Patrol Report December 2017

Possession of a Controlled Substance- Riverdale PD was dispatched to the parking lot of JC

Penney on a suspicious vehicle. A male was found asleep in the driver's seat with drug

paraphernalia on his lap. The driver’s vehicle was searched. Meth, heroin and drug paraphernalia

were seized. The driver was transported to the Weber County Jail where he was booked for two

felony 3 counts of possession of controlled substance with prior convictions along with possession

of paraphernalia.

Retail Theft- Officers responded to Shopko where a male was caught shoplifting. The suspect

was also found to be in possession of marijuana and paraphernalia and had a no bail warrant for his

arrest. He was booked into jail.

Drug Violation/DUI- Officers responded on a report of persons smoking marijuana in a vehicle.

The driver was arrested for possession of marijuana, paraphernalia and DUI metabolite.

Agency Assist- WCSO requested our assistance on a high risk stop in the parking lot of Shopko.

This stemmed from a weapons disturbance case that originated in Washington Terrace. Three

suspects were taken into custody and a firearm was recovered.

Suspicious Person- Officers responded to a suspicious person compliant. The suspect appeared to

be under the influence of a drug. The suspect was taken into custody for warrants and a search

incident to arrest discovered drug paraphernalia. The suspect was checked by medical and was

subsequently transported to Ogden Regional Hospital.

Lewdness- Police were dispatched to Golden Spike Park located at 1250 w 5050 S, Riverdale, UT

on a report of a suspicious vehicle. When police arrived they located a male and female engaging

in sexual activity in the back seat of a vehicle. Both parties where educated about possible

consequences and released.

Traffic Accident/DUI- A 16-year female crashed her vehicle near the church on 300 W. She was

found to be under the influence of alcohol as were two of her juvenile passengers. She was cited

for DUI and open container and then released to her father.

Disturbance- Officers responded to the area of 1055 W Riverdale Road on a report of a male and

female pushing each other. A female was contacted and found to be intoxicated. The female

reported that her boyfriend assaulted her by pushing her and stealing her phone. The female

provided a written statement. After further investigation, it was determined the females adult son

responded to the area after getting a call from her boyfriend saying the female jumped out of the

vehicle at Larry Miller. The son attempted to get his mother to come with him in his vehicle and

it’s believed the son was the male seen in an altercation with his mother.

DUI-Officers responded on a disturbance where a female was in front of her home in her vehicle

causing a disturbance and accusing a neighbor of stealing from her. A strong odor of an alcoholic

beverage was emanating from the females person and she was placed into custody for suspicion of

DUI and disorderly conduct. The female submitted to a blood draw but refused a breath test. She

was booked into WCCF for DUI.

DUI- Officers responded to an unknown trouble complaint. A female was found unconscious in

her vehicle. She admitted to prescription medications use and failed sobriety tests. She was

arrested and booked for a warrant and DUI.

DUI-Officers handled a reckless driver complaint in which the suspect was found to be impaired.

The suspect was arrested for DUI and released on citation.

VEHICLE THEFT- This report is in reference to a theft that occurred at Tuesday Morning,

located at 4050 South Riverdale Road. Employees had their keys and wallets taken from the

employee breakroom and their cars were subsequently stolen.

DUI-Officers arrested a male for DUI metabolite following a complaint of reckless driving.

Heroin and meth along with paraphernalia were located in the suspect’s vehicle.

Theft/resisting arrest- Officers responded to Target on a theft in progress. Officers contacted the

suspect and attempted to take him into custody. The suspect resisted arrest and he attempted to

access a firearm during the altercation. Officers knocked the gun from the suspects hand and took

him into custody after a struggle to get him handcuffed. The suspect was booked into WCCF on

multiple charges.

Agency Assist/DUI/Recovered Stolen Vehicle- A female juvenile stole her mother’s car and ran

away. She was located and fled from Ogden PD and South Ogden PD in the stolen vehicle. She

crashed into another vehicle causing serious injuries to the driver. She had been using

methamphetamines throughout the day. Officers investigated and charged her with DUI.

Domestic Violence- Officers responded to Walmart for a Domestic Violence/Disturbance. A male

was observed striking his wife by a witness. The suspect then threatened the witness when she

confronted him. The suspect continued inside Walmart and threatened the manager when he was

denied entry because he was wearing a backpack. Video surveillance corroborated the witness’

statement. The suspect assaulted an officer after being handcuffed. He was booked at the Weber

County Jail.

Investigations Report December 2017

Retail Theft- A male selected several items and pretended to pay at the self check out line. The

suspect left the store without paying for the items. The suspect was identified but hasn’t been

located. An arrest warrant was issued for the suspect.

Child Abuse- A child reported to his teacher that his step-mother was hitting him with a belt and

shoe. Detectives interviewed the child and the suspect. The suspect confessed to abusing the

child. The suspect was charged with child abuse.

Retail Theft- 3 juveniles stole shoes from a store. A detective identified the juveniles and

interviewed them. They confessed to committing the theft. All 3 were cited into the juvenile

court.

Domestic Violence- Detective’s followed up on a report of domestic violence. The suspect

wasn’t located. An arrest warrant was drafted for the suspect.

An arrest warrant was drafted for the suspect.

Criminal Mischief- Two females were involved in an argument. One of the females retaliated and

damaged the windshield of the other female’s vehicle. The suspect snap chatted about damaging

the vehicle. The suspect was summonsed for criminal mischief.

Evading/DUI/Ungovernable Juvenile- Detectives had been following up on an ungovernable

juvenile who had been using drugs and soliciting sex for money and or drugs over the internet.

The juvenile stole her mothers car and ran away. The suspect evaded police and crashed into

another vehicle causing injury. Detectives compiled several cases and booked her into Weber

Valley Detention Center.

Sergeant Jones will be leaving investigations and will be assigned to patrol. Sergeant Jones

did a great job in investigations. Sergeant Engstrom will be assigned to investigations.

January 10, 2018

ONGOING DEVELOPMENTS

Floor & Décor will be opening in the old Sports Authority building as well as taking the old Zurchers and Office Max building spaces. They will be located at 1060 W. Riverdale Road.

El Pollo Loco restaurant has announced that they will open a location in the Riverdale Town Square development at 899 W Riverdale Road.

Good Earth is starting a remodel of the interior and exterior of their store at 1050 W. Riverdale Road.

Lady Jane’s Haircuts for Men will be opening a store in the Riverdale Town Square development.

Krispy Kreme Doughnuts has announced that they will build in Riverdale at the location of the old Best Burger, 4210 S. Riverdale Road.

a) PTIF (Public Treasurer's Investment Fund), the most recent yield was 1.61%.

2) Checking consists of one account at Wells Fargo Bank: Accounts Payable

3) Cash Drawers are located at the Civic Center ($600), Comm. Ctr.($300), Senior's ($115), and Police ($500).

4) Receipts for sales tax, property tax, road tax and liquor tax are deposited directly into the PTIF account by the paying

agency of the State of Utah or Weber County.

5) Other receipts are handled through the counter cash drawers mentioned above.

6) All disbursements are paid through the checking accounts at Wells Fargo Bank except petty cash items.

7) Cash flow and all account balances are monitored daily, savings are transferred from the PTIF to the checking account

to cover disbursements as necessary.

8) Check disbursements are normally made weekly through the accounts payable system.

9) A check register report is available for detailed review of each disbursement made by city and RDA funds.

10) Our independent auditors include their review of these accounts in their annual audit report.

18 The City Council Work Session meeting began at 5:32 p.m. Mayor Searle welcomed all in attendance. 19 20 Open Communications: 21 There were no confirmed open communications. 22 23 Presentations and Reports: 24 Mayor Searle stated the Sewer District will be raising their rates by 3 percent in the near future. 25 26 Consent Items: 27 Mayor Searle invited any corrections or comments for the work session and regular meeting minutes for the City 28 Council Meetings held on December 19, 2017. Mayor Searle requested a change to line 85, for the Work Session 29 meeting, to change the word "destruction" to "transportation." 30 31 Discretionary Items: 32 There was a discussion regarding social media and the misinformation circulating regarding the landslide. A. Welcome & Roll Call 32 33 The City Council meeting began at 6:05 p.m. Mayor Searle called the meeting to order and welcomed all in 34 attendance, including all Council Members and all members of the public. 35 36

B. Pledge of Allegiance 37 38 Mayor Searle invited Mike Eggett, the Community Development Director, to lead the Pledge of Allegiance. 39 40

C. Moment of Silence 41 42 Mayor Searle called for a moment of silence and asked everyone to remember our police officers, fire fighters, U.S. 43 Military service members, and members of the City Council as they make decisions this evening. 44 45

D. Open Communications 46 47 Mayor Searle invited any member of the public with questions or concerns to address the Council and asked that they 48 keep their comments to approximately three minutes. 49 50 Louis Donnavon, 4839 South 600 West, Riverdale, discussed transparency regarding the Riverdale landslide. He 51 stated he is one of the impacted residents and wanted to know the action taken by the City. He explained he was told the 52 landslide was located on private property. He discussed the mandatory evacuation from his home. He asked if the water 53 running through the landslide had been tested, if so he wanted the results. He wanted answers and transparency. 54 55 Mike Meehan, stated he owns the farm at the bottom of the landslide. He stated he will do his own separate water 56 test because he didn't feel the City was being transparent about their water testing results. He discussed the increase in 57 water this year versus prior years. He discussed the damage done to his farm as a result of this landslide. He explained in 58 late December he walked the landslide area with a geologist and noted the water coloration and consistency. He stated 59 the geologist who inspected the landslide suggested having yellow tape along the landslide and he wondered why the City 60 had not placed yellow caution tape. He wondered if the landslide continues if it would eventually reach City property. 61 62 Mayor Searle explained the City is very concerned with the landslide and as such is actively testing the water. There 63 was a discussion regarding the work the City has done pertaining to the landslide. Councilmember Arnold explained the 64 City has budgeted $150,000 to allow for additional extensive tests to be performed on the landslide. 65 66

74 Mayor Searle thanked Dave Leahy and Charles Kerkvliet for their work in the Veteran's Memorial wreath placed 75 during the holiday season. 76 77 Mayor Searle discussed the anticipated increase in sewer fees as a result of the Sewer District raising their fees. 78 79

Review of meeting minutes for the City Council Work Session and Regular Meeting minutes held on 82 December 19, 2017. 83 84 Mayor Searle invited any corrections or comments for the City Council Work Session and Regular Meeting minutes 85 held on December 19, 2017. There was a word change requested to the work session minutes on line 85, “destruction” to 86 “transportation”. 87

88 MOTION: Councilmember Mitchell moved to approve the consent items as amended. 89 Councilmember Ellis seconded the motion. There was not any discussion 90 regarding this motion. The motion passed unanimously in favor. 91 92

G. Discretionary Items 93 94 Councilmember Ellis explained he is the president of the Riverdale Lion's Club and on January 26, 2018 there will be 95 a dinner to raise funds for families impacted by the landslide. 96 97 Councilmember Arnold discussed neighborhood safety and discussed various options to increase safety, such as 98 security cameras. He asked City Staff if they would put information about neighborhood safety in the City Newsletter. 99 100 Mayor Searle explained the Utah Department of Transportation (UDOT) made some adjustments to the timing of 101 traffic lights to help mitigate peak hour traffic congestion along 900 West and Riverdale Road. Mayor Searle discussed the 102 option of placing a no left turn sign on 1150 West Riverdale Road. 103 104

Summary of Supporting Facts & Options

This agreement states; all ambulance providers will pay the local paramedic providers for each

paramedic assisted (PMA) call. This is only applicable when the paramedic accompanies a patient to

the hospital on an ambulance transport.

All ambulance providers under this Agreement will make a good faith effort to collect paramedic aboard

fees through their perspective billing company. However; regardless of the success of collecting those

fees, the ambulance provider (Riverdale Fire Department in this case) will pay the previous year’s gross

annual collection rate average.

The formula consists of the Ambulance Transport Provider’s gross annual collection rate percentage

multiplied by the State approved PMA rate of $456.00. This amount will be adjusted annually on July

1st as the State approved PMA rate changes, and as the reported collection rate of each Ambulance

Transport Provider changes

The State Emergency Medical Services Committee has adopted the rate change in accordance to Section

R26-8-3 (3)(d)(iv) Utah Administrative Code. The new rates went into effect on December 1, 2017.

RESOLUTION NO. 2018-01

A RESOLUTION OF RIVERDALE CITY COUNCIL APPROVING AN INTERLOCAL AGREEMENT BETWEEN RIVERDALE CITY AND NUMEROUS OTHER LOCAL JURISDICTIONS CONCERNING

THE PARAMEDIC ABOARD COOPERATION AGREEMENT.

WHEREAS, Utah Code Ann. § 11-13-101 et. sec. permits governmental entities to enter into cooperation agreements with each other; and

WHEREAS, Riverdale City (herein “City”) recognizes the importance of the experience and available services offered from other local jurisdictions and their Emergency Service Departments, that they can provide to Riverdale City; and

WHEREAS, Riverdale City wishes to, and recognizes the importance of, participating in any efforts designed to jointly help each other in times of need and emergency; and

WHEREAS, the Riverdale City Council has fully reviewed the attached Interlocal Agreement between numerous local jurisdictions and Riverdale City concerning the Paramedic Aboard charges, between each other, in times of necessity, need or emergency and agrees to all the terms and conditions contained therein; and

NOW THEREFORE, the Riverdale City Council hereby approves the attached Interlocal Agreement as written and authorizes the Mayor of Riverdale City to execute this Agreement on behalf of the City.

INTERLOCAL COOPERATION AGREEMENT FOR

PARAMEDIC ABOARD CHARGES

This Agreement made and entered into the 1st day of January, 2018 (“Effective Date”)

pursuant to the provisions of the Interlocal Cooperation Act, Section 11-13-101, et. seq., Utah

Code Annotated, 1953 as amended, by and between Ogden City Corporation, a Utah municipal

corporation of the State of Utah (“Ogden City”), Riverdale City Corporation (“Riverdale City”),

Roy City Corporation (“Roy City”), South Ogden City Corporation (“South Ogden City”),

Clinton City Corporation (“Clinton City”), Brigham City Corporation (“Brigham City”), Morgan

County (“Morgan County”), all municipal corporations of the State of Utah, and Weber Fire

District, a Utah Local District (“Weber Fire District”), and North View Fire District, a Utah

Local District (“North View Fire”).

WITNESSETH:

WHEREAS, Ogden City, Roy City, and Weber Fire District furnish and provide

paramedic services to portions of Weber County, in this role hereinafter referred to as

“Paramedic Providers”; and

WHEREAS, Ogden City and Roy City, Riverdale City, South Ogden City, Clinton City,

Brigham City, Morgan County, and Weber Fire District and North View Fire District, are all

providers of various types of ambulance transport services within Weber County, in this role

hereinafter referred to as “Ambulance Transport Providers;” and

WHEREAS, some health insurance providers will only accept and pay claims for

paramedic aboard fees billed directly by the ambulance provider and will not accept a separate

and independent billing for the paramedic aboard fee from a Paramedic Provider; and

WHEREAS, the Paramedic Providers have an agreement with Weber County for the

disposition and use of paramedic fees; and

WHEREAS, the parties are desirous of providing for the reimbursement to the Paramedic

Providers by the Ambulance Transport Providers for paramedic services rendered during

ambulance transport in those instances where the Paramedic Provider is not able to bill

independently for such services.

NOW, THEREFORE, upon the mutual promises and other good and satisfactory

consideration, the parties agree as follows:

1. All charges shall be in accordance with the rate schedule adopted by the State

Emergency Medical Services Committee in accordance with Section R426-8-

2(3)(d)(iv) Utah Administrative Code, as amended from time to time.

2. As outlined in Section 4, an Ambulance Transport Provider shall pay a Paramedic

Provider for each “PMA Call” assisted by the Paramedic Provider, upon a request by

the Paramedic Provider (hereinafter referred to as a “Request for Collection”). The

Ambulance Transport Provider shall collect the allowable charges for such paramedic

services provided in conjunction with their own permitted charges. “PMA Call”

means a paramedic aboard assisted call wherein paramedic(s) of the applicable

Paramedic Provider accompany a patient to the hospital on an ambulance transport,

operated by the applicable Ambulance Transport Provider from the place of

assistance.

3. The applicable Ambulance Transport Provider shall pay the applicable Paramedic

Provider on a monthly basis for all PMA calls assisted by that Paramedic Provider for

which a Request for Collection has been made. Payments shall be for all such PMA

calls rendered after midnight of the first day of the month to midnight of the last day

of the month. The Ambulance Transport Provider shall resolve or dispute any

incidents deemed erroneous as provided by the Paramedic Provider, within thirty (30)

days of when invoice is received. Such disputes or adjustments shall be conveyed to

the Paramedic Provider for prompt resolution. Payment to the applicable Paramedic

Provider shall be made by the applicable Ambulance Transport Provider within

ninety (90) days for which payment is due. If payment is not received within ninety

(90) days for which payment is due, the Ambulance Transport Provider may incur

interest of 1.5% per month past payment due date. The Paramedic Provider shall

provide a monthly report to each Ambulance Transport Provider detailing all PMA

calls of that Ambulance Transport Provider assisted by that Paramedic Provider for

which a Request for Collection has been made, based on actual run reports.

4. Paramedic Fee and Allowable Adjustments.

Pursuant to Section R426-8-2(3)(d)(iv) Utah Administrative Code, as amended from

time to time, all Ambulance Transport Providers within this agreement agree to make

good faith efforts to collect the paramedic aboard fee. Regardless of the collection

amount received by the Ambulance Transport Providers, they agree to make payment

to the Paramedic Providers for the amount calculated by the formula outline below.

The Paramedic Providers agree to accept the calculated amount as full payment for

each billed PMA Call.

The formula consists of the Ambulance Transport Provider’s gross annual collection

rate percentage multiplied by the State approved PMA rate of $456.00. This amount

will be adjusted annually on July 1st as the State approved PMA rate changes, and as

the reported collection rate of each Ambulance Transport Provider changes (see

Section 13).

5. Term. The term of this Agreement will begin on the effective date and shall continue

to be in force for a period of five (5) years, unless terminated as provided herein.

Any party may terminate its obligations hereunder by giving thirty (30) days advance

written notice to the other parties. Such termination shall not modify the Agreement

as between any of the remaining parties, except only to exclude the terminating party

from the obligations created herein. Should this agreement be terminated by any

party, the Ambulance Transport Provider acknowledges and agrees to stop billing the

ALS rate when transporting with that Paramedic Provider. The Paramedic Provider

also acknowledges and agrees to be responsible for collecting the paramedic aboard

fee when transporting with that Ambulance Transport Provider.

6. Administrative Entity. It is the intent and understanding of all parties that no new

entity is created by this Agreement. This Agreement shall be administered by the

parties and each party shall appoint a representative to facilitate performance of this

Agreement.

7. Independent Contractors. In the performance of this Agreement, the parties are

independent contractors, and as such shall have no authorization, expressed or

implied, to bind any other party to any agreements, settlements, liability, or

understanding whatsoever, and agree not to perform any such acts as agent for any

other party except as expressly set forth herein.

8. Hold Harmless. Each party shall indemnify, defend, and hold the other parties, their

officers, agents, and employees harmless from any and all claims, demands,

liabilities, costs, expenses, penalties, damages, losses, and liens, including, without

limitation, reasonable attorney’s fees, arising out of or any way related to any act,

omission or event occurring as a consequence of performing under this Agreement;

provided, however, that each party shall be responsible for its own negligent acts and

agrees to indemnify and hold the other parties harmless therefrom.

9. Governmental Immunity. All parties to this agreement are governmental entities as

defined in the Utah Governmental Immunity Act found in Title 63G Chapter 7 of the

Utah Code. Nothing in this agreement shall be construed as a waiver by any party of

any rights, limits, protections or defenses provided by the Act. Nor shall this

agreement be construed, with respect to third parties, as a waiver of any governmental

immunity to which a party to this agreement is otherwise entitled. Subject to the Act,

each party will be responsible for its own actions and will defend any lawsuit brought

against it and pay any damages awarded against it.

10. Manner of Financing. This Agreement and the matters contemplated herein shall not

receive separate financing, nor shall a separate budget be required. Each party shall

be responsible for its own obligations under this Agreement, and shall be responsible

for any costs incurred as a result thereof.

11. Filing of Agreement. A copy of this Agreement shall be placed on file in the Office

of the Recorder of any participating Agency or maintained with the parties’ other

official records, and shall remain on file for public inspection during the term of this

Agreement.

12. Governing Law, Jurisdiction and Venue. This Agreement is made and entered into

subject to the provisions of the laws of the State of Utah, which laws shall control the

enforcement of this Agreement. The parties also recognize that certain Federal laws

may be applicable. In the event of any conflict between this Agreement and the

applicable State or Federal law, the State or Federal law shall control.

13. Review and Rate Reporting. The parties, through their appointed representatives,

shall meet annually to review this Agreement, the collection rate of each individual

Ambulance Transport Provider, and to discuss any matters or issues that may arise

under this Agreement. “Gross Collection Rate” is referred to as the providers’ Gross

Receipts divided by Gross Charges. This will be the rate used to calculate PMA

charges for that Ambulance Transport Provider starting in July of the current year.

The collection rate reported by each Ambulance Transport Provider shall be their

Gross Collection Rate from the previous calendar year.

14. Compliance with Laws. In connection with their activities under this Agreement, the

parties shall comply with all applicable federal, state and local laws and regulations.

15. Property. No real or personal property shall be acquired, nor improvements

constructed by the parties as a result of this Agreement.

16. General Provisions.

A. Severability. In the event that any condition, covenant, or other provision

herein contained is held to be invalid or void by any court of competent

jurisdiction, the same shall be deemed severable from the remainder of this

Agreement and shall in no way affect any other covenant or condition herein

contained. If such condition, covenant, or other provision shall be deemed

invalid due to its scope or breadth, such provision shall be deemed valid to the

extent of the scope or breadth permitted by law.

B. Entire Agreement. This Agreement contains the entire agreement between the

parties. No promise, representation, warranty, or covenant not included in this

Agreement has been or is relied upon by the parties. All prior understandings,

negotiations, or agreements are merged herein and superseded hereby.

C. Amendments. This Agreement may be modified only by a written amendment

signed by each of the parties hereto.

D. Not Assignable. This Agreement is specific to the parties hereto and is

therefore not assignable.

E. Counterparts. This Agreement may be executed in two or more counterparts,

each of which shall be deemed an original, but all of which shall constitute

one and the same instrument.

F. No Partnership, Joint Venture, or Third Party Rights. Nothing in this

Agreement shall be construed as creating any partnership, joint venture, or

business arrangement among the parties hereto, nor any rights or benefits to

third parties.

17. Resolution by Governing Bodies. This Interlocal Agreement shall become effective

immediately upon (1) the execution of, or an appropriate resolution approving, this

Agreement by the applicable commission, board, council or body or officer of each

entity vested with executive power of the entity; (2) approval as to form by the

authorized attorney for each entity; and, (3) the filing of the executed Agreement with

the keeper of records for each participating entity. Upon becoming effective, this

Agreement negates, nullifies, supplants and/or replaces the previous Interlocal

Agreement entered into by the parties, dated January 1, 2018.

R426-8-1. Authority and Purpose.

(1) This rule is established under Title 26, Chapter 8a.

(2) The purpose of this rule is to provide for the establishment of maximum ambulance

transportation and rates to be charged by licensed ground ambulance providers in the State of

Utah.

R426-8-2. Ground Ambulance Transportation Revenues, Rates, and Charges.

(1) Licensed ground ambulance providers operating under R426-3 shall not charge more than

the rates described in this rule. In addition, the net income of licensed ground ambulance

providers, including subsidies of any type, shall not exceed ten percent of gross revenue.

(a) Licensed ground ambulance providers may change rates at their discretion after notifying

the Department, provided that the rates do not exceed the maximums specified in this rule.

(b) A licensed ground ambulance provider may not charge a transportation fee for patients

who are not transported.

(2) The initial regulated rates established in this rule shall be adjusted annually on July 1,

based on financial data as delineated by the Department to be submitted as detailed under R426-

8-2(10). This data shall then be used as the basis for the annual rate adjustment.

(3) Base Rates for ground transport of a patient to a hospital or patient receiving facility are as

follows:

(a) Ground Ambulance - $746.00 per transport;

(b) Advanced EMT Ground Ambulance - $984.00 per transport;

(c) Advanced EMT Ground Ambulance who was prior to June 30, 2016 licensed as an EMT-

IA provider - $1,212.00 per transport;

(d) Paramedic Ground Ambulance - $1,440.00 per transport;

(e) Ground Ambulance with Paramedic on-board - $1,440.00 per transport if:

(i) a designated Emergency Medical Service dispatch center dispatches a licensed paramedic

provider to treat the individual;

(ii) the licensed paramedic provider has initiated advanced life support;

(iii) on-line medical control directs that a paramedic remain with the patient during transport;

and

(iv) a licensed ground ambulance provider who interfaces with a licensed paramedic rescue

service and has an inter-local or equivalent agreement in place, dealing with reimbursing the

paramedic ground ambulance licensed provider for services provided up to a maximum of

$456.00 per transport.

(4) Mileage rates may be charged at a rate of $31.65 per mile or fraction thereof, and

computed from the point of patient pick-up to the point of patient delivery. Fuel fluctuation

surcharges of $0.25 per mile may be added when diesel fuel prices exceed $5.10 per gallon, or

gasoline prices exceed $4.25 per gallon as invoiced.

(5) A surcharge of $1.50 per mile may be assessed if an ambulance is required to travel ten or

more miles on unpaved roads.

(6) If more than one patient is transported from the same point of origin to the same point of

delivery in the same ambulance, the charges to be assessed to each individual will be determined

as follows:

(a) Each patient will be assessed the transportation rate;

(b) The mileage rate will be computed as specified, the sum to be divided equally between the

total number of patients.

(7) A round trip may be billed as two one-way trips. A licensed ground ambulance provider

shall provide 15 minutes of time at no charge at both point of pickup and point of delivery, and

may charge $22.05 per quarter hour or fraction thereof thereafter. On round trips, 30 minutes at

no charge will be allowed from the time the ambulance reaches the point of delivery until

starting the return trip. At the expiration of the 30 minutes, the ambulance service may charge

$22.05 per quarter hour or fraction thereof thereafter.

(8) A licensed ground ambulance provider may charge for supplies, providing supplies,

medications, and administering medications on a response if:

(a) supplies shall be priced fairly and competitively with similar products in the local area;

(b) the individual does not refuse services; and

(c) the licensed ground ambulance personnel assess or treats the individual.

(9) In the event of a temporary escalation of costs, a licensed ground ambulance provider may

petition the Department for permission to make a temporary service-specific surcharge. The

petition shall specify the amount of the proposed surcharge, the reason for the surcharge, and

provide sufficient financial data to clearly demonstrate the need for the proposed surcharge.

Since this is intended to only provide temporary relief, the petition shall also include a

recommended time limit. The Department will make a final decision on the proposed surcharge

within 30 days of receipt of the petition.

(10) The licensed ground ambulance provider shall file with the Department within 90 days of

the end of each licensed provider's fiscal year, an operating report in accordance with the

instructions, guidelines and review criteria as specified by the Department. The Department shall

provide a summary of operating reports received during the previous state fiscal year to the EMS

Committee in the October quarterly meeting.

(11) The Department shall review licensed ground ambulance provider fiscal reports for

compliance to Department established standards. The Department may perform financial audits

as part of the review. If the Department determines that a licensed ground ambulance provider is

not in compliance with this rule, the Department shall proceed in accordance with Utah Code

Title 26-8a-504.

(12) All licensed ground ambulance providers shall submit a written total number of patient

transports for each calendar year to the Department for calculating Medicaid assessments.

(a) A written patient transport number shall be submitted within 90 days after the end of the

calendar year.

(b) The submission shall include a written justification when patient transport numbers are not

in agreement with patient care reports submitted to the Department as described in R426-7.

Written justifications shall include a description of data reporting errors, and a plan to correct

future data submission.

(c) The Department shall use submitted patient transport numbers to calculate ambulance

service providers assessments as described in Utah Code Title 26-37a-104(5).

(d) Submitted patient transport numbers and justifications for patient transport numbers not in

agreement with patient care report data may be evaluated, corrected, or audited by the

Department. If the Department determines that a licensed ground ambulance provider is not in

compliance with this rule, the Department may proceed in accordance with Utah Code Title 26-

8a-504.
