Employers and potential employees need to take note of a change in the qualifying period required for unfair dismissal laws to apply. New unfair dismissal laws, which mean employees cannot qualify for the right until completing two years service, come into effect on 6 April 2012. However, the new regulations will not be applied retrospectively, so employees starting work before 6 April 2012 will continue to be able to claim unfair dismissal after only one year's service. This could mean employers delaying

recruiting new employees until after 6 April.

Shaun Underhill, a Partner at Winchester-based solicitors Shentons, says, “The extended qualifying period has been brought in to kick-start the UK’s employment markets in the hope that it will lift the red tape burden faced by employers.”

Announcing the doubling of the qualifying period in October, Business Secretary Vince Cable said that businesses have told the government that unfair dismissal rules are a major barrier to taking on more people.

With all the signs indicating an early spring, it is likely that honey bees will begin swarming as early as April this year. Typically one expects to see this reproductive activity in May and June, but the warm weather might well have encouraged colonies to build up quicker than usual to the point where they feel compelled to swarm.

When a colony of honey bees feels the urge to swarm, there is little that can be done to stop it from a beekeeper’s perspective except for subdividing the colony and re-housing it, or giving it more room to expand. In its natural state a bee colony will itself subdivide with around half the bees, including the queen, heading off to find a new home in which it can properly establish itself before the forthcoming winter. Typically the first you may see of it is a large swirling mass of bees that come to rest on your house or on a bush in your garden, forming a dense mass about the size of a football.

Having settled, scout bees investigate further the new home they have in mind, returning to the colony and performing a dance to let their sisters know where to move next. This can take several hours or longer, but when it happens, the colony takes off en masse and settles at the entrance of the new squat. Hopefully it is in a hollow tree or similar place where they can neither come to harm nor cause offence.

Should a bee swarm take up residence in your chimney, roof, or in the wall of your house, where it is less accessible to a beekeeper or pest controller, it is important to act immediately and phone your local beekeeping society swarm liaison officer- most pest controllers will refer you in his direction in any case- and ask for someone to deal with the problem. The sooner you act the more likely are the chances of the bees being persuaded to leave. After the first 24 hours it seems little will shift them. Ideally you will have reported the swarm and had it removed before this happens. If you have left it rather late, removal may present an expensive alternative, and some people who are sadly less kindly disposed to honey bees may seek their destruction.

The law is clear on this. It is incumbent on pest controllers to prevent other bees from gaining access to the treated nest. The requirement to “take every reasonable action to prevent foraging honey bees from gaining access to the treated nest, by removing the combs or blocking the nest entrances” still applies, even though this phrase may not be on the label of the product (insecticide) concerned. This requirement is implicit in the Food and Environment Protection Act 1985 with reference to non-target species and is of particular importance in this situation given the likelihood of neighbouring bee colonies robbing the treated nest.

In practice bee proofing is usually difficult and there is always the risk of other bees gaining entry and proven negligence can lead to a very heavy fine

Making a Will is not always something that we like to think about but making a Will allows you to leave your estate to your loved ones and friends in the proportions that you wish rather than leaving it all up to the laws of Intestacy. You will need to choose your executors and perhaps you may need an independent third party to act as your executor if certain family members do not always get on with each other.

If you have children under the age of eighteen then you should think about making a Will so that you can appoint a Guardian for them, however you can only do this if you have Parental Responsibility for your child or children.

If there are children from a previous marriage or relationship then it is even more important to have a Will that clearly states your wishes. Even if you both make mirror Wills that provide for a child or children of a previous marriage or relationship the surviving spouse or partner is nearly always free to change their Will. We can offer advice on the creation of life interests or discretionary trusts over part or all of the assets which you own to provide for your surviving spouse or partner but also protect the capital for your child or children on your spouse or partner’s death. All too often there are cases of disagreement between step families where the survivor has gone on to change their Will or indeed remarry. There are difficulties with enforcing mutual Wills which seek to stop the surviving spouse or partner from changing their Will in the future and a solicitor would usually advise creating an express trust in your Will rather than relying on any mutual Wills.

Inheritance tax implications are also a main point to discuss. Is your estate getting near the tax free limit of £325,000? A solicitor can advise you on the pros and cons of either transferring your nil rate band (if you are married or in a civil partnership) or alternatively setting up a nil rate band discretionary trust on the first death. With effect from 9th October 2007 a claim can be made on the death of a surviving spouse/civil partner for the transfer of any unused nil-rate band of a pre-deceased spouse/civil partner. For civil partners, the death of the pre-deceased civil partner must necessarily have occurred after 5th December

2005 as it was not possible to enter into a civil partnership before this date. Foreign partnerships which pre-existed the Civil Partnership Act 2004, are deemed to have come into existence on 5th December 2005 for the purposes of English Law.

When you talk to a solicitor about making a Will you can ask about how the probate process works. For example if executors need to claim a transferable nil-rate band on death of the surviving spouse/civil partner this must be done within twenty-four months after the end of the month in which the deceased second spouse/civil partner died, although this time limit can be extended at HMRC’s discretion.

You may also need to consider making a Lasting Power of Attorney. From the 1st October 2007 it was no longer possible to make Enduring Powers of Attorney. If you have an Enduring Powers of Attorney created before the 1st October 2007 it is still valid and capable of registration. The new Lasting Powers of Attorney attempts to reduce the risk of abuse by including a number of safeguards. The decisions which an attorney can be authorised to make have also been increased by the Mental Capacity Act 2005 and these now extend to decisions about a donor’s healthcare and medical treatment as well as financial affairs. There are two types of LPAs to cover these decisions the first being a Property and Affairs LPA and the second being a Personal Welfare LPA.

Returning by popular demand to The Lights Theatre in Andover on 19th April will be CHIHO SUNAMOTO and JON SMITH, two talented musicians from very different parts of the world.

Skyline Gold, based in Hedge End is one of the “third tier” of UK radio stations licenced by Ofcom. It launched in January 2006 as Skyline Community Radio. The station broadcasts from studios based in The Old School House, St John’s Road locally on 102.5FM primarily to the villages of Hedge End, West End and Botley, although it can be received in other parts of the Borough of Eastleigh and a few areas outside of the borough, and via the internet on www. skylinegold.co.uk. The transmitter is located by the golfing range in Hedge End next to the M27.

Skyline Gold is run entirely by volunteers. Nobody is paid. Unlike many community radio stations it receives no money or grants from the taxpayer and is entirely funded by its volunteers and advertisers. The station is proud to provide such a service free of any charge to the general public, particularly in these difficult times.

Ofcom granted a new five year licence in 2011 and also allowed the station to enforce its oldies format of playing mainly 50s-80s era music weekdays between 8.00am and 7.00pm, and to change its name to Skyline Gold.

In its short existence Skyline Gold has directly, through publicity, found apprenticeships for over thirty young

people (Carillion Construction Training), and helped raise thousands of pounds for charity, through publicising charitable events, including the regular charity soul events held at the Concorde Club in Eastleigh hosted by disc jockey Paul Mico.

Specialist shows such as those specialising in big band music, country music, rock, rock ‘n’ roll, etc., continue to be aired during weekends and evenings and are presented by broadcasters with many years experience in radio work and having a vast knowledge of their particular specialist area of music.

The Skyline Gold website, www.skylinegold.co.uk, shows the programme schedule, pen pictures of the presenters, and also features a forum and a section detailing local news and forth-coming events.

Since the last issue of the Romsey & Wellow Gazette I have had several calls from local residents all keen to speak their minds about Tesco’s proposed plan to develop on the Broadlands estate in Romsey and other issues after reading Inspired Community’s article about the Future of Romsey (we’re pleased to say we’re working with Tracey who runs the Andover and Test Valley Gazette and works with the Romsey & Wellow Gazette team, all of which will feature a range of articles from Inspired Community in their printed editions each month).

It seems the issue of a having a Tesco’s superstore on the doorstep is a divisive issue. Some callers voiced strong opposition, while others have said that the proposed development would be a good thing for Romsey.

One gentleman who has been a resident of Romsey for 18 years said that he thinks Romsey should welcome the Tesco plans. He believes it will offer much more convenience and a wider range of goods, like white goods, sports equipment and clothing, DVDs, children’s clothing and more, than you can get in Romsey right now, and at an affordable price. He points to the potential of 200 new jobs for residents, which he says the town needs.

Another lady, who declined to be named, said “Bring it on. Having a Tesco on the doorstep will be a good thing for ordinary working class

people. We’re fed up of having to travel to get to shops outside of our community. Waitrose is far too expensive, and while Aldi is cheap there is not a wide enough range to get everything we need. We need something like a Tesco to meet all our needs. But it will also help with parking as it will be free and we can then walk into Romsey, where parking right now is so limited.”

Could Romsey Attract Better Shops?

When asked whether a Tesco would then make it even harder for Romsey to build on its character and increase the number of independent shops, the gentleman said he believes that Romsey won’t attract those kinds of shops even without a Tesco here.

We’ve talked to former resident, Nadine O’Connor, who has different views and believes if Romsey were to market itself better and address a few underlying issues, such as business rates, that the town could indeed attract a wider range of interesting shops to help the town thrive – have a read of her interesting blog about Tesco’s plans on her website http://www.nadineoconnor.org/.

Our gentleman also suggested that perhaps there were reasons other than supermarket competition and business rates for why the independent businesses mentioned in the original article went out of business. He said Angies was a long time ago and in a poor location, but we still have a “smashing florists” Judy Webb in town, while Stares butchers was not as bright and welcoming as the remaining butchers B. Drummond.

Whitenap development, has prompted Tesco’s latest move. Commenting on the Whitenap development site, another gentleman, who moved to Romsey at the age of four in 1943, pointing out six hectares of the site is designated for industrial use. He said that while he has a vested interest in the development as some of his land may be used, as a local resident, “it is madness and it will not be an attractive entrance into Romsey”.

On a more positive note, he also said he has fond memories of seeing Princess Margaret during her visits to stay at Broadlands walking along Highwood Lane. We may see more royals walking around Romsey soon if the totally unsubstantiated rumours we heard via Twitter about the Duke and Duchess possibly becoming new owners are true… But don’t hold me to that!

Finally, we have an apology to make to Debbie Babidge, the owner of the Courtyard Coffee House on The Hundred, which is not closed as we had stated, but indeed very much open for business. Going out together and spending time as a family is an ideal way to build physical activity and fitness into your lifestyle when time is short because work, school and home life occupy most of your waking hours! The health and fitness of the family doesn’t become a priority or even something that many people think about. Relaxation and leisure time is usually filled with television, cinema, restaurants or other non-active past-times and they’re often done separately, as opposed to being family activities.

However, it’s not difficult for a family to slot in some time, either at the weekend or in the long summer evenings, to start being active and to spend quality family time together. Making a plan to take up an activity to try and get fit as a family, while spending time together, helps parents to bond with their children and couples to benefit from doing something together instead of everyone sitting in front of the television not talking to each other.

Just being out in the fresh air is beneficial to everyone and it’s something you can do regardless of age, weight or poor health. Certainly, it can be an effort to get up from the sofa and get out, but the feeling of well-being afterwards is wonderful. Not everyone in the family is going to want to leave the television or video games, so it’s a good idea to have a family meeting and agree that everyone will commit to an hour or two out of the day or weekend to spend time outdoors doing something physically active. There are lots of options for all budgets – walking costs nothing, swimming, biking and tennis are cheaper than the cinema or eating out in restaurants.

Even on rainy days, there are many family activities that can be carried out, such as badminton, swimming, martial arts classes, aerobics and yoga classes. If getting out is really difficult or even impossible, for example, with very young babies, then family time indoors or in the garden is just as good. Choose from

control can be a mind boggling experience for many people!

Having made an impressive television, the manufacturers want to provide you with an equally impressive remote control with lots of buttons that are much too small for the human finger. Do we really need all those buttons? And even if you work out what they are supposed to do actually pressing the correct button and not several at the same time can be very difficult.

There are lots of mystery buttons that don’t seem to have a purpose in life and when I’m bored I can’t resist pressing them just to see what they do. Suddenly the picture disappears half way through my wife’s favourite series or a number comes up on the screen that just won’t go away whatever button you press. And why does the manual always disappear when you really need it? Most people only ever press a few of the buttons anyway, so perhaps there should be a separate section marked, “for techno boffins only”

The poor old remote gets dropped, sat on and wedged down the back of the settee and often disappears when I really need it, and I often I miss the start of a programme because I can’t find the it! After a long search around the house I often find it in another room or my wife has put in on top of the TV, not much point in that as I need it alongside my armchair.

more complicated than using the remote. Then the batteries seem to die at the worst possible time, I was in bed and just about the fall asleep recently so I reached out for the remote to turn the TV off, no amount of pressing would turn it off so I had to get up to change the batteries and after that I couldn’t get back to sleep.

Then there is the clutter of remote controls, I picked up one to turn the TV off once but no amount of pressing would turn it off and after changing the batteries I realised that I was using the wrong one!

Method -Heat the olive oil in a pan and fry the onions gently for 10 minutes or so until softened and starting to brown. Set aside. Next, on a lightly floured surface, roll out your puff pastry into a 26cm circle using a standard round dinner plate as a template. Cut around the dinner plate and dis-guard the trimmings. Place on baking tray covered with parchment. Score a circle around the edge of the pastry with a knife to make a 2cm border. Now carefully spread the cooked onions inside the scored circle. Brush a little milk along the exposed border of the pastry. Bake for 10 minutes at 220˚C (200˚C fan)/Gas Mark 7 and remove from the oven. Meanwhile, bring a pan of salted water to the boil and blanch the purple sprouting for 1 minute,

then drain and rinse under cold water. Leave to drain completely in a colander. Arrange the sprouting spears over the onions. Mix the yoghurt and beaten eggs together and season with the salt and pepper, then pour over the top of the tart. Scatter the feta cheese over. Reduce the oven temperature to 200˚C (180˚C fan)/Gas Mark 6 and bake the tart for 10 minutes. Then s p r i n k l e t h e sesame seeds on top and bake for a further 10 minutes.

Baroness Tyler, The Head of Relate recently stated in the Times newspaper that couples in their forties should undergo a relationship MOT in order to prevent their marriage falling apart as the strain of midlife takes its toll. She particularly highlighted couples who lead parallel lives spending what little free time they have doing their own thing.

Statistics are showing that divorce rates have surprisingly been falling since 2002 but figures published in December 2011 show a rise of 4.9% overall with the sharpest rise amongst the 40-45 age group.

So where do couples get to in their relationship when one or other partner gets to this age? When we take time to reflect on partnerships and life it is probably no wonder that this age group struggle. Individuals within a relationship have gone through setting up home, having a child or children, perhaps struggled to build up a business or career, changed jobs and even relocated and moved home at least once if not more. They have perhaps soldiered on through life events like redundancies, illnesses and bereavements. There has possibly been no time to pause and just talk together about how many of these life events might have impacted on them. Instead there have possibly been demands from immediate family and others for help and support. Even couples who believe that they have a strong relationship

can become so busy that they take their eye of each other whilst they attend to everyone and everything else; UNTIL THE CRACKS START TO APPEAR….. And often one or other might react in confusion, question what is happening, perhaps blame the other. Usually there is no space or time to take a step back to reflect on where the years have gone and what has happened to the other person in the relationship and most importantly why this has happened.

As Baroness Tyler observed – We take time for “health checks, dental check-up and even put our cars through MOTs”. And yet most people do not invest time in their emotional lives and in particular in their relationship. We meet the person we love, and with all our hopes and dreams, commit to marriage or a partnership but then somehow think that things will just work. It seems that often there is a feeling that people within a relationship have changed and therefore the inevitable answer is to part, begin a new relationship etc.

Perhaps a little time spent within a couple counselling session could help if you feel that your relationship might have got into a rut and communication has broken down or if either or both of you just feel plain lonely within the relationship. The start might be to book an assessment with a couple counsellor to talk over how each of you might be feeling. Try not to wait until the relationship has reached a crisis point when things might be said and done which makes going back painful and difficult. Perhaps you might like to call to make an appointment for both of you. Wings is also running a workshop on four Tuesday evenings commencing in May.
