The time commitment willvary from month to month by issuespresented, but minimum expectationfor the position will be the requiredattendance of the regular monthly Boardmeeting, held on the second Mondayof each month. We will encourageparticipation in discussions, but the

student representative is not authorized tovote or introduce or support motions.

We ask you to encourage your youngadult to participate in this program,as it will offer them a leadership rolewithin the school, a connection withthe community as well as a start to agreat resume builder for their futureaspirations.

If you have any questions regardingany of the afore mentioned, please don’thesitate to contact one of us.Sincerely,Tri County Area Board of Education

MacNaughton Elementary has participatedfor the last four years. Everyone enjoyed seeingthe pinwheels turning along the sidewalk in thefront of the school.

By Carrie White

Lieutenant David Pyle visited several classrooms at MacNaughtonElementary School to teach students about fire safety. He reminded the childrennever to play with matches, lighters, or candles. He also showed everyone hisawesome fire-fighting gear.

Next week the first graders will be visiting Howard City’s fire station to seethe different kinds of fire trucks.

Please take this opportunity to talk with your child about fire safety athome. Do you have an emergency plan? Where will you meet outside in caseof a fire? Act out the situation with your children, and be sure to check thebatteries in your smoke detectors!

By Gwen Mathis

The Kindergarten students had an awesome time at Anderson and Girls Orchard in Stanton thisweek. Everyone got a delicious doughnut and cup of cider. We enjoyed seeing lots of animals. Thechildren even got to feed the goats. We took a wagon ride out into the orchard where everyone wasallowed to pick an apple and a gourd to take home. The children also had fun playing on the largeslide, horse swings, wooden train, tractors and the fire truck. Thanks to all the parents who joinedus and helped make it such a special day.

Tri County High School is undergoing a school-wide curriculum revision. Under the guidance of the

Empowered High School organization, the staff is aligning all of the core courses (English, math, socialstudies and science) to the College Readiness Standards of the ACT. The main focus for each course willbe on reading, writing, and critical thinking skills. The specials courses (art, computers, P.E., etc.) arealso realigning their standards to focus more on college readiness. What does this mean for your highschool student?• Students in eighth grade will take the EXPLORE test and the scores in the core areas will be used todetermine their placement in high school classes.• Students in ninth and tenth grade will take the PLAN test and their scores will determine theirplacement in basic, college bound, or honors courses.• Students in eleventh grade will take the ACT during the spring. Students who are not determined tobe college ready (based on their ACT score in the different testing areas) will be encouraged to retakethe test again after working to improve in their areas of weakness.

Focusing on college readiness standards will allow students to be accepted into their choice of colleges, and to do well in their college courses. The goal of implementing the Empowered High Schoolprogram is to improve the ACT score average to a twenty-four, which will open doors for TCHS studentsin regards to scholarships, college and career opportunities. Tri County High School is only one of two

schools in the state of Michigan implementing Empowered High Schools this year; the other school isNorth Farmington High School.

“Michigan

Car-Deer

Crash Safety

 Awareness

 Month.”In Michigan in 2010 there

were 55,867 reported car-

deer crashes with 11 mo-

torists killed and 1,277

injured. About 80 percent

of all car-deer crashes take

place on two-lane roads

between dusk and dawn.(Of the reported car-deer

accidents Kent County is

number one and Montcalm County is number six in the state’s highest accident rate).

What can you do?

• Stay aware, awake, alert, and sober.

• Remember, safety belts are your best defense in any collision.

• Be alert for deer in spring and fall, especially at dawn and dusk.

• Heed deer crossing and speed limit signs, particularly on two-lane roads.

If a crash is unavoidable:• Don’t swerve!

• Brake firmly

• Hold on to the steering wheel.

• Stay in your lane.

• Bring you vehicle to a controlled stop.

We at Hill’s Body Shop have noticed an increase in deer hits in the month of October through December

and a big surge directly after the end of Daylight Savings, because more people are still on the road at

sunset.

If you have had the misfortune of hitting a deer, Hill’s Body Shop, Inc. is here to help restore your ve-hicle to its pre-accident condition. Your insurance company may refer you to one of their “preferred”

repair facilities. These body shops have an agreement with your insurance company to keep down the

cost of your vehicle repair in exchange for referrals. We believe it’s not in your best interest to take

your vehicle to these contracted repair shops. We believe safety and quality should come before cost,

whereas these “preferred” shops seem to put cost before quality and safety. We believe it to be unethi-

cal to cheapen your vehicle repair to save your insurance company money. You’re our customer, not

your insurance company’s. Hill’s Body Shop, Inc. has always and will always provide the finest repairs

available.

For more information about what you can do to avoid a car-deer accident and what to do if you do have

a car-deer accident, please visit our website http://www.hillsbodyshop.com/

SOMETHING FOR EVERYONE!

Murder is Not EntertainmentMost of us have experienced the death of someone close to us. The grief, sadness, regret, and other emotions

may stay with us a long time as we heal that loss. Fortunately most of us have not experienced the loss of someoneclose to us because of violence such as murder. For those who have experienced this, they know that there are other added emotions that make the feelings of loss even greater and make recovery more difficult.

Most of the people, who read this, with perhaps the exception of our Amish Community, watch Television or Movies. Many of these shows have violence and murder in them. Every time someone gets shot, drowned, hangedor blown up it is essentially a murder. The victim has a family and friends who will mourn and grieve that loss. There israrely acknowledgement of that death; it is just fallout around the main character. Yes, it is just a movie or televisionand yes, I know it is not “real”. However, it does have a negative impact on us. It subtly adds to the “toxic” state thatmany of us experience.

The portrayal of murder on TV and movies is nearly without emotion. We have become numb to the feelings of that. In 20 years of watching TV and moves, we will witness over 40,000 murders and violent acts against humans andanimals. This causes a great desensitization of the emotions around these events. But yet as we view them, our Fightor Flight emotions are triggered. Adrenaline flows freely. This whole thing contributes to high blood pressure, highblood sugar, acidity, heart burn, constipation, and many other health issues.

There is a small movement, started in Australia, by the family and friends of someone who was murdered, calledMINE (Murder is Not Entertainment). Their purpose is to raise awareness to these facts. With the ultimate goal of influencing the entertainment industry, this group is just quietly working with individuals, mostly through the socialnetworking sites, to get one person at a time to just stop and think.

This idea really resonated with me. I had simply never thought about this before. Wemay generally say we should reduce violence on TV or in the Movies, but after we begin toconsciously pay attention, we can see how prevalent this is. Recently, I counted over 40 violentdeaths during one 2 hour movie. This is more violent death than most of us will see in a wholelifetime. After becoming aware, it made me feel bad. I will be far more selective in my viewingchoices.

These things are subtle, but they may have a big impact on our physical, emotional andspiritual health. It is good to stop and think about this sort of thing from time to time. As wemake these subtle changes, we will have less anxiety and find more peace within ourselves.

And our children will learn from our example.
